				nuclear reactor financial obligations</header><text>Notwithstanding any other

				provision of this title—</text>

				assets held by a licensee or former licensee of the Nuclear Regulatory

				Commission, or by any other person, to satisfy the responsibility of the

				licensee, former licensee, or any other person to comply with a regulation or

				order of the Nuclear Regulatory Commission governing the decontamination and

				decommissioning of a nuclear power reactor licensed under section 103 or 104 b.

				of the Atomic Energy Act of 1954 (42 U.S.C. 2133, 2134(b)) shall not be used to

				satisfy the claim of any creditor in any proceeding under this title, other

				than a claim resulting from an activity undertaken to satisfy that

				responsibility, until the decontamination and decommissioning of the nuclear

				power reactor is completed to the satisfaction of the Nuclear Regulatory

				Commission;</text>

						</paragraph><paragraph changed="deleted" id="ID5caf07fdb9dc4deba8554203855519f2" reported-display-style="strikethrough"><enum>(2)</enum><text>obligations of

				licensees, former licensees, or any other person to use funds or other assets

				to satisfy a responsibility described in paragraph (1) may not be rejected,

				avoided, or discharged in any proceeding under this title or in any

				liquidation, reorganization, receivership, or other insolvency proceeding under

				Federal or State law; and</text>

						</paragraph><paragraph changed="deleted" id="ID1b7599390c6643b29763ff5fbfd6ec10" reported-display-style="strikethrough"><enum>(3)</enum><text>private insurance

				premiums and standard deferred premiums held and maintained in accordance with

				section 170 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2210(b)) shall not

				be used to satisfy the claim of any creditor in any proceeding under this

				title, until the indemnification agreement executed in accordance with section

				170 c. of that Act (42 U.S.C. 2210(c)) is

				terminated.</text>

			 to commence operations</quote>.</text>

			 of the Atomic Energy Act of 1954 (42 U.S.C. 2131 et seq.) is amended—</text>

				this subsection:</text>

								<subparagraph changed="deleted" id="ID163d5d4bec33482e978988451d728b22" reported-display-style="strikethrough"><enum>(A)</enum><header>Medical

				isotope</header><text>The term <term>medical isotope</term> includes Molybdenum

				99, Iodine 131, Xenon 133, and other radioactive materials used to produce a

				radiopharmaceutical for diagnostic, therapeutic procedures or for research and

				development.</text>

								</subparagraph><subparagraph changed="deleted" id="ID18111f2d57bb43718db292a3397c10e9" reported-display-style="strikethrough"><enum>(B)</enum><header>Radiopharmaceutical</header><text>The

				term <term>radiopharmaceutical</term> means a radioactive isotope that—</text>

									<clause changed="deleted" id="IDb585909730a4416b9b34f30df9b51e4a" reported-display-style="strikethrough"><enum>(i)</enum><text>contains byproduct

				material combined with chemical or biological material; and</text>

									</clause><clause changed="deleted" id="ID7891e09ca046499b8d395ed1fd8b1943" reported-display-style="strikethrough"><enum>(ii)</enum><text>is designed to

				accumulate temporarily in a part of the body for therapeutic purposes or for

				enabling the production of a useful image for use in a diagnosis of a medical

				condition.</text>

									</clause></subparagraph><subparagraph changed="deleted" id="IDb7a30bb4802848368a203298a910fdd0" reported-display-style="strikethrough"><enum>(C)</enum><header>Recipient

				country</header><text>The term <term>recipient country</term> means Belgium,

				Canada, France, Germany, and the Netherlands.</text>

								</subparagraph></paragraph><paragraph changed="deleted" id="ID2ae1a0ffae3d4c49bf8ad2a94f96e74a" reported-display-style="strikethrough"><enum>(2)</enum><header>Licenses</header><text>The

				Commission may issue a license authorizing the export (including shipment to

				and use at intermediate and ultimate consignees specified in the license) to a

				recipient country of highly enriched uranium for medical isotope production if,

				in addition to any other requirements of this Act (except subsection b.), the

				Commission determines that—</text>

								<subparagraph changed="deleted" id="ID859363fbbbd44f90a137e262f03fc231" reported-display-style="strikethrough"><enum>(A)</enum><text>a recipient

				country that supplies an assurance letter to the United States Government in

				connection with the consideration by the Commission of the export license

				application has informed the United States Government that any intermediate

				consignees and the ultimate consignee specified in the application are required

				to use the highly enriched uranium solely to produce medical isotopes;

				and</text>

								</subparagraph><subparagraph changed="deleted" id="ID587f6e78990747ab96688587c36b2039" reported-display-style="strikethrough"><enum>(B)</enum><text>the highly

				enriched uranium for medical isotope production will be irradiated only in a

				reactor in a recipient country that—</text>

									<clause changed="deleted" id="IDf5fc0cf1770749dbabd5261b6eda5f5b" reported-display-style="strikethrough"><enum>(i)</enum><text>uses an

