			<text display-inline="no-display-inline">Congress finds that—</text>

				<text display-inline="yes-display-inline">Senator Mark O. Hatfield and

			 Congresswoman Elizabeth Furse served the United States with distinction and

			 honor;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80D6D05300BB4DA799C20FC62ADD2812">

				<enum>(2)</enum>

				<text display-inline="yes-display-inline">Senator Hatfield and

			 Congresswoman Furse have had a lasting impact on the relationship between the

			 United States and Native Americans;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB9A329FB8A247EA8BCF8174B626E5F4">

				<enum>(3)</enum>

				<text display-inline="yes-display-inline">Senator Hatfield and

			 Congresswoman Furse have been champions of the rights of Native Americans and

			 Alaska Natives and worked in Congress to strengthen tribal self-governance;

			 and</text>

				<text display-inline="yes-display-inline">it is a fitting tribute to

			 the leadership, courage, and bipartisan spirit that Senator Mark O. Hatfield

			 and Congresswoman Elizabeth Furse exemplify to establish in their names

			 programs to encourage excellence in tribal government.</text>

			<enum>3.</enum>

			<header>Definitions</header>

			<text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id7FB606BAF3FD43F9BB4287243D3A4D6E">

				<enum>(1)</enum>

				<header>Board</header>

				<text display-inline="yes-display-inline">The term <term>Board</term>

			 means the Board of Trustees of the Foundation established under section

			 4(b).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC01E608E47734F74AA9728DE1BA10241">

				<enum>(2)</enum>

				<header>Eligible individual</header>

				<text display-inline="yes-display-inline">The term <term>eligible

			 individual</term> means a citizen or national of the United States or a

			 permanent resident alien of the United States.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11668AB109B74428BC5277DB8314486A">

				<enum>(3)</enum>

				<header>Foundation</header>

				<text display-inline="yes-display-inline">The term

			 <term>Foundation</term> means the Mark O. Hatfield-Elizabeth Furse Scholarship

			 and Excellence in Tribal Governance Foundation established by section

			 4(a).</text>

				<header>Fund</header>

				<text display-inline="yes-display-inline">The term <term>Fund</term>

			 means the Mark O. Hatfield-Elizabeth Furse Scholarship and Excellence in Tribal

			 Governance Fund established by section 7.</text>

				<header>Institute</header>

				<text display-inline="yes-display-inline">The term

			 <term>Institute</term> means the Institute for Tribal Government at Portland

			 State University.</text>

				<enum>(6)</enum>

				<header>Institution of higher education</header>

				<text display-inline="yes-display-inline">The term <term>institution of

			 higher education</term> has the meaning given the term in section 101(a) of the

			 Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text>

			<enum>4.</enum>

			<header>Establishment of the Mark O. Hatfield-Elizabeth Furse

			 Scholarship and Excellence in Tribal Governance Foundation</header>

			<subsection commented="no" display-inline="no-display-inline" id="idE706EBBE98F74252BA45F256BF2E9D1A">

				<enum>(a)</enum>

				<header>Establishment</header>

				<text display-inline="yes-display-inline">There is established as an

			 independent entity in the Executive branch the Mark O. Hatfield-Elizabeth Furse

			 Scholarship and Excellence in Tribal Governance Foundation.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC9BB41EBF8E14564855657C411C6C814">

				<enum>(b)</enum>

				<header>Board of Trustees</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id6892A8A67A5F4460812DA7F8AA3BDF6E">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Foundation shall be

			 subject to the supervision and direction of a Board of Trustees.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76DE7A2B2C1D4E27A5628D80EDCF0A96">

