			 title</header><text display-inline="no-display-inline">This title may be cited

			 as the <quote><short-title>Reclamation Rural Water Supply

			 Act of 2005</short-title></quote>.</text>

			</section><section commented="no" display-inline="no-display-inline" id="ID15BAB4184815426E826612087CAA054C" section-type="subsequent-section"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id99047CF2B8B546E699905C76F023747E"><enum>(1)</enum><header>Federal

			 reclamation law</header><text display-inline="yes-display-inline">The term

			 <term>Federal reclamation law</term> means the Act of June 17, 1902

			 (<external-xref legal-doc="statute-at-large" parsable-cite="stat/32/388">32

			 Stat. 388</external-xref>, chapter 1093), and Acts supplemental to and

			 amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371</external-xref> et seq.).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE9DC54EE5534465DB5DD52D4FB86B648"><enum>(2)</enum><header>Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> means an

			 individual who is a member of an Indian tribe.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID133BAB27ADD44D2DAC08F954BE925B7A"><enum>(3)</enum><header>Indian

			 Tribe</header><text display-inline="yes-display-inline">The term <term>Indian

			 tribe</term> has the meaning given the term in section 4 of the Indian

			 Self-Determination and Education Assistance Act (25 U.S.C. 450b).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID375194C671174193A2300D0F9ABEFEC1"><enum>(4)</enum><header>Non-Federal

			 project entity</header><text display-inline="yes-display-inline">The term

			 <term>non-Federal project entity</term> means a State, regional, or local

			 authority, Indian tribe or tribal organization, or other qualifying entity,

			 such as a water conservation district, water conservancy district, or rural

			 water district or association.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID187F7787B56C4BC1958804D5130C54DE"><enum>(5)</enum><header>Operations,

			 maintenance, and replacement costs</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID74244909732B4A24AEC4193AA4FB12F6"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The term

			 <term>operations, maintenance, and replacement costs</term> means all costs for

			 the operation of a rural water supply project that are necessary for the safe,

			 efficient, and continued functioning of the project to produce the benefits

			 described in a feasibility study.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCEA4A1F5142E4F889108340EF5635691"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>operations, maintenance, and

			 replacement costs</term> includes—</text>

						<clause commented="no" display-inline="no-display-inline" id="ID862724044C2E43B984C689117F9F190A"><enum>(i)</enum><text display-inline="yes-display-inline">repairs of a routine nature that maintain a

			 rural water supply project in a well kept condition;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDC77C78D99B0E46B7BD6905B9612124D5"><enum>(ii)</enum><text display-inline="yes-display-inline">replacement of worn-out project elements;

			 and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID73BD22A8D238482BA788C7407B7178B5"><enum>(iii)</enum><text display-inline="yes-display-inline">rehabilitation activities necessary to

			 bring a deteriorated project back to the original condition of the

			 project.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83A462B432D948C894A60123C9FD2AB0"><enum>(C)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <quote>operations, maintenance,

			 and replacement costs</quote> does not include construction costs.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0BF99030BA47446E9CB87604B53B4FFF"><enum>(6)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the

			 rural water supply program established under section 103.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE47F141782A64C06A73E0931B02EE577"><enum>(7)</enum><header>Reclamation

			 states</header><text display-inline="yes-display-inline">The term

			 <term>reclamation States</term> means the States and areas referred to in the

			 first section of the Act of June 17, 1902 (<external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE5D38C5961E740E6A429C633F0C198C5"><enum>(8)</enum><header>Rural water

			 supply project</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDC1AAEBA34E1848D5BD6DA5F3E18A5683"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The term <term>rural

			 water supply project</term> means a project that is designed to serve a group

			 of communities, which may include Indian tribes and tribal organizations,

			 dispersed homesites, or rural areas with domestic, industrial, municipal, and

			 residential water, each of which has a population of not more than 50,000

			 inhabitants.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7C0EC585516B443BA2E4BED619764E1B"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>rural water supply

			 project</term> includes—</text>

						<clause commented="no" display-inline="no-display-inline" id="id7A60E77E0F3F4AD1BE86A764F8F395C6"><enum>(i)</enum><text display-inline="yes-display-inline">incidental noncommercial livestock watering

			 and noncommercial irrigation of vegetation and small gardens of less than 1

			 acre; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id13B3475EEBF046F8A420EB347B3C3794"><enum>(ii)</enum><text display-inline="yes-display-inline">a project to improve rural water

			 infrastructure, including—</text>

							<subclause commented="no" display-inline="no-display-inline" id="IDDEC872E26AA74D76A6E0382822865660"><enum>(I)</enum><text display-inline="yes-display-inline">pumps, pipes, wells, and other

			 diversions;</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1CC91AB10E6747798692388C389F690B"><enum>(II)</enum><text display-inline="yes-display-inline">storage tanks and small

			 impoundments;</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDC9A69AB5D05A4B54BA0B3D422F28B1F9"><enum>(III)</enum><text display-inline="yes-display-inline">water treatment facilities for potable

			 water supplies;</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID19183436451D43A282CB4D747EC84CCA"><enum>(IV)</enum><text display-inline="yes-display-inline">equipment and management tools for water

			 conservation, groundwater recovery, and water recycling; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="id23B29EE091C94D7597415686847F5959"><enum>(V)</enum><text display-inline="yes-display-inline">appurtenances.</text>

							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB672F5902AF94A2D95F377D8B7A0F30E"><enum>(C)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>rural water supply

			 project</term> does not include—</text>

						<clause commented="no" display-inline="no-display-inline" id="idE6972E0349E449FCB56F2CA27E0D4BD6"><enum>(i)</enum><text display-inline="yes-display-inline">commercial irrigation; or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idD312E91662264F79B0334254530EF388"><enum>(ii)</enum><text display-inline="yes-display-inline">major impoundment structures.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID89C4FA3B664342349417DEAA073AE121"><enum>(9)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86D2388D38634C3EBEE28A089839615C"><enum>(10)</enum><header>Tribal

			 organization</header><text display-inline="yes-display-inline">The term

			 <term>tribal organization</term> means—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID7DCE8DC527764C84A9BDD988D4718B1D"><enum>(A)</enum><text display-inline="yes-display-inline">the recognized governing body of an Indian

			 tribe; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2F844944D8994D648152B1E046CBC8C3"><enum>(B)</enum><text display-inline="yes-display-inline">any legally established organization of