				alternative nuclear reactor fuel; or</text>

									</clause><clause changed="deleted" id="IDafd89c54d0094272b7bb43aa5efda982" reported-display-style="strikethrough"><enum>(ii)</enum><text>is the subject of

				an agreement with the United States Government to convert to an alternative

				nuclear reactor fuel when alternative nuclear reactor fuel can be used in the

				reactor.</text>

									</clause></subparagraph></paragraph><paragraph changed="deleted" id="ID6801cc18df384b6a85a89bfc97df743b" reported-display-style="strikethrough"><enum>(3)</enum><header>Review of

				physical protection requirements</header>

								<subparagraph changed="deleted" id="ID38de703e317b4be28c9786de24dac513" reported-display-style="strikethrough"><enum>(A)</enum><header>In

				general</header><text>The Commission shall review the adequacy of physical

				protection requirements that, as of the date of an application under paragraph

				(2), are applicable to the transportation and storage of highly enriched

				uranium for medical isotope production or control of residual material after

				irradiation and extraction of medical isotopes.</text>

								</subparagraph><subparagraph changed="deleted" id="ID8c2a630e794b4513967c07f283400950" reported-display-style="strikethrough"><enum>(B)</enum><header>Imposition of

				additional requirements</header><text>If the Commission determines that

				additional physical protection requirements are necessary (including a limit on

				the quantity of highly enriched uranium that may be contained in a single

				shipment), the Commission shall impose such requirements as license conditions

				or through other appropriate means.</text>

								</subparagraph></paragraph><paragraph changed="deleted" id="ID01c177ad0643409fab56a655ed48e094" reported-display-style="strikethrough"><enum>(4)</enum><header>First report to

				congress</header>

								<subparagraph changed="deleted" id="ID2006c102bb6c4aeea423f72843dbdf40" reported-display-style="strikethrough"><enum>(A)</enum><header>National Academy

				of Sciences study</header><text>The Secretary shall enter into an arrangement

				with the National Academy of Sciences to conduct a study to determine—</text>

									<clause changed="deleted" id="ID1feafc65639a45eb8b69ac06bb49a106" reported-display-style="strikethrough"><enum>(i)</enum><text>the feasibility of

				procuring supplies of medical isotopes from commercial sources that do not use

				highly enriched uranium;</text>

									</clause><clause changed="deleted" id="ID4d66953064e0469d8151f3eac83c17c1" reported-display-style="strikethrough"><enum>(ii)</enum><text>the current and

				projected demand and availability of medical isotopes in regular current

				domestic use;</text>

									</clause><clause changed="deleted" id="ID00acaa8ceaf4494aaeea1722069f8851" reported-display-style="strikethrough"><enum>(iii)</enum><text>the progress

				that is being made by the Department of Energy and others to eliminate all use

				of highly enriched uranium in reactor fuel, reactor targets, and medical

				isotope production facilities; and</text>

									</clause><clause changed="deleted" id="IDe742bd43fccf4ee4b64bb90b7241598d" reported-display-style="strikethrough"><enum>(iv)</enum><text>the potential

				cost differential in medical isotope production in the reactors and target

				processing facilities if the products were derived from production systems that

				do not involve fuels and targets with highly enriched uranium.</text>

									</clause></subparagraph><subparagraph changed="deleted" id="ID64ab1b9173fd4fc48112b577a541062d" reported-display-style="strikethrough"><enum>(B)</enum><header>Feasibility</header><text>For

				the purpose of this subsection, the use of low enriched uranium to produce

				medical isotopes shall be determined to be feasible if—</text>

									<clause changed="deleted" id="ID01fb6f7d90d84da1b82e603b39bc9cb0" reported-display-style="strikethrough"><enum>(i)</enum><text>low enriched

				uranium targets have been developed and demonstrated for use in the reactors

				and target processing facilities that produce significant quantities of medical

				isotopes to serve United States needs for such isotopes;</text>

									</clause><clause changed="deleted" id="ID919d3e5065234f379b183f2fa6e56bcf" reported-display-style="strikethrough"><enum>(ii)</enum><text>sufficient

				quantities of medical isotopes are available from low enriched uranium targets

				and fuel to meet United States domestic needs; and</text>

									</clause><clause changed="deleted" id="IDbf3cd68ed2e341ab9e903dc009eab2a6" reported-display-style="strikethrough"><enum>(iii)</enum><text>the average

				anticipated total cost increase from production of medical isotopes in such

				facilities without use of highly enriched uranium is less than 10

				percent.</text>

									</clause></subparagraph><subparagraph changed="deleted" id="IDfb21828b7cae4305869cde4253864d17" reported-display-style="strikethrough"><enum>(C)</enum><header>Report by the

				secretary</header><text>Not later than 5 years after the date of enactment of

				the <short-title>Nuclear Fees Reauthorization Act of

				2005</short-title>, the Secretary shall submit to Congress a report

				that—</text>

									<clause changed="deleted" id="ID4cc29c3da16048698c0443b9a4ce3683" reported-display-style="strikethrough"><enum>(i)</enum><text>contains the