					<enum>(2)</enum>

					<header>Membership</header>

					<text display-inline="yes-display-inline">The Board shall be comprised

			 of 12 trustees, of whom—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8F65FDF99C2F47DCA1B1BF42A8860CDA">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">2 trustees shall be

			 individuals appointed by the President, by and with the advice and consent of

			 the Senate, after considering recommendations of the Speaker of the House of

			 Representatives, in consultation with the minority leader of the House of

			 Representatives;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ECEFE76E73D4B82AAE86E6EA74A89FC">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">2 trustees shall be

			 individuals appointed by the President, by and with the advice and consent of

			 the Senate, after considering recommendations of the President pro tempore of

			 the Senate, in consultation with the majority and minority leaders of the

			 Senate;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2EE47BAA216D47AE9A4A95EE6F3BD1F4">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">5 trustees, not more than 3

			 trustees of whom shall be of the same political party, shall be individuals

			 appointed by the President, by and with the advice and consent of the Senate,

			 who have demonstrated leadership and interest in strengthening tribal

			 self-governance, such as tribal leaders involved in health and public policy

			 development affecting Native American and Alaska Native communities;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id926B2E7982344FD98BFB038AD09E317B">

						<enum>(D)</enum>

						<text display-inline="yes-display-inline">1 trustee shall be the

			 Secretary of the Interior;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF890B5A991074BA6B955C961257ADD76">

						<enum>(E)</enum>

						<text display-inline="yes-display-inline">1 trustee shall be the

			 Secretary of Education; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41474EC0D9674732B29F951EC1BF5D7F">

						<enum>(F)</enum>

						<text display-inline="yes-display-inline">1 trustee shall be the

			 president of Portland State University, who shall serve as a nonvoting member

			 and shall not be eligible to serve as Chairperson.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id621560A1CA174FDBB614FB6D509B3FD1">

				<enum>(c)</enum>

				<header>Term</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id55A25F6184E34A2F86E3CFE359750E0B">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The term of a member of the

			 Board shall be 6 years, except that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id420C62CD432D4B4F9D5C4B134D957675">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">in the case of the trustees

			 first taking office—</text>

						<clause commented="no" display-inline="no-display-inline" id="idE2D31A9222C14F44B2E0AD0DC1C6904A">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">as designated by the

			 President, 1 trustee appointed under subsection (b)(2)(B) and 2 trustees

			 appointed under subsection (b)(2)(C) shall serve 2 years;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id022D645CDE934B3FB8344F29BB88F537">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">as designated by the

			 President, 1 trustee appointed under subsection (b)(2)(A) and 2 trustees

			 appointed under subsection (b)(2)(C) shall serve 4 years; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id6804E0708D444B238C87BF54D35811E0">

							<enum>(iii)</enum>

							<text display-inline="yes-display-inline">as designated by the

			 President, 1 trustee appointed under subsection (b)(2)(A), 1 trustee appointed

			 under subsection (b)(2)(B), and 1 trustee appointed under subsection (b)(2)(C)

			 shall serve 6 years; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E4744B7D49E4C7296DDD257BBB33FFE">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">a trustee appointed to fill a

			 vacancy shall—</text>

						<clause commented="no" display-inline="no-display-inline" id="id3CD0D24463274F6A952B9DCA3FD6AEFC">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">serve for the remainder of

			 the term for which the predecessor of the trustee was appointed; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idDFFBAE1F6C6E458DA0D3D632BCA9F54E">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">be appointed in the same

			 manner as the original appointment for that vacancy was made.</text>

						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8384E69312C548C4AFF6741DF8C624DB">

				<enum>(d)</enum>

				<header>Travel and subsistence pay</header>

				<text display-inline="yes-display-inline">A trustee shall serve without

			 pay, but shall be entitled to reimbursement for travel, subsistence, and other

			 necessary expenses incurred in the performance of the duties of a member of the

			 Board.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9109CA28060644AAB375BE7179CC46AC">

				<enum>(e)</enum>

				<header>Location of Foundation</header>

				<text display-inline="yes-display-inline">The Foundation shall be

			 located in Portland, Oregon.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id49F5E3D50BE345B58833785E98796E4A">

				<enum>(f)</enum>

				<header>Executive Director</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idE4357BA54FE64B5EA98813AC6921735D">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">There shall be an Executive

