			</subsection></section><section commented="no" display-inline="no-display-inline" id="H7B944001B8FA412384F8517B5678B14C" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H1A55694F48614661AB451CC3EA455581"><enum>(1)</enum><text display-inline="yes-display-inline">Older people have the highest rate of

			 suicide of any population in the United States, and the suicide rate of that

			 population increases with age, with individuals 65 and older accounting for 20

			 percent of all suicide deaths in the United States, while comprising only 13

			 percent of the population of the United States.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC57A3BDFBF24565B2C03B1BC02EB000"><enum>(2)</enum><text display-inline="yes-display-inline">Disability due to mental illness in

			 individuals over 65 years old will become a major public health problem in the

			 near future because of demographic changes. In particular, anxiety, dementia,

			 depression, schizophrenia, among other conditions, will all present special

			 problems for this age group.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDBF2543B1AD045579B16A890E8E5ECD3"><enum>(3)</enum><text display-inline="yes-display-inline">Major depression is strikingly prevalent

			 among older people, with between 8 and 20 percent of older people in community

			 studies and up to 37 percent of those seen in primary care settings

			 experiencing symptoms of depression.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE36B2D8A00874BC5B2F1AEF88562B2D6"><enum>(4)</enum><text display-inline="yes-display-inline">Anxiety disorders rival depression in their

			 prevalence among older people with a rate of 11.4 percent in persons aged 55

			 and older.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAEA875669152412D96EA1900F353E5E4"><enum>(5)</enum><text display-inline="yes-display-inline">Almost 20 percent of the population of

			 individuals age 55 and older, experience specific mental disorders that are not

			 part of normal aging.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1819E9790BF48B4A9D69F4E994D00AB"><enum>(6)</enum><text display-inline="yes-display-inline">Unrecognized and untreated depression,

			 Alzheimer’s disease, anxiety, late-life schizophrenia, and other mental

			 conditions can be severely impairing and may even be fatal.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB23160023E794F7C8EB72B6EDB1C004E"><enum>(7)</enum><text display-inline="yes-display-inline">Substance abuse, particularly the abuse of

			 alcohol and prescription drugs, among adults 65 and older is one of the fastest

			 growing health problems in the United States, with 17 percent of this age group

			 suffering from addiction or substance abuse. While addiction often goes

			 undetected and untreated among older adults, aging and disability makes the

			 body more vulnerable to the effects of alcohol and drugs, further exacerbating

			 other age-related health problems. Medicare coverage for addiction treatment of

			 the elderly needs to recognize these special vulnerabilities.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43094BFDC4A14BEDAC514E8E82C7891E"><enum>(8)</enum><text display-inline="yes-display-inline">The disabled are another population

			 receiving inadequate mental health care through medicare. According to the

			 Centers for Medicare &amp; Medicaid Services, medicare is the primary health

			 care coverage for the 5,000,000 nonelderly, disabled people on Social Security

			 Disability Insurance. Up to 40 percent of these individuals have a diagnosis of

			 mental illness.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H846512CEC1654B06A4F9DDA55174A46D"><enum>(9)</enum><text display-inline="yes-display-inline">The current medicare benefit structure

			 discriminates against the millions of Americans who suffer from mental illness

			 and maintains an outdated bias toward institutionally based service delivery.

			 According to the report of the Surgeon General on mental health for 1999,

			 intensive outpatient services, such as psychiatric rehabilitation and assertive

			 community treatment, represent state-of-the-art mental health services. These

			 evidence-based community support services help people with psychiatric

			 disabilities improve their ability to function in the community and reduce

			 hospitalization rates by 30 to 60 percent, even for people with the most severe

			 mental illnesses.</text>

			</paragraph></section><title commented="no" id="HCF74912CAE554C90B8762E581853EF48" style="OLC"><enum>I</enum><header>Establishing parity for mental health

			 services</header>

			<section commented="no" display-inline="no-display-inline" id="H9007907A802F40B9AE8D836D57E00082" section-type="subsequent-section"><enum>101.</enum><header>Elimination of

			 lifetime limit on inpatient mental health services</header>

				<subsection commented="no" display-inline="no-display-inline" id="HE1FA3B273F18498299F1CFB1C4834739"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1812 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395d)

			 is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="HE62868326A2D43BAA71E7B74A542A117"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="H9D5DA92302DC4BAB8CE4C7A5A6ABE6FB"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding

