				hemicellulosic matter that is available on a renewable or recurring basis,

										<header>Renewable fuel</header>

											<enum>(i)</enum>

											<header>In general</header>

											<text display-inline="yes-display-inline">The term <term>renewable

				fuel</term> means motor vehicle fuel that—</text>

											<subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID860ECF41900144B7B1225300C4338726">

												<enum>(I)</enum>

												<item commented="no" display-inline="yes-display-inline" id="idE1892D5BEC484CD8A0BDC2B6F875251E"><enum>(aa)</enum>

													<text display-inline="yes-display-inline">is produced from grain,

				starch, oilseeds, or other biomass; or</text>

												</item><item changed="not-changed" commented="no" display-inline="no-display-inline" id="ID12B2FE18B3D8424980DA4053F15673B2" indent="up1">

													<enum>(bb)</enum>

													<text display-inline="yes-display-inline">is natural gas produced

				from a biogas source, including a landfill, sewage waste treatment plant,

				feedlot, or other place where decaying organic material is found; and</text>

												</item></subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8C085F4BF83E4F0DB91729005DF74053">

												<enum>(II)</enum>

												<text display-inline="yes-display-inline">is used to replace or

				reduce the quantity of fossil fuel present in a fuel mixture used to operate a

				motor vehicle.</text>

											</subclause></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID379AE84E11394282AF584146524E99E6">

											<enum>(ii)</enum>

											<header>Inclusion</header>

											<text display-inline="yes-display-inline">The term <term>renewable

				fuel</term> includes—</text>

											<subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8376F5EA5C5D4A2AACE8F11D99C649C6">

												<enum>(I)</enum>

												<text display-inline="yes-display-inline">cellulosic biomass ethanol;

				and</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDB1AB8F604FA94BCBA86EAD189C001B4B">

												<enum>(II)</enum>

												<text display-inline="yes-display-inline">biodiesel (as defined in

				section 312(f) of the Energy Policy Act of 1992 (42 U.S.C. 13220(f))).</text>

											</subclause></clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID7A339AE82ECA4C00A13DA1DD752C00F5">

										<enum>(C)</enum>

										<header>Small refinery</header>

										<text display-inline="yes-display-inline">The term <term>small

				refinery</term> means a refinery for which the average aggregate daily crude

				oil throughput for a calendar year (as determined by dividing the aggregate

				throughput for the calendar year by the number of days in the calendar year)

				does not exceed 75,000 barrels.</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID39C4AA762A2F4C68A7069958F43893F3">

									<enum>(2)</enum>

									<header>Renewable fuel program</header>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID712CCBE62E444D2AB47E7CE351E17ECC">

										<enum>(A)</enum>

										<header>Regulations</header>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID48D147991BDD433EAF9738B9F64004B4">

											<enum>(i)</enum>

											<header>In general</header>

											<text display-inline="yes-display-inline">Not later than 1 year after

				the date of enactment of this paragraph, the Administrator shall promulgate

				regulations to ensure that gasoline sold or introduced into commerce in the

				United States (except in Alaska and Hawaii), on an annual average basis,

				contains the applicable volume of renewable fuel determined in accordance with

				subparagraph (B).</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDCE97DC680E4146F595AA58CE439824F9">

											<enum>(ii)</enum>

											<header>Provisions of regulations</header>

											<text display-inline="yes-display-inline">Regardless of the date of

				promulgation, the regulations promulgated under clause (i)—</text>

											<subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF80057E2AB0E48B19322163800E70418">

												<enum>(I)</enum>

												<text display-inline="yes-display-inline">shall contain compliance

				provisions applicable to refineries, blenders, distributors, and importers, as

				appropriate, to ensure that the requirements of this paragraph are met;

				but</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID47647378EF19485BB4D95CE5B7F7D353">

												<enum>(II)</enum>

												<text display-inline="yes-display-inline">shall not—</text>

												<item changed="not-changed" commented="no" display-inline="no-display-inline" id="ID0FFF939BD3104AE591D359944996A132">