				findings of the National Academy of Sciences made in the study under

				subparagraph (A); and</text>

									</clause><clause changed="deleted" id="IDcae2c62cfe6e40b882ad1d3c4e1c7ff2" reported-display-style="strikethrough"><enum>(ii)</enum><text>discloses the

				existence of any commitments from commercial producers to provide domestic

				requirements for medical isotopes without use of highly enriched uranium

				consistent with the feasibility criteria described in subparagraph (B) not

				later than the date that is 4 years after the date of submission of the

				report.</text>

									</clause></subparagraph></paragraph><paragraph changed="deleted" id="IDe8510fdd0dae481985443045b96676b5" reported-display-style="strikethrough"><enum>(5)</enum><header>Second report to

				congress</header><text>If the study of the National Academy of Sciences

				determines under paragraph (4)(A)(i) that the procurement of supplies of

				medical isotopes from commercial sources that do not use highly enriched

				uranium is feasible, but the Secretary is unable to report the existence of

				commitments under paragraph (4)(C)(ii), not later than the date that is 6 years

				after the date of enactment of the <short-title>Nuclear

				Fees Reauthorization Act of 2005</short-title>, the Secretary shall submit to

				Congress a report that describes options for developing domestic supplies of

				medical isotopes in quantities that are adequate to meet domestic demand

				without the use of highly enriched uranium consistent with the cost increase

				described in paragraph (4)(B)(iii).</text>

							</paragraph><paragraph changed="deleted" id="IDa18332f5a2fe4b98a5f21fbefda5099e" reported-display-style="strikethrough"><enum>(6)</enum><header>Certification</header><text>At

				such time as commercial facilities that do not use highly enriched uranium are

				capable of meeting domestic requirements for medical isotopes, within the cost

				increase described in paragraph (4)(B)(iii) and without impairing the reliable

				supply of medical isotopes for domestic utilization, the Secretary shall submit

				to Congress a certification to that effect.</text>

							</paragraph><paragraph changed="deleted" id="ID05acb00d4ac34215a2105fb9c2a36ab1" reported-display-style="strikethrough"><enum>(7)</enum><header>Sunset

				provision</header><text>After the Secretary submits a certification under

				paragraph (6), the Commission shall, by rule, terminate the review of the

				Commission of export license applications under this

				subsection.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				semester or equivalent term, science, engineering, or another field of study

				that the Commission determines is in a critical skill area related to the

				regulatory mission of the Commission, the Commission may carry out a program

				to—</text>

							<paragraph changed="deleted" id="IDf15997c11a07401b8fadd5bb8beccecb" reported-display-style="strikethrough"><enum>(1)</enum><text>award scholarships

				to undergraduate students who—</text>

								<subparagraph changed="deleted" id="ID531ec0fe984b469d99373951d8115713" reported-display-style="strikethrough"><enum>(A)</enum><text>are United States

				citizens; and</text>

								</subparagraph><subparagraph changed="deleted" id="ID2fda5874dba54dfeabf16f806db3e972" reported-display-style="strikethrough"><enum>(B)</enum><text>enter into an

				agreement under subsection (c) to be employed by the Commission in the area of

				study for which the scholarship is awarded.</text>

								</subparagraph></paragraph></subsection><subsection changed="deleted" id="idFDE334664EFB449E8BB9F161A6D03A59" reported-display-style="strikethrough"><enum>(b)</enum><header>Fellowship

				program</header><text>To enable students to pursue education in science,

				engineering, or another field of study that the Commission determines is in a

				critical skill area related to its regulatory mission, in a graduate or

				professional degree program offered by an institution of higher education in

				the United States, the Commission may carry out a program to—</text>

							<paragraph changed="deleted" id="IDee3c8e9602054fb381e4babcb7f10867" reported-display-style="strikethrough"><enum>(1)</enum><text>award fellowships

				to graduate students who—</text>

								<subparagraph changed="deleted" id="IDc5157ebd6a3140d280bf891cea2e688f" reported-display-style="strikethrough"><enum>(A)</enum><text>are United States

				citizens; and</text>

								</subparagraph><subparagraph changed="deleted" id="IDfc6cf32eef2c4d2c90f71c890f7a80b8" reported-display-style="strikethrough"><enum>(B)</enum><text>enter into an

				agreement under subsection (c) to be employed by the Commission in the area of

				study for which the fellowship is awarded.</text>

								</subparagraph></paragraph></subsection><subsection changed="deleted" id="IDda2cd3f0376e4fe0ab81980e9e8163d8" reported-display-style="strikethrough"><enum>(c)</enum><header>Requirements</header>

