					<text display-inline="yes-display-inline">the Corps of Engineers is the

			 primary Federal agency responsible for developing and managing the harbors,

			 waterways, shorelines, and water resources of the United States;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4E18916C5FD4469EA8ED185DBBF3BEBB">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">the scarcity of Federal

			 resources requires more efficient use of Corps resources and funding, and

			 greater oversight of Corps analyses;</text>

					<text display-inline="yes-display-inline">appropriate cost sharing

			 ensures efficient measures of project demands and enables the Corps to meet

			 more national project needs;</text>

					<text display-inline="yes-display-inline">the significant demand for

			 recreation, clean water, and healthy wildlife habitat must be fully reflected

			 in the project planning and construction process of the Corps;</text>

					<enum>(5)</enum>

					<text display-inline="yes-display-inline">the human health,

			 environmental, and social impacts of dams, levees, shoreline stabilization

			 structures, river training structures, river dredging, and other Corps projects

			 and activities must be adequately considered and, in any case in which adverse

			 impacts cannot be avoided, fully mitigated;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49DBA65161F141A5B2877A288B8D4524">

					<enum>(6)</enum>

					<text display-inline="yes-display-inline">the National Academy of

			 Sciences has concluded that the Principles and Guidelines for water resources

			 projects need to be modernized and updated to reflect current economic

			 practices and environmental laws and planning guidelines; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC98010E6342A4CDCBA55DEA42BDF4A39">

					<enum>(7)</enum>

					<text display-inline="yes-display-inline">affected interests must have

			 access to information that will allow those interests to play a larger and more

			 effective role in the oversight of Corps project development and

			 mitigation.</text>

				<enum>(b)</enum>

				<header>Purposes</header>

				<text display-inline="yes-display-inline">The purposes of this Act

			 are—</text>

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">to ensure that the water

			 resources investments of the United States are economically justified and

			 enhance the environment;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID23C5EF5C42BD4703914DCC6720CF24D3">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">to provide independent review

			 of feasibility studies, general reevaluation studies, and environmental impact

					<text display-inline="yes-display-inline">to ensure that environmental

			 protection and restoration, and national economic development, are co-equal

			 goals, and given co-equal emphasis, during the evaluation, planning, and

			 construction of Corps projects;</text>

					<text display-inline="yes-display-inline">to ensure that project

			 planning, project evaluations, and project recommendations of the Corps are

			 based on sound science and economics and on a full evaluation of the impacts to

			 the health of aquatic ecosystems; and</text>

					<enum>(9)</enum>

					<text display-inline="yes-display-inline">to ensure that the

			 determination of benefits and costs of Corps projects properly reflects current

			 law and Federal policies designed to protect human health and the

			 environment.</text>

				<text display-inline="yes-display-inline">The term <term>Academy</term>

			 means the National Academy of Sciences.</text>

			 Control Act of 1970 (42 U.S.C. 1962–2) is amended to read as follows:</text>

				Congress that—</text>

				development and environmental protection and restoration are co-equal

				objectives of water resources project planning and management; and</text>

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">Federal agencies manage

				and, if clearly justified, construct water resource projects—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDECC3F545C9904B16A75B5FBE4614052D">

										<enum>(A)</enum>

										<text display-inline="yes-display-inline">to meet national economic

				needs; and</text>

				environment.</text>

								<header>Revision of planning guidelines, regulations and

				circulars</header>

								<text display-inline="yes-display-inline">Not later than 18 months

				after the date of enactment of the Corps of Engineers Modernization and

				Improvement Act of 2005, the Secretary, in collaboration with the National

				Academy of Sciences, shall develop proposed revisions of, and revise, the

				planning guidelines, regulations, and circulars of the Corps.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID582A5CBE790F4040A0C33AC2A3D6D94D">

								<enum>(c)</enum>

								<header>Additional requirements</header>

								<text display-inline="yes-display-inline">Corps planning regulations

				revised under subsection (b) shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID4B93DE847B394BEFB728825DEB44529C">

									<enum>(1)</enum>

									<text display-inline="yes-display-inline">incorporate new and

				existing analytical techniques that reflect the probability of project benefits

				and costs;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFC0F5DDF43CF49C1900DF32BC9AD0203">

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">apply discount rates

				provided by the Office of Management and Budget;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05785CAC55DF4938A69C31E268C62F16">

									<enum>(3)</enum>

									<text display-inline="yes-display-inline">eliminate biases and

				disincentives that discourage the use of nonstructural approaches to water

				resources development and management;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD15E4AF5485D48B1A3D94DF80E2C5F80">

