			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Agricultural Security Assistance Act

			 of 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Definitions</header>

			<text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID4B67E616755A4ED591804B4FC6242114">

				<enum>(1)</enum>

				<header>Agricultural disease</header>

				<text display-inline="yes-display-inline">The term <term>agricultural

			 disease</term> means an outbreak of a plant or animal disease, or a pest

			 infestation, that requires prompt action in order to prevent injury or damage

			 to people, plants, livestock, property, the economy, or the environment.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3B99DB4A4BE14CAD817C55B2C59B2270">

				<enum>(2)</enum>

				<header>Agricultural disease emergency</header>

				<text display-inline="yes-display-inline">The term <term>agricultural

			 disease emergency</term> means an agricultural disease that the Secretary

			 determines to be an emergency under—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="IDCBF145D9995E4173870166D87A9480B5">

					<enum>(A)</enum>

					<text display-inline="yes-display-inline">section 415 of the Plant

			 Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7715">7

			 U.S.C. 7715</external-xref>); or</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3B19F61075BD45E28B33C226DF6396BE">

					<enum>(B)</enum>

					<text display-inline="yes-display-inline">section 10407(b) of the

			 Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8306(b)">7 U.S.C. 8306(b)</external-xref>).</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD7FB535D841D48E9BCFCDF9D3777DC2B">

				<enum>(3)</enum>

				<header>Agriculture</header>

				<text display-inline="yes-display-inline">The term

			 <term>agriculture</term> includes—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="ID87499B85208B421BB581C5A79E914700">

					<enum>(A)</enum>

					<text display-inline="yes-display-inline">the science and practice of

			 activities relating to food, feed, and fiber production, processing, marketing,

			 distribution, use, and trade;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF1B1BDB856F46CFAA079634881138A1">

					<enum>(B)</enum>

					<text display-inline="yes-display-inline">family and consumer science,

			 nutrition, food science and engineering, agricultural economics, and other

			 social sciences; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7E6F027FDB974FA8A4FBAD0DE3A86C4A">

					<enum>(C)</enum>

					<text display-inline="yes-display-inline">forestry, wildlife science,

			 fishery science, aquaculture, floraculture, veterinary medicine, and other

			 environmental and natural resource sciences.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA7A1BC5451134A16A972F545210E0E4D">

				<enum>(4)</enum>

				<header>Agroterrorism</header>

				<text display-inline="yes-display-inline">The term

			 <term>agroterrorism</term> means the commission of an agroterrorist act.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3F20988E39B7404D9A71185C62BF08C2">

				<enum>(5)</enum>

				<header>Agroterrorist Act</header>

				<text display-inline="yes-display-inline">The term <term>agroterrorist

			 act</term> means a criminal act consisting of causing or attempting to cause

			 damage or harm to, or destruction or contamination of, a crop, livestock, farm

			 or ranch equipment, material or property associated with agriculture, or a

			 person engaged in agricultural activity, that is committed with the

			 intent—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="IDD476A4553BB541FA863E1CB94B9F372C">

					<enum>(A)</enum>

					<text display-inline="yes-display-inline">to intimidate or coerce a

			 civilian population; or</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID361FBEFB0EDB4592992F3DFF4ABF5C5C">

					<enum>(B)</enum>

					<text display-inline="yes-display-inline">to influence the policy of a

			 government by intimidation or coercion.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE7B69A5DA12844F1B50EFA97A4428391">

				<enum>(6)</enum>

				<header>Biosecurity</header>

				<subparagraph commented="no" display-inline="no-display-inline" id="ID6D6A7080AFF24864BFFC4A6434E285AA">

					<enum>(A)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The term

			 <term>biosecurity</term> means protection from the risks posed by biological,

			 chemical, or radiological agents to—</text>

					<clause commented="no" display-inline="no-display-inline" id="ID780966D8A1784A86B782EE705B67EA9D">

						<enum>(i)</enum>

						<text display-inline="yes-display-inline">plant or animal

			 health;</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="IDCD3026B5375640E88A5BDB8270F4F5EA">

						<enum>(ii)</enum>

						<text display-inline="yes-display-inline">the agricultural

			 economy;</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="IDFE77518677304060A61293EE2A525E60">

						<enum>(iii)</enum>

						<text display-inline="yes-display-inline">the environment; or</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="IDAA2BAA0B7A804718AAF9B3144245A7DB">

						<enum>(iv)</enum>

						<text display-inline="yes-display-inline">human health.</text>

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE6A2EFCD00194117B5D93059060632DC">

