				paper record of the vote that shall be made available for inspection and

				verification by the voter before the vote is cast.</text>

										<enum>(ii)</enum>

										<text>The voting system shall provide the voter with an opportunity

				to correct any error made by the system in the voter-verifiable paper record

				before the permanent voter-verified paper record is preserved in accordance

				with subparagraph (B)(i).</text>

									</clause></subparagraph><subparagraph id="ID00B1BD7E10EB460497D170ABD4554C53">

									<enum>(B)</enum>

									<header>Manual audit capacity</header>

									<text>The permanent voter-verified paper record produced in

				accordance with subparagraph (A) shall—</text>

									<clause id="ID185CB71CBBF14ACEBA3C1F353EA4D37B">

										<enum>(i)</enum>

										<text>be preserved within the polling place, in the manner, if any,

				in which all other paper ballots are preserved within that polling place, or,

				in the manner employed by the jurisdiction for preserving paper ballots in

				general, for later use in any manual audit;</text>

									</clause><clause id="ID0EFB2AD56A164A10BF74905C460E25C3">

										<enum>(ii)</enum>

										<text>be suitable for a manual audit equivalent to that of a paper

				ballot voting system; and</text>

									</clause><clause id="ID8DC0EACD2C63456D8BACAA971200C79F">

										<enum>(iii)</enum>

										<text>be available as the official record and shall be the official

				record used for any recount conducted with respect to any Federal election in

				which the system is used.</text>

									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

						<enum>(2)</enum>

						<header>Prohibition of use of thermal paper</header>

						<text>Section 301(a) of the Help America Vote Act of 2002

						<header>Conforming amendment</header>

						<text>Section 301(a)(1)(A)(ii) of the Help America Vote Act

			 U.S.C. 15481(a)(1)(A)(ii)</external-xref>) is amended by inserting <quote>and

			 before the paper record is produced under paragraph (2)</quote> before the

			 semicolon at the end.</text>

					</paragraph></subsection><subsection id="id716826A307F943C0BA88F4ED8EE4D684"><enum>(b)</enum><header>Voter-verification

			 of results for individuals with disabilities and language minority

			 voters</header><text>Paragraph (3) of section 301(a) of the Help America Vote

			 Act of 2002 (42 U.S.C. 15481(a)(3)) is amended to read as follows:</text>

							<enum>(3)</enum>

							<header>Accessibility for individuals with disabilities and for

				language minorities</header>

							<subparagraph id="id627B13B79FFC4B5D9FF079CB9A97B714"><enum>(A)</enum><header>In

				general</header><text>The voting system shall—</text>

								<clause id="id0221B275C53949B99193893BF31EED04"><enum>(i)</enum><text>be accessible for

				individuals with disabilities, including nonvisual accessibility for the blind

				and visually impaired, in a manner that provides the same opportunity for

				access, participation (including privacy and independence), inspection, and

				verification as for other voters;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idD6CCBAF6AA374693BBE924BA38B9F4AD"><enum>(ii)</enum><text display-inline="yes-display-inline">be accessible for language minority

				individuals to the extent required under section 203 of the Voting Rights Act

				of 1965 (42 U.S.C. 1973aa-1), in a manner that provides the same opportunity

				for access, participation (including privacy and independence), inspection, and

				verification as for other voters;</text>

								</clause><clause id="idD04E71F8449145778CD0EB03F15D804D"><enum>(iii)</enum><text>satisfy the

				requirement of clauses (i) and (ii) through the use of at least one direct

				recording electronic voting system or other voting system equipped for

				individuals with disabilities at each polling place; and</text>

								</clause><clause id="idFAC7D93D17924C6EB51ABD08AD0CEE29"><enum>(iv)</enum><text>if purchased

				with funds made available under title II on or after November 1, 2006, meet the

				voting system standards for disability access (as outlined in this

				paragraph).</text>

								</clause></subparagraph><subparagraph id="id2BD8E1262EA54F5D98A16146020CE60B"><enum>(B)</enum><header>Verification

				requirements</header><text>Any direct recording electronic voting system or

				other voting system described in subparagraph (A)(iii) shall use a mechanism

				that separates the function of vote generation from the function of vote

				casting and shall produce, in accordance with paragraph (2)(A), an individual

				paper record which—</text>

								<clause id="idCC75794EFF0B489BB466720844B436A3"><enum>(i)</enum><text>shall be used to

				meet the requirements of paragraph (2)(B);</text>

								</clause><clause id="idA542EC897A854D37B660085544527053"><enum>(ii)</enum><text>shall be

				available for visual, audio, and pictorial inspection and verification by the

				voter, with language translation available for all forms of inspection and

				verification in accordance with the requirements of section 203 of the Voting

				Rights Act of 1965;</text>

								</clause><clause id="idAECEEA0F045B4EAB8D46B8CF46D0BD82"><enum>(iii)</enum><text>shall not

				require the voter to handle the paper; and</text>

								</clause><clause id="id6E32A324F9084B5A8D38674A36927368"><enum>(iv)</enum><text>shall not

				preclude the use of Braille or tactile ballots for those voters who need

				them.</text>

								</clause><continuation-text continuation-text-level="subparagraph">The

				requirement of clause (iii) shall not apply to any voting system certified by

				the Independent Testing Authorities before the date of the enactment of this

				Act.</continuation-text></subparagraph><subparagraph id="idC53CA22DDB7443638F04BD8AE928E9F0"><enum>(C)</enum><header>Requirements

				for language minorities</header><text>Any record produced under subparagraph

				(B) shall be subject to the requirements of section 203 of the Voting Rights

				Act of 1965 to the extent such section is applicable to the State or

				jurisdiction in which such record is produced.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDA29D3E96201D495880A15611D18DED4E">

					<enum>(c)</enum>

					<header>Additional voting system requirements</header>

					<text>Section 301(a) of the Help America Vote Act of 2002

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481(a)">42 U.S.C.

