			 <quote>

					<short-title>Security and Freedom Enhancement Act

			 of 2005</short-title>

				</quote> or the <quote>

					<short-title>SAFE Act</short-title>

				</quote>.</text>

			<enum>2.</enum>

			<header>Limitations on roving wiretaps under Foreign Intelligence

			 Surveillance Act of 1978</header>

			<text display-inline="no-display-inline">Section 105(c) of the Foreign

			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1805(c)">50 U.S.C. 1805(c)</external-xref>) is

			 amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID1FAB67B81AAF47C5823D20A9D3AD9C92">

				<enum>(1)</enum>

				<text display-inline="yes-display-inline">in paragraph (1), by striking

			 subparagraphs (A) and (B) and inserting the following:</text>

				each of the facilities or places at which the electronic surveillance will be

				directed, if known; or</text>

			<enum>3.</enum>

			<header>Limitations on delayed notice search warrants</header>

			<subsection commented="no" display-inline="no-display-inline" id="idD266FE8FDBA74E6D9D85B3A90B73B0C2">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">Section 3103a(b) of title 18,

			 United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDEB9D4C7ECE7B4ED993FA8F1D8CC2C374">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">in paragraph (1), by striking

			 <quote>may have an adverse result (as defined in section 2705);</quote> and

			 inserting</text>

					<quoted-block act-name="" display-inline="yes-display-inline" id="ID5EAA3CFF6DE7494B98BFD91FE590494C" style="USC">

						<text>will—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDF9BCC639EF024235BFD6CC857C122D88">

				physical safety of an individual;</text>

				prosecution;</text>

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">result in the destruction

				of or tampering with evidence; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF199C49071A94B47A2CCD34BEBC1A0A6">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">result in intimidation of

				potential witnesses;</text>

						</subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFC5BF4452BBF44E28DB3804B88631242">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">in paragraph (3), by striking

			 <quote>within a reasonable period</quote> and all that follows and

			 inserting</text>

						<text>not later than 7 days after the execution of

			 the warrant, which period may be extended by the court for an additional period

			 of not more than 21 days each time the court finds reasonable cause to believe,

			 the Associate Attorney General, that notice of the execution of the warrant

				physical safety of an individual;</text>

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">result in flight from

				prosecution;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD25B474E1D6349FD8368F369243F0046">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">result in the destruction

				of, or tampering with, the evidence sought under the warrant; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1BAE2F45A0804CF18B132B3D6E463B00">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">result in intimidation of

				potential witnesses.</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7636A5B1C1F34643A47B7627CC9C5400">

				<enum>(b)</enum>

				<header>Reports</header>

				<text display-inline="yes-display-inline">Section 3103a of title 18,

			 United States Code, is amended by adding at the end the following:</text>

						<enum>(c)</enum>

						<header>Reports</header>

						<paragraph commented="no" display-inline="no-display-inline" id="ID314EDF8CBC2C436980FCBD481EF58536">

							<enum>(1)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">Every 6 months, the

				Attorney General shall submit a report to Congress summarizing, with respect to

				warrants under subsection (b), the requests made by the Department of Justice

				to delay notice and extend a delay of notice during the previous 6-month

				period.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE04D530F47624872A6D33360A9FA1B89">

							<enum>(2)</enum>

							<header>Contents</header>

							<text display-inline="yes-display-inline">Each report submitted under

				paragraph (1) shall include, for the preceding 6-month period—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID1364B0DCA8764DDBAA7D821268DE0051">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">the number of requests to

				delay notice with respect to warrants under subsection (b), categorized as

				granted, denied, or pending;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF3BFBB35C56B47D4A53D90D4FD8C52FC">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">for each request to delay

				notice that was granted, the number of requests to extend the delay of notice,

				categorized as granted, denied, or pending; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id411E368B6D654C12A43309FFD53FACDD">

