				and other means as determined by the State, to parents of eligible children,

				child care providers, and the general public, information regarding—</text>

										<enum>(I)</enum>

										<text>the promotion of informed child care choices, including

				information about the quality and availability of child care services;</text>

									</subclause><subclause id="ID2E368DD191AD44DE90A777385DED7ABB">

										<enum>(II)</enum>

										<text>research and best practices concerning children’s development,

				including early cognitive development;</text>

									</subclause><subclause id="IDF7EA8EA7D70E454BBEBCABA4C78E20CF">

										<enum>(III)</enum>

										<text>the availability of assistance to obtain child care services;

				and</text>

									</subclause><subclause id="ID89AC8AB9B642482791FC3E17F3258962">

										<enum>(IV)</enum>

										<text>other programs for which families that receive child care

				services for which financial assistance is provided under this subchapter may

				be eligible, including the food stamp program established under the

				<act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C.

				2011</external-xref> et seq.), the special supplemental nutrition program for

				women, infants, and children established by section 17 of the

				<act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C.

				1786</external-xref>), the child and adult care food program established under

				section 17 of the Richard B. Russell <act-name parsable-cite="NSLA">National

				School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>), and the medicaid

				and State children’s health insurance programs under titles XIX and XXI of the

				<act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et

				seq. and 1397aa et seq.); and</text>

									</subclause></clause><clause id="ID1290F81677354747A494599E9FF74B86">

									<enum>(ii)</enum>

									<text>report to the Secretary the manner in which the consumer

				education information described in clause (i) was provided to parents and the

				number of parents to whom such consumer education information was provided,

				during the period of the previous State plan.</text>

				care services provided within the State (or area served by the tribe or

				organization), and provide a detailed description of such requirements and of

				how such requirements are effectively enforced.</text>

									<enum>(ii)</enum>

									<header>Construction</header>

									<text>Nothing in clause (i) shall be construed to require that

				licensing requirements be applied to specific types of providers of child care

				services.</text>

					</paragraph><paragraph id="ID97CA275DA9EE4A3EB65ACCA92F77B4F5">

						<enum>(4)</enum>

						<text>in subparagraph (F)—</text>

				assistance under a State program funded under part A of title IV of the

				seq.)) are not required to unduly disrupt their employment in order to comply

				with the State’s requirements for redetermination of eligibility for assistance

				under this subchapter.</text>

									<enum>(ii)</enum>

									<header>Minimum period</header>

									<text>Demonstrate that each child that receives assistance under this

				subchapter in the State will receive such assistance for not less than 6 months

				before the State redetermines the eligibility of the child under this

				subchapter, except as provided in clause (iii).</text>

								</clause><clause id="IDEA0CA68FC6F04E01ACB262A71004AB12">

									<enum>(iii)</enum>

									<header>Period before termination</header>

									<text>At the option of the State, demonstrate that the State will not

				terminate assistance under this subchapter based on a parent’s loss of work or

				cessation of attendance at a job training or educational program for which the

				family was receiving the assistance, without continuing the assistance for a

				reasonable period of time, of not less than 1 month, after such loss or

				cessation in order for the parent to engage in a job search and resume work, or

				resume attendance of a job training or educational program, as soon as

				possible.</text>

								</clause></subparagraph><subparagraph id="IDB93D244251854442BBA57A327967D060">

								<enum>(J)</enum>

								<header>Coordination with other programs</header>

								<text>Describe how the State, in order to expand accessibility and

				continuity of quality early care and early education, will coordinate the early

				childhood education activities assisted under this subchapter with—</text>

								<clause id="ID1CF868065C714171A04C786FD11C01B9">

									<enum>(i)</enum>

									<text>programs carried out under the <act-name parsable-cite="HSA">Head Start Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831</external-xref> et seq.), including

				the Early Head Start programs carried out under section 645A of that Act

				(<external-xref legal-doc="usc" parsable-cite="usc/42/9840a">42 U.S.C.

				9840a</external-xref>);</text>

								</clause><clause id="ID1C6363B6D87D432D84CECFD6FD5496DD">

									<enum>(ii)</enum>

										<text>Early Reading First and Even Start programs carried out under

				subparts 2 and 3 of part B of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/6371">20 U.S.C.

