			<enum>1.</enum>

			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Presidential Sites Improvement

			 Act</short-title></quote>.</text>

		</section><section id="IDA848ABC4E0F4470E9486489D14AE6C28">

			<enum>2.</enum>

			<header>Findings</header>

			<text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph id="IDCB34CC4C20C04CF1899456B7545B48A3">

				<enum>(1)</enum>

				<text>there are many sites honoring Presidents located throughout the

			 United States, including Presidential birthplaces, homes, museums, burial

			 sites, and tombs;</text>

			</paragraph><paragraph id="ID2691C5A6C3524051ABA1681FC2610D43">

				<enum>(2)</enum>

				<text>most of the sites are owned, operated, and maintained by

			 non-Federal entities such as State and local agencies, family foundations,

			 colleges and universities, libraries, historical societies, historic

			 preservation organizations, and other nonprofit organizations;</text>

			</paragraph><paragraph id="ID4D9AFAEC2EEE416DA6B0E79B9FAC832E">

				<enum>(3)</enum>

				<text>Presidential sites are often expensive to maintain;</text>

			</paragraph><paragraph id="IDAA73702E18D04A83B0DB19BA2F88E9B0">

				<enum>(4)</enum>

				<text>many Presidential sites are in need of capital, technological,

			 and interpretive display improvements for which funding is insufficient or

			 unavailable; and</text>

			</paragraph><paragraph id="ID95E5762C40FB4951A6B3940935C1966E">

				<enum>(5)</enum>

				<text>to promote understanding of the history of the United States by

			 recognizing and preserving historic sites linked to Presidents of the United

			 States, the Federal Government should provide grants for the maintenance and

			 improvement of Presidential sites.</text>

			</paragraph></section><section id="ID4ADF05C77E7D489DA75B7EF9C5923BD7">

			<enum>3.</enum>

			<header>Definitions</header>

			<text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDDDB56A26861C4BC086F02F78029D49FA">

				<enum>(1)</enum>

				<header>Grant Commission</header>

				<text>The term <term>Grant Commission</term> means the Presidential

			 Site Grant Commission established by section 4(d).</text>

			</paragraph><paragraph id="IDEDD29678BFD04C8C80D2B28341F3F66E">

				<enum>(2)</enum>

				<header>Presidential site</header>

				<text>The term <term>Presidential site</term> means a site that

			 is—</text>

				<subparagraph id="id337AEF128F7E4318B3876F1F32EDE048"><enum>(A)</enum><text>related to a

			 President of the United States;</text>

				</subparagraph><subparagraph id="idDF30EC110EF0432BA9F01EA0D69CC167"><enum>(B)</enum><text>of national

			 significance;</text>

				</subparagraph><subparagraph id="ID4C59C1F09AB54758A03D7D12E7EC5FF2">

					<enum>(C)</enum>

					<text>managed, maintained, and operated for, and is accessible to, the

			 public; and</text>

				</subparagraph><subparagraph id="IDF1EF3FEECF744E2A8AAD4D43F449F883">

					<enum>(D)</enum>

					<text>owned or operated by—</text>

					<clause id="ID5DC91D8331CD47CFBD558A69B9CAAC41">

						<enum>(i)</enum>

						<text>a State; or</text>

					</clause><clause id="IDAF54CE7551B94F269DCFA507611C14B0">

						<enum>(ii)</enum>

						<text>a private institution, organization, or person.</text>

					</clause></subparagraph></paragraph><paragraph id="ID5ADBEC9AC7C5408D819EAE8FF19079F0">

				<enum>(3)</enum>

				<header>Secretary</header>

				<text>The term <term>Secretary</term> means the Secretary of the

			 Interior, acting through the Director of the National Park Service.</text>

			</paragraph></section><section id="ID1E382A7FD32F4994A66BE9C481DB3A4A">

			<enum>4.</enum>

			<header>Grants for Presidential sites</header>

			<subsection id="IDD308B58A2A7A4992B1D3730E5C3F4B9F">

				<enum>(a)</enum>

				<header>In general</header>

				<text>The Secretary shall award grants for major maintenance and

			 improvement projects at Presidential sites to owners or operators of

			 Presidential sites in accordance with this section.</text>

			</subsection><subsection id="ID1C25021997AB489593BF1B764BEFE007">

				<enum>(b)</enum>

				<header>Use of grant funds</header>

				<paragraph id="IDF898999248664984913EE1D9992EA884">

					<enum>(1)</enum>

					<header>In general</header>

					<text>A grant awarded under this section may be used for—</text>

					<subparagraph id="ID0CB243105ECF49D098336E43151ADECD">

						<enum>(A)</enum>

						<text>repairs or capital improvements at a Presidential site (including

			 new construction for necessary modernization) such as—</text>

						<clause id="ID7877B727E1A34531B64E05A267DF2746">

							<enum>(i)</enum>

							<text>installation or repair of heating or air conditioning systems,

			 security systems, or electric service; or</text>

						</clause><clause id="ID52F70C7E4673407E80F64C954D5E74B5">

							<enum>(ii)</enum>

							<text>modifications at a Presidential site to achieve compliance with

			 requirements under titles II and III of the Americans with Disabilities Act of

			 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C.

