			 title</header><text display-inline="no-display-inline">This title may be cited

			 as the <quote>Flexible Voucher Act of 2005</quote>.</text>

			</section><section id="ID6609b73264c547a2b5f7eddb40a7bcd4"><enum>102.</enum><header>Findings and

			 purposes</header>

				<subsection id="ID3023de4638374085a51abfa047305e79"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

					<paragraph id="ID20d54e25a1d94c11896d70d8f593aee4"><enum>(1)</enum><text>the section 8

			 housing choice voucher program provides rental and homeownership assistance to

			 approximately 2,000,000 families;</text>

					</paragraph><paragraph id="IDe379cb17877541d6829fcb0d0339326c"><enum>(2)</enum><text>the Secretary

			 administers the housing choice voucher program through rules and regulations

			 that apply directly to more than 2,400 entities throughout the United

			 States;</text>

					</paragraph><paragraph id="ID86739cce5b1a46ef820b786616c60ca6"><enum>(3)</enum><text>such an

			 administrative structure has contributed to the development of statutory and

			 regulatory measures that have made the housing choice voucher program overly

			 prescriptive and difficult for public housing agencies and the Secretary to

			 administer;</text>

					</paragraph><paragraph id="IDede5d36f9e83478bb92e77d4d5032202"><enum>(4)</enum><text>the complexity of

			 the housing choice voucher program, its inability to allow adequate timely

			 adjustments to changing local markets, and its multiplicity of Federal

			 directives, all have contributed to fewer families being provided the housing

			 assistance made available by Congress;</text>

					</paragraph><paragraph id="ID3507830c0e0e402ba380b5df82b89618"><enum>(5)</enum><text>many families in

			 need of assistance under the housing choice voucher program wait several years

			 to receive assistance under the program;</text>

					</paragraph><paragraph id="ID5df997019a8b4f069a15c05640599e37"><enum>(6)</enum><text>the benefits that

			 assisted households derive from housing vouchers, including access to safer and

			 healthier environments and increased economic opportunity, derive in

			 substantial part from the choices of housing and location that vouchers

			 offer;</text>

					</paragraph><paragraph id="IDecd646fb562b4939a9465344ed7b3f33"><enum>(7)</enum><text>the combination

			 of increased administrative flexibility and procedures to measure and reward

			 local programs for better performance can substantially increase the benefit of

			 housing vouchers to low-income households; and</text>

					</paragraph><paragraph id="ID46e20570980f4f319ca1a30fdee9e461"><enum>(8)</enum><text>local public

			 housing agencies are in the best position to determine local housing needs and

			 market conditions necessary to effectively manage housing voucher

			 funding.</text>

					</paragraph></subsection><subsection id="IDa3b5029535934fa495c86e50a2a81cf6"><enum>(b)</enum><header>Purposes</header><text>The

			 purposes of this title are to—</text>

					<paragraph id="id53E38EF322AB4FCBAB35E6FE3B6E8CFA"><enum>(1)</enum><text>provide housing

			 assistance through a flexible voucher program;</text>

					</paragraph><paragraph id="ID2140039739494b74a204afa62334d230"><enum>(2)</enum><text>replace the

			 housing choice voucher program established under section 8 of the United States

			 Housing Act of 1937 (42 U.S.C. 1437f);</text>

					</paragraph><paragraph id="IDce298635e1964fe38990393ba7349642"><enum>(3)</enum><text>provide for the

			 necessary program flexibility and oversight so that funds are used promptly and

			 effectively to assist needy families;</text>

					</paragraph><paragraph id="ID163566cb5a9f4353b240331a150ba4de"><enum>(4)</enum><text>provide for

			 additional program flexibility to address local markets and needs;</text>

					</paragraph><paragraph id="ID9522fb0d34494fc8a0045db666fa7846"><enum>(5)</enum><text>provide for

			 administrative decision making closer to the communities and families affected,

			 by local officials who administer the program; and</text>

					</paragraph><paragraph id="IDd66e23227bca4b8980bfc46efb493bfa"><enum>(6)</enum><text>provide

			 incentives for improved self-sufficiency efforts by assisted families.</text>

					</paragraph></subsection></section><section id="IDae7d6f0aa362422aa58192bd60fd0d5f"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this title, the

			 following definitions shall apply:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idCE31628483534DB49AC57CFB634AEEF0"><enum>(1)</enum><header>Administrative

			 fee</header><text display-inline="yes-display-inline">The term

			 <term>administrative fee</term> means a fee paid by the Secretary to a public

			 housing agency for the routine administration, as determined by the Secretary,

			 of administering assistance under this title.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBF738AF84F2B4328B7C4E548934BFA98"><enum>(2)</enum><header>Disabled

			 family</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in law, the term <term>disabled family</term> means a family whose

			 head, spouse, or sole member is a person with disabilities, including 2 or more

			 persons who are persons with disabilities living together.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BE6F55B63A54D21AD3BF77E495716D2"><enum>(3)</enum><header>Downpayment

			 assistance</header><text>The term <term>downpayment assistance</term> means

			 assistance for a family to be used toward the purchase of a home, including

			 reasonable and customary closing costs required in connection with the purchase

			 of a home.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E4A8362C1F0400F80EF964802919161"><enum>(4)</enum><header>Elderly

			 family</header><text display-inline="yes-display-inline">Except as otherwise

			 provided, the term <term>elderly family</term> means a family whose head,

			 spouse, or sole member is a person who is at least 62 years of age, including 2

			 or more persons who are at least 62 years of age living together.</text>

				</paragraph><paragraph id="ID5c53aa86fd71443ba906c683a39d3d80"><enum>(5)</enum><header>Eligibility

			 event</header><text>The term <term>eligibility event</term> means, with respect

			 to a housing project—</text>

					<subparagraph id="id6E9AFF315AB5463BA74C91E7EE7698E2"><enum>(A)</enum><text>the prepayment of

			 the mortgage on such housing project;</text>

					</subparagraph><subparagraph id="id9665D3162C1341CCAB0618A5EF1900F7"><enum>(B)</enum><text>the voluntary

			 termination of the insurance contract for the mortgage for such housing

			 project;</text>

					</subparagraph><subparagraph id="idA99942E113904254806C635897588D00"><enum>(C)</enum><text>the termination

			 or expiration of the contract for rental assistance under section 8 of the

			 United States Housing Act of 1937 (42 U.S.C. 1437f) for such housing project;

			 or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB20A85950AE84A4CA872270F6DD7EFE5"><enum>(D)</enum><text>the transaction

			 under which the housing project is preserved as affordable housing, under

			 paragraphs (3) and (4) of section 515(c) and section 524(d) of the Multifamily

			 Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C. 1437f note),

			 section 223(f) of the Low-Income Housing Preservation and Resident

			 Homeownership Act of 1990 (12 U.S.C. 4113(f)), or section 201(p) of the Housing

			 and Community Development Amendments of 1978 (12 U.S.C. 1715z–1a(p)).</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF29DB61A249B4E67AE85D114F3C229A3"><enum>(6)</enum><header>Family</header><text display-inline="yes-display-inline">The term <term>family</term> means a person

			 or group of persons, as determined by the public housing agency, approved to

			 reside in a unit receiving assistance under this title.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC678A9FC5E7A4C01BDC47144612ED038"><enum>(7)</enum><header>First-time

			 homebuyer</header><text display-inline="yes-display-inline">The term

			 <term>first-time homebuyer</term> means a family, no member of which has had an

			 ownership interest in a principal residence during the 3 years preceding the

			 date on which the family initially receives tenant-based homeownership

			 assistance under this title.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14B970BF7BA846EA8841CAD70CBDE8A3"><enum>(8)</enum><header>Gross

			 income</header><text display-inline="yes-display-inline">The term <term>gross

			 income</term> is the amount of income from all sources for each family member

			 of a household, without deductions or exclusions, notwithstanding any other

			 provision of law.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ADCBA91C12F435A85FD13A1DE6EEC37"><enum>(9)</enum><header>Housing

			 project</header><text display-inline="yes-display-inline">The term

			 <term>housing project</term> means a multifamily housing development receiving

			 project-based rental assistance under section 107(b).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9A5C09A49174BCD871AE502D4726378"><enum>(10)</enum><header>Median income

			 for the area</header><text display-inline="yes-display-inline">The term

			 <term>median income for the area</term> means the family income at the fiftieth

			 percentile of income for an area, as determined by the Secretary, with

			 adjustments for smaller and larger families.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA65F765241A74BA792FB4DD34256A87F"><enum>(11)</enum><header>Owner</header><text display-inline="yes-display-inline">The term <term>owner</term> means any

			 private person or entity, including a cooperative, an agency of the Federal

			 Government, or a public housing agency, having the legal right to lease or

			 sublease dwelling units.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF12224420ECF4CACA166DF2AB1BA0BB2"><enum>(12)</enum><header>Person with

			 disabilities</header><text display-inline="yes-display-inline">The term

			 <quote>person with disabilities</quote> has the same meaning given the term in

			 section 3(b) of the United States Housing Act of 1937 (42 U.S.C.

			 1437a(3)(b)).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80D14D05106747F7BCE37612A3C54C49"><enum>(13)</enum><header>Project-based

			 rental assistance</header><text display-inline="yes-display-inline">The term

			 <term>project-based rental assistance</term> means housing assistance that a

			 public housing agency may attach to a specific property under section

			 107.</text>

				</paragraph><paragraph id="ID44759290a0714f16b3f4e12c47ee0fbd"><enum>(14)</enum><header>Public housing

			 agency</header><text>The term <term>public housing agency</term> or

			 <term>PHA</term> means—</text>

					<subparagraph id="ID436f5313bad44933aa75778281b0fa5a"><enum>(A)</enum><text>any State,

			 county, municipality, or other governmental entity or public body (or agency or

			 instrumentality thereof) which is authorized to engage in or assist in the

			 development or operation of low-income housing; or</text>

					</subparagraph><subparagraph id="ID9a12cd63de21489c929c8ab71dd83563"><enum>(B)</enum><text>any other entity

			 designated by the Secretary to administer assistance under this title in

			 jurisdictions where—</text>

						<clause id="id1E40C1F617FF4C99BF0BEB56349786CC"><enum>(i)</enum><text>no

			 public housing agency has been organized; or</text>

						</clause><clause id="idD9D305DD42D649C2988EDA78732D1D17"><enum>(ii)</enum><text>the Secretary

			 determines that a public housing agency is not capable of effectively

			 administering assistance under this title.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59A2C23ED8B64A7CA63DB0FDB9A2723C"><enum>(15)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of Housing and Urban Development.</text>

				</paragraph><paragraph id="ID5278289539ce4459a12e7175660d7bdf"><enum>(16)</enum><header>Special

			 administrative fee</header><text>The term <term>special administrative

			 fee</term> means a fee paid by the Secretary to a public housing agency for

			 non-routine administrative expenses, as determined by the Secretary, which may

			 include expenses associated with—</text>

					<subparagraph id="id72CA349B2C6B41B289312CBE495C6F12"><enum>(A)</enum><text>tenant-based

			 homeownership assistance;</text>

					</subparagraph><subparagraph id="idC41A4AF3E9F749A3BFEC79B7EB77AD70"><enum>(B)</enum><text>family

			 self-sufficiency coordinators; and</text>

					</subparagraph><subparagraph id="id3A63C37D16AE4CB29FFD07DC11098707"><enum>(C)</enum><text>lead-based paint

			 risk assessments.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF1758AA8DBE4784BF8F207D1EB0DF91"><enum>(17)</enum><header>Tenant-based

			 homeownership assistance</header><text display-inline="yes-display-inline">The

			 term <term>tenant-based homeownership assistance</term> means the payments made

			 on a monthly basis by public housing agencies under section 108(c) and are used

			 by families to make mortgage payments or meet other monthly homeownership

			 expenses.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFF001D1B73D8431B8B69F6CEBEFA1CCB"><enum>(18)</enum><header>Transfer-eligible

			 family</header><text display-inline="yes-display-inline">The term

			 <term>transfer-eligible family</term> means a family that has received rental

			 assistance under this title for at least 12 months and is in compliance with

			 applicable requirements imposed in accordance with this title and section 8 of

			 the United States Housing Act of 1937 (42 U.S.C. 1437f).</text>

				</paragraph><paragraph id="ID72683da5c7424522bdec3fe15058e7c6"><enum>(19)</enum><header>Tenant-based

			 rental assistance</header><text>The term <term>tenant-based rental

			 assistance</term> means housing assistance that provides for the eligible

			 family to select suitable housing within the jurisdiction of an administering

			 public housing agency.</text>

				</paragraph></section><section id="ID1d283f95ff36487188dac2d8d382e8ab"><enum>104.</enum><header>Authority of