									<enum>(4)</enum>

									<text display-inline="yes-display-inline">encourage, to the maximum

				extent practicable, the restoration of ecosystems through the restoration of

				hydrologic and geomorphic processes;</text>

									<enum>(5)</enum>

									<text display-inline="yes-display-inline">consider the costs and

				benefits of protecting or degrading natural systems;</text>

									<enum>(6)</enum>

									<text display-inline="yes-display-inline">ensure that projects are

				justified by benefits that accrue to the public at large;</text>

									<enum>(7)</enum>

									<text display-inline="yes-display-inline">ensure that benefit-cost

				calculations reflect a credible schedule for project construction;</text>

									<enum>(8)</enum>

									<text display-inline="yes-display-inline">ensure that each project

				increment complies with section 104;</text>

									<text display-inline="yes-display-inline">include as a cost any

				increase in direct Federal payments or subsidies and exclude as a benefit any

								<enum>(d)</enum>

								<header>National navigation and port plan</header>

								<paragraph commented="no" display-inline="no-display-inline" id="IDC51AC5DA76DC477FB79D07084EB44BAC">

									<enum>(1)</enum>

									<header>In general</header>

									<text display-inline="yes-display-inline">Not later than 18 months

				after the date of enactment of the Corps of Engineers Modernization and

				Improvement Act of 2005, the Corps shall develop, and update not less

				frequently than every 4 years, an integrated, national plan to manage,

				rehabilitate and, if justified, modernize inland waterway and port

				infrastructure to meet current national economic and environmental

				needs.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9BD02EE5D8C14F97966A99F3910C4C33">

									<enum>(2)</enum>

									<header>Tools</header>

									<text display-inline="yes-display-inline">To develop the plan, the

				Corps shall employ economic tools that—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID2F8B29D44EA648DDBA896AF77A5831E1">

										<enum>(A)</enum>

										<text display-inline="yes-display-inline">recognize the importance of

				alternative transportation destinations and modes; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID08000B735FE24BFF964A7E271A3C3417">

										<enum>(B)</enum>

										<text display-inline="yes-display-inline">employ practicable,

				cost-effective congestion management alternatives before constructing and

				expanding infrastructure to increase waterway and port capacity.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD57CFC238050455AA9CFF288618EFA1B">

									<enum>(3)</enum>

									<header>Benefits and proximity</header>

									<text display-inline="yes-display-inline">The Corps shall give

				particular consideration to the benefits and proximity of proposed and existing

				port, harbor, waterway, rail and other transportation infrastructure in

				determining whether to construct new water resources projects.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID590BD2809B464F27A55DCA3429D19A7D">

								<enum>(e)</enum>

								<header>Notice and comment</header>

								<text display-inline="yes-display-inline">The Secretary shall comply

				with the notice and comment provisions of chapter 551 of title 5, United States

				Code, in issuing revised planning regulations, guidelines and circulars.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8849065D6F364109A45AF016B9F6F289">

								<enum>(f)</enum>

								<header>Applicability</header>

								<text display-inline="yes-display-inline">On completion of the

				revisions required under this section, the Secretary shall apply the revised

				regulations to projects for which a draft feasibility study or draft

				reevaluation report has not yet been issued.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID926B0BB094D445299B373D4914207C60">

								<enum>(g)</enum>

								<header>Project reformulation</header>

								<text display-inline="yes-display-inline">Projects of the Corps, and

				separable elements of projects of the Corps, that have been authorized for 10

				years, but for which less than 15 percent of appropriations specifically

				identified for construction have been obligated, shall not be constructed

				unless a general reevaluation study demonstrates that the project or separable

				element meets—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID7B5F8288BB4B4AA488D82DDA54C7A3FE">

									<enum>(1)</enum>

									<text display-inline="yes-display-inline">all project criteria and

				requirements applicable at the time the study is initiated, including

				requirements under this section; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43768CD623D9467E97133DB548BD6B30">

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">cost share and mitigation

				requirements of this Act.</text>

					<header>Conforming amendments</header>

						<header>Affected state</header>

						<text display-inline="yes-display-inline">The term <term>affected

			 State</term>, with respect to a water resources project, means a State or

			 portion of a State that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID0EA1FF1FC97B47E39B221109398A1B94">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">is located, at least

			 partially, within the drainage basin in which the project is carried out;

						<header>Director</header>

						<text display-inline="yes-display-inline">The term

			 <term>Director</term> means the Director of Independent Review appointed under

			 subsection (c)(1).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB7444732D73C47059D9738E3186906BD">