							<paragraph changed="deleted" id="id13679C48EDD84A82B6F2F0A64F2AEAAA" reported-display-style="strikethrough"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">As a condition of

				receiving a scholarship or fellowship under subsection (a) or (b), a recipient

				of the scholarship or fellowship shall enter into an agreement with the

				Commission under which, in return for the assistance, the recipient

				shall—</text>

								<subparagraph changed="deleted" id="ID95643640eec14f19b7a86443594786d7" reported-display-style="strikethrough"><enum>(A)</enum><text>maintain

				satisfactory academic progress in the studies of the recipient, as determined

				by criteria established by the Commission;</text>

								</subparagraph><subparagraph changed="deleted" id="id5808A94F5D78417FACB544142EFD6A83" reported-display-style="strikethrough"><enum>(B)</enum><text>agree that failure

				to maintain satisfactory academic progress shall constitute grounds on which

				the Commission may terminate the assistance;</text>

								</subparagraph><subparagraph changed="deleted" id="IDf476d630b55841c886485015e082ba9e" reported-display-style="strikethrough"><enum>(C)</enum><text>on completion of

				the academic course of study in connection with which the assistance was

				provided, and in accordance with criteria established by the Commission, engage

				in employment by the Commission for a period specified by the Commission, that

				shall be not less than 1 time and not more than 3 times the period for which

				the assistance was provided; and</text>

								</subparagraph><subparagraph changed="deleted" id="ID2d8085747bd446bcb987e8dac18d7aff" reported-display-style="strikethrough"><enum>(D)</enum><text>if the recipient

				fails to meet the requirements of subparagraph (A), (B), or (C), reimburse the

				United States Government for—</text>

									<clause changed="deleted" id="id5D788EBBD03A4937A2EFB677879FC6FA" reported-display-style="strikethrough"><enum>(i)</enum><text>the entire amount

				of the assistance provided the recipient under the scholarship or fellowship;

				and</text>

									</clause><clause changed="deleted" id="idEC023531CE394A4EB49029E8BAB09728" reported-display-style="strikethrough"><enum>(ii)</enum><text>interest at a

				rate determined by the Commission.</text>

									</clause></subparagraph></paragraph><paragraph changed="deleted" id="id8A8CD272E8164E0BBE6061D6B18E4306" reported-display-style="strikethrough"><enum>(2)</enum><header>Waiver or

				suspension</header><text>The Commission may establish criteria for the partial

				or total waiver or suspension of any obligation of service or payment incurred

				by a recipient of a scholarship or fellowship under this section.</text>

							</paragraph></subsection><subsection changed="deleted" id="ID48ab06142ec742b9bad06e56e0077a82" reported-display-style="strikethrough"><enum>(d)</enum><header>Competitive

				process</header><text>Recipients of scholarships or fellowships under this

				section shall be selected through a competitive process primarily on the basis

				of academic merit and such other criteria as the Commission may establish, with

				consideration given to financial need and the goal of promoting the

				participation of individuals identified in section 33 or 34 of the Science and

				isotope</header><text>The term <term>medical isotope</term> includes Molybdenum

				99, Iodine 131, Xenon 133, and other radioactive materials used to produce a

				radiopharmaceutical for diagnostic, therapeutic procedures or for research and

				development.</text>

								</subparagraph><subparagraph changed="added" id="id6d130f88-15ea-4318-9665-0234de2a4332" reported-display-style="italic"><enum>(B)</enum><header>Radiopharmaceutical</header><text>The

				term <term>radiopharmaceutical</term> means a radioactive isotope that—</text>

									<clause changed="added" id="idd3da893e-d234-4e5f-b55d-6fde548e625d" reported-display-style="italic"><enum>(i)</enum><text>contains byproduct

				material combined with chemical or biological material; and</text>

									</clause><clause changed="added" id="idf2cde7fe-1669-41c9-867d-9b1bf17d2996" reported-display-style="italic"><enum>(ii)</enum><text>is designed to

				accumulate temporarily in a part of the body for therapeutic purposes or for

				enabling the production of a useful image for use in a diagnosis of a medical

				condition.</text>

									</clause></subparagraph><subparagraph changed="added" id="ide30c84bd-7b19-4adc-a094-8f43afb55801" reported-display-style="italic"><enum>(C)</enum><header>Recipient

				country</header><text>The term <term>recipient country</term> means Belgium,

				Canada, France, Germany, and the Netherlands.</text>

								</subparagraph></paragraph><paragraph changed="added" id="id8a8e321b-affa-4cac-a2cc-30a5a899d8ce" reported-display-style="italic"><enum>(2)</enum><header>Licenses</header><text>The

				Nuclear Regulatory Commission may issue a license authorizing the export

				(including shipment to and use at intermediate and ultimate consignees

				specified in the license) to a recipient country of highly enriched uranium for

				medical isotope production if, in addition to any other requirements of this

				Act (except subsection b.), the Nuclear Regulatory Commission determines

				that—</text>

								<subparagraph changed="added" id="id460855f0-902b-44b9-8e54-b60aa2ac7a21" reported-display-style="italic"><enum>(A)</enum><text>a recipient country that

				supplies an assurance letter to the United States Government in connection with

				the consideration by the Nuclear Regulatory Commission of the export license

				application has informed the United States Government that any intermediate

				consignees and the ultimate consignee specified in the application are required

				to use the highly enriched uranium solely to produce medical isotopes;