			 <quote>or</quote> at the end;</text>

			 1395<italic>l</italic>) is amended by striking subsection (c).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H898E02EE82684BE8A25BE2A289BC5488"><enum>(b)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendment made by

			 subsection (a) shall apply to items and services furnished on or after January

				</subsection></section></title><title commented="no" id="H7AAC79F0AB1748BDA611404FB600DF5" style="OLC"><enum>II</enum><header>Expanding coverage of community-based mental

			 health services</header>

			<section commented="no" display-inline="no-display-inline" id="H4FE8B957C2744B83A591C65BDC167D59" section-type="subsequent-section"><enum>201.</enum><header>Coverage of

			 intensive residential services</header>

				<subsection commented="no" display-inline="no-display-inline" id="HB668B9590A5549D7A561D6AF092D9F4F"><enum>(a)</enum><header>Coverage under

			 part A</header><text display-inline="yes-display-inline">Section 1812(a) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395d(a)) is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H5C71093840CA4D2BA14F772D6FE2D96F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking

			 <quote>and</quote> at the end;</text>

				in section 1861(bbb)) furnished to an individual for up to 120 days during any

				calendar year, except that such services may be furnished to the individual for

				additional days (not to exceed 20 days) during the year if necessary for the

				individual to complete a course of

				treatment.</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9DEB44B040504F0F804B173DED16818C"><enum>(b)</enum><header>Services

			 described</header><text display-inline="yes-display-inline">Section 1861 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x)

			 is amended by adding at the end the following new subsection:</text>

					<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="HC7B28E2E45CD45FDB7FD84ED2BE8B21D" other-style="archaic" style="other"><subsection commented="no" display-inline="no-display-inline" id="H3DEBC813A1CB4523A50000425014F55E"><enum>(bbb)</enum><header>Intensive residential

		  services</header><paragraph commented="no" display-inline="yes-display-inline" id="H538F06262CAE4F8F8632B2AF836D08C7"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraphs (3) and (4), the term

				<term>intensive residential services</term> means a program of residential

				services (described in paragraph (2)) that is—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H2B2805BAB35B41389D63EAB90FE0022" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">prescribed by a physician for an individual

				entitled to, or enrolled for, benefits under part A who is under the care of

				the physician; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6EC0E0E6DFB54B08A8AA6FB573267036" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">furnished under the supervision of a

				physician pursuant to an individualized, written plan of treatment established

				and periodically reviewed by a physician (in consultation with appropriate

				staff participating in such services), which plan sets forth—</text>

									<clause commented="no" display-inline="no-display-inline" id="H06D427887A2D4972A5E31338D3B8EE5"><enum>(i)</enum><text display-inline="yes-display-inline">the individual’s diagnosis,</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H222283A2D8C44962A0DFCAC1F079F446"><enum>(ii)</enum><text display-inline="yes-display-inline">the type, amount, frequency, and duration

				of the items and services provided under the plan, and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="HFBA1951B74F448D7ACD41D5D1C868E02"><enum>(iii)</enum><text display-inline="yes-display-inline">the goals for treatment under the

				plan.</text>

									</clause></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">In the case of such an individual who

				is receiving qualified psychologist services (as defined in subsection (ii)),

				the individual may be under the care of the clinical psychologist with respect

				to such services under this subsection to the extent permitted under State

				law.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5F7B3B915CD4342A0CEFE6F439B734" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The program of residential services

				described in this paragraph is a nonhospital-based community residential

				program that furnishes acute mental health services or substance abuse

				services, or both, on a 24-hour basis. Such services shall include treatment

				planning and development, medication management, case management, crisis

				intervention, individual therapy, group therapy, and detoxification services.

				Such services shall be furnished in any of the following facilities:</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="HAE41B93B69C047D9A45B3806EF30DDF4"><enum>(A)</enum><text display-inline="yes-display-inline">Crisis residential programs or mental

				illness residential treatment programs.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3AFADB53AB5A45CFAB859418B8C998CD"><enum>(B)</enum><text display-inline="yes-display-inline">Therapeutic family or group treatment

				homes.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C3F63DA8CBD422CAFB9E562D9D1976E"><enum>(C)</enum><text display-inline="yes-display-inline">Residential detoxification centers.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H004225A755704C1DBAC4CA4F09E5C7B1"><enum>(D)</enum><text display-inline="yes-display-inline">Residential centers for substance abuse

				treatment.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9F1867E05764DD2B57BBDCEE56D4390" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No service may be treated as an intensive

				residential service under paragraph (1) unless the facility at which the

				service is provided—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H95359A66061B41809918CE55BC2C774"><enum>(A)</enum><text display-inline="yes-display-inline">is legally authorized to provide such

				service under the law of the State (or under a State regulatory mechanism

				provided by State law) in which the facility is located or meets such

				certification requirements that the Secretary may impose; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98DB362BE23B462D9D5B2814E930E2A9"><enum>(B)</enum><text display-inline="yes-display-inline">meets such other requirements as the