			 Indians that is controlled, sanctioned, or chartered by the governing body or

			 democratically elected by the adult members of the Indian community to be

			 served by the organization.</text>

					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID1691B0CCBFF143DCBEC5311584A23C55" section-type="subsequent-section"><enum>103.</enum><header>Rural water supply

			 program</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID1BB61199F8EC4BDDB2C3A99434351352"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary, in

			 cooperation with non-Federal project entities and consistent with this title,

			 shall establish and carry out a rural water supply program in reclamation

			 States to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idE8D7724EA6DA498A87E9BDF8C324F6DA"><enum>(1)</enum><text display-inline="yes-display-inline">investigate and identify opportunities to

			 ensure safe and adequate rural water supply projects for municipal and

			 industrial use in small communities and rural areas of the reclamation States;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAB202C1C9E4049EBB76F4E323FB58A08"><enum>(2)</enum><text display-inline="yes-display-inline">plan the design and construction, through

			 the conduct of appraisal investigations and feasibility studies, of rural water

			 supply projects in reclamation States.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2B39EB1E2FBE45F080AC0D545AF4EB4A"><enum>(b)</enum><header>Non-Federal

			 project entity</header><text display-inline="yes-display-inline">Any activity

			 carried out under this title shall be carried out in cooperation with a

			 qualifying non-Federal project entity, consistent with this title.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA4BAEFF2880E4E84879E09A538CF4532"><enum>(c)</enum><header>Eligibility

			 criteria</header><text display-inline="yes-display-inline">Not later than 1

			 year after the date of enactment of this Act, the Secretary shall, consistent

			 with this title, develop and publish in the Federal Register criteria

			 for—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idFC26FC995DD44ABAB19C6FA63225048F"><enum>(1)</enum><text display-inline="yes-display-inline">determining the eligibility of a rural

			 community for assistance under the program; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC77F0E84F6AA4F72BE009F1C3442C4B2"><enum>(2)</enum><text display-inline="yes-display-inline">prioritizing requests for assistance under

			 the program.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID941D4DEFB9CD4C32A04FE0A4233F4793"><enum>(d)</enum><header>Factors</header><text display-inline="yes-display-inline">The criteria developed under subsection (c)

			 shall take into account such factors as whether—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID3FA2A43A768C41499B82EDB23D42C3BA"><enum>(1)</enum><text display-inline="yes-display-inline">a rural water supply project—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDCFFD72F416874792B6EFFF2F6E9AA1D6"><enum>(A)</enum><text display-inline="yes-display-inline">serves—</text>

							<clause commented="no" display-inline="no-display-inline" id="id88AF2E8BAF7D40628D5E341EC6EA3991"><enum>(i)</enum><text display-inline="yes-display-inline">rural areas and small communities;

			 or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDE5393A0D19914F47949379DFA2BF6962"><enum>(ii)</enum><text display-inline="yes-display-inline">Indian tribes; or</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id250ADFBEB53945DA947D66180082035A"><enum>(B)</enum><text display-inline="yes-display-inline">promotes and applies a regional or

			 watershed perspective to water resources management;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID48FA2ECA0E204DE09D9CD51F1D6E770C"><enum>(2)</enum><text display-inline="yes-display-inline">there is an urgent and compelling need for

			 a rural water supply project that would—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID48C7D42F0A6F49A1BA5F0B5A6C671107"><enum>(A)</enum><text display-inline="yes-display-inline">improve the health or aesthetic quality of

			 water;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E5EFC3619EB4BC3B5061F98D2CBD35E"><enum>(B)</enum><text display-inline="yes-display-inline">result in continuous, measurable, and

			 significant water quality benefits; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9ECB14E119FC45D8A51AE465FF0051EE"><enum>(C)</enum><text display-inline="yes-display-inline">address current or future water supply

			 needs;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB0F53B85A37943F18CCAC3E4E1B682AC"><enum>(3)</enum><text display-inline="yes-display-inline">a rural water supply project helps meet

			 applicable requirements established by law; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC901311D8F694790B4C6BEE9CF89D69B"><enum>(4)</enum><text display-inline="yes-display-inline">a rural water supply project is cost

			 effective.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8E60DF7480C04F78AC40232F9BA28F8C"><enum>(e)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The Secretary may include—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idFE7E095F956A473A82AAD11CA6E0150B"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent that connection provides a

			 reliable water supply, a connection to preexisting infrastructure (including

			 dams and conveyance channels) as part of a rural water supply project;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1C5C513314D14199BF99CFDDEC5A4DD8"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding the limitation in section

			 102(8), a town or community with a population in excess of 50,000 inhabitants

			 in an area served by a rural water supply project if, at the discretion of the

			 Secretary, the town or community is considered to be a critical partner in the

			 rural supply project.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID9BEDB27A6B224F8882F86E546348EF83" section-type="subsequent-section"><enum>104.</enum><header>Rural water programs

			 assessment</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDAE10B57BC59648D9A8C91BD9F4279588"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In consultation with

			 the Secretary of Agriculture, the Administrator of the Environmental Protection

			 Agency, and the Director of the Indian Health Service, the Secretary shall

			 develop an assessment of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID4D1EE1E55A194FC6980A4C6365E6869B"><enum>(1)</enum><text display-inline="yes-display-inline">the status of all rural water supply

			 projects under the jurisdiction of the Secretary authorized but not completed

			 prior to the date of enactment of this Act, including appropriation amounts,

			 the phase of development, total anticipated costs, and obstacles to

			 completion;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID942E031653344A8F8D305EC7A13AEBA9"><enum>(2)</enum><text display-inline="yes-display-inline">the current plan (including projected

			 financial and workforce requirements) for the completion of the rural water

			 supply projects within the time frames established under the provisions of law

			 authorizing the projects or the final engineering reports for the

			 projects;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID921481D588384E8EA6BAE97E32883A70"><enum>(3)</enum><text display-inline="yes-display-inline">the demand for rural water supply

			 projects;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83DBCA934D07441B8994760D4C3279F7"><enum>(4)</enum><text display-inline="yes-display-inline">programs within other agencies that can,

			 and a description of the extent to which the programs, provide support for

			 rural water supply projects and water treatment programs in reclamation States,

			 including an assessment of the requirements, funding levels, and conditions for

			 eligibility for the programs assessed; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A52200B54CD4F21829CFA487467A6EA"><enum>(5)</enum><text display-inline="yes-display-inline">the extent of the unmet needs that the