			 15481(a)</external-xref>), as amended by subsection (a)(2), is amended by

			 adding to the end the following new paragraphs:</text>

							<enum>(8)</enum>

							<header>Instruction of election officials</header>

							<text>Each State shall ensure that election officials are instructed

				on the right of any individual who requires assistance to vote by reason of

				blindness, other disability, or inability to read or write to be given

				assistance by a person chosen by that individual under section 208 of the

				<act-name parsable-cite="VRA65">Voting Rights Act of 1965</act-name>.</text>

						</paragraph><paragraph id="ID2A94BC924DE54CD3BFB2C6A3556A6502">

							<enum>(9)</enum>

							<header>Prohibition of use of undisclosed software in voting

				systems</header>

							<text>No voting system shall at any time contain or use any

				undisclosed software. Any voting system containing or using software shall

				disclose the source code, object code, and executable representation of that

				software to the Commission, and the Commission shall make that source code,

				object code, and executable representation available for inspection upon

				request to any citizen.</text>

						</paragraph><paragraph id="IDE00FB9E6CAAF4733AC9CD6C4D46649B7">

							<enum>(10)</enum>

							<header>Prohibition of use of wireless communication devices in

				voting systems</header>

							<text>No voting system shall use any wireless communication

				device.</text>

						</paragraph><paragraph id="IDA79CF977177D444199C41027490E78AD">

							<enum>(11)</enum>

							<header>Certification of software and hardware</header>

							<text>All software and hardware used in any electronic voting system

				shall be certified by laboratories accredited by the Commission as meeting the

				requirements of paragraphs (9) and (10).</text>

						</paragraph><paragraph id="ID4DD315ADC8EB4E2E9D68ED6BE0D40131">

							<enum>(12)</enum>

							<header>Security standards for manufacturers of voting systems used

				in Federal elections</header>

							<subparagraph id="ID3D5FB89BE92C4B81A4A42AE33649C347">

								<enum>(A)</enum>

								<header>In general</header>

								<text>No voting system may be used in an election for Federal office

				unless the manufacturer of such system meets the requirements described in

				subparagraph (B).</text>

							</subparagraph><subparagraph id="ID22A8E9E7444B4640A495BD71DA975796">

								<enum>(B)</enum>

								<header>Requirements described</header>

								<text>The requirements described in this subparagraph are as

				follows:</text>

								<clause id="ID293AB197405C4964B20ECD8E79813A9E">

									<enum>(i)</enum>

									<text>The manufacturer shall conduct background checks on individuals

				who are programmers and developers before such individuals work on any software

				used in connection with the voting system.</text>

								</clause><clause id="idACA6D4337249406BA31C7EE676E8CD64"><enum>(ii)</enum><text>The manufacturer

				shall document the chain of custody for the handling of software used in

				connection with voting systems.</text>

								</clause><clause id="ID4BC57FFAA1CD4918A59DF4DEFF369808">

									<enum>(iii)</enum>

									<text>The manufacturer shall ensure that any software used in

				connection with the voting system is not transferred over the Internet.</text>

								</clause><clause id="IDB8F094FD5DDF481C9242607EC710D47D">

									<enum>(iv)</enum>

									<text>In the same manner and to the same extent described in

				paragraph (9), the manufacturer shall provide the codes used in any software

				used in connection with the voting system to the Commission and may not alter

				such codes once certification by the Independent Testing Authorities has

				occurred unless such system is recertified.</text>

								</clause><clause id="IDEE79EBBC337E41AE8A1EBC8C075AF1E6">

									<enum>(v)</enum>

									<text>The manufacturer shall implement procedures to ensure internal

				security, as required by the Director of the National Institute of Standards

				and Technology.</text>

								</clause><clause id="ID8C1FA66042824D1A8264F6B0EFBCFB4D">

									<enum>(vi)</enum>

									<text>The manufacturer shall meet such other requirements as may be

				established by the Director of the National Institute of Standards and

				Technology.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="idD292CCF7D8BF4A02BD3F0F1D6A8CA89A"><enum>(d)</enum><header>Effective

			 date</header><text>Each State and jurisdiction shall be required to comply with

			 the amendments made by this section on and after November 1, 2006.</text>

				</subsection></section><section id="IDCC2E1D224CFB4C86AF8EF4F30D216F05">

				<enum>102.</enum>

				<header>Requirement for mandatory recounts</header>

				<text display-inline="no-display-inline">On and after the date of the

			 enactment of this Act, the Election Assistance Commission shall conduct random

			 unannounced manual mandatory recounts of the voter-verified records of each

			 election for Federal office (and, at the option of the State or jurisdiction

			 involved, of elections for State and local office held at the same time as such

			 an election for Federal office) in 2 percent of the polling locations (or, in

			 the case of any polling location which serves more than 1 precinct, 2 percent

			 of the precincts) in each State and with respect to 2 percent of the ballots

			 cast by uniformed and overseas voters immediately following the election and

			 shall promptly publish the results of those recounts in the Federal Register.

			 In addition, the verification system used by the Election Assistance Commission

			 shall meet the error rate standards described in section 301(a)(5) of the Help

			 America Vote Act of 2002.</text>

			</section><section id="ID76AF84A3EEDA486CA6A2D1F83297844F">

				<enum>103.</enum>

				<header>Specific, delineated requirement of study, testing, and

			 development of best practices</header>

				<subsection id="id0692B1FB013C49929D99ED9DFDDC6574"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subtitle C of title

			 II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15381">42 U.S.C. 15381</external-xref> et seq.) is

			 amended by—</text>

					<paragraph id="IDAD7E726A70E54F809BB4D4E03D8D4920">

						<enum>(1)</enum>

						<text>redesignating section 247 as section 248; and</text>

					</paragraph><paragraph id="IDFD2A8172FBF24083BACF3818A3C37ED7">

						<enum>(2)</enum>

						<text>by inserting after section 246 the following new section:</text>

									<header>Payments to States</header>

									<text>Subject to subsection (b), not later than the date that is 30

				days after the date of the enactment of the <short-title>Count Every Vote Act of 2005</short-title>, the Election

				Assistance Commission shall pay to each State an amount to assist the State in

				paying for the implementation of the voter-verification and audit capacity

				requirements of paragraphs (2) and (3) of section 301(a), as amended by

				subsections (a) and (b) of section 2 of such Act.</text>

								</subsection><subsection id="ID88FD11785D494201A7008114EB25FA2B">

									<enum>(b)</enum>

									<header>Limitation</header>

									<text>The amount paid to a State under subsection (a) for each voting

				system purchased by a State may not exceed the average cost of adding a printer

				with accessibility features to each type of voting system that the State could

				have purchased to meet the requirements described in such subsection.</text>

								</subsection></section><section id="ID09D22551406D4242AD835563525D5E55">

								<enum>298.</enum>

								<header>Appropriation</header>

								<text display-inline="no-display-inline">There are authorized and

				appropriated $500,000,000 to the Election Assistance Commission, without fiscal

				year limitation, to make payments to States in accordance with section 297(a).