					<enum>(b)</enum>

					<header>Projects subject to independent review</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDA02783DDC96248E39809954428687809">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">The Secretary shall ensure

			 that each feasibility report, general reevaluation report, and environmental

			 impact statement for each water resources project described in paragraph (2) is

			 subject to review by an independent panel of experts established under this

			 section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID56F831C5D4F44430835E18B01879837C">

						<enum>(2)</enum>

						<header>Projects subject to review</header>

						<text display-inline="yes-display-inline">A water resources project

			 shall be subject to review under paragraph (1) if—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID0E9B6D9CB3DD4BC5AEEFED736762B84D">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">the project has an estimated

			 total cost of more than $25,000,000, including mitigation costs;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4CF22CFCF7744128B699C568FCCA7A4F">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">the Governor of an affected

			 State requests the establishment of an independent panel of experts for the

			 project;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE89A7853B76C488285EA38C70B532629">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">the head of a Federal agency

			 charged with reviewing the project determines that the project is likely to

			 have a significant adverse impact on environmental, cultural, or other

			 resources under the jurisdiction of the agency; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D1A87DA2B0E4BC6931B197A274F6B0D">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">the Secretary determines

			 under paragraph (3) that the project is controversial.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE4B948F286D24797B4BEB52DDF5C8BEF">

						<enum>(3)</enum>

						<header>Controversial projects</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID3E34186E8C634276B37C37819F1EF3CD">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">The Secretary shall determine

			 that a water resources project is controversial for the purpose of paragraph

			 (2)(D) if the Secretary finds that—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDB4E736978FFF498DBB17D4B734E5CBC6">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">there is a significant

			 dispute as to the size, nature, or effects of the project;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDA42B28304D4440DDAE175E0540245F30">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">there is a significant

			 dispute as to the economic or environmental costs or benefits of the project;

			 or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID475392AD9AE24B99A766B99CE9FA2749">

								<enum>(iii)</enum>

								<text display-inline="yes-display-inline">there is a significant

			 dispute as to the benefits to the communities affected by the project of a

			 project alternative that—</text>

								<subclause commented="no" display-inline="no-display-inline" id="ID25D58E2D38724D09A5AE76D32E55AF80">

									<enum>(I)</enum>

									<text display-inline="yes-display-inline">was not the focus of the

			 feasibility report, general reevaluation report, or environmental impact

			 statement for the project; or</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7ADF01A88BE94F5A842B959A82BEE955">

									<enum>(II)</enum>

									<text display-inline="yes-display-inline">was not considered in the

			 feasibility report, general reevaluation report, or environmental impact

			 statement for the project.</text>

								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5C9BCD9AE6C2498CBAA3AB9F5A419B47">

							<enum>(B)</enum>

							<header>Written requests</header>

							<text display-inline="yes-display-inline">Not later than 30 days after

			 the date on which the Secretary receives a written request of any party, or on

			 the initiative of the Secretary, the Secretary shall determine whether a

			 project is controversial.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7F04123CC4B64BC1BAB666B9C3E9E4B2">

					<enum>(c)</enum>

					<header>Director of Independent Review</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID9A36EE72692C4D11BFB0746C19878F04">

						<enum>(1)</enum>

						<header>Appointment</header>

						<text display-inline="yes-display-inline">The Inspector General of the

			 Army shall appoint in the Office of the Inspector General of the Army a

			 Director of Independent Review.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76A6A06FE43F466ABEF9E2987A525F71">

						<enum>(2)</enum>

						<header>Qualifications</header>

						<text display-inline="yes-display-inline">The Inspector General of the

			 Army shall select the Director from among individuals who are distinguished

			 experts in biology, hydrology, engineering, economics, or another discipline

			 relating to water resources management.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID393C9C5556AE47D781640D3852F95068">

						<enum>(3)</enum>

						<header>Limitation on appointments</header>

						<text display-inline="yes-display-inline">The Inspector General of the

			 Army shall not appoint an individual to serve as the Director if the individual

			 has a financial interest in or close professional association with any entity

			 with a financial interest in a water resources project that, on the date of

			 appointment of the Director, is—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDE8996DA23EC7427397B426B91E29826A">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">under construction;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3EF69E07C9024DBF95628A2C4DFE1427">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">in the preconstruction

			 engineering and design phase; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID04398DE3104E4C9D80170412DDE30DA5">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">under feasibility or

			 reconnaissance study by the Corps.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB7324C98CB1D4552960F2A02CF086551">

						<enum>(4)</enum>

						<header>Terms</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC6D8CC69729B482DBC98E0F371ECBBEB">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">The term of a Director

			 appointed under this subsection shall be 6 years.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9FB384CCD2B6430694EE26CCDAB1E481">

