			 protection</header>

			<subsection id="idF4DE1A52CCA7492E902E0B65FEA984FF"><enum>(a)</enum><header>In

			 general</header><text>Subchapter III of chapter 19 of title 38, United States

			 Code, is amended—</text>

				<paragraph id="idF47FB62351BA4F4EA9556A6A0FC4D410"><enum>(1)</enum><text>in section 1965,

			 by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id040DC921825F40ACA88DE2EEA7A21187" style="OLC">

						<paragraph id="id9850637E2BDE413DBDC43B6FCFEE1CE4"><enum>(11)</enum><text>The term

				<quote>activities of daily living</quote> means the inability to independently

				perform 2 of the 6 following functions:</text>

							<subparagraph id="id569BBA183F97413EB520A24F277449B6"><enum>(A)</enum><text>Bathing.</text>

							</subparagraph><subparagraph id="id13CE36AF06474844ADEF1AE06342D17D"><enum>(B)</enum><text>Continence.</text>

							</subparagraph><subparagraph id="idF2C5B9EAAFD74EF69189C0FD60871CB3"><enum>(C)</enum><text>Dressing.</text>

							</subparagraph><subparagraph id="id0B88D006DAAB44B0A635628FA261614D"><enum>(D)</enum><text>Eating.</text>

							</subparagraph><subparagraph id="id051A3C6A3A444986BA54614628134F1C"><enum>(E)</enum><text>Toileting.</text>

							</subparagraph><subparagraph id="id36540A7E95024EBF8A0BBF3C670C7EE5"><enum>(F)</enum><text>Transferring.</text>

							</subparagraph></paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph id="id9CA3717C9E8747A284170BD3DFF812B4"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block act-name="" display-inline="no-display-inline" id="id52093F4DEBBD4C40B19F46198371424C" style="USC">

						<section id="ID1801c5a84fc7476cacda02a78c3dd5f4"><enum>1980A.</enum><header>Traumatic

				injury protection</header>

							<subsection id="idE6EC702541254940BB43C52B32AC8A5E"><enum>(a)</enum><text display-inline="yes-display-inline">A member who is insured under subparagraph

				(A)(i), (B), or (C)(i) of section 1967(a)(1) shall automatically be issued a

				traumatic injury protection rider that will provide for a payment not to exceed

				$100,000 if the member, while so insured, sustains a traumatic injury that

				results in a loss described in subsection (b)(1). The maximum amount payable

				for all injuries resulting from the same traumatic event shall be limited to

				$100,000. If a member suffers more than 1 such loss as a result of traumatic

				injury, payment will be made in accordance with the schedule in subsection (d)

				for the single loss providing the highest payment.</text>

							</subsection><subsection id="IDf026ac0dd8c4449e80d93da3f07ef76c"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF038CC4C8BD9459C951379243D3F45F1"><enum>(1)</enum><text display-inline="yes-display-inline">A member who is issued a traumatic injury

				protection rider under subsection (a) is insured against—</text>

									<subparagraph id="IDff5c40cb3ece4e39a50e1842ec30af78" indent="up1"><enum>(A)</enum><text>total and permanent loss of

				sight;</text>

									</subparagraph><subparagraph id="IDc1e8faa2fbe64abba83a5bbdc9b3d2cd" indent="up1"><enum>(B)</enum><text>loss of a hand or foot by severance at

				or above the wrist or ankle;</text>

									</subparagraph><subparagraph id="ID43c215766b884f45a9f5c3c96c65c202" indent="up1"><enum>(C)</enum><text>total and permanent loss of

				speech;</text>

									</subparagraph><subparagraph id="ID108c2558105143e7ac53126c944b853e" indent="up1"><enum>(D)</enum><text>total and permanent loss of hearing in

				both ears;</text>

									</subparagraph><subparagraph id="ID6401fec0350c44f29200c5d253157576" indent="up1"><enum>(E)</enum><text>loss of thumb and index finger of the

				same hand by severance at or above the metacarpophalangeal joints;</text>

									</subparagraph><subparagraph id="ID7bba9ef565ee43f58c3153b8e0ef0ec5" indent="up1"><enum>(F)</enum><text>quadriplegia, paraplegia, or

				hemiplegia;</text>

									</subparagraph><subparagraph id="ID09a53e906dd34abb9aea22fc946b825c" indent="up1"><enum>(G)</enum><text>burns greater than second degree,

				covering 30 percent of the body or 30 percent of the face; and</text>

									</subparagraph><subparagraph id="IDfb63cc89857746449ecbb0be9b38684f" indent="up1"><enum>(H)</enum><text>coma or the inability to carry out the

