				<text display-inline="yes-display-inline">Section 1111(b)(2) of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (20 U.S.C. 6311(b)(2)) is amended—</text>

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">in subparagraph

			 (C)(vii)—</text>

				<text display-inline="yes-display-inline">Section 1116(a)(1)(B) of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (20 U.S.C. 6316(a)(1)(B)) is amended by striking <quote>,

			 except that</quote> and all that follows through <quote>action or

			 restructuring</quote>.</text>

			<enum>3.</enum>

			<header>Grants for increasing data capacity for purposes of

			 ayp</header>

			<text display-inline="no-display-inline">Subpart 1 of part A of title I

			 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (20 U.S.C. 6311 et seq.) is amended by adding at the end the

			 following:</text>

					<header>Grants for increasing data capacity for purposes of

				ayp</header>

					<subsection commented="no" display-inline="no-display-inline" id="ID3D5A6CBEE3FB4A008EE835621BB1555B">

						<enum>(a)</enum>

						<header>Grant authority</header>

						<text display-inline="yes-display-inline">The Secretary may award

				grants, on a competitive basis, to State educational agencies to enable the

				State educational agencies—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id2F829911A0A740FF9132FEF7222D753E">

							<enum>(1)</enum>

							<text display-inline="yes-display-inline">to develop or increase the

				capacity of data systems for accountability purposes; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0CA3452A3190411BBD1D1F51435D761E">

							<enum>(2)</enum>

							<text display-inline="yes-display-inline">to award subgrants to

				increase the capacity of local educational agencies to upgrade, create, or

				manage information databases for the purpose of measuring adequate yearly

				progress.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0178F4F8D9D24B5C97608466E7D48CC2">

						<enum>(b)</enum>

						<header>Priority</header>

						<text display-inline="yes-display-inline">In awarding grants under

				this section the Secretary shall give priority to State educational agencies

				that have created, or are in the process of creating, a growth model or

				proficiency index as part of their adequate yearly progress

				determination.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3DC5327BEE4746589E12CC95704F0613">

						<enum>(c)</enum>

						<header>State use of funds</header>

						<text display-inline="yes-display-inline">Each State that receives a

				grant under this section shall use—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDD4769D72CE94408086CC3A5945DDDB5E">

							<enum>(1)</enum>

							<text display-inline="yes-display-inline">not more than 20 percent of

				the grant funds for the purpose of increasing the capacity of, or creating,

				State databases to collect information related to adequate yearly progress;

				and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2EBA2CD486EA4963B8A25EC27D76CE14">

							<enum>(2)</enum>

							<text display-inline="yes-display-inline">not less than 80 percent of

				the grant funds to award subgrants to local educational agencies within the

				State to enable the local educational agencies to carry out the authorized

				activities described in subsection (d).</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID527C9854CEBE4F578BB2D48D61916E8A">

						<enum>(d)</enum>

						<header>Authorized activities</header>

						<text display-inline="yes-display-inline">Each local educational

				agency that receives a subgrant under this section shall use the subgrant funds

				to increase the capacity of the local educational agency to upgrade databases

				or create unique student identifiers for the purpose of measuring adequate

				yearly progress, by—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDAE0FB4CF628F41BB85CC2046E93C1E82">

							<enum>(1)</enum>

							<text display-inline="yes-display-inline">purchasing database

				software or hardware;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2DE942D8AD2E487CBCEAC6C7D6404CCA">

							<enum>(2)</enum>

							<text display-inline="yes-display-inline">hiring additional staff for

				the purpose of managing such data;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID784FFCB3F91944DD830ED5B40544E513">

							<enum>(3)</enum>

							<text display-inline="yes-display-inline">providing professional

				development or additional training for such staff; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID878FCF1520F24CC08C1CF2E1D111BFD5">

							<enum>(4)</enum>

							<text display-inline="yes-display-inline">providing professional

				development or training for principals and teachers on how to effectively use

				such data to implement instructional strategies to improve student

				achievement.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID469F32B1802743ABB11289D1CDB4252F">

						<enum>(e)</enum>

						<header>State application</header>

						<text display-inline="yes-display-inline">Each State educational

				agency desiring a grant under this section shall submit an application to the

				Secretary at such time, in such manner, and containing such information as the

				Secretary may require.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID78C092FEDB0C4BF99D17A4EEEF169F5B">

						<enum>(f)</enum>

						<header>LEA application</header>

						<text display-inline="yes-display-inline">Each local educational

				agency desiring a subgrant under this section shall submit an application to

				the State educational agency at such time, in such manner, and containing such

				information as the State educational agency may require. Each such application

				shall include, at a minimum, a demonstration of the local educational agency’s

				ability to put such a database in place.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID18651870031E4D7BB6FE21348BEEE4E0">