				Furthermore, there are authorized and appropriated $20,000,000 to the Election

				Assistance Commission, for each of fiscal years 2006 through 2010, in addition

				to any amounts otherwise appropriated for administrative costs to assist with

				conducting recounts, the implementation of voter verification systems, and

				improved security measures.</text>

									<text>Not later than 6 months after the date of the enactment of the

				<short-title>Count Every Vote Act of 2005</short-title>,

				the Commission, in consultation with the Director of the National Institute of

				Standards and Technology, shall submit to Congress a report on a proposed

				security review and certification process for all voting systems used in

				elections for Federal office, including a description of the certification

				process to be implemented under section 231.</text>

								</subsection><subsection id="ID96BE21BD1C1245C2A641111B6D19822D">

									<enum>(b)</enum>

									<header>Report to Congress on operational and management

				systems</header>

									<text>Not later than 3 months after the date of the enactment of the

				<short-title>Count Every Vote Act of 2005</short-title>,

				the Commission shall submit to Congress a report on operational and management

				systems applicable with respect to elections for Federal office, including the

				security standards for manufacturers described in section 301(a)(7), that

				should be employed to safeguard the security of voting systems, together with a

				proposed schedule for the implementation of each such system.</text>

								</subsection><subsection id="ID7ECBEDE80DCA46F49051F192FDC94092">

									<enum>(c)</enum>

									<header>Provision of security consultation services</header>

									<paragraph id="ID15C2FAF707C94B2D8DB337934FA44FD8">

										<enum>(1)</enum>

										<header>In general</header>

										<text>On and after the date of the enactment of the

				<short-title>Count Every Vote Act of 2005</short-title>,

				the Commission, in consultation with the Director of the National Institute of

				Standards and Technology, shall provide security consultation services to

				States and local jurisdictions with respect to the administration of elections

				for Federal office.</text>

									</paragraph><paragraph id="ID726EE1095B5A4BDF890AC9A1A75B0839">

										<enum>(2)</enum>

										<header>Appropriation</header>

										<text>To carry out the purposes of paragraph (1), $2,000,000 is

			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481(a)(1)(B)">42 U.S.C. 15481(a)(1)(B)</external-xref>)

			 is amended by striking <quote>, a punch card voting system, or a central count

			 voting system</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE73801982F664B069C2E9C7BF60513D7"><enum>(b)</enum><header>Clarification

			 of requirements for punch card systems</header><text>Subparagraph (A) of

			 section 301(a)(1) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481(a)(1)(A)">42 U.S.C.

			 15481(a)(1)(A)</external-xref>) is amended by inserting <quote>punch card

			 voting system,</quote> after <quote>any</quote>.</text>

			 date</header><text display-inline="yes-display-inline">Each State and

			 jurisdiction shall be required to comply with the amendments made by this

			 section on and after November 1, 2006.</text>

				</subsection><subsection id="ID0020443cbdad4f84b010a9370c7b73cf"><enum>(d)</enum><header>Residual vote

			 benchmark</header><text>.</text>

					<paragraph id="ID92be2d8cb57641fb9913f719d4f9d3ad"><enum>(1)</enum><header>In

			 general</header><text>The error rate of the voting system (as defined under

			 section 301 of the Help America Vote Act of 2002) in counting ballots

			 (determined by taking into account only those errors which are attributable to

			 the voting system and not attributable to an act of the voter) shall not exceed

			 the error rate standards established under the voting systems standards issued

			 and maintained by Election Assistance Commission.</text>

					</paragraph><paragraph id="ID78c4adeba23d44d6ba6fbf8c6e00d9dc"><enum>(2)</enum><header>Residual ballot

			 performance benchmark</header><text>In addition to the error rate standards

			 described in paragraph (1), the Election Assistance Commission shall issue and

			 maintain a uniform benchmark for the residual ballot error rate that

			 jurisdictions may not exceed. For purposes of the preceding sentence, the

			 residual vote error rate shall be equal to the combination of overvotes,

			 spoiled or uncountable votes, and undervotes cast in the contest at the top of

			 the ballot, but excluding an estimate, based upon the best available research,

			 of intentional undervotes. The Commission shall base the benchmark issued and

			 maintained under this subparagraph on evidence of good practices in

			 representative jurisdictions.</text>

					</paragraph><paragraph id="IDa9077b6408f34f77b01a0adcf7a0239f"><enum>(3)</enum><header>Historically

			 high intentional undervotes</header>

						<subparagraph id="ID211463abe0c64fa2829961d563515b2a"><enum>(A)</enum><text>Congress finds

			 that there are certain distinct communities in certain geographic areas that

			 have historically high rates of intentional undervoting in elections for

			 Federal office, relative to the rest of the Nation.</text>

						</subparagraph><subparagraph id="IDe9264157d4ab44808c06a75d09df25e3"><enum>(B)</enum><text>In establishing

			 the benchmark described in subparagraph (B), the Election Assistance Commission

			 shall—</text>

							<clause id="ID9e7fd37306d5490285abf95cc3985e96"><enum>(i)</enum><text>study and report

			 to Congress on the occurrences of distinct communities that have significantly

			 higher than average rates of historical intentional undervoting; and</text>

							</clause><clause id="ID60ffa7eca0df404cb7c125f2bd501773"><enum>(ii)</enum><text>promulgate for

			 local jurisdictions in which that distinct community has a substantial presence

			 either a separate benchmark or an exclusion from the national benchmark, as

			 appropriate.</text>

							</clause></subparagraph></paragraph></subsection></section></title><title id="idC1AF2AF2B74A465CBC29C12AAC847592"><enum>II</enum><header>Provisional

			 ballots</header>

			<section id="id748F538C7A0F43F4B2089F6242E29D2A"><enum>201.</enum><header>Requirements

			 for casting and counting provisional ballots</header>

				<subsection id="id68BA6AA3C653484FB5C3136D1740181B"><enum>(a)</enum><header>Eligibility of

			 provisional ballots</header>

					<paragraph id="id588A18688284415AA1855884FA52B373"><enum>(1)</enum><header>In

			 general</header><text>Paragraph (4) of section 302(a) of the Help America Vote

			 Act of 2002 (42 U.S.C. 15482(a)(4)) is amended by inserting at the end the

			 following new sentence: <quote>The determination of eligibility shall be made

			 without regard to the location at which the voter cast the provisional ballot

			 and without regard to any requirement to present identification to any election

			 official.</quote>.</text>

					</paragraph><paragraph id="idEA75F8E08824430C937A18B8B575630E"><enum>(2)</enum><header>Effective

			 date</header><text>The amendment made by paragraph (1) shall apply to States

			 and jurisdictions on and after November 1, 2006.</text>

					</paragraph></subsection><subsection id="id5BD2EEC570DF4D32B4CE431272CC98D5"><enum>(b)</enum><header>Timely

			 processing of ballots</header>

					<paragraph id="idADE61C6F3C124CD098694E674208DC1A"><enum>(1)</enum><header>In

			 general</header><text>Subsection (a) of section 302 of the Help America Vote

			 Act of 2002 (42 U.S.C. 15482(a)) is amended by inserting after paragraph (5)

			 the following new paragraph:</text>

						<quoted-block display-inline="no-display-inline" id="idD83FA916117045A7A3D8096353F83033" style="OLC">

							<paragraph id="ID096fe0602a3e4a82b0a5fec72093d84c"><enum>(6)</enum><text>The appropriate

