This Act may be cited as the
Prevention of Childhood Obesity
Act
.

Congress makes the following
findings:
(1)
Childhood overweight and obesity is a major public health threat
to the United States. The rates of obesity have doubled in preschool children
and tripled in adolescents in the past 25 years. About 9,000,000 young people
are considered overweight.
(2)
Overweight and obesity is more prevalent in Mexican American and
African American youth. Among Mexican Americans, 24 percent of children (6 to
11 years) and adolescents (12 to 19 years) are obese and another 40 percent of
children and 44 percent of adolescents are overweight. Among African Americans,
20 percent of children and 24 percent of adolescents are obese and another 36
percent of children and 41 percent of adolescents are overweight.
(3)
Childhood overweight and obesity is related to the development of
a number of preventable chronic diseases in childhood and adulthood, such as
type 2 diabetes and hypertension.
(4)
Overweight adolescents have up to an 80 percent chance of
becoming obese adults. In 2003, obesity-related health conditions in adults
resulted in approximately $11,000,000,000 in medical expenditures.
(5)
Childhood overweight and obesity is preventable but will require
changes across the multiple environments to which our children are exposed.
This includes homes, schools, communities, and society at large.
(6)
Overweight and obesity in children are caused by unhealthy eating
habits and insufficient physical activity.
(7)
Only 2 percent of school children meet all of the recommendations
of the Food Guide Pyramid. Sixty percent of young people eat too much fat and
less than 20 percent eat the recommended 5 or more servings of fruits and
vegetables each day.
(8)
More than one third of young people do not meet recommended
guidelines for physical activity. Daily participation in high school physical
education classes dropped from 42 percent in 1991 to 28 percent in 2003.
(9)
Children spend an average of 51/2 hours per
day using media, more time than they spend doing anything besides
sleeping.
(10)
Children are exposed to an average of 40,000 television
advertisements each year for candy, high sugar cereals, and fast food. Fast
food outlets alone spend $3,000,000,000 in advertisements targeting children.
Children are exposed to 1 food commercial every 5 minutes.
(11)
A coordinated effort involving evidence-based approaches is
needed to ensure children develop in a society in which healthy lifestyle
choices are available and encouraged.

<enum>101.</enum>
<header>Federal Leadership Commission to Prevent Childhood
Obesity</header>

280h et seq.) is amended by inserting after section 399W, the following:</text>

<header>Federal Leadership Commission to Prevent Childhood
Obesity</header>
<subsection id="ID3483129ACB464037B9BF80A829FEE39A">
<enum>(a)</enum>
<header>In general</header>
<text>The Secretary shall ensure that the Federal Government
coordinates efforts to develop, implement, and enforce policies that promote
messages and activities designed to prevent obesity among children and
youth.</text>
</subsection><subsection id="ID760BBBBF8FD94C479B80A50438D8DD29">
<enum>(b)</enum>
<header>Establishment of leadership commission</header>
<text>The Secretary, acting through the Director of the Centers for
Disease Control and Prevention, shall establish within the Centers for Disease
Control and Prevention a Federal Leadership Commission to Prevent Childhood
Obesity (referred to in this section as the <quote>Commission</quote>) to
assess and make recommendations for Federal departmental policies, programs,
and messages relating to the prevention of childhood obesity. The Director
shall serve as the chairperson of the Commission.</text>
</subsection><subsection id="IDEC98278CF70947B4ADAE86DB647D262F">
<enum>(c)</enum>
<header>Membership</header>
<text>The Commission shall include representatives of offices and
agencies within—</text>

<text>the Department of Health and Human Services;</text>
</paragraph><paragraph id="ID6530D5DC97244A3FB04117509728A33F">
<enum>(2)</enum>
<text>the Department of Agriculture;</text>
</paragraph><paragraph id="ID5055663D84B14A20BCA51A40696FDCCA">
<enum>(3)</enum>
<text>the Department of Commerce;</text>
</paragraph><paragraph id="ID812EAF0B8DF0458EB5EDACDCD98A3E8F">
<enum>(4)</enum>
<text>the Department of Education;</text>
</paragraph><paragraph id="ID941DA0E3311146BB901C808A2D7A9474">
<enum>(5)</enum>
<text>the Department of Housing and Urban Development;</text>