						<enum>(g)</enum>

						<header>Authorization of appropriations</header>

						<text display-inline="yes-display-inline">There are authorized to be

				appropriated to carry out this part $80,000,000 for each of fiscal years 2006,

				2007, and 2008.</text>

			<enum>4.</enum>

			<header>Targeting transfer options and supplemental services</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID587D05D3CDBB4B069F2A01FF12118B9C">

				<enum>(a)</enum>

				<header>Targeting transfer options and supplemental services</header>

				<text display-inline="yes-display-inline">Section 1116 of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (20 U.S.C. 6316) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID44D0114C36CF4DEAAC1D3A662A98C19A">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">in paragraphs (1)(E)(i),

			 (5)(A), (7)(C)(i), and (8)(A)(i) of subsection (b), by striking the term

			 <term>all students enrolled in the school</term> each place such term appears

			 and inserting <quote>all students enrolled in the school, who are members of a

			 group described in section 1111(b)(2)(C)(v) that fails to make adequate yearly

			 progress as defined in the State’s plan under section

			 1111(b)(2),</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA5C76CAE9649437488172C7541111E4D">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">in subsection (b)(1), by

			 adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="IDECB3FF5EC8EC458FBD3517E87AACB7D4" style="OLC">

						<subparagraph commented="no" display-inline="no-display-inline" id="ID125ECC59820B42EDA79C1E0F46BFBB4A">

							<enum>(G)</enum>

							<header>Maintenance of least restrictive environment</header>

							<text display-inline="yes-display-inline">A student who is eligible

				to receive services under the Individuals with Disabilities Education Act and

				who uses the option to transfer under subparagraph (E), paragraph (5)(A),

				(7)(C)(i), or (8)(A)(i), or subsection (c)(10)(C)(vii), shall be placed and

				served in the least restrictive environment appropriate, in accordance with the

				Individuals with Disabilities Education Act.</text>

						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID309DF928B54641C6B35A0D761740B402">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">in clause (vii) of subsection

			 (c)(10)(C), by inserting <quote>, who are members of a group described in

			 section 1111(b)(2)(C)(v) that fails to make adequate yearly progress as defined

			 in the State’s plan under section 1111(b)(2),</quote> after <quote>Authorizing

			 students</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID64C7098E2FDC4124B6C3BFAD5AB59722">

					<enum>(4)</enum>

					<text display-inline="yes-display-inline">in subparagraph (A) of

			 subsection (e)(12), by inserting <quote>, who is a member of a group described

			 in section 1111(b)(2)(C)(v) that fails to make adequate yearly progress as

			 defined in the State’s plan under section 1111(b)(2)</quote> after <quote>under

			 section 1113(c)(1)</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID46503F56465C459680290DADD2F9E5A3">

				<enum>(b)</enum>

				<header>Student already transferred</header>

				<text display-inline="yes-display-inline">A student who transfers to

			 another public school pursuant to section 1116(b) of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (20 U.S.C. 6316(b)) before the effective date of this section

			 and the amendments made by this section, may continue enrollment in such public

			 school after the effective date of this section and the amendments made by this

			 section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID97D5B82867A846E08CD07BAEE34378D0">

				<enum>(c)</enum>

				<header>Effective date</header>

				<text display-inline="yes-display-inline">This section and the

			 amendments made by this section shall be effective for each fiscal year for

			 which the amount appropriated to carry out title I of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> for the fiscal year, is less than the amount authorized to be

			 appropriated to carry out such title for the fiscal year.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDE25C80E48FFE49ACB726789E45D64F04" section-type="subsequent-section">

			<enum>5.</enum>

			<header>Definition of highly qualified teachers</header>

			<text display-inline="no-display-inline">Section 9101(23)(B)(ii) of the

			 Elementary and Secondary Act of 1965 (20 U.S.C. 7801(23)(B)(ii)) is

			 amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID7F8CB2B0FEBA49A5BEBB33672BFBC5FD">

				<enum>(1)</enum>

				<text display-inline="yes-display-inline">in subclause (I), by striking

			 <quote>or</quote> after the semicolon;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID23B84EA5B958460A868508F91B44455C">

				<enum>(2)</enum>

				<text display-inline="yes-display-inline">in subclause (II), by

			 striking <quote>and</quote> after the semicolon; and</text>

						<text display-inline="yes-display-inline">obtaining a State social

				studies certificate that qualifies the teacher to teach history, geography,

				economics, and civics in middle or secondary schools, respectively, in the

				State; or</text>

					</subclause><subclause commented="no" display-inline="no-display-inline" id="IDD02A4B0B7A184CA1B54CE711864B9203">

						<enum>(V)</enum>

						<text display-inline="yes-display-inline">obtaining a State science

				certificate that qualifies the teacher to teach earth science, biology,

				chemistry, and physics in middle or secondary schools, respectively, in the

				State; and</text>

					</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