								<enum>(C)</enum>

								<text display-inline="yes-display-inline">on an aggregate basis, the

				nature of the crime being investigated for each request to delay notice that

				was granted or denied.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF5D2A7455F2147FFB02E9F3C982C492D">

							<enum>(3)</enum>

							<header>Public availability</header>

							<text display-inline="yes-display-inline">The Attorney General shall

				make the report submitted under paragraph (1) available to the public.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			<enum>4.</enum>

			<header>Privacy protections for library, bookseller, and other personal

			 records under Foreign Intelligence Surveillance Act of 1978</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID860F87CA55884FCAB069E2342797CDF8">

				<enum>(a)</enum>

				<header>Applications for orders</header>

				<text display-inline="yes-display-inline">Section 501(b)(2) of the

			 Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861(b)(2)">50 U.S.C. 1861(b)(2)</external-xref>) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID47A44579E91040C2B257DED1AFADEC50">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">by striking <quote>shall

			 specify that the records</quote> and inserting</text>

					<quoted-block display-inline="yes-display-inline" id="ID83224742C41C4ECBB61EA113FCA5C428" style="OLC">

						<text>shall specify

			 that—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDEF30540F40844F01004F30223647A98F">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">the records</text>

						</subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF5230B9F2C3C476381096F59E4793F98">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">by striking the period at the

			 end and inserting the following: <quote>; and</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE2FDB01915B84E66A1B03A3E823527A0">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">by inserting at the end the

			 following:</text>

				pertain is a foreign power or an agent of a foreign power.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID852D8F5FDF464BE8881DD095E6F4971E">

				<enum>(b)</enum>

				<header>Orders</header>

				<text display-inline="yes-display-inline">Section 501(c) of the Foreign

			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861(c)(1)">50 U.S.C. 1861(c)</external-xref>) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idD32705EEB1B54590940E5B9021AE5DB9">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">in paragraph (1), by striking

			 <quote>finds that</quote> and all that follows and inserting</text>

				pertain is a foreign power or an agent of a foreign power; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID15FE9F16EAD641399734494C39D51260" indent="up1">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">the application meets the

				other requirements of this section.</text>

						</subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD437DA76CD884DE58529E8B1E466D134">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">by adding at the end the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="idB3F57DC055514415A522D555C4F56ADD" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="id03B4864972AC4009B2D1B86E0EAF1698" indent="up1">

							<enum>(3)</enum>

							<text display-inline="yes-display-inline">An order under this

				subsection shall not—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id03D139B8A65E46D5B50C3638CCC929E2">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">contain any requirement

				which would be held to be unreasonable if contained in a subpoena duces tecum

				issued by a court of the United States in aid of a grand jury investigation of

				espionage or international terrorism; or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE1521ECEE5848C9B473385BABD78FC8">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">require the production of

				any documentary evidence which would be privileged from disclosure if demanded

				by a subpoena duces tecum issued by a court of the United States in aid of a

				grand jury investigation of espionage or international terrorism.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98a6d50d7fef4a26ba867fd7a142af15" indent="up1">

							<enum>(4)</enum>

							<text display-inline="yes-display-inline">An order under this

				subsection must provide notice of the recipient’s right to file a petition

				under subsection (f) and explain the procedures for doing so.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8ea1d0f562c741c0b45e5907ad09b927">

				<enum>(c)</enum>

				<header> Nondisclosure</header>

				<text display-inline="yes-display-inline">Section 501(d) of Foreign

			 Intelligence Surveillance Act of 1978 (50 U.S.C. 1861(d)) is amended to read as

			 follows:</text>

						<header>Nondisclosure</header>

							<enum>(1)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">No person who receives an

				order under subsection (c) shall disclose to any person that the Federal Bureau

				of Investigation has sought or obtained tangible things under this section for

				180 days after receipt of such order.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6451DD1495746E7B13A8E7327D8E427">