				activities of daily living resulting from traumatic injury to the brain.</text>

									</subparagraph></paragraph><paragraph id="ID2ece19a9866a41f6a7e2afc2e1afe911" indent="up1"><enum>(2)</enum><text>For purposes of this

				subsection—</text>

									<subparagraph id="ID9e501db233784a25a6f00a759eca1b90"><enum>(A)</enum><text>the term <term>quadriplegia</term>

				means the complete and irreversible paralysis of all 4 limbs;</text>

									</subparagraph><subparagraph id="ID60fc1c656dad460a877c6ca8695451dc"><enum>(B)</enum><text>the term <term>paraplegia</term> means

				the complete and irreversible paralysis of both lower limbs; and</text>

									</subparagraph><subparagraph id="ID79acabeb9fff4910ae53485d93cb155b"><enum>(C)</enum><text>the term <term>hemiplegia</term> means

				the complete and irreversible paralysis of the upper and lower limbs on 1 side

				of the body.</text>

									</subparagraph></paragraph><paragraph id="ID5f84289ac8ff4d3dbfa18de195853228" indent="up1"><enum>(3)</enum><text>In no case will a member be covered

				against loss resulting from—</text>

									<subparagraph id="ID3bf54296ef2546ab9c7cdeb5dcb79c05"><enum>(A)</enum><text>attempted suicide, while sane or

				insane;</text>

									</subparagraph><subparagraph id="ID0af60848888d4e0c9c30d856693a1b57"><enum>(B)</enum><text>an intentionally self-inflicted injury

				or any attempt to inflict such an injury;</text>

									</subparagraph><subparagraph id="ID32dac29333d24627aec8665b62db84e6"><enum>(C)</enum><text>illness, whether the loss results

				directly or indirectly;</text>

									</subparagraph><subparagraph id="IDcebfd7e3612940a6ad9cf425d2d9cd1b"><enum>(D)</enum><text>medical or surgical treatment of

				illness, whether the loss results directly or indirectly;</text>

									</subparagraph><subparagraph id="ID41cbbcea08b64c469288b752039b468b"><enum>(E)</enum><text>any infection other than—</text>

										<clause id="IDc69caa34a98148918b6c87d610641e12"><enum>(i)</enum><text>a pyogenic infection resulting from

				a cut or wound; or</text>

										</clause><clause id="IDc8c39f7f1c34410cb9eb656409db96c8"><enum>(ii)</enum><text>a bacterial infection resulting

				from ingestion of a contaminated substance;</text>

										</clause></subparagraph><subparagraph id="ID0c32bf69bfda4c1681e992221e4815e0"><enum>(F)</enum><text>the commission of or attempt to commit

				a felony;</text>

									</subparagraph><subparagraph id="IDdec8ec53530a4f10a8122c485962d836"><enum>(G)</enum><text>being legally intoxicated or under the

				influence of any narcotic unless administered or consumed on the advice of a

				physician; or</text>

									</subparagraph><subparagraph id="ID33da41c400d4401ca2980e648c4d6d4a"><enum>(H)</enum><text>willful misconduct as determined by a

				military court, civilian court, or administrative body.</text>

									</subparagraph></paragraph></subsection><subsection id="IDd459d5f204d440c19b6d0655e0ff5627"><enum>(c)</enum><text>A payment under

				this section may be made only if—</text>

								<paragraph id="ID3129d15b6e734395972f77f06fce6d38"><enum>(1)</enum><text>the member is

				insured under Servicemembers’ Group Life Insurance when the traumatic injury is

				sustained;</text>

								</paragraph><paragraph id="ID57ec90a3eec14d54ab57c7bfcc6920da"><enum>(2)</enum><text>the loss results

				directly from that traumatic injury and from no other cause; and</text>

								</paragraph><paragraph id="IDc87476ab499d4aba9b6bce6a6f9a049b"><enum>(3)</enum><text>the member

				suffers the loss not later than 90 days after sustaining the traumatic injury,

				except, if the loss is quadriplegia, paraplegia, or hemiplegia, the member

				suffers the loss not later than 365 days after sustaining the traumatic

				injury.</text>

								</paragraph></subsection><subsection id="ID5df7664930ec4800905ab1c181905a1e"><enum>(d)</enum><text>Payments under

				this section for losses described in subsection (b)(1) will be made in

				accordance with the following schedule:</text>

								<paragraph id="ID94dd7bfb32394b36abae0ea21796c943"><enum>(1)</enum><text>Loss of both

