		<official-title display="yes">To amend the Internal Revenue Code of 1986

		  to exclude from gross income the gain from the sale of a principal residence by

		  certain employees of the intelligence community.</official-title>

			<enum>1.</enum>

			<header>Exclusion of gain from sale of a principal residence by certain

			 employees of the intelligence community</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID928736689DE3400C840EA0191990F8A8">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">Subparagraph (A) of section

			 121(d)(9) of the Internal Revenue Code (relating to exclusion of gain from sale

			 of principal residence) is amended by striking <quote>duty</quote> and all that

			 follows and inserting</text>

				<quoted-block display-inline="yes-display-inline" id="IDE4D899C15DA24C7F8666C37605D3D524" style="OLC">

					<text>duty—</text><clause commented="no" display-inline="no-display-inline" id="ID0EF7BD612EED4B5EAE39E95B2C8B67E5">

						<enum>(i)</enum>

						<text display-inline="yes-display-inline">as a member of the

				uniformed services,</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="ID529AF2AB62FF482E9D9C4EA1C396AE6B">

						<enum>(ii)</enum>

						<text display-inline="yes-display-inline">as a member of the Foreign

				Service of the United States, or</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="ID02F90A6686694E4FB8BB0209F01B02DC">

						<enum>(iii)</enum>

						<text display-inline="yes-display-inline">as an employee of the

				intelligence community.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID47A43CEF2D0E4877AA6354C9AB7AF70F">

				<enum>(b)</enum>

				<header>Employee of intelligence community defined</header>

				<text display-inline="yes-display-inline">Subparagraph (C) of section

			 121(d)(9) of the Internal Revenue Code of 1986 is amended by redesignating

			 clause (iv) as clause (v) and by inserting after clause (iii) the following new

			 clause:</text>

						<header>Employee of intelligence community</header>

						<text display-inline="yes-display-inline">The term <term>employee of

				the intelligence community</term> means an employee (as defined by section 2105

				of title 5, United States Code) of—</text>

							<enum>(I)</enum>

							<text display-inline="yes-display-inline">the Office of the Director

				of National Intelligence,</text>

							<enum>(II)</enum>

							<text display-inline="yes-display-inline">the Central Intelligence

				Agency,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1F201D96104544078950DA96C25AE869">

							<enum>(III)</enum>

							<text display-inline="yes-display-inline">the National Security

				Agency,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID162FC8F0972E40DC96EF1B6C7911A079">

							<enum>(IV)</enum>

							<text display-inline="yes-display-inline">the Defense Intelligence

				Agency,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8F0DC5CB066E474CA745A52AEAF156AE">

							<enum>(V)</enum>

							<text display-inline="yes-display-inline">the National

				Geospatial-Intelligence Agency,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="IDE10E6148195E4DEE886F339606E876D6">

							<enum>(VI)</enum>

							<text display-inline="yes-display-inline">the National Reconnaissance

				Office,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID84FEA3944A9B4F6D9BF94D2DF1B091D5">

							<enum>(VII)</enum>

							<text display-inline="yes-display-inline">any other office within the

				Department of Defense for the collection of specialized national intelligence

				through reconnaissance programs,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4A435C506EEE402B8EFE7F97E0E5353E">

							<enum>(VIII)</enum>

							<text display-inline="yes-display-inline">any of the intelligence

				elements of the Army, the Navy, the Air Force, the Marine Corps, the Federal

				Bureau of Investigation, the Department of Treasury, the Department of Energy,

				and the Coast Guard,</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="IDC82E95B151644A7C952B65EEAC7E704B">

							<enum>(IX)</enum>

							<text display-inline="yes-display-inline">the Bureau of Intelligence

				and Research of the Department of State, or</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID31BE160CAABA46BB84C88B1E369ED736">

							<enum>(X)</enum>

							<text display-inline="yes-display-inline">any of the elements of the

				Department of Homeland Security concerned with the analyses of foreign

				intelligence information.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID91273B2D7AA54F3DA7E43E8CE0C81418">

				<enum>(c)</enum>

				<header>Special rule</header>

				<text display-inline="yes-display-inline">Subparagraph (C) of section

			 121(d)(9) of the Internal Revenue Code of 1986, as amended by subsection (b),

			 is amended by adding at the end the following new clause:</text>

					<clause commented="no" display-inline="no-display-inline" id="ID570B026B61104F84A3363A5ACE6C847A">

						<enum>(vi)</enum>

						<header>Special rule relating to intelligence community</header>

						<text display-inline="yes-display-inline">An employee of the

				intelligence community shall not be treated as serving on qualified extended

				duty unless—</text>

						<subclause commented="no" display-inline="no-display-inline" id="ID578D06A543924F81843D58F11F1D99F0">

							<enum>(I)</enum>

							<text display-inline="yes-display-inline">for purposes of such duty

				such employee has moved from 1 duty station to another, and</text>

						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID805E0C3F507D4219BA35917251B00C1F">

							<enum>(II)</enum>

							<text display-inline="yes-display-inline">at least 1 of such duty

				stations is located outside of the Washington, District of Columbia, and

				Baltimore metropolitan statistical areas (as defined by the Secretary of

				Commerce).</text>

						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA9A6C0EFC5614CE3B40D49FF066E0D50">

				<enum>(d)</enum>

				<header>Conforming amendment</header>

				<text display-inline="yes-display-inline">The heading for section

			 121(d)(9) of the Internal Revenue Code of 1986 is amended to read as follows:

			 <quote><header-in-text level="subsection" style="OLC">Uniformed services,

			 foreign service, and intelligence community</header-in-text></quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFE99B3AA143E4A32877D6E466C1F4BA8">

				<enum>(e)</enum>

				<header>Effective date; special rule</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDFFE1BF60C97843429FBD46BB6BB6E312">

					<enum>(1)</enum>

					<header>Effective date</header>

					<text display-inline="yes-display-inline">The amendments made by this

			 section shall take effect as if included in the amendments made by section 312

			 of the Taxpayer Relief Act of 1997.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID300AD3A2EDAA45FFB08072B8D4B2485A">

					<enum>(2)</enum>

					<header>Waiver of limitations</header>

					<text display-inline="yes-display-inline">If refund or credit of any

			 overpayment of tax resulting from the amendments made by this section is

			 prevented at any time before the close of the 1-year period beginning on the

			 date of the enactment of this Act by the operation of any law or rule of law

			 (including res judicata), such refund or credit may nevertheless be made or

			 allowed if claim therefor is filed before the close of such period.</text>