													<enum>(aa)</enum>

													<text display-inline="yes-display-inline">restrict cases in which

				renewable fuel may be used; or</text>

												</item><item changed="not-changed" commented="no" display-inline="no-display-inline" id="ID9BC5C47B15BF4B508843F834B42F1200">

													<enum>(bb)</enum>

													<text display-inline="yes-display-inline">impose any per-gallon

				obligation for the use of renewable fuel.</text>

												</item></subclause></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID274ED427C530487CB4BC2BD77B47F009">

											<enum>(iii)</enum>

											<header>Requirement in case of failure to promulgate

				regulations</header>

											<text display-inline="yes-display-inline">If the Administrator does

				not promulgate regulations under clause (i), the percentage of renewable fuel

				in gasoline sold or dispensed to consumers in the United States, on a volume

				basis, shall be 1.8 percent for calendar year 2006.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID7B9E12F7DD374E0B9C44480092428CBC">

										<enum>(B)</enum>

										<header>Applicable volume</header>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDB03A3E21E21149FFA76751DCBE81EC9B">

											<enum>(i)</enum>

											<header>Calendar years 2006 through 2012</header>

											<text display-inline="yes-display-inline">For the purpose of

				subparagraph (A), the applicable volume for any of calendar years 2006 through

				2012 shall be determined in accordance with the following table:</text>

				subparagraph (A), the applicable volume for calendar year 2013 and each

				calendar year thereafter shall be equal to the product obtained by

				multiplying—</text>

												<enum>(I)</enum>

												<text display-inline="yes-display-inline">the number of gallons of

				gasoline that the Administrator estimates will be sold or introduced into

				commerce in the calendar year; and</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID9BF5A40DA6424D39AE005C9417BEE558">

												<enum>(II)</enum>

												<text display-inline="yes-display-inline">the ratio that—</text>

													<enum>(aa)</enum>

													<text display-inline="yes-display-inline">5,000,000,000 gallons of

				renewable fuel; bears to</text>

													<enum>(bb)</enum>

													<text display-inline="yes-display-inline">the number of gallons of

				gasoline sold or introduced into commerce in calendar year 2012.</text>

									<enum>(3)</enum>

									<header>Applicable percentages</header>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF4CD0844BC8B44E8A2C266E447CABC26">

										<enum>(A)</enum>

										<header>Provision of estimate of volumes of Gasoline sales</header>

										<text display-inline="yes-display-inline">Not later than October 31

				of each of calendar years 2005 through 2011, the Administrator of the Energy

				Information Administration shall provide to the Administrator of the

				Environmental Protection Agency an estimate of the volumes of gasoline sold or

				introduced into commerce in the United States during the following calendar

				year.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID96A9DB13588B49249181AED1C397F6C3">

										<enum>(B)</enum>

										<header>Determination of applicable percentages</header>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID37F98D416EFB45A0AE127E3D5BCB46F9">

											<enum>(i)</enum>

											<header>In general</header>

											<text display-inline="yes-display-inline">Not later than November 30

				of each of calendar years 2005 through 2011, based on the estimate provided

				under subparagraph (A), the Administrator of the Environmental Protection

				Agency shall determine and publish in the Federal Register, with respect to the

				following calendar year, the renewable fuel obligation that ensures that the

				requirements of paragraph (2) are met.</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID24CA3D448ED044C0B3D1A3DAD6EB0000">

											<enum>(ii)</enum>

											<header>Required elements</header>

											<text display-inline="yes-display-inline">The renewable fuel

				obligation determined for a calendar year under clause (i) shall—</text>

											<subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDE16FB50207BC425A85DB812E00D90014">

												<enum>(I)</enum>

												<text display-inline="yes-display-inline">be applicable to

				refineries, blenders, and importers, as appropriate;</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID5AFBB117C3314971A34EAB28000079D4">