				6371</external-xref> et seq., 6381 et seq.);</text>

									<enum>(iii)</enum>

									<text>programs carried out under section 619 and part C of the

				Individuals with Disabilities Education Act;</text>

								</clause><clause id="IDB756CEF01780415CA75EBE75E772A00A">

									<enum>(iv)</enum>

									<text>State prekindergarten programs; and</text>

								</clause><clause id="ID46924A83B8BE49B8B524FBC161011342">

									<enum>(v)</enum>

									<text>other early childhood education programs.</text>

								</clause></subparagraph><subparagraph id="IDFC9BA2950D404B2D86FD9A82D0CD2FC4">

								<enum>(K)</enum>

								<header>Training in early learning and childhood development</header>

								<text>Describe any training requirements that are in effect within

				the State that are designed to enable child care providers to promote the

				social, emotional, physical, and cognitive development of children and that are

				applicable to child care providers that provide services for which assistance

				is made available under this subchapter in the State.</text>

							</subparagraph><subparagraph id="ID0FC4321C5FD24C1F86379C45AF1172C8">

								<enum>(L)</enum>

								<header>Public-private partnerships</header>

								<text>Demonstrate how the State is encouraging partnerships among

				State agencies, other public agencies, and private entities, to leverage

				existing service delivery systems (as of the date of submission of the State

				plan) for early childhood education and to increase the supply and quality of

				child care services for children who are less than 13 years of age.</text>

							</subparagraph><subparagraph id="IDDCF571DC344B46D4ADC59C41A08026B8">

								<enum>(M)</enum>

								<header>Access to care for certain populations</header>

								<text>Demonstrate how the State is addressing the child care needs of

				parents eligible for child care services for which assistance is provided under

										<text>collect and analyze data on the supply of and demand for child

									<text>describe how the State will provide for timely payment for

				child care services, and set payment rates for child care services, for which

				assistance is provided under this subchapter in accordance with the results of

				the market rates survey conducted pursuant to subclause (I) without reducing

				the number of families in the State receiving such assistance under this

				subchapter, relative to the number of such families on the date of introduction

				of the Caring for Children Act of 2005; and</text>

									<text>describe how the State will, not later than 30 days after the

				completion of the survey described in subclause (I), make the results of the

				survey widely available through public means, including posting the results on

								<header>Equal access</header>

								<text>The State plan shall include a certification that the payment

				rates are sufficient to ensure equal access for eligible children to child care

				are provided to children whose parents are not eligible to receive child care

				assistance under any Federal or State program.</text>

										<text>the age or particular needs of children (such as children with

				special needs and children served by child protective services);</text>

									</subclause><subclause id="ID6DC274F88D4249338990DAB51D13AB23">

										<enum>(III)</enum>

										<text>whether the providers provide child care during weekend and

				other nontraditional hours; and</text>

									</subclause><subclause id="IDF27636E60A6340E9986689C42EDA45FD">

										<enum>(IV)</enum>

										<text>the State’s determination that such differentiated payment

				rates are needed to enable a parent to choose child care that the parent

				believes to be of high quality.</text>

				<enum>105.</enum>

				<header>Activities to improve the quality of child care</header>

				a fiscal year shall reserve and use not less than 6 percent of the funds for

				activities provided directly, or through grants or contracts with resource and

				referral organizations or other appropriate entities, that are designed to

				improve the quality of child care services.</text>

							</paragraph><paragraph id="ID25CE4F5B4E094F62B11255DE47B95A1B">

								<enum>(2)</enum>

								<header>Activities</header>

								<text>The funds reserved under paragraph (1) may only be used

				to—</text>

								<subparagraph id="ID3DC655DCE8AF4F958EDD3F06F54C8771">

									<enum>(A)</enum>

									<text>develop and implement voluntary guidelines on pre-reading and

				language skills and activities, and prenumeracy and mathematics skills and

				activities, for child care programs in the State, that are aligned with State

				standards for kindergarten through grade 12 or the State’s general goals for

				school preparedness;</text>

								</subparagraph><subparagraph id="IDA550E762E25F4A349F9D43CEB465269C">

									<enum>(B)</enum>

									<text>support activities and provide technical assistance in Federal,

				State, and local child care settings to enhance early learning for preschool

				and school-aged children, to promote literacy, to foster school preparedness,

				and to support later school success;</text>

								</subparagraph><subparagraph id="IDB4E19E421E634037AAFA2FAF47D4F3EA">

									<enum>(C)</enum>

									<text>offer training, professional development, and educational

				opportunities for child care providers that relate to the use of

				developmentally appropriate and age-appropriate curricula, and early childhood

				teaching strategies, that are scientifically based and aligned with the social,

				emotional, physical, and cognitive development of children, including—</text>

									<clause id="IDAACECB15225B40E089620B15334298E4">

										<enum>(i)</enum>

										<text>developing and operating distance learning child care training

				infrastructures;</text>

									</clause><clause id="IDC1068189070E40159508D94E590196C9">

										<enum>(ii)</enum>

										<text>developing model technology-based training courses;</text>

									</clause><clause id="ID3F094B132DEF497A945E6E83524B4609">

										<enum>(iii)</enum>

										<text>offering training for caregivers in informal child care

				settings; and</text>

									</clause><clause id="ID056D976CE54E4A91B03622E35A7B9E85">

										<enum>(iv)</enum>

										<text>offering training for child care providers who care for infants

				and toddlers and children with special needs.</text>

									</clause></subparagraph><subparagraph id="ID2C576E5E9377458581E955F4AF0D794B">

									<enum>(D)</enum>

									<text>engage in programs designed to increase the retention and

				improve the competencies of child care providers, including wage incentive

				programs and initiatives that establish tiered payment rates for providers that

				meet or exceed child care services guidelines, as defined by the State;</text>

								</subparagraph><subparagraph id="IDC19CC40DB3924D28A377939CC7038186">

									<enum>(E)</enum>

									<text>evaluate and assess the quality and effectiveness of child care

				programs and services offered in the State to young children on improving

				overall school preparedness; and</text>

								</subparagraph><subparagraph id="ID56EDF8660BB8446E8591CAE15DEB6FF3">

									<enum>(F)</enum>

									<text>carry out other activities determined by the State to improve

				the quality of child care services provided in the State and for which

				measurement of outcomes relating to improved child safety, child well-being, or

				school preparedness is possible.</text>

								</subparagraph></paragraph></subsection><subsection id="ID790409EA9758431FAF6B4A2D5FD8D019">