							<enum>(B)</enum>

							<header>Term limit</header>

							<text display-inline="yes-display-inline">An individual may serve as

			 the Director for not more than 2 nonconsecutive terms.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID17ABEB2A3927453E8004747345D8C01B">

						<enum>(5)</enum>

						<header>Duties</header>

						<text display-inline="yes-display-inline">The Director shall establish

			 a panel of experts to review each water resources project that is subject to

			 review under subsection (b).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID433CB2D88CD342A7A0AD24C683F27BC1">

					<enum>(d)</enum>

					<header>Establishment of panels</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID542E912CB41D4727BC38170C5F9E2589">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">After the Secretary selects a

			 preferred alternative for a water resources project subject to review under

			 subsection (b) in a formal draft feasibility report, draft general reevaluation

			 report, or draft environmental impact statement, the Director shall establish a

			 panel of experts to review the project.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36EADC342DAD4867AE80538F0D1687FF">

						<enum>(2)</enum>

						<header>Membership</header>

						<text display-inline="yes-display-inline">A panel of experts

			 established by the Director for a project shall be composed of not less than 5

			 nor more than 9 independent experts (including 1 or more biologists,

			 hydrologists, engineers, and economists) who represent a range of areas of

			 expertise.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBAEC13FFE44C42DA8616FCCA7250AC5F">

						<enum>(3)</enum>

						<header>Limitation on appointments</header>

						<text display-inline="yes-display-inline">The Director shall not

			 appoint an individual to serve on a panel of experts for a project if the

			 individual has a financial interest in or close professional association with

			 any entity with a financial interest in the project.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDFE25626FF7D485484AE875A153AC645">

						<enum>(4)</enum>

						<header>Consultation</header>

						<text display-inline="yes-display-inline">The Director shall consult

			 with the Academy in developing lists of individuals to serve on panels of

			 experts under this section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6E7EBFA078D4970981CD2B29BA5BB55">

						<enum>(5)</enum>

						<header>Notification</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDCAC797970A6142F4811248A929FC1F75">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">To ensure that the Director

			 is able to effectively carry out the duties of the Director under this section,

			 the Secretary shall notify the Director in writing not later than 90 days

			 before the release of a draft feasibility report, draft general reevaluation

			 report, or draft environmental impact statement, for every water resources

			 project.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE5E11A73996D433C847AB3C8840A7F8D">

							<enum>(B)</enum>

							<header>Contents</header>

							<text display-inline="yes-display-inline">The notification shall

			 include—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID6CAF43ED0068445C991D97C5401DAC1F">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">the estimated cost of the

			 project; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDD1E8CE0AF05E47E1A0C613FF417F2C07">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">a preliminary assessment of

			 whether a panel of experts may be required.</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0D47F72ED8584A5EABDF3B33D4B1D4AA">

						<enum>(6)</enum>

						<header>Compensation</header>

						<text display-inline="yes-display-inline">An individual serving on a

			 panel of experts under this section shall be compensated at a rate of pay to be

			 determined by the Inspector General of the Army.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC31D78946C62487B8F879065C8808243">

						<enum>(7)</enum>

						<header>Travel expenses</header>

						<text display-inline="yes-display-inline">A member of a panel of

			 experts under this section shall be allowed travel expenses, including per diem

			 in lieu of subsistence, at rates authorized for an employee of an agency under

			 subchapter I of chapter 57 of title 5, United States Code, while away from the

			 home or regular place of business of the member in the performance of the

			 duties of the panel.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5D0ABEAC8A7C47DF82F4FA112F7EAEFD">

					<enum>(e)</enum>

					<header>Duties of panels</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID2EE07000108C45F9A2DD07B5EB5E9FEB">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">A panel of experts

			 established for a water resources project under this section shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID5A60110F5C9F4283846879C8D18433D4">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">review each draft feasibility

			 report, draft general reevaluation report, and draft environmental impact

			 statement prepared for the project;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD256D4272F234BBDBEC74413FA4A2EC5">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">assess the adequacy of the

			 economic, scientific, and environmental models used by the Secretary in

			 reviewing the project to ensure that—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID4A8C3ED025E9432B8A8A09308559B6FE">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">the best available economic

			 and scientific methods of analysis have been used;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID250AD24DF6A34526B591A9466398EB39">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">the best available economic,

			 scientific, and environmental data have been used; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID3A487CB1E8184AA395ACF64E7D11D4AB">