												<enum>(II)</enum>

												<text display-inline="yes-display-inline">be expressed in terms of a

				volume percentage of gasoline; and</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2F6C851C5ED64B20A703E3EA074200FC">

												<enum>(III)</enum>

												<text display-inline="yes-display-inline">subject to subparagraph

				(C)(i), consist of a single applicable percentage that applies to all

				categories of persons specified in subclause (I).</text>

											</subclause></clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID5E9BC2AE7E28418100AE003C9CA7BCC2">

										<enum>(C)</enum>

										<header>Adjustments</header>

										<text display-inline="yes-display-inline">In determining the

				applicable percentage for a calendar year, the Administrator shall make

				adjustments—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDB86773EB28174F3AB14CEE5BAA5EC1AF">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">to prevent the imposition

				of redundant obligations on any person specified in subparagraph (B)(ii)(I);

				and</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID79DCE86A8B374A7FB3D325A2202C4B9C">

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">to account for the use of

				renewable fuel during the previous calendar year by small refineries that are

				exempt under paragraph (9).</text>

										</clause></subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDEA32BB635DAE4119B0CDAB2781EF7D61">

									<enum>(4)</enum>

									<header>Credit program</header>

										<enum>(A)</enum>

										<header>In general</header>

										<text display-inline="yes-display-inline">The regulations promulgated

				under paragraph (2)(A) shall provide—</text>

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">for the generation of an

				appropriate amount of credits by any person that refines, blends, or imports

				gasoline that contains a quantity of renewable fuel that is greater than the

				quantity required under paragraph (2);</text>

				credits by small refineries in accordance with paragraph (9)(C).</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID1E204C0A0B3C47A3BF301711A7AC1DF7">

										<enum>(B)</enum>

										<header>Use of credits</header>

										<text display-inline="yes-display-inline">A person that generates

				credits under subparagraph (A) may use the credits, or transfer all or a

				portion of the credits to another person, for the purpose of complying with

				paragraph (2).</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID16781AA2C44D480EAB0016CA4432356F">

										<enum>(C)</enum>

										<header>Duration of credits</header>

										<text display-inline="yes-display-inline">A credit generated under

				this paragraph shall be valid to show compliance—</text>

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">subject to clause (ii), for

				the calendar year in which the credit was generated or the following calendar

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">if the Administrator

				promulgates regulations under paragraph (6), for the calendar year in which the

				credit was generated or any of the following 2 calendar years.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDDFD3D95B38D34ED495B7FD882921745B">

										<enum>(D)</enum>

										<header>Inability to generate or purchase sufficient credits</header>

										<text display-inline="yes-display-inline">The regulations promulgated

				under paragraph (2)(A) shall include provisions allowing any person that is

				unable to generate or purchase sufficient credits to meet the requirements of

				paragraph (2) to carry forward a renewable fuel deficit on condition that the

				person, in the calendar year following the year in which the renewable fuel

				deficit is created—</text>

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">achieves compliance with

				the renewable fuel requirement under paragraph (2); and</text>

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">generates or purchases

				additional renewable fuel credits to offset the renewable fuel deficit of the

				previous year.</text>

										</clause></subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF07B62CAA2934D3781FC728139F85279">

									<enum>(6)</enum>

									<header>Seasonal variations in renewable fuel use</header>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF633E7CDEC0442D8955C59CDE27307A1">

										<enum>(A)</enum>

										<header>Study</header>

										<text display-inline="yes-display-inline">For each of calendar years

				2006 through 2012, the Administrator of the Energy Information Administration

				shall conduct a study of renewable fuel blending to determine whether there are

				excessive seasonal variations in the use of renewable fuel.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8E7324CF84AF4BD28F08EF40F200B850">

										<enum>(B)</enum>

										<header>Regulation of excessive seasonal variations</header>

										<text display-inline="yes-display-inline">If, for any calendar year,

				the Administrator of the Energy Information Administration, based on the study

				under subparagraph (A), makes the determinations specified in subparagraph (C),

				the Administrator of the Environmental Protection Agency shall promulgate

				regulations to ensure that 35 percent or more of the quantity of renewable fuel

				necessary to meet the requirements of paragraph (2) is used during each of the

				2 periods specified in subparagraph (D) of each subsequent calendar

				year.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDA8D7550376564C2E84BEC73BE2C4DBF6">