			 Secretary can meet with the program that complements activities undertaken

			 under the authorities already within the jurisdiction of the Secretary and the

			 heads of the agencies with whom the Secretary consults.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID898CBCD0DDA64EFD97967C571FA2BC89"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of

			 enactment of this Act, the Secretary shall submit to the Committee on Energy

			 and Natural Resources of the Senate and the Committee on Resources of the House

			 of Representatives a detailed report on the assessment conducted under

			 subsection (a).</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDFFC836FF062B43609889FEE81AC26A7E" section-type="subsequent-section"><enum>105.</enum><header>Appraisal

			 investigations</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID576410A2B9D54923BAB4E7FF934CE91D"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">On request of a

			 non-Federal project entity with respect to a proposed rural water supply

			 project that meets the eligibility criteria published under section 103(c) and

			 subject to the availability of appropriations, the Secretary may—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID7F2FAC22C31A4429B8BAF83774D60AB8"><enum>(1)</enum><text display-inline="yes-display-inline">receive and review an appraisal

			 investigation that is—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID83E451E90A664ABB8935E399B79663ED"><enum>(A)</enum><text display-inline="yes-display-inline">developed by the non-Federal project entity

			 independent of support from the Secretary; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32291994C62C460D8D943DEC41140B17"><enum>(B)</enum><text display-inline="yes-display-inline">submitted to the Secretary by the

			 non-Federal project entity;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDABA258D3BFE443919BB3A8473233EC72"><enum>(2)</enum><text display-inline="yes-display-inline">conduct an appraisal investigation;

			 or</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF7008162ECE34B45A1D38460061F096F"><enum>(3)</enum><text display-inline="yes-display-inline">provide a grant to, or enter into a

			 cooperative agreement with, the non-Federal project entity to conduct an

			 appraisal investigation, if the Secretary determines that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idBB977AF2A26443EFBB67FC3ADA49AE40"><enum>(A)</enum><text display-inline="yes-display-inline">the non-Federal project entity is qualified

			 to complete the appraisal investigation in accordance with the criteria

			 published under section 103(c); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBEA7B3BE6474182831ACAD36A07DC56"><enum>(B)</enum><text display-inline="yes-display-inline">using the non-Federal project entity to

			 conduct the appraisal investigation is the lowest cost alternative for

			 completing the appraisal investigation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7EDDC41400BB4FE29EB0EB514CAFA7AD"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">An appraisal investigation conducted under

			 subsection (a) shall be scheduled for completion not later than 2 years after

			 the date on which the appraisal investigation is initiated.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD72D5C0DB64431C862275ECD0D790D0"><enum>(c)</enum><header>Appraisal

			 report</header><text display-inline="yes-display-inline">As soon as practicable

			 after an appraisal investigation is submitted to the Secretary under subsection

			 (a)(1) or completed under paragraph (2) or (3) of subsection (a), the Secretary

			 shall prepare an appraisal report that—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id6DFF1DDF3A5A49D998F2D58472E533C8"><enum>(1)</enum><text display-inline="yes-display-inline">considers—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID0B2479EF9C334D69AC1408B5262C2B9D"><enum>(A)</enum><text display-inline="yes-display-inline">whether the project meets—</text>

							<clause commented="no" display-inline="no-display-inline" id="idAD7808A926FF40D4B67213514E5B7713"><enum>(i)</enum><text display-inline="yes-display-inline">the appraisal criteria developed under

			 subsection (d); and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id21534B715B0F4B77B1AC66DAE223F7F8"><enum>(ii)</enum><text display-inline="yes-display-inline">the eligibility criteria developed under

			 section 103(c);</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID062CFD86D376459EA3C7A0839995E77E"><enum>(B)</enum><text display-inline="yes-display-inline">whether viable water supplies and water

			 rights exist to supply the project, including all practicable water sources

			 such as lower quality waters, nonpotable waters, and water reuse-based water

			 supplies;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3D4B118A6D2B4FB58496EE338AEBF199"><enum>(C)</enum><text display-inline="yes-display-inline">whether the project has a positive effect

			 on public health and safety;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5CB16A7F047A4822B69302CDDB37F4F9"><enum>(D)</enum><text display-inline="yes-display-inline">whether the project will meet water demand,

			 including projected future needs;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC752D76378CF4D7EBCAA28D249E4E2BD"><enum>(E)</enum><text display-inline="yes-display-inline">the extent to which the project provides

			 environmental benefits, including source water protection;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7C50DB3936204BD99B0E9D2B18DC99C8"><enum>(F)</enum><text display-inline="yes-display-inline">the ability of the project to supply water

			 consistent with Indian trust responsibilities, as appropriate;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6C20786E7269400490E8D9F02E9F95E1"><enum>(G)</enum><text display-inline="yes-display-inline">whether the project applies a regional or

			 watershed perspective and promotes benefits in the region in which the project

			 is carried out;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF74BEA568A224460874E971C28A59818"><enum>(H)</enum><text display-inline="yes-display-inline">whether the project—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID8790C860FF5C4AB6896DFC36FB0E33BB"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="IDB77213BBE05B4E139A6897B4E311DF8C"><enum>(I)</enum><text display-inline="yes-display-inline">implements an integrated resources

			 management approach; or</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDD6D1869372BB45EAAA7A26A778BEC82F" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">enhances water management flexibility,

			 including providing for—</text>

									<item commented="no" display-inline="no-display-inline" id="IDF4244148EC524C6882A62551E53565D6"><enum>(aa)</enum><text display-inline="yes-display-inline">local control to manage water supplies

			 under varying water supply conditions; and</text>

									</item><item commented="no" display-inline="no-display-inline" id="ID4DDB2FE09B0C4B00B4E0BAD1854D3183"><enum>(bb)</enum><text display-inline="yes-display-inline">participation in water banking and markets

			 for domestic and environmental purposes; and</text>

									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEF06A359ADCA4F059BEC902E36B0F09D"><enum>(ii)</enum><text display-inline="yes-display-inline">promotes long-term protection of water

			 supplies;</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8977876B8C8045348C38F8CD91799D22"><enum>(I)</enum><text display-inline="yes-display-inline">preliminary cost estimates for the project;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30CAA47493814F44AEC265EDFC0CBD5B"><enum>(J)</enum><text display-inline="yes-display-inline">whether the non-Federal project entity has

			 the capability to pay 100 percent of the costs associated with the operations,

			 maintenance, and replacement of the facilities constructed or developed as part

			 of the rural water supply project; and</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA4F74B04FF5847F088ED4F16C0946AA8"><enum>(2)</enum><text display-inline="yes-display-inline">provides recommendations on whether a

			 feasibility study should be initiated under section 106(a).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID844105EFB9DF436FBC8804E130DAC4EA"><enum>(d)</enum><header>Appraisal

			 criteria</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID12931DA3B18D4D8B849823F691D7D661"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act, the Secretary shall promulgate

			 criteria (including appraisal factors listed under subsection (c)) against

			 which the appraisal investigations shall be assessed for completeness and

			 appropriateness for a feasibility study.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5BF4FC06E33B46CB9B6C7B3589EB4D3D"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">To minimize the cost of a rural water

			 supply project to a non-Federal project entity, the Secretary shall include in

			 the criteria methods to scale the level of effort needed to complete the

			 appraisal investigation relative to the total size and cost of the proposed

			 rural water supply project.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID61735F6F11474A04B64CF5B872BEC36A"><enum>(e)</enum><header>Review of

			 appraisal investigation</header><text display-inline="yes-display-inline">Not

			 later than 180 days after the date of submission of an appraisal investigation

			 under subsection (a)(1) or the completion of an appraisal investigation under

			 paragraph (2) or (3) of subsection (a), the Secretary shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDC561D8FD05B8458CADEBC5DEF8E23F43"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to an appraisal investigation