								<enum>(iii)</enum>

								<text display-inline="yes-display-inline">any regional effects on

			 navigation systems have been examined;</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4A67D8FD6200415296B687F1A79ADA18">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">receive from the public

			 written and oral comments concerning the project;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1482F2519B994BB5AE77B69D349BAB07">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">not later than the deadline

			 established under subsection (f), submit to the Secretary a report concerning

			 the economic, engineering, and environmental analyses of the project, including

			 the conclusions of the panel, with particular emphasis on areas of public

			 controversy, with respect to the feasibility report, general reevaluation

			 report, or environmental impact statement; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD311DDF5EB4C4D958C527D60144C3F40">

							<enum>(E)</enum>

							<text display-inline="yes-display-inline">not later than 30 days after

			 the date of issuance of a final feasibility report, final general reevaluation

			 report, or final environmental impact statement, submit to the Secretary a

			 brief report stating the views of the panel on the extent to which the final

			 analysis adequately addresses issues or concerns raised by each earlier

			 evaluation by the panel.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF145D10C132346FBBA09DAB751C24E0D">

						<enum>(2)</enum>

						<header>Extensions</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDA4D3EE71BF2D44F3A971AB744654FD8A">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">The panel may request from

			 the Director a 30-day extension of the deadline established under paragraph

			 (1)(E).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4654318A26614A248880E2C89C0C8F93">

							<enum>(B)</enum>

							<header>Record of decision</header>

							<text display-inline="yes-display-inline">The Secretary shall not issue

			 a record of decision until after, at the earliest—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID9DF1023AF7664F7F9700FE2A71234F0E">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">the final day of the 30-day

			 period described in paragraph (1)(E); or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID7A99EF516D304DC493EE3FA10ACC6231">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">if the Director grants an

			 extension under subparagraph (A), the final day of the 60-day period beginning

			 on the date of issuance of a final feasibility report described in paragraph

			 (1)(E) and ending on the final day of the extension granted under subparagraph

			 (A).</text>

							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7F0611FDF2CF413A9B2C5A11BAD78804">

					<enum>(f)</enum>

					<header>Duration of project reviews</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID7C7DE5A5E5994727AFA3F1929E1093B7">

						<enum>(1)</enum>

						<header>Deadline</header>

						<text display-inline="yes-display-inline">Except as provided in

			 paragraph (2), not later than 180 days after the date of establishment of a

			 panel of experts for a water resources project under this section, the panel

			 shall complete—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID316ACBF692F041BEB6B2FD969599B351">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">each required review of the

			 project; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0BF2491BB4884ED3915082A1D12CEEEF">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">all other duties of the panel

			 relating to the project (other than the duties described in subsection

			 (e)(1)(E)).</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4851019AE6B347D489861A71C6EC58DF">

						<enum>(2)</enum>

						<header>Extension of deadline for report on project reviews</header>

						<text display-inline="yes-display-inline">Not later than 240 days after

			 the date of issuance of a draft feasibility report, draft general reevaluation

			 report, or draft environmental impact statement for a project, if a panel of

			 experts submits to the Director before the end of the 180-day period described

			 in paragraph (1), and the Director approves, a request for a 60-day extension

			 of the deadline established under that paragraph, the panel of experts shall

			 submit to the Secretary a report required under subsection (e)(1)(D).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID23C5A0B7F26D4A1F8066A6E45A885F89">

					<enum>(g)</enum>

					<header>Recommendations of panel</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDEC2097850DF74223B0A44A6978EDE7AD">

						<enum>(1)</enum>

						<header>Consideration by secretary</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID6A888FFFEEB04B8F881BDE79F27D241B">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">If the Secretary receives a

			 report on a water resources project from a panel of experts under this section

			 by the applicable deadline under subsection (e)(1)(E) or (f), the Secretary

			 shall, at least 14 days before entering a final record of decision for the

			 water resources project—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID8081C76C678E4511BEF40247D00CC1F6">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">take into consideration any

			 recommendations contained in the report; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID27DE516A60FF4329A12019900C46EC37">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">prepare a written explanation

			 for any recommendations not adopted.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID59E9C4DDB1AF4C5897566114DC758BF1">

							<enum>(B)</enum>

							<header>Inconsistent recommendations and findings</header>

							<text display-inline="yes-display-inline">Recommendations and findings

			 of the Secretary that are inconsistent with the recommendations and findings of

			 a panel of experts under this section shall not be entitled to deference in a

			 judicial proceeding.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0C683C2C640040C8982ED8AD5190B5CC">

						<enum>(2)</enum>

						<header>Public review; submission to congress</header>

						<text display-inline="yes-display-inline">After receiving a report on a

			 water resources project from a panel of experts under this section (including a

			 report under subsection (e)(1)(E)), the Secretary shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID398899EF83BE4C50B2369A8C47234CBD">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">immediately make a copy of

			 the report (and, in a case in which any written explanation of the Secretary on

			 recommendations contained in the report is completed, shall immediately make a

			 copy of the response) available for public review; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7A91CF7D45B94AB8900A8DFEB6B86147">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">include a copy of the report