										<enum>(C)</enum>

										<header>Determinations</header>

										<text display-inline="yes-display-inline">The determinations referred

				to in subparagraph (B) are that—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID52DCA236FB504E2295A3B000C431C8D6">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">less than 35 percent of the

				quantity of renewable fuel necessary to meet the requirements of paragraph (2)

				has been used during 1 of the 2 periods specified in subparagraph (D) of the

				calendar year; and</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID0535AFB69AA044E6933E2F485E353419">

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">a pattern of excessive

				seasonal variation described in clause (i) will continue in subsequent calendar

				years.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF1598FB598434330AEA6CA08415ED9A9">

										<enum>(D)</enum>

										<header>Periods</header>

										<text display-inline="yes-display-inline">The 2 periods referred to

				in this paragraph are—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDD0A4ED21D9014ED3A7D22E592DD6C771">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">April through September;

				and</text>

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">January through March and

				October through December.</text>

										<header>Exclusion</header>

										<text display-inline="yes-display-inline">Renewable fuel blended or

				consumed in calendar year 2006 in a State that has received a waiver under

				section 209(b) shall not be included in the study under subparagraph

				(A).</text>

									<enum>(7)</enum>

									<header>Waivers</header>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID04A9945393CC46B2A9E1D51F013623E0">

										<enum>(A)</enum>

										<header>In general</header>

										<text display-inline="yes-display-inline">The Administrator, in

				consultation with the Secretary of Agriculture and the Secretary of Energy, may

				waive the requirements of paragraph (2) in whole or in part on petition by 1 or

				more States by reducing the national quantity of renewable fuel required under

				paragraph (2)—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID45723765B28D4A73A2F5CDD7BB4FAF69">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">based on a determination by

				the Administrator, after public notice and opportunity for comment, that

				implementation of the requirement would severely harm the economy or

				environment of a State, a region, or the United States; or</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDB28675F6B7E64326BB35DCE5447CE450">

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">based on a determination by

				the Administrator, after public notice and opportunity for comment, that there

				is an inadequate domestic supply or distribution capacity to meet the

				requirement.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID6784A99B2537448E972DB3959998A42C">

										<enum>(B)</enum>

										<header>Petitions for waivers</header>

										<text display-inline="yes-display-inline">The Administrator, in

				consultation with the Secretary of Agriculture and the Secretary of Energy,

				shall approve or disapprove a State petition for a waiver of the requirements

				of paragraph (2) within 90 days after the date on which the petition is

				received by the Administrator.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDD9207F1FD13C41468F3E7E6C3BA6039B">

										<enum>(C)</enum>

										<header>Termination of waivers</header>

										<text display-inline="yes-display-inline">A waiver granted under

				subparagraph (A) shall terminate after 1 year, but may be renewed by the

				Administrator after consultation with the Secretary of Agriculture and the

				Secretary of Energy.</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDAF562AD430F14644B5003065BBF025C9">

									<enum>(8)</enum>

									<header>Study and waiver for initial year of program</header>

									<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID33F2CD8D1FBB4CC88BE5E42D507BF390">

										<enum>(A)</enum>

										<header>In general</header>

										<text display-inline="yes-display-inline">Not later than 180 days

				after the date of enactment of this paragraph, the Secretary of Energy shall

				conduct for the Administrator a study assessing whether the renewable fuel

				requirement under paragraph (2) will likely result in significant adverse

				impacts on consumers in 2006, on a national, regional, or State basis.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID0FFC6530B7A24698A9AA6B492832DC96">

										<enum>(B)</enum>

										<header>Required evaluations</header>

										<text display-inline="yes-display-inline">The study shall evaluate

				renewable fuel—</text>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF0085F50756847989B12C2C17100BBD8">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">supplies and prices;</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDFD3B5DAFD3764123988162E68133F4AB">