			 Secretary</header>

				<subsection id="IDe302a0f773cd4d02a08047f6bd4dade9"><enum>(a)</enum><header>Grant

			 authority</header><text>The Secretary is authorized to make grants to—</text>

					<paragraph id="idB85A9126A1D74BDBA674166677B2CDCF"><enum>(1)</enum><text>public housing

			 agencies to provide tenant-based and project-based rental assistance, and

			 tenant-based homeownership assistance to low income individuals; and</text>

					</paragraph><paragraph id="id29F92146C0CB4D8D8B7D1E6815969EB5"><enum>(2)</enum><text>carry out

			 activities related to the assistance described in paragraph (1) in accordance

			 with this title.</text>

					</paragraph></subsection><subsection id="ID986b207850904a87ada5e43207c8a1a4"><enum>(b)</enum><header>Contract

			 authority</header>

					<paragraph id="id76F505EE491844CDBA15785CC3FF6F8E"><enum>(1)</enum><header>In

			 general</header><text>The Secretary is authorized to enter into contracts with

			 public housing agencies to administer grants authorized under subsection

			 (a).</text>

					</paragraph><paragraph id="idC970B0FD50684E9798D6DA1C4C0FEA86"><enum>(2)</enum><header>Payments to

			 owners</header><text>Pursuant to the contracts entered into under subsection

			 (a), public housing agencies may enter into contracts to make assistance

			 payments to owners, and such contracts shall include any terms and conditions

			 required by the Secretary.</text>

					</paragraph></subsection><subsection id="IDb7f4616601344578965a59dd447d97cf"><enum>(c)</enum><header>Tenant-Based

			 assistance to continue</header><text>Any family that is receiving tenant-based

			 homeownership assistance under section 8(y) of the United States Housing Act of

			 1937 (42 U.S.C. 1437f(y)) shall continue to receive such assistance, subject to

			 the terms and conditions of the United States Housing Act of 1937, as that Act

			 was in effect on the day before the date of enactment of this Act, from amounts

			 made available for assistance under this title.</text>

				</subsection><subsection id="ID0a24cea448174c208d57d6ab0bed2e92"><enum>(d)</enum><header>Housing

			 assistance under project-Based voucher program to continue</header><text>Any

			 units covered by a housing assistance payments contract on the day before the

			 date of enactment of this Act under the project-based voucher program or

			 project-based certificate program under section 8 of the United States Housing

			 Act of 1937 (42 U.S.C. 1437f) shall continue to receive assistance subject to

			 the terms and conditions of that contract, from amounts made available for

			 assistance under this title.</text>

				</subsection></section><section id="ID7fae2a10c93b4f09a43eb1ba20474547"><enum>105.</enum><header>Elderly

			 families and disabled families</header>

				<subsection id="ID0882451f91e7435ebe4a64a24920a1fb"><enum>(a)</enum><header>Existing

			 tenants</header><text>Notwithstanding any other provision of this title,

			 elderly families and disabled families, as such terms were defined under

			 section 3(b)(3)(B) the United States Housing Act of 1937 (42 U.S.C.

			 1437a(b)(3)(B)) immediately prior to the date of enactment of this title, who

			 were receiving assistance under section 8 (o) or (t) of the United States

			 Housing Act of 1937 (42 U.S.C. 1437f(o), (t)) as in effect on the day prior to

			 the date of enactment of this title, shall be treated in accordance with the

			 immediately above-referenced sections until January 1, 2009.</text>

				</subsection><subsection id="ID2a167f8ded6944b9a7334cb57a75a19f"><enum>(b)</enum><header>New

			 admissions</header><text>Notwithstanding any other provision of this title,

			 except as provided in subsection (d), elderly families and disabled families

			 not meeting the requirements of subsection (a), shall also be treated in

			 accordance with section 8 (o) or (t) of the United States Housing Act of 1937

			 (42 U.S.C. 1437f(o), (t)) as in effect on the day prior to the date of

			 enactment of this title, until January 1, 2009.</text>

				</subsection><subsection id="ID43578379bd7c4cc1a655d1c7fa223abf"><enum>(c)</enum><header>Public housing

			 agency policies</header><text>Notwithstanding any other provision of this

			 title, a public housing agency receiving a grant under section 104 shall, by

			 January 1, 2009, have implemented a policy to ensure that the needs of elderly

			 families and disabled families described under subsections (a) and (b) are

			 addressed by a policy to be determined by the public housing agency as they

			 relate to, among other things, eligibility and rent.</text>

				</subsection><subsection id="ID1bd0a297081142e1bbe56c0728c52791"><enum>(d)</enum><header>Early

			 implementation</header><text>A public housing agency that has implemented the

			 policy described in subsection (c) before January 1, 2009, shall administer

			 assistance for elderly families and disabled families first receiving a grant

			 under section 104 after the effective date of such policy in accordance with

			 such policy.</text>

				</subsection></section><section id="ID6443d54421e34a199316990efe375fea"><enum>106.</enum><header>Performance

			 Standards</header>

				<subsection id="idC79A65AE632F4CF5B93583FD1DAE68F3"><enum>(a)</enum><header>Performance

			 standards and evaluation</header><text display-inline="yes-display-inline">The

			 Secretary shall establish performance standards and a performance assessment

			 system for public housing agencies receiving grants under this title to

			 maximize the benefits of such assistance.</text>

				</subsection><subsection id="ID35dadf75a7c14e5688f3e8929318012c"><enum>(b)</enum><header>General

			 reports</header><text>In developing a performance assessment system or in

			 evaluating the performance of a public housing agency, the Secretary may

			 require the public housing agency to provide and report information

			 including—</text>

					<paragraph id="ID4a531f0d2db147f38da4043c5c37f15e"><enum>(1)</enum><text>the number of

			 households and persons in such households receiving assistance under this

			 title, including—</text>

						<subparagraph id="id1C6CDB6BB43A409C8056F3992076CCC0"><enum>(A)</enum><text>the number of

			 families with children;</text>

						</subparagraph><subparagraph id="id934D70247BE64FBFBCB4B583C14222A6"><enum>(B)</enum><text>the number of

			 elderly families;</text>

						</subparagraph><subparagraph id="id6F629930FF8141C099FC07F7C74D504C"><enum>(C)</enum><text>the number of

			 disabled families; and</text>

						</subparagraph><subparagraph id="idFCFD0DDFBBDA48DDBF6EBAFFC40F07B3"><enum>(D)</enum><text>for each family,

			 general demographic information and income levels;</text>

						</subparagraph></paragraph><paragraph id="ID96d3d38067884145a766064062e283ca"><enum>(2)</enum><text>the actual

			 subsidy per family and value of assistance under this title received per

			 family;</text>

					</paragraph><paragraph id="ID63ddd19477e142fabb12192c561d214e"><enum>(3)</enum><text>administrative

			 costs incurred by a public housing agency in fulfilling its responsibilities

			 under this title; and</text>

					</paragraph><paragraph id="IDb896e4ab727d4f348c234d0ef219edb6"><enum>(4)</enum><text>other information

			 as the Secretary may prescribe.</text>

					</paragraph></subsection><subsection id="ID29589ef19b6a4a5582058609399263af"><enum>(c)</enum><header>Public housing

			 agency reports</header><text>Not less frequently than once every 12 months, the

			 Secretary shall require each public housing agency to provide to the public on

			 the Internet the reports required under subsection (a) in a form and manner

			 acceptable to the Secretary.</text>

				</subsection><subsection id="ID5e75fb99734b45238694d9cb0fa54d15"><enum>(d)</enum><header>Alternative

			 administration</header>

					<paragraph id="ID68134758e77942bba4eb4a211e38078e"><enum>(1)</enum><header>Troubled

			 programs</header><text>A public housing agency operating a program under

			 section 8 of the United States Housing Act of 1937 (42 U.S.C. 1437f) that the

			 Secretary has designated as troubled under a performance evaluation system for

			 the housing choice voucher program, or a public housing program that the

			 Secretary has found to be troubled under section 6(j) of the United States

			 Housing Act of 1937 (42 U.S.C. 1436d(j)) for the first full fiscal year after

			 the date of enactment of this title—</text>

						<subparagraph id="IDc1d409270dc7487abaa4e7e046ac80b9"><enum>(A)</enum><text>shall not

			 implement the provisions of sections 107, 109, or 112, unless approved by the

			 Secretary; and</text>

						</subparagraph><subparagraph id="IDbdb7e348c33e4eb9a8908e360dbf6adf"><enum>(B)</enum><text>may implement the

			 provision of any section of this title not specifically cited in subparagraph

			 (A).</text>

						</subparagraph></paragraph><paragraph id="ID6f77d986de18422cb3ad82076ec50749"><enum>(2)</enum><header>Failing

			 score</header><text>If any public housing agency receives a failing score under

			 the performance evaluation system implemented pursuant to subsection (a), the

			 Secretary shall determine how to best administer the grant, which may

			 include—</text>

						<subparagraph id="id389A489747EE4DC2939B0FD60B53D51A"><enum>(A)</enum><text>administration of

			 such grant by 1 or more other public housing agencies or other entities;</text>

						</subparagraph><subparagraph id="idDC0A7A9565B744CCB668F7F85A362C68"><enum>(B)</enum><text>appointment of a

			 receiver to manage the grant; or</text>

						</subparagraph><subparagraph id="id844042DB4AAA44C891B533D01B2E5E0F"><enum>(C)</enum><text>setting a

			 specific deadline for improvement, if the Secretary determines that significant

			 improvements can be made expeditiously.</text>

						</subparagraph></paragraph><paragraph id="ID9cba9b3a32ce4860b3ecdb20aba01457"><enum>(3)</enum><header>Applicability</header><text>All

			 provisions applicable to public housing agencies administering funds under this

			 title shall be applicable to such other public housing agencies or other

			 entities as are designated by the Secretary pursuant to paragraph

			 (2)(A).</text>

					</paragraph></subsection></section><section id="ID58491cb3202b4f3794cf76ead507ac14"><enum>107.</enum><header>Eligible

			 families</header>

				<subsection id="ID6a3b2e4bb6db4a7a9b9bc567c44e3f32"><enum>(a)</enum><header>Initial

			 eligibility</header><text>Subject to subsection (c), to be eligible to receive

			 tenant-based rental or tenant-based homeownership assistance under this title,

			 a family shall—</text>

					<paragraph id="IDf4b5699585624a899328be1883a1976b"><enum>(1)</enum><text>not own a

			 significant interest in any real property;</text>

					</paragraph><paragraph id="ID81d1ebb5e68b4f5d8cd2ac4fb9aabf91"><enum>(2)</enum><text>not have assets

			 exceeding an amount established by the Secretary; and</text>

					</paragraph><paragraph id="ID98ed25022f2c4da1aa9bdaff0f1cc4be"><enum>(3)</enum><text>have a gross

			 income that does not exceed 80 percent of the median income for the area, as

			 determined by the Secretary in a manner consistent with income limits

			 established for other Department of Housing and Urban Development programs,

			 with adjustments for smaller or larger families and areas of unusually high or

			 low income.</text>

					</paragraph></subsection><subsection id="IDeb29fa375866470f96bd80a9b1b49e86"><enum>(b)</enum><header>Continued

			 eligibility</header><text>Subject to subsections (f) and (g), continued

			 eligibility for housing assistance pursuant to this title shall be determined

			 in accordance with standards established by the Secretary and the public

			 housing agency, except that families with incomes above 80 percent of area

			 median income shall not be eligible for continued assistance.</text>

				</subsection><subsection id="ID21cb795638e047e19646bd307d5a4283"><enum>(c)</enum><header>Other