			 12131</external-xref> et seq.); and</text>

						</clause></subparagraph><subparagraph id="IDFC66472FA6274AC6AA216C02A3146196">

						<enum>(B)</enum>

						<text>interpretive improvements to enhance public understanding and

			 enjoyment of a Presidential site.</text>

					</subparagraph></paragraph><paragraph id="ID2F247F3E3AC64CF4B2152187B28E7AF8">

					<enum>(2)</enum>

					<header>Allocation of funds</header>

					<subparagraph id="IDD628E735FAEC41F5A31E007517304D62">

						<enum>(A)</enum>

						<header>In general</header>

						<text>Of the funds made available to award grants under this

			 Act—</text>

						<clause id="IDB7F66459435A42D0B93993F6741DD644">

							<enum>(i)</enum>

							<text>15 percent shall be used for emergency projects, as determined by

			 the Secretary;</text>

						</clause><clause id="IDAF40F333CA5A47C3B3113D214D1CBDF5">

							<enum>(ii)</enum>

							<text>65 percent shall be used for grants for Presidential sites

			 with—</text>

							<subclause id="IDC3D4D89D63D449768D4E2990F5354250">

								<enum>(I)</enum>

								<text>a 3-year average annual operating budget of less than $700,000

			 (not including the amount of any grant received under this section); and</text>

							</subclause><subclause id="IDA065113CA8B44EB98B42F6BE0510A36B">

								<enum>(II)</enum>

								<text>an endowment in an amount that is less than 3 times the annual

			 operating budget of the site; and</text>

							</subclause></clause><clause id="ID21EF412B5CD042FCB395E0435471489A">

							<enum>(iii)</enum>

							<text>20 percent shall be used for grants for Presidential sites

			 with—</text>

							<subclause id="ID7FDDE1E4CEA749B985C19AD1B6A2AC6F">

								<enum>(I)</enum>

								<text>an annual operating budget of $700,000 or more (not including the

			 amount of any grant received under this section); and</text>

							</subclause><subclause id="ID0E364191481C46F0984BAEDF4C6A21AE">

								<enum>(II)</enum>

								<text>an endowment in an amount that is equal to or more than 3 times

			 the annual operating budget of the site.</text>

							</subclause></clause></subparagraph><subparagraph id="IDBE3AFA7C726F4046B090BE7F5265D663">

						<enum>(B)</enum>

						<header>Unexpended funds</header>

						<text>If any funds allocated for a category of projects described in

			 subparagraph (A) are unexpended, the Secretary may use the funds to award

			 grants for another category of projects described in that subparagraph.</text>

					</subparagraph></paragraph></subsection><subsection id="ID47439F551A31427A829D9AC293F1570E">

