		<official-title>To promote food safety and to protect the animal feed

		  supply from bovine spongiform encephalopathy.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Animal Feed Protection Act of

			 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Definitions</header>

			<text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDA8FC9E84ABA7422E91CC63772C6005E2">

				<enum>(1)</enum>

				<header>BSE</header>

				<text>The term <term>BSE</term> means bovine spongiform

			 encephalopathy.</text>

			</paragraph><paragraph id="ID06589234038C4D13840AE32595321E94">

				<enum>(2)</enum>

				<header>Covered article</header>

				<subparagraph id="ID54BDA442B1F24B3FBF8C395DF019EC8B">

					<enum>(A)</enum>

					<header>In general</header>

					<text>The term <term>covered article</term> means—</text>

					<clause id="ID78414D1317DA4B7BB9C9C37E1591CA14">

						<enum>(i)</enum>

						<text>feed for an animal;</text>

					</clause><clause id="IDA02396557F46418EB3DC19BC34EAC361">

						<enum>(ii)</enum>

						<text>a nutritional supplement for an animal;</text>

					</clause><clause id="ID0261910E0B66489DB3128752FC0B9BDF">

						<enum>(iii)</enum>

						<text>medicine for an animal; and</text>

					</clause><clause id="ID5DAF847C1AA743F7B99D702635A748C3">

						<enum>(iv)</enum>

						<text>any other article of a kind that is ordinarily ingested,

			 implanted, or otherwise taken into an animal.</text>

					</clause></subparagraph><subparagraph id="IDFBA793C6390845BB882326BB9FAD3A12">

					<enum>(B)</enum>

					<header>Exclusions</header>

					<text>The term <term>covered article</term> does not include—</text>

					<clause id="IDB43C522A328642718C70465E7DB69340">

						<enum>(i)</enum>

						<text>an unprocessed agricultural commodity that is readily

			 identifiable as nonanimal in origin, such as a vegetable, grain, or nut;</text>

					</clause><clause id="ID99AE0653145948E6B4085A87C461BD6E">

						<enum>(ii)</enum>

						<text>an article described in subparagraph (A) that, based on

			 compelling scientific evidence, the Secretary determines does not pose a risk

			 of transmitting prion disease; or</text>

					</clause><clause id="ID3A9D1F701B234E0284156F3711A6E8D6">

						<enum>(iii)</enum>

						<text>an article regulated by the Secretary that, as determined by the

			 Secretary—</text>

						<subclause id="ID41C15DD9F4364CD2920E10DA7DF1B9A4">

							<enum>(I)</enum>

							<text>poses a minimal risk of carrying prion disease; and</text>

						</subclause><subclause id="ID237728C2FD804EBAA41544C4A5890C27">

							<enum>(II)</enum>

							<text>is necessary to protect animal health or public health.</text>

						</subclause></clause></subparagraph></paragraph><paragraph id="ID48788637ACBB4DAE89D9919B148F80F9">

				<enum>(3)</enum>

				<header>Specified risk material</header>

				<subparagraph id="IDDE345135DF6A42FCAC6DB35B5567B5DE">

					<enum>(A)</enum>

					<header>In general</header>

					<text>The term <term>specified risk material</term> means—</text>

					<clause id="IDF67308E5B7184C81AE1A37011E392426">

						<enum>(i)</enum>

						<text>the skull, brain, trigeminal ganglia, eyes, tonsils, spinal cord,

			 vertebral column, or dorsal root ganglia of—</text>

						<subclause id="IDE0E80FE3E0E44165A235BCF1593642AD">

							<enum>(I)</enum>

							<text>cattle and bison 30 months of age and older; or</text>

						</subclause><subclause id="ID2ECFCD6A99A54A2293BB0DB8F3B66FAD">

							<enum>(II)</enum>

							<text>sheep, goats, deer, and elk 12 months of age and older;</text>

						</subclause></clause><clause id="IDFA2264016C824203BCC9D28B5EF70FD8">

						<enum>(ii)</enum>

						<text>the intestinal tract of a ruminant of any age; and</text>

					</clause><clause id="IDD6C9C91E63BA4211BADCC4F51FC69415">

						<enum>(iii)</enum>

						<text>any other material of a ruminant that may carry a prion disease,

			 as determined by the Secretary, based on scientifically credible

			 research.</text>

					</clause></subparagraph><subparagraph id="IDFFE2717C0DC54B269186EDBCD90D07DD">

					<enum>(B)</enum>

					<header>Modification</header>

					<text>The Secretary shall conduct an annual review of scientific

			 research and may modify the definition of specified risk material based on

			 scientifically credible research (including the conduct of ante-mortem and

			 post-mortem tests certified by the Secretary of Agriculture).</text>

				</subparagraph></paragraph><paragraph id="IDC40573A33C804B7FB06A5A67B0FF0A41">

				<enum>(4)</enum>

				<header>Secretary</header>

				<text>The term <term>Secretary</term> means the Secretary of Health and

			 Human Services.</text>

			</paragraph></section><section id="IDB1CA7A7E53C84FC393EAF5D7E3159D1D">

			<enum>3.</enum>

			<header>Protection of animal feed and public health</header>

			<text display-inline="no-display-inline">It shall be unlawful for any

			 person to introduce into interstate or foreign commerce a covered article if

			 the covered article contains—</text>

			<paragraph id="ID81B42EA39A4E4C0994B5B996D5DF6652">

				<enum>(1)</enum>

				<subparagraph commented="no" display-inline="yes-display-inline" id="ID2322725C5531472B809BE46F06EF3CCB"><enum>(A)</enum>

