			 <quote><short-title>Betty Dick Residence Protection

			 Act</short-title></quote>.</text>

			<subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id84B947CAC1B54F22822152F2BBAEFFE5" reported-display-style="strikethrough"><enum></enum><text display-inline="yes-display-inline">Congress finds that—</text>

				<paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID175969721C5A45548D9480A96F7AB7E4" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">before their divorce, Fred and Marilyn

			 Dick, owned as tenants in common a tract of land that included the property

			 described in section 5(b);</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID195926A8B0CB4495994E4F082A0F968A" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">when Fred and Marilyn Dick divorced,

			 Marilyn Dick became the sole owner of the tract of land, but Fred Dick retained

			 the right of first refusal to acquire the tract of land;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDAFF189CD6FCE4E8FA923F4E307B2FC99" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">in 1977, Marilyn Dick sold the tract to the

			 United States for addition to Rocky Mountain National Park, but Fred Dick,

			 asserting his right of first refusal, sued to cancel the transaction;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDA0B7BE8F2B4443D3AA4093D95EAAC910" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">in 1980, the lawsuit was settled through an

			 agreement between the National Park Service, Fred Dick, and the heirs,

			 successors, and assigns of Fred Dick;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDD25D98C917524A2EB7948CF54BAF989A" reported-display-style="strikethrough"><enum>(5)</enum><text display-inline="yes-display-inline">under the 1980 settlement agreement, Fred

			 Dick and his wife, Betty Dick, were allowed to lease and occupy the 23 acres

			 comprising the property described in section 5(b) for 25 years;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDE8813AC8B0BC44DD93DEF5AF3FACC970" reported-display-style="strikethrough"><enum>(6)</enum><text display-inline="yes-display-inline">Fred Dick died in 1992, but Betty Dick has

			 continued to lease and occupy the property described in section 5(b) under the

			 terms of the settlement agreement;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDD997C9F44CFC41CA8C18D0A069ECBCEA" reported-display-style="strikethrough"><enum>(7)</enum><text display-inline="yes-display-inline">Betty Dick’s right to lease and occupy the

			 property described in section 5(b) will expire on July 16, 2005, at which time

			 Betty Dick will be 83 years old;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID4A843E98AF8041149D6D77C11D9D01E5" reported-display-style="strikethrough"><enum>(8)</enum><text display-inline="yes-display-inline">Betty Dick wishes to continue to occupy the

			 property for the remainder of her life and has sought to enter into a new

			 agreement with the National Park Service that would allow her to continue to

			 occupy the property;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id422F903CA11F4E919B6F8E14545101BE" reported-display-style="strikethrough"><enum>(9)</enum><text display-inline="yes-display-inline">the National Park Service has not been

			 willing to enter into a new agreement with Betty Dick and is demanding that she

			 vacate the property by July 16, 2005;</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDCDEACCD778504F598372A14E97EF200E" reported-display-style="strikethrough"><enum>(10)</enum><text display-inline="yes-display-inline">since 1980, Betty Dick—</text>

					<subparagraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id6E501F0E6D3E48AF9B2640B8F7DD720B" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">has consistently occupied the property

			 described in section 5(b) as a summer residence;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idB52F95737B9543ADB5E4A2656F939820" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">has made the property available for

			 community events; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id06A9900B79B14E12AD4BFF76A362DA1F" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">has been a good steward of the

			 property;</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id53B864555A774C7E993D5AF9B216D591" reported-display-style="strikethrough"><enum>(11)</enum><text display-inline="yes-display-inline">Betty Dick's occupancy of the property has

			 not—</text>

					<subparagraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id7D3D766340F74523BFAFD612C4C4C090" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">been detrimental to the resources and

			 values of Rocky Mountain National Park; or</text>

					</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idDCD62A77B20C4ACFA4699BAD24F4D1FC" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">created problems for the National Park

			 Service or the public; and</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID3E35CFCCB6DE4C49956E257B3136BE08" reported-display-style="strikethrough"><enum>(12)</enum><text display-inline="yes-display-inline">under the circumstances, it is appropriate

			 for Betty Dick to be allowed to continue her occupancy of the property

			 described in section 5(b) for the remainder of her natural life under the terms

			 and conditions applicable to her occupancy of the property since 1980.</text>

			 Secretary of the Interior to permit the continued occupancy and use of the

			 property described in section 5(b) by Betty Dick for the remainder of her

			 natural life.</text>

			<subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id321A47DE689446C1BFC17519ADB0D2D3" reported-display-style="strikethrough"><enum></enum><text display-inline="yes-display-inline">In this Act:</text>