				State election official shall develop, according to guidelines established by

				the Election Assistance Commission, reasonable procedures to assure the timely

				processing and counting of provisional ballots, including—</text>

								<subparagraph id="ID567f6a593c704b9e91ceed4a8fba0d99"><enum>(A)</enum><text>standards for

				timely processing and counting to assure that, after the conclusion of the

				provisional vote count, parties and candidates may have full, timely, and

				effective recourse to the recount and contest procedures provided by State law;

				and</text>

								</subparagraph><subparagraph id="ID39bc15b24c174b6ba0449162068ef8a8"><enum>(B)</enum><text>standards for the

				informed participation of candidates and parties such as are consistent with

				reasonable procedures to protect the security, confidentiality, and integrity

				of personal information collected in the course of the processing and counting

				of provisional ballots.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph><paragraph id="idD80AE3ABE48E40F99BBF48ECFF079291"><enum>(2)</enum><header>Effective

			 date</header><text>Subsection (d) of section 302 of the Help America Vote Act

			 of 2002 (42 U.S.C. 15482(d)) is amended—</text>

				site</header><text>For purposes of this section and section 299, the term

				<term>voting site</term> means a polling location, except that in the case of

				any polling location which serves more than 1 precinct, such term shall mean a

				precinct.</text>

				standards regarding the minimum number of voting systems, poll workers, and

				other election resources (including all other physical resources) required

				under section 321 on the day of any Federal election and on any days during

				which early voting is allowed for a Federal election.</text>

										</subsection><subsection id="IDD6C3EFF29AAF472A8595008866157356">

											<enum>(b)</enum>

											<header>Distribution</header>

											<paragraph id="id7CB39636C6CD4ACB91E4CD27655CA524"><enum>(1)</enum><header>In

				general</header><text>The standards described in subsection (a) shall provide

				for a uniform and nondiscriminatory distribution of such systems, workers, and

				other resources, and shall take into account, among other factors, the

				following with respect to any voting site:</text>

												<subparagraph id="id48CAD80A5D2D4A9F990C96AB1F360174"><enum>(A)</enum><text>The voting age

				population.</text>

												</subparagraph><subparagraph id="id2D1BEFEAD7774C64A1DC959F03A205B0"><enum>(B)</enum><text>Voter turnout in

				past elections.</text>

												</subparagraph><subparagraph id="id84F2372455BA4F96ADE646740B1287C8"><enum>(C)</enum><text>The number of

				voters registered.</text>

												</subparagraph><subparagraph id="id28F0B0093BF44F8AB2EC92B81AA53063"><enum>(D)</enum><text>The number of

				voters who have registered since the most recent Federal election.</text>

												</subparagraph><subparagraph id="idD02153FC240A4907B5AF8E9457E61D18"><enum>(E)</enum><text>Census data for

				the population served by such voting site.</text>

												</subparagraph><subparagraph id="idAB5BE9AEEC4944308D07839BE638A71E"><enum>(F)</enum><text>The educational

				levels and socio-economic factors of the population served by such voting

				site.</text>

												</subparagraph><subparagraph id="id9D4C40FBA5FD4497B45D5266782D6706"><enum>(G)</enum><text>The needs and

				numbers of disabled voters and voters with limited English proficiency.</text>

												</subparagraph><subparagraph id="id382C72AD73CC4B4AB32501DFD5572919"><enum>(H)</enum><text>The type of

				voting systems used.</text>

												</subparagraph></paragraph><paragraph id="idADF201D8756341E583C7520A1706F1A4"><enum>(2)</enum><header>No factor

				dispositive</header><text>The standards shall provide that any distribution of

				such systems shall take into account the totality of all relevant factors, and

				no single factor shall be dispositive under the standards.</text>

											</paragraph><paragraph id="idEB6BC326A076401381F8FB892FB5E645"><enum>(3)</enum><header>Purpose</header><text>To

				the extent possible, the standards shall provide for a distribution of voting

				systems, poll workers, and other election resources with the goals of—</text>

												<subparagraph id="idC23A578FCB6843A0A16509B48126C967"><enum>(A)</enum><text>ensuring an equal

				waiting time for all voters in the State; and</text>

												</subparagraph><subparagraph id="idA991396DBE284D0CA07FA48FE5D08A78"><enum>(B)</enum><text>preventing a

				waiting time of over 1 hour at any polling place.</text>

												</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4A5D70752DAE4E0AAE14CB77D65CEBDC"><enum>(c)</enum><header>Deviation</header><text>The

				standards described in subsection (a) shall permit States, upon giving

				reasonable public notice, to deviate from any allocation requirements in the

				case of unforseen circumstances such as a natural disaster or terrorist

				attack.</text>

				plans for States with excessive voter wait times</header>

									<subsection commented="no" display-inline="no-display-inline" id="idBA76A26A9C984B8BA69FC9BAD715F8A4"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Each jurisdiction for

				which the Election Assistance Commission determines that a substantial number

				of voters waited more than 90 minutes to cast a vote in the election on

				November 2, 2004, shall comply with a State remedial plan established under

				this section.</text>

									</subsection><subsection commented="no" display-inline="no-display-inline" id="id7BAFBAE1678A437D9429C9EE50E0BB87"><enum>(b)</enum><header>State remedial

				plans</header><text>For each State or jurisdiction which is required to comply

				with this section, the Election Assistance Commission shall establish a State

				remedial plan to minimize the waiting times of voters.</text>

									</subsection><subsection commented="no" display-inline="no-display-inline" id="id141C82B1ACA64E928179DC84E1591BEE"><enum>(c)</enum><header>Jurisdiction</header><text>For

				purposes of this section, the term <term>jurisdiction</term> has the same

				meaning as the term <term>registrar's jurisdiction</term> under section 8 of

				the National Voter Registration Act of 1993.</text>

									</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>

				and processed in the manner provided for absentee ballots under State

				ballot cast under subsection (a) shall be counted if postmarked or signed

				before the close of the polls on election day and received by the appropriate

				State election official on or before the date which is 10 days after the date

				of the election or the date provided for the receipt of absentee ballots under

				State law, whichever is later.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id55EF1E16D26E49D98885C05EE0C8AF24"><enum>(c)</enum><header>Effective

				absentee and overseas ballots cast, including the numbers of such ballots cast

				of voting machines that were replaced on the day of the election.</text>

				subsection (a) and shall report to Congress not later than 9 months after any

				Federal election the following:</text>

				expenditures of each State under the provisions of this Act.</text>

								</paragraph><paragraph commented="no" id="id5DF223B0A8244A15AF295839A7CC256A"><enum>(2)</enum><text>The voter turnout

				in the election.</text>

								</paragraph><paragraph commented="no" id="idFB06272BCB7C4B4EB402D1C4251B1694"><enum>(3)</enum><text>The number of

				registered voters and the number of individuals eligible to register who are

				not registered.</text>

								</paragraph><paragraph commented="no" id="idA3EE5F83404A4F1FB2721DE44F2B5F11"><enum>(4)</enum><text>The number of

				voters who have registered to vote in a Federal election since the most recent

				such election.</text>

								</paragraph><paragraph commented="no" id="id2CCF94D7FE5344548462ED00B5F4BB31"><enum>(5)</enum><text>The extent to