				and</text>

								</subparagraph><subparagraph changed="added" id="ida97cba71-7103-4bd7-8c98-7beb6962aa04" reported-display-style="italic"><enum>(B)</enum><text>the highly enriched

				uranium for medical isotope production will be irradiated only in a reactor in

				a recipient country that—</text>

									<clause changed="added" id="ide4665f48-2fde-4305-b59e-01d9acf11642" reported-display-style="italic"><enum>(i)</enum><text>uses an alternative

				nuclear reactor fuel; or</text>

									</clause><clause changed="added" id="idf07806ba-3781-49f6-9466-4b14a3b167c5" reported-display-style="italic"><enum>(ii)</enum><text>is the subject of an

				agreement with the United States Government to convert to an alternative

				nuclear reactor fuel when alternative nuclear reactor fuel can be used in the

				reactor.</text>

									</clause></subparagraph></paragraph><paragraph changed="added" id="id9077c206-4c4e-4f21-b334-1519b319df03" reported-display-style="italic"><enum>(3)</enum><header>Review of physical

				protection requirements</header>

								<subparagraph changed="added" id="id653258a8-b157-4483-9ba2-dc85de12ca41" reported-display-style="italic"><enum>(A)</enum><header>In

				general</header><text>The Nuclear Regulatory Commission shall review the

				adequacy of physical protection requirements that, as of the date of an

				application under paragraph (2), are applicable to the transportation and

				storage of highly enriched uranium for medical isotope production or control of

				residual material after irradiation and extraction of medical isotopes.</text>

								</subparagraph><subparagraph changed="added" id="id9c74e98b-3497-44cd-b2cf-cdda2e9af60a" reported-display-style="italic"><enum>(B)</enum><header>Imposition of

				additional requirements</header><text>If the Nuclear Regulatory Commission

				determines that additional physical protection requirements are necessary

				(including a limit on the quantity of highly enriched uranium that may be

				contained in a single shipment), the Nuclear Regulatory Commission shall impose

				such requirements as license conditions or through other appropriate

				means.</text>

								</subparagraph></paragraph><paragraph changed="added" id="idb3ab4736-aa4a-435c-a6bc-07efccb5dbba" reported-display-style="italic"><enum>(4)</enum><header>First report to

				congress</header>

								<subparagraph changed="added" id="id586a6edd-4684-4f28-9501-a446baba1b79" reported-display-style="italic"><enum>(A)</enum><header>National Academy of

				Sciences study</header><text>The Secretary shall enter into an arrangement with

				the National Academy of Sciences to conduct a study to determine—</text>

									<clause changed="added" id="id549b9c28-2595-4183-8745-2fd6ceebe351" reported-display-style="italic"><enum>(i)</enum><text>the feasibility of

				procuring supplies of medical isotopes from commercial sources that do not use

				highly enriched uranium;</text>

									</clause><clause changed="added" id="id0feb285a-34b8-4f32-b18b-f8bc3541c369" reported-display-style="italic"><enum>(ii)</enum><text>the current and

				projected demand and availability of medical isotopes in regular current

				domestic use;</text>

									</clause><clause changed="added" id="idaadb4f33-a9c0-4ff9-9503-0723350b1bd0" reported-display-style="italic"><enum>(iii)</enum><text>the progress that is

				being made by the Department of Energy and others to eliminate all use of

				highly enriched uranium in reactor fuel, reactor targets, and medical isotope

				production facilities; and</text>

									</clause><clause changed="added" id="idf9f66d38-918d-4adf-8048-36c520b2b882" reported-display-style="italic"><enum>(iv)</enum><text>the potential cost

				differential in medical isotope production in the reactors and target

				processing facilities if the products were derived from production systems that

				do not involve fuels and targets with highly enriched uranium.</text>

									</clause></subparagraph><subparagraph changed="added" id="id4550daf4-568b-480b-86f8-2818735afbb2" reported-display-style="italic"><enum>(B)</enum><header>Feasibility</header><text>For

				the purpose of this subsection, the use of low enriched uranium to produce

				medical isotopes shall be determined to be feasible if—</text>

									<clause changed="added" id="id4e55175e-21de-46d1-bdf8-5b4b92162de3" reported-display-style="italic"><enum>(i)</enum><text>low enriched uranium

				targets have been developed and demonstrated for use in the reactors and target

				processing facilities that produce significant quantities of medical isotopes

				to serve United States needs for such isotopes;</text>

									</clause><clause changed="added" id="id438e77d1-1ca2-45d9-8502-d4ef696bfa49" reported-display-style="italic"><enum>(ii)</enum><text>sufficient quantities of

				medical isotopes are available from low enriched uranium targets and fuel to

				meet United States domestic needs; and</text>

									</clause><clause changed="added" id="ide267caad-9837-4d2e-b154-211eb6f3b6d3" reported-display-style="italic"><enum>(iii)</enum><text>the average anticipated

				total cost increase from production of medical isotopes in such facilities

				without use of highly enriched uranium is less than 10 percent.</text>

									</clause></subparagraph><subparagraph changed="added" id="id160b110a-41ed-4bc6-801c-9c6d117d429f" reported-display-style="italic"><enum>(C)</enum><header>Report by the

