		  nationals of Liberia to that of lawful permanent residence.</official-title>

		<section id="idAEC9E2BD700D4FF7BFA119C110FE1FE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Liberian Refugee Immigration Fairness

			 Act of 2005</short-title></quote>.</text>

		</section><section id="ID5AA29FFECB8E48E2A1C761548B163CA3"><enum>2.</enum><header>Adjustment of

			 status</header>

			<subsection id="ID27F7EB2F5DBB454DBB8CE3E00001B6C7"><enum>(a)</enum><header>Adjustment of

			 status</header>

				<paragraph id="ID9A722BA8FF0343C2B64319B4FD734E19"><enum>(1)</enum><header>In

			 general</header>

					<subparagraph id="ID86EFEE9EA5994353ABBB4EEF0311C886"><enum>(A)</enum><header>Eligibility</header><text>The

			 Secretary of Homeland Security shall adjust the status of an alien described in

			 subsection (b) to that of an alien lawfully admitted for permanent residence,

			 if the alien—</text>

						<clause id="ID17E17E8ED795427F96A43FECC932002C"><enum>(i)</enum><text>applies for

			 adjustment before April 1, 2007; and</text>

						</clause><clause id="IDFA34477A4972464EA28800E0724BB6F4"><enum>(ii)</enum><text>is

			 otherwise eligible to receive an immigrant visa and admissible to the United

			 States for permanent residence, except that, in determining such admissibility,

			 the grounds for inadmissibility specified in paragraphs (4), (5), (6)(A), and

			 (7)(A) of <external-xref legal-doc="act" parsable-cite="INA/212(a)">section

			 212(a)</external-xref> of the <act-name parsable-cite="INA">Immigration and

			 Nationality Act</act-name> (8 U.S.C. 1182(a)) shall not apply.</text>

						</clause></subparagraph><subparagraph id="ID310DA4336C9E4CEEBBFF9E9BF62DEEEC"><enum>(B)</enum><header>Ineligible

			 aliens</header><text>An alien shall not be eligible for adjustment of status

			 under this section if the Secretary of Homeland Security finds that the alien

			 has been convicted of—</text>

						<clause id="ID6A9452068C834EEE00EF66BE9F702C7C"><enum>(i)</enum><text>any

			 aggravated felony (as defined in

			 <external-xref legal-doc="act" parsable-cite="INA/101(a)(43)">section

			 101(a)(43)</external-xref> of the <act-name parsable-cite="INA">Immigration and

			 Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101(a)(43)">8 U.S.C. 1101(a)(43)</external-xref>);

			 or</text>

						</clause><clause id="ID93F88B9F2B5C46C19389698688C7E8F5"><enum>(ii)</enum><text>2

			 or more crimes involving moral turpitude.</text>

						</clause></subparagraph></paragraph><paragraph id="ID53873A6B4A6B4798AB8FAE4235F619BD"><enum>(2)</enum><header>Relationship of

			 application to certain orders</header>

					<subparagraph id="id81AD0B4BE68841A98B3931D7FF798022"><enum>(A)</enum><header>In

			 general</header><text>An alien present in the United States who has been

			 ordered excluded, deported, removed, or to depart voluntarily from the United

			 States under any provision of the Immigration and Nationality Act may,

			 notwithstanding such order, apply for adjustment of status under paragraph (1)

			 if otherwise qualified under that paragraph.</text>

					</subparagraph><subparagraph id="idCF341B1D8B3B42B5B1EBFE4CF6E4318E"><enum>(B)</enum><header>Separate motion

			 not required</header><text>An alien described in subparagraph (A) may not be

			 required, as a condition of submitting or granting such application, to file a

			 separate motion to reopen, reconsider, or vacate the order described in

			 subparagraph (A).</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEB8AFC42C88A44BBA012E37766D2380A"><enum>(C)</enum><header>Effect of

			 decision by Secretary</header><text>If the Secretary of Homeland Security

			 grants the application, the Secretary shall cancel the order. If the Secretary

			 of Homeland Security makes a final decision to deny the application, the order

			 shall be effective and enforceable to the same extent as if the application had

			 not been made.</text>

					</subparagraph></paragraph></subsection><subsection id="IDFE8493526EA64CBD88053F41EF8D4CDA"><enum>(b)</enum><header>Aliens eligible

			 for adjustment of status</header>

				<paragraph id="IDCD0EF34EB74C4DD5B413B3EDE4322293"><enum>(1)</enum><header>In

			 general</header><text>The benefits provided under subsection (a) shall apply to

			 any alien—</text>

					<subparagraph id="ID8A61AB39BB1E45AEACB3AF9365FE4902"><enum>(A)</enum><text>who is—</text>

						<clause id="IDBB2F51FBB6A04ABCB1DFEB1229E277CA"><enum>(i)</enum><text>a

			 national of Liberia; and</text>

						</clause><clause id="ID9DBC63D6D9304DF3AFA6AA4E26B5C56D"><enum>(ii)</enum><text>has been

			 continuously present in the United States from January 1, 2005, through the

			 date of application under subsection (a); or</text>

						</clause></subparagraph><subparagraph id="ID8A0B51A1D6A5465F96CBEE0059F32920"><enum>(B)</enum><text>who is the

			 spouse, child, or unmarried son or daughter of an alien described in

			 subparagraph (A).</text>

					</subparagraph></paragraph><paragraph id="IDFF8CA97D49DB41E194899667E88955F3"><enum>(2)</enum><header>Determination