				hands, $100,000.</text>

								</paragraph><paragraph id="IDf3304f4964a1453c9486e99fde32393d"><enum>(2)</enum><text>Loss of both

				feet, $100,000.</text>

								</paragraph><paragraph id="ID4c25d9a2766041fc92eff0e17431edd4"><enum>(3)</enum><text>Inability to

				carry out activities of daily living resulting from traumatic brain injury,

				$100,000.</text>

								</paragraph><paragraph id="ID5b27ff3115a5413aaac5bdab83cfabfb"><enum>(4)</enum><text>Burns greater

				than second degree, covering 30 percent of the body or 30 percent of the face,

				$100,000.</text>

								</paragraph><paragraph id="ID93e4b50579184ce6bbf78ae0cba26951"><enum>(5)</enum><text>Loss of sight in

				both eyes, $100,000.</text>

								</paragraph><paragraph id="IDcfffefc2cc8a4743b82209a23ebaeaeb"><enum>(6)</enum><text>Loss of 1 hand

				and 1 foot, $100,000.</text>

								</paragraph><paragraph id="IDd7b99ec320fc44c6936a03ee1e15a83b"><enum>(7)</enum><text>Loss of 1 hand

				and sight of 1 eye, $100,000.</text>

								</paragraph><paragraph id="IDb58bd8ef68b24ae2afce93292c621c8b"><enum>(8)</enum><text>Loss of 1 foot

				and sight of 1 eye, $100,000.</text>

								</paragraph><paragraph id="IDf81cfd17f9dc4a26a1d461ff6e46cf1e"><enum>(9)</enum><text>Loss of speech

				and hearing in 1 ear, $100,000.</text>

								</paragraph><paragraph id="IDa271a5ec8bca414d99c8d0e442ebf785"><enum>(10)</enum><text>Total and

				permanent loss of hearing in both ears, $100,000.</text>

								</paragraph><paragraph id="IDc459c8257e0b4a7c9ccd8ebe84de7570"><enum>(11)</enum><text>Quadriplegia,

				$100,000.</text>

								</paragraph><paragraph id="ID28d00548e9504b88b9c34c9b8dbfcd99"><enum>(12)</enum><text>Paraplegia,

				$75,000.</text>

								</paragraph><paragraph id="IDc6ea7893a5664ab5b70f54809c861f87"><enum>(13)</enum><text>Loss of 1 hand,

				$50,000.</text>

								</paragraph><paragraph id="ID9eab6fc1eb4841e890c068647407a1c5"><enum>(14)</enum><text>Loss of 1 foot,

				$50,000.</text>

								</paragraph><paragraph id="ID85db276fc88a4b16b19a73acf7293257"><enum>(15)</enum><text>Loss of sight

				one eye, $50,000.</text>

								</paragraph><paragraph id="IDd4e8591cafc14f059c2a6345a74aac41"><enum>(16)</enum><text>Total and

				permanent loss of speech, $50,000.</text>

								</paragraph><paragraph id="ID25e5ff73ac4f431f981e03d8774573f2"><enum>(17)</enum><text>Loss of hearing

				in 1 ear, $50,000.</text>

								</paragraph><paragraph id="ID3c25bc6c4fc24e57abb58ed01b2d93c9"><enum>(18)</enum><text>Hemiplegia,

				$50,000.</text>

								</paragraph><paragraph id="ID6f50030787754a42ab11d460400c2ff0"><enum>(19)</enum><text>Loss of thumb

				and index finger of the same hand, $25,000.</text>

								</paragraph><paragraph id="IDee45d8ed4726448a9df92433e25ed457"><enum>(20)</enum><text>Coma resulting

				from traumatic brain injury, $50,000 at time of claim and $50,000 at end of

				6-month period.</text>

								</paragraph></subsection><subsection id="ID798c9f1e098d4de4966e2d6fc8118439"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id9B0CE15746194AF28E64ADDF5392E80A"><enum>(1)</enum><text>During any period in

				which a member is insured under this section and the member is on active duty,

				there shall be deducted each month from the member's basic or other pay until

				separation or release from active duty an amount determined by the Secretary of

				Veterans Affairs as the premium allocable to the pay period for providing

				traumatic injury protection under this section (which shall be the same for all

				such members) as the share of the cost attributable to provided coverage under

				this section, less any costs traceable to the extra hazards of such duty in the

				uniformed services.</text>

								</paragraph><paragraph id="ID93df39c3ca45445a979a54f08524c687" indent="up1"><enum>(2)</enum><text>During any month in which a member is