<text>other Federal entities as determined appropriate by the
Secretary.</text>
</paragraph></subsection><subsection id="ID6E28764C8FEF40D7A98F34B5918BEBBE">
<enum>(d)</enum>
<header>Duties</header>
<text>The Commission shall—</text>
<paragraph id="ID8C30F820B0234D82BCECCB60EA05E8E6">
<enum>(1)</enum>
<text>serve as a centralized mechanism to coordinate activities
related to obesity prevention across all Federal departments and
agencies;</text>
</paragraph><paragraph id="ID907742B18111488CBBF94704620C22D9">
<enum>(2)</enum>
<text>establish specific goals for obesity prevention, and determine
accountability for reaching these goals, within and across Federal departments
and agencies;</text>
</paragraph><paragraph id="ID3CA22BE2A8C9457BBF6BFAE38AEA4EF9">
<enum>(3)</enum>
<text>review evaluation and economic data relating to the impact of
Federal interventions on the prevention of childhood obesity;</text>
</paragraph><paragraph id="ID7E4CD32650B14E9887BEA98627A46E14">
<enum>(4)</enum>
<text>provide a description of evidence-based best practices, model
programs, effective guidelines, and other strategies for preventing childhood
obesity;</text>
</paragraph><paragraph id="ID6E76567DEC594ED6A874C8CCA335CBFD">
<enum>(5)</enum>
<text>make recommendations to improve Federal efforts relating to
obesity prevention and to ensure Federal efforts are consistent with available
standards and evidence; and</text>
</paragraph><paragraph id="ID099EF8C929CB45CD829CD9FDA3319EA9">
<enum>(6)</enum>
<text>monitor Federal progress in meeting specific obesity prevention
goals.</text>
</paragraph></subsection><subsection id="IDAFB4402588BB4AD7B4E74F962B9B11EF">
<enum>(e)</enum>
<header>Study; summit; guidelines</header>
<paragraph id="ID8E5E7BD70FBB4393BE3732E02C361AF1">
<enum>(1)</enum>
<header>Study</header>
<text>The Government Accountability Office shall—</text>
<subparagraph id="ID857E9F36547D4CE3AFC95E17A3840F9A">
<enum>(A)</enum>
<text>conduct a study to assess the effect of Federal nutrition
assistance programs and agricultural policies on the prevention of childhood
obesity, and prepare a report on the results of such study that shall include a
description and evaluation of the content and impact of Federal agriculture
subsidy and commodity programs and policies as such relate to Federal nutrition
programs;</text>
</subparagraph><subparagraph id="ID84C06679239945B385D7D0B1F6C67B4C">
<enum>(B)</enum>
<text>make recommendations to guide or revise Federal policies for
ensuring access to nutritional foods in Federal nutrition assistance programs;
and</text>
</subparagraph><subparagraph id="IDF78BEFA5A2514D54A97CF470301072F0">
<enum>(C)</enum>
<text>complete the activities provided for under this section not
later than 18 months after the date of enactment of this section.</text>
</subparagraph></paragraph><paragraph id="ID45E56219229949EAB9D85E0D2DBC20F9">
<enum>(2)</enum>
<header>Institute of medicine study</header>
<subparagraph id="IDBF494603527F47FCBE57F97676573C89">
<enum>(A)</enum>
<header>In general</header>
<text>Not later than 6 months after the date of enactment of this
section, the Secretary shall request that the Institute of Medicine (or similar
organization) conduct a study and make recommendations on guidelines for
nutritional food and physical activity advertising and marketing to prevent
childhood obesity. In conducting such study the Institute of Medicine
shall—</text>
<clause id="ID148C0A90B3AC44819A9644D83D1A3F4D">
<enum>(i)</enum>
<text>evaluate children’s advertising and marketing guidelines and
evidence-based literature relating to the impact of advertising on nutritional
foods and physical activity in children and youth; and</text>
</clause><clause id="IDD9325AFE1E57435E89C540A4C684BDFF">
<enum>(ii)</enum>
<text>make recommendations on national guidelines for advertising and
marketing practices relating to children and youth that—</text>
<subclause id="IDD807FDBE37614492BE6D9565E0FD1605">
<enum>(I)</enum>
<text>reduce the exposure of children and youth to advertising and
marketing of foods of poor or minimal nutritional value and practices that
promote sedentary behavior; and</text>
</subclause><subclause id="ID79C3AFD9D5314DDEB0E27BFE782F24CE">
<enum>(II)</enum>
<text>increase the number of media messages that promote physical
activity and sound nutrition.</text>
</subclause></clause></subparagraph><subparagraph id="ID481A421462BD46598F78102CE4659C8C">
<enum>(B)</enum>
<header>Guidelines</header>
<text>Not later than 2 years after the date of enactment of this
section, the Institute of Medicine shall submit to the Commission the final
report concerning the results of the study, and making the recommendations,
required under this paragraph.</text>
</subparagraph></paragraph><paragraph id="ID9DF0274BE0764A2C95295DBD600ACB38">
<enum>(3)</enum>
<header>National summit</header>
<subparagraph id="ID0C8740DFBD124FA09E73EBDCAC14CF7E">
<enum>(A)</enum>
<header>In general</header>
<text>Not later than 1 year after the date on which the report under
paragraph (2)(B) is submitted, the Commission shall convene a National Summit
to Implement Food and Physical Activity Advertising and Marketing Guidelines to
Prevent Childhood Obesity (referred to in this section as the
<quote>Summit</quote>).</text>
</subparagraph><subparagraph id="ID98144A80EE044992999DC00D4E63A907">
<enum>(B)</enum>
<header>Collaborative effort</header>
<text>The Summit shall be a collaborative effort and include
representatives from—</text>
<clause id="IDC8307F067EB740E1B5D5D7271BF33380">
<enum>(i)</enum>
<text>education and child development groups;</text>
</clause><clause id="ID4A631E691D724660BE2AA1A7E3C73F7A">
<enum>(ii)</enum>
<text>public health and behavioral science groups;</text>
</clause><clause id="ID9960BBD0E70B48AF9939173BBAE7A6AA">
<enum>(iii)</enum>
<text>child advocacy and health care provider groups; and</text>
</clause><clause id="ID5BD15D3024B842B6AFFD2C41E4664BCF">
<enum>(iv)</enum>
<text>advertising and marketing industry.</text>
</clause></subparagraph><subparagraph id="ID3523C466D215473DB11D8DA30B6333BC">
<enum>(C)</enum>
<header>Activities</header>
<text>The participants in the Summit shall develop a 5-year plan for
implementing the national guidelines recommended by the Institute of Medicine
in the report submitted under paragraph (2)(B).</text>
</subparagraph><subparagraph id="ID93D2AA29F1E74723A5206DA84FA3AEF1">
<enum>(D)</enum>
<header>Evaluation and reports</header>
<text>Not later than 1 year after the date of enactment of this
section, and biannually thereafter, the Commission shall evaluate and submit a
report to Congress on the efforts of the Federal Government to implement the
recommendations made by the Institute of Medicine in the report under paragraph
(2)(B) that shall include a detailed description of the plan of the Secretary
to implement such recommendations.</text>
</subparagraph></paragraph></subsection><subsection id="ID5428C7DF9D674B47B752A5BCA0DA4396">
<enum>(f)</enum>
<header>Authorization of appropriations</header>
<text>There are authorized to be appropriated to carry out this
section, such sums as may be necessary for each of fiscal years 2006 through
2010.</text>
</subsection><subsection id="ID54611C46F67143E182C347A35F283CB8">
<enum>(g)</enum>
<header>Definitions</header>
<text>For purposes of this section, the definitions contained in
section 401 of the Prevention of Childhood Obesity Act shall apply.</text>