				<paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id5D0A2A2B8B1A4AFCA4E34CB9B3121DE4" reported-display-style="strikethrough"><enum>(1)</enum><header>Agreement</header><text display-inline="yes-display-inline">The term <quote>Agreement</quote> means the

			 agreement between the National Park Service and Fred Dick entitled

			 <quote>Settlement Agreement</quote> and dated July 17, 1980.</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id8756D17A527A4049BBCCF396AF84A91D" reported-display-style="strikethrough"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map

			 entitled <quote>Betty Dick Residence and Barn</quote> and dated January

			 Secretary of the Interior.</text>

			 occupancy</header>

			<subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDB4865EBE0B0045A8861DBA7FAEF91A0E" reported-display-style="strikethrough"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 allow Betty Dick to continue to occupy and use the property described in

			 subsection (b) for the remainder of the natural life of Betty Dick, subject to

			 the requirements of this Act.</text>

			</subsection><subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDD080C21D9DC64E2487336411F907909A" reported-display-style="strikethrough"><enum>(b)</enum><header>Description of

			 property</header><text display-inline="yes-display-inline">The property

			 referred to in subsection (a) is the land and any improvements to the land

			 within the boundaries of Rocky Mountain National Park identified on the map as

			 <quote>residence</quote>, <quote>occupancy area</quote>, and

			 <quote>barn</quote>.</text>

			</subsection><subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID218AC6218F054F06BA668BEBBC6B39A8" reported-display-style="strikethrough"><enum>(c)</enum><header>Terms and

			 conditions</header>

				<paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id5587DA0A21414B40BF547F2F86CF1BEA" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 paragraph (2), the occupancy and use of the property identified in subsection

			 (b) by Betty Dick shall be subject to the same terms and conditions specified

			 in the Agreement.</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idE1968F3DBB5C47BC8886CFE211C7C844" reported-display-style="strikethrough"><enum>(2)</enum><header>Payment</header><text display-inline="yes-display-inline">In exchange for the continued use and

			 occupancy of the property, Betty Dick shall annually pay to the Secretary an

			 amount equal to <fraction>1/25</fraction> of the amount specified in section

			 3(B) of the Agreement.</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="IDE9C1C183A83B4692B032E2C13A529023" reported-display-style="strikethrough"><enum>(d)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this Act—</text>

				<paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id0A7E6410F3934124A191920CEF8A9878" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">allows the construction of any structure on

			 the property described in subsection (b) not in existence on November 30, 2004;

			 or</text>

				</paragraph><paragraph changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id54F412A13DCE4348BD2BB2C0E98A3C9D" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">applies to the occupancy or use of the

			 property described in subsection (b) by any person other than Betty

			 Dick.</text>

			 Act may be cited as the <quote><short-title>Betty Dick

			 Residence Protection Act</short-title></quote>.</text>

			 this Act:</text>

				<paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id2844069f-562e-45af-b687-a259380efa97" reported-display-style="italic"><enum>(1)</enum><header>Agreement</header><text display-inline="yes-display-inline">The term <quote>Agreement</quote> means the

			 agreement between the National Park Service and Fred Dick entitled

			 <quote>Settlement Agreement</quote> and dated July 17, 1980.</text>

				</paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idf16db75b-0186-40f8-85c6-4bf595b98afb" reported-display-style="italic"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map

			 entitled <quote>RMNP Land Occupancy</quote> and dated September 2005, which

			 identifies approximately 8 acres for the occupancy and use by the

			 tenant.</text>

				</paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idb712bf65-e364-4c58-b275-3e77854746a3" reported-display-style="italic"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the

			 Secretary of the Interior.</text>

				</paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id0E2738E895344C829FDC922970A32478" reported-display-style="italic"><enum>(4)</enum><header>Tenant</header><text>The

			 term <quote>tenant</quote> means Betty Dick, widow of George Fredrick Dick, who

			 held a 25-year reservation of occupancy and use at a property within the

			 boundaries of Rocky Mountain National Park.</text>

				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id719697e3-53d0-41d0-a471-c32f9635d994" reported-display-style="italic" section-type="subsequent-section"><enum>4.</enum><header>Right of

			 occupancy</header>

			<subsection changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id22d5e07f-5722-49ca-a448-c7f73cca8f7c" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 allow the tenant to continue to occupy and use the property described in