							<enum>(2)</enum>

							<header>Exception</header>

							<text display-inline="yes-display-inline">A person who receives an

				order under subsection (c) may disclose that the Federal Bureau of

				Investigation has sought or obtained tangible things under this section

				to—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id9E99F4D1345A4A1487E102A50BA9FFA7">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">those persons to whom

				disclosure is necessary in order to comply with an order under this section;

				or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id237BA58FB1B94F86BDC154B0B1348E6E">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">an attorney in order to

				obtain legal advice regarding such order.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B68B5B837D44C9FB2741E5E24C08A81">

							<enum>(3)</enum>

							<header>Extension</header>

							<text display-inline="yes-display-inline">The Director of the Federal

				Bureau of Investigation, or a designee of the Director (whose rank shall be no

				lower than Assistant Special Agent in Charge), may apply for an order

				prohibiting disclosure that the Federal Bureau of Investigation has sought or

				obtained access to tangible things under this section for an additional 180

				days.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6152a988c61147129c0e0b645183bf76">

							<enum>(4)</enum>

							<header>Jurisdiction</header>

							<text display-inline="yes-display-inline">An application for an order

				pursuant to this subsection shall be made to—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID161abf0c5fb34166b5868df79b9c87ad">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">a judge of the court

				established under section 103(a); or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd5705920ad314c788d08ab3cc49c6678">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">a United States Magistrate

				Judge under chapter 43 of title 28, who is publicly designated by the Chief

				Justice of the United States to have the power to hear applications and grant

				orders for the production of tangible things under this section on behalf of a

				judge of the court established under section 103(a).</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2de50eac2d4a4ea8b3286433e509ae49">

							<enum>(5)</enum>

							<header>Application contents</header>

							<text display-inline="yes-display-inline">An application for an order

				pursuant to this subsection must state specific and articulable facts giving

				the applicant reason to believe that disclosure that the Federal Bureau of

				Investigation has sought or obtained tangible things under this section will

				result in—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDf1a4dc329c2b428885120e3fb779f7d4">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">endangering the life or

				physical safety of any person;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID89eeb642010b4742a0407282b8d5ac20">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">flight from

				prosecution;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7fb6d15a0cb14b958fd70bec5715c7ed">

								<enum>(C)</enum>

								<text display-inline="yes-display-inline">destruction of or tampering

				with evidence;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID25c179cee479465c9f8999f14377925e">

								<enum>(D)</enum>

								<text display-inline="yes-display-inline">intimidation of potential

				witnesses; or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfc0393ddee1f484a9c9e7cb33ecffa42">

								<enum>(E)</enum>

								<text display-inline="yes-display-inline">otherwise seriously

				endangering the national security of the United States by alerting a target, a

				target’s associates, or the foreign power of which the target is an agent, of

				the Government’s interest in the target.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4cde99357d34b6fac9ac228e40fa67b">

							<enum>(6)</enum>

							<header>Standard</header>

							<text display-inline="yes-display-inline">The judge may issue an ex

				parte order pursuant to this subsection if the judge determines there is reason

				to believe that disclosure that the Federal Bureau of Investigation has sought

				or obtained access to tangible things under this section will result in—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID4b58670812ab4cc08f1e014e8feabe16">

							<enum>(7)</enum>

							<header>Renewal</header>

							<text display-inline="yes-display-inline">An order under this

				subsection may be renewed for additional periods of up to 180 days upon another

				application meeting the requirements of paragraph (5) and a determination by

				the court that the circumstances described in paragraph (6) continue to

				exist.</text>

				the order in whole or in part as deemed proper and ordered by the court shall

				be based upon any failure of such order to comply with the provisions of this

				section or upon any constitutional or other legal right or privilege of such

				disclosing information under subsection (d) may file, in the courts established

				by section 103(a) or in the district court of the United States for the

				judicial district within which such person resides, is found, or transacts

				business, a petition for such court to set aside the nondisclosure requirement.