				assigned to the Ready Reserve of a uniformed service under conditions which

				meet the qualifications set forth in section 1965(5)(B) of this title and is

				insured under a policy of insurance purchased by the Secretary of Veterans

				Affairs under section 1966 of this title, there shall be contributed from the

				appropriation made for active duty pay of the uniformed service concerned an

				amount determined by the Secretary of Veterans Affairs (which shall be the same

				for all such members) as the share of the cost attributable to provided

				coverage under this section, less any costs traceable to the extra hazards of

				such duty in the uniformed services. Any amounts so contributed on behalf of

				any member shall be collected by the Secretary of the concerned service from

				such member (by deduction from pay or otherwise) and shall be credited to the

				appropriation from which such contribution was made in advance on a monthly

				basis.</text>

								</paragraph><paragraph id="ID59155f6558434c42bfcf6d161a036f76" indent="up1"><enum>(3)</enum><text>The Secretary of Veterans Affairs

				shall determine the premium amounts to be charged for traumatic injury

				protection coverage provided under this section.</text>

								</paragraph><paragraph id="IDf278ebfb73f84a8eac4411e33dc1013b" indent="up1"><enum>(4)</enum><text>The premium amounts shall be

				determined on the basis of sound actuarial principles and shall include an

				amount necessary to cover the administrative costs to the insurer or insurers

				providing such insurance.</text>

								</paragraph><paragraph id="ID9950d1ff55c641e280aa90de550152f6" indent="up1"><enum>(5)</enum><text>Each premium rate for the first

				policy year shall be continued for subsequent policy years, except that the

				rate may be adjusted for any such subsequent policy year on the basis of the

				experience under the policy, as determined by the Secretary of Veterans Affairs

				in advance of that policy year.</text>

								</paragraph><paragraph id="ID32f9f208e4b648bab72b6c84b8a63110" indent="up1"><enum>(6)</enum><text>The cost attributable to insuring

				such member under this section, less the premiums deducted from the pay of the

				member’s uniformed service, shall be paid by the Secretary of Defense to the

				Secretary of Veterans Affairs. This amount shall be paid on a monthly basis,

				and shall be due within 10 days of the notice provided by the Secretary of

				Veterans Affairs to the Secretary of the concerned uniformed service.</text>

								</paragraph><paragraph id="ID04ff7dd66dd341acb7debb564e13ccf5" indent="up1"><enum>(7)</enum><text>The Secretary of Defense shall

				provide the amount of appropriations required to pay expected claims in a

				policy year, as determined according to sound actuarial principles by the

				Secretary of Veterans Affairs.</text>

								</paragraph><paragraph id="IDc1f4f28ffcd54f2cb17e70ab174e1fc6" indent="up1"><enum>(8)</enum><text>The Secretary of Defense shall

				forward an amount to the Secretary of Veterans Affairs that is equivalent to

				half the anticipated cost of claims for the current fiscal year, upon the

				effective date of this legislation.</text>

								</paragraph></subsection><subsection id="ID4a39e9bdbee14455993ccea05c0d6f6c"><enum>(f)</enum><text>The Secretary of

				Defense shall certify whether any member claiming the benefit under this

				section is eligible.</text>

							</subsection><subsection id="ID29a006ba7a0c4fe6a24529a26a8118a2"><enum>(g)</enum><text>Payment for a

				loss resulting from traumatic injury will not be made if the member dies not

				more than 7 days after the date of the injury. If the member dies before

				payment to the member can be made, the payment will be made according to the

				member’s most current beneficiary designation under Servicemembers’ Group Life

				Insurance, or a by law designation, if applicable.</text>

							</subsection><subsection id="ID89a872ed39b940cda0c591cc59ba9c23"><enum>(h)</enum><text>Coverage for loss

				resulting from traumatic injury provided under this section shall cease at

				midnight on the date of the member’s separation from the uniformed service.

				Payment will not be made for any loss resulting from injury incurred after the

				date a member is separated from the uniformed services.</text>

							</subsection><subsection id="ID926de06bc6c748a78086ccca369e0f0c"><enum>(i)</enum><text>Insurance

				coverage provided under this section is not convertible to Veterans’ Group Life

				Insurance.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa931a205400c4526aa2898f6d5194089"><enum>(b)</enum><header>Clerical

			 amendment</header><text display-inline="yes-display-inline">The table of

			 sections for chapter 19 of title 38, United States Code, is amended by adding

			 after the item relating to section 1980 the following:</text>

			 date</header><text display-inline="no-display-inline">The amendments made by

			 section 1 shall take effect on the first day of the first month beginning more

			 than 180 days after the date of enactment of this Act.</text>
