		<section id="H4D98DCFF553D4047B01532AF090027F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Coal Leasing Amendments Act of

			 2005</short-title></quote>.</text>

		</section><section display-inline="no-display-inline" id="H43A07DD08614415C8C4298782D563951"><enum>2.</enum><header>Financial

			 assurances with respect to bonus bids</header><text display-inline="no-display-inline">Section 2(a) of the Mineral Leasing Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/30/201">30 U.S.C.

			 201(a)</external-xref>) is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="id4A4C6B1E95A942D0A27FFCB0A8408BE3" style="OLC">

				<paragraph id="H843366A1D7B54E2FA8E48594276F78E4" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6A3E50435EE24E6CA59E31EA3FC22FE"><enum>(A)</enum><text>The Secretary shall not

				require a surety bond or any other financial assurance to guarantee payment of

				deferred bonus bid installments with respect to any coal lease issued on a cash

				bonus bid to a lessee or successor in interest having a history of a timely

				payment of noncontested coal royalties and advanced coal royalties in lieu of

				production (where applicable) and bonus bid installment payments.</text>

					</subparagraph><subparagraph id="H7857999D7B7043D0B536330023A6FAAA" indent="up1"><enum>(B)</enum><text>The Secretary may waive any

				requirement that a lessee provide a surety bond or other financial assurance

				for a coal lease issued before the date of enactment of this paragraph only if

				the Secretary determines that the lessee has a history of making the timely

				payments described in subparagraph (A).</text>

					</subparagraph></paragraph><paragraph id="H9C9FA398251746A18DEF95D26D8B4743" indent="up1"><enum>(5)</enum><text>Notwithstanding any other provision

				of law, if the lessee under a coal lease fails to pay any installment of a

				deferred cash bonus bid within 10 days after the Secretary provides written

				notice that payment of the installment is past due—</text>

					<subparagraph id="H1548209A090B421EADCADBFFA16DADC5"><enum>(A)</enum><text>the lease shall automatically

				terminate; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7BD854F85C2464200A51C220099F0C9"><enum>(B)</enum><text>any bonus payments already made to the

				United States with respect to the lease shall not be returned to the lessee or

				credited in any future lease

				sale.</text>

					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="H3D3014BFCEC54577007017CAAFFC611"><enum>3.</enum><header>Mining

			 plans</header><text display-inline="no-display-inline">Section 2(d)(2) of the

			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/202a">30 U.S.C. 202a(2)</external-xref>)

			 is amended—</text>

			<paragraph id="HBA0DEC2ED0B841CEA6A0E7EFA9750821"><enum>(1)</enum><text>by inserting

			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>

			</paragraph><paragraph id="H5799300A930F484F92F71DDA56609107"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block id="H3F8C70684A8C41C39000A8A69B338116">

					<subparagraph id="HD4297B790D904414876C990420FD2ED6" indent="up2"><enum>(B)</enum><text>The Secretary may establish a period

				of more than 40 years if the Secretary determines that the longer

				period—</text>

						<clause id="H4BAEB185D32F4830B1F801FFDBA7322"><enum>(i)</enum><text>will ensure the maximum economic

				recovery of a coal deposit; or</text>

						</clause><clause id="HCE2AD21769394CB7B5279162606F17E8"><enum>(ii)</enum><text>is in the interest of the orderly,

				efficient, or economic development of a coal

				resource.</text>

						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id245AE98467B841E6A2188E610929160A" section-type="subsequent-section"><enum>4.</enum><header>Repeal of the 160-ACRE

			 limitation for coal leases</header><text display-inline="no-display-inline">Section 3 of the

			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/203">30 U.S.C. 203</external-xref>) is

			 amended in the first sentence by striking <quote>such lease,</quote> and all

			 that follows through the period at the end and inserting <quote>the

			 lease.</quote>.</text>

		</section><section id="HBBB46A15B77E4A2F852036D705E3E519"><enum>5.</enum><header>Payment of

			 advance royalties under coal leases</header>

			<subsection id="H63CCB36C3DBD49DBAC2B141DB800D95F"><enum>(a)</enum><header>In

			 general</header><text>Section 7 of the <act-name parsable-cite="MLA">Mineral

			 Leasing Act</act-name> of 1920 (<external-xref legal-doc="usc" parsable-cite="usc/30/207">30 U.S.C. 207</external-xref>) is amended by

			 striking subsection (b) and inserting the following:</text>

				<quoted-block act-name="Mineral Leasing Act" id="H5B323D670D2E48E7A82790AE0061302E">