				Secretary may impose to assure the quality of the intensive residential

				services provided.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD413E6F653A746B2B7BB8D3CEC7EA86F" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">No service may be treated as an intensive

				residential service under paragraph (1) unless the service is furnished in

				accordance with standards established by the Secretary for the management of

				such

				services.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HACD19AE88F0C43B79BC8FF925CAF6029"><enum>(c)</enum><header>Amount of

			 payment</header><text display-inline="yes-display-inline">Section 1814 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395f)

			 is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H4EC4CB4AEE2545158D7E26EEAB8599DB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), in the matter preceding

			 paragraph (1), by inserting <quote>other than intensive residential

			 services,</quote> after <quote>hospice care,</quote>; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7AF34FA1E4C48F2A35E83A304560083"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 subsection:</text>

						<quoted-block display-inline="no-display-inline" id="HBDC3D836706F4FD193448E5B73316935" other-style="archaic" style="other">

							<subsection commented="no" display-inline="no-display-inline" id="H7ED620F0CEB948D5AF0379B926FE79B6"><enum>(m)</enum><header>Payment for intensive residential

		  services</header><paragraph commented="no" display-inline="yes-display-inline" id="H2722608F2A2D47F4A7A28337EDAB5FF9"><enum>(1)</enum><text display-inline="yes-display-inline">The amount of payment under this part for

				intensive residential services under section 1812(a)(6) shall be equal to an

				amount specified under a prospective payment system established by the

				Secretary, taking into account the prospective payment system established for

				psychiatric hospitals pursuant to section 124 of the Medicare, Medicaid, and

				SCHIP Balanced Budget Refinement Act of 1999 (113 Stat. 1501A–332), as enacted

				into law by section 1000(a)(6) of Public Law 106–113.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H93AAFA51E2CE4A4D81BA1900329BFF76" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Prior to the date on which the Secretary

				implements the prospective payment system established under paragraph (1), the

				amount of payment under this part for such intensive residential services is

				the reasonable costs of providing such

				services.</text>

								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H65EBB2FD40D24F71AC3F99F22FAD783B"><enum>(d)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section shall apply to items and services furnished on or after January 1,

			 2006.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HF55CC3412C1F4897879E30703B75EBB2" section-type="subsequent-section"><enum>202.</enum><header>Coverage of

			 intensive outpatient services</header>

				<subsection commented="no" display-inline="no-display-inline" id="H77E4B032065C43BC8883F7924C0685B1"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1832(a)(2) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395k(a)(2)) is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H44E27E6898544FDDA7F2ADCDB44B35A1"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (I), by striking

			 <quote>and</quote> at the end;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5F3FF86CC20D4CE69D1419DD4E68DB4F"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (J), by striking the period

				in section

				1861(ccc)).</text>

							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H296BA3BB7BFA4491A3BF9389F2BC77F7"><enum>(b)</enum><header>Services

			 described</header><text display-inline="yes-display-inline">Section 1861 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x),

			 as amended by section 201(b), is amended by adding at the end the following new

			 subsection:</text>

					<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="HBB947537B6F2454D9BA0C88CA016CAD7" other-style="archaic" style="other"><subsection commented="no" display-inline="no-display-inline" id="HBD39804F34FD4828A78D42451D5FDA8F"><enum>(ccc)</enum><header>Intensive outpatient

		  services</header><paragraph commented="no" display-inline="yes-display-inline" id="H86D30F6525BF4510B752DCF3E718E455"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>intensive outpatient

				services</term> means the items and services described in paragraph (2)

				prescribed by a physician and provided within the context described in

				paragraph (3) under the supervision of a physician (or, to the extent permitted

				under the law of the State in which the services are furnished, a non-physician

				mental health professional) pursuant to an individualized, written plan of

				treatment that is established by a physician and periodically reviewed by a

				physician or, to the extent permitted under the laws of the State in which the

				services are furnished, a non-physician mental health professional (in

				consultation with appropriate staff participating in such services), which plan

				sets forth the patient’s diagnosis, the type, amount, frequency, and duration

				of the items and services provided under the plan, and the goals for treatment

				under the plan.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3725D91B93674C6182F5B18B73B5943B" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4C59B0B318AD44F59FD3DD15075B74FB"><enum>(A)</enum><text display-inline="yes-display-inline">The items and services described in this