			 conducted by a non-Federal project entity under subsection (a)(1), provide to

			 the non-Federal entity an evaluation of whether the appraisal investigation

			 satisfies the criteria promulgated under subsection (d);</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID38ECB62CFA5C44CE84EAD620F00E7DD6"><enum>(2)</enum><text display-inline="yes-display-inline">make available to the public, on request,

			 the results of each appraisal investigation conducted under this title;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DDFD3F979FD4CF88B72580EEBB76BB2"><enum>(3)</enum><text display-inline="yes-display-inline">promptly publish in the Federal Register a

			 notice of the availability of the results.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9806A92623024A32854B88C5DD72D35E"><enum>(f)</enum><header>Costs</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idA5F49462DEC34C019D99367A1D4EB89A"><enum>(1)</enum><header>Federal

			 share</header><text display-inline="yes-display-inline">The Federal share of an

			 appraisal investigation conducted under subsection (a) shall be 100 percent of

			 the total cost of the appraisal investigation, up to $200,000.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA129D01962544090B31787447847E206"><enum>(2)</enum><header>Non-federal

			 share</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idB80F7B500FC6488A90F6460170C4F398"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 subparagraph (B), if the cost of conducting an appraisal investigation is more

			 than $200,000, the non-Federal share of the costs in excess of $200,000 shall

			 be 50 percent.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2F617B5157B54392AC4EB0B14CF9F7FC"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may reduce the non-Federal

			 share required under subparagraph (A) if the Secretary determines that there is

			 an overwhelming Federal interest in the appraisal investigation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID01F2366A22C8444BB3BEEB1B0BA3DDEA"><enum>(g)</enum><header>Consultation;

			 Identification of Funding Sources</header><text display-inline="yes-display-inline">In conducting an appraisal investigation

			 under subsection (a)(2), the Secretary shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id7C279A83D0F74139ADB6B872EA8E2605"><enum>(1)</enum><text display-inline="yes-display-inline">consult and cooperate with the non-Federal

			 project entity and appropriate State, tribal, regional, and local

			 authorities;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA383C6CDCCED4CCC8DF3884FB75351AE"><enum>(2)</enum><text display-inline="yes-display-inline">consult with the heads of appropriate

			 Federal agencies to—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDA5F73958A63243B5A663C62E2F90AB79"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that the proposed rural water supply

			 project does not duplicate a project carried out under the authority of the

			 agency head; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID34FAFD6243B74DD1BFE74C42C1FC21A0"><enum>(B)</enum><text display-inline="yes-display-inline">if a duplicate project is being carried

			 out, identify the authority under which the duplicate project is being carried

			 out; and</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBEC0EB7B5B0840C0A9C9A7C14DD679B2"><enum>(3)</enum><text display-inline="yes-display-inline">identify what funding sources are available

			 for the proposed rural water supply project.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDE3F6F297B9604BA9BA705EB98ED8A20E" section-type="subsequent-section"><enum>106.</enum><header>Feasibility

			 studies</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDA3FE24601CB6495793AB4A82CA395B32"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">On completion of an

			 appraisal report under section 105(c) that recommends undertaking a feasibility

			 study and subject to the availability of appropriations, the Secretary

			 shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id8898E3B5C6044668A1B26F6FD8F6E30A"><enum>(1)</enum><text display-inline="yes-display-inline">in cooperation with a non-Federal project

			 entity, carry out a study to determine the feasibility of the proposed rural

			 water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBB8579B17A38447896F5ABF5C0898A10"><enum>(2)</enum><text display-inline="yes-display-inline">receive and review a feasibility study that

			 is—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF1F5C248EA5F4050AA7C50E9ADA4034C"><enum>(A)</enum><text display-inline="yes-display-inline">developed by the non-Federal project entity

			 independent of support from the Secretary; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id690645752D1246C294D30249B816FF58"><enum>(B)</enum><text display-inline="yes-display-inline">submitted to the Secretary by the

			 non-Federal project entity; or</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89EBD3DDBA084EDC9EF58CF09A026B80"><enum>(3)</enum><text display-inline="yes-display-inline">provide a grant to, or enter into a

			 cooperative agreement with, a non-Federal project entity to conduct a

			 feasibility study, for submission to the Secretary, if the Secretary determines

			 that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id4463815AD3564A62BF117C4D24B3395E"><enum>(A)</enum><text display-inline="yes-display-inline">the non-Federal entity is qualified to

			 complete the feasibility study in accordance with the criteria promulgated

			 under subsection (d); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65A2A4F0D7684B8D8F68743CFF572E0F"><enum>(B)</enum><text display-inline="yes-display-inline">using the non-Federal project entity to

			 conduct the feasibility study is the lowest cost alternative for completing the

			 appraisal investigation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA343C0FBCD424A8485BCADCFA219FA10"><enum>(b)</enum><header>Review of

			 non-Federal feasibility studies</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id843774511A2E43C396889D082A84910B"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In conducting a

			 review of a feasibility study submitted under paragraph (2) or (3) of

			 subsection (a), the Secretary shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF47F4FF5A69E42EBAF0E3B9A5521F521"><enum>(A)</enum><text display-inline="yes-display-inline">in accordance with the feasibility factors

			 described in subsection (c) and the criteria promulgated under subsection (d),

			 assess the completeness of the feasibility study; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA5E8C0FE56F42BCB471F68A1F76F157"><enum>(B)</enum><text display-inline="yes-display-inline">if the Secretary determines that a

			 feasibility study is not complete, notify the non-Federal entity of the

			 determination.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D5D8C8D593D45A9B40B48AAB84F460F"><enum>(2)</enum><header>Revisions</header><text display-inline="yes-display-inline">If the Secretary determines under paragraph

			 (1)(B) that a feasibility study is not complete, the non-Federal entity shall

			 pay any costs associated with revising the feasibility study.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9B1CACECF1BA4CC087D329CF04AF6635"><enum>(c)</enum><header>Feasibility

			 factors</header><text display-inline="yes-display-inline">Feasibility studies

			 authorized or reviewed under this title shall include an assessment of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID4C1FC8A819314782B039A5D174CF8386"><enum>(1)</enum><text display-inline="yes-display-inline">near- and long-term water demand in the

			 region to be served by the rural water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID80E40312FA20443893E52B1F982E095B"><enum>(2)</enum><text display-inline="yes-display-inline">advancement of public health and safety of

			 any existing rural water supply project and other benefits of the proposed

			 rural water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID249A15BF894848B6A9080E483EBBF9D9"><enum>(3)</enum><text display-inline="yes-display-inline">alternative new water supplies in the study

			 area, including any opportunities to treat and use low-quality water,

			 nonpotable water, water reuse-based supplies, and brackish and saline waters

			 through innovative and economically viable treatment technologies;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE09BAD9A3F814380944A473007EAEE3B"><enum>(4)</enum><text display-inline="yes-display-inline">environmental quality and source water