				Such petition shall specify each ground upon which the petitioner relies in

				seeking relief, and may be based upon any failure of the nondisclosure

				requirement to comply with the provisions of this section or upon any

				constitutional or other legal right or privilege of such person.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd4f30341e29d45d1ae6c76c50d0dd562">

								<header>In general</header>

								<text display-inline="yes-display-inline">Not later than 180 days

				after the date of enactment of the <short-title>Security

				and Freedom Enhancement Act of 2005</short-title>, the courts established

				pursuant to section 103(a) shall establish such rules and procedures and take

				such actions as are reasonably necessary to administer their responsibilities

				under this subsection.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B9B51F7C90C448194B3207BB36F651F">

								<enum>(B)</enum>

								<header>Reporting</header>

								<text display-inline="yes-display-inline">Not later than 30 days

				after promulgating rules and procedures under subparagraph (A), the courts

				established pursuant to section 103(a) shall transmit a copy of the rules and

				procedures, unclassified to the greatest extent possible (with a classified

				annex, if necessary), to the Committee on the Judiciary and the Select

				Committee on Intelligence of the Senate and the Committee on the Judiciary and

				the Permanent Select Committee on Intelligence of the House of

				Representatives.</text>

							<header>Disclosures to petitioners</header>

							<header>Disclosure for law enforcement purposes</header>

							<text display-inline="yes-display-inline">No tangible things or

				information acquired pursuant to this section shall be disclosed for law

				enforcement purposes unless such disclosure is accompanied by a statement that

				such tangible things or information, or any information derived therefrom, may

				only be used in a criminal proceeding with the advance authorization of the

				Attorney General.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9ae25420c5f2407ea5eae5f86eb1f32c">

							<enum>(3)</enum>

							<header>Notification of intended disclosure by the united

				states</header>

							<text display-inline="yes-display-inline">Whenever the United States

				intends to enter into evidence or otherwise use or disclose in any trial,

				hearing, or other proceeding in or before any court, department, officer,

				agency, regulatory body, or other authority of the United States against an

				aggrieved person any tangible things or information obtained or derived from an

				order pursuant to this section, the United States shall, before the trial,

				hearing, or other proceeding or at a reasonable time before an effort to so

				disclose or so use the tangible things or information or submit them in

				evidence, notify the aggrieved person and the court or other authority in which

				the tangible things or information are to be disclosed or used that the United

				States intends to so disclose or so use such tangible things or

				information.</text>

							<header>Notification of intended disclosure by state or political

				information are to be disclosed or used, and the Attorney General that the

				State or political subdivision thereof intends to so disclose or so use such

				tangible things or information.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4dd5a9b8a2d4d739176609d35d953d5">

							<enum>(5)</enum>

							<header>Motion to suppress</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDb8eb94efc5cd4296b94ee12000575bc5">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">Any aggrieved person

				against whom evidence obtained or derived from an order pursuant to this

				section is to be, or has been, introduced or otherwise used or disclosed in any

				trial, hearing, or other proceeding in or before any court, department,

				officer, agency, regulatory body, or other authority of the United States, or a

				State or political subdivision thereof, may move to suppress the evidence

				obtained or derived from the order, as the case may be, on the grounds

				that—</text>

				(A) shall be made before the trial, hearing, or other proceeding unless there

				was no opportunity to make such a motion or the aggrieved person concerned was

				not aware of the grounds of the motion.</text>

				district court in the same district as the authority shall, notwithstanding any

				other provision of law and if the Attorney General files an affidavit under

				may be necessary to determine whether the order was lawfully authorized and

								<text display-inline="yes-display-inline">If the United States

				district court determines pursuant to paragraph (6) that the order was not

				authorized or served in compliance with the Constitution or laws of the United

				States, the court may, in accordance with the requirements of law, suppress the

				evidence which was unlawfully obtained or derived from the order or otherwise

				grant the motion of the aggrieved person.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4ec017653cec4d06800aec345dce10fd">

