		<official-title>To amend part E of title IV of the Social Security Act to

		  provide equitable access for foster care and adoption services for Indian

		  children in tribal areas.</official-title>

		<section id="ID829485E7EE0447AF84C84D63C5378BCE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Indian and Alaska Native Foster Care

			 and Adoption Services Amendments of 2005</short-title></quote>.</text>

		</section><section id="IDD541D7A535204251800020B1DC9E9162"><enum>2.</enum><header>Authority of

			 Indian tribes to receive Federal funds for foster care and adoption

			 assistance</header>

			<subsection id="ID08CA1054CBF14227A69C249508403966"><enum>(a)</enum><header>Children placed

			 in tribal custody eligible for foster care funding</header><text><external-xref legal-doc="act" parsable-cite="SSA/472(a)(2)">Section 472(a)</external-xref> of

			 the <act-name parsable-cite="SSA">Social Security Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/672(a)(2)">42 U.S.C.

			 672(a)(2)</external-xref>) is amended by striking paragraph (2) and inserting

			 the following:</text>

				<quoted-block display-inline="no-display-inline" id="idE8963B46DF25451B90D12393905128F1" style="OLC">

					<paragraph id="idAA9F844320AD4A34AA42804F2CE21DCE"><enum>(2)</enum><text>the placement and

				care of a child under this section shall be the responsibility of—</text>

						<subparagraph id="id46C0047D3FDF45FAAD1EA49C710360B2"><enum>(A)</enum><text>the State agency

				administering the State plan approved under section 471;</text>

						</subparagraph><subparagraph id="id84899ACE4B014D03816711F55EEA0EAC"><enum>(B)</enum><text>any other public

				agency with which the State agency administering or supervising the

				administration of the State plan approved under section 471 has made an

				agreement that is in effect; or</text>

						</subparagraph><subparagraph id="id89FF5FAA66B9478793559D5152AF46F1"><enum>(C)</enum><text>an Indian tribe

				(as defined in section 479B(e)) or an intertribal consortium, if the Indian

				tribe or intertribal consortium—</text>

							<clause id="idF1977EAF54854ACDA78A6F9137499D29"><enum>(i)</enum><text>does not operate

				a program under section 479B; and</text>

							</clause><clause id="idD3FF345EC91A4CDF9AD4A5D5C50F20FD"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idD40D7AF676CB480A804C6E4013DA731E"><enum>(I)</enum><text>has a cooperative

				agreement with a State under section 479B(c); or</text>

								</subclause><subclause id="id918FAD278EDC42BDB0FC9EDCCAACDE88" indent="up1"><enum>(II)</enum><text>submits to the Secretary a description

				of the arrangements (jointly developed or developed in consultation with the

				State) made by the Indian tribe or intertribal consortium for the payment of

				funds and the provision of the child welfare services and protections required

				under this title;</text>

								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID8CA9593E10CD4E6F92638649C37D7161"><enum>(b)</enum><header>Programs

			 operated by Indian tribal organizations</header><text>Part E of title IV of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670</external-xref> et

			 seq.) is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id044E65A6577740958E2D809C58CE2D6C" style="OLC">

					<section id="IDA3951ACBB1BB493C9885001635EA02C7"><enum>479B.</enum><header>Programs

				operated by Indian tribal organizations</header>

						<subsection commented="no" display-inline="no-display-inline" id="IDCC52BD88048C477DA6A989E96DCD0043"><enum>(a)</enum><header>Definitions of

				Indian tribe; tribal organization</header><text display-inline="yes-display-inline">In this section, the terms <term>Indian

				tribe</term> and <term>tribal organization</term> have the meanings given those

				terms in section 4 of the <act-name parsable-cite="ISDA">Indian

				Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C.

				450b</external-xref>).</text>

						</subsection><subsection id="ID22C45D8F203C4848A30808727C8EEE19"><enum>(b)</enum><header>Application</header><text>Except

				as provided in subsection (b), this part shall apply to an Indian tribe that

				elects to operate a program under this part in the same manner as this part

				applies to a State.</text>

						</subsection><subsection id="IDFA6494EE87A04602BDA9D02027A79219"><enum>(c)</enum><header>Modification of

				plan requirements</header>

							<paragraph id="ID2346AED5669D41EAB1A3FD0069F07413"><enum>(1)</enum><header>In

				general</header><text>In the case of an Indian tribe submitting a plan for

				approval under section 471, the plan shall—</text>

								<subparagraph id="IDFF8072941281457EBF5F68B2F1369745"><enum>(A)</enum><text>in lieu of the

