		<section commented="no" display-inline="no-display-inline" id="ID516BF2422DB74592B32C76902D8121E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Railroad Carriers and Mass

			 Transportation Protection Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID7483CAC888D74E659496CC3125FD6BBA" section-type="subsequent-section"><enum>2.</enum><header>Attacks against

			 railroad carriers, passenger vessels, and mass transportation systems</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDBF44E98662B0433EA3B2A0AC18BAE63B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Chapter 97 of title

			 18, United States Code, is amended by striking sections 1992 and 1993 and

			 inserting the following:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="id9446DCA7AC794FC195E21F333CBE9FDF" style="USC">

					<section commented="no" display-inline="no-display-inline" id="ID27095191E4D340D68B3C52A16B5B120B" section-type="subsequent-section"><enum>1992.</enum><header>Terrorist attacks

				and other violence against railroad carriers, passenger vessels, and against

				mass transportation systems on land, on water, or through the air</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID63BD6798982745D09A1B92857F9B42DC"><enum>(a)</enum><header>General

				prohibitions</header><text display-inline="yes-display-inline">Whoever, in a

				circumstance described in subsection (c), knowingly—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDBA89BAB96B9D4EC2AFDBAF08990634F0"><enum>(1)</enum><text display-inline="yes-display-inline">wrecks, derails, sets fire to, or disables

				railroad on-track equipment, a passenger vessel, or a mass transportation

				vehicle;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15577466FCBA49ADAD9690A413359078"><enum>(2)</enum><text display-inline="yes-display-inline">with intent to endanger the safety of any

				passenger or employee of a railroad carrier, passenger vessel, or mass

				transportation provider, or with a reckless disregard for the safety of human

				life, and without previously obtaining the permission of the railroad carrier,

				mass transportation provider, or owner of the passenger vessel—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDB07AFBB414B34CEEA041AD1602661AF9"><enum>(A)</enum><text display-inline="yes-display-inline">places any biological agent or toxin,

				destructive substance, or destructive device in, upon, or near railroad

				on-track equipment, a passenger vessel, or a mass transportation vehicle;

				or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8C915458E5BE4769BDC12D121A15AA19"><enum>(B)</enum><text display-inline="yes-display-inline">releases a hazardous material or a

				biological agent or toxin on or near the property of a railroad carrier, owner

				of a passenger vessel, or mass transportation provider;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD218D6B02BC5402DA8E68825AAE87A0B"><enum>(3)</enum><text display-inline="yes-display-inline">sets fire to, undermines, makes unworkable,

				unusable, or hazardous to work on or use, or places any biological agent or

				toxin, destructive substance, or destructive device in, upon, or near

				any—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDC50F5DB0FED64DBC9BC23FF6348A23F4"><enum>(A)</enum><text display-inline="yes-display-inline">tunnel, bridge, viaduct, trestle, track,

				electromagnetic guideway, signal, station, depot, warehouse, terminal, or any

				other way, structure, property, or appurtenance used in the operation of, or in

				support of the operation of, a railroad carrier, without previously obtaining

				the permission of the railroad carrier, and with intent to, or knowing or

				having reason to know such activity would likely, derail, disable, or wreck

				railroad on-track equipment; <added-phrase reported-display-style="italic">or</added-phrase></text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB4BD33A468F648F78145DD332A0CF5AF"><enum>(B)</enum><text display-inline="yes-display-inline">garage, terminal, structure, track,

				electromagnetic guideway, supply, or facility used in the operation of, or in

				support of the operation of, a mass transportation vehicle, without previously

				obtaining the permission of the mass transportation provider, and with intent

				to, or knowing or having reason to know such activity would likely, derail,

				disable, or wreck a mass transportation vehicle used, operated, or employed by

				a mass transportation provider; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF0A5F035372347CFBDD159DE139C84B6"><enum>(C)</enum><text display-inline="yes-display-inline">structure, supply, or facility used in the