					<enum>(B)</enum>

					<header>Inclusions</header>

					<text display-inline="yes-display-inline">The term

			 <term>biosecurity</term> includes the exclusion, eradication, and control of

			 biological agents that cause plant or animal diseases.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id379D58BE8D0A4FE0A0ECC6A6E41BBF99">

				<enum>(7)</enum>

				<header>Indian tribe</header>

				<text display-inline="yes-display-inline">The term <term>Indian

			 tribe</term> has the meaning given the term in

			 <external-xref legal-doc="act" parsable-cite="ISDA/4">section 4</external-xref>

			 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education

			 Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25495FE1A2874FAE9C97CDE831B62F12">

				<enum>(8)</enum>

				<header>Secretary</header>

				<text display-inline="yes-display-inline">The term

			 <quote>Secretary</quote> means the Secretary of Agriculture.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8443ED1049B448ED9B6D318344500158">

				<enum>(9)</enum>

				<header>Tribal government</header>

				<text display-inline="yes-display-inline">The term <term>tribal

			 government</term> means the governing body of an Indian tribe.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idFCA7F3A854B74B34BA4EE21C102E7439" section-type="subsequent-section">

			<enum>3.</enum>

			<header>State and local assistance</header>

			<subsection commented="no" display-inline="no-display-inline" id="id7F53E1CE7F7948AFAC59E0B756C21CF8">

				<enum>(a)</enum>

				<header>Study</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDdf21d5041dcb4394a3799518a93bcf8e">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">In consultation with the

			 steering committee of the National Animal Health Emergency Management System

			 and other stakeholders, the Secretary shall conduct a study to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID9d4853559a32464cbeb9240fe4b401f1">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">determine the best use of

			 epidemiologists, computer modelers, and statisticians as members of emergency

			 response task forces that handle foreign or emerging agricultural disease

			 emergencies; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd28ba34142114f32b67cc765803b070d">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">identify the types of data

			 that are necessary for proper modeling and analysis of agricultural disease

			 emergencies.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID892f10a52fe247e6b60706e87963f0de">

					<enum>(2)</enum>

					<header>Report</header>

					<text display-inline="yes-display-inline">Not later than 180 days after

			 the date of enactment of this Act, the Secretary shall submit a report that

			 describes the results of the study under paragraph (1) to—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID1b236768c2df49ec965d62864cc16d12">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the Secretary of Homeland

			 Security; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb0c0699401794223baba7c373a33ed91">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">the head of any other agency

			 involved in response planning for agricultural disease emergencies.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6a4845164b864711aa82547161f80334">

				<enum>(b)</enum>

				<header>Geographic information system grants</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID205020086512404b980777ad81150269">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Secretary, in

			 consultation with the Secretary of Homeland Security and the Secretary of the

			 Interior, shall establish a program under which the Secretary shall provide

			 grants to States to develop capabilities to use a geographic information system

			 or statistical model for an epidemiological assessment in the event of an

			 agricultural disease emergency.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa70589ddb4384aff8d3d19ad7fa48f92">

					<enum>(2)</enum>

					<header>Authorization of appropriations</header>

					<text display-inline="yes-display-inline">There are authorized to be

			 appropriated to carry out this subsection—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID0babaf15845644539d1763344c20f147">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">$2,500,000 for fiscal year

			 2006; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6bf7a5752aee4d81b395f8c7c7737090">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">such sums as are necessary

			 for each subsequent fiscal year.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdcc346c4acfc4a7fa3922e54acd85fb2">

				<enum>(c)</enum>

				<header>Biosecurity awareness and programs</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID84b9ffbc798141bdb9e915e7e8c33ee4">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Secretary shall implement

			 a public awareness campaign for farmers, ranchers, and other agricultural

			 producers that emphasizes—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDeadc2d70075643b7b5b02e63e5f4dbe4">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the need for heightened

			 biosecurity on farms; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6c922bc7c81e432c95267484b8441b5a">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">reporting to the Department

			 of Agriculture any agricultural disease anomaly.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4b9602399fa243d9b3c3b3ae4236d3b3">

					<enum>(2)</enum>

					<header>On-farm biosecurity</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDd9f2973fa0d546de88ac70f8c02cb23c">

						<enum>(A)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">Not later than 240 days after

			 the date of enactment of this Act, the Secretary, in consultation with

			 associations of agricultural producers and taking into consideration research

			 conducted under the National Agricultural Research, Extension, and Teaching

			 Policy Act of 1977 (7 U.S.C. 3101 et seq.), shall—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDb1f084cce996421098d5b8afb9406a92">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">develop guidelines—</text>