			 requirements</header>

					<paragraph id="ID8852e402fba546d58d0bb6ea3efe7e5b"><enum>(1)</enum><header>90 percent

			 test</header><text>Not fewer than 90 percent of the families selected during

			 any 1-year period for assistance under this title shall have gross incomes that

			 do not exceed 60 percent of the median income for the area, as determined by

			 the Secretary, with adjustments for smaller or larger families and areas of

			 unusually high or low income.</text>

					</paragraph><paragraph id="ID361f09f3edc6447aaf824483565c3c2e"><enum>(2)</enum><header>Additional

			 requirement</header><text>The Secretary or a public housing agency may

			 establish other eligibility requirements for assistance under this

			 title.</text>

					</paragraph></subsection><subsection id="ID052074ed5bcb485fa8907fcca509e172"><enum>(d)</enum><header>Term

			 limits</header>

					<paragraph id="ID9e0093636872485084d0613a7e1f065b"><enum>(1)</enum><header>Assistance

			 limits</header><text>Subject to paragraph (2), and beginning on January 1,

			 2008, a public housing agency may establish term limits to determine the

			 maximum amount of time during which a family may receive assistance under this

			 title.</text>

					</paragraph><paragraph id="IDfbcccfb51b024d5c80c3323a5054231c"><enum>(2)</enum><header>Guidelines for

			 term limits</header><text>Term limits established under paragraph (1)—</text>

						<subparagraph id="ID0ed3a9e519244b5b992ec835956f923d"><enum>(A)</enum><text>shall not apply

			 to elderly and disabled families; and</text>

						</subparagraph><subparagraph id="IDea6d05a652674be69ac0b2afe6f93bc8"><enum>(B)</enum><text>shall set a

			 minimum term limit for families receiving rental assistance at 5 years.</text>

						</subparagraph></paragraph></subsection><subsection id="IDff765c2fbed348c1988b3e6a52053dd2"><enum>(e)</enum><header>Preferences and

			 nondiscrimination</header>

					<paragraph id="IDdf10e6ad1dff4909bea172b7f5cf8b5e"><enum>(1)</enum><header>System for

			 housing assistance</header>

						<subparagraph id="id271DA3D867DD409C86B5F0F71C1175DE"><enum>(A)</enum><header>In

			 general</header><text>Each public housing agency receiving a grant pursuant to

			 this title shall establish a system for making housing assistance pursuant to

			 this title available to eligible families.</text>

						</subparagraph><subparagraph id="idA23177CAA0CD4B9B8BBA51B3962B106F"><enum>(B)</enum><header>Requirements of

			 system</header><text>A system required under subparagraph (A) may include

			 preferences for certain eligible populations identified by the public housing

			 agency.</text>

						</subparagraph><subparagraph id="id9F58CFAD481E43C1826F54CB48A9E64D"><enum>(C)</enum><header>Disability

			 preference</header><text>Notwithstanding any other provisions of law, in

			 providing assistance under this title a public housing agency may establish a

			 preference for persons with a specific disability.</text>

						</subparagraph></paragraph><paragraph id="ID7416729b9ce448629377abea6e981183"><enum>(2)</enum><header>Nondiscrimination

			 provision</header><text>No person in the United States shall, on the grounds of

			 race, color, national origin, religion, or sex, be excluded from participation

			 in, be denied the benefits of, or be subjected to discrimination under any

			 program or activity funded in whole or in part with funds made available under

			 this title.</text>

					</paragraph></subsection><subsection id="IDa0a1dea8cb0048c18eedb8de9380747f"><enum>(f)</enum><header>Review of

			 family income</header>

					<paragraph id="id7AF25EF20B2240229FA04E56AF369DE7"><enum>(1)</enum><header>In

			 general</header><text>Not less frequently than once every 2 years, each public

			 housing agency administering a housing assistance grant pursuant to this title

			 shall conduct a review of the family income of each family receiving assistance

			 under this title to determine the continued eligibility of that family to

			 receive assistance under this title.</text>

					</paragraph><paragraph id="id202619CD6AAA4505868FD79B9C40DF32"><enum>(2)</enum><header>Elderly or

			 disabled family exception</header><text>Notwithstanding paragraph (1), not less

			 frequently than once every 3 years, each public housing agency shall review the

			 income of each elderly family and each disabled family receiving assistance

			 under this title to determine the continued eligibility of that family to

			 receive assistance under this title.</text>

					</paragraph></subsection><subsection id="ID82f328fe69ce4bcb896f400de0644b48"><enum>(g)</enum><header>Termination for

			 criminal activity and alcohol abuse and selection of tenants</header>

					<paragraph id="IDdffb0c18bb0c4103987c913753c82d32"><enum>(1)</enum><header>Termination of

			 assistance</header><text>Notwithstanding any other provision of law, a public

			 housing agency may deny assistance under this title based on the actions by a

			 family member, and may terminate assistance under this title based on actions

			 by a family member, or any guest or other person under the family's control, if

			 the public housing agency determines that the family member or other person

			 engages in or has engaged in any—</text>

						<subparagraph id="IDb60df03bcf234e1cb383b7680c64d39c"><enum>(A)</enum><text>criminal activity

			 (including violent criminal activity and drug-related criminal activity) on or

			 off the premises;</text>

						</subparagraph><subparagraph id="ID102cf12bb43645a1a28d4b6c0bb985e4"><enum>(B)</enum><text>alcohol abuse (or

			 pattern of abuse) that threatens the health, safety, or right to peaceful

			 enjoyment of the premises by other tenants;</text>

						</subparagraph><subparagraph id="ID9be7efaadc1445b58d9eac9a16c8f254"><enum>(C)</enum><text>parole violation,

			 probation violation, or flight to avoid prosecution, custody, or confinement

			 after conviction; or</text>

						</subparagraph><subparagraph id="ID393b4f229f944547822efdd10729b01a"><enum>(D)</enum><text>such other acts

			 that subject the person to a lifetime registration requirement under a State

			 sex offender registration program.</text>

						</subparagraph></paragraph><paragraph id="ID473883bcd7de4b9b95e0cb8f53a8dab9"><enum>(2)</enum><header>General

			 termination provisions</header><text>Each contract between a public housing

			 agency and an owner to make assistance payments under this title shall provide

			 that, during the term of the lease, the owner may not terminate the tenancy

			 except for serious or repeated violations of the terms and conditions of the

			 lease, for violation of applicable Federal, State, and local law, in accordance

			 with this title, or for other good cause.</text>

					</paragraph><paragraph id="ID212a702a5784471c9b41e9a1d9346423"><enum>(3)</enum><header>Specific causes

			 for termination</header>

						<subparagraph id="id621B8FA3C0494394A58AEBAD3B3BF605"><enum>(A)</enum><header>In

			 general</header><text>Each contract between a public housing agency and an

			 owner to make assistance payments under this title shall provide that, during

			 the term of the lease, the circumstances described un subparagraph (B) shall be

			 cause for termination of tenancy by the owner, if the owner determines that the

			 tenant of a unit, any member of the tenant's household, or any guest or other

			 person under the tenant's control engages in or has engaged in any activities

			 described in subparagraph (B).</text>

						</subparagraph><subparagraph id="IDa3146d0ae1d0442aa2446d3d82e53ce0"><enum>(B)</enum><header>Prohibited

			 activities</header><text>Activities described in this subparagraph are—</text>

							<clause id="id7F1C8C2C9DBE4EC7BDC39C759CE555FD"><enum>(i)</enum><text>violent criminal

			 activity or drug-related criminal activity, on or off the premises;</text>

							</clause><clause id="ID396290ddd0fe4e9b8b8083c34415e6fe"><enum>(ii)</enum><text>other criminal

			 activity that threatens the health, safety, or right to peaceful enjoyment of

			 the premises by other tenants, or the right to peaceful enjoyment of their

			 residences by persons residing in the immediate vicinity of the

			 premises;</text>

							</clause><clause id="IDb6a2456a1f2e4560b77405e7ab8d3197"><enum>(iii)</enum><text>alcohol abuse

			 (or pattern of abuse) that threatens the health, safety, or right to peaceful

			 enjoyment of the premises by other tenants;</text>

							</clause><clause id="ID8f4cbf777df04b0e9fa7117011712af5"><enum>(iv)</enum><text>parole

			 violation, probation violation, or flight to avoid prosecution, custody, or

			 confinement after conviction; or</text>

							</clause><clause id="ID7d9ed8ff3d094ab791eafee13a79b129"><enum>(v)</enum><text>such other acts

			 that subject the person to a lifetime registration requirement under a State

			 sex offender registration program.</text>

							</clause></subparagraph></paragraph><paragraph id="ID21481f45744a4803a69bc266ba47e07b"><enum>(4)</enum><header>Additional

			 termination provisions</header><text>A public housing agency may deny or

			 terminate assistance under this title, and the owner may terminate tenancy for

			 reasons other than the reasons specified in paragraph (3), as specified in an

			 agreement or contract or as prescribed by the Secretary.</text>

					</paragraph><paragraph id="ID527979d5fd4f4305a0776fadc1a8cfb9"><enum>(5)</enum><header>Selection of

			 tenants</header><text>After the eligibility of a family is determined in

			 accordance with this section, the selection of a tenant shall be the function

			 of the owner.</text>

					</paragraph></subsection><subsection id="ID6af560bd80544a0bb73fb6ae1b31e321"><enum>(h)</enum><header>Selection of

			 families</header><text>In selecting families for the provision of assistance

			 under this title, a public housing agency may not exclude or penalize a family

			 solely because the family resides in a public housing project, subject to the

			 normal and customary procedures of the public housing agency.</text>

				</subsection></section><section id="ID3b005c8485f84b6688609fd147a22075"><enum>108.</enum><header>Eligible

			 activities</header>

				<subsection id="ID41403237247d41ad96d597a207058012"><enum>(a)</enum><header>In

			 general</header><text>Eligible activities under this title include—</text>

					<paragraph id="ID67c4c507675a4ae59a9e8d9f525c3628"><enum>(1)</enum><text>tenant-based

			 rental assistance, including pad rentals;</text>

					</paragraph><paragraph id="IDa297b24cd36f468e9be0b2d91c8aa597"><enum>(2)</enum><text>project-based

			 rental assistance under subsection (b);</text>

					</paragraph><paragraph id="IDeebdeea065174ccaad88c35fa2f04724"><enum>(3)</enum><text>tenant-based

			 homeownership assistance for first-time homebuyers under subsection (c);</text>

					</paragraph><paragraph id="IDa804cbe2d8454dfa87904b6746df1272"><enum>(4)</enum><text>self-sufficiency

			 programs under section 114, including self-sufficiency escrow savings accounts

			 deposits;</text>

					</paragraph><paragraph id="IDd7e2bfaa31224d779492f0e6c9bdc0b9"><enum>(5)</enum><text>costs of

			 administering grant amounts under this title;</text>

					</paragraph><paragraph id="ID5ec61cbc24b045538fb1514298befd30"><enum>(6)</enum><text>costs of other

			 activities, as specified by the Secretary, in support of tenant-based rental

			 assistance, project-based rental assistance, tenant-based homeownership

			 assistance, and self-sufficiency coordinators authorized under this title;

			 and</text>

					</paragraph><paragraph id="ID0bd7020798d846aa95a12dc51af2967f"><enum>(7)</enum><text>amounts to be

			 used by the Secretary for purposes of program evaluation, management

			 information systems, and technical assistance.</text>

					</paragraph></subsection><subsection id="IDefc17b5a633743e8bd343e2f944c22aa"><enum>(b)</enum><header>Project-Based

			 rental assistance</header>

					<paragraph id="ID1b26b9fb5cc84877b8dc87a2a6215599"><enum>(1)</enum><header>In

			 general</header><text>A public housing agency may use amounts provided under

			 this title to enter into a project-based housing assistance payments contract

			 with respect to eligible units for up to 10 years, subject to the availability

			 of appropriations and to compliance with the inspection requirements under

			 section 112(b).</text>

					</paragraph><paragraph id="ID53fbc3ee76b942f986b8c3f15e03358e"><enum>(2)</enum><header>Extensions</header><text>At

