			 <quote><short-title>Nuclear Safety and Security Act of

			 2005</short-title></quote>.</text>

			 Commission</header><text display-inline="no-display-inline">In this Act, the

			 term <term>Commission</term> means the Nuclear Regulatory Commission.</text>

			 provisions</header>

			 1954 (42 U.S.C. 2201) is amended—</text>

			 security personnel</header><text display-inline="no-display-inline">The Atomic

			 Energy Act of 1954 is amended by inserting after section 161 (42 U.S.C. 2201)

			 the following:</text>

				security personnel</header>

					<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id38D1388D562B4B568AC05A8774F030C4" reported-display-style="strikethrough"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms

				<quote>handgun</quote>, <quote>rifle</quote>, <quote>shotgun</quote>,

				<quote>firearm</quote>, <quote>ammunition</quote>, <quote>machinegun</quote>,

				<quote>short-barreled shotgun</quote>, and <quote>short-barreled rifle</quote>

				have the meanings given the terms in section 921(a) of title 18, United States

				Code.</text>

					</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id33C1B038AB7E437DBCC219135FDBD564" reported-display-style="strikethrough"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">Notwithstanding subsections (a)(4), (a)(5),

				(b)(2), (b)(4), and (o) of section 922 of title 18, United States Code, section

				925(d)(3) of title 18, United States Code, section 5844 of the Internal Revenue

				Code of 1986, and any law (including regulations) of a State or a political

				subdivision of a State that prohibits the transfer, receipt, possession,

				transportation, importation, or use of a handgun, a rifle, a shotgun, a

				short-barreled shotgun, a short-barreled rifle, a machinegun, a semiautomatic

				assault weapon, ammunition for any such gun or weapon, or a large capacity

				ammunition feeding device, in carrying out the duties of the Commission, the

				Commission may authorize the security personnel of any licensee or certificate

				holder of the Commission (including an employee of a contractor of such a

				licensee or certificate holder) to transfer, receive, possess, transport,

				import, and use 1 or more such guns, weapons, ammunition, or devices, if the

				Commission determines that—</text>

						<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDbb06589a96aa4701be849618cc70858a" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">the authorization is necessary to the

				discharge of the official duties of the security personnel; and</text>

						</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDbd7c0690745a4bd2897ad037040850cd" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">the security personnel—</text>

							<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDdcd86190a88246068040015df12d15cb" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">are not otherwise prohibited from

				possessing or receiving a firearm under Federal or State laws relating to

				possession of firearms by a certain category of persons;</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID1b3d205aefdb4019a936b03507313fda" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">have successfully completed any requirement

				under this section for training in the use of firearms and tactical

				maneuvers;</text>

							</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDbcf4baf5ce124f178eadf2f64542c24e" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">are engaged in the protection of—</text>

								<clause changed="deleted" commented="no" display-inline="no-display-inline" id="ID53b4d9e6ef9d4e63abc81817237e09a2" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">a facility owned or operated by a licensee

				or certificate holder of the Commission that is designated by the Commission;

				or</text>

								</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="IDbbd9c1bb67794574856b7be18209080b" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">radioactive material or other property

				owned or possessed by a licensee or certificate holder of the Commission, or

				that is being transported to or from a facility owned or operated by such a

				licensee or certificate holder, and that has been determined by the Commission

				to be of significance to the common defense and security or public health and

				safety; and</text>

								</clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDf30e88bc43d74e60b555da135157aa1b" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">are discharging the official duties of the

				security personnel in transferring, receiving, possessing, transporting, or

				importing the weapons, ammunition, or devices.</text>

							</subparagraph></paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDb6168a7097ac4f7c8aacbba190a91d2d" reported-display-style="strikethrough"><enum>(c)</enum><header>Background

				checks</header><text display-inline="yes-display-inline">A person that

				receives, possesses, transports, imports, or uses a weapon, ammunition, or a

				device under subsection (b) shall be subject to a background check by the

				Attorney General, based on fingerprints and including a background check under

				section 103(b) of the Brady Handgun Violence Prevention Act (Public Law

				103–159; 18 U.S.C. 922 note) to determine whether the person is prohibited from

				possessing or receiving a firearm under Federal or State law.</text>

					</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID972dfaca342d4597ac8cf0920092b89c" reported-display-style="strikethrough"><enum>(d)</enum><header>Effective

				date</header><text display-inline="yes-display-inline">This section takes

				effect on the date on which regulations are promulgated by the Commission, with

				the approval of the Attorney General, to carry out this

				section.</text>

					</subsection></section><after-quoted-block></after-quoted-block></quoted-block>

		</section><section changed="deleted" commented="no" display-inline="no-display-inline" id="IDc6d923d51b0841bd9e997e9a7dfc920c" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header>Fingerprinting and

			 criminal history record checks</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDc6cc91c92f3847888ab823935ed250b6" reported-display-style="strikethrough"><enum></enum><text display-inline="yes-display-inline">Section 149 of the Atomic Energy Act of

			 1954 (42 U.S.C. 2169) is amended—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID5a4be9008b3e4f6ba8207707cb0ea472" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection a.—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id13B7175041E6483D8E47AA02202B05E6" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>a. The Nuclear</quote>

			 and all that follows through <quote>section 147.</quote> and inserting the

			 following:</text>

						<quoted-block changed="deleted" display-inline="no-display-inline" id="id090BF89EEE044EBC830AB93254ABC979" reported-display-style="strikethrough" style="OLC">