							<enum>(b)</enum>

							<header>Certification</header>

							<text>Beginning with fiscal year 2006, the State shall annually

				submit to the Secretary a certification in which the State certifies that the

				State was in compliance with subsection (a) during the preceding fiscal year

				and describes how the State used funds made available to carry out this

				subchapter to comply with subsection (a) during that preceding fiscal

				year.</text>

						</subsection><subsection id="ID648CF7CBF2EE400BA0F4312D1C2AC10A">

							<enum>(c)</enum>

							<header>Strategy</header>

							<text>The State shall annually submit to the Secretary—</text>

							<paragraph id="ID123FFEF917244EEA840C323E8BD0FDB8">

								<enum>(1)</enum>

								<text>beginning with fiscal year 2006, an outline of the strategy the

				State will implement during that fiscal year to address the quality of child

				care services for which financial assistance is made available under this

				subchapter, including—</text>

								<subparagraph id="IDB06C7786E8844F57A969E4CAA63713EF">

									<enum>(A)</enum>

									<text>a statement specifying how the State will address the

				activities carried out under subsection (a);</text>

								</subparagraph><subparagraph id="ID27977E56D4074727A8AF1ECC180C7374">

									<enum>(B)</enum>

									<text>a description of quantifiable, objective measures that the

				State will use to evaluate the State’s progress in improving the quality of the

				child care services (including measures regarding the impact, if any, of State

				efforts to improve the quality by increasing payment rates, as defined in

				section 658H(c)), evaluating separately the impact of the activities listed in

				each of such subparagraphs on the quality of the child care services;

				and</text>

								</subparagraph><subparagraph id="ID365AF0068B4345EB9490F3CDEE6C978B">

									<enum>(C)</enum>

									<text>a list of State-developed child care services quality targets

				quantified for such fiscal year for such measures; and</text>

								</subparagraph></paragraph><paragraph id="IDD7AB22042D7F4A93892D71838159D864">

								<enum>(2)</enum>

								<text>beginning with fiscal year 2007, a report on the State’s

				progress in achieving such targets for the preceding fiscal year.</text>

							</paragraph></subsection><subsection id="ID03725673481E42D199CD72B8D423761C">

							<enum>(d)</enum>

							<header>Improvement plan</header>

							<text>If the Secretary determines that a State failed to make

				progress as described in subsection (c)(2) for a fiscal year—</text>

							<paragraph id="IDE31AA9FBC4374344AE9A19F23112E329">

								<enum>(1)</enum>

								<text>the State shall submit an improvement plan that describes the

				measures the State will take to make that progress; and</text>

							</paragraph><paragraph id="ID203B0926E84B45CEA406C9F44D566411">

								<enum>(2)</enum>

								<text>the State shall comply with the improvement plan by a date

				specified by the Secretary but not later than 1 year after the date of the

				determination.</text>

							</paragraph></subsection><subsection id="ID4C603DEA4AED4963A24488B26DCD36E9">

							<enum>(e)</enum>

							<header>Construction</header>

							<text>Nothing in this subchapter shall be construed to require that

				the State apply measures for evaluating quality of child care services to

				specific types of child care providers.</text>

				<enum>106.</enum>

				<header>Optional priority use of additional funds</header>

				<text display-inline="no-display-inline">The

			 <act-name parsable-cite="CCDBGA90">Child Care and Development Block Grant Act

			 of 1990</act-name> is amended by inserting after section 658G (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e</external-xref>)