					<text>specified risk material from a ruminant; or</text>

				</subparagraph><subparagraph id="ID880047D5428F47A58CB26A343CAD9B39" indent="up1">

					<enum>(B)</enum>

					<text>any material from a ruminant that—</text>

					<clause id="IDE838C3229F474225A06EFB7C9B9790B7">

						<enum>(i)</enum>

						<text>was in any foreign country at a time at which there was a risk of

			 transmission of BSE in the country, as determined by the Secretary of

			 Agriculture; and</text>

					</clause><clause id="ID4A4872DF1F3242CBBE26735195118ACB">

						<enum>(ii)</enum>

						<text>may contain specified risk material from a ruminant; or</text>

					</clause></subparagraph></paragraph><paragraph id="ID6DFDFCCCCB834C39ADBCC608CEB03C94">

				<enum>(2)</enum>

				<text>any material from a ruminant exhibiting signs of a neurological

			 disease.</text>

			</paragraph></section><section id="IDDB357D473241425BA8580A99573F3C9E">

			<enum>4.</enum>

			<header>Enforcement</header>

			<subsection id="IDEA8798B1F33F4E86AF9B10AE00AA0E4F">

				<enum>(a)</enum>

				<header>Cooperation</header>

				<text>The Secretary and the heads of other Federal agencies, as

			 appropriate, shall cooperate with the Attorney General in enforcing this

			 Act.</text>

			</subsection><subsection id="ID18B7F927D72B43CEAD38B8D3081D4AF9">

				<enum>(b)</enum>

				<header>Due process</header>

				<text>Any person subject to enforcement action under this section shall

			 have the opportunity for an informal hearing on the enforcement action as soon

			 as practicable after, but not later than 10 days after, the enforcement action

			 is taken.</text>

			</subsection><subsection id="ID5A0879AD4A9F41499130BB606908794F">

				<enum>(c)</enum>

				<header>Remedies</header>

				<text>In addition to any remedies available under other provisions of

			 law, the head of a Federal agency may enforce this Act by—</text>

				<paragraph id="ID1E30E890B12A464D98F93EA1AC83A24A">

					<enum>(1)</enum>

					<text>seizing and destroying an article that is introduced into

			 interstate or foreign commerce in violation of this Act; or</text>

				</paragraph><paragraph id="ID1BB4A56DBBD7472CAE5A6F703C5C7A43">

					<enum>(2)</enum>

					<text>issuing an order requiring any person that introduces an article

			 into interstate or foreign commerce in violation of this Act—</text>

					<subparagraph id="IDD2DC9812BF9E4EE29A48B575224E4616">

						<enum>(A)</enum>

						<text>to cease the violation;</text>

					</subparagraph><subparagraph id="ID34BC54D231434217ABF7F4723CC18F11">

						<enum>(B)</enum>

						<clause commented="no" display-inline="yes-display-inline" id="ID5EC2EC72896E4B40ABDD35EEC221D53B"><enum>(i)</enum>

							<text>to recall any article that is sold; and</text>

						</clause><clause id="ID1BBA09DF8FFD456FB9651E87E944C5CD" indent="up1">

							<enum>(ii)</enum>

							<text>to refund the purchase price to the purchaser;</text>

						</clause></subparagraph><subparagraph id="ID30F6451FF09B4ABCBE88B690DCE76D26">

						<enum>(C)</enum>

						<text>to destroy the article or forfeit the article to the United

			 States for destruction; or</text>

					</subparagraph><subparagraph id="IDFA527B2788BB46078CFC017380F836D4">

						<enum>(D)</enum>

						<text>to cease operations at the facility at which the article is

			 produced until the head of the appropriate Federal agency determines that the

			 operations are no longer in violation of this Act.</text>

					</subparagraph></paragraph></subsection><subsection id="ID6713AC1C0B1A45E0A0411A635958A817">

				<enum>(d)</enum>

				<header>Civil and monetary penalties</header>

				<text>Not later than 180 days after the date of enactment of this Act,

			 the Secretary shall promulgate regulations establishing the appropriate level

			 of civil and monetary penalties necessary to carry out this Act.</text>

			</subsection></section><section id="IDDF925F10694B4B73A4F4AC169204B42A">

			<enum>5.</enum>

			<header>Training standards</header>

			<text display-inline="no-display-inline">The Secretary, in consultation

			 with the Secretary of Agriculture, shall issue training standards to industry

			 for the removal of specified risk materials.</text>

		</section><section id="ID3422D020FA974091850B0D3185C57D74">

			<enum>6.</enum>

			<header>Authorization of appropriations</header>

			<text display-inline="no-display-inline">There is authorized to be

			 appropriated $5,000,000 to carry out this Act.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID00A4996D702D4DAE816FAA4186ACD15E" section-type="subsequent-section"><enum>7.</enum><header>Effective

			 date</header><text display-inline="no-display-inline">This Act takes effect on

			 the date that is 180 days after the date of enactment of this Act.</text>