								<enum>(B)</enum>

								<header>Lawful orders</header>

								<text display-inline="yes-display-inline">If the court determines

			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1862">50 U.S.C. 1862(a)</external-xref>) is amended to

			 read as follows:</text>

				this section to—</text>

								<text display-inline="yes-display-inline">The court may issue an ex

				parte order pursuant to this subsection if the court determines there is reason

				to believe that disclosure that the Federal Bureau of Investigation has sought

				or obtained access to information or records under this section will result

				in—</text>

				pursuant to this subparagraph must state specific and articulable facts giving

				the applicant reason to believe that disclosure that the Federal Bureau of

				Investigation has sought or obtained access to a customer’s or entity’s

				financial records under this paragraph will result in—</text>

									<text display-inline="yes-display-inline">intimidation of potential

				witnesses; or</text>

									<enum>(V)</enum>

									<text display-inline="yes-display-inline">otherwise seriously

				endangering the national security of the United States by alerting a target, a

				target’s associates, or the foreign power of which the target is an agent, of

				the Government’s interest in the target.</text>

								<enum>(vi)</enum>

								<header>Standard</header>

								<text display-inline="yes-display-inline">The court may issue an ex

				parte order pursuant to this subparagraph if the court determines there is

				reason to believe that disclosure that the Federal Bureau of Investigation has

				sought or obtained access to a customer’s or entity’s financial records under

				this paragraph will result in—</text>

								<header>Renewal</header>

								<text display-inline="yes-display-inline">An order under this

				subparagraph may be renewed for additional periods of up to 180 days upon

				another application meeting the requirements of clause (v) and a determination

				by the court that the circumstances described in clause (vi) of this

				subparagraph continue to exist.</text>

					<header>Consumer reporting agencies</header>

					<text display-inline="yes-display-inline">Section 625(d) of the Fair

			 Credit Reporting Act (15 U.S.C. 1681u(d)) is amended to read as follows:</text>

				agency, or officer, employee, or agent of a consumer reporting agency, shall

				disclose to any person that the Federal Bureau of Investigation has sought or

				obtained the identity of financial institutions or a consumer report respecting

				any consumer under subsection (a), (b), or (c) for 90 days after receipt of a

				request or order under this section, and no consumer reporting agency, or

				officer, employee, or agent of a consumer reporting agency, shall include in

				any consumer report any information that would indicate that the Federal Bureau

				of Investigation has sought or obtained such information or a consumer

				report.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6321666350E0481484B3E539FA357A8C">

								<enum>(2)</enum>

								<header>Exception</header>

								<text display-inline="yes-display-inline">A consumer reporting agency

				or officer, employee, or agent of a consumer reporting agency who receives an

				order under this subsection may disclose that the Federal Bureau of

				Investigation has sought or obtained the identity of financial institutions or

				a consumer report respecting any consumer to—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="idC6DB77568D334A05AEB477C15D49E327">

									<enum>(A)</enum>

									<text display-inline="yes-display-inline">those officers, employees,

				or agents of a consumer reporting agency necessary to fulfill the requirement

				to disclose information to the Federal Bureau of Investigation under this

				section; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6FFD33F2B4F84E90BCBC4B1E4B0957F4">

									<enum>(B)</enum>

									<text display-inline="yes-display-inline">an attorney in order to

				obtain legal advice regarding such requirement.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5e2d271e791942f099d256a9e48929f2">