				requirement of section 471(a)(3), identify any service area and population to

				be served by the Indian tribe; and</text>

								</subparagraph><subparagraph id="IDCB86BFB8C3CC4B99001293BC6209FE00"><enum>(B)</enum><text>in lieu of the

				requirement of section 471(a)(10), provide for the approval of foster homes in

				accordance with tribal standards and in a manner that ensures the safety of,

				and accountability for, children placed in foster care.</text>

								</subparagraph></paragraph><paragraph id="ID7B8E34EE18574788B306DA9C95E8F427"><enum>(2)</enum><header>Determination

				of Federal share</header>

								<subparagraph id="IDEFAC4B3F413C4F6482E340A3AFC4F498"><enum>(A)</enum><header>Per capita

				income</header>

									<clause id="ID4C8C94BAEDDC4D3485764FCEC3259E98"><enum>(i)</enum><header>In

				general</header><text>For purposes of determining the Federal medical

				assistance percentage applicable to an Indian tribe under paragraphs (1) and

				(2) of section 474(a), the calculation of the per capita income of an Indian

				tribe shall be based on the service population of the Indian tribe as defined

				in the plan of the tribe, in accordance with paragraph (1)(A).</text>

									</clause><clause id="ID8BAFD959BA4B4972982EC6EC27DFB935"><enum>(ii)</enum><header>Consideration

				of other information</header><text>Before making a calculation under clause

				(i), the Secretary shall consider any information submitted by an Indian tribe

				that the Indian tribe considers relevant to the calculation of the per capita

				income of the Indian tribe.</text>

									</clause></subparagraph><subparagraph id="ID2789DE3CDCB7444B9B92663D64BB7660"><enum>(B)</enum><header>Administrative

				expenditures</header><text>The Secretary shall, by regulation, determine the

				proportions to be paid to Indian tribes pursuant to section 474(a)(3), except

				that in no case shall an Indian tribe receive a lesser proportion than the

				corresponding amount specified for a State under that section.</text>

								</subparagraph><subparagraph id="ID41139C93064242C3B9EFB951CF915847"><enum>(C)</enum><header>Sources of

				non-federal share</header><text>An Indian tribe may use Federal or State funds

				to match payments for which the Indian tribe is eligible under section

				474.</text>

								</subparagraph></paragraph><paragraph id="IDEDB899AF10A5447DB39508E9BA51C56C"><enum>(3)</enum><header>Modification of

				other requirements</header><text>On the request of an Indian tribe, the

				Secretary may modify any requirement under this part if, after consulting with

				the Indian tribe, the Secretary determines that modification of the requirement

				would advance the best interests and the safety of children served by the

				Indian tribe.</text>

							</paragraph><paragraph id="ID5DEEE7C5754C4A10BC68E065004D5FA5"><enum>(4)</enum><header>Consortium</header><text>The

				participating Indian tribes of an intertribal consortium may develop and submit

				a single plan under section 471 that meets the requirements of this

				section.</text>

							</paragraph></subsection><subsection id="ID84D426D8C11A4C4FA0EA6F00B08FCD00"><enum>(d)</enum><header>Cooperative

				agreements</header>

							<paragraph id="id9049E699708942E8A8F4A2F2F1B6B3B3"><enum>(1)</enum><header>In

				general</header><text>An Indian tribe or intertribal consortium and a State may

				enter into a cooperative agreement for the administration or payment of funds

				under this part.</text>

							</paragraph><paragraph id="id9A5C4F1E87444CC195EE95ED64A39431"><enum>(2)</enum><header>Effect of

				section on agreements</header><text>If an Indian tribe or intertribal

				consortium and a State enter into a cooperative agreement that incorporates any

				of the provisions of this section, those provisions shall be valid and

				enforceable.</text>

							</paragraph><paragraph id="id806A0655B96C4E3397BEA16ADCE44497"><enum>(3)</enum><header>Prior existing

				agreements</header><text>A cooperative agreement under paragraph (1) that is in

				effect as of the date of enactment of this section shall remain in full force

				and effect, subject to the right of either party to the agreement to revoke or

				modify the agreement pursuant to the terms of the agreement.</text>

							</paragraph></subsection><subsection id="IDAD15A2785DDC4B3E8500233B54DE388B"><enum>(e)</enum><header>Regulations</header><text>Not

				later than 1 year after the date of enactment of this section, the Secretary,

				in consultation with Indian tribes and tribal organizations, shall promulgate

				regulations to carry out this section.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDCA717C70E9834158B14C58BD1988B743"><enum>(c)</enum><header>Effective

			 date</header><text>The amendments made by this section take effect on the date

			 of enactment of this Act, regardless of the date on which regulations are

			 promulgated to carry out the amendments.</text>