			 the expiration of a contract entered into under paragraph (1), a public housing

			 agency may extend the term of the contract if the housing continues to meet the

			 housing quality standards under section 112(b) and such other requirements as

			 that public housing agency may prescribe.</text>

					</paragraph><paragraph id="ID46de012ab9d3401b8e5242c70a1052a1"><enum>(3)</enum><header>Percentage

			 limitations</header>

						<subparagraph id="idE4E1FAF10CC74D83A5D89E1AD3CBA8E4"><enum>(A)</enum><header>Attached

			 structures</header><text>Not more than 20 percent of the funding made available

			 to the public housing agency under this title may be attached to structures

			 pursuant to this subsection.</text>

						</subparagraph><subparagraph id="idC75D601113BD4AAB8EA63FC14FFE6B71"><enum>(B)</enum><header>Project-Based

			 housing assistance</header><text>Not more than 25 percent of the dwelling units

			 in any building may be assisted under a project-based housing assistance

			 payments contract, except for—</text>

							<clause id="idB3FB29A0314745929AE2039AE78C8D6F"><enum>(i)</enum><text>housing

			 consisting of single-family properties; or</text>

							</clause><clause id="id2F39B7771B834137AB0047CEE948C453"><enum>(ii)</enum><text>dwelling units

			 that are specifically made available for households comprised of elderly

			 families, disabled families, and families receiving supportive services.</text>

							</clause></subparagraph></paragraph><paragraph id="ID1d390f335d244a3ab095fae63a1f725b"><enum>(4)</enum><header>Option of

			 tenant-based assistance</header>

						<subparagraph id="ID56da4e2e35c04a8b81271f0da178647f"><enum>(A)</enum><header>Relocation</header><text>Each

			 low-income family occupying a dwelling unit assisted under a project-based

			 voucher contract may relocate and continue to receive assistance under this

			 title so long as the family has occupied the assisted dwelling unit for 12

			 months and relocates within the jurisdiction of the public housing agency

			 wherein it currently resides.</text>

						</subparagraph><subparagraph id="IDe8587e23cadf4530887cdc6afef92133"><enum>(B)</enum><header>Comparable

			 assistance</header><text>Except as provided in subparagraphs (C) and (D), upon

			 such a move to a unit that meets Federal and local requirements, including

			 housing quality standards, the public housing agency shall provide the

			 low-income family with tenant-based rental assistance under this title or such

			 other tenant-based rental assistance that is comparable.</text>

						</subparagraph><subparagraph id="ID2bcc038566434c79bd22617aa4704820"><enum>(C)</enum><header>Limitation</header><text>In

			 providing assistance under subparagraph (B), the public housing agency shall

			 not be required to provide housing assistance in an amount higher than the

			 assistance provided to the low-income family prior to the relocation under

			 subparagraph (A).</text>

						</subparagraph><subparagraph id="IDccf65b4672814391a25a2bc8540ad4f9"><enum>(D)</enum><header>If assistance

			 not available</header><text>If tenant-based rental assistance is not

			 immediately available to fulfill this requirement, the public housing agency

			 shall provide the family with the next available tenant-based rental voucher or

			 other tenant-based rental assistance amounts that become available.</text>

						</subparagraph></paragraph><paragraph id="IDa284d259d2d74f068db906dbdf47f9ce"><enum>(5)</enum><header>Payment for

			 vacant units</header>

						<subparagraph id="id65A8B20B54844BFDB0244D41B208917E"><enum>(A)</enum><header>In

			 general</header><text>The public housing agency may continue to provide

			 assistance under the project-based contract, for a reasonable period not

			 exceeding 60 days, for a dwelling unit that becomes vacant, but only if—</text>

							<clause id="IDc2c4ddbe007b457fa8c2b1757229a4d0"><enum>(i)</enum><text>the

			 vacancy was not the fault of the owner of the dwelling unit; and</text>

							</clause><clause id="IDa4c5d385551f475ebb7702f20b8977fe"><enum>(ii)</enum><text>the owner takes

			 every reasonable action to minimize the likelihood and extent of any such

			 vacancy.</text>

							</clause></subparagraph><subparagraph id="idABB9F8EC004C45E1B97CF29E43626119"><enum>(B)</enum><header>No assistance

			 after expiration of 60-day period</header><text>Project-based rental assistance

			 may not be provided for a vacant unit after the expiration of the 60-day period

			 described in subparagraph (A).</text>

						</subparagraph></paragraph></subsection><subsection id="ID1cf091fde5a245eebf649e2c8d045284"><enum>(c)</enum><header>Homeownership

			 assistance for first-Time homebuyers</header>

					<paragraph id="ID33b7001e5e674ced8c9479fb36b4c89a"><enum>(1)</enum><header>In

			 general</header><text>A public housing agency may provide tenant-based

			 homeownership assistance and downpayment assistance under this title to assist

			 a first-time homebuyer that purchases a home.</text>

					</paragraph><paragraph id="ID6ed0f08d912143ffa5ee7aba94985a7e"><enum>(2)</enum><header>Family

			 eligibility</header><text>In order to receive tenant-based homeownership

			 assistance or downpayment assistance under this title, a family shall—</text>

						<subparagraph id="idD6013154F66148C983667CDB21B33D29"><enum>(A)</enum><text>qualify as a

			 first-time homebuyer;</text>

						</subparagraph><subparagraph id="idD24CB6F6896349548BC9FC65AE9E540A"><enum>(B)</enum><text>participate in a

			 homeownership counseling program; and</text>

						</subparagraph><subparagraph id="id2391209DF20C4E31A7DACB7CBF08DAA1"><enum>(C)</enum><text>meet any other

			 initial or continuing requirements established by the public housing

			 agency.</text>

						</subparagraph></paragraph><paragraph id="ID6b28fafb5b974f3b90d9e6f758ee6e36"><enum>(3)</enum><header>Purchase

			 agreement</header><text>A recipient of tenant-based homeownership assistance or

			 downpayment assistance may enter into a purchase agreement for a home whether

			 constructed, under construction, or proposed.</text>

					</paragraph><paragraph id="ID913fc93f13cb4421a844caeeeb26ee21"><enum>(4)</enum><header>Downpayment

			 assistance</header>

						<subparagraph id="IDe0e7bbe0f9fa4aefa8f6447bcf2b8f91"><enum>(A)</enum><header>In

			 general</header><text>Subject to the provisions of this paragraph, a public

			 housing agency may, in lieu of providing tenant-based homeownership assistance

			 to a family under this subsection, provide downpayment assistance under this

			 title for a family that has received a rental subsidy administered by the

			 Secretary for a period of not less than 12 months prior to the date of receipt

			 of downpayment assistance.</text>

						</subparagraph><subparagraph id="ID38fee6bfd0d84cc29fc80a56c95f34d2"><enum>(B)</enum><header>Grant

			 requirements</header><text>A downpayment assistance grant under subparagraph

			 (A)—</text>

							<clause id="ID8457381915ab477eb92efb16b10eeabd"><enum>(i)</enum><text>shall be in the

			 form of a single one-time grant to be used only as a contribution toward the

			 downpayment and reasonable and customary closing costs required in connection

			 with the purchase of a home; and</text>

							</clause><clause id="ID7b0a586070094e99ab4789aa94c14664"><enum>(ii)</enum><text>may not exceed

			 $10,000.</text>

							</clause></subparagraph><subparagraph id="IDcdc15fdc680243328b35b87704bf90f2"><enum>(C)</enum><header>No effect on

			 obtaining outside sources for downpayment assistance</header><text>This title

			 may not be construed to prohibit a public housing agency from providing

			 downpayment assistance to families from sources other than a grant provided

			 under this title, or as determined by the public housing agency.</text>

						</subparagraph></paragraph></subsection></section><section id="ID6f542bdfb7204537b32895b32ef6c542"><enum>109.</enum><header>Amount of

			 assistance</header>

				<subsection id="ID0711e5f7949a4e8f81864ecfb3bf59bc"><enum>(a)</enum><header>In

			 general</header><text>In accordance with the provisions of this section, each

			 public housing agency administering assistance under this title shall determine

			 the amount of any monthly assistance payment for a family.</text>

				</subsection><subsection id="id8230C40C6392431C8D8E5ED0CF177CC7"><enum>(b)</enum><header>Rent

			 structures</header><text>In fulfilling its requirements under this section, a

			 public housing agency may establish—</text>

					<paragraph id="IDc0f5d64dd4e9458eb5de9c9da72516f6"><enum>(1)</enum><text>a rent structure

			 in which a family pays a flat amount of rent and such amount is adjusted on the

			 basis of an annual cost index;</text>

					</paragraph><paragraph id="ID502dce7e72dd4ebfa4f82d6cba707eb1"><enum>(2)</enum><text>an income-tiered

			 rent structure in which the amount of rent that a family is required to pay is

			 set and distributed on the basis of broad tiers of income, adjusted on the

			 basis of an annual cost index;</text>

					</paragraph><paragraph id="ID326b0c57750c4637bc4534b520af7779"><enum>(3)</enum><text>a rent structure

			 in which the amount of rent that a family is required to pay is based on a

			 percentage of family income;</text>

					</paragraph><paragraph id="ID2d582d1bbc284973a64a3a5d9a92b92a"><enum>(4)</enum><text>a rent structure

			 in which the amount of rent that a family is required to pay is based on the

			 provisions of sections 3 and 8(o)(2) of the United States Housing Act of 1937

			 (42 U.S.C. 1437a and 1437f(o)(2)) as such sections existed prior to the date of

			 enactment of this title; or</text>

					</paragraph><paragraph id="ID138d578ecefe47558e2d0fcc69f03317"><enum>(5)</enum><text>any other rent

			 structure that includes 1 or more of the elements of the rent structures

			 specified in this subsection.</text>

					</paragraph></subsection><subsection id="ID1a76305e90ae4d0cbdc1d8bbce65188a"><enum>(c)</enum><header>Elderly and

			 disabled families</header><text>Notwithstanding subsection (b), elderly

			 families and disabled families shall pay rent in accordance with the provisions

			 of section 105.</text>

				</subsection><subsection id="ID317c35b0263c4bfe8a85cf917943fac6"><enum>(d)</enum><header>Minimum rental

			 amount</header><text>A public housing agency shall establish a minimum monthly

			 rental amount to be paid by each family assisted in accordance with this

			 title.</text>

				</subsection><subsection id="ID08b3e44f84ec46669eb8fb8f25956cac"><enum>(e)</enum><header>Rent

			 reasonableness</header>

					<paragraph id="idF0FA00D862764FBF8F1D73025ADB2F09"><enum>(1)</enum><header>In

			 general</header><text>The rent for dwelling units assisted under this title

			 shall be reasonable and appropriate in comparison with rents charged for

			 dwelling units of a modest nature and a non-luxury standard in the private,

			 unassisted local market.</text>

					</paragraph><paragraph id="id77432CBB263F458DB5F8F29E148B024D"><enum>(2)</enum><header>Review</header><text>Public

			 housing agencies shall review rents not less than annually to ensure that they

			 meet the standard described in paragraph (1).</text>

					</paragraph></subsection><subsection id="IDe3cda8bc074d43efbfcd56574e1f2d28"><enum>(f)</enum><header>Maximum

			 subsidy</header><text>Public housing agencies shall establish maximum subsidy

			 levels for housing assistance under this title that are reasonable and

			 appropriate for the market area.</text>

				</subsection></section><section id="ID4cae9b290a17446386c7a3b7649e3dae"><enum>110.</enum><header>Allocation and

			 distribution of funds</header>

				<subsection id="ID81650f6f9e8f43b5aaea4176fd42d586"><enum>(a)</enum><header>In

			 general</header><text>For purposes of administering assistance under this

			 title, the Secretary shall allocate available amounts subject to appropriations

			 as follows:</text>

					<paragraph id="IDf1fbc484faac48d38c652772930b487f"><enum>(1)</enum><header>Interim formula

			 for allocation of funds</header><text>During the fiscal years in which this

			 title is being administered pursuant to the Federal Register notice described

			 in section 118(a), each public housing agency may receive an amount

			 proportionate to its annual 2005 housing choice voucher program funding for

			 housing assistance and administrative expenses, adjusted for inflation and

			 subject to validation.</text>

					</paragraph><paragraph id="IDe126a1fc77124d918f0f94895880ff8c"><enum>(2)</enum><header>Permanent

			 formula for allocation of funds</header><text>In accordance with the provisions

			 of section 118(b)(2), the Secretary shall establish a formula to allocate

			 funding made available by Congress under this title.</text>

					</paragraph></subsection><subsection id="ID6053c38d61d34df1ba6c8860db5c4d26"><enum>(b)</enum><header>Amounts to

			 provide tenant-Based rental assistance</header>

					<paragraph id="idE072AC2FCA7C475BB8E72D3DE6D5A3EF"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall allocate amounts made available from

			 appropriations to public housing agencies for tenant-based rental assistance as

			 authorized by section 115.</text>

					</paragraph><paragraph id="id4D8F6D46FE1449628B6AE16975E9450A"><enum>(2)</enum><header>Timing</header><text>Additional

			 tenant-based rental assistance provided under paragraph (1) for a family shall

			 be allocated for 1 year.</text>

					</paragraph><paragraph id="id4D932CC08EDB460890C98FB4837DFE72"><enum>(3)</enum><header>Expiration</header><text>After

			 the expiration of the 1-year period described in paragraph (2), any amounts not

			 expended shall be included in the subsequent grant to each public housing

			 agency under this title.</text>

					</paragraph></subsection></section><section id="ID655c225a988b47b38340f93d61690e71"><enum>111.</enum><header>Environmental

			 review</header><text display-inline="no-display-inline">Notwithstanding any

			 other provision of law, the National Environmental Protection Act (42 U.S.C.