			 protection issues related to the rural water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFCA9878569494B3C98C13E233B0F4683"><enum>(5)</enum><text display-inline="yes-display-inline">innovative opportunities for water

			 conservation in the study area to reduce water use and water system costs,

			 including—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID415DE47C1EEC495EBA183DE4F57C5D32"><enum>(A)</enum><text display-inline="yes-display-inline">nonstructural approaches to reduce the need

			 for the project; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4FC7416F245E4334B24F4FFC7FCB4D9E"><enum>(B)</enum><text display-inline="yes-display-inline">demonstration technologies;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID77AF5C02BB3C469C9521DC365CAC32C5"><enum>(6)</enum><text display-inline="yes-display-inline">the extent to which the project and

			 alternatives take advantage of economic incentives and the use of market-based

			 mechanisms;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID521CD4BF64CC4EC7997C9DAEA4765B39"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID4484D106F2D64D79A4DE8C288B855558"><enum>(A)</enum><text display-inline="yes-display-inline">the construction costs and projected

			 operations, maintenance, and replacement costs of all alternatives; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD9D027E7D6754154AA939168AB889D65" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the economic feasibility and lowest cost

			 method of obtaining the desired results of each alternative, taking into

			 account the Federal cost-share;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44A8C9ED30974060976E94DC39C3B4F1"><enum>(8)</enum><text display-inline="yes-display-inline">the availability of guaranteed loans for a

			 proposed rural water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID311FEC2A31B64F37870622F97457BD41"><enum>(9)</enum><text display-inline="yes-display-inline">the financial capability of the non-Federal

			 project entity to pay the non-Federal project entity's proportionate share of

			 the design and construction costs and 100 percent of operations, maintenance,

			 and replacement costs, including the allocation of costs to each non-Federal

			 project entity in the case of multiple entities;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9CCC78AC9D84F9D8FB50A7E36ED460B"><enum>(10)</enum><text display-inline="yes-display-inline">whether the non-Federal project entity has

			 developed an operations, management, and replacement plan to assist the

			 non-Federal project entity in establishing rates and fees for beneficiaries of

			 the rural water supply project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99A6324C44DE42FB970FFE7FF612D41C"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAC473794BEB043C49E2AA7AFA2D40759"><enum>(A)</enum><text display-inline="yes-display-inline">the non-Federal project entity

			 administrative organization that would implement construction, operations,

			 maintenance, and replacement activities; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00290042C0BF41808CBF24B5FCC0CC30" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the fiscal, administrative, and operational

			 controls to be implemented to manage the project;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4202FE3D240948D19D36A02AF4509CF1"><enum>(12)</enum><text display-inline="yes-display-inline">the extent to which the project addresses

			 Indian trust responsibilities, as appropriate;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC84DF1C3C6414F1E82B1CE83AAE01749"><enum>(13)</enum><text display-inline="yes-display-inline">the extent to which assistance for rural

			 water supply is available under other Federal authorities;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF92F15EE32AE4B09AB99B5DDB80A91AD"><enum>(14)</enum><text display-inline="yes-display-inline">the engineering, environmental, and

			 economic activities to be undertaken to carry out the study;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID324949B362454B2AABE7B0E00F8038B7"><enum>(15)</enum><text display-inline="yes-display-inline">the extent to which the project involves

			 partnerships with other State, local, or tribal governments or Federal

			 entities; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEF8CB9E82C414D8B8C3F6CC262FDF7D8"><enum>(16)</enum><text display-inline="yes-display-inline">in the case of a project intended for

			 Indian tribes and tribal organizations, the extent to which the project

			 addresses the goal of economic self-sufficiency.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID02DB6A412ACD40CD8A6B7AADBCEA95D4"><enum>(d)</enum><header>Feasibility

			 study criteria</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDAEA44C1667E94A46A42828D76C1EF8FA"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 18

			 months after the date of enactment of this Act, the Secretary shall promulgate

			 criteria (including the feasibility factors listed under subsection (c)) under

			 which the feasibility studies shall be assessed for completeness and

			 appropriateness.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD289651B3E46480CA14EB834B45F834D"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The Secretary shall include in the criteria

			 promulgated under paragraph (1) methods to scale the level of effort needed to

			 complete the feasibility assessment relative to the total size and cost of the

			 proposed rural water supply project and reduce total costs to non-Federal

			 entities.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB19F96F5357D48998EA055DD3719617B"><enum>(e)</enum><header>Feasibility

			 report</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID87EFBD6E1B8645ECBCDF72AE19E24732"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">After completion of

			 appropriate feasibility studies for rural water supply projects that address

			 the factors described in subsection (c) and the criteria promulgated under

			 subsection (d), the Secretary shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID01F1F4AB0B104FCF81CE4CBD2EED4E1D"><enum>(A)</enum><text display-inline="yes-display-inline">develop a feasibility report that

			 includes—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDC131D98F11824C87AF82DCA1DD53ED28"><enum>(i)</enum><text display-inline="yes-display-inline">a recommendation of the Secretary

			 on—</text>

								<subclause commented="no" display-inline="no-display-inline" id="ID17E1808584214B049EFB372F724B1485"><enum>(I)</enum><text display-inline="yes-display-inline">whether the rural water supply project

			 should be authorized for construction; and</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDAB9F78A0773A47DABAFBFDEF016384B1"><enum>(II)</enum><text display-inline="yes-display-inline">the appropriate non-Federal share of

			 construction costs, which shall be—</text>

									<item commented="no" display-inline="no-display-inline" id="id9076DBEE2DC24E8CBBCBA892D312236C"><enum>(aa)</enum><text display-inline="yes-display-inline">at least 25 percent of the total

			 construction costs; and</text>

									</item><item commented="no" display-inline="no-display-inline" id="id327EB205CD114839BC328908F3D08E25"><enum>(bb)</enum><text display-inline="yes-display-inline">determined based on an analysis of the

			 capability-to-pay information considered under subsections (c)(9) and (f);

			 and</text>

									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id74FE37E2A482452AB1612B4DA47FE4F4"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Secretary recommends that the

			 project should be authorized for construction—</text>

								<subclause commented="no" display-inline="no-display-inline" id="idE7A5CCFC614C49B6904AA38F180AE264"><enum>(I)</enum><text display-inline="yes-display-inline">what amount of grants, loan guarantees, or

			 combination of grants and loan guarantees should be used to provide the Federal

			 cost share;</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id60342E7E67B349F4915FC4D6959A568E"><enum>(II)</enum><text display-inline="yes-display-inline">a schedule that identifies the annual

			 operations, maintenance, and replacement costs that should be allocated to each

			 non-Federal entity participating in the rural water supply project; and</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id195A286DFEB742CA8008F719D437B094"><enum>(III)</enum><text display-inline="yes-display-inline">an assessment of the financial capability

			 of each non-Federal entity participating in the rural water supply project to

			 pay the allocated annual operation, maintenance, and replacement costs for the

			 rural water supply project;</text>

								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID16B373F8073F4E07BB13F6BC6386F227"><enum>(B)</enum><text display-inline="yes-display-inline">submit the report to the Committee on

