		<official-title>To require labeling of raw agricultural forms of ginseng,

		  including the country of harvest, and for other purposes.</official-title>

		<section id="idF9C9A2D8CD3D4A42A79BD205BC20B9AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Ginseng Harvest Labeling Act of

			 2005</short-title></quote>.</text>

		</section><section id="IDD4BF6FF82F28475EA697E0CF95A0BE58"><enum>2.</enum><header>Disclosure of

			 country of harvest</header><text display-inline="no-display-inline">The

			 Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> et seq.) is amended by

			 adding at the end the following:</text>

				<subtitle id="ID9987597224FD4B73B896CE240EFAA196"><enum>E</enum><header>Ginseng</header>

					<section id="IDF8A92A9B915F4914AF167F314F4E8840"><enum>291.</enum><header>Disclosure of

				country of harvest</header>

						<subsection id="IDB7497DB8C866474388EFF10D56BDAF7C"><enum>(a)</enum><header>Definition of

				ginseng</header><text>In this section, the term <term>ginseng</term> means an

				herb or herbal ingredient that—</text>

							<paragraph id="IDFC3F4534155040878D7D85475D5B7518"><enum>(1)</enum><text>is derived from a

				plant classified within the genus Panax; and</text>

							</paragraph><paragraph id="ID15055C5A84E945CF9F347E008034147F"><enum>(2)</enum><text>is offered for

				sale as a raw agricultural commodity in any form intended to be used in or as a

				food or dietary supplement under the name of <quote>ginseng</quote>.</text>

							</paragraph></subsection><subsection id="IDCB36F1793CE0449AADBB5631EDB226B2"><enum>(b)</enum><header>Disclosure</header>

							<paragraph id="ID4298861F57044447A5AF6BFC0C294124"><enum>(1)</enum><header>In

				general</header><text>A person that offers ginseng for sale as a raw

				agricultural commodity shall disclose to potential purchasers the country of

				harvest of the ginseng.</text>

							</paragraph><paragraph id="ID52EF28FEF1FF4D95929552B20A93264A"><enum>(2)</enum><header>Importation</header><text>A

				person that imports ginseng into the United States shall disclose the country

				of harvest of the ginseng at the point of entry of the United States, in

				accordance with section 304 of the <act-name parsable-cite="TA30">Tariff Act of

				1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19

				U.S.C. 1304</external-xref>).</text>

							</paragraph></subsection><subsection id="ID11C4F9457CA94E459DEDCA09CD87DBAB"><enum>(c)</enum><header>Manner of

				disclosure</header>

							<paragraph id="IDEE15606243694B528DDC264A18DA1DB0"><enum>(1)</enum><header>In

				general</header><text>The disclosure required by subsection (b) shall be

				provided to potential purchasers by means of a label, stamp, mark, placard, or

				other clear and visible sign on the ginseng or on the package, display, holding

				unit, or bin containing the ginseng.</text>

							</paragraph><paragraph id="ID7B6496460D8A4A3FB357F407AAEED765"><enum>(2)</enum><header>Retailers</header><text>A

				retailer of ginseng shall—</text>

								<subparagraph id="IDAE91D18367924D6FAD324633DED585AA"><enum>(A)</enum><text>retain disclosure

				provided under subsection (b); and</text>

								</subparagraph><subparagraph id="ID61D9379EDF0143E89DC912F529B40B1C"><enum>(B)</enum><text>provide

				disclosure to a retail purchaser of the raw agricultural commodity.</text>

								</subparagraph></paragraph><paragraph id="IDD80A46CD45024B5692EC34BA5594E654"><enum>(3)</enum><header>Regulations</header><text>The

				Secretary of Agriculture shall by regulation prescribe with specificity the

				manner in which disclosure shall be made in transactions at wholesale or retail

				(including transactions by mail, telephone, or Internet or in retail

				stores).</text>

							</paragraph></subsection><subsection id="ID26190BB55D36484EAA3EA1FBBAC9B369"><enum>(d)</enum><header>Failure to

				disclose</header><text>The Secretary of Agriculture may impose on a person that

				fails to comply with subsection (b) a civil penalty of not more than—</text>

							<paragraph id="ID4BB41D16DC3B485C8645D0D8EF353F0B"><enum>(1)</enum><text>$1,000 for the

				first day on which the failure to disclose occurs; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE4C31F83DD264F708866DE26196516EA"><enum>(2)</enum><text>$250 for each day

				on which the failure to disclose

				continues.</text>

							</paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="id02B58FFE92054E0289618BE58709CEEE"><enum>3.</enum><header>Effective

			 date</header><text display-inline="no-display-inline">This Act and the

			 amendments made by this Act take effect on the date that is 180 days after the

			 date of enactment of this Act.</text>