							<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDa8165a21e21b4e52a91a3774f61b4f9e" reported-display-style="strikethrough"><enum>a.</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8D8BFD92BF704D2E997D05C982EE8AA7"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5864E3889C3E41348D136618B81E03D6"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idB7640655BC554575B9DB48DE440A439F"><enum>(i)</enum><text display-inline="yes-display-inline">The Commission shall require each

				individual or entity described in clause (ii) to fingerprint each individual

				described in subparagraph (B) before the individual described in subparagraph

				(B) is permitted access under subparagraph (B).</text>

										</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id9AA84A15978B46968060AECC9D2B1765" indent="up3" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">The individuals and entities referred to in

				clause (i) are individuals and entities that, on or before the date on which an

				individual is permitted access under subparagraph (B)—</text>

											<subclause changed="deleted" commented="no" display-inline="no-display-inline" id="IDfa4278599ef8450e8f4273ce2b7fbb0a" reported-display-style="strikethrough"><enum>(I)</enum><text display-inline="yes-display-inline">are licensed or certified to engage in an

				activity subject to regulation by the Commission;</text>

											</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="ID7aa421729c1d457eaf3eed5306feadc1" reported-display-style="strikethrough"><enum>(II)</enum><text display-inline="yes-display-inline">have filed an application for a license or

				certificate to engage in an activity subject to regulation by the Commission;

				or</text>

											</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="IDef028e03426a499396f705652982e84a" reported-display-style="strikethrough"><enum>(III)</enum><text display-inline="yes-display-inline">have notified the Commission in writing of

				an intent to file an application for licensing, certification, permitting, or

				approval of a product or activity subject to regulation by the

				Commission.</text>

											</subclause></clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDaabb2c6dc58b4a409aefa7c3d5c45930" indent="up2" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">The Commission shall require to be

				fingerprinted any individual who—</text>

										<clause changed="deleted" commented="no" display-inline="no-display-inline" id="ID0d7a9a5876764cae832bef8c3c5920ac" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">is permitted unescorted access to—</text>

											<subclause changed="deleted" commented="no" display-inline="no-display-inline" id="ID46c52125126149bf9f9b7f16a44db46b" reported-display-style="strikethrough"><enum>(I)</enum><text display-inline="yes-display-inline">a utilization facility; or</text>

											</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="ID1a9576ce573b41e2a9c50608f0cb3942" reported-display-style="strikethrough"><enum>(II)</enum><text display-inline="yes-display-inline">radioactive material or other property

				subject to regulation by the Commission that the Commission determines to be of

				such significance to the public health and safety or the common defense and

				security as to warrant fingerprinting and background checks; or</text>

											</subclause></clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="ID16103b2ac00b4a3ab56805eb0948d8b1" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">is permitted access to safeguards

				information under section

				147.</text>

										</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDdb56dcce1efc4d59aab7d4c61651be7c" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>All fingerprints

			 obtained by a licensee or applicant as required in the preceding

			 sentence</quote> and inserting the following:</text>

						<quoted-block changed="deleted" display-inline="no-display-inline" id="id389376C5EB804357AD6AA6B05AB85271" reported-display-style="strikethrough" style="OLC">

							<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDa21767e8861440bc98c51065cd382e19" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">All fingerprints obtained by an individual

				or entity as required in paragraph

				(1)</text>

							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID84047c31ea6441f4afaa22b6ccb2566d" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>The costs of any

			 identification and records check conducted pursuant to the preceding sentence

			 shall be paid by the licensee or applicant.</quote> and inserting the

			 following:</text>

						<quoted-block changed="deleted" display-inline="no-display-inline" id="id19F716B0BE8849BBBF7FFA81167F5B56" reported-display-style="strikethrough" style="OLC">

							<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID1973b839cb94424a9f74b05d31d2db8c" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">The costs of an identification or records

				check under paragraph (2) shall be paid by the individual or entity required to

				conduct the fingerprinting under paragraph

				(1)(A).</text>

							</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID4b7b5e7aa6e342759e6c62f71062a4ad" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">by striking <quote>Notwithstanding any

			 other provision of law, the Attorney General may provide all the results of the

			 search to the Commission, and, in accordance with regulations prescribed under

			 this section, the Commission may provide such results to licensee or applicant

			 submitting such fingerprints.</quote> and inserting the following:</text>

						<quoted-block changed="deleted" display-inline="no-display-inline" id="id57ABB68B857847ECBC1075610CA628DE" reported-display-style="strikethrough" style="OLC">

							<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID9c0700bd65f5429794302b5f64e40d54" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of

				law—</text>

								<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id470E0F8414E7403CAB74E17FC535CCE9" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the Attorney General may provide any result

				of an identification or records check under paragraph (2) to the Commission;

				and</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idC3F5FC580ADA4197B0989B16527A21B8" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the Commission, in accordance with

				regulations prescribed under this section, may provide the results to the

				individual or entity required to conduct the fingerprinting under paragraph

				(1)(A).</text>

								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDe30a7c37dc7843bbaa0a170ba162389b" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection c.—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID114524970fed4733afd1765469ff2dfe" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>, subject to public

			 notice and comment, regulations—</quote> and inserting

			 <quote>requirements—</quote>; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID8d3e9725a07b4c1584ff79fae72f67c1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking

			 “unescorted access to the facility of a licensee or applicant” and inserting

			 <quote>unescorted access to a utilization facility, radioactive material, or

			 other property described in subsection a.(1)(B)</quote>;</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDdb5cd63d07464625964825c77be36c24" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsection d. as

			 subsection e.; and</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD448A64AAC6344CB8B44B9F0E54032D3" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection c. the

			 following:</text>

					<quoted-block changed="deleted" display-inline="no-display-inline" id="idC403C26C91FE401DB8002D54D5447BF2" reported-display-style="strikethrough" style="OLC">

				925(d)(3) of title 18, United States Code, section 5844 of the Internal Revenue

				Code of 1986, and any law (including regulations) of a State or a political

				subdivision of a State that prohibits the transfer, receipt, possession,

				transportation, importation, or use of a handgun, a rifle, a shotgun, a

				short-barreled shotgun, a short-barreled rifle, a machinegun, a semiautomatic

				assault weapon, ammunition for any such gun or weapon, or a large capacity

				ammunition feeding device, in carrying out the duties of the Commission, the

				Commission may authorize the security personnel of any licensee or certificate

				holder of the Commission (including an employee of a contractor of such a

				licensee or certificate holder) to transfer, receive, possess, transport,

				import, and use 1 or more such guns, weapons, ammunition, or devices, if the

				Commission determines that—</text>

							<paragraph changed="added" commented="no" display-inline="no-display-inline" id="id7971717f-669e-4464-8345-a4d092b80e37" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">the authorization is necessary to the

				discharge of the official duties of the security personnel; and</text>

								</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id88f2377d-f45f-4ebb-9c25-b29fefadaed2" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">have successfully completed any requirement

				under this section for training in the use of firearms and tactical

				maneuvers;</text>

								</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id97635c4b-d216-4985-897a-834642998733" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">are engaged in the protection of—</text>