			 Director of the Foundation, who shall be appointed by the Board.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E2E5B8F706B43FD9894433A61AC6527">

					<enum>(2)</enum>

					<header>Duties</header>

					<text display-inline="yes-display-inline">The Executive

			 Director—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idE48D59C0B02D4675B19F9DF8C69B708E">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">shall be the chief executive

			 officer of the Foundation; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1A27B5F2A32F4CA1AB2F8FD26D5FABD0">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">shall carry out the functions

			 of the Foundation, subject to the supervision and direction of the Board, and

			 such other functions consistent with this Act as the Board shall

			 prescribe.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id976443F2ED864CC8AB07C328541A697A">

					<enum>(3)</enum>

					<header>Compensation</header>

					<text display-inline="yes-display-inline">The Executive Director shall

			 be compensated at the rate specified for an employee in level IV of the

			 Executive Schedule under section 5315 of title 5, United States Code.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3270B52165F3451A937D0654425DDC95" section-type="subsequent-section">

			<enum>5.</enum>

			<header>Purposes</header>

			<text display-inline="no-display-inline">The purposes of the Foundation

			 shall be—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id73D149D5805A4BDB9BFFD86C7ED6622B">

				<enum>(1)</enum>

				<text display-inline="yes-display-inline">to develop resources to

			 properly train Native American and Alaska Native tribal council members in

			 self-government and related fields;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id368595B122B649898FD367F4D2F188BF">

				<enum>(2)</enum>

				<text display-inline="yes-display-inline">to foster among people in the

			 United States greater recognition and understanding of the role of tribal

			 self-government in the development of the United States;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84062779E25E40709E4FE9344ADBDBF1">

				<enum>(3)</enum>

				<text display-inline="yes-display-inline">to identify critical issues

			 facing tribal governments;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0280EA0113A54F249A45A431689F8272">

				<enum>(4)</enum>

				<text display-inline="yes-display-inline">to establish a program for

			 tribal governance research at the Institute; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5CABB39C6E5A400182FBBA5533EE511F">

				<enum>(5)</enum>

				<text display-inline="yes-display-inline">to provide educational

			 outreach regarding tribal self-government.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id39B6A99F4405485B80867FFBCD86780B" section-type="subsequent-section">

			<enum>6.</enum>

			<header>Authority of the Foundation</header>

			<subsection commented="no" display-inline="no-display-inline" id="id4789B4EB50C3442B83B54C6A954DDE60">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">The Foundation, in

			 consultation with the Institute, may identify and conduct such programs,

			 activities, and services as the Foundation considers appropriate to carry out

			 the purposes of the Foundation.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC5E6C03CA1934AF5A463B3327079E790">

				<enum>(b)</enum>

				<header>Programs, Activities, and Services</header>

				<text display-inline="yes-display-inline">The Foundation may, in

			 accordance with this section—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id12C55D44AE9843C8ABB44AB061A46B32">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">award scholarships,

			 fellowships, internships, and grants; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5AF6C053F67F4699B28E4CFF725FB4A1">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">provide grants to the

			 Institute to carry out and manage other programs, activities, and

			 services.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id94C4FF932A304BD080A875D51BC5EE64">

				<enum>(c)</enum>

				<header>National Competition</header>

				<text display-inline="yes-display-inline">The Foundation may provide,

			 directly or by contract, for the conduct of national competition for the

			 purpose of selecting recipients of scholarships, fellowships, internships, and

			 grants awarded under this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1B064C5DB6F245A381B0943C6F36689D">

				<enum>(d)</enum>

				<header>Award of Scholarships, Fellowships, Internships, and

			 Grants</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id74620C3A769F4D9AB40D81E5E7A6F1B2">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Foundation may award

			 scholarships, fellowships, internships, and grants to eligible individuals who

			 meet the minimum criteria established by the Foundation, for study in fields

			 relating to tribal governance.</text>

				</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idF5185BE1EF7A47029CACFE1502A43F38">

