		<official-title>To require imported explosives to be marked in the same

		  manner as domestically manufactured explosives.</official-title>

			<enum>1.</enum>

			<header>Identification of explosive materials</header>

			<subsection id="IDB5F11361947E4728BF7F604BCC829222">

				<enum>(a)</enum>

				<header>In general</header>

				<text>Section 842 of title 18, United States Code, is amended by adding

			 at the end the following:</text>

					<subsection id="ID2DFE7B451440420C893C7FDC008B85E0">

						<enum>(q)</enum>

						<header>Identification of explosive materials</header>

						<paragraph id="IDF9A355B53AA44230A5188F702835FFB9">

							<enum>(1)</enum>

							<header>In general</header>

							<text>It shall be unlawful for any person to manufacture or import

				explosive materials for sale or distribution unless the explosive materials are

				legibly identified by marking in accordance with this subsection.</text>

						</paragraph><paragraph id="ID9B5A6DCE7239458F8CEF20A783597400">

							<enum>(2)</enum>

							<header>Type and placement of marking</header>

							<text>The marks required under this subsection shall—</text>

							<subparagraph id="IDDE38B477ADC14147815C403B29A1CD08">

								<enum>(A)</enum>

								<text>identify the name of the manufacturer;</text>

							</subparagraph><subparagraph id="ID60AFC3000BC84443A16CFCE8AA567140">

								<enum>(B)</enum>

								<text>identify the location, date, and shift of manufacture;</text>

							</subparagraph><subparagraph id="ID74B80CD9F09A4EE294D0DAD886B812BC">

								<enum>(C)</enum>

								<text>be placed on each cartridge, bag, or other immediate container

				of explosive materials manufactured for sale or distribution; and</text>

							</subparagraph><subparagraph id="IDEF59605B5F144C05BE2D4FC6B2BF7FC3">

								<enum>(D)</enum>

								<text>be placed on the outside container, if any, used for the

				packaging of explosive materials manufactured for sale or distribution.</text>

							</subparagraph></paragraph><paragraph id="ID96F5DE6CF443419CA3DC1856C4E989FE">

							<enum>(3)</enum>

							<header>Exceptions</header>

							<subparagraph id="IDA10CEB314A54454AA4BAEADDD9D5BE89">

								<enum>(A)</enum>

								<header>Detonators</header>

								<text>Licensed manufacturers or importers of detonators are only

				required to place the identification marks prescribed in paragraph (2) on the

				containers used for the packaging of detonators.</text>

							</subparagraph><subparagraph id="IDE833E0EF463F4E2D88EA1720AEA1A73C">

								<enum>(B)</enum>

								<header>Authorization of alternative identification</header>

								<text>The Attorney General may authorize a licensed manufacturer or

				importer to identify explosive materials in a different manner than the manner

				prescribed by paragraph (2) upon receipt from the manufacturer or importer of a

				written application showing that the alternative identification is reasonable

				and will not hinder the effective administration of this section.</text>

							</subparagraph><subparagraph id="ID69E8C80EC0084CD1B1F9C500EBC35DCF">

								<enum>(C)</enum>

								<header>Fireworks</header>

								<text>The Attorney General may authorize the licensed manufacturer or

				importer to identify fireworks in a different manner than the manner prescribed

				by paragraph (2).</text>

							</subparagraph></paragraph><paragraph id="IDA58999DEB46F4C4799BF05455599895C">

							<enum>(4)</enum>

							<header>Report</header>

							<text>Not later than 24 hours after the release of explosive

				materials from the custody of the United States Customs and Border Protection,

				the importer of such explosive materials shall submit a report to the Attorney

				General, in a format to be determined by the Attorney General, that

				contains—</text>

							<subparagraph id="ID77B3A3C480BC4AAFB182C68C4615F13C">

								<enum>(A)</enum>

								<text>the name and address of the importer;</text>

							</subparagraph><subparagraph id="IDE97349F76C8B4C148977AE0037F4EE18">

								<enum>(B)</enum>

								<text>the manufacturer of the explosive materials;</text>

							</subparagraph><subparagraph id="ID72971ADAB793407AABF64F8CBBB45358">

								<enum>(C)</enum>

								<text>the city and country where the explosive materials being

				imported were manufactured;</text>

							</subparagraph><subparagraph id="ID02C209A655774F0FBEACD569C5446BE2">

								<enum>(D)</enum>

								<text>the product name, size, and other marks of identification on

				the explosive materials; and</text>

							</subparagraph><subparagraph id="IDF671166D7A9E4C28B2108C1597328650">

								<enum>(E)</enum>

								<text>the date and shift of manufacture of the explosive

				materials.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDAE8C821705C941D984C8F6EF8DBD88D4">

				<enum>(b)</enum>

				<header>Rulemaking</header>

				<paragraph id="ID89896FB90AAF4F6FA65103EACC93A7A6">

					<enum>(1)</enum>

					<header>In general</header>

					<text>Not later than 6 months after the date of enactment of this Act,

			 the Attorney General shall issue final regulations to carry out the amendment

			 under subsection (a).</text>

				</paragraph><paragraph id="ID46375C06770E45FAA272D0774814CC28">

					<enum>(2)</enum>

					<header>Deference requirement</header>

					<text>In promulgating the regulations required under paragraph (1), the

			 Attorney General shall give deference to the standards for safety and security

			 marking recognized in the explosives industry.</text>

				</paragraph></subsection><subsection id="IDC9EF9EE4660249168B92736F214E94D6">

				<enum>(c)</enum>

				<header>Enforcement</header>

				<text>Section 844(a)(1) of title 18, United States Code, is amended by

			 striking <quote>or (<added-phrase>l</added-phrase>) through

			 (<added-phrase>o</added-phrase>)</quote> and inserting <quote>,

			 (<added-phrase>l</added-phrase>) through (<added-phrase>o</added-phrase>), or

			 (q)</quote>.</text>