				paragraph are the items and services described in subparagraph (B) that are

				reasonable and necessary for the diagnosis or treatment of the individual’s

				condition, reasonably expected to improve or maintain the individual’s

				condition and functional level and to prevent relapse or hospitalization, and

				furnished pursuant to such guidelines relating to frequency and duration of

				services as the Secretary shall by regulation establish (taking into account

				accepted norms of clinical practice).</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA5381ECF962434A9CAAE325FF98114" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A), the items

				and services described in this paragraph are as follows:</text>

									<clause commented="no" display-inline="no-display-inline" id="H78F1723E82AA400E82653B73023C0000"><enum>(i)</enum><text display-inline="yes-display-inline">Psychiatric rehabilitation.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H337269B041754C3A9C2C979502E4859C"><enum>(ii)</enum><text display-inline="yes-display-inline">Assertive community treatment.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H3230B9BAA3CE4B95A4698957E71D2F60"><enum>(iii)</enum><text display-inline="yes-display-inline">Intensive case management.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H0EB23E187F4744E58022CD9290BAB541"><enum>(iv)</enum><text display-inline="yes-display-inline">Day treatment for individuals under 21

				years of age.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H168498E4CC244E9A8D1FD861DD55A5E5"><enum>(v)</enum><text display-inline="yes-display-inline">Ambulatory detoxification.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="H93AF2D3C95C6452EB45B36371FA477B3"><enum>(vi)</enum><text display-inline="yes-display-inline">Such other items and services as the

				Secretary may provide (but in no event to include meals and

				transportation).</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAE106471B2A3412EA8CAF9DA14BD3D34" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The context described in this paragraph for

				the provision of intensive outpatient services is as follows:</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="HA14E3B4D0FFA46548B289076F6FDAF85"><enum>(A)</enum><text display-inline="yes-display-inline">Such services are furnished in a facility,

				home, or community setting.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF9E4CC65BB854456AA16EE2EED4E96FB"><enum>(B)</enum><text display-inline="yes-display-inline">Such services are furnished—</text>

									<clause commented="no" display-inline="no-display-inline" id="HFFD79C517BD44F1CBB883C4371B026B5"><enum>(i)</enum><text display-inline="yes-display-inline">to assist the individual to compensate for,

				or eliminate, functional deficits and interpersonal and environmental barriers

				created by the disability; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="HFC9F7D96D3934B23ACE8E0453A6FFB2"><enum>(ii)</enum><text display-inline="yes-display-inline">to restore skills to the individual for

				independent living, socialization, and effective life management.</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3C6B2FDB0D94EC08F840047E5E9D181"><enum>(C)</enum><text display-inline="yes-display-inline">Such services are furnished by an

				individual or entity that—</text>

									<clause commented="no" display-inline="no-display-inline" id="H977690FE876343CE8F80B3ED122F9473"><enum>(i)</enum><text display-inline="yes-display-inline">is legally authorized to furnish such

				services under State law (or the State regulatory mechanism provided by State

				law) or meets such certification requirements that the Secretary may impose;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="HCD09839EEEBE4A7D9C58032EE414F184"><enum>(ii)</enum><text display-inline="yes-display-inline">meets such other requirements as the

				Secretary may impose to assure the quality of the intensive outpatient services

				provided.</text>

									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H6096259758624148A04B827CE3574EB0"><enum>(c)</enum><header>Payment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="HE2A6F1F1F8F242FBBA347F3D98049D85"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">With respect to

			 intensive outpatient services (as defined in section 1861(ccc)(1) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (as added by

			 subsection (b)) furnished under the medicare program, the amount of payment

			 under such Act for such services shall be 80 percent of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="H78F6FFF354234BCDA8D02D08A02992F3"><enum>(A)</enum><text display-inline="yes-display-inline">during 2006 and 2007, the reasonable costs

			 of furnishing such services; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8B9F276542F5419A8C1BE32D92BCC4FD"><enum>(B)</enum><text display-inline="yes-display-inline">on or after January 1, 2008, the amount of

			 payment established for such services under the prospective payment system

			 established by the Secretary under paragraph (2) for such services.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H960C6E057EFA4C5BAD28305509D89C8F"><enum>(2)</enum><header>Establishment of

			 pps</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="HA9A05E6BCEAD45C3B404F51B9C7B7BCA"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">With respect to