			 4321 et seq.) shall not apply to activities authorized under this title.</text>

			</section><section id="ID7d743c7a4f6d452ea61edafc9304b27c"><enum>112.</enum><header>Inspection of

			 units</header>

				<subsection id="ID0e66963089ce4745b5028e9f7f9123f1"><enum>(a)</enum><header>Inspection

			 required</header>

					<paragraph id="id74EA4C1377AD4854BD48DA6412D54925"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall require that a public housing agency

			 administering rental assistance under this title shall inspect each rental

			 dwelling unit assisted pursuant to this title not later than 60 days after the

			 date of receipt of the initial assistance payment to determine that the rental

			 dwelling unit meets the housing quality standards under subsection (b).</text>

					</paragraph><paragraph id="id1FCC200E044540B4AC7C8CCD611DCE88"><enum>(2)</enum><header>Standards must

			 be met</header><text>Each rental dwelling unit shall meet such standards in

			 order to receive continued assistance payments.</text>

					</paragraph></subsection><subsection id="IDbf4a3fad66a7448398fdff41ac62d590"><enum>(b)</enum><header>Housing quality

			 standards</header><text>Each rental dwelling unit assisted by a public housing

			 agency under this title shall either meet the housing quality standards

			 established by the Secretary or comparable housing quality standards that the

			 Secretary has approved.</text>

				</subsection><subsection id="IDb02933e196284985be3f147b11e5f027"><enum>(c)</enum><header>

			 Inspections</header>

					<paragraph id="idB5CD60AF13FC4F709A2363FE8C79B2E6"><enum>(1)</enum><header>Maintenance

			 requirement</header><text>Each public housing agency administering rental

			 assistance under this title shall determine that all occupied dwelling units

			 assisted by such public housing agency pursuant to this title are maintained in

			 accordance with the standards described under subsection (b).</text>

					</paragraph><paragraph id="idAC2014DB9630497190E0FC87B28ACB83"><enum>(2)</enum><header>Timing</header><text>Each

			 rental dwelling unit assisted by the public housing agency under this title

			 shall be inspected when it is first leased, pursuant to subsection (a).

			 Thereafter, each public housing agency shall annually inspect at least 25

			 percent of all of its rental dwelling units assisted under this title, and each

			 such rental dwelling unit shall be inspected at least once every 4

			 years.</text>

					</paragraph></subsection><subsection id="IDf208c78910694b0b9a6068a99ca54c90"><enum>(d)</enum><header>Corrective

			 actions</header><text>No further assistance payment may be made pursuant to

			 this title for a rental dwelling unit which fails to meet the standards under

			 subsections (b) or (c).</text>

				</subsection></section><section id="ID6d69d601fced45ef9c50e63f911138f3"><enum>113.</enum><header>Ability to

			 transfer tenant-based rental assistance</header>

				<subsection id="ID50289d5613674a0da3f461b628223370"><enum>(a)</enum><header>State and

			 regional transfer agreements</header><text>A public housing agency may enter

			 into agreements with other public housing agencies within the same State or

			 region in order to facilitate the ability of transfer-eligible families who

			 wish to transfer their tenant-based rental assistance under this title to

			 another jurisdiction within a State or region.</text>

				</subsection><subsection id="ID50c8591508cf4287bfeb368c524497e1"><enum>(b)</enum><header>Regional

			 boundaries</header><text>For the purpose of entering into agreements among

			 public housing agencies within a proposed region pursuant to subsection (a),

			 public housing agencies may establish regions and enter into regional

			 agreements with other public housing agencies, except that the public housing

			 agencies shall notify the Secretary of any proposed regional boundaries

			 encompassing more than 1 State or the District of Columbia prior to the

			 execution of any such agreement, and the boundaries may be implemented only if

			 the Secretary does not object, not later than 60 days after the date of

			 notification to the Secretary.</text>

				</subsection><subsection id="IDb397f65f14e446d8901019c7efe3ff3e"><enum>(c)</enum><header>Procedures</header><text>The

			 Secretary may establish procedures to transfer funding between public housing

			 agencies in order to phase out and eliminate previous portability billing

			 arrangements among public housing agencies under section 8(r)(3) of the United

			 States Housing Act of 1937 (42 U.S.C. 1437f(r)(3)) as in effect on the day

			 prior to the date of enactment of this title.</text>

				</subsection></section><section id="ID2e5442ed0a8d44ef8bc273a7e7ea807b"><enum>114.</enum><header>Self-sufficiency</header>

				<subsection id="idA65675D8D28642AA84A45D37F2CD88B8"><enum>(a)</enum><header>Self-Sufficiency</header><text display-inline="yes-display-inline">Subject to the provisions of this section,

			 a public housing agency may develop a local self-sufficiency initiative

			 accessing public and private resources to enable families to achieve economic

			 independence and homeownership.</text>

				</subsection><subsection id="ID1508559e35d5422793a59adc40c84d83"><enum>(b)</enum><header>Eligible

			 activities</header><text>A public housing agency may use funds made available

			 under this title for a self-sufficiency initiative authorized by subsection (a)

			 only—</text>

					<paragraph id="id42BA80F81EF14A33A1B2272BC86F0E9E"><enum>(1)</enum><text>to provide

			 housing assistance;</text>

					</paragraph><paragraph id="idB647B232DC6840B382176651CD6D07EC"><enum>(2)</enum><text>to employ

			 self-sufficiency coordinators; and</text>

					</paragraph><paragraph id="idF47FE9CFF33840028CED782DAAD41CF3"><enum>(3)</enum><text>to establish and

			 maintain a special escrow account incentive.</text>

					</paragraph></subsection><subsection id="IDe92a6d26c76f4a048405cc6259b2553a"><enum>(c)</enum><header>Requirements</header><text>A

			 public housing agency may establish requirements for participating families and

			 terminate or withhold assistance under this title if families fail to comply,

			 without good cause, with any such requirements.</text>

				</subsection></section><section id="ID981a2117d5d44fbd95e3da655dcc7e90"><enum>115.</enum><header>Termination of

			 rental assistance contracts and related transactions</header>

				<subsection id="IDb8e5ee9f9dd94db2b501b6ebe1baa563"><enum>(a)</enum><header>Enhanced

			 voucher assistance</header>

					<paragraph id="IDa5d5b11c3b72494786ad2585c3a524aa"><enum>(1)</enum><header>In

			 general</header><text>Except as provided in subsection (b), families affected

			 by an eligibility event shall receive enhanced voucher assistance under this

			 subsection.</text>

					</paragraph><paragraph id="ID55a81e506d35477fb762b2bc8495830c"><enum>(2)</enum><header>Scope of

			 enhanced voucher assistance</header><text>Enhanced voucher assistance shall be

			 tenant-based rental assistance under this title, except that a family

			 shall—</text>

						<subparagraph id="ID5359eedda38546ad96d5b24c7ac206f7"><enum>(A)</enum><text>pay as rent not

			 less than the amount that the family was paying on the date of the eligibility

			 event;</text>

						</subparagraph><subparagraph id="IDd1de0125ad1c41b696613ab46afde4bc"><enum>(B)</enum><text>be allowed to

			 remain in the rental housing project in which they were residing for 12 months;

			 and</text>

						</subparagraph><subparagraph id="ID335b161f5cd440088678cd8eead9c000"><enum>(C)</enum><text>have its housing

			 assistance calculated in accordance with the provisions of section 109 if the

			 family moves out of the housing project.</text>

						</subparagraph></paragraph><paragraph id="IDe5bb30af6cfa42a1815502eff20a896d"><enum>(3)</enum><header>Amount of

			 rental assistance</header><text>If a family elects to remain in the same

			 housing project under paragraph (2)(A), and if the rent for the dwelling unit

			 in the housing project exceeds the maximum subsidy level established by the

			 public housing agency, the maximum subsidy level used to calculate the enhanced

			 voucher shall equal the rent for the dwelling unit, subject to the rent

			 reasonableness requirements of section 109(e) and any other reasonable limit

			 prescribed by the Secretary.</text>

					</paragraph><paragraph id="IDbe8f30ed8c3d418b96b41d6fb35f43c7"><enum>(4)</enum><header>Tenant-based

			 rental assistance</header><text>After 12 months of receiving assistance under

			 subsection (a), affected families shall receive tenant-based rental assistance

			 calculated in accordance with section 109 in lieu of the assistance under

			 subsection (a).</text>

					</paragraph></subsection></section><section id="IDaf13e9b9568a46209531ed4700889ae3"><enum>116.</enum><header>Failure to

			 perform</header>

				<subsection id="ID242de1fb21aa47e6b0a69c51db85b1e0"><enum>(a)</enum><header>Monitoring</header><text>The