<enum>102.</enum>
<header>Federal Trade Commission and marketing to children and
youth</header>
<subsection id="IDDD0EAEB6C3524DF3B3A9DD3303378483">
<enum>(a)</enum>
<header>In general</header>
<text>Notwithstanding section 18 of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (15 U.S.C. 57a),
the Federal Trade Commission is authorized to promulgate regulations and
monitor compliance with the guidelines for advertising and marketing of
nutritional foods and physical activity directed at children and youth, as
recommended by the National Summit to Implement Food and Physical Activity
Advertising and Marketing Guidelines to Prevent Childhood Obesity (as
established under section 399W–1(e)(3) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>).</text>
</subsection><subsection id="ID9F9A866ADB8C477C984663F0DEB4ED30">
<enum>(b)</enum>
<header>Fines</header>
<text>Notwithstanding section 18 of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (15 U.S.C. 57a),
the Federal Trade Commission may assess fines on advertisers or network and
media groups that fail to comply with the guidelines described in subsection
(a).</text>
</subsection></section>
<enum>II</enum>
<header>State children and youth obesity prevention and
control</header>

<enum>201.</enum>
<header>Amendment to the <act-name parsable-cite="PHSA">Public Health
Service Act</act-name>
</header>

241 et seq.) is amended by adding at the end the following:</text>

<text>The Secretary, acting through the Director of the Centers for
Disease Control and Prevention, shall award competitive grants to eligible
entities to support activities that implement the children’s obesity prevention
and control plans contained in the applications submitted under subsection
(b)(2).</text>
</subsection><subsection id="IDAD79BCB2CA9B4A1D9AF3E5ECF0DBF8BC">
<enum>(b)</enum>
<header>Eligibility</header>
<text>To be eligible to receive a grant under this section, an entity
shall—</text>
<paragraph id="IDAAEA0ACE02634F66BB511750697E10B1">
<enum>(1)</enum>
<text>be a State, territory, or an Indian tribe; and</text>
</paragraph><paragraph id="ID8779FB2C678240C68629A2A1AFEC61EF">
<enum>(2)</enum>
<text>submit to the Secretary an application at such time, in such
manner, and containing such agreements, assurances, and information as the
Secretary may require, including a children’s obesity prevention and control
plan that—</text>
<subparagraph id="IDE614E0F634B6442483BFBAEEF57A6C32">
<enum>(A)</enum>
<text>is developed with the advice of stakeholders from the public,
private, and nonprofit sectors that have expertise relating to obesity
prevention and control;</text>
</subparagraph><subparagraph id="IDB230079A151740559E945BBB4839412A">
<enum>(B)</enum>
<text>targets prevention and control of childhood obesity;</text>
</subparagraph><subparagraph id="IDFDA1C6E1C62842EAB8BCCADEA3DD5E32">
<enum>(C)</enum>
<text>describes the obesity-related services and activities to be
undertaken or supported by the applicant; and</text>
</subparagraph><subparagraph id="ID513E92CDFDBD4C29904527038EDE1364">
<enum>(D)</enum>
<text>describes plans or methods to evaluate the services and
activities to be carried out under the grant.</text>
</subparagraph></paragraph></subsection><subsection id="IDA9BE88A466B54DFFB6EB2C61279D6533" indent="down1">
<enum>(c)</enum>
<header>Use of funds</header>
<text>An eligible entity shall use amounts received under a grant
under this section to conduct, in a manner consistent with the children’s
obesity prevention and control plan under subsection (b)(2)—</text>
<paragraph id="IDD3AE428830674CA69F1BBA238F5CFC2D" indent="up1">
<enum>(1)</enum>
<text>an assessment of the prevalence and incidence of obesity in
children;</text>
</paragraph><paragraph id="IDBE4F1B0510374203ADCAF364FF6DD024" indent="up1">
<enum>(2)</enum>
<text>an identification of evidence-based and cost-effective best
practices for preventing childhood obesity;</text>
</paragraph><paragraph id="ID191CB9BE34AB47BD930874A7BA187199" indent="up1">
<enum>(3)</enum>
<text>innovative multi-level behavioral or environmental
interventions to prevent childhood obesity;</text>
</paragraph><paragraph id="IDCB530D77FB3946D690EB62B3ADC76BAA" indent="up1">
<enum>(4)</enum>
<text>demonstration projects for the prevention of obesity in
children and youth through partnerships between private industry organizations,
community-based organizations, academic institutions, schools, hospitals,
health insurers, researchers, health professionals, or other health entities
determined appropriate by the Secretary;</text>
</paragraph><paragraph id="IDE0686788AB944717A51817B92EA6A712" indent="up1">
<enum>(5)</enum>
<text>ongoing coordination of efforts between governmental and
nonprofit entities pursuing obesity prevention and control efforts, including
those entities involved in related areas that may inform or overlap with
childhood obesity prevention and control efforts, such as activities to promote
school nutrition and physical activity; and</text>
</paragraph><paragraph id="ID3252258DB1544F8DA07EF7F269D70C74" indent="up1">
<enum>(6)</enum>
<text>evaluations of State and local policies and programs related to
obesity prevention in children.</text>
</paragraph></subsection><subsection id="IDC97503F8ECC74B399D9E8FFA20EB901B">
<enum>(d)</enum>
<header>Authorization of appropriations</header>
<text>There are authorized to be appropriated to carry out this
section, such sums as may be necessary for each of fiscal years 2006 through
2010.</text>