				which voter registration information has been shared among government agencies

				(including any progress on implementing statewide voter registration databases

				under section 303(a)).</text>

								</paragraph><paragraph commented="no" id="id3133FFAD344B4C2E8FB47627F4C7EF9B"><enum>(6)</enum><text>The extent to

				which accurate voter information has been maintained over time.</text>

								</paragraph><paragraph commented="no" id="idF5D9325C376A4522AA76EC239C6AFAA8"><enum>(7)</enum><text>The number and

				types of new voting systems purchased by States and jurisdictions.</text>

								</paragraph><paragraph commented="no" id="id2E1FC12DC61E467DAA503976833B8BEA"><enum>(8)</enum><text>The amount of

				time individuals waited to vote.</text>

								</paragraph><paragraph commented="no" id="idAF10E5F2365D4AA19A0314B57AE180D9"><enum>(9)</enum><text>The number of

				early votes, provisional votes, absentee ballots, and overseas ballots

				distributed, cast, and counted.</text>

								</paragraph><paragraph commented="no" id="id7DED05ADDE1547E5B1325AC7FE74AC7B"><enum>(10)</enum><text>The amount of

				training that poll workers received.</text>

								</paragraph><paragraph commented="no" id="id305281E745E448989F5AF15A09AEEDE6"><enum>(11)</enum><text>The number of

				poll workers.</text>

				polling locations and precincts.</text>

			 of title III of the Help America Vote Act of 2002, as added and amended by this

				general</header><text>Each State and jurisdiction shall require that each

				person who works in a polling place during an election for Federal office

				receives adequate training not earlier than 3 months before the

				election.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="idFF22FE764AFA4DD4B9E74E5452A5037B"><enum>(b)</enum><header>Training</header><text>The

				training required under subsection (a) shall, at a minimum, include—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="idC8A351D45A044582B474F9FC893DC1C6"><enum>(1)</enum><text>hands-on training

				on all voting systems used in the election;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id064DBB921E584CFF961A16EBB14E89B2"><enum>(2)</enum><text>training on

				accommodating individuals with disabilities, individuals who are of limited

				English proficiency, and individuals who are illiterate;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDA460C472FB04429BAFE7298071D20B0"><enum>(3)</enum><text>training on

				requirements for the identification of voters;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35F91B0F767B469FB7D670F30E0D7C85"><enum>(4)</enum><text>training on the

				appropriate use of provisional ballots and the process for casting such

				ballots;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6CA0E7737B04D90B4E7D56E4912A486"><enum>(5)</enum><text>training on

				registering voters on the day of the election;</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC132981AF4A24E00A5393DECBED19B25"><enum>(6)</enum><text>training on which

				individuals have the authority to challenge voter eligibility and the process

				for any such challenges; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84FBF037042D4B45BBB82145D5DDDE52"><enum>(7)</enum><text>training on

				security procedures.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7B39478B744848218A5D790DC56D90D5"><enum>(c)</enum><header>Effective

				date</header><text>Each State and jurisdiction shall be required to comply with

				the requirements of this section on and after August 1, 2006.</text>

					<header>Impartial administration of elections</header>

								<header>Publication of State election laws</header>

								<paragraph id="idDB510D729ADF4552B2EE13A4A56DFFD0"><enum>(1)</enum><header>In

				general</header><text>Each State shall be required to publish all State laws,

				regulations, procedures, and practices relating to Federal elections on January

				1 of each year in which there is a regularly scheduled election for a Federal

				office.</text>

								</paragraph><paragraph id="id96C788EA4D7149B69B8302A77C1CBFD3"><enum>(2)</enum><header>Maintenance of

				laws on the Internet</header><text>Each State shall be required to maintain an

				updated version of all material published under paragraph (1) on an easily

				accessible public web site on the Internet.</text>

								</paragraph></subsection><subsection id="id7F612DD3B0DA4069BCEE673F5410E6F6"><enum>(b)</enum><header>Notice of

				changes in State election laws</header>

								<text>Not later than 15 days prior to any Federal election, each

				State shall issue a public notice describing all changes in State law affecting

				voting in Federal elections and the administration of Federal elections since

				the most recent prior such election. If any State or local government makes any

				change affecting the administration of Federal elections within 15 days of a

				Federal election, the State or local government shall provide adequate public

				notice.</text>

							</subsection><subsection id="idF4FBF08C1F474E279624C4F6141B6C2D">

								<enum>(c)</enum>

								<header>Observers</header>

								<paragraph id="idA6A5ED093BB7438FAB0B2F7A916317AA"><enum>(1)</enum>

									<header>Standards</header><text>Each State shall issue

				nondiscriminatory standards for granting access to nonpartisan election

				observers. Such standards shall take into account the need to avoid disruption

				and crowding in polling places.</text>

								</paragraph><paragraph id="id227AD731C5A5446CA4A3EFA25B808C48">

									<enum>(2)</enum>

									<header>In general</header>

									<text>Each State shall allow uniform and nondiscriminatory access to

				any polling place for purposes of observing a Federal election to nonpartisan

				domestic observers (including voting rights and civil rights organizations) and

				international observers in accordance with the standards published under

				paragraph (1).</text>

								</paragraph><paragraph id="idFEAFDCB14A6348C19D665EBAEDC3821D">

									<enum>(3)</enum>

									<header>Notice of denial of observation request</header>

									<text>Each State shall issue a public notice with respect to any

				denial of a request by any observer described in paragraph (2) for access to

				any polling place for purposes of observing a Federal election. Such notice

				shall be issued not later than 24 hours after such denial.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8E17CB4AEE434EB2994AE5554D8EAC1E"><enum>(d)</enum><header>Effective

				date</header><text>Each State shall be required to comply with the requirements

				of this section on and after October 1, 2006.</text>

				shall provide public notice of—</text>

				have been removed from the voter registration list of such State under section

				303 since the later of the most recent election for Federal office or the day

				of the most recent previous public notice provided under this section;

				and</text>

								</paragraph><paragraph commented="no" id="id09A9296E8B014EC1B04E7EE17685B384"><enum>(2)</enum><text>the criteria,

				processes, and procedures used to determine which names were removed.</text>

								</paragraph></subsection><subsection commented="no" id="id80D2D3615DB8412D9547AC6169E137E7">