								<enum>(3)</enum>

								<header>Extension</header>

								<text display-inline="yes-display-inline">The Director of the Federal

				Bureau of Investigation, or the Director’s designee in a position not lower

				than Deputy Assistant Director at Bureau headquarters or a Special Agent in

				Charge of a Bureau field office designated by the Director, may apply for an

				order prohibiting disclosure that the Federal Bureau of Investigation has

				sought or obtained access to information or records under subsection (a), (b),

				or (c) for an additional 180 days.</text>

								<header>Jurisdiction</header>

								<text display-inline="yes-display-inline">An application for an order

				pursuant to this subsection shall be filed in the district court of the United

				States in any district within which the authorized investigation that is the

				basis for a request or order pursuant to this section is being

				conducted.</text>

				after any person receives a request pursuant to subsection (b), or at any time

				before the return date specified in the request, whichever period is shorter,

				such person may file, in the district court of the United States for the

				judicial district within which such person resides, is found, or transacts

				business, a petition for such court to modify or set aside such request. The

				time allowed for compliance with the request in whole or in part as deemed

				proper and ordered by the court shall not run during the pendency of such

				petition in the court. Such petition shall specify each ground upon which the

				petitioner relies in seeking relief, and may be based upon any failure of such

				request to comply with the provisions of this section or upon any

				constitutional or other legal right or privilege of such person.</text>

										<text display-inline="yes-display-inline">A person prohibited from

				disclosing information under subsection (c) may file, in the district court of

				the United States for the judicial district within which such person resides,

				is found, or transacts business, a petition for the court to set aside the

				nondisclosure requirement. Such petition shall specify each ground upon which

				the petitioner relies in seeking relief, and may be based upon any failure of

				the nondisclosure requirement to comply with the provisions of this section or

				upon any constitutional or other legal right or privilege of such

				person.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb8af826f70ed4dee8dfe9d4ae8bf8c9d">

										<enum>(B)</enum>

										<header>Standard</header>

										<text display-inline="yes-display-inline">The court shall set aside

				the nondisclosure requirement unless the court determines that there is a

				reason to believe that disclosure of the request under subsection (b) will

				result in—</text>

				under this subsection, the court shall disclose to the petitioner, the counsel

				of the petitioner, or both, under the procedures and standards provided in the

				Classified Information Procedures Act (18 U.S.C. App.), portions of the

				application, order, or other related materials unless the court finds that such

				disclosure would not assist in determining any legal or factual issue pertinent

				to the case.</text>

				time before the return date specified in the request, whichever period is

				shorter, such person may file, in the district court of the United States for

				the judicial district within which such person resides, is found, or transacts

				business, a petition for the court to modify or set aside the request. The time

				allowed for compliance with the request in whole or in part as deemed proper

				which the petitioner relies in seeking the relief, and may be based upon any

				failure of the nondisclosure requirement to comply with the provisions of this

				section or upon any constitutional or other legal right or privilege of the

				petitioner.</text>

				in the Classified Information Procedures Act (18 U.S.C. App.), portions of the

				application, order, or other related materials unless the court finds that such

				disclosure would not assist in determining any legal or factual issue pertinent

				the United States person only in accordance with the provisions of this

				subsection.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID374077984bb345069a9847fe9a228f66">

									<enum>(B)</enum>

									<header>Lawful purpose</header>

									<text display-inline="yes-display-inline">No information acquired

				from an order pursuant to this section may be used or disclosed by Federal

				officers or employees except for lawful purposes.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb293b87b7f2947edaa76768a0ecb6cab">

								<enum>(2)</enum>

								<header>Disclosure for law enforcement purposes</header>

								<text display-inline="yes-display-inline">No information acquired

				pursuant to this section shall be disclosed for law enforcement purposes unless

				such disclosure is accompanied by a statement that such information, or any

				information derived therefrom, may only be used in a criminal proceeding with

				the advance authorization of the Attorney General.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91a958d0adee4d069e14872d511df5d1">

