		<legis-type>A BILL</legis-type>

		<official-title>To amend the Internal Revenue Code of 1986 to allow

		  certain modifications to be made to qualified mortgages held by a REMIC or a

		  grantor trust.</official-title>

	<legis-body>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Certain modifications

			 permitted to qualified mortgages held by a REMIC or a grantor trust</header>

			<subsection id="ID4b31255f83cf49a1b9c787c2d665c8c9"><enum>(a)</enum><header>Qualified

			 mortgages held by a REMIC</header>

				<paragraph id="IDfe03000914714052b21b837045625b69"><enum>(1)</enum><header>In

			 general</header><text>Paragraph (3) of section 860G(a) of the Internal Revenue

			 Code of 1986 is amended by adding at the end the following new

			 subparagraph:</text>

					<quoted-block display-inline="no-display-inline" id="id628C3415AD9C40D892479411A8005603" style="OLC">

						<subparagraph id="ID9aeca2e28d034d398459c1d6ab9026dd"><enum>(C)</enum><header>Qualified

				modifications</header>

							<clause id="IDc33fe3f15192414082923fbab9a0d75a"><enum>(i)</enum><header>In

				general</header><text>An obligation shall not fail to be treated as a qualified

				mortgage solely because of a qualified modification of such obligation.</text>

							</clause><clause id="IDafe9281df203485282c21ec9cc6e824f"><enum>(ii)</enum><header>Qualified

				modification</header><text>For purposes of this section, the term

				<term>qualified modification</term> means, with respect to any obligation, any

				amendment, waiver, or other modification which is treated as a disposition of

				such obligation under section 1001 if such amendment, waiver or other

				modification does not—</text>

								<subclause id="IDb4ff8fcce0ed48018e12bd721599152f"><enum>(I)</enum><text>extend the final

				maturity date of the obligation,</text>

								</subclause><subclause id="IDb24df9870f5f430caaeddb449985fa62"><enum>(II)</enum><text>increase the

				outstanding principal balance under the obligation (other than the

				capitalization of accrued, unpaid interest),</text>

								</subclause><subclause id="IDd84f14db43d048daaa723c48d72b391d"><enum>(III)</enum><text>result in a

				release of an interest in real property securing the obligation such that the

				obligation is not principally secured by an interest in real property

				(determined after giving effect to the release), or</text>

								</subclause><subclause id="IDe1852fb220ec46f1860689f69226f5ac"><enum>(IV)</enum><text>result in an

				instrument or property right which is not debt for Federal income tax

				purposes.</text>

								</subclause></clause><clause id="ID7444929f52bd4f529c9c3c37243a3ad9"><enum>(iii)</enum><header>Defaults</header><text>Under

				regulations prescribed by the Secretary, any amendment, waiver, or other

				modification of an obligation which is in default or with respect to which

				default is reasonably foreseeable may be treated as a qualified modification

				for purposes of this section.</text>

							</clause><clause id="ID31263d4d4dcc49459c24e7194b3a6fd7"><enum>(iv)</enum><header>Defeasance

				with government securities</header><text>The requirements of clause (ii)(III)

				shall be treated as satisfied if, after the release described in such clause,

				the obligation is principally secured by Government securities and the

				amendment, waiver, or other modification to such obligation satisfies such

				requirements as the Secretary may prescribe.</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID303976e0011d4dd6a8fe6aa6d79d8de9"><enum>(2)</enum><header>Exception from

			 prohibited transaction rules</header><text>Subparagraph (A) of section

			 860F(a)(2) of such Code is amended—</text>

					<subparagraph id="idE5A277A35DCF4FF9A99FC5DFA36D2895"><enum>(A)</enum><text>by striking

			 <quote>or</quote> at the end of clause (iii);</text>

					</subparagraph><subparagraph id="id46155C1137BC4E3581E6C84FBAE60024"><enum>(B)</enum><text>by striking the

			 period at the end of clause (iv) and inserting <quote>or</quote>; and</text>

					</subparagraph><subparagraph id="id55609EE0C0E2430095A375707C9AD960"><enum>(C)</enum><text>by adding at the

			 end the following new clause:</text>

						<quoted-block display-inline="no-display-inline" id="idD93632BEAE9849EC9EF2272839E6A486" style="OLC">