					<enum>(2)</enum>

					<header>Elizabeth furse scholars</header>

					<text display-inline="yes-display-inline">Recipients of scholarships,

			 fellowships, internships, and grants under this Act shall be known as

			 <quote>Elizabeth Furse Scholars</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2CC27E0796084F969D710C9B0DFB4E3C">

				<enum>(e)</enum>

				<header>Scholarships</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idADA6303A569F4606887360651531B56A">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Foundation may award

			 scholarships to outstanding—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idA17020FC0BBC461F883546CC555A0996">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">undergraduate students who

			 intend to pursue careers relating to tribal governance; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB76C2A662B834A50A330E97A5C726514">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">Native American and Alaska

			 Native undergraduate students who intend to pursue careers in tribal public

			 policy.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD319F8DB7CF24C0CBF93F7A740E0C96A">

					<enum>(2)</enum>

					<header>Payments</header>

					<text display-inline="yes-display-inline">An eligible individual

			 awarded a scholarship under this Act may receive payments under this Act only

			 during such periods as the Foundation determines that the eligible

			 individual—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id9F86BBA1C8284EF0BF332244776C1945">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">is maintaining satisfactory

			 proficiency and devoting full time to study or research; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5DE5ADC84DB34CA2943DD7F642A18424">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">is not engaging in gainful

			 employment other than employment approved by the Foundation under regulations

			 of the Board.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC284E344B9A84E1AAA6DDA38325DA0DC">

					<enum>(3)</enum>

					<header>Reports</header>

			 reports containing such information, in such form, and to be filed at such

			 times as the Foundation determines to be necessary from any eligible individual

			 awarded a scholarship under this Act.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE817BA6C00648BB8A345B3810760B1A">

						<enum>(B)</enum>

						<header>Certificate</header>

						<text display-inline="yes-display-inline">Except as otherwise provided

			 under this subsection, a report under subparagraph (A) shall be accompanied by

			 a certificate from an appropriate official at the institution of higher

			 education, approved by the Foundation, stating that the individual is making

			 satisfactory progress in, and is devoting essentially full time to, study or

			 research.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id56BB41F92FD544E3ADEBE2F246261F98">

				<enum>(f)</enum>

				<header>Fellowships</header>

				<text display-inline="yes-display-inline">The Foundation may award

			 fellowships to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idA5C5B9679C754266BC38EDDA53C14F24">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">outstanding graduate students

			 who intend to pursue advanced degrees in fields relating to tribal

			 governance;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F9E4C8AC3864DAD9D914207FF602035">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">outstanding Native American

			 and Alaska Native graduate students who intend to pursue advanced degrees in

			 tribal public policy, law, or medicine; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8A47069F9E0C4F5BA01206F7CC52FDCF">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">faculty from a variety of

			 disciplines to bring the expertise of the faculty to the Foundation.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01B60A3B53CC46DA97223DD12C0B643F">

				<enum>(g)</enum>

				<header>Internships</header>

				<text display-inline="yes-display-inline">The Foundation may award

			 internships to deserving and qualified—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id5A3D6118A5C042559B94AFB3F1ED3F86">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">individuals, for use in

			 participating in internships in Federal, State, and local agencies or in

			 offices of major tribal governance organizations; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCA52769374474CFA9AC503E81DE989BD">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">Native American and Alaska

			 Native individuals, for use in participating in internships in Federal, State,

			 and local agencies or in offices of major public health or public policy

			 organizations.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idABF5FDA22F2F4FD4847DB87B7EC2B911">

				<enum>(h)</enum>

				<header>Grants</header>

				<text display-inline="yes-display-inline">The Foundation shall award

			 grants to the Institute—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id268034B96E4744A2AF718635EC7EF66D">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">to provide for an annual

			 panel of experts to discuss contemporary tribal governance issues;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBEC274346F6247BDA0DA40563D7DB9F1">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">to conduct tribal governance

			 policy research;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88B9938906DE4FFAB35E1B263ABE7BFA">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">to conduct research on Native