			 intensive outpatient services (as defined in section 1861(ccc)(1)) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (as added by

			 subsection (b)) furnished under the medicare program on or after January 1,

			 2008, the Secretary of Health and Human Services (in this paragraph referred to

			 as the <quote>Secretary</quote>) shall establish a prospective payment system

			 for payment for such services. Such system shall include an adequate patient

			 classification system that reflects the differences in patient resource use and

			 costs and shall provide for an annual update to the rates of payment

			 established under the system.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7CC4F5323CF24F5DBD8FEF334439D94E"><enum>(B)</enum><header>Adjustments</header><text display-inline="yes-display-inline">In establishing the system under

			 subparagraph (A), the Secretary shall provide for adjustments in the

			 prospective payment amount for variations in wage and wage-related costs, case

			 mix, and such other factors as the Secretary determines appropriate.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6B3A87A7DAB46A5AD15D6FBDF502BAB"><enum>(C)</enum><header>Collection of

			 data and evaluation</header><text display-inline="yes-display-inline">In

			 developing the system described in subparagraph (A), the Secretary may require

			 providers of services under the medicare program to submit such information to

			 the Secretary as the Secretary may require to develop the system, including the

			 most recently available data.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3288518035D4430FA3CE6D6725F21C80"><enum>(D)</enum><header>Reports to

			 Congress</header><text display-inline="yes-display-inline">Not later than

			 October 1 of each of 2006 and 2007, the Secretary shall submit to Congress a

			 report on the progress of the Secretary in establishing the prospective payment

			 system under this paragraph.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2FB532526BAB473182EED19D00009C58"><enum>(d)</enum><header>Conforming

			 amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H35D97E6E778F4FCC85EF05377CF79DD"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1835(a)(2) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395n(a)(2)) is amended—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="HB2B48C9D3FD34ADEB0C7E6CE2009117E" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking

			 <quote>and</quote> at the end;</text>

				services, (i) that those services are reasonably expected to improve or

				maintain the individual’s condition and functional level and to prevent relapse

				or hospitalization, (ii) an individualized, written plan for furnishing such

				services has been established by a physician and is reviewed periodically by a

				physician or, to the extent permitted under the laws of the State in which the

				services are furnished, a non-physician mental health professional, and (iii)

				such services are or were furnished while the individual is or was under the

				care of a physician or, to the extent permitted under the law of the State in

				which the services are furnished, a non-physician mental health

				professional.</text>

								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA65B82341AA404C00A5B4ABF119C154" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Section 1861(s)(2)(B) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395x(s)(2)(B)) is amended by inserting <quote>and intensive outpatient

			 services</quote> after <quote>partial hospitalization services</quote>.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EE3C48425804DD98F3BF52EFCBD7DF" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Section 1861(ff)(1) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

				law) of the State in which such services are performed, provided such services

				are covered under this title, as would otherwise be covered if furnished by a

				physician or as incident to a physician’s professional service, but only if no

				facility or other provider charges or is paid any amounts with respect to the

				furnishing of such services.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7E81333ABCF4232BD8BE3C070E0EAF3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>marriage and family

				therapist</term> means an individual who—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H57F82ED811AB42F3A861BC2EB5F40353"><enum>(A)</enum><text display-inline="yes-display-inline">possesses a master’s or doctoral degree

				which qualifies for licensure or certification as a marriage and family

				therapist pursuant to State law;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H436988E496EC4B7291009E5BC262F84D"><enum>(B)</enum><text display-inline="yes-display-inline">after obtaining such degree has performed

				at least 2 years of clinical supervised experience in marriage and family

				therapy; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA315A073AB6746D58969FF79ACCC8FAC"><enum>(C)</enum><text display-inline="yes-display-inline">is licensed or certified as a marriage and

				family therapist in the State in which marriage and family therapist services

				are

				performed.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 criteria with respect to consultation with a physician</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services

			 shall, taking into consideration concerns for patient confidentiality, develop

			 criteria with respect to payment for marriage and family therapist services for

			 which payment may be made directly to the marriage and family therapist under

			 part B of title XVIII of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (42 U.S.C. 1395j et seq.) under which such a therapist must

			 agree to consult with a patient’s attending or primary care physician in

			 accordance with such criteria.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC15E9A4D466048E1A4E6D80A19418D5"><enum>(e)</enum><header>Exclusion of

			 marriage and family therapist services from skilled nursing facility

			 prospective payment system</header><text display-inline="yes-display-inline">Section 1888(e)(2)(A)(ii) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395yy(e)(2)(A)(ii)), as amended in section 301(a), is amended by inserting