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">blendstock supplies;

				and</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID1BBB609BE1D649F800ED00D89514C780">

											<enum>(iii)</enum>

											<text display-inline="yes-display-inline">supply and distribution

				system capabilities.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID8061BF224A0C4C12A82DFA9D4161262F">

										<enum>(C)</enum>

										<header>Recommendations by the Secretary</header>

										<text display-inline="yes-display-inline">Based on the results of the

				study, the Secretary of Energy shall make specific recommendations to the

				Administrator concerning waiver of the requirements of paragraph (2), in whole

				or in part, to prevent any adverse impacts described in subparagraph

				(A).</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID278912DA56D247B9AC4210646FCF55EF">

										<enum>(D)</enum>

										<header>Waiver</header>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2D516427B2104E8EB87900B45BF40207">

											<enum>(i)</enum>

											<header>In general</header>

											<text display-inline="yes-display-inline">Not later than 270 days

				after the date of enactment of this paragraph, the Administrator shall, if and

				to the extent recommended by the Secretary of Energy under subparagraph (C),

				waive, in whole or in part, the renewable fuel requirement under paragraph (2)

				by reducing the national quantity of renewable fuel required under paragraph

				(2) in calendar year 2006.</text>

				2008, the Secretary of Energy shall conduct for the Administrator a study to

				determine whether compliance with the requirements of paragraph (2) would

				impose a disproportionate economic hardship on small refineries.</text>

											</subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID2C2C91CB6E35470B8877D302012C48FD">

												<enum>(II)</enum>

												<header>Extension of exemption</header>

												<text display-inline="yes-display-inline">In the case of a small

				refinery that the Secretary of Energy determines under subclause (I) would be

				subject to a disproportionate economic hardship if required to comply with

				paragraph (2), the Administrator shall extend the exemption under clause (i)

				for the small refinery for a period of not less than 2 additional years.</text>

											</subclause></clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID9CC71634804447B98486879C7B169776">

										<enum>(B)</enum>

										<header>Petitions based on disproportionate economic

				hardship</header>

										<clause changed="not-changed" commented="no" display-inline="no-display-inline" id="IDD2E1C26FD1BE4D2D97E29635FD577196">

											<enum>(i)</enum>

											<header>Extension of exemption</header>

											<text display-inline="yes-display-inline">A small refinery may at any

				time petition the Administrator for an extension of the exemption under

				subparagraph (A) for the reason of disproportionate economic hardship.</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID12A37DCA54C141FB8FAEA5C3DFC95FB8">

											<enum>(ii)</enum>

											<header>Evaluation of petitions</header>

											<text display-inline="yes-display-inline">In evaluating a petition

				under clause (i), the Administrator, in consultation with the Secretary of

				Energy, shall consider the findings of the study under subparagraph (A)(ii) and

				other economic factors.</text>

										</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID35CBDD6B18BD4B4FA49925CADF18BF8C">

											<enum>(iii)</enum>

											<header>Deadline for action on petitions</header>

											<text display-inline="yes-display-inline">The Administrator shall act

				on any petition submitted by a small refinery for a hardship exemption not

				later than 90 days after the date of receipt of the petition.</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID08B98B334BA7433989BA2BA2DD9C003B">

										<enum>(C)</enum>

										<header>Credit program</header>

										<text display-inline="yes-display-inline">If a small refinery

				notifies the Administrator that the small refinery waives the exemption under

				subparagraph (A), the regulations promulgated under paragraph (2)(A) shall

				provide for the generation of credits by the small refinery under paragraph (5)

				beginning in the calendar year following the date of notification.</text>

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID94F16D0D42064CC99E0995CF8F87855B">