			 the following:</text>

								<text>to support payment rate increases in accordance with the market

								<text>to support the establishment of tiered payment rates as

				described in section 658G(a)(2)(D); and</text>

								<text>to support payment rate increases for care for children in

				communities served by local educational agencies that have been identified for

				counted toward the maintenance of effort requirement under section 409(a)(7) of

									<text>whether the child care provider involved was a relative;</text>

									<text>the cost of child care for such family, separately stating the

				amount of the subsidy payment of the State and the amount of the co-payment of

				the family toward such cost;</text>

									<enum>(I)</enum>

									<text>the average hours per month of such care;</text>

								</subparagraph><subparagraph id="ID5C0AB28A17A34D928CC9A66B5161FAD7">

									<enum>(J)</enum>

									<text>household size;</text>

								</subparagraph><subparagraph id="ID685532A8D50947E5B530D76942647729">

									<enum>(K)</enum>

									<text>whether the parent involved reports that the child has an

				individualized education program or an individualized family service plan, as

				such terms are defined in section 602 of the Individuals with Disabilities

				Education Act; and</text>

								</subparagraph><subparagraph id="ID603E5059F8664DBBBEBF456387306402">

									<enum>(L)</enum>

									<text>the reason for any termination of benefits under this

				subchapter, including whether the termination was due to—</text>

										<enum>(i)</enum>

										<text>the child’s age exceeding the allowable limit;</text>

									</clause><clause id="ID33E00E71C9E148938E9AC14721D0920C">

										<text>the family income exceeding the State eligibility limit;</text>

										<enum>(iii)</enum>

										<text>the State recertification or administrative requirements not

				being met;</text>

										<text>parent work, training, or education status no longer meeting

				State requirements;</text>

									</clause><clause id="ID2DE8B779593540ED846B72AABB8CF331">

										<enum>(v)</enum>

										<text>a nonincome related change in status; or</text>

									</clause><clause id="ID7ACBF36DEE7A49E68BE2C72F51FC41EC">

										<enum>(vi)</enum>

										<text>other reasons;</text>

								<header>Submission to Secretary</header>

								<text>A State described in paragraph (1) shall, on a quarterly basis,

				submit to the Secretary the information required to be collected under

				paragraph (2) and the number of children and families receiving assistance

				under this subchapter (stated on a monthly basis). Information on the number of

				families receiving the assistance shall also be posted on the website of such

				State. In the fourth quarterly report of each year, a State described in

				paragraph (1) shall also submit to the Secretary information on the annual

				number and type of child care providers (as described in section 658T(5)) that

				received funding under this subchapter and the annual number of payments made

				by the State through vouchers, under contracts, or by payment to parents

				reported by type of child care provider.</text>

							</paragraph><paragraph id="ID5FB399DDCBB3480E91E417D0868470C0">

								<enum>(4)</enum>

								<header>Use of samples</header>

								<subparagraph id="ID9999343E47724605ACD03026B10BD790">

									<enum>(A)</enum>

									<header>Authority</header>

									<text>A State may comply with the requirement to collect the

				information described in paragraph (2) through the use of disaggregated case

				record information on a sample of families selected through the use of

				scientifically acceptable sampling methods approved by the Secretary.</text>

								</subparagraph><subparagraph id="ID37F3B24829B6482FB9BE25127C44B73C">

									<enum>(B)</enum>

									<header>Sampling and other methods</header>

									<text>The Secretary shall provide the States with such case sampling

				plans and data collection procedures as the Secretary determines necessary to

				produce statistically valid samples of the information described in paragraph

				(2). The Secretary may develop and implement procedures for verifying the

				quality of data submitted by the States.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDA9AC7BEA7BF84FD7A904EE8A0EB633A6">