<enum>399AA–1.</enum>
<header>Comprehensive obesity prevention action grants</header>
<subsection id="ID7C6B59D5F98647849586030658E02406">
<enum>(a)</enum>
<header>In general</header>
<text>The Secretary shall award grants on a competitive basis to
eligible entities to enable such entities to implement activities related to
obesity prevention and control.</text>
</subsection><subsection id="ID64E53E51CA094545837354F66F02CA03">
<enum>(b)</enum>
<header>Eligibility</header>
<text>To be eligible to receive a grant under this section, an entity
shall—</text>
<paragraph id="ID4F558AF2980041759D307ED607A084BB">
<enum>(1)</enum>
<text>be a public or private nonprofit entity; and</text>
</paragraph><paragraph id="IDB9C44E6F6CDE451AAB897446321A77E3">
<enum>(2)</enum>
<text>submit to the Secretary an application at such time, in such
manner, and containing such agreements, assurances, and information as the
Secretary may require, including a description of how funds received under a
grant awarded under this section will be used to—</text>
<subparagraph id="IDF2EA4A814F2E4783B6C9F64348C60B12">
<enum>(A)</enum>
<text>supplement or fulfill unmet needs identified in the children’s
obesity prevention and control plan of a State, Indian tribe, or territory (as
prepared under this part); and</text>
</subparagraph><subparagraph id="ID05BB79DD4B2D451394CAC265BEA7EC96">
<enum>(B)</enum>
<text>otherwise help achieve the goals of obesity prevention as
established by the Secretary or the Commission.</text>
</subparagraph></paragraph></subsection><subsection id="ID4168E6A39B444C2A893A5536EFAFAF30">
<enum>(c)</enum>
<header>Priority</header>
<text>In awarding grants under this section, the Secretary shall give
priority to eligible entities submitting applications proposing to carry out
programs for preventing obesity in children and youth from at-risk populations
or reducing health disparities in underserved populations.</text>
</subsection><subsection id="ID6E1DFCEB02F346469C60FE4E00409D70">
<enum>(d)</enum>
<header>Use of funds</header>
<text>An eligible entity shall use amounts received under a grant
awarded under subsection (a) to implement and evaluate behavioral and
environmental change programs for childhood obesity prevention.</text>
</subsection><subsection id="IDBC4F3799CCEE473AA5907B5EEA1CEE21">
<enum>(e)</enum>
<header>Evaluation</header>
<text>An eligible entity that receives a grant under this section
shall submit to the Secretary an evaluation of the operations and activities
carried out under such grant that includes an analysis of the utilization and
benefit of public health programs relevant to the activities described in
subsection (d).</text>
</subsection><subsection id="ID75CE11CF033E4E69905477B66794AA3B">
<enum>(f)</enum>
<header>Authorization of appropriations</header>
<text>There are authorized to be appropriated to carry out this
section, such sums as may be necessary for each of fiscal years 2006 through
2010.</text>