								<enum>(b)</enum>

								<header>Notice to individual voters</header>

								<paragraph commented="no" id="idCCCAEC489AD04776BCEFC0A069F9DBD4">

									<enum>(1)</enum>

									<header>In general</header>

									<text>No individual shall be removed from the voter registration list

				under section 303 unless such individual is first provided with a notice which

				meets the requirements of paragraph (2).</text>

									<header>Requirements of notice</header>

									<text>The notice required under paragraph (1) shall be—</text>

										<text>in the form and manner prescribed by the Election Assistance

				State or jurisdiction may disclose the reason for the removal of any voter from

				the voter registration list unless ordered to do so by a court of competent

				jurisdiction.</text>

				Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6</external-xref>), each State

				shall permit any individual on the day of a Federal election—</text>

										<subparagraph id="idFBCBBAB06D384644B41F207C1E137083">

											<enum>(A)</enum>

											<text>to register to vote in such election at the polling place using

				the form established by the Election Assistance Commission pursuant to section

				299A; and</text>

										</subparagraph><subparagraph id="id25C39B964A0645BC85DD79858A820437">

											<enum>(B)</enum>

											<text>to cast a vote in such election and have that vote counted in

				the same manner as a vote cast by an eligible voter who properly registered

				during the regular registration period.</text>

										</subparagraph></paragraph><paragraph id="idF8C3B40856D448E3BB56FDC17C1A5441">

										<enum>(2)</enum>

										<header>Exception</header>

										<text>The requirements under paragraph (1) shall not apply to a State

				in which, under a State law in effect continuously on and after the date of the

									<text>Each polling place which allows voting prior to the day of a

									<header>Application of Election Day registration to early

				voting</header>

									<text>A State shall permit individuals to register to vote at each

				polling place which allows voting prior to the day of a Federal election

				pursuant to subsection (a) in the same manner as the State is required to

				permit individuals to register to vote and vote on the day of the election

				under section 327.</text>

				voting prior to the day scheduled for a Federal election. Such standards shall

				include the nondiscriminatory geographic placement of polling places at which

				such voting occurs and the public listing of the date, time, and location of

				polling places no earlier than 10 days before the date on which such voting

				begins.</text>

								</subsection><subsection commented="no" display-inline="no-display-inline" id="ID009BF0E97D704EA7AFAA63BA094A98D9"><enum>(b)</enum><header>Deviation</header><text>The

				standards described in subsection (a) shall permit States, upon giving

				reasonable public notice, to deviate from any requirement in the case of

				unforeseen circumstances such as a natural disaster or a terrorist

				attack.</text>

				register</header><text>There shall be a presumption that persons who submit

				voter registration applications should be registered.</text>

				cure material omission</header><text>Each State and jurisdiction shall—</text>

				to permit voters an opportunity to cure any material omission within a

				reasonable period of time; and</text>

				application which is so cured as having been filed on the date on which such

				application is originally received.</text>

				date</header><text>Each State and jurisdiction shall be required to comply with

				the requirements of this subsection on and after October 1, 2006.</text>

				information not a material omission</header><text display-inline="yes-display-inline">In establishing the guidelines under

				subsection (a), the Commission shall provide that the following shall not

				constitute a <quote>material omission or information that specifically affects

				the eligibility of the voter</quote>:</text>

				number or driver's license number.</text>

										<text>The failure to provide information concerning citizenship or

				age in a manner other than the attestation required under section 9(b)(2) of

				the National Voter Registration Act of 1993 (42 U.S.C. 1973–gg–7).</text>

				Internet to vote in Federal elections.</text>

										</subparagraph></paragraph></subsection><subsection id="idB3382BF3D681441784655A1D2C5A6683"><enum>(b)</enum><header>Report</header><text>Not

				later than 6 months after the date of the enactment of the

				<short-title>Count Every Vote Act of 2005</short-title>,

				the Commission shall transmit to Congress a report on the results of the study

				funds</header><text>A State receiving a payment under this part shall use the

				payment only to provide free photo identification cards to registered voters

				who do not have an identification card and who cannot obtain an identification

				card without undue hardship.</text>

				funds</header>

				general</header><text>The amount of the grant made to a State under this part

				for a year shall be equal to the product of—</text>

				appropriated for payments under this part for the year under section 298B;

				and</text>

				age of all eligible States which submit an application for payments under this

				be unlawful for any chief State election official to take part in prohibited

				political activities with respect to any election for Federal office over which

				such official has managerial authority.</text>

				manufacturers</header><text display-inline="yes-display-inline">It shall be

				unlawful for any person who owns or serves as the chief executive officer,

				chief financial officer, chief operating officer, or president of any entity

				that designs or manufacturers a voting system to take part in prohibited

				political activities with respect to any election for a Federal office for

				which a voting system produced by such manufacturer is used.</text>

								</paragraph></subsection><subsection commented="no" id="id8C7F8B3167A4434E95695520C55AA6BE"><enum>(b)</enum><header>Definitions</header><text>For

				purposes of this section:</text>

								<paragraph commented="no" id="id498186720D424D4881BE004D8098C799"><enum>(1)</enum><header>Chief State

				election official</header><text>The term <term>chief State election

				official</term> means the individual designated as such under section 10 of the

				National Voter Registration Act of 1993.</text>

								</paragraph></subsection></section><after-quoted-block></after-quoted-block></quoted-block>

					<quoted-block display-inline="no-display-inline" id="id7CE5A151C1B742579EFD8EEE65956FD2" style="OLC">

						<paragraph id="idA6F6368AD078478A94734E692197DCB1"><enum>(2)</enum><header>Prohibited

				political activities</header>

							<text>The term <term>prohibited political activities</term> means

				campaigning to support or oppose a candidate or slate of candidates for Federal

				office, making public speeches in support of such a candidate, fundraising and

				collecting contributions on behalf of such a candidate, distributing campaign

				materials with respect to such a candidate, organizing campaign events with

				respect to such a candidate, and serving in any position on any political

				campaign committee of such a candidate.</text>

						</paragraph><subsection commented="no" id="id5BDA4A05E19E47C8ADAFD2F8B289B951"><enum>(c)</enum><header>Ownership</header><text>For

				purposes of subsection (a)(2), a person shall be considered to own an entity if

				such person controls at least 20 percent, by vote or value, of the

				entity.</text>

					<enum>(a)</enum>

					<header>Short title</header>

					<text display-inline="yes-display-inline">This title may be cited as

			 the <short-title>Civic Participation Act of

			 2005</short-title>.</text>

				</subsection><subsection id="ID6F8C2721495C43BA982E517DC2C94E84">

					<enum>(b)</enum>

					<header>Findings and purpose</header>

					<paragraph commented="no" id="IDF474DB0ACEC14E9894901CBF835718BC">

						<enum>(1)</enum>

						<header>Findings</header>

						<text>Congress makes the following findings:</text>

						<subparagraph commented="no" id="IDC812A9E474E145F4A2201E00F020B47B">

							<enum>(A)</enum>

							<text>The right to vote is the most basic constitutive act of

			 citizenship and regaining the right to vote reintegrates offenders into free

			 society. The right to vote may not be abridged or denied by the United States

			 or by any State on account of race, color, gender, or previous condition of

			 servitude. Basic constitutional principles of fairness and equal protection

			 require an equal opportunity for United States citizens to vote in Federal

			 elections.</text>

						</subparagraph><subparagraph commented="no" id="IDF6031CA7016D48B1B200BCBDAF0045D8">