							<subclause commented="no" display-inline="no-display-inline" id="ID9b1081d3968240cea0e8750a569e3a94">

								<enum>(I)</enum>

								<text display-inline="yes-display-inline">to improve monitoring of

			 vehicles and materials entering or leaving farm or ranch operations; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID15ddd140907247b9bddc87266cad1d19">

								<enum>(II)</enum>

								<text display-inline="yes-display-inline">to control human traffic

			 entering or leaving farm or ranch operations; and</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDc5bf257350fc4b01aea12c357ac1552b">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">distribute the guidelines

			 developed under clause (i) to agricultural producers through agricultural

			 informational seminars and biosecurity training sessions.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID75a9e95ea34c4fa5ab9907b7942c00ad">

						<enum>(B)</enum>

						<header>Authorization of appropriations</header>

						<clause commented="no" display-inline="no-display-inline" id="IDa5653a810d7c40189dd860dcb845c4a4">

							<enum>(i)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">There are authorized to be

			 appropriated to carry out this paragraph—</text>

							<subclause commented="no" display-inline="no-display-inline" id="IDbea782686a6e4db4bfa512b9da621d0a">

								<enum>(I)</enum>

								<text display-inline="yes-display-inline">$5,000,000 for fiscal year

			 2006; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1e61039095264909b04b2793f6a2aada">

								<enum>(II)</enum>

								<text display-inline="yes-display-inline">such sums as are necessary

			 for each subsequent fiscal year.</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDfac91530bf6640d0b4005be37c9f6a96">

							<enum>(ii)</enum>

							<header>Information program</header>

							<text display-inline="yes-display-inline">Of the amounts made available

			 under clause (i), the Secretary may use such sums as are necessary to establish

			 in each State an information program to distribute the biosecurity guidelines

			 developed under subparagraph (A)(i).</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9b99ece56d96449db4de9f398c4d1974">

					<enum>(3)</enum>

					<header>Biosecurity grant pilot program</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID33c062a7607c4528a3e240d9d57781b8">

						<enum>(A)</enum>

						<header>Incentives</header>

						<clause commented="no" display-inline="no-display-inline" id="id47005E6F54CD4D1CBBD105F138D3E297">

							<enum>(i)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">Not later than 240 days after

			 the date of enactment of this Act, the Secretary shall develop a pilot program

			 to provide incentives, in the form of grants or low-interest loans, to

			 agricultural producers to restructure farm and ranch operations (based on the

			 biosecurity guidelines developed under paragraph (2)(A)(i)) to achieve the

			 goals described in clause (ii).</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idBE425104C298427D8053094E265307B3">

							<enum>(ii)</enum>

							<header>Goals</header>

							<text display-inline="yes-display-inline">The goals referred to in

			 clause (i) are—</text>

							<subclause commented="no" display-inline="no-display-inline" id="ID71cffe7ca31346fb887cf7475d6df67a">

								<enum>(I)</enum>

								<text display-inline="yes-display-inline">to control access to farms

			 and ranches by persons intending to commit agroterrorist acts;</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID01e787f27e484c46842815703246ac98">

								<enum>(II)</enum>

								<text display-inline="yes-display-inline">to prevent the introduction

			 and spread of agricultural diseases; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa04d123f18dd4dd286eeeda8078f2ad7">

								<enum>(III)</enum>

								<text display-inline="yes-display-inline">to take other measures to

			 ensure biosecurity.</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id02E8DCA1E88341E4B2B8C79F72066DF7">

							<enum>(iii)</enum>

							<header>Limitation</header>

							<text display-inline="yes-display-inline">The amount of a grant or

			 low-interest loan provided under this paragraph shall not exceed

			 $10,000.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfe6bc7dc437f4ac5bf0af0322a04f2da">

						<enum>(B)</enum>

						<header>Report</header>

						<text display-inline="yes-display-inline">Not later than 3 years after

			 the date of enactment of this Act, the Secretary shall submit to Congress a

			 report that—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDd4b757b65cae4477a32c5ad781e76450">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">describes the implementation

			 of the pilot program; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID76cbc5874e254c64b10a1cbb61aef9c1">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">makes recommendations for

			 expanding the pilot program.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9c28e72fb3d34595a352a1f7ffb54e41">

						<enum>(C)</enum>

						<header>Authorization of appropriations</header>

						<text display-inline="yes-display-inline">There are authorized to be

			 appropriated to carry out this paragraph—</text>

						<clause commented="no" display-inline="no-display-inline" id="ID941f35b54e3f47c18b9780630955abc6">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">$5,000,000 for fiscal year