			 of continuous physical presence</header><text>For purposes of establishing the

			 period of continuous physical presence referred to in paragraph (1), an alien

			 shall not be considered to have failed to maintain continuous physical presence

			 by reasons of an absence, or absences, from the United States for any period or

			 periods amounting in the aggregate to not more than 180 days.</text>

				</paragraph></subsection><subsection id="ID2783CBA62ADF4433A7827279ABDC3112"><enum>(c)</enum><header>Stay of

			 removal</header>

				<paragraph id="IDFBDB58B62F0344AEAD4921845CD47629"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Homeland Security shall provide by

			 regulation for an alien who is subject to a final order of deportation or

			 removal or exclusion to seek a stay of such order based on the filing of an

			 application under subsection (a).</text>

				</paragraph><paragraph id="IDC6914DF0BDBD47CE9DA08D18CDE100EA"><enum>(2)</enum><header>During certain

			 proceedings</header><text>Notwithstanding any provision in the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, the

			 Secretary of Homeland Security shall not order an alien to be removed from the

			 United States if the alien is in exclusion, deportation, or removal proceedings

			 under any provision of such Act and has applied for adjustment of status under

			 subsection (a), except where the Secretary of Homeland Security has made a

			 final determination to deny the application.</text>

				</paragraph><paragraph id="ID9C2754B9046643029C09093974203663"><enum>(3)</enum><header>Work

			 authorization</header>

					<subparagraph id="idDA924E5C98DB45E0A46588BAEEF6B9B1"><enum>(A)</enum><header>In

			 general</header><text>The Secretary of Homeland Security may authorize an alien

			 who has applied for adjustment of status under subsection (a) to engage in

			 employment in the United States during the pendency of such application and may

			 provide the alien with an <quote>employment authorized</quote> endorsement or

			 other appropriate document signifying authorization of employment.</text>

					</subparagraph><subparagraph id="idFEFA8CB839064617ABBF88B70E134FCC"><enum>(B)</enum><header>Pending

			 applications</header><text>If an application under subsection (a) is pending

			 for a period exceeding 180 days and has not been denied, the Secretary of

			 Homeland Security shall authorize such employment.</text>

					</subparagraph></paragraph></subsection><subsection id="ID42990AB0D6054CC2A1306483005989EC"><enum>(d)</enum><header>Record of

			 permanent residence</header><text>Upon approval of an alien’s application for

			 adjustment of status under subsection (a), the Secretary of Homeland Security

			 shall establish a record of the alien’s admission for permanent record as of

			 the date of the alien’s arrival in the United States.</text>

			</subsection><subsection id="ID1E25F8A9BA8C4E558F8815E454E8D860"><enum>(e)</enum><header>Availability of

			 administrative review</header><text>The Secretary of Homeland Security shall

			 provide to applicants for adjustment of status under subsection (a) the same

			 right to, and procedures for, administrative review as are provided to—</text>

				<paragraph id="ID40FCF07675C24ACB94D401A89E24ECEF"><enum>(1)</enum><text>applicants for

			 adjustment of status under

			 <external-xref legal-doc="act" parsable-cite="INA/245">section

			 245</external-xref> of the <act-name parsable-cite="INA">Immigration and

			 Nationality Act (8 U.S.C. 1255)</act-name>; or</text>

				</paragraph><paragraph id="ID5F63A98536F649C8944C935DCC323307"><enum>(2)</enum><text>aliens subject to

			 removal proceedings under section 240 of such Act.</text>

				</paragraph></subsection><subsection id="ID156CD78AE0824FA4AC3DB2971174A104"><enum>(f)</enum><header>Limitation on

			 judicial review</header><text>A determination by the Secretary of Homeland

			 Security as to whether the status of any alien should be adjusted under this

			 section is final and shall not be subject to review by any court.</text>

			</subsection><subsection id="ID4E616B7C43C64440910032E35E0024A8"><enum>(g)</enum><header>No offset in

			 number of visas available</header><text>If an alien is granted the status of

			 having been lawfully admitted for permanent residence pursuant to this section,

			 the Secretary of State shall not be required to reduce the number of immigrant

			 visas authorized to be issued under any provision of the

			 <act-name parsable-cite="INA">Immigration and Nationality

			 Act</act-name>.</text>

			</subsection><subsection id="ID77A21A8AB1E748BC8D8C315E69C0C879"><enum>(h)</enum><header>Application of

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 provisions</header>

				<paragraph id="idCEA29A6F9C1B470F8AF6AC5ED1BC6B4D"><enum>(1)</enum><header>Definitions</header><text>Except

			 as otherwise specifically provided in this Act, the definitions contained in

			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 shall apply in this section.</text>

				</paragraph><paragraph id="idD7AD31495103472EBD6B9A1475CE99C7"><enum>(2)</enum><header>Savings

			 provision</header><text>Nothing in this Act shall be construed to repeal,

			 amend, alter, modify, effect, or restrict the powers, duties, function, or

			 authority of the Secretary of Homeland Security in the administration and

			 enforcement of the Immigration and Nationality Act or any other law relating to

			 immigration, nationality, or naturalization.</text>

				</paragraph><paragraph id="id37C9BC37BAD9422D9AE76735752CA3F2"><enum>(3)</enum><header>Effect of

			 eligibility for adjustment of status</header><text>Eligibility to be granted

			 the status of having been lawfully admitted for permanent residence under this

			 section shall not preclude an alien from seeking any status under any other

			 provision of law for which the alien may otherwise be eligible.</text>

				</paragraph></subsection></section></legis-body>
