		<official-title display="yes">To amend title 49, United States Code, to

		  require phased increases in the fuel efficiency standards applicable to light

		  trucks, to require fuel economy standards for automobiles up to 10,000 pounds

		  gross vehicle weight, to increase the fuel economy of the Federal fleet of

		  vehicles, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID539497488223405E9D46ACCA8D704F63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Automobile Fuel Economy Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID3766AB2257B74FC291F7A66631BC4F3F" section-type="subsequent-section"><enum>2.</enum><header>Increased average fuel

			 economy standard for light trucks</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDB4BF97CD56C54ADE874B7417B0A4F723"><enum>(a)</enum><header>Definition of

			 light truck</header><text display-inline="yes-display-inline">Section 32901(a)

			 of title 49, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idD441D4E1B8B948879C49207BD1B687D0"><enum>(1)</enum><text display-inline="yes-display-inline">in each of paragraphs (1) through (14), by

			 striking the period at the end and inserting a semicolon;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25CC07C21E96416386308CEAA89F9095"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (15), by striking the period

			 at the end and inserting <quote>; and</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8B025C7CFA2944F99C75737F2B5791C4"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (12) through

			 (16) as paragraphs (13) through (17), respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB5BCDB1D5B8E4830A7703BB1123A0BED"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11) the

			 following:</text>

				given that term in regulations prescribed by the Secretary of Transportation in

				the administration of this

				chapter;</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC0E9F824494846B19FA45785B04B758B"><enum>(b)</enum><header>Requirement for

			 increased standard</header><text display-inline="yes-display-inline">Section

			 32902(a) of title 49, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID1C75C5385238444182A1512055F65F39"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after

			 <quote><header-in-text level="section" style="OLC">Automobiles</header-in-text>.—</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA8988918CCBA4A689F2E1F4748B3DC56"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote>

			 and inserting <quote>Subject to paragraph (2), the Secretary</quote>;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID80B270E1FE10492D8EB898E4EFBDB41E"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="ID622E104BD3694FCDB0E48396307D8CAA" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID042096E0CD91414F9F704B8000818F4C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The average fuel economy standard for light

				trucks manufactured by a manufacturer may not be less than—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID7930742EFEE34F56BA74D675BCC211D7"><enum>(A)</enum><text display-inline="yes-display-inline">23.5 miles per gallon for model year

				2008;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID51E3C856236E40DFBF7CE0219BFAAE53"><enum>(B)</enum><text display-inline="yes-display-inline">24.8 miles per gallon for model year

				2009;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF9EDD60768B248B2A1FAB704F1D1B0D7"><enum>(C)</enum><text display-inline="yes-display-inline">26.1 miles per gallon for model year 2010;

				and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id319B1BDB5AE5453D89B036A476F3A11F"><enum>(D)</enum><text display-inline="yes-display-inline">27.5 miles per gallon for model year 2011

				and each model year

				thereafter.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2CDB8DD718164ABEABF0778F54242688"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 32902(a)(2) of title 49, United

			 States Code, as added by subsection (b)(3), shall not apply with respect to

			 light trucks manufactured before model year 2009.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID05472B661F2D4398BA76006CEA8DA54E" section-type="subsequent-section"><enum>3.</enum><header>Fuel economy standards

			 for automobiles up to 10,000 pounds gross vehicle weight</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDA9809BF27E8A4E62B3A0BE4B65DD03EB"><enum>(a)</enum><header>Vehicles

			 defined as automobiles</header><text display-inline="yes-display-inline">Section 32901(a)(3) of title 49, United

			 States Code, is amended by striking <quote>rated at—</quote> and all that

			 follows and inserting <quote>rated at not more than 10,000 pounds gross vehicle

			 weight.</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID661BDF711748478CA420E41B567CC694"><enum>(b)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendment made by

			 subsection (a) shall take effect on January 1, 2011.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID702A867125904369AD9D145094277F6D" section-type="subsequent-section"><enum>4.</enum><header>Fuel economy of the

			 Federal fleet of vehicles</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID6BC4053198AE4DE8A1D544EE31A99782"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9551374582DA44E5BEB5395BEDB5ABA1"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>class of vehicles</term>

			 means a class of vehicles for which an average fuel economy standard is in

			 effect under chapter 329 of title 49, United States Code;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB539BB38D3A4D23A97262239C64225F"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>executive agency</term> has

			 the meaning given the term in section 4(1) of the Office of Federal Procurement

			 Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403(1)">41

			 U.S.C. 403(1)</external-xref>); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52C41A7365CA4C5D805044F0CEB003F6"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>new vehicle</term>, with

			 respect to the fleet of vehicles of an executive agency, means a vehicle

			 procured by or for the agency after September 30, 2007.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8277902132F747F3A74E166EF3BE5BD8"><enum>(b)</enum><header>Baseline

			 average fuel economy</header><text display-inline="yes-display-inline">The head

			 of each executive agency shall determine the average fuel economy for all of

			 the vehicles in each class of vehicles in the agency’s fleet of vehicles in

			 fiscal year 2006.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA56B9F4F73CD48F6AFC063055CA1D21D"><enum>(c)</enum><header>Increase of

			 average fuel economy</header><text display-inline="yes-display-inline">The head

			 of each executive agency shall manage the procurement of vehicles in each class

			 of vehicles for that agency to ensure that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID57D4255D4BE442A398007DFEEE672379"><enum>(1)</enum><text display-inline="yes-display-inline">not later than September 30, 2008, the

			 average fuel economy of the new vehicles in the agency’s fleet of vehicles in

			 each class of vehicles is not less than 3 miles per gallon higher than the

			 baseline average fuel economy determined for that class; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7EFC0A7814D44F018E1CEF4871CC06DB"><enum>(2)</enum><text display-inline="yes-display-inline">not later than September 30, 2011, the

			 average fuel economy of the new vehicles in the agency’s fleet of vehicles in

			 each class of vehicles is not less than 6 miles per gallon higher than the

			 baseline average fuel economy determined for that class.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C5CD6840E0042BA9877E1B2245B8DE1"><enum>(d)</enum><header>Calculation of

			 average fuel economy</header><text display-inline="yes-display-inline">For

			 purposes of this section—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id2E32A8FC61424E0CB6A6499200DB6422"><enum>(1)</enum><text display-inline="yes-display-inline">average fuel economy shall be calculated in

			 accordance with guidance prescribed by the Secretary of Transportation for the

			 implementation of this section; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1DC87985F764A5C933A289D1A6105C5"><enum>(2)</enum><text display-inline="yes-display-inline">average fuel economy calculated under

			 subsection (b) for an agency’s vehicles in a class of vehicles shall be the

			 baseline average fuel economy for the agency’s fleet of vehicles in that

			 class.</text>