				secretary</header><text>Not later than 5 years after the date of enactment of

				the <short-title>Nuclear Fees Reauthorization Act of

				2005</short-title>, the Secretary shall submit to Congress a report

				that—</text>

									<clause changed="added" id="id763588c4-1e9b-4a82-b4b1-99aacf074c88" reported-display-style="italic"><enum>(i)</enum><text>contains the findings of

				the National Academy of Sciences made in the study under subparagraph (A);

				and</text>

									</clause><clause changed="added" id="id8143b0cf-10a7-4e74-9f16-0e2500f7721b" reported-display-style="italic"><enum>(ii)</enum><text>discloses the existence

				of any commitments from commercial producers to provide domestic requirements

				for medical isotopes without use of highly enriched uranium consistent with the

				feasibility criteria described in subparagraph (B) not later than the date that

				is 4 years after the date of submission of the report.</text>

									</clause></subparagraph></paragraph><paragraph changed="added" id="idb0a0740e-b57a-4ec4-9e19-77c3d74a6c65" reported-display-style="italic"><enum>(5)</enum><header>Second report to

				congress</header><text>If the study of the National Academy of Sciences

				determines under paragraph (4)(A)(i) that the procurement of supplies of

				medical isotopes from commercial sources that do not use highly enriched

				uranium is feasible, but the Secretary is unable to report the existence of

				commitments under paragraph (4)(C)(ii), not later than the date that is 6 years

				after the date of enactment of the <short-title>Nuclear

				Fees Reauthorization Act of 2005</short-title>, the Secretary shall submit to

				Congress a report that describes options for developing domestic supplies of

				medical isotopes in quantities that are adequate to meet domestic demand

				without the use of highly enriched uranium consistent with the cost increase

				described in paragraph (4)(B)(iii).</text>

							</paragraph><paragraph changed="added" id="id4981f12e-1c2a-400d-9741-c139d793a808" reported-display-style="italic"><enum>(6)</enum><header>Certification</header><text>At

				such time as commercial facilities that do not use highly enriched uranium are

				capable of meeting domestic requirements for medical isotopes, within the cost

				increase described in paragraph (4)(B)(iii) and without impairing the reliable

				supply of medical isotopes for domestic utilization, the Secretary shall submit

				to Congress a certification to that effect.</text>

							</paragraph><paragraph changed="added" id="idef32b072-4a63-40f4-bc84-beba62ad21e7" reported-display-style="italic"><enum>(7)</enum><header>Sunset

				provision</header><text>After the Secretary submits a certification under

				paragraph (6), the Nuclear Regulatory Commission shall, by rule, terminate the

				review of the Nuclear Regulatory Commission of export license applications

				under this

				subsection.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				program</header><text>To enable students to study, for at least 1 academic

				semester or equivalent term, science, engineering, or another field of study

				that the Nuclear Regulatory Commission determines is in a critical skill area

				related to the regulatory mission of the Nuclear Regulatory Commission, the

				Nuclear Regulatory Commission may carry out a program to—</text>

							<paragraph changed="added" id="id8d2fed9f-5d2f-4b08-b0a5-174b361b1c8d" reported-display-style="italic"><enum>(1)</enum><text>award scholarships to

				undergraduate students who—</text>

								<subparagraph changed="added" id="id2e44dc18-2788-4e47-a401-81c2b2acd225" reported-display-style="italic"><enum>(A)</enum><text>are United States

				citizens; and</text>

								</subparagraph><subparagraph changed="added" id="id2d83dbc1-d3b1-4f73-8be0-d1be7f477158" reported-display-style="italic"><enum>(B)</enum><text>enter into an agreement

				under subsection c. to be employed by the Nuclear Regulatory Commission in the

				area of study for which the scholarship is awarded.</text>

								</subparagraph></paragraph></subsection><subsection changed="added" id="idbf9ff3e4-ff8f-4318-b2ac-fe5d66326111" reported-display-style="italic"><enum>b.</enum><header>Fellowship

				program</header><text>To enable students to pursue education in science,

				engineering, or another field of study that the Nuclear Regulatory Commission

				determines is in a critical skill area related to its regulatory mission, in a

				graduate or professional degree program offered by an institution of higher

				education in the United States, the Nuclear Regulatory Commission may carry out

				a program to—</text>

							<paragraph changed="added" id="idefbc9e9c-8594-4be3-9757-6e17616c4a50" reported-display-style="italic"><enum>(1)</enum><text>award fellowships to

				graduate students who—</text>

								<subparagraph changed="added" id="ida84c4a69-6140-4112-aeb0-816a8df19500" reported-display-style="italic"><enum>(A)</enum><text>are United States

				citizens; and</text>

								</subparagraph><subparagraph changed="added" id="id47660f00-1965-495f-8df5-a99023ca6c70" reported-display-style="italic"><enum>(B)</enum><text>enter into an agreement

				under subsection c. to be employed by the Nuclear Regulatory Commission in the

				area of study for which the fellowship is awarded.</text>

								</subparagraph></paragraph></subsection><subsection changed="added" id="id5a579e9d-60ca-40e2-85fa-2e1eda025b5f" reported-display-style="italic"><enum>c.</enum><header>Requirements</header>