									<clause changed="added" commented="no" display-inline="no-display-inline" id="id35f72c53-9176-4889-b2bc-2eac3e205e32" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">a facility owned or operated by a licensee

				or certificate holder of the Commission that is designated by the Commission;

				or</text>

				licensee or certificate holder, and that has been determined by the Commission

				to be of significance to the common defense and security or public health and

				safety; and</text>

									</clause></subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id4c5f15cd-1613-43de-b860-cfbaede9aa9a" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">are discharging the official duties of the

				security personnel in transferring, receiving, possessing, transporting, or

				importing the weapons, ammunition, or devices.</text>

								</subparagraph></paragraph></subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="idea7dcd30-91aa-458d-835d-59bbc6147b72" reported-display-style="italic"><enum>c.</enum><header>Background

				checks</header><text display-inline="yes-display-inline">A person that

				receives, possesses, transports, imports, or uses a weapon, ammunition, or a

				device under subsection (b) shall be subject to a background check by the

				Attorney General, based on fingerprints and including a background check under

				section 103(b) of the Brady Handgun Violence Prevention Act (Public Law

				103–159; 18 U.S.C. 922 note) to determine whether the person is prohibited from

				possessing or receiving a firearm under Federal or State law.</text>

						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="id6b869add-e294-44da-9515-2381b1a60612" reported-display-style="italic"><enum>d.</enum><header>Effective

				date</header><text display-inline="yes-display-inline">This section takes

				effect on the date on which guidelines are issued by the Commission, with the

				approval of the Attorney General, to carry out this

				section.</text>

			 criminal history record checks</header>

				<subsection changed="added" commented="no" display-inline="no-display-inline" id="id1a4f796b-8509-45b6-8481-db460f9ea382" reported-display-style="italic"><enum></enum><text display-inline="yes-display-inline">Section 149 of the Atomic Energy Act of

			 1954 (42 U.S.C. 2169) is amended—</text>

					<paragraph changed="added" commented="no" display-inline="no-display-inline" id="id0c8f567e-a98a-4c67-9c93-f9aad6cc3d95" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection a.—</text>

				individual is permitted access under subparagraph (B)—</text>

												<subclause changed="added" commented="no" display-inline="no-display-inline" id="idd481dede-c7eb-494c-af7d-b2765295f11b" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">are licensed or certified to engage in an

				activity subject to regulation by the Commission;</text>

												</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="id7d57058f-3972-4485-8f81-92f68a2d727b" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">have filed an application for a license or

				certificate to engage in an activity subject to regulation by the Commission;

				or</text>

												</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="id964c94db-1bc0-461e-b194-f122129626e6" reported-display-style="italic"><enum>(III)</enum><text display-inline="yes-display-inline">have notified the Commission in writing of

				an intent to file an application for licensing, certification, permitting, or

				approval of a product or activity subject to regulation by the

				Commission.</text>

												</subclause></clause></subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="idc1e5cf96-90c6-466c-841f-21141fb00143" indent="up2" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The Commission shall require to be

				fingerprinted any individual who—</text>

											<clause changed="added" commented="no" display-inline="no-display-inline" id="id20612ca9-06b6-434b-bd0a-40acc5a19a5c" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">is permitted unescorted access to—</text>

												<subclause changed="added" commented="no" display-inline="no-display-inline" id="id0ab52f02-8d16-462f-af88-cc244ba85ae0" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">a utilization facility; or</text>

												</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="ide2c4a669-d4bd-47b7-b773-5ff0a962dfd9" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">radioactive material or other property

				subject to regulation by the Commission that the Commission determines to be of

				such significance to the public health and safety or the common defense and

				security as to warrant fingerprinting and background checks; or</text>

												</subclause></clause><clause changed="added" commented="no" display-inline="no-display-inline" id="id32c0a95d-5928-4a6b-9a3e-9bc87219e2d4" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">is permitted access to safeguards

				information under section

				147.</text>

											</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

						</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id48ee41ac-04ec-4869-9f99-80ad90a35ae0" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>All fingerprints

			 identification and records check conducted pursuant to the preceding sentence

			 shall be paid by the licensee or applicant.</quote> and inserting the

			 following:</text>

				check under paragraph (2) shall be paid by the individual or entity required to

				conduct the fingerprinting under paragraph

				(1)(A).</text>

								</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

						</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id90b1e929-d6ed-48a8-b383-632f681f5d67" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">by striking <quote>Notwithstanding any

			 other provision of law, the Attorney General may provide all the results of the

			 search to the Commission, and, in accordance with regulations prescribed under

			 this section, the Commission may provide such results to licensee or applicant

			 submitting such fingerprints.</quote> and inserting the following:</text>

							<quoted-block changed="added" display-inline="no-display-inline" id="id99c6c4d0-5158-4066-aa9d-565ec1d16147" reported-display-style="italic" style="OLC">

								<paragraph changed="added" commented="no" display-inline="no-display-inline" id="ided47fd9f-2b51-40e2-a11b-1362e25437fc" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of

				law—</text>

									<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id06acbd06-464b-470f-894d-bf592e13164e" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">the Attorney General may provide any result

				of an identification or records check under paragraph (2) to the Commission;

				and</text>

									</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id8539fba6-a561-461c-a5ad-0817a3a34ada" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">the Commission, in accordance with

				regulations prescribed under this section, may provide the results to the

				individual or entity required to conduct the fingerprinting under paragraph

				(1)(A).</text>

									</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

						</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id7199ae6b-ad25-498e-b1a5-4092e4d84773" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection c.—</text>

						<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id61a2a6bb-1472-427d-b8ce-78819a854148" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>, subject to public

			 notice and comment, regulations—</quote> and inserting

			 <quote>requirements—</quote>; and</text>

						</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id0ec38ce7-f233-421f-919e-6d1946c00d49" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking

			 “unescorted access to the facility of a licensee or applicant” and inserting

			 <quote>unescorted access to a utilization facility, radioactive material, or

			 other property described in subsection a.(1)(B)</quote>;</text>

						</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id7a5e643c-9911-4fc0-a76d-9bc528d13397" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsection d. as

			 subsection e.; and</text>

					</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id5b743528-faf7-4d9d-b32e-57cc7b3b5ed6" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection c. the

			 following:</text>

				individual to conduct fingerprinting under subsection a.(1) by authorizing or

				requiring the use of any alternative biometric method for identification that

				has been approved by—</text>

			 design basis threat rulemaking</header>

				<subsection changed="added" id="ID10C6A7413C824712BEB6762772F855E9" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text>Chapter 14 of the <act-name parsable-cite="AEA54">Atomic

			 Energy Act of 1954</act-name> (42 U.S.C. 2201 et seq.) is amended by adding at

			 the end the following:</text>

							<subsection changed="added" id="ID4f7fff19403f465c8f45c66b4cef3982" reported-display-style="italic"><enum>a.</enum><header>Security response

				evaluations</header><text>Not less often than once every 3 years, the

				Commission shall conduct security evaluations at each licensed facility that is

				part of a class of licensed facilities, as the Commission considers to be

				appropriate to assess the ability of a private security force of a licensed

				facility to defend against any applicable design basis threat.</text>

							</subsection><subsection changed="added" id="ID7c34fabe491b4e05bbf98a4a6f1384ac" reported-display-style="italic"><enum>b.</enum><header>Force-on-Force

				exercises</header><paragraph commented="no" display-inline="yes-display-inline" id="id0F4926A298E04BC4B74591EC66144CE9"><enum>(1)</enum><text>The security

				evaluations shall include force-on-force exercises.</text>

								</paragraph><paragraph changed="added" id="ID2c7040cb118348619efc227b9ed058df" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The

				force-on-force exercises shall, to the maximum extent practicable, simulate

				security threats in accordance with any design basis threat applicable to a

				facility.</text>

								</paragraph><paragraph changed="added" id="ID760b05bd8b654ca785eb06c80e562fa3" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>In

				conducting a security evaluation, the Commission shall mitigate any potential

				conflict of interest that could influence the results of a force-on-force

				exercise, as the Commission determines to be necessary and appropriate.</text>

								</paragraph></subsection><subsection changed="added" id="ID0bc60cc5c691403b99781dbde987bc3f" reported-display-style="italic"><enum>c.</enum><header>Action by

				licensees</header><text>The Commission shall ensure that an affected licensee

				corrects any defect in performance identified by the Commission in a security

				response evaluation.</text>

							</subsection><subsection changed="added" id="IDb7c2ad70e07b48c9a11f541d5e0aeec5" reported-display-style="italic"><enum>d.</enum><header>Facilities under

				heightened threat levels</header><text>The Commission may suspend a security

				evaluation under this section if the Commission determines that the evaluation

				would compromise security at a nuclear facility under a heightened threat

				level.</text>

							</subsection><subsection changed="added" id="ID3eabe2bc34064e609875ce6c7ef99ef4" reported-display-style="italic"><enum>e.</enum><header>Report</header><text>Not

				less often than once each year, the Commission shall submit to the Committee on

				Environment and Public Works of the Senate and the Committee on Energy and

				Commerce of the House of Representatives a report, in classified form and

				unclassified form, that describes the results of each security response

				evaluation conducted and any relevant corrective action taken by a licensee

				during the previous year.</text>

							</subsection></section><section changed="added" id="ID04844a72ea484f4e9ef218e390db81fb" reported-display-style="italic"><enum>170D.</enum><header>Design basis threat

				rulemaking</header><text display-inline="no-display-inline">The Commission

				shall—</text>

							<paragraph changed="added" id="id981DEB65F5A94F2E8ED1509B10FAB9D5" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of

				enactment of this section, initiate a rulemaking proceeding, to be completed

				not later than 18 months after that date, to revise the design basis threats of

				the Commission; or</text>

							</paragraph><paragraph changed="added" id="id27DFB5E4485146129738B98C1391AA6B" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of

				enactment of this section, complete any ongoing rulemaking to revise the design

				basis

				threats.</text>

				entitled the <quote>Code of Conduct on the Safety and Security of Radioactive

				Sources</quote>, approved by the Board of Governors of the International Atomic

				Energy Agency and dated September 8, 2003.</text>

								</paragraph><paragraph changed="added" id="id1ED349FB9E094F4CBB8C6791E03B5659" reported-display-style="italic"><enum>(2)</enum><header>Radiation

				source</header><text>The term <term>radiation source</term> means—</text>

									<subparagraph changed="added" id="idA124BA8A0EC84A82BA9ABD70FFFB8C66" reported-display-style="italic"><enum>(A)</enum><text>a Category 1 Source or a

				Category 2 Source, as defined in the Code of Conduct; and</text>

									</subparagraph><subparagraph changed="added" id="idF5069EB7E26C4DF6B732842DC73D0D6F" reported-display-style="italic"><enum>(B)</enum><text>any other material that

				poses a threat such that the material is subject to this section, as determined

				by the Commission, by regulation.</text>

									</subparagraph></paragraph></subsection><subsection changed="added" id="ID4B6F7AA04ABB487B90CADF23E6374C24" reported-display-style="italic"><enum>b.</enum><header>Commission

				approval</header><text>Not later than 180 days after the date of enactment of

				this section, the Commission shall issue regulations prohibiting a person

				from—</text>

								<paragraph changed="added" id="IDD57D68B032454EF6A8A5C4851279BFF9" reported-display-style="italic"><enum>(1)</enum><text>exporting a radiation

				source, unless the Commission has specifically determined under section 57 or

				82, consistent with the Code of Conduct, with respect to the exportation,

				that—</text>

									<subparagraph changed="added" id="IDF1314D6B04264FF3ABCEA5EEF5BE9BAA" reported-display-style="italic"><enum>(A)</enum><text>the recipient of the

				radiation source may receive and possess the radiation source under the laws

				and regulations of the country of the recipient;</text>

									</subparagraph><subparagraph changed="added" id="ID9D5FE187215149AD98EB9831811060A9" reported-display-style="italic"><enum>(B)</enum><text>the recipient country has

