		  development highway system, and for other purposes.</official-title>

		<section id="ID319F10B3EAFF4A2D8459DA99438988DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Appalachian Development Highway System

			 Completion Act of 2005</short-title></quote>.</text>

		</section><section id="ID5021409B1D5843CEA8C94DD610AC1BE9"><enum>2.</enum><header>Appalachian

			 development highway system</header>

			<subsection id="ID332A29D021D74C9DA500F53F90BCB724"><enum>(a)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated out of

			 the Highway Trust Fund (other than the Mass Transit Account) for the

			 Appalachian development highway system program under section 14501 of title 40,

			 United States Code, $840,000,000 for each of fiscal years 2005 through

			 2010.</text>

			</subsection><subsection id="ID383E4656E4284E35A021F800C68B552C"><enum>(b)</enum><header>Apportionment</header><text>The

			 Secretary shall apportion funds made available by subsection (a) for fiscal

			 years 2005 through 2010 among the States based on the latest available

			 cost-to-complete estimate for the Appalachian development highway system under

			 section 14501 of title 40, United States Code, prepared by the Appalachian

			 Regional Commission.</text>

			</subsection><subsection id="ID593B344C84EE4C8BB09300E589A92496"><enum>(c)</enum><header>Applicability

			 of title <enum-in-header>23</enum-in-header></header><text>Funds made available

			 by subsection (a) shall be available for obligation in the same manner as if

			 the funds were apportioned under chapter 1 of title 23, United States Code,

			 except that—</text>

				<paragraph id="ID17D3C5903EA04BC18CA2E2E51F4768F7"><enum>(1)</enum><text>the Federal share

			 of the cost of any project carried out using the funds shall be determined in

			 accordance with section 14501 of title 40, United States Code; and</text>

				</paragraph><paragraph id="ID5CA02992BB764A8397D43E3F2C3BEE3E"><enum>(2)</enum><text>the funds shall

			 remain available until expended.</text>

				</paragraph></subsection><subsection id="ID9D401E4BFE184CAABEBC646E235256AA"><enum>(d)</enum><header>Availability of

			 funds</header><text>Notwithstanding any other provision of law enacted before,

			 on, or after the date of enactment of this Act, any obligation limitation

			 enacted for any of fiscal years 2005 through 2010 shall not apply to

			 obligations authorized for the Appalachian development highway system program

			 under section 14501 of title 40, United States Code.</text>

			</subsection><subsection id="ID7A594283CCC7475AA471BF18039FD6A8"><enum>(e)</enum><header>Loans between

			 States</header>

				<paragraph id="IDA519E7AC13B649DFAAC89C6C13DBD7EE"><enum>(1)</enum><header>In

			 general</header><text>On notice to the Secretary of Transportation, a State

			 that receives an apportionment under subsection (b) may lend any amount of

			 contract authority or obligation authority available to the State pursuant to

			 the apportionment to any other State that is eligible for such an apportionment

			 for use by the borrowing State for activities eligible under section 14501 of

			 title 40, United States Code.</text>

				</paragraph><paragraph id="IDAFF33AF13D114EB297DB7E07D8C528BE"><enum>(2)</enum><header>Repayment</header><text>Any

			 loan under paragraph (1) shall be repaid not later than September 30,

			 2010.</text>

				</paragraph></subsection><subsection id="ID78BA831B432C40C990EF86D647870060"><enum>(f)</enum><header>Administrative

			 expenses</header><text>Section 104(a) of title 23, United States Code, is

			 amended—</text>

				<paragraph id="ID1457C65357B64FE6AD326DEEAD89571F"><enum>(1)</enum><text>in paragraph

			 (1)—</text>

					<subparagraph id="ID97611F8193A940D6B148858CB39F5355"><enum>(A)</enum><text>by striking

			 <quote>the Federal lands highway program under section 204, or the Appalachian

			 development highway system program under section 201 of the Appalachian

			 Regional Development Act of 1965 (40 U.S.C. App.),</quote> and inserting

			 <quote>or the Federal lands highway program under section 204,</quote>;

			 and</text>

					</subparagraph><subparagraph id="ID5E98EFA0CC0341F0A9504237837FB1A5"><enum>(B)</enum><text>in subparagraph

			 (A)—</text>

						<clause id="ID63F3964270334DC5A27CCB364DF0FED3"><enum>(i)</enum><text>by

			 striking <quote>necessary—</quote> and all that follows through <quote>to

			 administer</quote> and inserting <quote>necessary to administer</quote>;

			 and</text>

						</clause><clause id="ID32563425E2BA4BE483847CA55C2CF752"><enum>(ii)</enum><text>by

			 striking clause (ii);</text>

						</clause></subparagraph></paragraph><paragraph id="ID569C7850516A43A99983B319B104B36E"><enum>(2)</enum><text>by redesignating

			 paragraphs (2) through (4) as paragraphs (3) through (5), respectively;

			 and</text>

				</paragraph><paragraph id="IDD535531B59B04E2585D7F6E3ED89BD98"><enum>(3)</enum><text>by inserting

			 after paragraph (1) the following:</text>

					<quoted-block id="ID1365F7B94FE442DB863C76AFF7707851">

						<paragraph id="ID5BE1A95C422E4C5A95A1A7E0E800FC05"><enum>(2)</enum><header>Appalachian

				development highway system</header><text>Whenever an apportionment is made of

				the sums made available for expenditure on the Appalachian development highway

				system program under section 14501 of title 40, the Secretary shall deduct that

				sum, in an amount not to exceed <fraction>2/5</fraction> of 1 percent of the

				sums made available, as the Secretary determines to be appropriate—</text>

							<subparagraph id="IDCDAB9AEDC30243B4997D40A39066C368"><enum>(A)</enum><text>to administer

				that section; and</text>

							</subparagraph><subparagraph id="IDBFE9C78A88A54ECC9FFD24334C450977"><enum>(B)</enum><text>to make transfers

				to the Appalachian Regional Commission to pay the costs of administrative

				activities associated with the Appalachian development highway system.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="IDBB61C6FA238B43A8B78746E4A14B36AA"><enum>(g)</enum><header>Minimum

			 guarantee</header><text>Section 105 of title 23, United States Code, is

			 amended—</text>

				<paragraph id="ID56A76F5770344A8A0044EA13E7DF1B00"><enum>(1)</enum><text>in the first

			 sentence of subsection (a), by striking <quote>Appalachian development highway

			 system,</quote>; and</text>

				</paragraph><paragraph id="ID9B0542D0814241A983919669AFEAAED5"><enum>(2)</enum><text>in subsection

			 (c)(1), by striking <quote>Appalachian development highway system,</quote> each

			 place it appears.</text>

				</paragraph></subsection></section></legis-body>
