		<official-title display="yes">To amend the Internal Revenue Code of 1986

		  to clarify the calculation of the reserve allowance for medical benefits of

		  plans sponsored by bona fide associations.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Allowance of reserve for

			 medical benefits of plans sponsored by bona fide associations</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID523E20E745A9465AB1C9B865E39D9517"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 419A(c) of

			 the Internal Revenue Code of 1986 (relating to account limit) is amended by

			 adding at the end the following new paragraph:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1C5F405120534BC2AF981B626CF2D9A1"><enum>(6)</enum><header>Additional

				reserve for medical benefits of bona fide association plans</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID669B912EDE8F43169DEDF309E30F74CE"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">An applicable account

				limit for any taxable year may include a reserve in an amount not to exceed 35

				percent of the sum of—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDDF38505089704EA786F2C1BD2E6C14F5"><enum>(i)</enum><text display-inline="yes-display-inline">the qualified direct costs, and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID62CB8CAF98224D17AEE615D28ACDF013"><enum>(ii)</enum><text display-inline="yes-display-inline">the change in claims incurred, but unpaid,

				for such taxable year with respect to medical benefits (other than

				post-retirement medical benefits).</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1735854E8D23424BA0EFCC5841BCD69D"><enum>(B)</enum><header>Applicable

				account limit</header><text display-inline="yes-display-inline">For purposes of

				this subsection, the term <term>applicable account limit</term> means an

				account limit for a qualified asset account with respect to medical benefits

				provided through a plan maintained by a bona fide association (as defined in

				section 2791(d)(3) of the <act-name parsable-cite="PHSA">Public Health Service

				Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91(d)(3)">42 U.S.C.

				300gg–91(d)(3)</external-xref>)</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA33842DBB0234E388C2FCD13BC77C840"><enum>(b)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendment made by

			 this section shall apply to taxable years ending after December 31,

			 2004.</text>
