		<official-title>To authorize the Secretary of Agriculture to sell or

		  exchange certain National Forest System land in the State of

		  Vermont.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Green Mountain National Forest

			 Land Adjustment Act of 2005</short-title></quote>.</text>

		</section><section id="id6A01F947B9C146F796474D48446FFFEB" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="id04EA68B0DDF340D9AD4575EBC1DDCD7F"><enum>(1)</enum><header>Bromley</header><text>The

			 term <term>Bromley</term> means Bromley Mountain Ski Resort, Inc.</text>

			</paragraph><paragraph id="id817BE12B4F184C46BFFB8833AD396F3E"><enum>(2)</enum><header>Map</header><text>The

			 term <term>map</term> means the map entitled <quote>Proposed Bromley Land Sale

			 or Exchange</quote> and dated April 7, 2004.</text>

			</paragraph><paragraph id="id47526A9A9D3A48B5B411482FDB92B425"><enum>(3)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Agriculture.</text>

			</paragraph><paragraph id="id48E03F8796754A3D9546543E30D40C51"><enum>(4)</enum><header>State</header><text>The

			 term <term>State</term> means the State of Vermont.</text>

			</paragraph></section><section id="IDae7ba8e82096416b98d94c537f98e97f"><enum>3.</enum><header>Sale or exchange

			 of green mountain national forest land</header>

			<subsection id="IDf530e4d14f134f598b26f2cba193c76d"><enum>(a)</enum><header>In

			 general</header><text>The Secretary may, under any terms and conditions that

			 the Secretary may prescribe, sell or exchange any right, title, and interest of

			 the United States in and to the parcels of National Forest System land

			 described in subsection (b).</text>

			</subsection><subsection id="idF3A6DBD6A1EB4F0A8F3EEB7A5AD8F262"><enum>(b)</enum><header>Description of

			 land</header><text>The parcels of National Forest System land referred to in

			 subsection (a) are the 5 parcels of land in Bennington County in the State, as

			 generally depicted on the map.</text>

			</subsection><subsection id="IDe5fee6f286e14fe8a9461b39552caf2f"><enum>(c)</enum><header>Map and legal

			 descriptions</header>

				<paragraph id="id8101E386A4B54DC4BA962D4F2FEDFE20"><enum>(1)</enum><header>In

			 general</header><text>The map shall be on file and available for public

			 inspection in—</text>

					<subparagraph id="idF8B11AAB3A3B47EFAE18EF719C73B3A0"><enum>(A)</enum><text>the office of the

			 Chief of the Forest Service; and</text>

					</subparagraph><subparagraph id="idD6D391B94EE649AAB7AB380DCA718F29"><enum>(B)</enum><text>the office of the

			 Supervisor of the Green Mountain National Forest.</text>

					</subparagraph></paragraph><paragraph id="idA81DF3A810D44B7EB21272C2AAE33A48"><enum>(2)</enum><header>Modifications</header><text>The

			 Secretary may modify the map and legal descriptions to—</text>

					<subparagraph id="id518B0FAC22E14274B23ABFBDCF9F8F7C"><enum>(A)</enum><text>correct technical

			 errors; or</text>

					</subparagraph><subparagraph id="idE2D818FD29304FA9889A688469F1C07B"><enum>(B)</enum><text>facilitate the

			 conveyance under subsection (a).</text>

					</subparagraph></paragraph></subsection><subsection id="ID3e13bb0289f047f2ba5446af8327ff8d"><enum>(d)</enum><header>Consideration</header><text>Consideration

			 for the sale or exchange of land described in subsection (b)—</text>

				<paragraph id="id54E85A2F04584B76B5C524130778C295"><enum>(1)</enum><text>shall be equal to

			 an amount that is not less than the fair market value of the land sold or

			 exchanged; and</text>

				</paragraph><paragraph id="id3C32B871CAE8441DBFA4089CA18C3B61"><enum>(2)</enum><text>may be in the

			 form of cash, land, or a combination of cash and land.</text>

				</paragraph></subsection><subsection id="ID17c83ea46e27438bb2cbd15c5fd4d46e"><enum>(e)</enum><header>Appraisals</header><text>Any

			 appraisal carried out to facilitate the sale or exchange of land under

			 subsection (a) shall conform with the Uniform Appraisal Standards for Federal

			 Land Acquisitions.</text>

			</subsection><subsection id="ID12480c6b4b09420f944e93c0d922f819"><enum>(f)</enum><header>Methods of

			 sale</header>

				<paragraph id="ID797a6ea0599c49798b04fc23abda171e"><enum>(1)</enum><header>Conveyance to

			 bromley</header>

					<subparagraph id="idB2F83CCA3E1B41DBA2DB8EAEAB5807C4"><enum>(A)</enum><header>In

			 general</header><text>Before soliciting offers under paragraph (2), the

			 Secretary shall offer to convey to Bromley the land described in subsection

			 (b).</text>

					</subparagraph><subparagraph id="id349CAE3506CD484E92FE45757A974617"><enum>(B)</enum><header>Contract

			 deadline</header><text>If Bromley accepts the offer under subparagraph (A), the

			 Secretary and Bromley shall have not more than 180 days after the date on which

			 any environmental analyses with respect to the land are completed to enter into

			 a contract for the sale or exchange of the land.</text>

					</subparagraph></paragraph><paragraph id="ID2bbc159358b24d5a8c3669ed2039a57f"><enum>(2)</enum><header>Public or