			 Secretary shall make such reviews and audits as may be necessary or appropriate

			 to determine whether—</text>

					<paragraph id="idF019114E832547ABA6F5DBD4FFAF2A88"><enum>(1)</enum><text>each public

			 housing agency has carried out the activities and objectives of this title,

			 including all certifications, in accordance with the requirements of this title

			 and other applicable laws;</text>

					</paragraph><paragraph id="idC215D386B5894FB086B3AF3CC71D5618"><enum>(2)</enum><text>it has the

			 continuing capacity to undertake such activities and objectives in a timely and

			 effective manner; and</text>

					</paragraph><paragraph id="id0B92B03CBC024C32BCBAB41C474AE52D"><enum>(3)</enum><text>whether it has

			 met the performance standards established by the Secretary pursuant to section

			 106(a).</text>

					</paragraph></subsection><subsection id="ID992382d09fe04afe84c3b2687f2d3f70"><enum>(b)</enum><header>Enforcement</header><text>In

			 addition to any other actions authorized under this or any other applicable

			 law, if the Secretary finds that a public housing agency receiving assistance

			 under this title has failed to comply with any provision of this title,

			 including any performance standard established by the Secretary pursuant to

			 this title, and until the Secretary is satisfied that there is no longer any

			 such failure to comply, the Secretary may—</text>

					<paragraph id="ID0abf5889ba1f408b8c4b53a8def758fa"><enum>(1)</enum><text>terminate

			 payments under this title to the public housing agency and provide for

			 alternative administration of such amounts;</text>

					</paragraph><paragraph id="IDb5456348cddc4663b17e6886212d39af"><enum>(2)</enum><text>withhold from the

			 public housing agency amounts from the total allocation that would otherwise be

			 available to the public housing agency under this title;</text>

					</paragraph><paragraph id="ID266e868de83046e094cf791ba5979e7f"><enum>(3)</enum><text>reduce the amount

			 of future grants to the public housing agency by an amount equal to the amount

			 of such grants that were not expended in accordance with this title;</text>

					</paragraph><paragraph id="ID6e39e22ae8a54fac9cce5000090bad4d"><enum>(4)</enum><text>limit the

			 availability of amounts provided to the public housing agency to programs and

			 activities under this title not affected by such failure to comply;</text>

					</paragraph><paragraph id="IDccda629a11044721a2827b7d3abe6827"><enum>(5)</enum><text>withhold from the

			 public housing agency other amounts allocated for the public housing agency

			 under other programs administered by the Secretary;</text>

					</paragraph><paragraph id="IDa854264de2924a1f9a1716e61f56d98a"><enum>(6)</enum><text>require such

			 changes in public housing agency policy or management practices, consistent

			 with other provisions of this title, as determined necessary to ensure

			 compliance;</text>

					</paragraph><paragraph id="ID3d5b6c921f95452fabc51dcd2fc50f3d"><enum>(7)</enum><text>refer any such

			 failure to comply, as appropriate, to Federal, State, or local enforcement

			 agencies for appropriate action;</text>

					</paragraph><paragraph id="ID714f0fa16b824ca79aa12c97f6827336"><enum>(8)</enum><text>impose civil

			 money penalties, except that a public housing agency shall not pay a civil

			 money penalty imposed under this paragraph from a grant received under section

			 103; or</text>

					</paragraph><paragraph id="id6F91E7305E0F4F3CA7FBE45F3FBA4164"><enum>(9)</enum><text>take any

			 combination of the actions described in paragraphs (1) through (8), as

			 appropriate.</text>

					</paragraph></subsection></section><section id="ID86ab93e5cd7a4cd0b17d52ee7739afe6"><enum>117.</enum><header>Administrative

			 and special administrative fees</header>

				<subsection id="IDd3b2a55166534b58bac1bfbecf2f3db2"><enum>(a)</enum><header>Administrative

			 fees</header><text>In each fiscal year, the Secretary shall pay an

			 administrative fee to each public housing agency administering a program under

			 this title.</text>

				</subsection><subsection id="IDd1e0b2e7ae6f4e608110a3575704f17c"><enum>(b)</enum><header>Special

			 administrative fees</header><text>Of amounts made available under this title

			 for administrative fees, the Secretary may retain up to 5 percent for

			 allocation as special administrative fees to public housing agencies for

			 non-routine expenses.</text>

				</subsection><subsection id="IDc887068b9f53477597fc0ba6474f7c2b"><enum>(c)</enum><header>Interim

			 allocation of administrative fees</header><text>During the period in which this

			 title is being administered pursuant to the Federal Register notice described

			 in section 118(a), the Secretary shall allocate administrative fees to public

			 housing agencies on a pro rata basis, based upon the amount that each public

			 housing agency received under the pro rata distribution method in fiscal year

			 2005.</text>

				</subsection><subsection id="ID6e3e5f03df59427a84669fc09311c157"><enum>(d)</enum><header>Permanent

			 allocation of administrative fees</header><text>In the final rule described in

			 section 118(b)(2), the Secretary shall establish a formula for distributing

			 administrative fees for the administration of this title.</text>

				</subsection></section><section id="ID486eae9a9c754c77bb4e8ffb93020935"><enum>118.</enum><header>Implementation</header>

				<subsection id="ID1969535296074da3bfc7160106627fb0"><enum>(a)</enum><header>Interim

			 implementation</header><text>Notwithstanding any other provision of law, the

			 Secretary shall publish a notice in the Federal Register not later than 90 days

			 after the date of enactment of this title describing the immediate

			 implementation of this title on an interim basis.</text>

				</subsection><subsection id="ID9a3b8f075c3441c6b3be25a9e02a7ad4"><enum>(b)</enum><header>Final

			 implementation</header>

					<paragraph id="IDa9bbf795c62b4499a6bfbb49396cc71f"><enum>(1)</enum><header>Rules</header><text>The

			 Secretary shall, not later than 18 months after the date of enactment of this

			 title, issue a final rule for the purpose of implementation of this title,

			 other than sections 110(a)(2) and 117(d).</text>

					</paragraph><paragraph id="ID3ca3b5a961a94f45bfd7c55cd4aad6e2"><enum>(2)</enum><header>Rules issued

			 under negotiated rulemaking procedures</header><text>For the purpose of final

			 implementation of sections 110(a)(2) and 117(d), the Secretary shall issue 1 or

			 more proposed rules developed under the negotiated rulemaking procedure under

			 subchapter III of chapter 5 of title 5, United States Code.</text>

					</paragraph><paragraph id="id3C0AD54EFE4A44AEAF1826E9E2856EF9"><enum>(3)</enum><header>Rules shall be

			 issued within 24 months</header><text>One or more final rules implementing

			 sections 110(a)(2), and 117(d) shall be issued not later than 24 months after

			 the date of enactment of this title.</text>

					</paragraph></subsection></section><section id="id94055BF392CE42F08EB2D116725234C8"><enum>119.</enum><header>Authorization

			 of appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out the

			 provisions of this title for each of fiscal years 2006 through 2011.</text>

			</section><section id="IDca9a975d24a04cdca83f61926996a241"><enum>120.</enum><header>Conforming

			 amendments</header>

				<subsection id="IDaa40e6ed946f4606b56abffbe24d2847"><enum>(a)</enum><header>Public Housing

			 Agency Organization</header><text>Section 2 of the United States Housing Act of

			 1937 (42 U.S.C. 1437) is amended—</text>

					<paragraph id="ID7fef332655dc4875912374b49bba834b"><enum>(1)</enum><text>in subsection

			 (b)(2)—</text>

						<subparagraph id="id4EF3274D51834DEC96C91BB197A119C2"><enum>(A)</enum><text>in subparagraph

			 (A), by striking <quote>or</quote> at the end;</text>

						</subparagraph><subparagraph id="IDddc8f0bce11a488891317939c2fa1b65"><enum>(B)</enum><text>in subparagraph

			 (B), by striking the period at the end and inserting <quote>; or</quote>;

			 and</text>

						</subparagraph><subparagraph id="ID93384cfc9fed426db0853fd107e32037"><enum>(C)</enum><text>by adding at the

			 end the following:</text>

			 be cited as the <quote>Public Housing Rent Flexibility and Simplification Act

			 of 2005</quote>.</text>

				</subsection></section><section id="IDe1223761bd634bb3bdd13156dbbbb5a5"><enum>202.</enum><header>Public housing

			 rent flexibility and simplification</header>

				<subsection id="ID3c2a4854b8f3457fba8341ba23aff114"><enum>(a)</enum><header>In

			 general</header><text>Section 3 of the United States Housing Act of 1937 (42

			 U.S.C. 1437a), as amended by section 120, is amended—</text>

					<paragraph id="ID49b9479667934d1696cf5a8865d3d67a"><enum>(1)</enum><text>in subsection

			 (a)—</text>

						<subparagraph id="id4D23C78A5CD844A4B7C3EC87BF0B96C9"><enum>(A)</enum><text>by striking

			 <quote>(1) Dwelling units</quote> and that follows through <quote>(3), a

			 family</quote> and inserting <quote>A family</quote>; and</text>

			 rental payments</header><text>The United States Housing Act of 1937 is amended

			 by inserting after section 3 (42 U.S.C. 1437a) the following new

			 section:</text>

						<section id="ID801bad3c10e442b280dc334cfb1a749d"><enum>3A.</enum><header>Public housing

				rental payments</header>

							<subsection id="ID9cb55f2a476345fc8586e3d9198630f9"><enum>(a)</enum><header>Rent structure

				and occupancy</header>

								<paragraph id="ID3176125c260f44abbf240a24a6c11ff1"><enum>(1)</enum><header>In

				general</header><text>Public housing dwelling units assisted under this Act

				shall be rented only to and occupied by low-income families that do not own a

				significant interest in real property and do not have assets exceeding an

				amount established by the Secretary at the time of their initial occupancy of

				such units.</text>

								</paragraph><paragraph id="id20225DA16AF74AD58A3E34478C34085C"><enum>(2)</enum><header>Review</header><text>Not

				less frequently than once every 2 years, each public housing dwelling unit

				receiving assistance under this Act shall conduct a review of the family income

				of each family occupying such unit to determine the continued eligibility of

				that family to occupy such unit.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26BD399BC9AC486C9EC94230C7991F04"><enum>(3)</enum><header>Elderly or

				disabled family exception</header><text>Notwithstanding paragraph (1), not less

				frequently than once every 3 years, each public housing dwelling unit receiving

				assistance under this Act shall conduct a review of the income of each elderly

				family or disabled family occupying such unit to determine the continued

				eligibility of that family to occupy such unit.</text>

								</paragraph><paragraph id="ID04425492863f43629257d352126b3a05"><enum>(4)</enum><header>Rental payments

				for public housing families and rent structure</header>

									<subparagraph id="IDbdbbb4508898427a9108399941d8a732"><enum>(A)</enum><header>In

				general</header><text>In accordance with the provisions of this section, public

				housing agencies shall determine the amount of any monthly rent for a family

				with respect to a public housing dwelling unit receiving assistance under this

				Act.</text>

									</subparagraph><subparagraph id="idC6F2EEF9DE694C3EB6642A5D4950CBF5"><enum>(B)</enum><header>Rent structure

				guidelines</header><text>In fulfilling its requirements under this section, a

				public housing agency may establish—</text>

										<clause id="ID4844863fd014412e8f950cd8242dc323"><enum>(i)</enum><text>a

				rent structure in which the public housing agency establishes a flat amount of

				rent for each dwelling unit that it owns and operates, based on the rental

				value of the unit, as determined by the public housing agency, and in which

				such rent is adjusted on the basis of an annual cost index;</text>

										</clause><clause id="ID3d4a5aad56104da9841c937f8965350a"><enum>(ii)</enum><text>an income-tiered

				rent structure in which the amount of rent that a family is required to pay is

				set and distributed on the basis of broad tiers of income, and such tiers and

				rents are adjusted on the basis of an annual cost index, except that families

				entering public housing shall not be offered a rent that is lower than the rent

				corresponding to their income tier;</text>

										</clause><clause id="ID9e360b60860e4fa8a58bb2a6aca4dfce"><enum>(iii)</enum><text>a rent

				structure in which the amount of rent that a family is required to pay is based

				on a percentage of family income;</text>

										</clause><clause id="IDf28a67acfd8b4cbdb038547ab9fca3d4"><enum>(iv)</enum><text>a rent structure

				in which the amount of rent that a family is required to pay is based on the

				provisions of section 3, as such section was in effect on the day prior to the

				date of enactment of this section; or</text>

										</clause><clause id="IDf9aee95ec4eb46e2979e93824b9c5821"><enum>(v)</enum><text>any other rent

				structure that includes 1 or more of the elements of the rent structures

				specified in this subparagraph.</text>

										</clause></subparagraph><subparagraph id="ID2a1bcb626d474d18a07825a1e3b0a896"><enum>(C)</enum><header>Elderly

				families and disabled families</header>

										<clause id="IDf0f268bd56f24e9a8cfe4711b1cd510d"><enum>(i)</enum><header>Existing

				tenants</header><text>Notwithstanding any other provision of this Act, elderly

				families and disabled families, as such terms were used in this Act on the day

				prior to the date of enactment of this section, who were receiving assistance

				under section 3, as such section was in effect on the day prior to the date of

				enactment of this section, shall be treated in accordance with section 3 until

				January 1, 2009.</text>

										</clause><clause id="IDce1c0dd4dca64a5dad9f60785572a2a4"><enum>(ii)</enum><header>New

				admissions</header><text>Notwithstanding any other provision of this Act,

				except as provided in clause (iv), elderly families and disabled families not

				meeting the requirements of clause (i) shall also be treated in accordance with

				section 3, as such section was in effect on the day prior to the date of

				enactment of this section, until January 1, 2009.</text>

										</clause><clause id="ID5910b45420f94e1cb8c87667c115bba4"><enum>(iii)</enum><header>Public