<enum>399AA–2.</enum>
<header>Discovery to Practice Centers of Excellence within the Health
Promotion and Disease Prevention Research Centers of the Centers for Disease
Control and Prevention</header>
<subsection id="ID76D844D7FAF447629F9903AC21275461">
<enum>(a)</enum>
<header>In general</header>
<text>The Secretary, acting through the Director of the Centers for
Disease Control and Prevention, shall award grants to eligible entities for the
establishment of Centers of Excellence for Discovery to Practice (referred to
in this section as the <quote>Centers</quote>) implemented through the Health
Promotion and Disease Prevention Research Centers of the Centers for Disease
Control and Prevention. Such eligible entities shall use grant funds to
disseminate childhood obesity prevention evidence-based practices to
individuals, families, schools, organizations, and communities.</text>
</subsection><subsection id="ID8C3BBA3530CB47E3A20606A0E66E2CBC">
<enum>(b)</enum>
<header>Eligibility</header>
<text>To be eligible to receive a grant under this section, an entity
shall—</text>
<paragraph id="ID8B0361F09F4746918CC2311340F45552">
<enum>(1)</enum>
<text>be a Health Promotion and Disease Prevention Research Center of
the Centers for Disease Control and Prevention;</text>
</paragraph><paragraph id="IDD4936F890FEE4C689C640C3D52BB49AE">
<enum>(2)</enum>
<text>demonstrate a history of service to and collaboration with
populations with a high incidence of childhood obesity; and</text>
</paragraph><paragraph id="IDA8A33B8B4F2E4277BA5F1A610BDFE60F">
<enum>(3)</enum>
<text>submit to the Secretary an application at such time, in such
manner, and containing such agreements, assurances, and information as the
Secretary may require.</text>
</paragraph></subsection><subsection id="ID95ADCB409FBF4865A38EEE5028818830">
<enum>(c)</enum>
<header>Priority</header>
<text>In awarding grants under this section, the Secretary shall give
priority to applications targeting childhood obesity prevention activities in
underserved populations.</text>
</subsection><subsection id="ID9BE08D46AF194147A09F4E333D4E2142">
<enum>(d)</enum>
<header>Use of funds</header>
<text>An eligible entity shall use amounts received under a grant
under this section to disseminate childhood obesity prevention evidence-based
practices through activities that—</text>

<enum>(1)</enum>
<text>expand the availability of evidence-based nutrition and

shall award grants for the development of obesity prevention behavior change
curricula to be incorporated into early childhood home visitation
programs.</text>

<enum>(b)</enum>
<header>Eligibility</header>
<text>To be eligible to receive a grant under this section, an entity
shall—</text>

<enum>(1)</enum>
<text>be an academic center collaborating with a public or private
nonprofit organization that has the capability of testing behavior change
curricula in service delivery settings and disseminating results to home
visiting programs nationally, except that an organization testing the behavior
change curricula developed under the grant shall implement a model of home
visitation that—</text>

<enum>(A)</enum>
<text>focuses on parental education and care of children who are
prenatal through 5 years of age;</text>

<text>promotes the overall health and well-being of young children;
and</text>
</subparagraph><subparagraph id="ID0E27AFCECB18463BA3272FF7189479D9">
<enum>(C)</enum>
<text>adheres to established quality standards; and</text>
</subparagraph></paragraph><paragraph id="ID17E98A2CF3BE4021B0B5078551DBEE5F">
<enum>(2)</enum>
<text>submit to the Secretary an application at such time, in such
manner, and containing such agreements, assurances, and information as the
Secretary may require.</text>

<header>Priority</header>
<text>In awarding grants under this section, the Secretary shall give
priority to eligible entities submitting applications that propose to develop
and implement programs for preventing childhood obesity and reducing health

<enum>(d)</enum>
<header>Use of funds</header>
<text>An eligible entity shall use amounts received under a grant
under this section to develop, implement, and evaluate the impact of behavior
change curricula for early childhood home visitation programs that—</text>

<text>encourage breast-feeding of infants;</text>

<text>promote age-appropriate portion sizes for a variety of
nutritious foods;</text>
</paragraph><paragraph id="ID5EAFA1A3B1F24832AFBD472F41D7D842">
<enum>(3)</enum>
<text>promote consumption of fruits and vegetables and low-energy
dense foods; and</text>
</paragraph><paragraph id="IDED7CD01F0A2A45C0BCE0F5708CDCF896">
<enum>(4)</enum>
<text>encourage education around parental modeling of physical
activity and reduction in television viewing and other sedentary activities by
toddlers and young children.</text>
</paragraph></subsection><subsection id="ID1BFC664B63A44D47BE6A56EA22701540">
<enum>(e)</enum>
<header>Evaluation</header>
<text>Not later than 3 years after the date on which a grant is
awarded under this section, the grantee shall submit to the Secretary a report
that describes the activities carried out with funds received under the grant
and the effectiveness of such activities in preventing obesity by improving
nutrition and increasing physical activity.</text>

<enum>(f)</enum>
<header>Incorporation into Evidence-Based programs</header>
<text>The Secretary, in consultation with the heads of other Federal
departments and agencies, shall ensure that policies that prevent childhood
obesity are incorporated into evidence-based early childhood home visitation
programs in a manner that provides for measurable outcomes.</text>

<text>The Secretary shall award grants to local educational agencies
to enable elementary and secondary schools to promote good nutrition and
physical activity among children.</text>