										<enum>(D)</enum>

										<header>Opt-in for small refineries</header>

										<text display-inline="yes-display-inline">A small refinery shall be

				subject to the requirements of paragraph (2) if the small refinery notifies the

				Administrator that the small refinery waives the exemption under subparagraph

				(A).</text>

				Federal Trade Commission shall perform a market concentration analysis of the

				ethanol production industry using the Herfindahl-Hirschman Index to determine

				whether there is sufficient competition among industry participants to avoid

				price-setting and other anticompetitive behavior.</text>

											<enum>(ii)</enum>

											<header>Scoring</header>

											<text display-inline="yes-display-inline">For the purpose of scoring

				under clause (i) using the Herfindahl-Hirschman Index, all marketing

				arrangements among industry participants shall be considered.</text>

										<header>Report</header>

				Congress and the Administrator a report on the results of the market

				concentration analysis performed under subparagraph (A)(i).</text>

										<text display-inline="yes-display-inline">Notwithstanding any other

				provision of Federal or State law, no renewable fuel (as defined in subsection

				(o)(1)) used or intended to be used as a motor vehicle fuel, nor any motor

				vehicle fuel containing renewable fuel, shall be deemed to be defective in

				design or manufacture by reason of the fact that the fuel is, or contains,

				renewable fuel, if—</text>

											<text display-inline="yes-display-inline">the manufacturer of the

				fuel is in compliance with all requests for information under subsection

				(b).</text>

										</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDE33E74AFD1E84BBE9FA708FDF6A3CB81">

										<enum>(B)</enum>

										<header>Safe harbor not applicable</header>

										<text display-inline="yes-display-inline">In any case in which

				subparagraph (A) does not apply to a quantity of fuel, the existence of a

				design defect or manufacturing defect with respect to the fuel shall be

				determined under otherwise applicable law.</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDE0A580329B8D41778B36C5E2E069AEC0">

				Federal Nonnuclear Energy Research and Development Act of 1974 (42 U.S.C. 5919)

				to carry out celluosic biomass commercial demonstration projects.</text>

										<text display-inline="yes-display-inline">The Secretary shall issue

				loan guarantees under this section to carry out not more than 3 projects to

				commercially demonstrate the feasibility and viability of converting celluosic

				biomass derived from agricultural residue such as corn stover or straw

				(including at least 1 project that uses cereal straw as a feedstock or

				municipal solid waste) into ethanol.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8C47B92B9C6A4DB28EB659E070769D9B">

										<enum>(B)</enum>

										<header>Design capacity</header>

										<text display-inline="yes-display-inline">Each project shall have a

				design capacity to produce at least 30,000,000 gallons of cellulose ethanol

				each year.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7935354223904507A8D0EF0E6D661B1E">

									<enum>(3)</enum>

									<header>Applicant assurances</header>

									<text display-inline="yes-display-inline">An applicant for a loan

				guarantee under this section shall provide assurances, satisfactory to the

				Secretary, that—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID21A3935184FE4324ACC645CBA9008916">

										<enum>(A)</enum>

										<text display-inline="yes-display-inline">the project design has been

				validated through the operation of a continuous process facility with a

				cumulative output of at least 50,000 gallons of ethanol;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA7CB56E9C0A24692B5670D09BFB8CCF4">

										<enum>(B)</enum>

										<text display-inline="yes-display-inline">the project has been

				subject to a full technical review;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3F97CF730B444D32AE098477ADF5CD7E">

										<enum>(C)</enum>

										<text display-inline="yes-display-inline">the project is covered by

				adequate project performance guarantees;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41C45F0FCF804B368D1F8BA1F2954A67">

										<enum>(D)</enum>

										<text display-inline="yes-display-inline">the project, with the loan

				guarantee, is economically viable; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFF1B7B16AC91434299B7FDC6605246D3">

										<enum>(E)</enum>

										<text display-inline="yes-display-inline">there is a reasonable

				assurance of repayment of the guaranteed loan.</text>

				subparagraph (B), notwithstanding section 19(c)(2)(A) of the Federal Nonnuclear

				guarantee under this section may be issued for up to 80 percent of the

				estimated cost of a project, but may not exceed $250,000,000 for a

				project.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA0A6651F668840958598837694F70552">