				housing agency policies</header><text>Notwithstanding any other provision of

				this Act, a public housing agency providing assistance under this Act shall, by

				January 1, 2009, have implemented a policy to ensure that the needs of elderly

				families and disabled families described under clauses (i) and (ii) are

				addressed by a policy determined by a public housing agency, as they relate to,

				among other things, eligibility and rent.</text>

										</clause><clause id="IDdc569176354d44408dd1031e0a735072"><enum>(iv)</enum><header>Early

				implementation</header><text>A public housing agency that has implemented a

				policy described in clause (iii) before January 1, 2009, shall administer

				assistance for elderly families and disabled families first receiving

				assistance under this Act after the effective date of such policy in accordance

				with such policy.</text>

										</clause></subparagraph><subparagraph id="IDfeb8df5b151a4b50a7737e0ce4466bc7"><enum>(D)</enum><header>Minimum rental

				amount</header><text>Public housing agencies shall establish a minimum monthly

				rental amount to be paid by each family.</text>

									</subparagraph></paragraph><paragraph id="ID989d0c0ccb234f3e9b929b37cc9aed6f"><enum>(5)</enum><header>Occupancy by

				police officers</header>

									<subparagraph id="IDac57005eefa44fb5ab4526cd92237f98"><enum>(A)</enum><header>Eligibility

				requirements waiver</header>

										<clause id="idF8C9F4CB9F024803996F29F14BBC1557"><enum>(i)</enum><header>In

				general</header><text>Subject to subparagraph (B) and notwithstanding any other

				provision of law, a public housing agency may, in accordance with the public

				housing agency plan for the agency, allow a police officer who is not otherwise

				eligible for residence in public housing to reside in a public housing dwelling

				unit.</text>

										</clause><clause id="id4E298A2947374B888A379EEE0E759C97"><enum>(ii)</enum><header>Number and

				location</header><text>The number and location of units occupied by police

				officers under this paragraph and the terms and conditions of their tenancies

				shall be determined by the public housing agency.</text>

										</clause></subparagraph><subparagraph id="IDe132d6398fbd4d428f45fa156be121ee"><enum>(B)</enum><header>Increased

				security</header><text>A public housing agency may take the actions authorized

				in subparagraph (A) only for the purpose of increasing security for the

				residents of a public housing project.</text>

									</subparagraph></paragraph><paragraph id="ID2c19e6e88200405abb01e67e9831abdf"><enum>(6)</enum><header>Occupancy by

				over-income families in certain public housing</header>

									<subparagraph id="IDd97fdae46ad149d59bf000ef3a7a9886"><enum>(A)</enum><header>Authority</header><text>Notwithstanding

				any other provision of law, a public housing agency that owns or operates fewer

				than 250 public housing dwelling units may, on a month-to-month basis, lease a

				dwelling unit in a public housing project to an over-income family in

				accordance with this paragraph, but only if—</text>

										<clause id="id4FE22FE09C7848409A4678431A816BAF"><enum>(i)</enum><text>there are no

				eligible families applying for housing assistance from the public housing

				agency for that month; and</text>

										</clause><clause id="id3FE6E72095944B92901A438172A07170"><enum>(ii)</enum><text>the agency

				provides not less than a 30-day public notice of the availability of such

				assistance.</text>

										</clause></subparagraph><subparagraph id="ID71c71ef6a386411589a5341250704abf"><enum>(B)</enum><header>Terms and

				conditions</header><text>The number and location of dwelling units of a public

				housing agency occupied under this paragraph by over-income families, and the

				terms and conditions of those tenancies, shall be determined by the public

				housing agency, except that—</text>

										<clause id="ID38c96a4232a74387bb1757ba1a8b16c2"><enum>(i)</enum><text>notwithstanding

				paragraph (2), rent for a unit shall be in an amount that is not less than the

				costs to operate the unit;</text>

										</clause><clause id="IDc4fd9e8fb3e74c0abece9eeac11c8d7d"><enum>(ii)</enum><text>if an eligible

				family applies for residence after an over-income family moves in to the last

				available unit, the over-income family shall vacate the unit in accordance with

				notice of termination of tenancy provided by the agency, which shall be

				provided not less than 30 days before such termination; and</text>

										</clause><clause id="ID2e01699018b44181b0e29c7bd1c2fd89"><enum>(iii)</enum><text>if a unit is

				vacant and there is no one on the waiting list, the public housing agency may

				allow an over-income family to gain immediate occupancy in the unit, while

				simultaneously providing reasonable public notice and outreach with regard to

				availability of the unit.</text>

										</clause></subparagraph></paragraph><paragraph id="ID4de277ce2e3a457c9034a17dea7b8eae"><enum>(7)</enum><header>Escrow savings

				accounts</header>

									<subparagraph id="id1B72EAF653FD453FA07765709921FAE9"><enum>(A)</enum><header>In

				general</header><text>A public housing agency may establish escrow savings

				accounts for any family residing in a public housing dwelling unit as an

				incentive to encourage savings.</text>

									</subparagraph><subparagraph id="idE8F0F0A657F54E93B0B49677CE352B12"><enum>(B)</enum><header>Matching</header><text>Escrow

				savings accounts may be matched with any other public or private funds.</text>

									</subparagraph></paragraph></subsection><subsection id="IDe88e3db9c81146abb0998746b591c3e8"><enum>(b)</enum><header>Definition of

				terms under this section</header><text>As used in this section, the following

				definitions shall apply:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id6D341276CD8847A085C78E3F08A1C017"><enum>(1)</enum><header>Disabled

				family</header><text display-inline="yes-display-inline">Except as otherwise

				provided in law, the term <term>disabled family</term> means a family whose

				head, spouse, or sole member is a person with disabilities, including 2 or more

				persons who are persons with disabilities living together.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBECAEA6750B7401EB7969A1707CC5F56"><enum>(2)</enum><header>Elderly

				family</header><text display-inline="yes-display-inline">Except as otherwise

				provided, the term <term>elderly family</term> means a family whose head,

				spouse, or sole member is a person who is at least 62 years of age, including 2

				or more persons who are at least 62 years of age living together.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B461B6EB924415A80A3493A4A3DB025"><enum>(3)</enum><header>Family</header><text display-inline="yes-display-inline">The term <term>family</term> means a person

				or group of persons, as determined by the public housing agency, approved to

				reside in a unit receiving assistance under this title.</text>

								</paragraph><paragraph id="ID149756fd60334286aaf3574be9ee6d21"><enum>(4)</enum><header>Income</header><text>The

				term <term>income</term> means income from all sources of each member of the

				household without deductions or exclusions, notwithstanding any other

				provisions of law, except where a public housing agency has approved deductions

				or exclusions.</text>

								</paragraph><paragraph id="ID47c0f38e695f419fba7b3fb0f426423e"><enum>(5)</enum><header>Police

				officer</header><text>The term <term>police officer</term> means any person

				determined by a public housing agency to be, during the period of residence of

				that person in public housing, employed on a full-time basis as a duly licensed

				professional police officer by a Federal, State, or local government or by any

				agency thereof (including a public housing agency having an accredited police

				force).</text>

								</paragraph><paragraph id="id7960E24DE5864C63A655F70A383DFCD5"><enum>(6)</enum><header>Public housing

				agency</header><text>The term <term>public housing agency</term> means—</text>

									<subparagraph id="idEB24BB5AB2BA442588F7047A1C80B93C"><enum>(A)</enum><text>any State,

				county, municipality, or other governmental entity or public body (or agency or

				instrumentality thereof) which is authorized to engage in or assist in the

				development or operation of low-income housing; or</text>

									</subparagraph><subparagraph id="id39D4A87DCE3A4E48AA75983F6123F19F"><enum>(B)</enum><text>any other entity

				designated by the Secretary to administer assistance under this title in

				jurisdictions where—</text>

										<clause commented="no" display-inline="no-display-inline" id="idEE8FFA1C540C42A9B8602D7F3E28D90A"><enum>(i)</enum><text>no public housing

				agency has been organized; or</text>

										</clause></subparagraph></paragraph><paragraph id="IDc7be92cf80a34c26b2d83c93e2262f31"><enum>(7)</enum><header>Over-income

				family</header><text>The term <term>over-income family</term> means an

				individual or family that is not a low-income family.</text>

								</paragraph></subsection><subsection id="IDbdc20a9763ea4c49a7bdad193bf08f7a"><enum>(c)</enum><header>Availability of

				income matching information</header><text>A public housing agency shall require

				any family residing in a public housing dwelling unit who receives information

				regarding income, earnings, wages, or unemployment compensation from the

				Department of Housing and Urban Development pursuant to income verification

				procedures of the Department to disclose such information, upon receipt of the

				information, to the public housing agency that owns or operates the public

				housing dwelling unit in which such family

				resides.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDb2c7a2d9ad4640edadf87c948912d68b"><enum>(c)</enum><header>Technical and

			 conforming amendments</header><text>The United States Housing Act of 1937 (42

			 U.S.C. 1437 et seq.) is amended—</text>

					<paragraph id="id9C8FA2E3E7C74D2C9E9C1EDC07EFB378"><enum>(1)</enum><text>in section 16(a)

			 (42 U.S.C. 1437n), as amended by this Act, by striking paragraph (3) and by

			 redesignating paragraph (4) as paragraph (3); and</text>

					</paragraph><paragraph id="IDb8967c7f427440ef922da4b3327779f2"><enum>(2)</enum><text>in section 23 (42

			 U.S.C. 1437u)—</text>

						<subparagraph id="idE4919CBE784945859DBE55971E37D3CD"><enum>(A)</enum><text>by striking

			 subsection (d) and inserting the following:</text>

							<quoted-block display-inline="no-display-inline" id="id4D7B983D2CAD446BAD91458EB052EF40" style="OLC">

				public housing agency carrying out a local program under this section shall

				establish a plan to offer incentives to families to encourage families to

				participate in the

				program.</text>

						</subparagraph><subparagraph id="id35315FF5B4D64CC28D8460F634ABCCD7"><enum>(B)</enum><text>by striking

			 subsection (e); and</text>

						</subparagraph><subparagraph id="ID80b5b1a9151c448bb1ba93ec8d946cc7"><enum>(C)</enum><text>by redesignating

			 subsections (f) through (o) as subsections (e) through (n),

			 respectively.</text>

						</subparagraph></paragraph></subsection></section></title><title id="id18D8E58C426A47CA9EF79687D62AEEF0"><enum>III</enum><header>Moving to work

			 program</header>

			<section id="ID78f077a2c1fb4d2ca523e31408d9d374"><enum>301.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This title may be cited

			 as the <quote>Moving to Work Program Act of 2005</quote>.</text>

			</section><section id="IDe5c04fca5d994f3ab257f07e7df5f5d2"><enum>302.</enum><header>Moving to work

			 program</header>

				<subsection id="IDcae69ba615334a8d877e3f0b35b9afbf"><enum></enum><text>The United

			 States Housing Act of 1937 (42 U.S.C. 1437) is amended by adding at the end the

			 following new section:</text>

					<quoted-block display-inline="no-display-inline" id="id5E7F9D037FD64664AB4E48EBF188F703" style="OLC">

