		<official-title>To prohibit products that contain dry ultra-filtered milk

		  products, milk protein concentrate, or casein from being labeled as domestic

		  natural cheese, and for other purposes.</official-title>

	<legis-body>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Quality Cheese Act of

			 2005</short-title></quote>.</text>

		</section><section id="id4636D94BB47E483C993ACCE6F9713049"><enum>2.</enum><header>Natural cheese

			 standard</header>

			<subsection id="idFC4BD0F807BB4F3482A6EB18145B76BC"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

				<paragraph id="IDe7bf39b46e9a45079d6401f988c47d4e"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0475E69DE29445668BE0DDC9B07815AA"><enum>(A)</enum><text>any change in domestic

			 natural cheese standards to allow dry ultra-filtered milk products, milk

			 protein concentrate, or casein to be labeled as domestic natural cheese would

			 result in increased costs to the dairy price support program; and</text>

					</subparagraph><subparagraph id="id2B1FC48FD056469186DA982BDF8DDA83" indent="up1"><enum>(B)</enum><text>that change would be unfair to

			 taxpayers, who would be forced to pay more program costs;</text>

					</subparagraph></paragraph><paragraph id="IDa94b5c11b0ee44de8ad7c4d37e259584"><enum>(2)</enum><text>any change in

			 domestic natural cheese standards to allow dry ultra-filtered milk products,

			 milk protein concentrate, or casein to be labeled as domestic natural cheese

			 would result in lower revenues for dairy farmers;</text>

				</paragraph><paragraph id="ID550c8325cc7c4c9e8d95519d484a053d"><enum>(3)</enum><text>any change in

			 domestic natural cheese standards to allow dry ultra-filtered milk products,

			 milk protein concentrate, or casein to be labeled as domestic natural cheese

			 would cause dairy products containing dry ultra-filtered milk, milk protein

			 concentrate, or casein to become vulnerable to contamination and would

			 compromise the sanitation, hydrosanitary, and phytosanitary standards of the

			 United States dairy industry; and</text>

				</paragraph><paragraph id="IDd6d0c05633684c1e9bf03fa53c8a5491"><enum>(4)</enum><text>changing the

			 labeling standard for domestic natural cheese would be misleading to the

			 consumer.</text>

				</paragraph></subsection><subsection id="ID8b7006722be9427dbfb093d9e755e402"><enum>(b)</enum><header>Prohibition</header><text>Section

			 401 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 341) is

			 amended—</text>

				<paragraph id="ID4ef330880e384d2396c476cadea65786"><enum>(1)</enum><text>by striking

			 <quote>Whenever</quote> and inserting <quote>(a) Whenever</quote>; and</text>

				</paragraph><paragraph id="ID7f82f8b801f4492b8635c2b7276c9290"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idA6A1161DFC2C4F1F86FA9E2141B09CE4" style="OLC">

						<subsection id="ID54335486b8324dd2be8c1ec99917414a"><enum>(b)</enum><text>The Commissioner

				may not use any Federal funds to amend section 133.3 of title 21, Code of

				Federal Regulations (or any corresponding similar regulation or ruling), to

				include dry ultra-filtered milk, milk protein concentrate, or casein in the

				definition of the term <quote>milk</quote> or <quote>nonfat milk</quote>, as

				specified in the standards of identity for cheese and cheese products published

				at part 133 of title 21, Code of Federal Regulations (or any corresponding

				similar regulation or

				ruling).</text>