					<enum>(c)</enum>

					<header>Period of compliance and waivers</header>

						<text>States shall have 2 years from the date of enactment of this Act

			 to comply with the changes to data collection and reporting required by the

			 amendments made by this section.</text>

						<header>Waivers</header>

						<text>The Secretary of Health and Human Services may grant a waiver

									<text>Aggregated statistics on and an analysis of the supply of,

				demand for, and quality of child care, early education, and nonschool-hour

				programs.</text>

								</subparagraph><subparagraph id="ID28F372D9A9884488A49D62D4750A07C0">

									<enum>(C)</enum>

									<text>An assessment and, where appropriate, recommendations for

				Congress concerning efforts that should be undertaken to improve the access of

				the public to quality and affordable child care in the United States.</text>

								</subparagraph><subparagraph id="IDCD440AED1B044F37B7B6A7F8ECF52F59">

									<enum>(D)</enum>

									<text>A progress report describing the progress of the States in

				streamlining data reporting, the Secretary’s plans and activities to provide

				technical assistance to States, and an explanation of any barriers to getting

				data in an accurate and timely manner.</text>

								</subparagraph></paragraph><paragraph id="ID9DFFEF29105C42AC9BEBFFDBE4C1487C">

								<enum>(2)</enum>

								<header>Collection of information</header>

								<text>The Secretary may make arrangements with resource and referral

				organizations, to utilize the child care data system of the resource and

				referral organizations at the national, State, and local levels, to collect the

				information required by paragraph (1)(B).</text>

							<enum>(b)</enum>

							<header>Grants To improve quality and access</header>

								<text>The Secretary shall award grants to States, from allotments

				made under paragraph (2), to improve the quality of and access to child care

				for infants and toddlers, subject to the availability of appropriations for

				this purpose.</text>

								<enum>(2)</enum>

								<header>Allotments</header>

								<text>From funds reserved under section 658O(a)(3) for a fiscal year,

				the Secretary shall allot to each State an amount that bears the same

				relationship to such funds as the amount the State receives for the fiscal year

				under section 658O bears to the amount all States receive for the fiscal year

				under section 658O.</text>

							</paragraph></subsection><subsection id="IDBEDFF146758146259D57752952FFA872">

							<enum>(c)</enum>

							<header>Toll-Free hotline</header>

							<text>The Secretary shall award a grant or contract, or enter into a

				cooperative agreement for the operation of a national toll-free hotline to

				assist families in accessing local information on child care options and

				providing consumer education materials, subject to the availability of

				appropriations for this purpose.</text>

						</subsection><subsection id="IDA4E6781328BD415FADF466C0DE9E6556">

							<enum>(d)</enum>

							<header>Technical assistance</header>

							<text>The Secretary shall provide technical assistance to States on

				developing and conducting the State market rates survey described in section

				658E(c)(4)(A)(i).</text>

					<text>The term <term>Administrator</term> means the Administrator of

					<text>The term <term>corresponding child care facility</term>, used

			 with respect to the Chief Administrative Officer of the House of

			 licensing agreement with, an office of the House of Representatives, the

			 Library of Congress, or an office of the Senate, respectively.</text>

					<header>Entity sponsoring a child care facility</header>

					<text>The term <term>entity sponsoring</term>, used with respect to a

			 child care facility, means a Federal agency that operates, or an entity that

			 enters into a contract or licensing agreement with a Federal agency to operate,

			 a child care facility primarily for the use of Federal employees.</text>

					<enum>(4)</enum>

					<header>Executive agency</header>

					<text>The term <term>Executive agency</term> has the meaning given the

			 term in section 105 of title 5, United States Code, except that the

						<text>does not include the Department of Defense and the Coast Guard;

					<text>The term <term>Federal agency</term> means an Executive agency, a

			 legislative office, or a judicial office.</text>

				<header>Enhancing security</header>

				<subsection id="ID6A1D0DFE687E41E88AA5B472FEA93A2C">

					<enum>(a)</enum>

					<header>Coverage</header>

					<paragraph id="IDD20DDD75B43E4002BBD36229A0F4A4F3">

						<enum>(1)</enum>

						<header>Executive branch</header>

						<text>The Administrator shall issue the regulations described in

			 subsection (b) for child care facilities, and entities sponsoring child care

			 facilities, in executive facilities.</text>

					</paragraph><paragraph id="ID6DD57681C7284046A71043C839AAD9C1">

						<enum>(2)</enum>

						<header>Legislative branch</header>

						<text>The Chief Administrative Officer of the House of Representatives,

			 the Librarian of Congress, and the head of a designated entity in the Senate

			 shall issue the regulations described in subsection (b) for corresponding child

			 care facilities, and entities sponsoring the corresponding child care

			 facilities, in legislative facilities.</text>

					</paragraph><paragraph id="IDB60F7FB2FBA74A468134FB14FCC75C2E">

						<enum>(3)</enum>

						<header>Judicial branch</header>

						<text>The Director of the Administrative Office of the United States

			 Courts shall issue the regulations described in subsection (b) for child care

			 facilities, and entities sponsoring child care facilities, in judicial

			 facilities.</text>

					</paragraph></subsection><subsection id="IDAAB21038A94F45CC9CAA9104ABD11E53">

					<enum>(b)</enum>

					<header>Regulations</header>

					<text>The officers and designated entity described in subsection (a)

			 shall issue regulations that concern—</text>

					<paragraph id="IDF96BCEE5B10C4219888F0FCC6979126B">

						<enum>(1)</enum>

						<text>matters relating to an occupant emergency plan and evacuations,

			 such as—</text>

						<subparagraph id="ID1CAEDE9C767C4A47AB68166D956556CC">

							<enum>(A)</enum>

							<text>providing for building security committee membership for each

			 director of a child care facility described in subsection (a);</text>

						</subparagraph><subparagraph id="ID2467D44A45E1443588BAEA597357605E">

							<enum>(B)</enum>

							<text>establishing a separate section in an occupant emergency plan for

			 each such facility;</text>

						</subparagraph><subparagraph id="ID3534515C8E184581B64B429C4E207A83">

							<enum>(C)</enum>

							<text>promoting familiarity with procedures and evacuation routes for

			 different types of emergencies (such as emergencies caused by hazardous

			 materials, a fire, a bomb threat, a power failure, or a natural

			 disaster);</text>

						</subparagraph><subparagraph id="ID64D6A53DAD104A938A09F08F1C905877">

							<enum>(D)</enum>

							<text>strengthening onsite relationships between security personnel and

			 the personnel of such a facility, such as by ensuring that the post orders of

			 guards reflect responsibility for the facility;</text>

						</subparagraph><subparagraph id="ID79625E2A93074065ACEF8C1076AA3D15">

							<enum>(E)</enum>

							<text>providing specific, clear, and concise evacuation instructions

			 for a facility, including instructions specifying who authorizes an

			 evacuation;</text>

						</subparagraph><subparagraph id="ID409BBD744E524BD4B3F4F73014C573E7">

							<enum>(F)</enum>

							<text>providing for good evacuation equipment, especially cribs;

			 and</text>

						</subparagraph><subparagraph id="ID278D18A4469A4B1DAD87C5447CE69D89">

							<enum>(G)</enum>

							<text>promoting the ability to evacuate without outside assistance;