			 subsection (b) for the remainder of the natural life of the tenant, subject to

			 the requirements of this Act.</text>

			</subsection><subsection changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idbde2006a-0f6f-49c3-9789-41ac7d9a5c89" reported-display-style="italic"><enum>(b)</enum><header>Description of

			 property</header><text display-inline="yes-display-inline">The property

			 referred to in subsection (a) is the land and any improvements to the land

			 within the boundaries of Rocky Mountain National Park identified on the map as

			 <quote>residence</quote> and <quote>occupancy area</quote>.</text>

			</subsection><subsection changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id27ffd231-78e7-40ba-bf2f-362c55b93f88" reported-display-style="italic"><enum>(c)</enum><header>Terms and

			 conditions</header>

				<paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id170dc7b7-4983-4deb-9dd3-7a9dd071a9a9" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this Act, the occupancy and use of the property identified in

			 subsection (b) by the tenant shall be subject to the same terms and conditions

			 specified in the Agreement.</text>

				</paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idae8ea491-abed-4e96-b922-9a5fbac03857" reported-display-style="italic"><enum>(2)</enum><header>Payments</header>

					<subparagraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idCDBD09AF16EB4F05A1EF2DD34F195CEE" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">In exchange for the

			 continued occupancy and use of the property, the tenant shall annually pay to

			 the Secretary an amount equal to <fraction>1/25</fraction> of the amount

			 specified in section 3(B) of the Agreement.</text>

					</subparagraph><subparagraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idF09C64617ECD43B9B2B8AE9194EC0357" reported-display-style="italic"><enum>(B)</enum><header>Advance payment

			 required</header><text display-inline="yes-display-inline">The annual payments

			 required under subparagraph (A) shall be paid in advance by not later than May

			 1 of each year.</text>

					</subparagraph><subparagraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id874D2F73AA214CD5A85CD785FB102E87" reported-display-style="italic"><enum>(C)</enum><header>Disposition</header><text>Amounts

			 received by the Secretary under this paragraph shall be—</text>

						<clause changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id99942907509E4F80B0BBB3D881D44294" reported-display-style="italic"><enum>(i)</enum><text>deposited in a special

			 account in the Treasury of the United States; and</text>

						</clause><clause changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idB86B07C870B64F46A8DDD79B5CCC3A44" reported-display-style="italic"><enum>(ii)</enum><text>made available, without

			 further appropriation, to the Rocky Mountain National Park until

			 expended.</text>

						</clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id5C076E3D6A304B3E8B65E6673E119278" reported-display-style="italic"><enum>(3)</enum><header>Public

			 access</header><text>The public shall have access to both banks of the main

			 channel of the Colorado River.</text>

				</paragraph></subsection><subsection changed="added" committee-id="SSEG00" id="ID4bcf6d5e0cc84b06a3f622748a419d9f" reported-display-style="italic"><enum>(d)</enum><header>Termination</header><text>The

			 right of occupancy and use authorized under this Act—</text>

				<paragraph changed="added" committee-id="SSEG00" id="id3DBBCAE851A14CBFA9B06A30D8BDF88A" reported-display-style="italic"><enum>(1)</enum><text>shall not be extended to

			 any individual other than the tenant; and</text>

				</paragraph><paragraph changed="added" committee-id="SSEG00" id="id8F02E91F2EE042FFB8C6D00D760F3AB9" reported-display-style="italic"><enum>(2)</enum><text>shall terminate—</text>

					<subparagraph changed="added" committee-id="SSEG00" id="ID4831e359123f4590b7ce9e4d46486e3a" reported-display-style="italic"><enum>(A)</enum><text>on the death of the

			 tenant;</text>

					</subparagraph><subparagraph changed="added" committee-id="SSEG00" id="ID94e9bb9d08464f16bc125aec2a8c86e4" reported-display-style="italic"><enum>(B)</enum><text>if the tenant does not

			 make a payment required under subsection (c)(2); or</text>

					</subparagraph><subparagraph changed="added" committee-id="SSEG00" id="ID61b43580cb96493992b819bc2949fadb" reported-display-style="italic"><enum>(C)</enum><text>if the tenant otherwise

			 fails to comply with the terms of this Act.</text>

				<paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idc42e6275-9c6b-4933-9ad7-c99765e90e56" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">allows the construction of any structure on

			 the property described in subsection (b) not in existence on November 30, 2004;

			 or</text>

				</paragraph><paragraph changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id25be6ac1-539f-45f0-9c3c-3a11448d61e9" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">applies to the occupancy or use of the

			 property described in subsection (b) by any person other than the

			 tenant.</text>
