		  costs of the Pactola Dam and Reservoir, South Dakota, to reflect increased

		  demands for municipal, industrial, and fish and wildlife

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Pactola Reservoir Reallocation

			 Authorization Act of 2005</short-title></quote>.</text>

		</section><section id="IDFD7C333B06354B5082AE32D13B71E27D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph id="IDEBC78B180B7F47CE9C4F835FBDE7B33C"><enum>(1)</enum><text>it is appropriate

			 to reallocate the costs of the Pactola Dam and Reservoir, South Dakota, to

			 reflect increased demands for municipal, industrial, and fish and wildlife

			 purposes; and</text>

			</paragraph><paragraph id="ID57F74B069F434B4191390B2D7BF2D41A"><enum>(2)</enum><text>section 302 of

			 the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7152">42 U.S.C. 7152</external-xref>) prohibits such a

			 reallocation of costs without congressional approval.</text>

			</paragraph></section><section changed="not-changed" commented="no" id="ID5B878F1663DF4AE8B7EC5C391037970D" section-type="subsequent-section"><enum>3.</enum><header>Reallocation of costs

			 of pactola dam and reservoir, South Dakota</header><text display-inline="no-display-inline">The Secretary of the Interior may, as

			 provided in the contract of August 2001 entered into between Rapid City, South

			 Dakota, and the Rapid Valley Conservancy District, reallocate, in a manner

			 consistent with Federal reclamation law (the Act of June 17, 1902

			 (<external-xref legal-doc="statute-at-large" parsable-cite="stat/32/388">32

			 Stat. 388</external-xref>, chapter 1093), and Acts supplemental to and

			 amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371</external-xref> et seq.)), the

			 construction costs of Pactola Dam and Reservoir, Rapid Valley Unit, Pick-Sloan

			 Missouri Basin Program, South Dakota, from irrigation purposes to municipal,

			 industrial, and fish and wildlife purposes.</text>