				the appropriate technical and administrative capability, resources, and

				regulatory structure to ensure that the radiation source will be managed in a

				safe and secure manner; and</text>

									</subparagraph><subparagraph changed="added" id="idD59C4050FF2C45BF9E5DB512FC90A197" reported-display-style="italic"><enum>(C)</enum><text>before the date on which

				the radiation source is shipped—</text>

										<clause changed="added" id="id9F2E7258C0B84474BD876778F79EEBB6" reported-display-style="italic"><enum>(i)</enum><text>a notification has been

				provided to the recipient country; and</text>

										</clause><clause changed="added" id="idBE66ABC2BB77439CB3392CABE0D54AA2" reported-display-style="italic"><enum>(ii)</enum><text>a notification has been

				received from the recipient country, as the Commission determines to be

				appropriate;</text>

										</clause></subparagraph></paragraph><paragraph changed="added" id="ID050D61EE4327445CBE758DF9FEBA9F42" reported-display-style="italic"><enum>(2)</enum><text>importing a radiation

				source, unless the Commission has determined, with respect to the importation,

				that—</text>

									<subparagraph changed="added" id="IDA49A1F959C0349448C20DB34DFBD0648" reported-display-style="italic"><enum>(A)</enum><text>the proposed recipient is

				authorized by law to receive the radiation source; and</text>

									</subparagraph><subparagraph changed="added" id="IDDDECB97623FB4032BEE803AE552D2A74" reported-display-style="italic"><enum>(B)</enum><text>the shipment will be made

				in accordance with any applicable Federal or State law or regulation;

				and</text>

									</subparagraph></paragraph><paragraph changed="added" id="IDE3FA1CD8966D47ABB027872B089A4244" reported-display-style="italic"><enum>(3)</enum><text>selling or otherwise

				transferring ownership of a radiation source, unless the Commission—</text>

									<subparagraph changed="added" id="IDF45B42B878CB48D38766C9E00D8E2C2A" reported-display-style="italic"><enum>(A)</enum><text>has determined that the

				licensee has verified that the proposed recipient is authorized under law to

				receive the radiation source; and</text>

									</subparagraph><subparagraph changed="added" id="IDBC75BDEF83684F84B06F0CA33AE4DF9B" reported-display-style="italic"><enum>(B)</enum><text>has required that the

				transfer shall be made in accordance with any applicable Federal or State law

				or regulation.</text>

									</subparagraph></paragraph></subsection><subsection changed="added" id="IDFEE7B8EB2ACA44A4A2ACAD76504AED5F" reported-display-style="italic"><enum>c.</enum><header>Tracking

				system</header><paragraph commented="no" display-inline="yes-display-inline" id="idE0CF7DAF1C574D1CA9543E0F59EB9956"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0B480082F1C4485599E87EE05CC5C1C3"><enum>(A)</enum><text>Not later than 1 year

				after the date of enactment of this section, the Commission shall issue

				regulations establishing a mandatory tracking system for radiation sources in

				the United States.</text>

									</subparagraph><subparagraph changed="added" id="idF60BE6F9F35241FD9360293369D44999" indent="up2" reported-display-style="italic"><enum>(B)</enum><text>In

				establishing the tracking system under subparagraph (A), the Commission shall

				coordinate with the Secretary of Transportation to ensure compatibility, to the

				maximum extent practicable, between the tracking system and any system

				established by the Secretary of Transportation to track the shipment of

				radiation sources.</text>

									</subparagraph></paragraph><paragraph changed="added" id="id54FE7A79E138491F8B7527FE0D36D319" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The

				tracking system under paragraph (1) shall—</text>

									<subparagraph changed="added" id="ID80B7056ECF9241DFA3203F138981ACFC" indent="down1" reported-display-style="italic"><enum>(A)</enum><text>enable the identification

				of each radiation source by serial number or other unique identifier;</text>

									</subparagraph><subparagraph changed="added" id="ID5BD8147C1EC945DDA16958094782DB37" indent="down1" reported-display-style="italic"><enum>(B)</enum><text>require reporting within

				7 days of any change of ownership or geographic location of a radiation

				source;</text>

									</subparagraph><subparagraph changed="added" id="ID9F18122B88094420B596E1E8B4F8F744" indent="down1" reported-display-style="italic"><enum>(C)</enum><text>require reporting within

				24 hours of any loss of control of, or accountability for, a radiation source;

				and</text>

									</subparagraph><subparagraph changed="added" id="ID6E12AED0288B4B1AB4A1F5E2981883C9" indent="down1" reported-display-style="italic"><enum>(D)</enum><text>provide for reporting

				under subparagraphs (B) and (C) through a secure Internet connection.</text>

									</subparagraph></paragraph></subsection><subsection changed="added" id="ID452F6AA9482745E1A5D236176423D913" reported-display-style="italic"><enum>d.</enum><header>Penalty</header><text>A

				violation of a regulation issued under subsection a. or b. shall be punishable

				by a civil penalty not to exceed $1,000,000.</text>

							</subsection><subsection changed="added" id="IDDC0ACC8666BD4F95A9DC7D794D2D1937" reported-display-style="italic"><enum>e.</enum><header>National Academy of

