			<enum>1.</enum>

			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Water Infrastructure Revitalization

			 Act</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Definitions</header>

			<text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDE7D2C4278EC640ACA8CA38FDCCA51B29">

				<enum>(1)</enum>

				<header>Secretary</header>

				<text>The term <term>Secretary</term> means the Secretary of the Army,

			 acting through the Chief of Engineers.</text>

			</paragraph><paragraph id="IDEE2C140A11974F0FA3463C6BB69429C9">

				<enum>(2)</enum>

				<header>State</header>

				<text>The term <term>State</term> means the State of North

			 Dakota.</text>

			</paragraph></section><section id="ID0E9CE739966846AB844F11FD5D9BCD7D">

			<enum>3.</enum>

			<header>Program</header>

			<subsection id="IDF581E46B0B1F443E9846D5D2BD2230BE">

				<enum>(a)</enum>

				<header>Establishment</header>

				<text>The Secretary shall establish a program to provide environmental

			 assistance to non-Federal interests in the State.</text>

			</subsection><subsection id="ID1954C093432B4D3D9A82FA89A10858C3">

				<enum>(b)</enum>

				<header>Form of assistance</header>

				<text>Assistance under this Act may be provided in the form of design

			 and construction assistance for water-related environmental infrastructure and

			 resource protection and development projects in the State, including projects

			 for—</text>

				<paragraph id="IDD80A0B7F3913430E8D76C60BE56DAA32">

					<enum>(1)</enum>

					<text>wastewater treatment and related facilities;</text>

				</paragraph><paragraph id="ID4D8E29AE70214AE8ACF7B575F28BF2F6">

					<enum>(2)</enum>

					<text>water supply and related facilities;</text>

				</paragraph><paragraph id="IDB64DB7CEB5D843649FC9A5E0C8964BF9">

					<enum>(3)</enum>

					<text>environmental restoration; and</text>

				</paragraph><paragraph id="ID199029DE3232404BBCB5F778912D0974">

					<enum>(4)</enum>

					<text>surface water resource protection and development.</text>

				</paragraph></subsection><subsection id="IDEABF782C140645FEBE3A6D3E3A451F17">

				<enum>(c)</enum>

				<header>Public ownership requirement</header>

				<text>The Secretary may provide assistance for a project under this

			 section only if the project is publicly owned.</text>

			</subsection><subsection id="ID9575C7EBCE19408AB17CF01697A29137">

				<enum>(d)</enum>

				<header>Local cooperation agreement</header>

				<paragraph id="ID39742A488FA842399C1F0EAECCB9B383">

					<enum>(1)</enum>

					<header>In general</header>

					<text>Before providing assistance under this section, the Secretary

			 shall enter into a local cooperation agreement with a non-Federal interest to

			 provide for design and construction of the project to be carried out with the

			 assistance.</text>

				</paragraph><paragraph id="ID688906BDA4964866AA0048B3EA843987">

					<enum>(2)</enum>

					<header>Requirements</header>

					<text>Each local cooperation agreement entered into under this

			 subsection shall provide for the following:</text>

					<subparagraph id="ID6AD2E155A4F64A72846E64AAB79CE194">

						<enum>(A)</enum>

						<header>Plan</header>

						<text>Development by the Secretary, in consultation and coordination

			 with appropriate Federal, State, and tribal officials and organizations

			 recognized under State law that are involved in Federal water programs, of a

			 facilities or resource protection and development plan, including appropriate

			 engineering plans and specifications.</text>

					</subparagraph><subparagraph id="ID197211E70EA1493D895B67375A10DEB4">

						<enum>(B)</enum>

						<header>Legal and institutional structures</header>

						<text>Establishment of such legal and institutional structures as are

			 necessary to ensure the effective long-term operation of the project by the

			 non-Federal interest.</text>

					</subparagraph></paragraph><paragraph id="ID3613607487F24ECF8E18C25857599279">

					<enum>(3)</enum>

					<header>Cost sharing</header>

					<subparagraph id="ID54EF7AA78ABD4889BF3ED4F4D47C5117">

						<enum>(A)</enum>

						<header>In general</header>