			 <quote>marriage and family therapist services (as defined in subsection

			 (ddd)(1)),</quote> after <quote>clinical social worker

			 services,</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H270654F3A048415FBB79F5E7323D35F8"><enum>(f)</enum><header>Coverage of

			 marriage and family therapist services provided in rural health clinics and

			 federally qualified health centers</header><text display-inline="yes-display-inline">Section 1861(aa)(1)(B) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395x(aa)(1)(B)) is amended by striking <quote>or by a clinical social worker

			 (as defined in subsection (hh)(1)),,</quote> and inserting <quote>, by a

			 clinical social worker (as defined in subsection (hh)(1)), or by a marriage and

			 family therapist (as defined in subsection (ddd)(2)),</quote>.</text>

			 marriage and family therapists as practitioners for assignment of

			 claims</header><text display-inline="yes-display-inline">Section 1842(b)(18)(C)

			 1395u(b)(18)(C)) is amended by adding at the end the following new

								<subparagraph commented="no" display-inline="no-display-inline" id="H5F592FFFA5674F42916366D951827EF2" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">possesses a master’s or doctor’s degree in

				mental health counseling or a related field;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5876C3A38B6447D80076756230739F8D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">after obtaining such a degree has performed

				at least 2 years of supervised mental health counselor practice; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64DDD565F902482B9928090070448D61" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">is licensed or certified as a mental health

				counselor or professional counselor by the State in which the services are

				performed.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3120C428E60E445A8298E6A935A20881" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>mental health counselor

				services</term> means services performed by a mental health counselor (as

				defined in paragraph (1)) for the diagnosis and treatment of mental illnesses

				which the mental health counselor is legally authorized to perform under State

				law (or the State regulatory mechanism provided by the State law) of the State

				in which such services are performed, provided such services are covered under

				this title, as would otherwise be covered if furnished by a physician or as

				incident to a physician’s professional service, but only if no facility or

				other provider charges or is paid any amounts with respect to the furnishing of

				such

				services.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H6E61E9C5A31040F5B6134C00A92CDC8F"><enum>(c)</enum><header>Payment</header>

					<paragraph commented="no" display-inline="no-display-inline" id="H2A73AF4E97734E7F8CE7A124829C9851"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of

			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395<italic>l</italic>(a)(1)), as amended by section 302(d), is amended—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="H59A9220E6E7546C49EA5738FC0CA6626"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> before

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HFAC3713DF6CD4B33B8B02047FA37924F" section-type="subsequent-section"><enum>304.</enum><header>Study of coverage

			 criteria for Alzheimer’s disease and related mental illnesses</header>

				<subsection commented="no" display-inline="no-display-inline" id="HEA259A7FB977483A86498D0839FBB7E"><enum>(a)</enum><header>Study</header>

					<paragraph commented="no" display-inline="no-display-inline" id="HEDA737050611485693B9C8B0A0C73114"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Health and Human Services (in this section referred to as the

			 <quote>Secretary</quote>) shall conduct a study to determine whether the

			 criteria for coverage of any therapy service (including occupational therapy

			 services and physical therapy services) or any outpatient mental health care

			 service under the medicare program under title XVIII of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395 et

			 seq.) unduly restricts the access of any medicare beneficiary who has been

			 diagnosed with Alzheimer’s disease or a related mental illness to such a

			 service because the coverage criteria requires the medicare beneficiary to

			 display continuing clinical improvement to continue to receive the

			 service.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF70EDF6CCFC44FA2967213B1D7DEEB41"><enum>(2)</enum><header>Determination of

			 new coverage criteria</header><text display-inline="yes-display-inline">If the

			 Secretary determines that the coverage criteria described in paragraph (1)

			 unduly restricts the access of any medicare beneficiary to the services

			 described in such paragraph, the Secretary shall identify alternative coverage

			 criteria that would permit a medicare beneficiary who has been diagnosed with

			 Alzheimer’s disease or a related mental illness to receive coverage for health

			 care services under the medicare program that are designed to control symptoms,

			 maintain functional capabilities, reduce or deter deterioration, and prevent or

			 reduce hospitalization of the beneficiary.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H47553BA6C90A4549918301C71C105418"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

			 enactment of this Act, the Secretary shall submit to the committees of

			 jurisdiction of Congress a report on the study conducted under subsection (a)

			 together with such recommendations for legislative and administrative action as

			 the Secretary determines appropriate.</text>