				Sciences study</header><paragraph commented="no" display-inline="yes-display-inline" id="id0ED9F1975C594EADA0199D40FCCC067D"><enum>(1)</enum><text>Not later than 60 days

				after the date of enactment of this section, the Commission shall enter into an

				arrangement with the National Academy of Sciences under which the National

				Academy of Sciences shall conduct a study of industrial, research, and

				commercial uses for radiation sources.</text>

								</paragraph><paragraph changed="added" id="id56F5ED434A0E41DD82C17B9312622F84" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The

				study under paragraph (1) shall include a review of uses of radiation sources

				in existence on the date on which the study is conducted, including an

				identification of any industrial or other process that—</text>

									<subparagraph changed="added" id="id797DCE73365346D7B02E93757AC1BABC" reported-display-style="italic"><enum>(A)</enum><text>uses a

				radiation source that could be replaced with an economically and technically

				equivalent (or improved) process that does not require the use of a radiation

				source; or</text>

									</subparagraph><subparagraph changed="added" id="id7B7A76F3A1DD44EBBFE62A8B7D3D9181" reported-display-style="italic"><enum>(B)</enum><text>may be

				used with a radiation source that would pose a lower risk to public health and

				safety in the event of an accident or attack involving the radiation

				source.</text>

									</subparagraph></paragraph><paragraph changed="added" id="idF3CF89ED5E7648C4903378E70FC906AB" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>Not

				later than 2 years after the date of enactment of this section, the Commission

				shall submit to Congress the results of the study under paragraph (1).</text>

								</paragraph></subsection><subsection changed="added" id="ID04A40CC54CDD4D4490294141714E6DC7" reported-display-style="italic"><enum>f.</enum><header>Task force on radiation

				source protection and security</header><paragraph commented="no" display-inline="yes-display-inline" id="idB0A5208CE6934CDDA1AD5EBE0B427189"><enum>(1)</enum><text>There is established a

				task force on radiation source protection and security (referred to in this

				section as the <quote>task force</quote>).</text>

								</paragraph><paragraph changed="added" id="ID5517677F31FE4A98A88E8E8342229C00" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF2556D072DC245D7B5DB5BE27350A3B5"><enum>(A)</enum><text>The chairperson of the

				task force shall be the Chairperson of the Commission (or a designee).</text>

										</clause></subparagraph></paragraph><paragraph changed="added" id="IDD3B173528DF4476EB4DA8B230D3DA678" indent="up1" reported-display-style="italic"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB54D9A8E711E413DB46CA85DFA500EE9"><enum>(A)</enum><text>The task force, in

				consultation with Federal, State, and local agencies, the Conference of

				Radiation Control Program Directors, and the Organization of Agreement States,

				and after public notice and an opportunity for comment, shall evaluate, and

				provide recommendations relating to, the security of radiation sources in the

				United States from potential terrorist threats, including acts of sabotage,

				theft, or use of a radiation source in a radiological dispersal device.</text>

									</subparagraph><subparagraph changed="added" id="ID2A258A3EF3404886A2B2F32BDFB86D2C" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Not

				later than 1 year after the date of enactment of this section, and not less

				than once every 4 years thereafter, the task force shall submit to Congress and

				the President a report, in unclassified form with a classified annex if

				necessary, providing recommendations, including recommendations for appropriate

				regulatory and legislative changes, for—</text>

										<clause changed="added" id="IDD7F1D7CEFBA14D5F9DA11729E8751210" reported-display-style="italic"><enum>(i)</enum><text>a list

				of additional radiation sources that should be required to be secured under

				this Act, based on the potential attractiveness of the sources to terrorists

				and the extent of the threat to public health and safety of the sources, taking

				into consideration—</text>

											<subclause changed="added" id="id12EFB71725C741A49E0F239DE88C79F4" reported-display-style="italic"><enum>(I)</enum><text>radiation source

				radioactivity levels;</text>

											</subclause><subclause changed="added" id="id8A3E527DAB3E4CDAA09131EF763CA8B0" reported-display-style="italic"><enum>(II)</enum><text>radioactive half-life of

				a radiation source;</text>

											</subclause><subclause changed="added" id="id81CB325FC7404968A01176F2699B60CD" reported-display-style="italic"><enum>(III)</enum><text>dispersability;</text>

											</subclause><subclause changed="added" id="idEE26EF53FF0441839B181E0BCE48A281" reported-display-style="italic"><enum>(IV)</enum><text>chemical and material

				form;</text>

											</subclause><subclause changed="added" id="id3DE2410790134421A549AD192539C3A8" reported-display-style="italic"><enum>(V)</enum><text>for

				radioactive materials with a medical use, the availability of the sources to

				physicians and patients for medical treatment; and</text>

											</subclause><subclause changed="added" id="id82EFECE0629A47B785E49E31D1146BF8" reported-display-style="italic"><enum>(VI)</enum><text>any other factor that

				the Chairperson of the Commission determines to be appropriate;</text>

											</subclause></clause><clause changed="added" id="ID94E4107D439D4C4A8DDBE5FA5430CE60" reported-display-style="italic"><enum>(ii)</enum><text>the

				establishment of, or modifications to, a national system for recovery of lost

				or stolen radiation sources;</text>

										</clause><clause changed="added" id="ID60A884F5E06641AAB56674D50313B42D" reported-display-style="italic"><enum>(iii)</enum><text>the

				storage of radiation sources that are not used in a safe and secure manner as

				of the date on which the report is submitted;</text>

										</clause><clause changed="added" id="IDDD204F4B28D04E04A596134216F79445" reported-display-style="italic"><enum>(iv)</enum><text>modifications to the

				national tracking system for radiation sources;</text>

										</clause><clause changed="added" id="IDCF7731DC53C74310B3EC3BCBECA6F4D6" reported-display-style="italic"><enum>(v)</enum><text>the

				establishment of, or modifications to, a national system (including user fees

				and other methods) to provide for the proper disposal of radiation sources

				secured under this Act;</text>

										</clause><clause changed="added" id="ID394AA18CD09640339782209481D365EC" reported-display-style="italic"><enum>(vi)</enum><text>modifications to export

				controls on radiation sources to ensure that foreign recipients of radiation

				sources are able and willing to adequately control radiation sources from the

				United States;</text>

										</clause><clause changed="added" id="ID524E881EB196463ABB718ED77F6895B9" reported-display-style="italic"><enum>(vii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id6FBB8039F2CA4F8DADB0B8271A963A7B"><enum>(I)</enum><text>any alternative

				technologies available as of the date on which the report is submitted that may

				perform some or all of the functions performed by devices or processes that

				employ radiation sources; and</text>

											</subclause><subclause changed="added" id="idEF8076A08D894D5BBB4FDC4849B90002" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>the

				establishment of appropriate regulations and incentives for the replacement of

				the devices and processes described in subclause (I)—</text>

												<item changed="added" id="id0917C70116E7416CB056D421BCCD848B" reported-display-style="italic"><enum>(aa)</enum><text>with alternative