			 (and any written explanation of the Secretary) in any report submitted to

			 Congress concerning the project.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID752F37620E714DDAB84332E902ED49AC">

					<enum>(h)</enum>

					<header>Public access to information</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID185E93F32D9D4CDDAB0961C81CDF3F65">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">Except as provided in

			 paragraph (3), the Secretary shall ensure that information relating to the

			 analysis of any water resources project by the Corps, including all supporting

			 data, analytical documents, and information that the Corps has considered in

			 the analysis, is made available—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID2E34616E397B4B6DA68EC9E25545AAFB">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">to any individual upon

			 request;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7E78D91C609B41288B062357DAFD4496">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">to the public on the

			 Internet; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID25C7C44AD79944C19EC6426B8E3B57D9">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">to an independent review

			 panel, if such a panel is established for the project.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD6DE7D3955A4F0B95B6F04494058310">

						<enum>(2)</enum>

						<header>Types of information</header>

						<text display-inline="yes-display-inline">Information concerning a

			 project that is available under paragraph (1) shall include—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDB5FCD9E4217D4FECAAA03718C36BE38B">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">any information that has been

			 made available to the non-Federal interests with respect to the project;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFE4BD7104C844ADA8CFD1CC55D530CFE">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">all data and information used

			 by the Corps in the justification and analysis of the project.</text>

			 information available under paragraph (1) that the Secretary determines to be a

			 trade secret of any person that provided the information to the Corps.</text>

					<header>Costs</header>

						<header>Limitation on cost of review</header>

						<text display-inline="yes-display-inline">The cost of conducting a

			 review of a water resources project under this section shall not exceed—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID8764BD3F10CA42A49ACE7C2EBCEEE2CE">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">$250,000 for a project, if

			 the total cost of the project in current year dollars is less than $50,000,000;

							<text display-inline="yes-display-inline">0.5 percent of the total cost

						<enum>(2)</enum>

						<header>Treatment</header>

						<text display-inline="yes-display-inline">The cost of conducting a

			 review of a project under this section shall be considered to be part of the

			 total cost of the project.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID71580661AFAB46288FC3118E85496436">

						<enum>(3)</enum>

						<header>Cost sharing</header>

						<text display-inline="yes-display-inline">A review of a project under

			 this section shall be subject to section 105(a) of the Water Resources

			 Development Act of 1986 (33 U.S.C. 2215(a)).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID717A56F55CBC4C0EBB4D73E98F878BEE">

						<enum>(4)</enum>

						<header>Waiver of limitation</header>

						<text display-inline="yes-display-inline">The Secretary may waive a

			 limitation under paragraph (1) if the Secretary determines that the waiver is

			 2006, in the case of a water resources project that is subject to a

			 benefit-cost analysis, the Secretary may recommend the project for

			 authorization by Congress, and may choose the project as a recommended

			 alternative in any record of decision or environmental impact statement, only

			 if the project, in addition to meeting any other criteria required by law, has

			 projected national benefits that are at least 1.5 times as great as the

			 estimated total costs of the project, based on current discount rates provided

			 by the Office of Management and Budget.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID49F76B071B0A4157B75BF4A5EE75217B">

					<enum>(b)</enum>

					<header>Deauthorization of projects</header>

						<enum>(1)</enum>

						<header>Report</header>

						<text display-inline="yes-display-inline">Not later than 180 days after

			 the date of enactment of this Act, the Secretary shall submit to Congress a

			 report identifying each water resources project (or separable element of such a

			 project) that is subject to a benefit-cost analysis and authorized for

			 construction, the projected remaining benefits of which are less than 1.5 times

			 as great as the remaining projected costs.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA1C0D5BAEC0A4AB69A8C9F3F7FC30CBE">

						<enum>(2)</enum>

						<header>Deauthorizations</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="id592A3FCAB44648D7A233A8562514509E">

							<enum>(A)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">Effective beginning on the

			 date that is 3 years after the date of submission of the report under paragraph

			 (1), any project identified in the report shall be deauthorized unless the

			 project was reauthorized by Congress during the preceding 3 years.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5C4CDC93E4DA473C9C934B24708C070A">

							<enum>(B)</enum>

							<header>Construction in progress</header>

							<text display-inline="yes-display-inline">If construction (other than

			 preconstruction engineering or design) began on or before the date of enactment

			 of this Act for a project that is deauthorized under subparagraph (A), the

			 Secretary may take such actions with respect to the project as the Secretary

			 determines to be necessary to protect public health and safety and the

			 environment.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6A5267EA1B514D33986939AF415D1DD6">