							<clause id="IDd49ddf966b7f4a65a170034bbc8eafb8"><enum>(v)</enum><text>a

				qualified modification (as defined in section 860G(a)(3)(C)).</text>

							</clause><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID869aea7ed2ed455fab5e4fcc0ea82ebb"><enum>(3)</enum><header>Conforming

			 amendments</header>

					<subparagraph id="ID96f7ce73dedf4897ba22e5057e4f059c"><enum>(A)</enum><text>Section

			 860G(a)(3) of such Code is amended—</text>

						<clause id="IDa7147154bed74ea7a94adbd544da1415"><enum>(i)</enum><text>by

			 redesignating clauses (i) and (ii) of subparagraph (A) as subclauses (I) and

			 (II), respectively;</text>

						</clause><clause id="ID61a263a27710436cbba8a4415bc6b0d4"><enum>(ii)</enum><text>by

			 redesignating subparagraphs (A) through (D) as clauses (i) through (iv),

			 respectively;</text>

						</clause><clause id="ID90d229a8e591434980b2f3ed9ffec157"><enum>(iii)</enum><text>by striking

			 `The term' and inserting the following:</text>

								<subparagraph id="IDf0ad176d395d49a3b46184016425cadd"><enum>(A)</enum><header>In

				general</header><text>The term</text>

						</clause><clause id="IDedbaf9c1fd3040a38bfc2050030f9e9d"><enum>(iv)</enum><text>by

			 striking <quote>For purposes of subparagraph (A)</quote> and inserting the

			 following:</text>

								<subparagraph id="ID7268fb4023f34740bc64abb4c53f2691"><enum>(B)</enum><header>Tenant-stockholders

				of cooperative housing corporations</header><text>For purposes of subparagraph

				(A)(i)</text>

								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

						</clause></subparagraph><subparagraph id="ID654cd09e61fc49b280b1d317993aec67"><enum>(B)</enum><text>Section

			 860G(a)(3)(A)(iv) of such Code (as redesignated by subparagraph (A)) is

			 amended—</text>

						<clause id="IDaa7d9e0091b14f898ee157b0bc1c86b0"><enum>(i)</enum><text>by

			 striking <quote>clauses (i) and (ii) of subparagraph (A)</quote> and inserting

			 <quote>subclauses (I) and (II) of clause (i)</quote>; and</text>

						</clause><clause id="ID38a28b721af84032b4c1c999824d013f"><enum>(ii)</enum><text>by

			 striking <quote>subparagraph (A) (without regard to such clauses)</quote> and

			 inserting <quote>clause (i) (without regard to such subclauses)</quote>.</text>

						</clause></subparagraph></paragraph></subsection><subsection id="ID60cd614bcfc24989a2f607da2aca5373"><enum>(b)</enum><header>Qualified

			 mortgages held by a grantor trust</header><text>Section 672 of the Internal

			 Revenue Code of 1986 is amended by adding at the end the following new

			 subsection:</text>

				<quoted-block display-inline="no-display-inline" id="idB2D80727C55D4323B10C08E3C3EA4744" style="OLC">

					<subsection id="ID90e998fb657043179324d82a09942f3a"><enum>(g)</enum><header>Special rule

				for certain investment trusts</header><text>A grantor shall not fail to be

				treated as the owner of any portion of a trust under this subpart solely

				because such portion includes one or more obligations with respect to which a

				qualified modification (within the meaning of section 860G(a)(3)(C)) has been,

				or may be, made under the terms of such trust.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDbecbfda220b84f6b82cbb94bf84d4271"><enum>(c)</enum><header>Effective

			 date</header><text>The amendments made by this section shall apply to

			 amendments, waivers, and other modifications made after the date of enactment

			 of this Act.</text>