<header>Carol m. white physical education program</header>
<text>The Secretary of Education, in collaboration with the
Secretary, may give priority in awarding grants under the Carol M. White
Physical Education Program under subpart 10 of part D of title V of the
<act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
1965</act-name> to local educational agencies and other eligible entities that
have a plan to—</text>
<subparagraph id="ID82951AD637F1481F8DF6694A2C22BA47">
<enum>(A)</enum>
<text>implement behavior change curricula that promotes the concepts
of energy balance, good nutrition, and physical activity;</text>
</subparagraph><subparagraph id="ID32198197B97145189748B193020B16C2">
<enum>(B)</enum>
<text>implement policies that encourage the appropriate portion sizes
and limit access to soft drinks or other foods of poor or minimal nutritional
value on school campuses, and at school events;</text>
</subparagraph><subparagraph id="ID63788051C88A40D3BCCCB11EA1054280">
<enum>(C)</enum>
<text>provide age-appropriate daily physical activity that helps
students to adopt, maintain, and enjoy a physically active lifestyle;</text>
</subparagraph><subparagraph id="ID2BF2BE63C962492290A1BE5EF67D6FED">
<enum>(D)</enum>
<text>maintain a minimum number of functioning water fountains (based
on the number of individuals) in school buildings;</text>
</subparagraph><subparagraph id="ID0DD06B0A51104536B49320531A4B0435">
<enum>(E)</enum>
<text>prohibit advertisements and marketing in schools and on school
grounds for foods of poor or minimal nutritional value such as fast foods, soft
drinks, and candy; and</text>
</subparagraph><subparagraph id="ID9A3698BDC0504D0EAE50C3DF9875BEAF">
<enum>(F)</enum>
<text>develop and implement policies to conduct an annual assessment
of each student’s body mass index and provide such assessment to the student
and the parents of that student with appropriate referral mechanisms to address
concerns with respect to the results of such assessments.</text>
</subparagraph></paragraph><paragraph id="ID0A073906C03747039F1C5BAAD85FD314">
<enum>(3)</enum>
<header>Grants for additional activities</header>
<text>The Director of the Centers for Disease Control and Prevention,
in collaboration with the Secretary, the Secretary of Agriculture, and the
Secretary of Education, shall award grants for the implementation and
evaluation of activities that—</text>
<subparagraph id="ID830481E507854328B3CB803223F8FB29">
<enum>(A)</enum>
<text>educate students about the health benefits of good nutrition
and moderate or vigorous physical activity by integrating it into other subject
areas and curriculum;</text>
</subparagraph><subparagraph id="ID2D454B3DF4154528808E5BB0DF796C77">
<enum>(B)</enum>
<text>provide food options that are low in fat, calories, and added
sugars such as fruit, vegetables, whole grains, and dairy products;</text>
</subparagraph><subparagraph id="IDB84C373975B14BCFBF9E360261FC4440">
<enum>(C)</enum>
<text>develop and implement guidelines for healthful snacks and foods
for sale in vending machines, school stores, and other venues within the
school’s control;</text>
</subparagraph><subparagraph id="IDD7302A5FD81946F3A8573617539C3240">
<enum>(D)</enum>
<text>restrict student access to vending machines, school stores, and
other venues that contain foods of poor or minimal nutritional value;</text>
</subparagraph><subparagraph id="ID48A2D9D2764C4E1E9DAA60B951E524A0">
<enum>(E)</enum>
<text>encourage adherence to single-portion sizes, as defined by the
Food and Drug Administration, in foods offered in the school
environment;</text>
</subparagraph><subparagraph id="ID040165845BF842CA90B33AC2D1FA13AD">
<enum>(F)</enum>
<text>provide daily physical education for students in
prekindergarten through grade 12 through programs that are consistent with the
Guidelines for Physical Activity as reported by Centers for Disease Control and
Prevention and the American College of Sports Medicine and National Physical
Education Standards;</text>
</subparagraph><subparagraph id="ID932EA2339A1A454A9F16287DD2C7BF08">
<enum>(G)</enum>
<text>encourage the use of school facilities for physical activity
programs offered by the school or community-based organizations outside of
school hours;</text>
</subparagraph><subparagraph id="IDF748907350CD48C2ACD31D5BEEB31D09">
<enum>(H)</enum>
<text>promote walking or bicycling to and from school using such
programs as Walking School Bus and Bike Train;</text>
</subparagraph><subparagraph id="IDFBA25DCB25F44F3C97CEE1A128A91382">
<enum>(I)</enum>
<text>train school personnel in a manner that provides such personnel
with the knowledge and skills needed to effectively teach lifelong healthy
eating and physical activity; and</text>
</subparagraph><subparagraph id="ID21A5172374A44838B50EE6892A249ABC">
<enum>(J)</enum>
<text>evaluate the impact of school nutrition and physical education
programs and facilities on body mass index and related fitness criteria at
annual intervals to determine the extent to which national guidelines are
met.</text>

