		<official-title>To amend title XVIII of the Social Security Act to
		  require the use of generic drugs under the Medicare part D prescription drug
		  program when available unless the brand name drug is determined to be medically
		  necessary.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Generics First Act of
			 2006</short-title></quote>.</text>
		</section><section id="idB359F9F13F4C403FA3B0EE26E13C5C4D"><enum>2.</enum><header>Required use of
			 generic drugs under the Medicare part D prescription drug program</header>
			<subsection id="id988A85E812C743DE942D2CD2B0357216"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–2(e)(2) of the Social Security Act (42
			 U.S.C. 1395w–102(e)(2)) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="id637050E5B1384FADBE30A46E34F15597" style="OLC">
					<subparagraph id="id029FFFDE44C74D5CB122FD7EC59D437F"><enum>(C)</enum><header>Non-generic
				drugs unless certain requirements are met</header>
						<clause id="id48DF2FA6620340FC815FF6E2A08086D9"><enum>(i)</enum><header>In
				general</header><text>Such term does not include a drug that is a nongeneric
				drug unless–</text>
							<subclause id="id20519A0F73CF4B038BBDF048284EEE70"><enum>(I)</enum><text>no generic drug
				has been approved under the <act-name parsable-cite="FFDCA">Federal Food, Drug,
				and Cosmetic Act with respect to the drug;</act-name> or</text>
							</subclause><subclause id="idAC216D8EE6534576A51A8D947617F62E"><enum>(II)</enum><text>the nongeneric
				drug is determined to be medically necessary by the individual prescribing the
				drug and prior authorization for the drug is obtained from the
				Secretary.</text>
							</subclause></clause><clause id="IDBF97B5A943F947CB8D79610761277998"><enum>(ii)</enum><header>Definitions</header><text>In
				this subparagraph:</text>
							<subclause id="ID3D38E4F9693E4FAA8566A86E005349B4"><enum>(I)</enum><header>Generic
				drug</header><text>The term <term>generic drug</term> means a drug that is the
				subject of an application approved under subsection (b)(2) or (j) of section
				505 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic
				Act</act-name>, for which the Secretary has made a determination that the drug
				is the therapeutic equivalent of a listed drug under section 505(j)(7) of such
				Act.</text>
							</subclause><subclause id="ID8D00F855CC864200B4D17E299B5102C0"><enum>(II)</enum><header>Nongeneric
				drug</header><text>The term <term>nongeneric drug</term> means a drug that is
				the subject of an application approved under—</text>
								<item id="ID7C35334F94F84D4D81A58C6953BC3FD2"><enum>(aa)</enum><text>section
				505(b)(1) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and
				Cosmetic Act</act-name>; or</text>
								</item><item id="ID43783BF167454043B51DB4FCB6FD5D2D"><enum>(bb)</enum><text>section
				505(b)(2) of such Act and that has been determined to be not therapeutically
				equivalent to any listed
				drug.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0ECEF9DE96F240629CD2D9C6F8CFCBD3"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to drugs
			 dispensed on or after the date of enactment of this Act.</text>