								<enum>(3)</enum>

								<header>Notification of intended disclosure by the united

				states</header>

								<text display-inline="yes-display-inline">Whenever the United States

				intends to enter into evidence or otherwise use or disclose in any trial,

				hearing, or other proceeding in or before any court, department, officer,

				agency, regulatory body, or other authority of the United States against an

				aggrieved person any information obtained or derived from a request pursuant to

				this section, the United States shall, before the trial, hearing, or other

				proceeding or at a reasonable time before an effort to so disclose or so use

				this information or submit it in evidence, notify the aggrieved person and the

				court or other authority in which the information is to be disclosed or used

				that the United States intends to so disclose or so use such

				information.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2387aef9155a4ab7ba107b3bf1c95b4c">

								<enum>(4)</enum>

								<header>Notification of intended disclosure by state or political

				subdivision</header>

								<text display-inline="yes-display-inline">Whenever any State or

				political subdivision thereof intends to enter into evidence or otherwise use

				or disclose in any trial, hearing, or other proceeding in or before any court,

				department, officer, agency, regulatory body, or other authority of the State

				or political subdivision thereof against an aggrieved person any information

				obtained or derived from a request pursuant to this section, the State or

				political subdivision thereof shall notify the aggrieved person, the court or

				other authority in which the information is to be disclosed or used, and the

				Attorney General that the State or political subdivision thereof intends to so

				disclose or so use such information.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9cfb172cd04745249d8ff10a33c19e2a">

								<enum>(5)</enum>

								<header>Motion to suppress</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID35c3abd5cc404b16a3887b7ba47ad931">

									<enum>(A)</enum>

									<header>In general</header>

									<text display-inline="yes-display-inline">Any aggrieved person

				against whom evidence obtained or derived from a request pursuant to this

				section is to be, or has been, introduced or otherwise used or disclosed in any

				trial, hearing, or other proceeding in or before any court, department,

				officer, agency, regulatory body, or other authority of the United States, or a

				State or political subdivision thereof, may move to suppress the evidence

				obtained or derived from the request, as the case may be, on the grounds

				that—</text>

									<clause commented="no" display-inline="no-display-inline" id="IDc56a50103177464f85e12e63bf51cad9">

										<enum>(i)</enum>

										<text display-inline="yes-display-inline">the information was

				acquired in violation of the Constitution or laws of the United States;

				or</text>

										<enum>(ii)</enum>

										<text display-inline="yes-display-inline">the request was not in

				conformity with the requirements of this section.</text>

									<enum>(B)</enum>

									<header>Timing</header>

									<text display-inline="yes-display-inline">A motion under subparagraph

				(A) shall be made before the trial, hearing, or other proceeding unless there

				was no opportunity to make such a motion or the aggrieved person concerned was

				not aware of the grounds of the motion.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53aa69fc05034ad492b523976ed9e783">

								<enum>(6)</enum>

								<header>Judicial review</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID69ea7d4616d849c29ef182a38f10ec48">

									<enum>(A)</enum>

									<header>In general</header>

									<text display-inline="yes-display-inline">Whenever—</text>

									<clause commented="no" display-inline="no-display-inline" id="id28A2AAF073C444A79A9970C6D09F0226">

										<enum>(i)</enum>

										<text display-inline="yes-display-inline">a court or other authority

				is notified pursuant to paragraph (3) or (4);</text>

										<enum>(ii)</enum>

										<text display-inline="yes-display-inline">a motion is made pursuant

				to paragraph (5); or</text>

										<enum>(iii)</enum>

										<text display-inline="yes-display-inline">any motion or request is

				made by an aggrieved person pursuant to any other statute or rule of the United

				States or any State before any court or other authority of the United States or

				any State to—</text>

				materials relating to a request issued pursuant to this section; or</text>

											<enum>(II)</enum>

											<text display-inline="yes-display-inline">discover, obtain, or

				suppress evidence or information obtained or derived from a request issued

				pursuant to this section;</text>

										</subclause></clause><continuation-text commented="no" continuation-text-level="subparagraph">the United States district court