			 and</text>

						</subparagraph></paragraph><paragraph id="IDB91F7EA122304C53BAF07592A9A8C8CD">

						<enum>(2)</enum>

						<text>matters relating to relocation sites, such as—</text>

						<subparagraph id="ID0E71EC8EB1C14559848CD25D7966C676">

							<enum>(A)</enum>

							<text>promoting an informed parent body that is knowledgeable about

			 evacuation procedures and relocation sites;</text>

						</subparagraph><subparagraph id="IDB8739FC6E774401FAD59A25D37A97BA4">

							<enum>(B)</enum>

							<text>providing regularly updated parent contact information (regarding

			 matters such as names, locations, electronic mail addresses, and cell phone and

			 other telephone numbers);</text>

						</subparagraph><subparagraph id="ID1FBD4F3BC8AB43F7989FAC5AC33141A9">

							<enum>(C)</enum>

							<text>establishing remote telephone contact for parents, to and from

			 areas that are not less than 10 miles from such a facility; and</text>

						</subparagraph><subparagraph id="ID044093614533450F9F37BF06AD5191FA">

							<enum>(D)</enum>

							<text>providing for an alternate site (in addition to regular sites) in

			 the event of a catastrophe, which site may include—</text>

							<clause id="ID91A03024AEF944EFB4ACD41750BEFBD1">

								<enum>(i)</enum>

								<text>a site that would be an unreasonable distance from the facility

			 under normal circumstances; and</text>

							</clause><clause id="ID2488E7BE9C2D4E32B7F3B3908F2380FA">

								<enum>(ii)</enum>

								<text>a facility with 24-hour operations, such as a hotel or law school

			 library.</text>

							</clause></subparagraph></paragraph></subsection></section></title><title id="IDC8A6DF7120C449C7A911B23F565F6F12">

			<enum>III</enum>

			<header>Removal of barriers to increasing the supply of quality child

			 care</header>

				<enum>301.</enum>

				<header>Small business child care grant program</header>

				<subsection id="IDFE7C2F1E334E4FD9889B373628F9212D">

					<enum>(a)</enum>

					<header>Establishment</header>

					<text>The Secretary of Health and Human Services (referred to in this

			 section as the <quote>Secretary</quote>) shall establish a program to award

			 grants to States, on a competitive basis, to assist States in providing funds

			 to encourage the establishment and operation of employer-operated child care

			 programs.</text>

				</subsection><subsection id="ID102C7FB626934D459C3082E7ACACAB39">

					<enum>(b)</enum>

					<header>Application</header>

					<text>To be eligible to receive a grant under this section, a State

			 shall prepare and submit to the Secretary an application at such time, in such

			 manner, and containing such information as the Secretary may require, including

			 an assurance that the funds required under subsection (e) will be

			 provided.</text>

				</subsection><subsection id="ID7D42D4D7B2ED479C86F98130ADA8E8BB">

					<enum>(c)</enum>

					<header>Amount of grant</header>

					<text>The Secretary shall determine the amount of a grant to a State

			 under this section based on the population of the State as compared to the

			 population of all States receiving grants under this section.</text>

				</subsection><subsection id="ID4E4BB91F996D46719AC3626FC7B29889">

					<enum>(d)</enum>

					<header>Use of funds</header>

					<paragraph id="IDB0A8A44EC3BE4C058B11C0A1826D73D0">

						<enum>(1)</enum>

						<header>In general</header>

						<text>A State shall use amounts provided under a grant awarded under

			 this section to provide assistance to small businesses (or consortia formed in

			 accordance with paragraph (3)) located in the State to enable the small

			 businesses (or consortia) to establish and operate child care programs. Such

			 assistance may include—</text>

						<subparagraph id="idF8AE0256950746539C0C4B0C70C98004"><enum>(A)</enum><text>technical

			 assistance in the establishment of a child care program;</text>

						</subparagraph><subparagraph id="ID475E909C4596409BB7CDE8054F0B5C51">

							<enum>(B)</enum>

							<text>assistance for the startup costs related to a child care

			 program;</text>

						</subparagraph><subparagraph id="IDDD1F033B57104FFA9793BD8A824CA0C3">

							<enum>(C)</enum>

							<text>assistance for the training of child care providers;</text>

						</subparagraph><subparagraph id="IDC8D1CF3D472D4F909EDAEB9F58FECE16">

							<enum>(D)</enum>

							<text>scholarships for low-income wage earners;</text>

						</subparagraph><subparagraph id="ID02153ECCE6B441469ABD27DACBAF0E39">

							<enum>(E)</enum>

							<text>the provision of services to care for sick children or to provide

			 care to school-aged children;</text>

						</subparagraph><subparagraph id="ID3E427EAD1D024F8FB25F280164C2EC9F">

							<enum>(F)</enum>

							<text>the entering into of contracts with local resource and referral

			 or local health departments;</text>

						</subparagraph><subparagraph id="IDBE0C4122C60A4CA193E1AA490AD76992">

							<enum>(G)</enum>

							<text>assistance for care for children with disabilities;</text>

						</subparagraph><subparagraph id="idD4FA11CA875C4BA4ADAEA4989C65908B"><enum>(H)</enum><text>payment of