					<enum>(c)</enum>

					<header>Public notification</header>

					<text display-inline="yes-display-inline">The Secretary shall—</text>

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">publish in the Federal

			 Register the report under subsection (b)(1); and</text>

								<enum>(B)</enum>

								<header>Specific requirements</header>

								<text display-inline="yes-display-inline">Specific mitigation plans

				shall ensure that impacts to bottomland hardwood forests and other habitat

				types are mitigated in kind.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID49CAE8DAEBE547A1912D444E1A47675C">

								<enum>(C)</enum>

								<header>Consultation</header>

								<text display-inline="yes-display-inline">In carrying out this

									<text display-inline="yes-display-inline">acquire and restore 1 acre

				of superior or equivalent habitat of the same type to replace each acre of

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">replace the hydrologic

				functions and characteristics, the ecological functions and characteristics,

				and the spatial distribution of the habitat adversely affected by the

				project.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAE3E08C7B9B442DD8F188DB51684A232">

								<enum>(B)</enum>

								<header>Detailed mitigation plan</header>

								<text display-inline="yes-display-inline">The specific mitigation

				plan for a water resources project under paragraph (1) shall include, at a

				minimum—</text>

								<clause commented="no" display-inline="no-display-inline" id="IDC6A5EE118DA342F48349D184F1FDF4EF">

									<enum>(i)</enum>

									<text display-inline="yes-display-inline">a detailed and specific

				plan to monitor mitigation implementation and ecological success, including the

				designation of the entities that will be responsible for monitoring;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID03A7DCE76FD64F36BE700E3B74F1295F">

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">specific ecological success

				criteria by which the mitigation will be evaluated and determined to be

				successful, prepared in consultation with the United States Fish and Wildlife

				Service;</text>

									<enum>(iii)</enum>

									<text display-inline="yes-display-inline">a detailed description of

				the land and interests in land to be acquired for mitigation and the basis for

				a determination that land and interests are available for acquisition;</text>

									<enum>(iv)</enum>

									<text display-inline="yes-display-inline">sufficient detail regarding

				the chosen mitigation sites and type and amount of restoration activities to

				permit a thorough evaluation of the plan’s likelihood of ecological success and

				resulting aquatic and terrestrial resource functions and habitat values;

				and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID1353FF53224C48FABC597F6D88916BAF">

									<enum>(v)</enum>

								<header>Applicable law</header>

								<text display-inline="yes-display-inline">A time period for

				mitigation monitoring or for the implementation and monitoring of contingency

				plan actions shall not be subject to the deadlines described in section

				202.</text>

							<header>Determination of mitigation success</header>

								<enum>(A)</enum>

								<header>In general</header>

								<text display-inline="yes-display-inline">Mitigation shall be

				considered to be successful at the time at which monitoring demonstrates that

				the mitigation has met the ecological success criteria established in the

				mitigation plan.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB310DEE58F9C4A2DB7FACC36CDBFB823">

								<enum>(B)</enum>

								<header>Requirements for success</header>

								<text display-inline="yes-display-inline">To ensure the success of

				any attempted mitigation, the Secretary shall—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID73F141526E7E455198058888A1A3541C">

									<enum>(i)</enum>

									<text display-inline="yes-display-inline">consult yearly with the

				United States Fish and Wildlife Service on each water resources project

				requiring mitigation to determine whether mitigation monitoring for that

				project demonstrates that the project is achieving, or has achieved, ecological

				success;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID80F086EE878745F3BD14C445A4929FFF">

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">ensure that implementation

				of the mitigation contingency plan for taking corrective action begins not

				later than 30 days after a finding by the Secretary or the United States Fish

				and Wildlife Service that the original mitigation efforts likely will not

				result in, or have not resulted in, ecological success;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID2EB6456C5BF548EC816B83293CD78045">

									<enum>(iii)</enum>

									<text display-inline="yes-display-inline">complete implementation of

				the contingency plan as expeditiously as practicable; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDB4CEC836ABE844E5AEFB42D1A6E9FF24">

									<enum>(iv)</enum>

									<text display-inline="yes-display-inline">ensure that monitoring of

				mitigation efforts, including those implemented through a mitigation

				contingency plan, continues until the monitoring demonstrates that the

				mitigation has met the ecological success criteria.</text>

								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFDAA477C45E14273AD7D5F088F2604A0">

