		<official-title>To amend the Public Health Service Act to prohibit human

		  cloning.</official-title>

		<section id="ID2B50A62C7B9C49349556BBC881D77E29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Human Cloning Prohibition Act of

			 2005</short-title></quote>.</text>

		</section><section id="ID4E2879AC4F4B4F7EBB8414BF314795BB"><enum>2.</enum><header>Prohibition on

			 human cloning</header><text display-inline="no-display-inline">Part H of title

			 IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/289">42 U.S.C.

			 289</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

				<section id="ID26CC29DFB3D44AAFA6A41F8CEBDA5104"><enum>498D.</enum><header>Prohibition

				on human cloning</header>

					<subsection id="ID1177E44DF9A3442C825C7318E6A86DD2"><enum>(a)</enum><header>Definitions</header><text>In

				this section:</text>

						<paragraph id="ID255524B63BD34568A3FAA2ABA9004655"><enum>(1)</enum><header>Human

				cloning</header><text>The term <term>human cloning</term> means human asexual

				reproduction, accomplished by introducing nuclear material from one or more

				human somatic cells into a fertilized or unfertilized oocyte whose nuclear

				material has been removed or inactivated so as to produce a living organism (at

				any stage of development) that is genetically virtually identical to an

				existing or previously existing human organism.</text>

						</paragraph><paragraph id="ID48FD43055D7C4219B1B152A1C28787C5"><enum>(2)</enum><header>Asexual

				reproduction</header><text>The term <term>asexual reproduction</term> means

				reproduction not initiated by the union of oocyte and sperm.</text>

						</paragraph><paragraph id="IDDF28ADE7549E401D9E425CE4FA5B2BFE"><enum>(3)</enum><header>Somatic

				cell</header><text>The term <term>somatic cell</term> means a diploid cell

				(having a complete set of chromosomes) obtained or derived from a living or

				deceased human body at any stage of development.</text>

						</paragraph></subsection><subsection id="IDD36E99A4A1F14647937B16472BBBBD98"><enum>(b)</enum><header>Prohibition</header><text>It

				shall be unlawful for any person or entity, public or private, in or affecting

				interstate commerce, knowingly—</text>

						<paragraph id="ID3BB7B9A207D84E31B3275B998380FD55"><enum>(1)</enum><text>to perform or

				attempt to perform human cloning;</text>

						</paragraph><paragraph id="ID941AF1EAA5A8411C8ED5289618082DDF"><enum>(2)</enum><text>to participate in

				an attempt to perform human cloning; or</text>

						</paragraph><paragraph id="ID639DB594EC864EACA46CC0C2ACCEC0DE"><enum>(3)</enum><text>to ship or

				receive for any purpose an embryo produced by human cloning or any product

				derived from such embryo.</text>

						</paragraph></subsection><subsection id="ID88C5B888BC7141A49BA272DE00928F64"><enum>(c)</enum><header>Importation</header><text>It

				shall be unlawful for any person or entity, public or private, knowingly to

				import for any purpose an embryo produced by human cloning.</text>

					</subsection><subsection id="ID4B7D229CDCBD40C8A9BEF89B038C35E2"><enum>(d)</enum><header>Penalties</header>

						<paragraph id="IDC3F642D575F34A629D9B0833507ED454"><enum>(1)</enum><header>Criminal

				penalty</header><text>Any person or entity that violates this section shall be

				fined or imprisoned for not more than 10 years, or both.</text>

						</paragraph><paragraph id="ID32BC786296124A839C8C31A1E3FF1135"><enum>(2)</enum><header>Civil

				penalty</header><text>Any person or entity that violates any provision of this

				section shall be subject to, in the case of a violation that involves the

				derivation of a pecuniary gain, a civil penalty of not less than $1,000,000 and

				not more than an amount equal to the amount of the gross gain multiplied by 2,

				if that amount is greater than $1,000,000.</text>

						</paragraph></subsection><subsection id="IDBDA1346BDF534AF4A0B8F0164EE78802"><enum>(e)</enum><header>Scientific

				research</header><text>Nothing in this section restricts areas of scientific

				research not specifically prohibited by this section, including research in the

				use of nuclear transfer or other cloning techniques to produce molecules, DNA,

				cells other than human embryos, tissues, organs, plants, or animals other than

				humans.</text>

					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="IDD0BB6FFF58314FB7807CA9A479BEC6A9"><enum>3.</enum><header>Study by

			 Government Accountability Office</header>

			<subsection id="IDEF060A6843264D10B1A1D64585968944"><enum>(a)</enum><header>In

			 general</header><text>The Government Accountability Office shall conduct a

			 study to assess the need for amendment of the prohibition on human cloning, as

			 defined in <external-xref legal-doc="act" parsable-cite="PHSA/498D(a)">section

			 498D(a)</external-xref> of the <act-name parsable-cite="PHSA">Public Health

			 Service Act</act-name>, as added by section 2, which study should

			 include—</text>

				<paragraph id="ID08E076CCF31A412E862CB400DC886D79"><enum>(1)</enum><text>a discussion of

			 new developments in medical technology concerning human cloning and somatic

			 cell nuclear transfer, the need (if any) for somatic cell nuclear transfer to

			 produce medical advances, current public attitudes and prevailing ethical views

			 concerning the use of somatic cell nuclear transfer, and potential legal

			 implications of research in somatic cell nuclear transfer; and</text>

				</paragraph><paragraph id="ID74C090F979B848B99310BEFCA5EF0056"><enum>(2)</enum><text>a review of any

			 technological developments that may require that technical changes be made to

			 <external-xref legal-doc="act" parsable-cite="PHSA/498D">section

			 498D</external-xref> of the <act-name parsable-cite="PHSA">Public Health

			 Service Act</act-name>.</text>

				</paragraph></subsection><subsection id="ID82FDACDDB90E4E87BC908F8D2126CCE2"><enum>(b)</enum><header>Report</header><text>The

			 Government Accountability Office shall transmit to Congress, not later than 4

			 years after the date of enactment of this Act, a report containing the findings

			 and conclusions of its study, together with recommendations for any legislation

			 or administrative actions which it considers appropriate.</text>