				operation of, or in the support of the operation of, a passenger vessel,

				without previously obtaining the permission of the owner of the passenger

				vessel, and with intent to, or knowing or having reason to know that such

				activity would likely disable or wreck a passenger vessel;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAEA3050A8E124B20BEFD9D4AD737336E"><enum>(4)</enum><text display-inline="yes-display-inline">removes an appurtenance from, damages, or

				otherwise impairs the operation of a railroad signal system or mass

				transportation signal or dispatching system, including a train control system,

				centralized dispatching system, or highway-railroad grade crossing warning

				signal, without authorization from the rail carrier or mass transportation

				provider;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0B63DEEBA68A4FB9AFD445E00CEB88AD"><enum>(5)</enum><text display-inline="yes-display-inline">with intent to endanger the safety of any

				passenger or employee of a railroad carrier, owner of a passenger vessel, or

				mass transportation provider or with a reckless disregard for the safety of

				human life, interferes with, disables, or incapacitates any dispatcher, driver,

				captain, locomotive engineer, railroad conductor, or other person while the

				person is employed in dispatching, operating, or maintaining railroad on-track

				equipment, a passenger vessel, or a mass transportation vehicle;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE2B235E7AD494174B1A9DC2E4E9E3997"><enum>(6)</enum><text display-inline="yes-display-inline">engages in conduct, including the use of a

				dangerous weapon, with the intent to cause death or serious bodily injury to

				any person who is on the property of a railroad carrier, owner of a passenger

				vessel, or mass transportation provider that is used for railroad or mass

				transportation purposes;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCF831ACF6524434C9AFA430580F57EDD"><enum>(7)</enum><text display-inline="yes-display-inline">conveys false information, knowing the

				information to be false, concerning an attempt or alleged attempt that was

				made, is being made, or is to be made, to engage in a violation of this

				subsection; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0E22877F8E6A45F087451C9282795292"><enum>(8)</enum><text display-inline="yes-display-inline">attempts, threatens, or conspires to engage

				in any violation of any of paragraphs (1) through (7),

				<deleted-phrase reported-display-style="strikethrough">shall be

				fined</deleted-phrase></text>

							</paragraph><continuation-text continuation-text-level="subsection"><added-phrase reported-display-style="italic">shall be fined</added-phrase> under this title,

				imprisoned not more than 20 years, or both.</continuation-text></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="IDEA28916D63EF4B49AA9F979CDA528AEC" reported-display-style="strikethrough"><enum>(b)</enum><header>Aggravated

				offense</header><text display-inline="yes-display-inline">Whoever commits an

				offense under subsection (a) in a circumstance in which—</text>

							<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID1F05856EB1C547229916F07E81F11DC7" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying a passenger or employee at

				the time of the offense;</text>

							</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID43F71A5C07C2445DA3A74D1A26082BA1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying high-level radioactive

				waste or spent nuclear fuel at the time of the offense;</text>

							</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID59AA43112B1B4D9B9CD4C5377B25E2B2" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying a hazardous material at the

				time of the offense that—</text>

								<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID11571BFC672B4E72A3F6E1A55D82D4BA" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">was required to be placarded under subpart

				F of part 172 of title 49, Code of Federal Regulations; and</text>

								</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDDF00A557809E45CFB30A80FA5F5717B5" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">is identified as class number 3, 4, 5, 6.1,

				or 8 and packing group I or packing group II, or class number 1, 2, or 7 under

				the hazardous materials table of section 172.101 of title 49, Code of Federal

				Regulations; or</text>

								</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID2208F8D790CC45D19E7EB64685125E9F" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">the offense results in the death of any

				person, shall be fined under this title, imprisoned for any term of years or

				life, or both. The term of imprisonment for a violation described in paragraph

				(2) shall be not less than 30 years. In the case of a violation described in

				paragraph (4), the offender shall be fined under this title and imprisoned for

				life and be subject to the death penalty.</text>

							</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id715C0D545BAA40FCB62DDC67E8F8E5BB" reported-display-style="italic"><enum>(b)</enum><header>Aggravated

				offense</header><subparagraph commented="no" display-inline="yes-display-inline" id="id5522F1D0E2B24BEDAC3AC112253EAE19"><enum>(1)</enum><text display-inline="yes-display-inline">Whoever commits an offense under subsection