<header>Preventing childhood obesity in communities</header>
<subsection id="ID6AD66E0D1A9D4F23B0BC38482C23F990">
<enum>(a)</enum>
<header>In general</header>
<text>The Director of the Centers for Disease Control and Prevention,
in collaboration with the Secretary, the Secretary of Transportation, and
Secretary of the Interior, shall award grants and implement activities to
encourage healthy nutrition and physical activity by children in
communities.</text>
</subsection><subsection id="ID13348944942842EE8288294985BF3A25">
<enum>(b)</enum>
<header>Eligibility</header>
<text>To be eligible to receive a grant under this section, an entity
shall—</text>
<paragraph id="ID5BD188BCC60A4B9C806B29E848E102D0">
<enum>(1)</enum>
<text>be a public or private nonprofit organization or
community-based organizations that conduct initiatives that—</text>
<subparagraph id="ID394A8ECC117947138E8F8E119EAF52A3">
<enum>(A)</enum>
<text>focus on parental education and care of children;</text>
</subparagraph><subparagraph id="ID4F6D24B7691546C4950D539449E28476">
<enum>(B)</enum>
<text>promote the overall health and well-being of children;</text>
</subparagraph><subparagraph id="ID33ED4849E39B44CB8F5F34BBDC7F31BD">
<enum>(C)</enum>
<text>adhere to established quality standards; and</text>
</subparagraph><subparagraph id="IDE1B292352D2C49C8BA3458E56EA56B65">
<enum>(D)</enum>
<text>have the capability to provide training on a nationwide basis;
and</text>
</subparagraph></paragraph><paragraph id="ID17F2078E7156416EBF62B6DAD22026E3">
<enum>(2)</enum>
<text>submit to the Secretary an application at such time, in such
manner, and containing such agreements, assurances, and information as the
Secretary may require.</text>
</paragraph></subsection><subsection id="ID49AFB67A9C1B48B9A1D1891C7411F57D">
<enum>(c)</enum>
<header>Communities</header>
<paragraph id="ID62FA0FF93E464EDABB90043245D7A47B">
<enum>(1)</enum>
<header>In general</header>
<text>The Director of the Centers for Disease Control and Prevention,
in collaboration with the Secretary, the Secretary of Transportation, and
Secretary of the Interior, shall award grants to eligible entities to develop
broad partnerships between private and public and nonprofit entities to promote
healthy nutrition and physical activity for children by assessing, modifying,
and improving community planning and design.</text>
</paragraph><paragraph id="IDF2C4A10B83A74BA4B5932DC70E0DD9D2">
<enum>(2)</enum>
<header>Activities</header>
<text>Amounts awarded under a grant under paragraph (1) shall be used
for the implementation and evaluation of activities—</text>
<subparagraph id="ID8CD4EB1A07F24616A2ADA944944D4253">
<enum>(A)</enum>
<text>to create neighborhoods that encourage healthy nutrition and
physical activity;</text>
</subparagraph><subparagraph id="IDB1A61308B70144FFBF8FD39D444DD914">
<enum>(B)</enum>
<text>to promote safe walking and biking routes to schools;</text>
</subparagraph><subparagraph id="ID18E022C8AE6248E0B2169E7A30D7EDC7">
<enum>(C)</enum>
<text>to design pedestrian zones and construct safe walkways, cycling
paths, and playgrounds;</text>
</subparagraph><subparagraph id="IDE4F6F80BAB144BB68496B3071D16366E">
<enum>(D)</enum>
<text>to implement campaigns, in communities at risk for sedentary
activity, designed to increase levels of physical activity, which should be
evidence-based, and may incorporate informational, behavioral, and social, or
environmental and policy change interventions;</text>
</subparagraph><subparagraph id="ID59708C3F5E90485EA7617052F32BC2C1">
<enum>(E)</enum>
<text>to implement campaigns, in communities at risk for poor
nutrition, that are designed to promote intake of foods by children consistent
with established dietary guidelines through the use of different types of media
including television, radio, newspapers, movie theaters, billboards, and
mailings; and</text>
</subparagraph><subparagraph id="ID1ABB880F7F21473D9421309C9348E087">
<enum>(F)</enum>
<text>to implement campaigns, in communities at risk for poor
nutrition, that promote water as the main daily drink of choice for children
through the use of different types of media including television, radio,
newspapers, movie theaters, billboards, and mailings.</text>
</subparagraph></paragraph></subsection><subsection id="ID9B4EA7538AC142FEA556271DE50B3E1A">
<enum>(d)</enum>
<header>Evaluation</header>
<text>Not later than 3 years after the date on which a grant is
awarded under this section, the grantee shall submit to the Director of the
Centers for Disease Control and Prevention a report that describes the
activities carried out with funds received under the grant and the
effectiveness of such activities in increasing physical activity and improving
dietary intake.</text>
</subsection><subsection id="ID122A34E478D54DD2B819515842BAD4B4">
<enum>(e)</enum>
<header>Authorization of appropriations</header>
<text>There is authorized to be appropriated to carry out this
section, $50,000,000 for each of fiscal years 2006 through 2010.</text>

<enum>342.</enum>
<header>Grants and contracts for a national campaign to change
children’s health behaviors</header>
<text display-inline="no-display-inline">Section 399Y of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
280h–2) is amended by striking subsection (b) and inserting the
following:</text>