							<paragraph changed="added" id="id7b840af6-91f7-44f9-80d4-081ab81a66a6" reported-display-style="italic"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">As a condition of

				receiving a scholarship or fellowship under subsection a. or b., a recipient of

				the scholarship or fellowship shall enter into an agreement with the Nuclear

				Regulatory Commission under which, in return for the assistance, the recipient

				shall—</text>

								<subparagraph changed="added" id="idd0ec27f6-b568-4ddc-baa8-949e3982e1de" reported-display-style="italic"><enum>(A)</enum><text>maintain satisfactory

				academic progress in the studies of the recipient, as determined by criteria

				established by the Nuclear Regulatory Commission;</text>

								</subparagraph><subparagraph changed="added" id="id16cfd498-c5b1-42b8-bc44-43285d81609d" reported-display-style="italic"><enum>(B)</enum><text>agree that failure to

				maintain satisfactory academic progress shall constitute grounds on which the

				Nuclear Regulatory Commission may terminate the assistance;</text>

								</subparagraph><subparagraph changed="added" id="iddb05e3b2-6973-456b-8383-b6519228abe1" reported-display-style="italic"><enum>(C)</enum><text>on completion of the

				academic course of study in connection with which the assistance was provided,

				and in accordance with criteria established by the Nuclear Regulatory

				Commission, engage in employment by the Nuclear Regulatory Commission for a

				period specified by the Nuclear Regulatory Commission, that shall be not less

				than 1 time and not more than 3 times the period for which the assistance was

				provided; and</text>

								</subparagraph><subparagraph changed="added" id="id4f803167-5938-452a-b2d0-77edffc6ca11" reported-display-style="italic"><enum>(D)</enum><text>if the recipient fails to

				meet the requirements of subparagraph (A), (B), or (C), reimburse the United

				States Government for—</text>

									<clause changed="added" id="idab308ba6-82cd-4444-b3a8-affbc531c6a5" reported-display-style="italic"><enum>(i)</enum><text>the entire amount of the

				assistance provided the recipient under the scholarship or fellowship;

				and</text>

									</clause><clause changed="added" id="id6bd2b026-9d38-442e-b3f4-fa4bce16e084" reported-display-style="italic"><enum>(ii)</enum><text>interest at a rate

				determined by the Nuclear Regulatory Commission.</text>

									</clause></subparagraph></paragraph><paragraph changed="added" id="ide0d58075-2af8-41fd-8c99-d1c6b0fefcd0" reported-display-style="italic"><enum>(2)</enum><header>Waiver or

				suspension</header><text>The Nuclear Regulatory Commission may establish

				criteria for the partial or total waiver or suspension of any obligation of

				service or payment incurred by a recipient of a scholarship or fellowship under

				this section.</text>

							</paragraph></subsection><subsection changed="added" id="id336a2811-1060-4e77-9207-baee2155f605" reported-display-style="italic"><enum>d.</enum><header>Competitive

				process</header><text>Recipients of scholarships or fellowships under this

				section shall be selected through a competitive process primarily on the basis

				of academic merit and such other criteria as the Nuclear Regulatory Commission

				may establish, with consideration given to financial need and the goal of

				promoting the participation of individuals identified in section 33 or 34 of

				the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a,

				1885b).</text>

						</subsection><subsection changed="added" id="ida7fde1e6-751b-403e-bf4b-3d08a56c8202" reported-display-style="italic"><enum>e.</enum><header>Direct

				appointment</header><text>The Nuclear Regulatory Commission may appoint

				directly, with no further competition, public notice, or consideration of any

				other potential candidate, an individual who has—</text>

							<paragraph changed="added" id="id996F140C873E40C4AD58D915EC9977CE" reported-display-style="italic"><enum>(1)</enum><text>received a scholarship or

				fellowship awarded by the Nuclear Regulatory Commission under this section;

				and</text>

							</paragraph><paragraph changed="added" id="idA1F41E62580D4F6FB24DA8F64098D153" reported-display-style="italic"><enum>(2)</enum><text>completed the academic

				program for which the scholarship or fellowship was

				awarded.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section changed="added" id="id30da9edd-e289-4834-af41-0ff807099fca" reported-display-style="italic"><enum>305.</enum><header>Partnership program

			 with institutions of higher education</header><text display-inline="no-display-inline">Chapter 19 of the Atomic Energy Act of 1954