				technologies in order to reduce the number of radiation sources in the United

				States; or</text>

												</item><item changed="added" id="id6F86775DCD5A4038A55FB7A54655EC86" reported-display-style="italic"><enum>(bb)</enum><text>with radiation sources

				that would pose a lower risk to public health and safety in the event of an

				accident or attack involving the radiation source; and</text>

												</item></subclause></clause><clause changed="added" id="ID7039DFA04B73430C8564C34A13CFA725" reported-display-style="italic"><enum>(viii)</enum><text>the

				creation of, or modifications to, procedures for improving the security of use,

				transportation, and storage of radiation sources, including—</text>

											<subclause changed="added" id="id09EF07C908684D24B1F48A82255CB279" reported-display-style="italic"><enum>(I)</enum><text>periodic audits or

				inspections by the Commission to ensure that radiation sources are properly

				secured and can be fully accounted for;</text>

											</subclause><subclause changed="added" id="id3AEF448601D14C209F131D6E2020365D" reported-display-style="italic"><enum>(II)</enum><text>evaluation of the

				security measures by the Commission;</text>

											</subclause><subclause changed="added" id="id7198E84151F04DBBA25DD9767B40E89F" reported-display-style="italic"><enum>(III)</enum><text>increased fines for

				violations of Commission regulations relating to security and safety measures

				applicable to licensees that possess radiation sources;</text>

											</subclause><subclause changed="added" id="id2F2E5F11554B4129B23AB9CE5E119C0A" reported-display-style="italic"><enum>(IV)</enum><text>criminal and security

				background checks for certain individuals with access to radiation sources

				(including individuals involved with transporting radiation sources);</text>

											</subclause><subclause changed="added" id="id7CA8CD4336C14085874936493329D686" reported-display-style="italic"><enum>(V)</enum><text>requirements for

				effective and timely exchanges of information relating to the results of

				criminal and security background checks between the Commission and any State

				with which the Commission has entered into an agreement under section 274

				b.;</text>

											</subclause><subclause changed="added" id="idF735EE72944F4BE7A5B60470289A0EF0" reported-display-style="italic"><enum>(VI)</enum><text>assurances of the

				physical security of facilities that contain radiation sources (including

				facilities used to temporarily store radiation sources being transported);

				and</text>

											</subclause><subclause changed="added" id="idC99FFFF98E574DB189E09F557B74F545" reported-display-style="italic"><enum>(VII)</enum><text>the screening of

				shipments to facilities that the Commission determines to be particularly at

				risk for sabotage of radiation sources to ensure that the shipments do not

				contain explosives.</text>

											</subclause></clause></subparagraph></paragraph></subsection><subsection changed="added" id="IDB4E91D40FFFF4B5D89A2A32DEB25DCBA" reported-display-style="italic"><enum>g.</enum><header>Action by

				Commission</header><text>Not later than 60 days after the date of receipt by

				Congress and the President of a report under subsection f.(3)(B), the

				Commission, in accordance with the recommendations of the task force,

				shall—</text>

				Commission determines to be appropriate, including revising the system of the

			 general</header><text>Not later than 18 months after the date of enactment of

			 this Act, the Commission, after consultation with States and other

			 stakeholders, shall issue final regulations establishing such requirements as

			 the Commission determines to be necessary to carry out this Act and the

			 amendments made by this Act.</text>

						</subparagraph><subparagraph changed="added" id="id1E04EB29B35E45D6B5BC43B0B9550D79" reported-display-style="italic"><enum>(B)</enum><header>Inclusions</header><text>The

			 regulations shall include a definition of the term <term>discrete source</term>

			 for purposes of paragraphs (3) and (4) of section 11 e. of the

			 <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C.

			 2014(e)) (as amended by subsection (a)).</text>

						</subparagraph></paragraph><paragraph changed="added" id="ID16EDB499C7EB4066AA0DCD4D6E9EBE10" reported-display-style="italic"><enum>(2)</enum><header>Cooperation</header><text>In

			 promulgating regulations under paragraph (1), the Commission shall, to the

			 maximum extent practicable—</text>

						<subparagraph changed="added" id="id7E992019FCEB4BA7A4D2CBFACE5CD128" reported-display-style="italic"><enum>(A)</enum><text>cooperate with States;

			 and</text>

						</subparagraph><subparagraph changed="added" id="idC7FF320ECC764DE0997E00384330F3D2" reported-display-style="italic"><enum>(B)</enum><text>use model State standards

			 in existence on the date of enactment of this Act.</text>

						</subparagraph></paragraph><paragraph changed="added" id="ID55F980ACD35741C08F6783B2D0826BD5" reported-display-style="italic"><enum>(3)</enum><header>Transition

			 plan</header>

						<subparagraph changed="added" id="id0A14E608AA01475F92FFE6480AC59308" reported-display-style="italic"><enum>(A)</enum><header>Definition of byproduct

			 material</header><text>In this paragraph, the term <term>byproduct

			 material</term> has the meaning given the term in paragraphs (3) and (4) of

			 section 11 e. of the <act-name parsable-cite="AEA54">Atomic Energy Act of

			 1954</act-name> (42 U.S.C. 2014(e)) (as amended by subsection (a)).</text>

						</subparagraph><subparagraph changed="added" id="id97C9E3C1FBE644868D16D8DEA68153F1" reported-display-style="italic"><enum>(B)</enum><header>Preparation and

			 publication</header><text>To facilitate an orderly transition of regulatory

			 authority with respect to byproduct material, the Commission, in issuing

			 regulations under paragraph (1), shall prepare and publish a transition plan

			 for—</text>

							<clause changed="added" id="ID382F1791CAA7499EB923E5A50CDBD1BD" reported-display-style="italic"><enum>(i)</enum><text>States that have not,

			 before the date on which the plan is published, entered into an agreement with

			 the Commission under section 274 b. of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C. 2021(b));

			 and</text>

							</clause><clause changed="added" id="ID0F448CECBFE146109FA1570FAAD4F31A" reported-display-style="italic"><enum>(ii)</enum><text>States that have entered

			 into an agreement with the Commission under that section before the date on

			 which the plan is published.</text>

							</clause></subparagraph><subparagraph changed="added" id="id39632A70C0024850831FF4993897D4CF" reported-display-style="italic"><enum>(C)</enum><header>Inclusions</header><text>The

			 transition plan under subparagraph (B) shall include—</text>

							<clause changed="added" id="id51FA959E448842029EDFC5024D07BC60" reported-display-style="italic"><enum>(i)</enum><text>a description of the

			 conditions under which a State may exercise authority over byproduct material;

			 and</text>

							</clause><clause changed="added" id="idB90D734ADE0A45CFAEBE22459C874FBD" reported-display-style="italic"><enum>(ii)</enum><text>a statement of the