			 American and Alaska Native tribal public policy issues; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13ED8E7FA802487D9C81BD135CBDC0D7">

					<enum>(4)</enum>

					<text display-inline="yes-display-inline">to invite visiting

			 policymakers to share practical experiences with the Foundation.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBD471473F47B432FA62A62B0806FD6F2">

				<enum>(i)</enum>

				<header>Coordination</header>

				<text display-inline="yes-display-inline">The Foundation shall assist

			 in the development and implementation of a program for tribal governance

			 research to be located at the Institute.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAB355A3B9C9C4C419AAAD7ABEBE2FE87">

				<enum>(j)</enum>

				<header>Program priorities</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id74CA964EB0DA4FFCA252FDE3FC645CCD">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">Subject to paragraph (2), the

			 Foundation shall determine—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idCE0A608920ED43DD89C6752D3ADC95A1">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the priority of the programs

			 to be carried out under this Act; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id366A7E0CF2C44ED99F253F0C84A86E52">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">the amount of funds to be

			 allocated for the programs.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2303A13B033340C6BDEF7FD3B2101447">

					<enum>(2)</enum>

					<header>Requirements</header>

					<text display-inline="yes-display-inline">Of amounts made available to

			 carry out this section—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id40D5C01B7A0F489AA6E0765309229831">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">not less than 50 percent

			 shall be used for the programs described in subsections (e), (f), and

			 (g);</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id883E0442D7194A249FF6C32908FC6A39">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">not less than 20 percent

			 shall be made available to the Institute to carry out subsections (h) and (i),

			 on the conditions that—</text>

						<clause commented="no" display-inline="no-display-inline" id="id2F45BC9BBEFB49BD98FF24317FC27EE3">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">a 25-percent matching share

			 is provided from other non-Federal sources; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idC221952782FF4D80AE6CA1F72BC1B00B">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">adequate space at the

			 Institute is made available by the Institute for the Executive Director and

			 other appropriate staff of the Foundation; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2B1D1FC0C6034FCA9B3C288A41354966">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">not more than 15 percent

			 shall be used for salaries and other administrative purposes.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idFC7523E58F20428C929315E4A03F5E51" section-type="subsequent-section">

			<enum>7.</enum>

			<header>Establishment of Mark O. Hatfield-Elizabeth Furse Scholarship

			 and Excellence in Tribal Governance Trust Fund</header>

			<subsection commented="no" display-inline="no-display-inline" id="id8CAADB6C827F43E1A40D054D29426A86">

				<enum>(a)</enum>

				<header>Establishment of Fund</header>

				<text display-inline="yes-display-inline">There is established in the

			 Treasury of the United States a trust fund to be known as the <quote>Mark O.

			 Hatfield-Elizabeth Furse Scholarship and Excellence in Tribal Governance Trust

			 Fund</quote>, to be administered by the Foundation, consisting of amounts

			 appropriated to the fund under section 10.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0C00646B2DFD4EA69DF99F935C0E8B5D">

				<enum>(b)</enum>

				<header>Investment of Fund assets</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id4F803E92EA954B6C837350E33FC2C4C5">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The Secretary of the Treasury

			 shall invest in full, at the direction of the Board, the amounts appropriated

			 to the Fund.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9BD16B3C02DD42AEB62D8D9A0EAEA861">

					<enum>(2)</enum>

					<header>Eligible investments</header>

					<text display-inline="yes-display-inline">The investments shall be in

			 public debt securities with maturities suitable for the needs of the

			 Fund.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52382E220D214018B5749C97F01ED737">

					<enum>(3)</enum>

					<header>Interest</header>

					<text display-inline="yes-display-inline">Investments in public debt

			 securities shall bear interest at rates determined by the Secretary of the

			 Treasury, taking into consideration the current average market yield on

			 outstanding marketable obligations of the United States of comparable

			 maturity.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id28E6C189BC2F46F18D49240A503F6A8B" section-type="subsequent-section">