			 (42 U.S.C. 2015 et seq.) (as amended by section 304) is amended by inserting

			 after section 243 the following:</text>

				this section:</text>

							<paragraph changed="added" id="idd61cc6c6-68bb-4f2a-b2a9-b2a490fdec00" reported-display-style="italic"><enum>(1)</enum><header>Hispanic-serving

				institution</header><text>The term <term>Hispanic-serving institution</term>

				has the meaning given the term in section 502(a) of the Higher Education Act of

				1965 (20 U.S.C. 1101a(a)).</text>

							</paragraph><paragraph changed="added" id="id4b750687-752f-472e-913d-444b399cf637" reported-display-style="italic"><enum>(2)</enum><header>Historically Black

				college and university</header><text>The term <term>historically Black college

				or university</term> has the meaning given the term <quote>part B

				institution</quote> in section 322 of the Higher Education Act of 1965 (20

				U.S.C. 1061).</text>

							</paragraph><paragraph changed="added" id="id5b78d3d9-a443-40bd-8800-0fcc37c583e5" reported-display-style="italic"><enum>(3)</enum><header>Tribal

				college</header><text>The term <term>Tribal college</term> has the meaning

				given the term <quote>tribally controlled college or university</quote> in

				section 2(a) of the Tribally Controlled College or University Assistance Act of

				1978 (25 U.S.C. 1801(a)).</text>

							</paragraph></subsection><subsection changed="added" id="id4e4ab8db-f2ef-40c0-85b9-e2542f1683e6" reported-display-style="italic"><enum>b.</enum><header>Partnership

				program</header><text>The Nuclear Regulatory Commission may establish and

				participate in activities relating to research, mentoring, instruction, and

				training with institutions of higher education, including Hispanic-serving

				institutions, historically Black colleges or universities, and Tribal colleges,

				to strengthen the capacity of the institutions—</text>

							<paragraph changed="added" id="id962f5867-4c7e-4f75-9c0b-026c8806c404" reported-display-style="italic"><enum>(1)</enum><text>to educate and train

				students (including present or potential employees of the Nuclear Regulatory

				Commission); and</text>

							</paragraph><paragraph changed="added" id="id8f41d0ce-45d4-49c3-a0f8-db1817b6c768" reported-display-style="italic"><enum>(2)</enum><text>to conduct research in

				the field of science, engineering, or law, or any other field that the Nuclear

				Regulatory Commission determines is important to the work of the Nuclear

				Regulatory

				Commission.</text>

			</section><section changed="added" id="id874041e5-90d9-4167-9611-f322e028d482" reported-display-style="italic"><enum>306.</enum><header>Elimination of pension

			 offset for certain rehired Federal retirees</header><text display-inline="no-display-inline">Chapter 14 of the Atomic Energy Act of 1954

			 (42 U.S.C. 2201 et seq.) (as amended by sections 302 and 303) is amended by

			 adding at the end the following:</text>

					<section changed="added" id="id0144ea67-1579-4a0c-91c8-410a6aaebf09" reported-display-style="italic"><enum>170E.</enum><header>Elimination of

				pension offset for certain rehired Federal retirees</header>

						<subsection changed="added" id="idb1c4d137-34ea-4cea-acc8-6f0285dbbb69" reported-display-style="italic"><enum>a.</enum><header>In

				general</header><text>The Nuclear Regulatory Commission may waive the

				application of section 8344 or 8468 of title 5, United States Code, on a

				case-by-case basis for employment of an annuitant—</text>

							<paragraph changed="added" id="id932a25d9-d791-4160-a679-1d9bd28bccb0" reported-display-style="italic"><enum>(1)</enum><text>in a position of the

				Nuclear Regulatory Commission for which there is exceptional difficulty in

				recruiting or retaining a qualified employee; or</text>

							</paragraph><paragraph changed="added" id="id10e67aa5-c80d-4eff-9bb3-959a5caa5dc8" reported-display-style="italic"><enum>(2)</enum><text>when a temporary

				emergency hiring need exists.</text>

							</paragraph></subsection><subsection changed="added" id="idd985877a-349a-4303-ad62-ac29868340ba" reported-display-style="italic"><enum>b.</enum><header>Procedures</header><text>The

				Nuclear Regulatory Commission shall prescribe procedures for the exercise of

				authority under this section, including—</text>

							<paragraph changed="added" id="idf049f245-96c2-430c-bd70-9cbb62d7f40d" reported-display-style="italic"><enum>(1)</enum><text>criteria for any exercise

				of authority; and</text>

							</paragraph><paragraph changed="added" id="id2e41179c-358c-4a0c-9ecf-169f5d5f0163" reported-display-style="italic"><enum>(2)</enum><text>procedures for a

				delegation of authority.</text>

							</paragraph></subsection><subsection changed="added" id="idd88a5070-1e8a-4795-9e98-161f9a954366" reported-display-style="italic"><enum>c.</enum><header>Effect of

				waiver</header><text>An employee as to whom a waiver under this section is in

				effect shall not be considered an employee for purposes of subchapter II of

				chapter 83, or chapter 84, of title 5, United States

				Code.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section changed="added" commented="no" display-inline="no-display-inline" id="id5C18341FABC1474BA9C1D4FFBE585BF1" reported-display-style="italic" section-type="subsequent-section"><enum>307.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated to carry out this title and amendments made by

			 this title such sums as may be necessary for fiscal year 2006 and each fiscal

			 year thereafter.</text>