				<enum>(c)</enum>

				<header>Application and award procedure</header>

				<paragraph id="ID8CA9B36AACB540429F1C4E311D5F55CE">

					<enum>(1)</enum>

					<header>In general</header>

					<text>Not later than a date to be determined by the Secretary, an owner

			 or operator of a Presidential site may submit to the Secretary an application

			 for a grant under this section.</text>

				</paragraph><paragraph id="IDA826B15E446F43B0AC49E70321A0D0DB">

					<enum>(2)</enum>

					<header>Involvement of Grant Commission</header>

					<subparagraph id="IDBF5A237F9F8046D19C8BDE95BB6E8A4C">

						<enum>(A)</enum>

						<header>In general</header>

						<text>The Secretary shall forward each application received under

			 paragraph (1) to the Grant Commission.</text>

					</subparagraph><subparagraph id="ID180DF08318924674B8259C8A9C5BCCE5">

						<enum>(B)</enum>

						<header>Consideration by Grant Commission</header>

						<text>Not later than 60 days after receiving an application from the

			 Secretary under subparagraph (A), the Grant Commission shall return the

			 application to the Secretary with a recommendation of whether the proposed

			 project should be awarded a Presidential site grant.</text>

					</subparagraph><subparagraph id="ID5D28440DD64C4102BEC1060B4158F17B">

						<enum>(C)</enum>

						<header>Recommendation of Grant Commission</header>

						<text>In making a decision to award a Presidential site grant under

			 this section, the Secretary shall take into consideration any recommendation of

			 the Grant Commission.</text>

					</subparagraph></paragraph><paragraph id="ID2692881CD77746F8AD532551CFB3D853">

					<enum>(3)</enum>

					<header>Award</header>

					<text>Not later than 180 days after receiving an application for a

			 Presidential site grant under paragraph (1), the Secretary shall—</text>

					<subparagraph id="IDF7E79860C7D4491B849E2D2DACAD5516">

						<enum>(A)</enum>

						<text>award a Presidential site grant to the applicant; or</text>

					</subparagraph><subparagraph id="IDDAFFEB832A044521976A04112B514C75">

						<enum>(B)</enum>

						<text>notify the applicant, in writing, of the decision of the

			 Secretary not to award a Presidential site grant.</text>

					</subparagraph></paragraph><paragraph id="ID56E831652DC64543AFDE42DBDE361FCF">

					<enum>(4)</enum>

					<header>Matching requirements</header>

					<subparagraph id="ID6AF8C08CDF894B519DCD3A4C7BD0D695">

						<enum>(A)</enum>

						<header>In general</header>

						<text>The Federal share of the cost of a project at a Presidential site

			 for which a grant is awarded under this section shall not exceed 50

			 percent.</text>

					</subparagraph><subparagraph id="IDF7ECB312A6444B7B9D01D8264B1B8464">

						<enum>(B)</enum>

						<header>Non-federal share</header>

						<text>The non-Federal share of the cost of a project at a Presidential

			 site for which a grant is awarded under this section may be provided in cash or

			 in kind.</text>

					</subparagraph></paragraph></subsection><subsection id="IDC172DB03F797497CB7F4EF331F7207A8">

				<enum>(d)</enum>

				<header>Presidential Site Grant Commission</header>

				<paragraph id="IDE46FD2A7AC594B65B0605EF97A19E1FE">

					<enum>(1)</enum>

					<header>In general</header>

					<text>There is established the Presidential Site Grant

			 Commission.</text>

				</paragraph><paragraph id="IDF1302120CE81418C97C9516EE82C623F">

					<enum>(2)</enum>

					<header>Composition</header>

					<text>The Grant Commission shall be composed of—</text>

					<subparagraph id="ID07F15CB2993E469785BB5F5CC95189B2">

						<enum>(A)</enum>

						<text>the Director of the National Park Service; and</text>

					</subparagraph><subparagraph id="IDA361B7E5841D41B78BE5B2708264B682">

						<enum>(B)</enum>

						<text>4 members appointed by the Secretary as follows:</text>

						<clause id="IDC539E2EFCEE4437AA0B6C221230EB6B6">

							<enum>(i)</enum>

							<text>A State historic preservation officer.</text>

						</clause><clause id="ID29FE6E2912C543F3B93E6394445E2923">

							<enum>(ii)</enum>

							<text>A representative of the National Trust for Historic

			 Preservation.</text>

						</clause><clause id="ID1E56BA76F0C444FEB3C77002F0E3F211">

							<enum>(iii)</enum>

							<text>A representative of a site described in subsection

			 (b)(2)(A)(ii).</text>

						</clause><clause id="ID81F8BEBC769E44EE911C95F457BC0031">

							<enum>(iv)</enum>

							<text>A representative of a site described in subsection

			 (b)(2)(A)(iii).</text>

						</clause></subparagraph></paragraph><paragraph id="ID50CA799789B84D77930ACDB322298B08">

					<enum>(3)</enum>

					<header>Term</header>

					<text>A member of the Grant Commission shall serve a term of 2

			 years.</text>

				</paragraph><paragraph id="IDDFBD065682A14142B3240C2246AE588F">

					<enum>(4)</enum>

					<header>Duties</header>

					<text>The Grant Commission shall—</text>

					<subparagraph id="IDE84045EC786F4E18A630C8E798D0EB81">

						<enum>(A)</enum>

						<text>review applications for Presidential site grants received under

			 subsection (c); and</text>

					</subparagraph><subparagraph id="IDD314C235A1754811882FFFB4418A68FF">

						<enum>(B)</enum>

						<text>recommend to the Secretary projects for which Presidential site

			 grants should be awarded.</text>

					</subparagraph></paragraph><paragraph id="ID1B514AAAFE4A45F4B0BA1A157F2A5919">

					<enum>(5)</enum>

					<header>Ineligibility of sites during term of representative</header>

					<text>A site described in clause (iii) or (iv) of paragraph (2)(B)

			 shall be ineligible for a grant under this Act during the 2-year period in

			 which a representative of the site serves on the Grant Commission.</text>

				</paragraph><paragraph id="ID37BE36ED08504CE881E60FED0DAE37B5">

					<enum>(6)</enum>

					<header>Nonapplicability of faca</header>

					<text>The Grant Commission shall not be subject to the

			 <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5

			 U.S.C. App.).</text>

				</paragraph></subsection><subsection id="ID55ECC66AB8C342F195A77E991A48514A">

				<enum>(e)</enum>

				<header>Authorization of appropriations</header>

				<text>There is authorized to be appropriated to carry out this Act

			 $5,000,000 for each of fiscal years 2006 through 2010, to remain available

			 until expended.</text>