			 2006; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDd6e8207da7704045a0d04bd3a1798d8c">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">such sums as are necessary

			 for each of fiscal years 2007 through 2009.</text>

						</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID469b5df81c4f4216b3c05e125e80088e" section-type="subsequent-section">

			<enum>4.</enum>

			<header>Regional, State, and local preparedness</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID10322f2a3bb441dd8c638b5335c866e3">

				<enum>(a)</enum>

				<header>Environmental protection agency</header>

				<text display-inline="yes-display-inline">The Administrator of the

			 Environmental Protection Agency, in consultation with the Secretary, shall

			 cooperate with regional, State, and local disaster preparedness officials to

			 include consideration of the potential environmental effects of a response

			 activity in planning a response to an agricultural disease.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5f5f7fb2de3841e4a208ee7a3b5e25fc">

				<enum>(b)</enum>

				<header>Department of agriculture</header>

				<text display-inline="yes-display-inline">The Secretary, in

			 consultation with the Secretary of Homeland Security, shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDeaaec0aee7794e1d98fede4981c4fea3">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">develop and implement

			 procedures to provide information to, and share information among, Federal,

			 regional, State, tribal, and local officials regarding agricultural threats,

			 risks, and vulnerabilities; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75c6e99bcfe94649bd8a9d07c49313d3">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">cooperate with State

			 agricultural officials, State and local emergency managers, representatives

			 from State land grant colleges and research universities, agricultural

			 producers, and agricultural trade associations to establish local response

			 plans for agricultural diseases.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDf6082285d0454093905d6459a3133136" section-type="subsequent-section">

			<enum>5.</enum>

			<header>Interagency coordination</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID3bf9e151819548f98203d679fc0aab67">

				<enum>(a)</enum>

				<header>Agricultural disease liaisons</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9ee2d2fb6f44480fb9ada12d1efd245b">

					<enum>(1)</enum>

					<header>Agricultural disease management liaison</header>

					<text display-inline="yes-display-inline">The Secretary of Homeland

			 Security shall establish a senior level position within the Federal Emergency

			 Management Agency the primary responsibility of which is to serve as a liaison

			 for agricultural disease management between—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID16767611e07b419482c213d852181638">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the Department of Homeland

			 Security; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3d95fbb6adff4466bed58ffd6b0f61f1">

						<enum>(B)</enum>

					<header>Animal health care liaison</header>

					<text display-inline="yes-display-inline">The Secretary of Health and

			 Human Services shall establish within the Department of Health and Human

			 Services a senior level position the primary responsibility of which is to

			 serve as a liaison between—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID42f1b09108574a288cb1465bb9911594">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the Department of Health and

			 Human Services; and</text>

						<enum>(B)</enum>

				<enum>(b)</enum>

				<header>Transportation</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID33d8bea106944de283ef718999b34435">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Secretary of

			 Transportation, in consultation with the Secretary and the Secretary of

			 Homeland Security, shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID3468811abbf34804b28580426dc1d38e">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">publish in the Federal

			 Register proposed guidelines for restrictions on interstate transportation of

			 an agricultural commodity or product in response to an agricultural

			 disease;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID409b262d6ce046a3bc2acfd070b11fb0">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">provide for a comment period

			 of not less than 90 days for the proposed guidelines; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf5a1dab702f14ba591293738be9b7fbb">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">establish final guidelines,

			 taking into consideration any comment received under subparagraph (B);

			 and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID486733c1e2014933bdc2022dd979596d">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">provide the guidelines

			 described in paragraph (1) to officers and employees of—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID34e34906b4b3457fbafb63f7ee37b0a6">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the Department of

			 Agriculture;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa35e85d9844e4c05b6a7da7ac173a176">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">the Department of

			 Transportation; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDde8a56a035d841f4a3759321b4fe65e2">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">the Department of Homeland

			 Security.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDe8cf4fc58da84682a0775c9d66e4a827" section-type="subsequent-section">

			<enum>6.</enum>

			<header>International activities</header>

			<subsection commented="no" display-inline="no-display-inline" id="id98A5F8B09C964D22A4749E25FC31FABF">

				<enum>(a)</enum>

				<header>International agricultural disease surveillance</header>

				<text display-inline="yes-display-inline">Not later than 1 year after

			 the date of enactment of this Act, the Secretary, in consultation with the

			 Secretary of State and the Administrator of the Agency for International

			 Development, shall submit to Congress a report that describes measures taken by

			 the Secretary to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID0ad6c2d57a9a4a78aa0605f91c4f2cc7">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">streamline the process of

			 notification by the Secretary to Federal agencies in the event of an

			 agricultural disease in a foreign country; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe30cd4841a364e48adea692b874ff338">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">cooperate with

			 representatives of foreign countries, international organizations, and industry

			 to develop and implement methods of sharing information relating to

			 international agricultural diseases and unusual agricultural activities.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd47c849028c34e53ad4d1fe5142a9884">