						<text>The Federal share of project costs under each local cooperation

			 agreement entered into under this subsection—</text>

						<clause id="ID1D598CC605494BA1AC6482E08D7F84F3">

							<enum>(i)</enum>

							<text>shall be 75 percent; and</text>

						</clause><clause id="IDBE059644DC43428FB7D08CF54C8416A0">

							<enum>(ii)</enum>

							<text>may be in the form of grants or reimbursements of project

			 costs.</text>

						</clause></subparagraph><subparagraph id="ID3F569AA0CDB94C048C7577354DBEBAEB">

						<enum>(B)</enum>

						<header>Credit for design work</header>

						<text>The non-Federal interest shall receive credit, not to exceed 6

			 percent of the total construction costs of a project, for the reasonable costs

			 of design work completed by the non-Federal interest before entering into a

			 local cooperation agreement with the Secretary for the project.</text>

					</subparagraph><subparagraph id="ID5709B3E316864D72AE02B339F9A433F9">

						<enum>(C)</enum>

						<header>Credit for interest</header>

						<text>In case of a delay in the funding of the Federal share of the

			 costs of a project that is the subject of an agreement under this section, the

			 non-Federal interest shall receive credit for reasonable interest incurred in

			 providing the Federal share of the costs of the project.</text>

					</subparagraph><subparagraph id="IDB60DDF9B64094E758EF503AE251159E3">

						<enum>(D)</enum>

						<header>Land, easements, and rights-of-way credit</header>

						<text>The non-Federal interest shall receive credit for land,

			 easements, rights-of-way, and relocations toward the non-Federal share of

			 project costs (including all reasonable costs associated with obtaining permits

			 necessary for the construction, operation, and maintenance of the project on

			 publicly owned or controlled land), but not to exceed 25 percent of total

			 project costs.</text>

					</subparagraph><subparagraph id="IDB6EBC1B461264614BC957396C0A5F94E">

						<enum>(E)</enum>

						<header>Consideration of water rate impacts for local cost

			 share</header>

						<clause id="ID14612E800D0540D49FCEB375379DA57A">

							<enum>(i)</enum>

							<header>In general</header>

							<text>The non-Federal share of the cost of constructing a project under

			 this Act shall be reduced, using the national affordability criteria for water

			 rate percentages relating to State average medium household income developed by

			 the Environmental Protection Agency, by 5 percent for each

			 <fraction>1/2</fraction> percent by which the rate for affordability relating

			 to the project area exceeds the average State-wide rate for

			 affordability.</text>

						</clause><clause id="IDE7CD9119997745CA8BE14CB5BDBE0407">

							<enum>(ii)</enum>

							<header>Multicounty projects</header>

							<text>With respect to a multicounty project under this Act, the average

			 of all affordability rates applicable in the area covered by the project shall

			 be used for the purpose of establishing the local share of the costs of the

			 project.</text>

						</clause></subparagraph><subparagraph id="ID8739E413C417438C8BDA7FB98A45B700">

						<enum>(F)</enum>

						<header>Operation and maintenance</header>

						<text>The non-Federal share of operation and maintenance costs for

			 projects constructed with assistance provided under this section shall be 100

			 percent.</text>

					</subparagraph></paragraph></subsection><subsection id="ID1AF6CB2C33D1430D893CE0CFEEE8E5BA">

				<enum>(e)</enum>

				<header>Applicability of other Federal and State laws</header>

				<text>Nothing in this section waives, limits, or otherwise affects the

			 applicability of any provision of Federal or State law that would otherwise

			 apply to a project to be carried out with assistance provided under this

			 section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID637CA9B3F7204146911922CDD723E397"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text>There is authorized to be appropriated to carry

			 out this section $60,000,000 for the period beginning with fiscal year 2006, to

			 remain available until expended.</text>