			 private sale</header><text>If the Secretary and Bromley do not enter into a

			 contract for the sale or exchange of the land by the date specified in

			 paragraph (1)(B), the Secretary may sell or exchange the land at public or

			 private sale (including auction), in accordance with such terms, conditions,

			 and procedures as the Secretary determines to be in the public interest.</text>

				</paragraph><paragraph id="IDb89c36c09fcd48e699f452b0cf1208e6"><enum>(3)</enum><header>Rejection of

			 offers</header><text>The Secretary may reject any offer received under this

			 subsection if the Secretary determines that the offer is not adequate or is not

			 in the public interest.</text>

				</paragraph><paragraph id="ID1ee35979d0c849a796aa10649f621f84"><enum>(4)</enum><header>Brokers</header><text>In

			 any sale or exchange of land under this section, the Secretary may—</text>

					<subparagraph id="id1CC692BA54CD458683A1A2895B2DC5E8"><enum>(A)</enum><text>use a real estate

			 broker or other third party; and</text>

					</subparagraph><subparagraph id="idC57413F2B3D94D6DB8F460B6D84BE86C"><enum>(B)</enum><text>pay the real

			 estate broker or third party a commission in an amount comparable to the

			 amounts of commission generally paid for real estate transactions in the

			 area.</text>

					</subparagraph></paragraph></subsection><subsection changed="not-changed" commented="no" id="id94BFDB6310814E4FB835D4C65EEF5493"><enum>(g)</enum><header>Cash

			 equalization</header><text display-inline="yes-display-inline">Notwithstanding

			 section 206(b) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.

			 1716(b)), the Secretary may accept a cash equalization payment in excess of 25

			 percent of the value of any Federal land exchanged under this Act.</text>

			</subsection></section><section id="ID3462a9d18139452b9279644f67d34580"><enum>4.</enum><header>Disposition of

			 proceeds</header>

			<subsection id="id729E9D1A60964ED6AA0D3822E7C7479C"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall deposit the net proceeds from a sale

			 or exchange under this Act in the fund established under Public Law 90–171 (16

			 U.S.C. 484a) (commonly known as the <quote>Sisk Act</quote>).</text>

			</subsection><subsection id="id74477BD6DA6747DD916413460DEBB62C"><enum>(b)</enum><header>Use</header><text>Amounts

			 deposited under subsection (a) shall be available to the Secretary until

			 expended, without further appropriation, for—</text>

				<paragraph id="IDa0be389b7d9a434dbb95cc936ec3eee8"><enum>(1)</enum><text>the location and

			 relocation of the Appalachian National Scenic Trail and the Long National

			 Recreation Trail in the State;</text>

				</paragraph><paragraph id="IDb0e8619cbde747f699fd47d9f4110a94"><enum>(2)</enum><text>the acquisition

			 of land and interests in land by the Secretary for National Forest System

			 purposes within the boundary of the Green Mountain National Forest, including

			 land for and adjacent to the Appalachian National Scenic Trail and the Long

			 National Recreation Trail;</text>

				</paragraph><paragraph id="ID354941ba33064a7dba1b1b2fbce42ddf"><enum>(3)</enum><text>the acquisition

			 of wetland or an interest in wetland within the boundary of the Green Mountain

			 National Forest to offset the loss of wetland from the parcels sold or

			 exchanged; and</text>

				</paragraph><paragraph id="id28E5B18310854E1F85D38537D9B8DB75"><enum>(4)</enum><text>the payment of

			 direct administrative costs incurred in carrying out this Act.</text>

				</paragraph></subsection><subsection id="ID5249d94539104047a4839da86c521f34"><enum>(c)</enum><header>Limitation</header><text>Amounts

			 deposited under subsection (a) shall not—</text>

				<paragraph id="id9246BEDF52EB40DFB342312AD82AA6AF"><enum>(1)</enum><text>be paid or

			 distributed to the State or counties or towns in the State under any provision

			 of law; or</text>

				</paragraph><paragraph id="id8CE1E60E80DB4B5FA778E20014920F04"><enum>(2)</enum><text>be considered to

			 be money received from units of the National Forest System for purposes

			 of—</text>

					<subparagraph id="ID2dc254687e194a35a8c071ca40a9487a"><enum>(A)</enum><text>the Act of May

			 23, 1908 (16 U.S.C. 500); or</text>

					</subparagraph><subparagraph changed="not-changed" commented="no" id="id06D21DECEA414744A8F29917A4253E18"><enum>(B)</enum><text>the Act of March

			 4, 1913 (16 U.S.C. 501).</text>

					</subparagraph></paragraph></subsection><subsection changed="not-changed" commented="no" id="id008E2CCE204344C9AA43CD879AC263E5"><enum>(d)</enum><header>Prohibition of

			 Transfer or Reprogramming</header><text>Amounts deposited under subsection (a)

			 shall not be subject to transfer or reprogramming for wildfire management or

			 any other emergency purposes.</text>

			</subsection></section><section changed="not-changed" commented="no" id="idFD790BCD08BE49E19BBD1E848B51A35F"><enum>5.</enum><header>Acquisition of

			 land</header><text display-inline="no-display-inline">The Secretary may

			 acquire, using funds made available under section 4 or otherwise made available

			 for acquisition, land or an interest in land for National Forest System

			 purposes within the boundary of the Green Mountain National Forest.</text>

		</section><section id="ID78540514d68545f6832c0f1a66abf141"><enum>6.</enum><header>Exemption from

			 certain laws</header><text display-inline="no-display-inline">Subtitle I of

			 title 40, United States Code, shall not apply to any sale or exchange of

			 National Forest System land under this Act.</text>