			<enum>8.</enum>

			<header>Expenditures and audit of trust fund</header>

			<subsection commented="no" display-inline="no-display-inline" id="idCE89ED41087248729D8587FCB7DE7FC8">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">The Foundation shall pay from

			 the interest and earnings of the Fund such amounts as the Board determines are

			 appropriate to enable the Foundation to carry out this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id64D714FF76194970B5C4ACEBFECE2CF3">

				<enum>(b)</enum>

				<header>Audit by Government Accountability Office</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idE0D7009D930C4CC984EE9DFEEDB03127">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">The activities of the

			 Foundation and the Institute under this Act may be audited by the Government

			 Accountability Office under such regulations as may be promulgated by the

			 Comptroller General of the United States.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0AF86345C6C43CBA019DAF3AD75845C">

					<enum>(2)</enum>

					<header>Access</header>

					<text display-inline="yes-display-inline">Representatives of the

			 Government Accountability Office shall have access to all books, accounts,

			 records, reports filed and all other papers, things, or property belonging to

			 or in use by the Foundation and the Institute that pertain to

			 federally-assisted activities and are necessary to facilitate the audit.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idFEF99FBC1C674678960E68905D0F0A98" section-type="subsequent-section">

			<enum>9.</enum>

			<header>Administrative provisions</header>

			<subsection commented="no" display-inline="no-display-inline" id="idFDAB05D8545946C9A489B9A5BC007F87">

				<enum></enum><text display-inline="yes-display-inline">To carry out this Act, the

			 Foundation may—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id8DCC28EF69BE4F5A80CA62C23136EE11">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">appoint, and fix the

			 compensation of, such personnel as are necessary to carry out this Act, except

			 that in no case shall an employee other than the Executive Director be

			 compensated at a rate that exceeds the maximum rate for employees in grade

			 GS–15 of the General Schedule under section 5332 of title 5, United States

			 Code;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6CF972FF21C41A9B9596A48766046D3">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">procure or fund the Institute

			 to procure temporary and intermittent services of such experts and consultants

			 as are necessary to the extent authorized by section 3109 of title 5, United

			 States Code, but at rates not to exceed the rate specified at the time of such

			 service for level IV of the Executive Schedule under section 5315 of title 5,

			 United States Code;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82080D4D2F7C40ED8104319A3C719835">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">promulgate such regulations

			 as the Foundation considers to be necessary governing the manner in which the

			 functions of the Foundation shall be carried out;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46D9D4025DAE4DC4B38AEB0AE528E875">

					<enum>(4)</enum>

					<text display-inline="yes-display-inline">accept, hold, administer, and

			 use gifts, both real and personal, for the purpose of aiding or facilitating

			 the work of the Foundation;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3793384BCA44C12AACD3939FA0B9C89">

					<enum>(5)</enum>

					<text display-inline="yes-display-inline">accept and use the services

			 of voluntary and noncompensated personnel and reimburse such personnel for

			 travel expenses, including per diem expenses, as authorized by section 5703 of

			 title 5, United States Code;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D5381397B914D02A3C40FAA002548DD">

					<enum>(6)</enum>

					<text display-inline="yes-display-inline">enter into contracts, grants,

			 or other arrangements or modifications of contracts, grants, or arrangements to

			 carry out this Act, which contracts, grants, arrangements, and modifications

			 may, with the concurrence of at least <fraction>2/3</fraction> of the members

			 of the Board, be entered into without performance bond or other bond, and

			 without regard to section 3709 of the Revised Statutes (41 U.S.C. 5);

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCD15BDE22074515AF33F2E86ABDC43C">

					<enum>(7)</enum>

					<text display-inline="yes-display-inline">make other necessary

			 expenditures.</text>

			<enum>10.</enum>

			<header>Authorization of appropriations</header>

			 appropriated to the Fund $50,000,000.</text>