						<section id="IDde1dccf4f1d74618a7d66660eed403a6"><enum>36.</enum><header>Moving to work

				program</header>

							<subsection id="ID3f19649943ce454fa96ed242d4431b50"><enum>(a)</enum><header>Purposes</header><text>The

				purposes of the program established under this title are—</text>

								<paragraph id="IDe43fe31d32e440ec9eb07ee9cad942cd"><enum>(1)</enum><text>to give

				incentives to families to become self-sufficient;</text>

								</paragraph><paragraph id="ID02c7458b030f49328c14420d2a886e2c"><enum>(2)</enum><text>to give public

				housing agencies and the Secretary flexibility to develop approaches for

				providing and administering housing assistance that achieve greater

				cost-effectiveness in Federal expenditures;</text>

								</paragraph><paragraph id="ID0a298977e796456b998622ce8ec8f9ac"><enum>(3)</enum><text>to increase

				housing opportunities for low-income families;</text>

								</paragraph><paragraph id="ID72356f91b08346ea8c06f4094fbaeb8c"><enum>(4)</enum><text>to reduce

				administrative burdens on public housing agencies in providing housing

				assistance; and</text>

								</paragraph><paragraph id="IDcffdf89fc90744f69af924198c706106"><enum>(5)</enum><text>to allow Federal

				resources to be more effectively utilized at the local level.</text>

								</paragraph></subsection><subsection id="ID563eee7b14734262b15072035804f35c"><enum>(b)</enum><header>Program

				authority</header>

								<paragraph id="IDbd298656d64f4706a73b7ea7ed33e7d8"><enum>(1)</enum><header>In

				general</header><text>The Secretary shall establish the Moving to Work Program

				(in this title referred to as the <quote>Program</quote>), in which public

				housing agencies meeting the eligibility criteria under subsection (c) may

				participate.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea8247856c844e4e927aa8da3d9e886a"><enum>(2)</enum><header>Use of

				assistance</header><text>Under the Program a public housing agency may combine

				operating assistance provided under section 9(e), modernization assistance

				provided under section 9(d), and assistance provided under the Flexible Voucher

				Act of 2005, to provide housing assistance for low-income families, and

				services to facilitate the transition to work.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA41660743B1848ADA10F764532B45387"><enum>(3)</enum><header>Authority of

				secretary</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="id79D5BA9C072F415290012717E076BBCF"><enum>(A)</enum><header>Waiver</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

				except as provided in subsection (e), the Secretary may waive any provision of

				this Act with respect to assistance under the Program under this title.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDCC092533F274EDD932FD0B2FED7167D"><enum>(B)</enum><header>Additional

				powers</header><text display-inline="yes-display-inline">The Secretary may, as

				the Secretary determines appropriate to further the purposes of this

				section—</text>

										<clause commented="no" display-inline="no-display-inline" id="idA337F82520A3437CACB2A31DE5A3C9AE"><enum>(i)</enum><text display-inline="yes-display-inline">provide streamlined procedures including

				procurement procedures; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="idE471E427D75C454AA25B72576F406595"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to paragraph (2), may provide for

				immediate implementation of such procedures.</text>

										</clause></subparagraph></paragraph></subsection><subsection id="ID88300fe6b4ec47ecb71185b5410abc79"><enum>(c)</enum><header>Eligibility</header><text>A

				public housing agency may submit an application, in such form as prescribed by

				the Secretary, under this title to participate in the Program if such public

				housing agency—</text>

								<paragraph id="ID7bba650f41114673bc16015bd4684872"><enum>(1)</enum><text>participates at

				the time of the submission in the Moving to Work Demonstration established

				under section 101(e) of the Departments of Veterans Affairs and Housing and

				Urban Development, and independent Agencies Appropriations Act, 1996 (Public

				Law 104–134; 110 Stat. 1321–281; 42 U.S.C. 1437f note);</text>

								</paragraph><paragraph id="ID29250042645c425abfd412883650fa9c"><enum>(2)</enum><text>is designated at

				the time of submission as a high performer under the applicable assessment

				systems that evaluate a public housing agency’s performance, if any, with

				respect to its public housing and voucher programs;</text>

								</paragraph><paragraph id="id812B69644BE841F3AA6217D763AE18ED"><enum>(3)</enum><text>manages at least

				500 units of public housing pursuant to contracts for annual

				contributions;</text>

								</paragraph><paragraph id="id59EA453738E5418CBDAD350691111398"><enum>(4)</enum><text>administers at

				least 500 vouchers under the Flexible Voucher Act of 2005; or</text>

								</paragraph><paragraph id="IDbf62b27c62404af1a7eef64250c42e30"><enum>(5)</enum><text>meets other

				criteria as determined by the Secretary, including the public housing

				agency’s—</text>

									<subparagraph id="ID2473d0ac2e4742db8d34dab5602e9544"><enum>(A)</enum><text>demonstrated

				capacity to develop and manage a successful Program;</text>

									</subparagraph><subparagraph id="ID9a8cc93e0f084cb3a6c878be2157e7e7"><enum>(B)</enum><text>demonstrated

				compliance with statutes and regulations applicable to Department of Housing

				and Urban Development programs in which the public housing agency participates

				or has participated;</text>

									</subparagraph><subparagraph id="ID9e951aacbfac4646852b3d9ac1f62283"><enum>(C)</enum><text>commitment of

				non-Federal resources, including resources from the local community; and</text>

									</subparagraph><subparagraph id="ID45859f6f31de4784b3aca4ad746e027e"><enum>(D)</enum><text>demonstrated

				commitment of units of local government serving the areas within which the

				public housing agency administers its Program, on removing regulatory barriers

				to affordable housing.</text>

									</subparagraph></paragraph></subsection><subsection id="IDc2e689c31622492ab9d967346e7b4cac"><enum>(d)</enum><header>Program

				requirements</header><text>A public housing agency that is administering a

				Program pursuant to this section shall, as a condition of continued

				participation in the Program—</text>

								<paragraph id="ID58113e7014bc4d34bb0354d09b1db3fe"><enum>(1)</enum><text>consult with

				representatives of the community that represent a broad range of the various

				interests that are affected by the Program;</text>

								</paragraph><paragraph id="ID5ee0e23ecaa64c87a5e0b5f03f864e0f"><enum>(2)</enum><text>target, for

				purposes of the Program, not fewer than 90 percent of families authorized in

				the Program under this section to receive assistance, who have gross incomes

				that do not exceed 60 percent of the median income for the area, as determined

				by the Secretary, with adjustments for smaller or larger families;</text>

								</paragraph><paragraph id="ID55992c093df549daad8324a10899a232"><enum>(3)</enum><text>establish a

				reasonable rent policy, in accordance with section 3A, which is designed to

				encourage employment and self-sufficiency by participating families;</text>

								</paragraph><paragraph id="IDc7cd8a77ef2a48e583d28a68e0c30f32"><enum>(4)</enum><text>assure that

				housing assisted under the Program meets housing standards established or

				approved by the Secretary; and</text>

								</paragraph><paragraph id="ID0eee106ece704e8c8083e344486259a6"><enum>(5)</enum><text>provide such

				additional information as determined by the Secretary.</text>

								</paragraph></subsection><subsection id="IDbf8ea1d6940e4aacaa4a244f3806142e"><enum>(e)</enum><header>Applicability

				of section 18 provisions</header><text>Section 18 shall continue to apply to

				public housing notwithstanding any use of the housing under the Program.</text>

							</subsection><subsection id="ID2452b59f58b14337af82b58e6b6843b3"><enum>(f)</enum><header>Effect on

				section 8, operating subsidies, and comprehensive grant program

				allocations</header><text>The amount of assistance received under section 8,

				section 9, or the Flexible Voucher Act of 2005, by a public housing agency

				participating in the Program shall, subject to appropriations, not be affected

				by its participation in the Program.</text>

							</subsection><subsection id="ID119b29c56c5f4bec9281f56af7c7ce8b"><enum>(g)</enum><header>Effect on

				current participants in moving to work demonstration</header><text>Subject to

				such procedures and requirements as the Secretary may establish—</text>

								<paragraph id="ID4c19abb270e14332ad053d0db04e80ae"><enum>(1)</enum><text>a public housing

				agency participating in the Moving to Work Demonstration referred to in

				subsection (c)(1) may opt out of the demonstration and the requirements

				governing the demonstration, and continue to operate its demonstration as part

				of the Program in accordance with the requirements of this section; or</text>

								</paragraph><paragraph id="IDc814ef0f3ab94bf5989947f893245440"><enum>(2)</enum><text>a public housing

				agency that will terminate its participation in the Moving to Work

				Demonstration referred to in subsection (c)(1) in 2005 or 2006 may renew and

				extend its participation in the demonstration for an additional 3 years, and

				may apply for participation in the Program at the end of the 3-year

				period.</text>

								</paragraph></subsection><subsection id="ID59d6837966a340adaf7825c20a1c2f8b"><enum>(h)</enum><header>Evaluation of

				performance</header>

								<paragraph id="ID3ee48aac49a34f7da524cee05fe54a64"><enum>(1)</enum><header>In

				general</header><text>Subject to paragraph (2), a public housing agency’s

				performance in the Moving to Work Demonstration referred to in subsection

				(c)(1) and the Program under this section shall be assessed under the

				applicable assessment systems that evaluate a public housing agency’s

				performance with respect to its public housing and voucher programs, including

				section 6(j), for a period not to extend beyond January 1, 2008, or under such

				other assessment systems as may be designed by the Secretary to evaluate the

				Program.</text>

								</paragraph><paragraph id="ID4d1ae58d299a4407a700a863b06f4c5c"><enum>(2)</enum><header>Performance

				standards</header>

									<subparagraph id="IDf82045496f814742bc0236d1c0b53659"><enum>(A)</enum><header>Issuance of

				rules</header><text>The Secretary shall, for the purposes of designing and

				implementing performance standards for public housing agencies participating in

				the Program under this section, issue a proposed rule and a final rule

				implementing performance standards under this section.</text>

									</subparagraph><subparagraph id="idF053618C009D413F814FADB062F7E865"><enum>(B)</enum><header>Timing</header><text>The

				final rule required under subparagraph (A) shall be issued not later than 24

				months after the date of enactment of this title.</text>

									</subparagraph><subparagraph id="IDa3ae33bcfa404e778d4bd1bd6cd1d28a"><enum>(C)</enum><header>Standards</header><text>Performance

				standards issued by the Secretary under subparagraph (A) may include standards

				for—</text>

										<clause id="ID1020013f33454c0c9c3aa512c066323b"><enum>(i)</enum><text>moving assisted

				low-income families to economic self-sufficiency;</text>

										</clause><clause id="ID28d036352658437dbf0f730b424938ee"><enum>(ii)</enum><text>reducing the

				per-family cost of providing housing assistance;</text>

										</clause><clause id="IDdaae027b04af435bbac905e09b82ef74"><enum>(iii)</enum><text>expanding

				housing choices for low-income families;</text>

										</clause><clause id="ID527a76a290fd42e0aa242c61320e205a"><enum>(iv)</enum><text>improving

				Program management;</text>

										</clause><clause id="IDbf01f616a37f4264b3bfa8bbbf100bfd"><enum>(v)</enum><text>increasing the

				number of homeownership opportunities for low-income families; and</text>

										</clause><clause id="IDfc96264c2323443293ffa33dee18a126"><enum>(vi)</enum><text>any other

				performance goals that they Secretary may establish.</text>

										</clause></subparagraph></paragraph></subsection><subsection id="ID3e3f809ea03947dcba3f3b861e327ec1"><enum>(i)</enum><header>Recordkeeping,

				reports, and audits</header>

								<paragraph id="ID8e4158b2fa3e4adf84fca9701946ab08"><enum>(1)</enum><header>Recordkeeping</header><text>Each

				public housing agency participating in the Program shall keep such records as

				the Secretary may prescribe as reasonably necessary to disclose the amounts and

				the disposition of amounts under the Program, to ensure compliance with the

				requirements of this section, and to measure performance.</text>

								</paragraph><paragraph id="ID1ee6c885f2884741bd3c3b4e355a12c4"><enum>(2)</enum><header>Reports</header><text>Each

				such agency shall submit to the Secretary a report, or series of reports, in a

				form and at a time specified by the Secretary.</text>

								</paragraph><paragraph id="ID67fbcb782a174b12b2e79541013ec35a"><enum>(3)</enum><header>Access to

				documents by the secretary</header><text>The Secretary shall have access for

				the purpose of audit and examination to any books, documents, papers, and

				records that are pertinent to assistance in connection with, and the

				requirements of, this section.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID184e0b08242a46cdbc819fd8a3833a08"><enum>(4)</enum><header>Access to

				documents by the comptroller general</header><text>The Comptroller General of

				the United States, or any of the duly authorized representatives of the

				Comptroller General, shall have access for the purpose of audit and examination

				to any books, documents, papers, and records that are pertinent to assistance

				in connection with, and the requirements of, this

				section.</text>