				<enum>(b)</enum>

				<header>Bilateral mutual assistance agreements</header>

				<text display-inline="yes-display-inline">The Secretary of State, in

			 coordination with the Secretary and the Secretary of Homeland Security,

			 shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID4b1cf816c30a4631acf55c839f807c47">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">enter into mutual assistance

			 agreements with other countries to provide and receive assistance in the event

			 of an agricultural disease, including—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID118fe4cadca045ee876392c227c1c6da">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">training for veterinarians

			 and agriculture specialists of the United States in the identification,

			 diagnosis, and control of foreign agricultural diseases;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfca3ebafee4045da822a9115b10772f8">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">providing resources and

			 personnel to a foreign government with limited resources to respond to an

			 agricultural disease; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd761451ed93e4337ada43e35a72904c3">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">bilateral training programs

			 and exercises relating to assistance provided under this paragraph; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75a2132ab5bb43a493a936ffb4645a63">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">provide funding for a program

			 or exercise described in paragraph (1)(C).</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE968945AA83F4A1AB34A41028D0C248F" section-type="subsequent-section">

			<enum>7.</enum>

			<header>Additional studies and reports</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID468d8a14b2de42c79cf45edc0c504d64">

				<enum>(a)</enum>

				<header>Vaccines</header>

				<text display-inline="yes-display-inline">Not later than 180 days after

			 the date of enactment of this Act, the Secretary shall conduct a study of, and

			 submit to Congress a report that describes, the projected costs and benefits of

			 developing ready-to-use vaccines against foreign animal diseases.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf676b0b5ec644fae9ab52a1cb1344ac9">

				<enum>(b)</enum>

				<header>Plant disease laboratory</header>

				<text display-inline="yes-display-inline">Not later than 270 days after

			 the date of enactment of this Act, the Secretary shall conduct a study of, and

			 submit to Congress a report that describes, the feasibility of establishing a

			 national plant disease laboratory based on the model of the Centers for Disease

			 Control and Prevention, the primary task of which is to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id614A47E362014D86AC390C7F319FEE41">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">integrate and coordinate a

			 nationwide system of independent plant disease diagnostic laboratories,

			 including plant clinics maintained by land grant colleges and universities;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc7aa5c7fd6014e3f92e25caf63bf9177">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">increase the capacity,

			 technical infrastructure, and information-sharing capabilities of laboratories

			 described in paragraph (1).</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7489AA7093F5420C9E48FCCF9B259002" section-type="subsequent-section">

			<enum>8.</enum>

			<header>Veterinarian accreditation</header>

			<text display-inline="no-display-inline">Not later than 180 days after

			 the date of enactment of this Act, the Secretary shall promulgate regulations

			 requiring that any veterinarian accredited by the Department of Agriculture

			 shall be trained to recognize foreign animal diseases.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDb113ff8c531e4d408414de8b1ef57a5f" section-type="subsequent-section">

			<enum>9.</enum>

			<header>Review of legal authority</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDcdb83963dfc34848954777ca54d50b1d">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">The Attorney General, in

			 consultation with the Secretary, shall conduct a review of State and local laws

			 relating to agroterrorism and biosecurity to determine—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID4b94652219ba438b9f44ee1b20aff11f">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">the extent to which the laws

			 facilitate or impede the implementation of a current or proposed response plan

			 relating to an agricultural disease;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2f47f42000744b76af2e11e9f4e36d2e">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">whether an injunction issued

			 by a State court could—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDf019b34624bf46b3af9eef9b9862a766">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">delay the implementation of a

			 Federal response plan described in paragraph (1); or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID112de6b78d3545a09d1295ad6ef22bea">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">affect the extent to which an

			 agricultural disease spreads; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7faf3b209eac4ea1a7b216f16e0093a1">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">the types and extent of legal

			 evidence that may be required by a State court before a response plan described

			 in paragraph (1) may be implemented.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcecd12596df344e99b316ed36d641353">

				<enum>(b)</enum>

				<header>Report</header>

				<text display-inline="yes-display-inline">Not later than 1 year after

			 the date of enactment of this Act, the Attorney General shall submit to

			 Congress a report that describes the results of the review under subsection (a)

			 (including any recommendations of the Attorney General).</text>