					<subsection id="H1CA1DA364EAC49A99FBD1C34FE5782CD"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9711504A9C9C4E5DB5278FA838CF43E4"><enum>(1)</enum><text>Each lease shall be

				subject to the condition of diligent development and continued operation of the

				mine, except in cases in which operations under the lease are interrupted by

				strikes, the elements, or casualties not attributable to the lessee.</text>

						</paragraph><paragraph id="H2C52C894FE2B40709400AA3300193092" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H41C248C94AC94E3CBD5017C4F06609D4"><enum>(A)</enum><text>The Secretary of the

				Interior may suspend the condition of continued operation on the payment of

				advance royalties if the Secretary of the Interior determines that the

				suspension is in the public interest.</text>

							</subparagraph><subparagraph display-inline="no-display-inline" id="H238DE73B416F4184B657A2A39376B552" indent="up1"><enum>(B)</enum><text>The amount of advance royalties to be

				paid under subparagraph (A) shall be determined based on—</text>

								<clause id="HFF0ACF9FE710484DB378DFA9C2826999"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id252626C69A4F4EA1A1DA9406699832FD"><enum>(I)</enum><text>the average price in

				the spot market for sales of coal from the same region during the last month of

				each applicable continued operation year; or</text>

									</subclause><subclause id="id177C352BB5F645AD81ECF2775737BC15" indent="up1"><enum>(II)</enum><text>if there is no spot market for coal

				from the same region, a comparable method established by the Secretary of the

				Interior to capture the commercial value of coal; and</text>

									</subclause></clause><clause id="H72AE695D78E44396A53B26B54FEA79B8"><enum>(ii)</enum><text>based on commercial quantities, as

				defined by regulations issued by the Secretary of the Interior.</text>

								</clause></subparagraph><subparagraph id="H9079AE13D9A84299B2B701A3B84D3E37" indent="up1"><enum>(C)</enum><text>Advance royalties may be accepted in

				lieu of the condition of continued operation for not more than a total of 20

				years during the initial term and any extended terms of a lease.</text>

							</subparagraph></paragraph><paragraph id="H6D69AE2681C242038C2D875CADF0B659" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8F24752983E74811A886462FC5BC25FD"><enum>(A)</enum><text>Subject to subparagraph

				(B), the amount of a production royalty paid for any year shall be reduced by

				the amount of any advance royalties paid under the lease to the extent that the

				advance royalties have not been used to reduce production royalties for a prior

				year.</text>

							</subparagraph><subparagraph id="id236E1C43707D411B9D6A4D68631AEF5D" indent="up1"><enum>(B)</enum><text>The amount of a production royalty

				shall not be reduced below zero.</text>

							</subparagraph></paragraph><paragraph id="HC8527036956B491C81560085E3BCD8CC" indent="up1"><enum>(4)</enum><text>This subsection applies to any lease

				or logical mining unit that is—</text>

							<subparagraph id="id6B48A76CFC4744C6909128B499C918C5"><enum>(A)</enum><text>in existence on the date of enactment

				of this paragraph; or</text>

							</subparagraph><subparagraph id="id38404E79478A47399E17E689564C01F0"><enum>(B)</enum><text>issued or approved after the date of

				enactment of this paragraph.</text>

							</subparagraph></paragraph><paragraph id="HD6751A53C2814D04A32458BF4370A482" indent="up1"><enum>(5)</enum><text>Nothing in this subsection affects

				the requirement in the second sentence of subsection (a) relating to

				commencement of production at the end of 10

				years.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="H93D0DF5CA53C4CF09CB4FECCA77C1395"><enum>(b)</enum><header>Authority to

			 waive, suspend, or reduce advance royalties</header><text>Section 39 of the

			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/209">30 U.S.C. 209</external-xref>) is

			 amended by striking the last sentence.</text>

			</subsection></section><section id="HEB3AE1A8907141D9007D1036009C13CC"><enum>6.</enum><header>Elimination of