			 Commission that any agreement covering byproduct material, as defined in

			 paragraph (1) or (2) of section 11e. of the Atomic Energy Act of 1954 (42

			 U.S.C. 2014(e)), entered into between the Commission and a State under section

			 274 b. of that Act (42 U.S.C. 2021(b)) before the date of publication of the

			 transition plan shall be considered to include byproduct material, as defined

			 in paragraph (3) or (4) of section 11e. of that Act (42 U.S.C. 2014(e)) (as

			 amended by subsection (a)), if the Governor of the State certifies to the

			 Commission on the date of publication of the transition plan that—</text>

								<subclause changed="added" id="idFF3C7CF309874EA4A705F9DE74F450A9" reported-display-style="italic"><enum>(I)</enum><text>the State has a program

			 for licensing byproduct material, as defined in paragraph (3) or (4) of section

			 11e. of the Atomic Energy Act of 1954, that is adequate to protect the public

			 health and safety, as determined by the Commission; and</text>

								</subclause><subclause changed="added" id="idE715E663DC0E41CA8895E2AD1C070121" reported-display-style="italic"><enum>(II)</enum><text>the State intends to

			 continue to implement the regulatory responsibility of the State with respect

			 to the byproduct material.</text>

								</subclause></clause></subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="ID98D468F9EAEF4C15B691E65F9A311BC8" reported-display-style="italic"><enum>(4)</enum><header>Availability of

			 radiopharmaceuticals</header><text>In promulgating regulations under paragraph

			 (1), the Commission shall consider the impact on the availability of

			 radiopharmaceuticals to—</text>

						<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id31E28B65A8B24611B66973D0F2BE1BE9" reported-display-style="italic"><enum>(A)</enum><text>physicians; and</text>

						</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="idD08AF7C7232A44529514363E6988B431" reported-display-style="italic"><enum>(B)</enum><text>patients the medical

			 treatment of which relies on radiopharmaceuticals.</text>

						</subparagraph></paragraph></subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="id90B84BC244A44E8C917EEF6618C8ABC0" reported-display-style="italic"><enum>(e)</enum><header>Waivers</header>

					<paragraph changed="added" commented="no" display-inline="no-display-inline" id="idC2A53B7B2700421EA8F2B8EEE500ECB2" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>Except as provided in paragraph (2), the Commission may

			 grant a waiver to any entity of any requirement under this section or an

			 amendment made by this section with respect to a matter relating to byproduct

			 material (as defined in paragraphs (3) and (4) of section 11 e. of the

			 <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C.

			 2014(e)) (as amended by subsection (a))) if the Commission determines that the

			 waiver is in accordance with the protection of the public health and safety and

			 the promotion of the common defense and security.</text>

					</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id03A8FFCFC7A2419C83B81EE56A3904EA" reported-display-style="italic"><enum>(2)</enum><header>Exceptions</header>

						<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="idB6E40A83C63E4AD08B64C97ECE370652" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text>The Commission may not grant a waiver under paragraph (1)

			 with respect to—</text>

							<clause changed="added" commented="no" display-inline="no-display-inline" id="id01E3E3B099534797A3045D5570E854D9" reported-display-style="italic"><enum>(i)</enum><text>any requirement under the

			 amendments made by subsection (c)(1);</text>

							</clause><clause changed="added" commented="no" display-inline="no-display-inline" id="idA5C7C50330774288B7EC2D08B3CE0AC8" reported-display-style="italic"><enum>(ii)</enum><text>a matter relating to an

			 importation into, or exportation from, the United States for a period ending

			 after the date that is 1 year after the date of enactment of this Act;

			 or</text>

							</clause><clause changed="added" commented="no" display-inline="no-display-inline" id="idC1553AA63E16402DA7AA727A6D703F3A" reported-display-style="italic"><enum>(iii)</enum><text>any other matter for a

			 period ending after the date that is 4 years after the date of enactment of

			 this Act.</text>

							</clause></subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id664AFF3FBED94B4895A6D793DAEB0F82" reported-display-style="italic"><enum>(B)</enum><header>Waivers to

			 States</header><text>The Commission shall terminate any waiver granted to a

			 State under paragraph (1) if the Commission determines that—</text>

							<clause changed="added" commented="no" display-inline="no-display-inline" id="id2FE8B0F7FA8147EFBF60557E97A67928" reported-display-style="italic"><enum>(i)</enum><text>the State has entered

			 into an agreement with the Commission under section 274 b. of the Atomic Energy

			 Act of 1954 (42 U.S.C. 2021(b));</text>

							</clause><clause changed="added" commented="no" display-inline="no-display-inline" id="idCE0B367A14B94B52A4D4E907799166F3" reported-display-style="italic"><enum>(ii)</enum><text>the agreement described

			 in clause (i) covers byproduct material (as described in paragraph (3) or (4)

			 of section 11 e. of the <act-name parsable-cite="AEA54">Atomic Energy Act of

			 1954</act-name> (42 U.S.C. 2014(e)) (as amended by subsection (a))); and</text>

							</clause><clause changed="added" commented="no" display-inline="no-display-inline" id="id54EF2B90907A437FA531233558B42D14" reported-display-style="italic"><enum>(iii)</enum><text>the program of the

			 State for licensing such byproduct material is adequate to protect the public

			 health and safety.</text>

							</clause></subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id40B4DB0A31C04C35A236E92C7534C53A" reported-display-style="italic"><enum>(3)</enum><header>Publication</header><text>The

			 Commission shall publish in the Federal Register a notice of any waiver granted

			 under this subsection.</text>