			 Energy and Natural Resources of the Senate and the Committee on Resources of

			 the House of Representatives;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID047521DFF4A3453886B39A6F68802BFE"><enum>(C)</enum><text display-inline="yes-display-inline">make the report publicly available, along

			 with associated study documents; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47910B10F9B341029DF1205361FD2CC9"><enum>(D)</enum><text display-inline="yes-display-inline">publish in the Federal Register a notice of

			 the availability of the results.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD78EC26479FF40A3AF74CCC50A832FC2"><enum>(f)</enum><header>Capability-To-Pay</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID2E81F481ACF7490787588D73ADF0D4DB"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In evaluating a

			 proposed rural water supply project under this section, the Secretary

			 shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="idF94D2881CEEE4A8AA23103C069DE42E5"><enum>(A)</enum><text display-inline="yes-display-inline">consider the financial capability of any

			 non-Federal project entities participating in the rural water supply project to

			 pay the capital construction costs of the rural water supply project;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id55FE9BB7CFA748BDAD3BDA60FC9173E1"><enum>(B)</enum><text display-inline="yes-display-inline">recommend an appropriate Federal share and

			 non-Federal share of the capital construction costs, as determined by the

			 Secretary.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3B814C8011B44B5815DE5883D441D62"><enum>(2)</enum><header>Factors</header><text display-inline="yes-display-inline">In determining the financial capability of

			 non-Federal project entities to pay for a rural water supply project under

			 paragraph (1), the Secretary shall evaluate factors for the project area,

			 relative to the State and county average, including—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID678B209838DA4E918C6148F82688E595"><enum>(A)</enum><text display-inline="yes-display-inline">per capita income;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC25DA31D66AE4F61B5AD818A0D336510"><enum>(B)</enum><text display-inline="yes-display-inline">median household income;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA4B9B503447D435D9A3687C8A47884CA"><enum>(C)</enum><text display-inline="yes-display-inline">the poverty rate;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0BCFF67DB300482089462A2409422F1C"><enum>(D)</enum><text display-inline="yes-display-inline">the ability of the non-Federal project

			 entity to raise tax revenues or assess fees;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4871AAFB4FCC4D6A82968D0009E2F994"><enum>(E)</enum><text display-inline="yes-display-inline">the strength of the balance sheet of the

			 non-Federal project entity; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC45149FD8BB74B93A8D7D30DF24C0173"><enum>(F)</enum><text display-inline="yes-display-inline">the existing cost of water in the

			 region.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47B314D8917F443DA12771EECCEC353D"><enum>(3)</enum><header>Indian

			 tribes</header><text display-inline="yes-display-inline">In determining the

			 capability-to-pay of Indian tribe project beneficiaries, the Secretary may

			 consider deferring the collection of all or part of the non-Federal

			 construction costs apportioned to Indian tribe project beneficiaries unless or

			 until the Secretary determines that the Indian tribe project beneficiaries

			 should pay—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id388C42CAE35E478DA713A70BD5C155E5"><enum>(A)</enum><text display-inline="yes-display-inline">the costs allocated to the beneficiaries;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D4BACDF110D4EBE9B223957C6B2434C"><enum>(B)</enum><text display-inline="yes-display-inline">an appropriate portion of the costs.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1B1993D4DEFD40A78E84F3E4BB63D144"><enum>(g)</enum><header>Cost-Sharing

			 requirement</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDA2DDC2A4A5214D87A1CA8EF9BF4892FE"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this subsection, the Federal share of the cost of a feasibility

			 study carried out under this section shall not exceed 50 percent of the study

			 costs.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4C796E1F3A06431B9C10CE504F50D013"><enum>(2)</enum><header>Form</header><text display-inline="yes-display-inline">The non-Federal share under paragraph (1)

			 may be in the form of any in-kind services that the Secretary determines would

			 contribute substantially toward the conduct and completion of the study.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID221AEEC08AE24437B66A92FA08D08C59"><enum>(3)</enum><header>Financial

			 hardship</header><text display-inline="yes-display-inline">The Secretary may

			 increase the Federal share of the costs of a feasibility study if the Secretary

			 determines, based on a demonstration of financial hardship, that the

			 non-Federal participant is unable to contribute at least 50 percent of the

			 costs of the study.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFFF059A86294427288CA4DFD5F39752D"><enum>(4)</enum><header>Larger

			 communities</header><text display-inline="yes-display-inline">In conducting a

			 feasibility study of a rural water supply system that includes a community with

			 a population in excess of 50,000 inhabitants, the Secretary may require the

			 community to pay a greater percentage of the non-Federal share than that

			 required for communities with less than 50,000 inhabitants.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2A7C6ACC92024DB5AAF3F2869E958FEC"><enum>(h)</enum><header>Consultation

			 and cooperation</header><text display-inline="yes-display-inline">In addition

			 to the non-Federal project entity, the Secretary shall consult and cooperate

			 with appropriate Federal, State, tribal, regional, and local authorities during

			 the conduct of each feasibility assessment and development of the feasibility

			 report conducted under this title.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID11495ED582A4439F998CD18258B239B2" section-type="subsequent-section"><enum>107.</enum><header>Miscellaneous</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDCEABEC5E32434DF8806B93FA7D0F274C"><enum>(a)</enum><header>Authority of

			 Secretary</header><text display-inline="yes-display-inline">The Secretary may

			 enter into contracts, financial assistance agreements, and such other

			 agreements, and promulgate such regulations, as are necessary to carry out this

			 title.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID511F667609834A39922BDA2491B22227"><enum>(b)</enum><header>Transfer of

			 projects</header><text display-inline="yes-display-inline">Nothing in this

			 title authorizes the transfer of pre-existing facilities or pre-existing

			 components of any water system from Federal to private ownership or from

			 private to Federal ownership.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB1B2514AF04D470CA90212780AC3944C"><enum>(c)</enum><header>Federal

			 reclamation law</header><text display-inline="yes-display-inline">Nothing in

			 this title supersedes or amends any Federal law associated with a project, or

			 portion of a project, constructed under Federal reclamation law.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA095B24E6A224B4286C83AC574D69518"><enum>(d)</enum><header>Interagency

			 coordination</header><text display-inline="yes-display-inline">The Secretary

			 shall coordinate the program carried out under this title with existing Federal

			 and State rural water and wastewater programs to facilitate the most efficient

			 and effective solution to meeting the water needs of the non-Federal project

			 sponsors.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0A150B84CA4B4E7183E6E155B74C2101"><enum>(e)</enum><header>Multiple Indian