			 deadline for submission of coal lease operation and reclamation

			 plan</header><text display-inline="no-display-inline">Section 7(c) of the

			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/207">30 U.S.C. 207(c)</external-xref>) is

			 amended in the first sentence by striking <quote>and not later than three years

			 after a lease is issued,</quote>.</text>

		</section><section id="H0D35EC5AEDC84F708E6792A6389132E1"><enum>7.</enum><header>Inventory

			 requirement</header>

			<subsection id="H7E3CB671C8994544A7227E2CCB49F984"><enum>(a)</enum><header>Definitions</header><text>In

			 this section:</text>

				<paragraph id="idD3C15CDEDF264E6BBD90B19EDD4A9F64"><enum>(1)</enum><header>Compliant

			 coal</header><text>The term <term>compliant coal</term> means coal that

			 contains not less than 1.0 and not more than 1.2 pounds of sulfur dioxide per

			 million Btu.</text>

				</paragraph><paragraph id="idA1814BD4D00444078DAA204E5D5DF303"><enum>(2)</enum><header>Secretary</header><text>The

			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>

				</paragraph><paragraph id="id95CD033FDBB34F2685DEDFF58FB2CA9B"><enum>(3)</enum><header>Supercompliant

			 coal</header><text>The term <term>supercompliant coal</term> means coal that

			 contains less than 1.0 pounds of sulfur dioxide per million Btu.</text>

				</paragraph></subsection><subsection id="id7E7A245545AA4B538E905DC0B517B050"><enum>(b)</enum><header>Review of

			 assessments; inventory</header><text>The Secretary, in consultation with the

			 Secretary of Agriculture and the Secretary of Energy, shall review coal

			 assessments and other available data for purposes of preparing an inventory

			 that identifies—</text>

				<paragraph id="HF86DCB7D1C8A42D792F1B94E004DA6E8"><enum>(1)</enum><text>public land with

			 coal resources;</text>

				</paragraph><paragraph id="H4F8462D82D0D45D595564B434BDB5B4B"><enum>(2)</enum><text>the extent and

			 nature of any restrictions or impediments to the development of coal resources

			 on the public land identified under paragraph (1); and</text>

				</paragraph><paragraph id="H0ECD4E4238824817AED5D1CF83BE3FBD"><enum>(3)</enum><text>with respect to

			 areas of the identified public land for which sufficient data exists, resources

			 of compliant coal and supercompliant coal.</text>

				</paragraph></subsection><subsection id="H5C91F4FD52164A2E9F438930C337E65"><enum>(c)</enum><header>Completion and

			 updates of inventory</header>

				<paragraph id="id0A7D561BBBE04C9C8B231B21388F5B12"><enum>(1)</enum><header>Completion</header><text>Not

			 later than 2 years after the date of enactment of this Act, the Secretary shall

			 complete the inventory required under subsection (b).</text>

				</paragraph><paragraph id="HCCBA070A22DA4EE09EFC2243B8AEBBA2"><enum>(2)</enum><header>Updates</header><text>The

			 Secretary shall update the inventory prepared under subsection (b) as the

			 availability of data and developments in technology warrant.</text>

				</paragraph></subsection><subsection id="HF8886377454A4875BE833E6E947362D1"><enum>(d)</enum><header>Report</header><text>The

			 Secretary shall submit to the Committee on Resources of the House of

			 Representatives and the Committee on Energy and Natural Resources of the Senate

			 and make publicly available—</text>

				<paragraph id="H61FDFCE1374C45DCBB87A0432865CE83"><enum>(1)</enum><text>on completion of

			 the inventory required under subsection (b), a report that includes the

			 inventory; and</text>

				</paragraph><paragraph id="H910673B6DD2A49C684D19DE906AA00C"><enum>(2)</enum><text>any updates of the

			 inventory prepared under subsection (c)(2).</text>

				</paragraph></subsection></section><section id="H020BFF7B98E84549B35CC799F1548308"><enum>8.</enum><header>Application of

			 amendments</header><text display-inline="no-display-inline">The amendments made

			 by this Act apply with respect to any coal lease issued before, on, or after

			 the date of enactment of this Act.</text>