			 expenses for renovation or operation of a child care facility; or</text>

						</subparagraph><subparagraph id="IDAE6BF37AEEBD46AEA1999D1F1934F375">

							<enum>(I)</enum>

							<text>assistance for any other activity determined appropriate by the

			 State.</text>

						</subparagraph></paragraph><paragraph id="ID953C41E0F64C4BD5A981D41CCBD6321B">

						<enum>(2)</enum>

						<header>Application</header>

						<text>In order for a small business or consortium to be eligible to

			 receive assistance from a State under this section, the small business involved

			 shall prepare and submit to the State an application at such time, in such

			 manner, and containing such information as the State may require.</text>

					</paragraph><paragraph id="IDE54ADE31D96948199583966F8D0B997D">

						<enum>(3)</enum>

						<header>Preference</header>

						<subparagraph id="id535D4FBC24674C5D851BDEDBD96F45C8"><enum>(A)</enum><header>In

			 general</header><text>In providing assistance under this section, a State shall

			 give priority to an applicant that desires to form a consortium to provide

			 child care in a geographic area within the State where such care is not

			 generally available or accessible.</text>

						</subparagraph><subparagraph id="idCC0E8E676A754B4CAC38DD2FE3C136D2"><enum>(B)</enum><header>Consortium</header><text>For

			 purposes of subparagraph (A), a consortium shall be made up of 2 or more

			 entities that shall include small businesses and that may include large

			 businesses, nonprofit agencies or organizations, local governments, or other

			 appropriate entities.</text>

						</subparagraph></paragraph><paragraph id="IDF5AA388BA3B742EB8031CCEBE689157C">

						<enum>(4)</enum>

						<header>Limitation</header>

						<text>With respect to grant funds received under this section, a State

			 may not provide in excess of $500,000 in assistance from such funds to any

			 single applicant.</text>

					</paragraph></subsection><subsection id="ID569F782312E44D94B27EBBEE27982A7B"><enum>(e)</enum><header>Matching

			 requirement</header><text>To be eligible to receive a grant under this section,

			 a State shall provide assurances to the Secretary that, with respect to the

			 costs to be incurred by a covered entity receiving assistance in carrying out

			 activities under this section, the covered entity will make available (directly

			 or through donations from public or private entities) non-Federal contributions

			 to such costs in an amount equal to—</text>

					<paragraph id="ID01FD41D42D7C449AAEF95F59F8B63D90">

						<enum>(1)</enum>

						<text>for the first fiscal year in which the covered entity receives

			 such assistance, not less than 50 percent of such costs ($1 for each $1 of

			 assistance provided to the covered entity under the grant);</text>

					</paragraph><paragraph id="ID8FBA951D5C384B01A60B6C0484AD4549">

						<enum>(2)</enum>

						<text>for the second fiscal year in which the covered entity receives

			 such assistance, not less than 66<fraction>2/3</fraction> percent of such costs

			 ($2 for each $1 of assistance provided to the covered entity under the grant;

			 and</text>

					</paragraph><paragraph id="ID71630DB60ADE49AC83031591FAE3F443">

						<enum>(3)</enum>

						<text>for the third fiscal year in which the covered entity receives

			 such assistance, not less than 75 percent of such costs ($3 for each $1 of

			 assistance provided to the covered entity under the grant.</text>

					</paragraph></subsection><subsection id="ID78126ED2F1C245559D1A2FA0898241B4"><enum>(f)</enum><header>Requirements of

			 providers</header><text>To be eligible to receive assistance under a grant

			 awarded under this section, a child care provider shall comply with all

			 applicable State and local licensing and regulatory requirements and all

			 applicable health and safety standards in effect in the State.</text>

				</subsection><subsection id="ID377919C386644A34840A51AF490352F4">

					<enum>(g)</enum>

					<header>State-Level activities</header>

					<text>A State may not retain more than 3 percent of the amount

			 described in subsection (c) for State administration and other State-level

			 activities.</text>

				</subsection><subsection id="ID7C9F8954413144F5B3049E1BDADB7645">

					<enum>(h)</enum>

					<header>Administration</header>

					<paragraph id="ID5C8CC7EE358F4C8E83F9E98A914D05C4">

						<enum>(1)</enum>

						<header>State responsibility</header>

						<text>A State shall have responsibility for administering a grant

			 awarded for the State under this section and for monitoring covered entities

			 that receive assistance under such grant.</text>

					</paragraph><paragraph id="ID321D5B826B4145B881D9FB7D9D33127C">

						<enum>(2)</enum>

						<header>Audits</header>

						<text>A State shall require each covered entity receiving assistance

			 under the grant awarded under this section to conduct an annual audit with

			 respect to the activities of the covered entity. Such audits shall be submitted

			 to the State.</text>

					</paragraph><paragraph id="ID14FA9D8DB011426ABD5308161025BED7">

						<enum>(3)</enum>

						<header>Misuse of funds</header>

						<subparagraph id="IDCF5C48A9FE524665B0A4B864FE360233">

							<enum>(A)</enum>

							<header>Repayment</header>

							<text>If the State determines, through an audit or otherwise, that a

			 covered entity receiving assistance under a grant awarded under this section

			 has misused the assistance, the State shall notify the Secretary of the misuse.