<text>The Secretary, acting through the Director of the Centers for
Disease Control and Prevention, shall award grants or contracts to eligible
entities to design and implement culturally and linguistically appropriate and
competent campaigns to change children’s health behaviors.</text>
</paragraph><paragraph id="ID63037B0D060B41E392BEE80303A1AEB5">
<enum>(2)</enum>
<header>Eligible entity</header>
<text>In this subsection, the term <term>eligible entity</term> means
a marketing, public relations, advertising, or other appropriate entity.</text>
</paragraph><paragraph id="ID55BFD10EF46A44A28BF1100FF1EC5D60">
<enum>(3)</enum>
<header>Content</header>
<text>An eligible entity that receives a grant under this subsection
shall use funds received through such grant or contract to utilize marketing
and communication strategies to—</text>
<subparagraph id="ID082EDDD571164A4DB911D3A8D5646CCF">
<enum>(A)</enum>
<text>communicate messages to help young people develop habits that
will foster good health over a lifetime;</text>
</subparagraph><subparagraph id="ID15212665E2824440B49B814564F527B0">
<enum>(B)</enum>
<text>provide young people with motivation to engage in sports and
other physical activities;</text>
</subparagraph><subparagraph id="ID683D46B7034849B1AD67D2E6DC5418DE">
<enum>(C)</enum>
<text>influence youth to develop good health habits such as regular
physical activity and good nutrition;</text>
</subparagraph><subparagraph id="ID9884C3059DC641519CBBB2152DACD89F">
<enum>(D)</enum>
<text>educate parents of young people on the importance of physical
activity and improving nutrition, how to maintain healthy behaviors for the
entire family, and how to encourage children to develop good nutrition and
physical activity habits; and</text>
</subparagraph><subparagraph id="ID63A3FA0AFE2F43E08FCC6FF4C3580F3D">
<enum>(E)</enum>
<text>discourage stigmatization and discrimination based on body size
or shape.</text>
</subparagraph></paragraph><paragraph id="ID055316B7F2544BBDBA5A1C59D3DAEE0E">
<enum>(4)</enum>
<header>Report</header>
<text>The Secretary shall evaluate the effectiveness of the campaign
described in paragraph (1) in changing children’s behaviors and report such
results to the Committee on Health, Education, Labor, and Pensions of the
Senate and the Committee on Energy and Commerce of the House of
Representatives.</text>
</paragraph></subsection><subsection id="ID794CC568272348BAA77C7966C3DE13D7">
<enum>(c)</enum>
<header>Authorization of appropriations</header>
<text>There is authorized to be appropriated to carry out this
section, $125,000,000 for fiscal year 2006, and such sums as may be necessary
for each of fiscal years 2007 through 2011.</text>

<enum>343.</enum>
<header>Prevention of childhood obesity research through the national
institutes of health</header>
<subsection id="IDE5BA15D25B5D4B4694D3C4EEFFD32F12">
<enum>(a)</enum>
<header>In general</header>
<text>The Director of the National Institutes of Health, in accordance
with the National Institutes of Health’s Strategic Plan for Obesity Research,
shall expand and intensify research that addresses the prevention of childhood
obesity.</text>
</subsection><subsection id="ID3AE04F3B90B24BE5824AF41B5423AC37">
<enum>(b)</enum>
<header>Plan</header>
<text>The Director of the National Institutes of Health shall—</text>
<paragraph id="ID9B15673BC7DC4B35B4F2D0D79F9708D3">
<enum>(1)</enum>
<text>conduct or support research programs and research training
concerning the prevention of obesity in children; and</text>
</paragraph><paragraph id="ID2A0F6C87766149C0A59891449B01A057">
<enum>(2)</enum>
<text>develop and periodically review, and revise as appropriate, the
Strategic Plan for Obesity Research.</text>
</paragraph></subsection><subsection id="ID32A7C26FFC0A463E8C637B90CA855441">
<enum>(c)</enum>
<header>Authorization of appropriations</header>
<text>There is authorized to be appropriated to carry out this section,
such sums as may be necessary for each of fiscal years 2006 through 2011.
Amounts appropriated under this section shall be in addition to other amounts
available for carrying out activities of the type described in this
section.</text>

<enum>344.</enum>
<header>Research on the relationship between the physical activity of
children and the built environment</header>

Public Health Service Act (as amended by section 341) is further amended by

research efforts to promote physical activity in children through enhancement
of the built environment.</text>

<enum>(b)</enum>
<header>Eligibility</header>
<text>In this section, the term <term>eligible institution</term>
means a public or private nonprofit institution that submits to the Secretary
an application at such time, in such manner, and containing such agreements,
assurances, and information as the Secretary may require.</text>

<enum>(c)</enum>
<header>Grant programs</header>
<paragraph id="id509ECA92C8D04FCC90CF5798D245752B">
<enum>(1)</enum>
<header>Research</header>
<text>The Secretary, in collaboration with the Transportation
Research Board of the National Research Council, shall award grants to eligible
institutions to expand, intensify, and coordinate research that will—</text>
<subparagraph id="IDcf639630531e457090150e728e96698b">
<enum>(A)</enum>
<text>investigate and define causal links between the built
environment and levels of physical activity in children;</text>
</subparagraph><subparagraph id="ID094cf6d495bf431885e85c253689c35f">
<enum>(B)</enum>
<text>include focus on a variety of geographic scales, with
particular focus given to smaller geographic units of analysis such as
neighborhoods and areas around elementary schools and secondary schools;</text>
</subparagraph><subparagraph id="IDafeb8323f6d2488a9e89d9d105924265">
<enum>(C)</enum>
<text>identify or develop effective intervention strategies to
promote physical activity among children with focus on behavioral interventions
and enhancements of the built environment that promote increased use by
children; and</text>
</subparagraph><subparagraph id="ID33f1f1c2cb634b5fbd872352a689c1da">
<enum>(D)</enum>
<text>assure the generalizability of intervention strategies to
high-risk populations and high-risk communities, including low-income urban and
rural communities.</text>
</subparagraph></paragraph><paragraph id="ID7fea7fc08b6d4a23bef4701aec811a7a">
<enum>(2)</enum>
<header>Intervention pilot programs</header>
<text>The Secretary, in collaboration with the Transportation
Research Board of the National Research Council and with appropriate Federal
agencies, shall award grants to pilot test the intervention strategies
identified or developed through research activities described in paragraph (1)
relating to increasing use of the built environment by children.</text>

<enum>(d)</enum>