										<enum>(B)</enum>

										<header>Additional guarantees</header>

				additional loan guarantees for a project to cover up to 80 percent of the

				excess of actual project cost over estimated project cost but not to exceed 15

				percent of the amount of the original guarantee.</text>

									<header>Equity contributions</header>

				guarantee under this section, an applicant for the loan guarantee shall have

				binding commitments from equity investors to provide an initial equity

				contribution of at least 20 percent of the total project cost.</text>

									<enum>(6)</enum>

									<header>Effect of other laws</header>

				are inapplicable to a loan guarantee made under this section:</text>

				appropriated, for a resource center to further develop bioconversion technology

				using low-cost biomass for the production of ethanol at the Center for

				Biomass-Based Energy at the University of Mississippi and the University of

				Oklahoma, $4,000,000 for each of fiscal years 2004 through 2006.</text>

							</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="IDFE4C194FA39745CC8266BAFB2109384F">

								<enum>(e)</enum>

								<header>Renewable fuel production research and development

				grants</header>

								<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID935D33D491304443B7C0FB9500847D98">

									<text display-inline="yes-display-inline">The Administrator shall

				provide grants for the research into, and development and implementation of,

				renewable fuel production technologies in RFG States with low rates of ethanol

				production, including low rates of production of cellulosic biomass

				ethanol.</text>

				receive a grant under this subsection are academic institutions in RFG States,

									</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDB373D97B84434C29A2FD6D3309530488">

										<enum>(B)</enum>

										<header>Application</header>

										<text display-inline="yes-display-inline">To be eligible to receive a

				grant under this subsection, an eligible entity shall submit to the

				Administrator an application in such manner and form, and accompanied by such

				information, as the Administrator may specify.</text>

									</subparagraph></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="IDF80BF35D1B834B859C2E1C3025969EEB">

				grants to merchant producers of cellulosic biomass ethanol in the United States

				to assist the producers in building eligible production facilities described in

				paragraph (2) for the production of cellulosic biomass ethanol.</text>

			 nationwide at low levels in gasoline to replace lead as an octane booster or

			 anti-knocking agent;</text>

									<enum>(D)</enum>

									<header>Publication of notice</header>

									<text display-inline="yes-display-inline">The Administrator shall

				publish in the Federal Register each notice submitted by a State under

				subparagraph (C).</text>

								</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID55A18E78AF4D4E09BCB85085CC6B597D">

									<enum>(E)</enum>

									<header>Trace quantities</header>

									<text display-inline="yes-display-inline">In carrying out

				subparagraph (A), the Administrator may allow trace quantities of methyl

				tertiary butyl ether, not to exceed 0.5 percent by volume, to be present in

				motor vehicle fuel in cases that the Administrator determines to be

				appropriate.</text>

								<header>MTBE merchant producer conversion assistance</header>

										<header>Grants</header>

										<text display-inline="yes-display-inline">The Secretary of Energy, in

				consultation with the Administrator, may make grants to merchant producers of

				methyl tertiary butyl ether in the United States to assist the producers in the

				conversion of eligible production facilities described in subparagraph (C) to

				the production of—</text>

										<subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ID6D7A5565D7D240CF805E05C9B1A53687">

											<enum>(I)</enum>

											<text display-inline="yes-display-inline">iso-octane or alkylates,

				unless the Administrator, in consultation with the Secretary of Energy,

				determines that transition assistance for the production of iso-octane or

				alkylates is inconsistent with the criteria specified in subparagraph (B);

				and</text>

											<enum>(II)</enum>

											<text display-inline="yes-display-inline">any other fuel additive

				that meets the criteria specified in subparagraph (B).</text>

									<enum>(B)</enum>

									<header>Criteria</header>

									<text display-inline="yes-display-inline">The criteria referred to in

				subparagraph (A) are that—</text>

				consistent with this subsection;</text>

										<enum>(ii)</enum>

										<text display-inline="yes-display-inline">the Administrator has not

				determined that the fuel additive may reasonably be anticipated to endanger

				public health or the environment;</text>

										<enum>(iii)</enum>

										<text display-inline="yes-display-inline">the fuel additive has been

				registered and tested, or is being tested, in accordance with the requirements

				of this section; and</text>

										<enum>(iv)</enum>

										<text display-inline="yes-display-inline">the fuel additive will

				contribute to replacing quantities of motor vehicle fuel rendered unavailable

				as a result of paragraph (5).</text>

									</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID5F0C918EAA09469DA92E7144D644B812">