				or, where the motion is made before another authority, the United States

				district court in the same district as the authority shall, notwithstanding any

				other provision of law and if the Attorney General files an affidavit under

				oath that disclosure would harm the national security of the United States,

				review in camera the materials as may be necessary to determine whether the

									<enum>(B)</enum>

									<header>Disclosure</header>

									<text display-inline="yes-display-inline">In making a determination

				under subparagraph (A), unless the court finds that such disclosure would not

				assist in determining any legal or factual issue pertinent to the case, the

				court shall disclose to the aggrieved person, the counsel of the aggrieved

				person, or both, under the procedures and standards provided in the Classified

				Information Procedures Act (18 U.S.C. App.), portions of the application,

				order, or other related materials, or evidence or information obtained or

				derived from the order.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID731bdf01f1864d0fb240c32fc408daff">

								<enum>(7)</enum>

								<header>Effect of determination of lawfulness</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID413907839d9c4f338fe4ee8a8aa05ad5">

									<enum>(A)</enum>

									<header>Unlawful orders</header>

									<text display-inline="yes-display-inline">If the United States

				district court determines pursuant to paragraph (6) that the request was not in

				compliance with the Constitution or laws of the United States, the court may,

				in accordance with the requirements of law, suppress the evidence which was

				unlawfully obtained or derived from the request or otherwise grant the motion

				of the aggrieved person.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7364baad79194545872bb88add656acb">

									<enum>(B)</enum>

									<header>Lawful orders</header>

									<text display-inline="yes-display-inline">If the court determines

				that the request was lawful, it may deny the motion of the aggrieved person

				except to the extent that due process requires discovery or disclosure.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd15bdee143b74505b32a8ca9c823045f">

								<enum>(8)</enum>

								<header>Binding final orders</header>

								<text display-inline="yes-display-inline">Orders granting motions or

				requests under paragraph (6), decisions under this section that a request was

				not lawful, and orders of the United States district court requiring review or

				granting disclosure of applications, orders, or other related materials shall

				be final orders and binding upon all courts of the United States and the

				several States except a United States court of appeals or the Supreme

				Court.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id83A5F714364A41DAA7CFF298ED124749">

							<enum>(g)</enum>

							<header>Definitions</header>

							<text display-inline="yes-display-inline">As used in this

				section—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id901C3929D4984D498724BAC9F85E64BF">

								<enum>(1)</enum>

								<text display-inline="yes-display-inline">the term <term>agent of a

				foreign power</term> has the meaning given such term by section 101(b) of the

				Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1862">50 U.S.C. 1801(b)</external-xref>);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA014DBA2DC34F65ACC8C078DC23972D">

								<enum>(2)</enum>

								<text display-inline="yes-display-inline">the term <term>aggrieved

				person</term> means a person whose name, address, length of service, or local

				or long distance toll records were sought or obtained under this section;

				and</text>

				extensions of such orders granted or denied pursuant to this chapter during the

				preceding calendar year. Such report shall include a summary and analysis of

				the data required to be reported to Congress under subsection (a).</text>

				for an order or extension under section 3122(a) and whether the court granted

				or denied such application; and</text>

									<enum>(B)</enum>

									<text display-inline="yes-display-inline">if the order or extension

				was granted—</text>

										<enum>(i)</enum>

										<text display-inline="yes-display-inline">the date of the entry of

				such order or extension and the period of authorized, approved, or disapproved

				use of the pen register or trap and trace device;</text>

										<enum>(ii)</enum>

										<text display-inline="yes-display-inline">whether a pen register or

				trap and trace device was installed or used during the period authorized;

				and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idA8921EABDADF4875A9BF0AF9C60D189A">

										<enum>(iii)</enum>

										<text display-inline="yes-display-inline">the specific types of

				dialing, routing, addressing, or signaling information sought in the

				application and collected by the pen register or trap and trace device.</text>

								<header>Timing</header>

								<text display-inline="yes-display-inline">The court shall serve

				notice under paragraph (1) within a reasonable time, but not later than 90 days