							<enum>(B)</enum>

							<text>Congress has ultimate supervisory power over Federal elections,

			 an authority that has repeatedly been upheld by the Supreme Court.</text>

						</subparagraph><subparagraph commented="no" id="ID40FAC1D9F50A435000A2F83C6D081D84">

							<enum>(C)</enum>

							<text>Although State laws determine the qualifications for voting in

			 Federal elections, Congress must ensure that those laws are in accordance with

			 the Constitution. Currently, those laws vary throughout the Nation, resulting

			 in discrepancies regarding which citizens may vote in Federal elections.</text>

						</subparagraph><subparagraph commented="no" id="IDCD1B6E7A611241F58BF7FF69BB909542">

							<enum>(D)</enum>

							<text>An estimated 4,700,000 individuals in the United States, or 1 in

			 44 adults, currently cannot vote as a result of a felony conviction. Women

			 represent about 676,000 of those 4,700,000.</text>

						</subparagraph><subparagraph commented="no" id="ID17ECEC44307043BD9C6F295D6D68EE8D">

							<enum>(E)</enum>

							<text>State disenfranchisement laws disproportionately impact ethnic

			 minorities.</text>

						</subparagraph><subparagraph commented="no" id="ID746C9A83D7B5411EA935228D16C20802">

							<enum>(F)</enum>

							<text>Fourteen States disenfranchise some or all ex-offenders who have

			 fully served their sentences, regardless of the nature or seriousness of the

			 offense.</text>

						</subparagraph><subparagraph commented="no" id="IDE5529A4C0C2A47D682195EC74783B0D8">

							<enum>(G)</enum>

							<text>In those States that disenfranchise ex-offenders who have fully

			 served their sentences, the right to vote can be regained in theory, but in

			 practice this possibility is often illusory.</text>

						</subparagraph><subparagraph commented="no" id="ID498BA0F7AB644603BD9EAC3CB5300341">

							<enum>(H)</enum>

							<text>In those States that disenfranchise ex-offenders, an

			 ex-offender's right to vote can only be restored through a gubernatorial pardon

			 or order, or a certificate granted by a parole board. Some States require

			 waiting periods as long as 10 years after completion of the sentence before an

			 ex-offender can initiate the application for restoration of the right to

			 vote.</text>

						</subparagraph><subparagraph commented="no" id="IDBB04EA251B2D48D9BA5B2FC628380989">

							<enum>(I)</enum>

							<text>Offenders convicted of a Federal offense often have additional

			 barriers to regaining voting rights. Many States do not offer a restoration

			 procedure for Federal offenders who have completed supervision. The only method

			 available to such persons is a Presidential pardon.</text>

						</subparagraph><subparagraph commented="no" id="IDF0987C04BC014100B7EA1998F4CF83C6">

							<enum>(J)</enum>

							<text>Few persons who seek to have their right to vote restored have

			 the financial and political resources needed to succeed.</text>

						</subparagraph><subparagraph commented="no" id="ID8C601B10B36C43CAB8C027E4F3300072">

							<enum>(K)</enum>

							<text>Thirteen percent of the African-American adult male population,

			 or 1,400,000 African-American men, are disenfranchised. Given current rates of

			 incarceration, 3 in 10 African-American men in the next generation will be

			 disenfranchised at some point during their lifetimes. Hispanic citizens are

			 also disproportionately disenfranchised, since those citizens are

			 disproportionately represented in the criminal justice system.</text>

						</subparagraph><subparagraph commented="no" id="ID8FB9EDD409094943AFC3CA3C99231BEF">

							<enum>(L)</enum>

							<text>The discrepancies described in this paragraph should be addressed

			 by Congress, in the name of fundamental fairness and equal protection.</text>

						</subparagraph></paragraph><paragraph id="ID2F5D6CD5D5654BB58E8554DB25A00095">

						<enum>(2)</enum>

						<header>Purpose</header>

						<text>The purpose of this title is to restore fairness in the Federal

			 election process by ensuring that ex-offenders who have fully served their

			 sentences are not denied the right to vote.</text>

					</paragraph></subsection><subsection id="IDA724946F5D7543B8B89FD152C0D5BCA8">

					<enum>(c)</enum>

					<header>Definitions</header>

					<text display-inline="yes-display-inline">In this title:</text>

					<paragraph id="ID592863C5F9B44328A044C4031F003800">

						<enum>(1)</enum>

						<header>Correctional institution or facility</header>

						<text>The term <term>correctional institution or facility</term> means

			 any prison, penitentiary, jail, or other institution or facility for the

			 confinement of individuals convicted of criminal offenses, whether publicly or

			 privately operated, except that such term does not include any residential

			 community treatment center (or similar public or private facility).</text>

					</paragraph><paragraph id="ID690973B1ACCB4F9BA35CA161CEF060E6">

						<enum>(2)</enum>

						<header>Election</header>

						<text>The term <term>election</term> means—</text>

						<subparagraph id="IDA0D59A8E017345F292B2E1BC9282AC00">

							<enum>(A)</enum>

							<text>a general, special, primary, or runoff election;</text>

						</subparagraph><subparagraph id="IDD9A7547995DA459B853E2F04FF082501">

							<enum>(B)</enum>

							<text>a convention or caucus of a political party held to nominate a

			 candidate;</text>

						</subparagraph><subparagraph id="ID1DBD1696BA0C43F9B595E1852F7C2950">

							<enum>(C)</enum>

							<text>a primary election held for the selection of delegates to a

			 national nominating convention of a political party; or</text>

						</subparagraph><subparagraph id="ID86CB40609D2B4D318372ED0329CC1C52">

							<enum>(D)</enum>

							<text>a primary election held for the expression of a preference for

			 the nomination of persons for election to the office of President.</text>

						</subparagraph></paragraph><paragraph id="ID591A7D6E4A5C48C180CF1D4D934E0348">

						<enum>(3)</enum>

						<header>Federal office</header>

						<text>The term <term>Federal office</term> means the office of

			 President or Vice President, or of Senator or Representative in, or Delegate or

			 Resident Commissioner to, Congress.</text>

					</paragraph><paragraph id="ID4598399DF741443EA0C866F8BF96AF2E">

						<enum>(4)</enum>

						<header>Parole</header>

						<text>The term <term>parole</term> means parole (including mandatory

			 parole), or conditional or supervised release (including mandatory supervised

			 release), imposed by a Federal, State, or local court.</text>

					</paragraph><paragraph id="ID514423DDDA6744FC893E11F5E7DADB00">

						<enum>(5)</enum>

						<header>Probation</header>

						<text>The term <term>probation</term> means probation, imposed by a

			 Federal, State, or local court, with or without a condition on the individual

			 involved concerning—</text>

						<subparagraph id="ID1DF5A7370AD74C948C00B795D9F2E699">

							<enum>(A)</enum>

							<text>the individual’s freedom of movement;</text>

						</subparagraph><subparagraph id="ID14B365A002C24272911BF03DFDEC2150">

							<enum>(B)</enum>

							<text>the payment of damages by the individual;</text>

						</subparagraph><subparagraph id="ID9E770F8FBA954D4B00CC4B841C80B2B6">

							<enum>(C)</enum>

							<text>periodic reporting by the individual to an officer of the court;

			 or</text>

						</subparagraph><subparagraph id="ID51C191C9680040B5A2318EFE09F20072">

							<enum>(D)</enum>

							<text>supervision of the individual by an officer of the court.</text>

						</subparagraph></paragraph></subsection><subsection id="ID7F0172B225244BC4AB4039CBD570F34C">