			 tribes</header><text display-inline="yes-display-inline">In any case in which a

			 contract is entered into with, or a grant is made, to an organization to

			 perform services benefitting more than 1 Indian tribe under this title, the

			 approval of each such Indian tribe shall be a prerequisite to entering into the

			 contract or making the grant.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8E009E819A1549E68856EFF0C52361B4"><enum>(f)</enum><header>Ownership of

			 facilities</header><text display-inline="yes-display-inline">Title to any

			 facility planned, designed, and recommended for construction under this title

			 is intended to be held by the non-Federal project entity.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1F87492C0A774665A64E233303A2CE9C"><enum>(g)</enum><header>Effect on State

			 water law</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idFD3E1668018847C7B928977939F40DDC"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Nothing in this title

			 preempts or affects State water law or an interstate compact governing

			 water.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4048C092F1CA4F76836B26C31C6998F2"><enum>(2)</enum><header>Compliance

			 required</header><text display-inline="yes-display-inline">The Secretary shall

			 comply with State water laws in carrying out this title.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDF3C2543EE8D4D359776D21FF09B7D13"><enum>(h)</enum><header>No additional

			 requirements</header><text display-inline="yes-display-inline">Nothing in this

			 title requires a feasibility study for, or imposes any other additional

			 requirements with respect to, rural water supply projects or programs that are

			 authorized before the date of enactment of this Act.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID22BF4DD696D64303B857EBFE65F9EBA8" section-type="subsequent-section"><enum>108.</enum><header>Authorization of

			 appropriations</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID8217FC86821445F288479541C945C1D2"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There is authorized

			 to be appropriated to carry out this title $20,000,000 for the period of fiscal

			 years 2006 through 2015, to remain available until expended.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEA91DC6D648438391B7B791CF0D35F8"><enum>(b)</enum><header>Rural water

			 programs assessment</header><text display-inline="yes-display-inline">Of the

			 amounts made available under subsection (a), not more than $1,000,000 may be

			 made available to carry out section 104 for each of fiscal years 2006 and

			 2007.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id95B3AD2F13CE40B6A6F07A73A7261866"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">No amounts made available under this

			 section shall be used to pay construction costs associated with any rural water

			 supply project.</text>

				</subsection></section></title><title commented="no" id="ID3365D9DDF28F47A89A450C516BD11AE2" style="OLC"><enum>II</enum><header>Twenty-First Century Water Works

			 Act</header>

			<section commented="no" display-inline="no-display-inline" id="ID0D9B685937C74505BAA441FFB6314668" section-type="subsequent-section"><enum>201.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This title may be cited

			 as the <quote><short-title>Twenty-First Century Water

			 Works Act</short-title></quote>.</text>

			</section><section commented="no" display-inline="no-display-inline" id="ID726333559E1041649BC9B0BD6E764F64" section-type="subsequent-section"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDE4DCB15DD323409687D6C6224A168BEA"><enum>(1)</enum><header>Indian

			 Tribe</header><text display-inline="yes-display-inline">The term <term>Indian

			 tribe</term> has the meaning given the term in section 4 of the Indian

			 Self-Determination and Education Assistance Act (25 U.S.C. 450b).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC5C41B53E6E64CF9BF97EEB787264040"><enum>(2)</enum><header>Lender</header><text display-inline="yes-display-inline">The term <term>lender</term> means any

			 non-Federal qualified institutional buyer (as defined in section 230.144A(a) of

			 title 17, Code of Federal Regulation (or any successor regulation), known as

			 Rule 144A(a) of the Securities and Exchange Commission and issued under the

			 <act-name parsable-cite="SA33">Securities Act of 1933</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/15/77a">15 U.S.C.

			 77a</external-xref> et seq.)).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9E5528C78A244150A3DD6DC24835F90B"><enum>(3)</enum><header>Loan

			 guarantee</header><text display-inline="yes-display-inline">The term <term>loan

			 guarantee</term> means any guarantee, insurance, or other pledge by the

			 Secretary to pay all or part of the principal of, and interest on, a loan or

			 other debt obligation of a non-Federal borrower to a lender.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5A5F4D08CEE941B18B0583D19CC9D494"><enum>(4)</enum><header>Non-federal

			 borrower</header><text display-inline="yes-display-inline">The term

			 <term>non-Federal borrower</term> means—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idD4A323D421E24982852FB83A3A7EB719"><enum>(A)</enum><text display-inline="yes-display-inline">a State (including a department, agency, or

			 political subdivision of a State); or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3716711F638B461BAF3EC82E40B4D3AB"><enum>(B)</enum><text display-inline="yes-display-inline">a conservancy district, irrigation

			 district, canal company, water users’ association, Indian tribe, an agency

			 created by interstate compact, or any other entity that has the capacity to

			 contract with the United States under Federal reclamation law.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA167403DAA6B432FA1538F17189EE940"><enum>(5)</enum><header>Project</header><text display-inline="yes-display-inline">The term <term>project</term> means—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id7F88817EBAEA4D68B5F90FB9DEFE653C"><enum>(A)</enum><text display-inline="yes-display-inline">a rural water supply project (as defined in

			 section 102(8)); or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA44E857B90FF45DCB33EB2592182CDEF"><enum>(B)</enum><text display-inline="yes-display-inline">an extraordinary operation and maintenance

			 activity for, or the rehabilitation of, a facility—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDC2100FC61F104B299BDEA632488A7614"><enum>(i)</enum><text display-inline="yes-display-inline">that is authorized by Federal reclamation

			 law and constructed by the United States under such law; or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDB13C66C485174FE983CB5B1491FFE140"><enum>(ii)</enum><text display-inline="yes-display-inline">in connection with which there is a

			 repayment or water service contract executed by the United States under Federal

			 reclamation law.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9FBF1B06D3EA420885BB317C517BC118"><enum>(6)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of the Interior.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID710DCCF711154C5A91B095EC6DBFFB4A" section-type="subsequent-section"><enum>203.</enum><header>Project

			 eligibility</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDEC523ECF53CB43099110A5B0E6785046"><enum>(a)</enum><header>Eligibility

			 criteria</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1F0E5525FEFB4DC98CFDB9E2B3FDCEF1"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 develop and publish in the Federal Register criteria for determining the

			 eligibility of a project for financial assistance under section 204.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID78D3830281A840CC8F56C0D224B7D260"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Eligibility criteria shall include—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID1CAAB75CC59F40A6B6CB8D5D5F0CE1A3"><enum>(A)</enum><text display-inline="yes-display-inline">submission of an application by the lender

			 to the Secretary;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2A9C434CDBFF44199F3B69BFA7727B80"><enum>(B)</enum><text display-inline="yes-display-inline">demonstration of the creditworthiness of

			 the project, including a determination by the Secretary that any financing for

			 the project has appropriate security features to ensure repayment;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4643176F6B6D4BCDB1C7C5420A5F80C2"><enum>(C)</enum><text display-inline="yes-display-inline">demonstration by the non-Federal borrower,