				(a) in a circumstance in which—</text>

								</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id73D8479DC25C41BF80794076B8CFE46E" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying a passenger or employee at

				the time of the offense;</text>

								</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id7C21473B31CC44E1B4B9B36F3E6C23FD" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying high-level radioactive

				waste or spent nuclear fuel at the time of the offense;</text>

								</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id3FFDAF6F76EA41589EDAE1C1A86E9B59" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">the railroad on-track equipment, passenger

				vessel, or mass transportation vehicle was carrying a hazardous material at the

				time of the offense that—</text>

									<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id1972BB5202B6486688A60EED38B19BBB" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">was required to be placarded under subpart

				F of part 172 of title 49, Code of Federal Regulations; and</text>

									</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id865D984008154EC09DCE5EA0E5479133" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">is identified as class number 3, 4, 5, 6.1,

				or 8 and packing group I or packing group II, or class number 1, 2, or 7 under

				the hazardous materials table of section 172.101 of title 49, Code of Federal

				Regulations; or</text>

									</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id0217775E49D945F5A23D80D97912F6B5" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">the offense results in the death of any

				person,</text>

								</subparagraph></paragraph><continuation-text changed="not-changed" continuation-text-level="paragraph" indent="subsection" reported-display-style="italic">shall be fined under this title,

				imprisoned for any term of years or life, or both.</continuation-text><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idEC98AB72328A47DAB2EDEEBD5A2EA67E" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The term of imprisonment for a violation

				described in paragraph (1)(B) shall be not less than 30 years.</text>

							</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id8D7626A3008947BE86FC080508A4C8FF" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">In the case of a violation described in

				paragraph (1)(D), the offender shall be fined under this title and imprisoned

				for a term of years up to life or sentenced to death, in accordance with

				section 3591 of title 18, United States Code.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2F3E4FBFA292459B9D6DEF6FED913C34"><enum>(c)</enum><header>Circumstances

				required for offense</header><text display-inline="yes-display-inline">A

				circumstance described in this subsection is any of the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDD90C0FB99EF04D06ABE29D967EE3EA31"><enum>(1)</enum><text display-inline="yes-display-inline">Any of the conduct required for the offense

				is, or, in the case of an attempt, threat, or conspiracy to engage in conduct,

				the conduct required for the completed offense would be, engaged in, on,

				against, or affecting a mass transportation provider, owner of a passenger

				vessel, or railroad carrier engaged in or affecting interstate or foreign

				commerce.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9719247946F44AF582352B5B5DDE7FA4"><enum>(2)</enum><text display-inline="yes-display-inline">Any person who travels or communicates

				across a State line in order to commit the offense, or transports materials

				across a State line in aid of the commission of the offense.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2E58DB69B3804D5691DAC3576810F156"><enum>(d)</enum><header>Nonapplicability</header><text display-inline="yes-display-inline">Subsection (a) does not apply to the

				conduct with respect to a destructive substance or destructive device that is

				also classified under chapter 51 of title 49 as a hazardous material in

				commerce if the conduct—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID23A47C28F0AC4DDF8AE5701669D2A629"><enum>(1)</enum><text display-inline="yes-display-inline">complies with chapter 51 of title 49 and

				regulations, exemptions, approvals, and orders issued under that chapter;

				or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDCE472EFD9A34E8D8A99586C833EAB42"><enum>(2)</enum><text display-inline="yes-display-inline">constitutes a violation, other than a

				criminal violation, of chapter 51 of title 49 or a regulation or order issued

				under that chapter.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB7A53F49423E42968AD46E8A45EB1F0F"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID614C33E9F6BE42ED97D7F2DE561AC28B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>biological agent</term> has

				the meaning given the term in section 178(1);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID59581DC204F544D4B53630954DCA1B6B"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>dangerous weapon</term>