					<enum>(d)</enum>

					<header>Rights of citizens</header>

					<text display-inline="yes-display-inline">The right of an individual

			 who is a citizen of the United States to vote in any election for Federal

			 office shall not be denied or abridged because that individual has been

			 convicted of a criminal offense unless, at the time of the election, such

			 individual—</text>

					<paragraph id="IDD73351ADC2AB43588EE7E6C1C6BA68EB">

						<enum>(1)</enum>

						<text>is serving a felony sentence in a correctional institution or

			 facility; or</text>

					</paragraph><paragraph id="ID3A605EE6113E405CB760EA86A8A397EC">

						<enum>(2)</enum>

						<text>is on parole or probation for a felony offense</text>

					</paragraph></subsection><subsection id="ID083FCE2717314786BE6038AD1EB2C815">

					<enum>(e)</enum>

					<header>Enforcement</header>

					<paragraph id="IDEC9F680FF34E4FB50073D2BAA250431F">

						<enum>(1)</enum>

						<header>Attorney General</header>

						<text>The Attorney General may bring a civil action in a court of

			 competent jurisdiction to obtain such declaratory or injunctive relief as is

			 necessary to remedy a violation of this section.</text>

					</paragraph><paragraph id="ID775A5E5862BB4607A741D222F66F6455">

						<enum>(2)</enum>

						<header>Private right of action</header>

						<subparagraph id="ID0769AE29DD1844C4B360B02825141387">

							<enum>(A)</enum>

							<header>Notice</header>

							<text>A person who is aggrieved by a violation of this section may

			 provide written notice of the violation to the chief election official of the

			 State involved.</text>

						</subparagraph><subparagraph id="IDD51E4384D0B842EE8B5C4F1C7DCEE362">

							<enum>(B)</enum>

							<header>Action</header>

							<text>Except as provided in subparagraph (C), if the violation is not

			 corrected within 90 days after receipt of a notice provided under subparagraph

			 (A), or within 20 days after receipt of the notice if the violation occurred

			 within 120 days before the date of an election for Federal office, the

			 aggrieved person may bring a civil action in such a court to obtain declaratory

			 or injunctive relief with respect to the violation.</text>

						</subparagraph><subparagraph id="IDA1E334D2D8694F88A8C370848E5EBB85">

							<enum>(C)</enum>

							<header>Action for violation shortly before a Federal election</header>

							<text>If the violation occurred within 30 days before the date of an

			 election for Federal office, the aggrieved person shall not be required to

			 provide notice to the chief election official of the State under subparagraph

			 (A) before bringing a civil action in such a court to obtain declaratory or

			 injunctive relief with respect to the violation.</text>

						</subparagraph></paragraph></subsection><subsection id="ID00D6A848669D4A2B9CF96279DD12613C">

					<enum>(f)</enum>

					<header>Relation to other laws</header>

					<paragraph id="ID19AE3EA82F784A8694D67D22EA2D8E3E">

						<enum>(1)</enum>

						<header>No prohibition on less restrictive laws</header>

						<text>Nothing in this section shall be construed to prohibit a State

			 from enacting any State law that affords the right to vote in any election for

			 Federal office on terms less restrictive than those terms established by this

			 section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6D18BE4B899B49448E508F72E9F17573"><enum>(2)</enum><header>No limitation

			 on other laws</header><text>The rights and remedies established by this section

			 shall be in addition to all other rights and remedies provided by law, and

			 shall not supersede, restrict, or limit the application of the

			 <act-name parsable-cite="VRA65">Voting Rights Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973">42 U.S.C.

			 1973</external-xref> et seq.) or the National Voter Registration Act of 1993

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg">42 U.S.C.

			 1973gg</external-xref> et seq.).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8E4C7A4B3CEC48179389D33363729FAA"><enum>(g)</enum><header>Notification of

			 restoration of voting rights</header><text>Subtitle C of title III of the Help

			 America Vote Act of 2002, as added and amended by this Act, is amended by

			 adding at the end the following new section:</text>

							<subsection commented="no" display-inline="no-display-inline" id="idCC1D9DBC63C441DFBD5878159FDEE091"><enum>(a)</enum><header>Notification</header>

								<paragraph commented="no" display-inline="no-display-inline" id="idD29F28D02063443999EC91A90D9E1400"><enum>(1)</enum><header>In

				general</header><text>On the date determined under subsection (b), each State

				shall notify any qualified ex-offender who resides in the State that such

				qualified ex-offender has the right to vote in an election for Federal office

				pursuant to the <short-title>Civic Participation Act of

				2005</short-title> and may register to vote in any such election.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00353A5266C945F5B4808ECC16C5DB4B"><enum>(2)</enum><header>Qualified

				ex-offender</header><text>For the purpose of this section, the term

				<term>qualified ex-offender</term> means any individual who resides in the

				State who has been convicted of a criminal offense and is not serving a felony

				sentence in a correctional institution or facility and who is not on parole or

				probation for a felony offense.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA6B5DF1C3830404BBDC1AF45BF9D57BD"><enum>(b)</enum><header>Date of

				notification</header><text>The notification required under subsection (a) shall

				be given on the later of the date on which such individual is released from a

				correctional institution or facility for serving a felony sentence or the date

				on which such individual is released from parole for a felony offense.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="idF5F2DF2D6DBB441C89372094F91D24BD"><enum>(c)</enum><header>Definitions</header><text>Any

				term which is used in this section that is also used in the

				<short-title>Civic Participation Act of 2005</short-title>

				shall have the meaning given to such term in that Act.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="id3E0C9EFC2C344F7BB157A8AD17C7F419"><enum>(d)</enum><header>Effective

				date</header><text>Each State shall be required to comply with the requirements

				of this section on and after the date of the enactment of the

				<short-title>Civic Participation Act of

				2005</short-title>.</text>

				appropriate methods to encourage State and local government employees to serve

				as poll workers in Federal elections.</text>

							</subsection><subsection id="id160675232CE44E5AA975F85CE1F1922F"><enum>(b)</enum><header>Report</header><text>Not

				later than 6 months after the date of the enactment of the

				<short-title>Count Every Vote Act of 2005</short-title>,

				the Commission shall transmit to Congress a report on the results of the study

				conducted under subsection (a).</text>

				of appropriations</header><text>Of the amount authorized to be appropriated

				under section 210 for fiscal year 2006, $100,000 shall be authorized solely to