							<enum>(5)</enum>

							<header>Recommendation of projects</header>

							<text display-inline="yes-display-inline">The Secretary shall not

				recommend a water resources project alternative or choose a project alternative

				in any final record of decision, environmental impact statement, or

				environmental assessment completed after the date of enactment of this

				paragraph unless the Secretary determines that the mitigation plan for the

				alternative will successfully mitigate the adverse impacts of the project on

				aquatic and terrestrial resources, hydrologic functions, and fish and

				wildlife.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14025CF3C00A4BB18665DFE7E0854F7D">

							<enum>(6)</enum>

							<header>Implementation of mitigation before construction of new

				projects</header>

							<text display-inline="yes-display-inline">The Secretary shall

				implement all mitigation required by a record of decision for water resources

				projects in a particular district of the Corps before beginning physical

				construction of any new water resources project (or separable element of such a

				project) in that district.</text>

				project, the Secretary shall reserve or reprogram sufficient funds to ensure

				that mitigation implementation is completed as expeditiously as practicable,

				but in no case later than the end of the next fiscal year immediately following

				the last day of that construction.</text>

							<header>Use of funds</header>

			 the date of enactment of this Act, the Secretary shall establish a

			 recordkeeping system to track each water resources project constructed,

			 operated, or maintained by the Secretary, and for each permit issued under

			 section 404 of the <act-name parsable-cite="FWPCA">Federal Water Pollution

			 Control Act</act-name> (33 U.S.C. 1344)—</text>

						<text display-inline="yes-display-inline">the quantity and type of

			 wetland and other habitat types affected by the project, project operation, or

			 permitted activity;</text>

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">the quantity and type of

			 mitigation required for the project, project operation or permitted

			 activity;</text>

						<enum>(3)</enum>

						<text display-inline="yes-display-inline">the quantity and type of

			 mitigation that has been completed for the project, project operation or

			 permitted activity; and</text>

					<enum>(b)</enum>

					<header>Required information and organization</header>

					<text display-inline="yes-display-inline">The recordkeeping system

			 shall—</text>

			 the Corps for the fiscal year during which the report is submitted; and</text>

			 project on or before the date of submission of the report;</text>

			 construction carried out relating to the project;</text>

			 intracoastal waterway operated and maintained under section 206 of the Inland

			 Waterways Revenue Act of 1978 (33 U.S.C. 1804), information including—</text>

								<text display-inline="yes-display-inline">the actual cost of operating

			 and maintaining the reach of the waterway at the depth of the waterway during

			 the previous fiscal year; and</text>

								<enum>(iii)</enum>

								<text display-inline="yes-display-inline">the number of barges

			 (including the number of loaded barges) and the total tonnage shipped over each

								<text display-inline="yes-display-inline">each allocation made to the

			 project on or before the date of submission of the report, including the amount

			 and type of the allocation;</text>

									<text display-inline="yes-display-inline">the date on which any

			 economic data used to justify the project was collected;</text>

								<text display-inline="yes-display-inline">a brief explanation of any

			 reason why Federal funds have not been obligated for construction of the

			 project.</text>

					<enum>(c)</enum>

					<header>Congressional and public notifications</header>

					<text display-inline="yes-display-inline">On submission of a report

			 under this section, the Secretary shall notify each Senator in the State of

			 whom, and each Member of the House of Representatives in the district of whom,

			 a project identified in the report is located.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA58046EF373242A0B97EA8A2B2854459">

					<enum>(d)</enum>

					<header>Publication</header>

					<text display-inline="yes-display-inline">For any report under this

			 section, the Secretary shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idA47BDD9AFE144E249F0BB3D739F835DA">

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">publish the report in the

			 Federal Register; and</text>

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">make the report available

			 to—</text>

				<text display-inline="no-display-inline">Section 1001 of the Water

			 Resources Development Act of 1986 (33 U.S.C. 579a) is amended to read as

			 follows:</text>

							<header>Physical work</header>

							<text display-inline="yes-display-inline">The term <term>physical

				work</term> does not include any activity relating to—</text>

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">project planning;</text>

							<text display-inline="yes-display-inline">Effective beginning on the

				date that is 30 months after the date of submission of a fiscal transparency

				report under section 301 of the Corps of Engineers Modernization and

				Improvement Act of 2005, each project identified under section 301(b)(2)(D) of

				that Act shall be deauthorized unless Federal funds were obligated for

				construction of the project during the preceding 30 months.</text>

							<enum>(2)</enum>

							<header>Effect of paragraph</header>

							<text display-inline="yes-display-inline">Paragraph (1) does not

								<text display-inline="yes-display-inline">in the case of a beach

				nourishment project, beginning on the date on which initial construction of the

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">in the case of any other

				project, beginning on the date on which construction of the project is

				completed.</text>

						<header>Final deauthorization list</header>