									<enum>(C)</enum>

									<header>Eligible production facilities</header>

									<text display-inline="yes-display-inline">A production facility shall

				be eligible to receive a grant under this paragraph if the production

				facility—</text>

				the average annual quantity of reformulated gasoline produced or distributed by

				the refiner or importer during calendar years 1999 and 2000.</text>

				in excess of the quantity subject to subclause (I) shall be subject to

				standards for emissions of toxic air pollutants promulgated under subparagraph

				(A) and paragraph (3)(B).</text>

									<enum>(iv)</enum>

									<header>Credit program</header>

									<text display-inline="yes-display-inline">The Administrator shall

				provide for the granting and use of credits for emissions of toxic air

				pollutants in the same manner as provided in paragraph (7).</text>

				in a PADD fails to meet or exceed the reduction of the average annual aggregate

				emissions of toxic air pollutants in the PADD in calendar years 1999 and 2000,

				the Administrator, not later than 90 days after the date of publication of the

				regulations promulgated under clause (ii), to take effect not earlier than 180

				days but not later than 270 days after the date of promulgation, to provide

				that, notwithstanding clause (iii)(II), all reformulated gasoline produced or

				distributed at each refiner or importer shall meet the standards applicable

				under clause (iii)(I) beginning not later than April 1 of the calendar year

				following publication of the report under subclause (I) and in each calendar

				year thereafter.</text>

					</paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID0886E16293874F37A1F6E8CC659F5965">

					<enum>(d)</enum>

					<header>Consolidation in reformulated Gasoline regulations</header>

					<text display-inline="yes-display-inline">Not later than 180 days after

			 the date of enactment of this Act, the Administrator of the Environmental

			 Protection Agency shall revise the reformulated gasoline regulations under

			 subpart D of part 80 of title 40, Code of Federal Regulations, to consolidate

			 the regulations applicable to VOC-Control Regions 1 and 2 under section 80.41

			 of that title by eliminating the less stringent requirements applicable to

			 gasoline designated for VOC-Control Region 2 and instead applying the more

			 stringent requirements applicable to gasoline designated for VOC-Control Region

			 1.</text>

			 any adjustments to the standards applicable to a refinery or importer under

			 Environmental Protection Agency and the Secretary of Energy shall jointly

			 conduct a study of Federal, State, and local requirements concerning motor

			 vehicle fuels, including—</text>

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">the effect of the

			 requirements described in paragraph (1) on emissions from vehicles, refiners,

			 and fuel handling facilities;</text>

						</subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID5DB24A622E9D41378C7142EE431196B2">

							<enum>(E)</enum>

							<text display-inline="yes-display-inline">the feasibility of developing

			 national or regional motor vehicle fuel slates for the 48 contiguous States

			 that, while protecting and improving air quality at the national, regional, and

			 local levels, could—</text>

			 to the gasoline market; and</text>

								<enum>(iv)</enum>

								<text display-inline="yes-display-inline">enhance fuel quality,

			 consistency, and supply; and</text>

							</clause></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ID74A830A8B7C84CD9808BA92F2FC1D855">

							<enum>(F)</enum>

							<text display-inline="yes-display-inline">the feasibility of providing

			 incentives, and the need for the development of national standards necessary,

			 to promote cleaner burning motor vehicle fuel.</text>

			 required modifications to refinery and fuel distribution systems in order to

			 ensure an adequate supply of motor vehicle fuel in all States.</text>