			 to the satisfaction of the Secretary, of the ability of the non-Federal

			 borrower to repay the project financing from user fees or other dedicated

			 revenue sources;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4EFCAB69EC734992AC3B947FAFB8C3CB"><enum>(D)</enum><text display-inline="yes-display-inline">demonstration by the non-Federal borrower,

			 to the satisfaction of the Secretary, of the ability of the non-Federal

			 borrower to pay all operations, maintenance, and replacement costs of the

			 project facilities; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2192D2DF3A174B7FB3F88272A00762D2"><enum>(E)</enum><text display-inline="yes-display-inline">such other criteria as the Secretary

			 determines to be appropriate.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID76113AED82EA453B83BDAFEB8D70613E"><enum>(b)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive any of the criteria

			 in subsection (a)(2) that the Secretary determines to be duplicative or

			 rendered unnecessary because of an action already taken by the United

			 States.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA26918965F984A62A7DF88C822AF032A"><enum>(c)</enum><header>Projects

			 previously authorized</header><text display-inline="yes-display-inline">A

			 project that was authorized for construction under Federal reclamation laws

			 prior to the date of enactment of this Act shall be eligible for assistance

			 under this title, subject to the criteria established by the Secretary under

			 subsection (a).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID91B04BF1B5CA48E08ADB92E0C9D64ED9"><enum>(d)</enum><header>Criteria for

			 rural water supply projects</header><text display-inline="yes-display-inline">A

			 rural water supply project that is determined to be feasible under section 106

			 is eligible for a loan guarantee under section 204.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID47A10660A49F4D4DBBF1EAD5E265E504" section-type="subsequent-section"><enum>204.</enum><header>Loan

			 guarantees</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID1837867CA3A24AED85834219CE93A51B"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Subject to the availability of

			 appropriations, the Secretary may make available to lenders for a project

			 meeting the eligibility criteria established in section 203 loan guarantees to

			 supplement private-sector or lender financing for the project.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7E1457BD6D4347D4A34D0CB2A80E115B"><enum>(b)</enum><header>Terms and

			 limitations</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID65F65042322441B8939C7907213D871E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Loan guarantees under

			 this section for a project shall be on such terms and conditions and contain

			 such covenants, representations, warranties, and requirements as the Secretary

			 determines to be appropriate to protect the financial interests of the United

			 States.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5790EBED15654E05AD363D7C4E6F1DF9"><enum>(2)</enum><header>Maximum

			 amount</header><text display-inline="yes-display-inline">The amount of a loan

			 guarantee shall not exceed 90 percent of the reasonably anticipated eligible

			 project costs.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC3BB0E42E35B4FA3A03AF2B15EE3CF92"><enum>(3)</enum><header>Interest

			 rate</header><text display-inline="yes-display-inline">The interest rate on a

			 loan guarantee shall be negotiated between the non-Federal borrower and the

			 lender with the consent of the Secretary.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID061A5EB9D114450CA055AD543FB509DB"><enum>(4)</enum><header>Amortization</header><text display-inline="yes-display-inline">A loan guarantee under this section shall

			 provide for complete amortization of the loan guarantee within not more than 40

			 years.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEA74AFDCBF594D19BC220334BE9DAB1B"><enum>(5)</enum><header>Non-subordination</header><text display-inline="yes-display-inline">In case of bankruptcy, insolvency, or

			 liquidation of the non-Federal borrower, a loan guarantee shall not be

			 subordinated to the claims of any holder of project obligations.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9467BCA2553F4FC3B02260BD947BB14A"><enum>(c)</enum><header>Prepayment and

			 refinancing</header><text display-inline="yes-display-inline">Any prepayment or

			 refinancing terms on a loan guarantee shall be negotiated between the

			 non-Federal borrower and the lender with the consent of the Secretary.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1B04AA1149E940919F980FA61F83CED4" section-type="subsequent-section"><enum>205.</enum><header>Operations,

			 maintenance, and replacement costs</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID7881CE0AC9D74453A442DB927A6FE3B5"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The non-Federal share

			 of operations, maintenance, and replacement costs for a project receiving

			 Federal assistance under this title shall be 100 percent.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3FCB5C2BE5F541319B33957551553FBD"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">On request of the non-Federal borrower, the

			 Secretary may assist in the development of an operation, maintenance, and

			 replacement plan to provide the necessary framework to assist the non-Federal

			 borrower in establishing rates and fees for project beneficiaries.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1A8C14F43FA14AF18951C98BCC670A05" section-type="subsequent-section"><enum>206.</enum><header>Title to newly

			 constructed facilities</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID95E9148FCF02483B967FEE2FBC680E2D"><enum>(a)</enum><header>New projects

			 and facilities</header><text display-inline="yes-display-inline">All new

			 projects or facilities constructed in accordance with this title shall remain

			 under the jurisdiction and control of the non-Federal borrower subject to the

			 terms of the repayment agreement.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID97DEEC50176240889450B03694F528B2"><enum>(b)</enum><header>Existing

			 projects and facilities</header><text display-inline="yes-display-inline">Nothing in this title affects the title

			 of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID13F1B176F346472991D2842CEEEA6F09"><enum>(1)</enum><text display-inline="yes-display-inline">reclamation projects authorized prior to

			 the date of enactment of this Act;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6E2EBD14489A4012A47304870CE903E5"><enum>(2)</enum><text display-inline="yes-display-inline">works supplemental to existing reclamation

			 projects; or</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8FA9623ACCF246EAB9ACCB72D594C707"><enum>(3)</enum><text display-inline="yes-display-inline">works constructed to rehabilitate existing

			 reclamation projects.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7B514E5665324C96B0E237B2054932EF" section-type="subsequent-section"><enum>207.</enum><header>Water

			 rights</header>

				<subsection commented="no" display-inline="no-display-inline" id="id9453C3B85BBC49D2AC60F6264C1FB2BE"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Nothing in this title

			 preempts or affects State water law or an interstate compact governing

			 water.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idA01B01F986D449238D15C96BCEBF442D"><enum>(b)</enum><header>Compliance

			 required</header><text display-inline="yes-display-inline">The Secretary shall

			 comply with State water laws in carrying out this title. Nothing in this title

			 affects or preempts State water law or an interstate compact governing

			 water.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID88F145B254CC44BD8BFEAE25095B685B" section-type="subsequent-section"><enum>208.</enum><header>Interagency

			 coordination and cooperation</header><text display-inline="no-display-inline">The Secretary and the Secretary of

			 Agriculture shall enter into a memorandum of agreement providing for Department

			 of Agriculture financial appraisal functions and loan guarantee administration

			 for activities carried out under this title.</text>

			</section><section commented="no" display-inline="no-display-inline" id="ID7E57F6588ECE4F62A6B7CA0CEFB72EF4" section-type="subsequent-section"><enum>209.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as are necessary to carry out this

			 title, to remain available until expended.</text>