			 The Secretary, upon such a notification, may seek from such a covered entity

			 the repayment of an amount equal to the amount of any such misused assistance

			 plus interest.</text>

						</subparagraph><subparagraph id="ID3818CB3F1E734D468B063135066E5AD8">

							<enum>(B)</enum>

							<header>Appeals process</header>

							<text>The Secretary shall by regulation provide for an appeals process

			 with respect to repayments under this paragraph.</text>

						</subparagraph></paragraph></subsection><subsection id="id3112044A8DD54E919693C09745CE370E"><enum>(i)</enum><header>Reporting

			 requirements</header>

					<paragraph id="ID946E2BDF55674159AAFFE07321B648A4">

						<enum>(1)</enum>

						<header>2-year study</header>

						<subparagraph id="ID29654FB4B0934C1E9AFD3A333BD12B82">

							<enum>(A)</enum>

							<header>In general</header>

							<text>Not later than 2 years after the date on which the Secretary

			 first awards grants under this section, the Secretary shall conduct a study to

			 determine—</text>

							<clause id="ID7B1D7C74DCFC457FA76B0FE48CC9F34E">

								<enum>(i)</enum>

								<text>the capacity of covered entities to meet the child care needs of

			 communities within States;</text>

							</clause><clause id="IDB9E415E31BFF4E4885D4ED7C4744E5BF">

								<enum>(ii)</enum>

								<text>the kinds of consortia that are being formed with respect to

			 child care at the local level to carry out programs funded under this section;

			 and</text>

							</clause><clause id="IDC424CDABA66E478DB03DBEF576389E9C">

								<enum>(iii)</enum>

								<text>who is using the programs funded under this section and the

			 income levels of such individuals.</text>

							</clause></subparagraph><subparagraph id="ID60E53F9D03EC4A8CA7B6DBAE5CFA36B5">

							<enum>(B)</enum>

							<header>Report</header>

							<text>Not later than 28 months after the date on which the Secretary

			 first awards grants under this section, the Secretary shall prepare and submit

			 to the appropriate committees of Congress a report on the results of the study

			 conducted in accordance with subparagraph (A).</text>

						</subparagraph></paragraph><paragraph id="ID013379D87F8F41B58707276340BDE8D6">

						<enum>(2)</enum>

						<header>4-year study</header>

						<subparagraph id="IDCDA18F5F38824D18ADEEDC08527C3BBF">

							<enum>(A)</enum>

							<header>In general</header>

							<text>Not later than 4 years after the date on which the Secretary

			 first awards grants under this section, the Secretary shall conduct a study to

			 determine the number of child care facilities that are funded through covered

			 entities that received assistance through a grant awarded under this section

			 and that remain in operation, and the extent to which such facilities are

			 meeting the child care needs of the individuals served by such

			 facilities.</text>

						</subparagraph><subparagraph id="IDEF51185819384F78AA5C6C2B021A085D">

							<enum>(B)</enum>

							<header>Report</header>

							<text>Not later than 52 months after the date on which the Secretary

			 first awards grants under this section, the Secretary shall prepare and submit

			 to the appropriate committees of Congress a report on the results of the study

			 conducted in accordance with subparagraph (A).</text>

						</subparagraph></paragraph></subsection><subsection id="ID9A0EDB2269324264B98C132729838B07"><enum>(j)</enum><header>Definitions</header><text>In

			 this section:</text>

					<paragraph id="id45F44EAB66614ECBB2DAAFF3F8FDECA0"><enum>(1)</enum><header>Covered

			 entity</header><text>The term <term>covered entity</term> means a small

			 business or a consortium formed in accordance with subsection (d)(3).</text>

					</paragraph><paragraph id="idF31F91CD24294263968F084C8CDDEF42"><enum>(2)</enum><header>Small

			 business</header><text>The term <term>small business</term> means an employer

			 who employed an average of at least 2 but not more than 50 employees on

			 business days during the preceding calendar year.</text>

					</paragraph></subsection><subsection id="IDBC7288C817A748239623AD81C21FB189">

					<enum>(k)</enum>

					<header>Authorization of appropriations</header>

					<paragraph id="ID898D9D38ABD44A688B158FC45FE4C6B9">

						<enum>(1)</enum>

						<header>In general</header>

						<text>There is authorized to be appropriated to carry out this section,

			 $50,000,000 for the period of fiscal years 2006 through 2010.</text>

					</paragraph><paragraph id="ID858C1844556C4D7BA18952F93BD6AD63">

						<enum>(2)</enum>

						<header>Evaluations and administration</header>

						<text>With respect to the total amount appropriated for such period in

			 accordance with this subsection, not more than $2,500,000 of that amount may be

			 used for expenditures related to conducting evaluations required under, and the

			 administration of, this section.</text>

					</paragraph></subsection><subsection id="ID56C7A03AAC6D4DF7B215B9D9D7C63E78">

					<enum>(l)</enum>

					<header>Termination of program</header>

					<text>The program established under subsection (a) shall terminate on

			 September 30, 2010.</text>