				means a weapon, device, instrument, material, or substance, animate or

				inanimate, that is used for, or is readily capable of, causing death or serious

				bodily injury, including a pocket knife with a blade of less than

				2<fraction>1/2</fraction> inches in length and a box cutter;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID885DD5A58CD04B8987F9774725FC2746"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>destructive device</term>

				has the meaning given the term in section 921(a)(4);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB3973FAD82F6491A941A6887A72ABB88"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>destructive substance</term>

				means an explosive substance, flammable material, infernal machine, or other

				chemical, mechanical, or radioactive device or material, or matter of a

				combustible, contaminative, corrosive, or explosive nature, except that the

				term <term>radioactive device</term> does not include any radioactive device or

				material used solely for medical, industrial, research, or other peaceful

				purposes;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB5372E29493C462AB38DE1E64E7FE050"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>hazardous material</term>

				has the meaning given the term in section 5102(2) of title 49;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDB7B9E3D7CAB4A328B912F41242BC8D1"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>high-level radioactive

				waste</term> has the meaning given the term in section 2(12) of the

				<act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (42

				U.S.C. 10101(12));</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43A356ABDD52498AAD9611B76F646728"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>mass transportation</term>

				has the meaning given the term in section 5302(a)(7) of title 49, except that

				the term includes school bus, charter, and sightseeing transportation;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05008D5033FB47D7B74BEBB3190A850C"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>on-track equipment</term>

				means a carriage or other contrivance that runs on rails or electromagnetic

				guideways;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3A985E44BA864E0B9BF0318B8D1973EF"><enum>(9)</enum><text display-inline="yes-display-inline">the term <term>passenger vessel</term> has

				the meaning given the term in section 2101(22) of title 46, United States Code,

				and includes a small passenger vessel (as defined under section 2101(35) of

				that title);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDCF9AF1BDCB549658FF192D1328E4DAF"><enum>(10)</enum><text display-inline="yes-display-inline">the term <term>railroad on-track

				equipment</term> means a train, locomotive, tender, motor unit, freight or

				passenger car, or other on-track equipment used, operated, or employed by a

				railroad carrier;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE099183F498743E499DA6EB12DB3F7A9"><enum>(11)</enum><text display-inline="yes-display-inline">the term <term>railroad</term> has the

				meaning given the term in section 20102(1) of title 49;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD2435B8868EB49988FE33DFD0C5DA82E"><enum>(12)</enum><text display-inline="yes-display-inline">the term <term>railroad carrier</term> has

				the meaning given the term in section 20102(2) of title 49;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID772C830FC35A47BEA8F10698D3BEE8AB"><enum>(13)</enum><text display-inline="yes-display-inline">the term <term>serious bodily injury</term>

				has the meaning given the term in section 1365(h)(3);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA431712652064E38A40401E070C38E56"><enum>(14)</enum><text display-inline="yes-display-inline">the term <term>spent nuclear fuel</term>

				has the meaning given the term in section 2(23) of the

				<act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (42

				U.S.C. 10101(23));</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0996D3BB47CF49F0BEDB709FD0FB2BAF"><enum>(15)</enum><text display-inline="yes-display-inline">the term <term>State</term> has the meaning

				given the term in section 2266(8);</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC470FA3A047149B392C7D9F6C6E23B54"><enum>(16)</enum><text display-inline="yes-display-inline">the term <term>toxin</term> has the meaning

				given the term in section 178(2); and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID380BC55C86D54C199FADEC4BA63731D2"><enum>(17)</enum><text display-inline="yes-display-inline">the term <term>vehicle</term> means any

				carriage or other contrivance used, or capable of being used, as a means of

				transportation on land, on water, or through the

				air.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3B868D42D9EB4B76B0643CF520F05377"><enum>(b)</enum><header>Conforming

			 amendments</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID06768A2A50A94EE08FC159BEF09AD73A"><enum>(1)</enum><header>Table of

			 inserting <quote>1992 (relating to terrorist attacks and other acts of violence

			 against railroad carriers and against mass transportation systems on land, on

			 water, or through the air),</quote>;</text>
