		<official-title>To provide authority for restoration of the Social
		  Security Trust Funds from the effects of a clerical error, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Social Security Trust Funds
			 Restoration Act of 2006</short-title></quote>.</text>
		</section><section id="idDBAEB341672D4EC0BDF7CE665E057B73"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="idA9863B4A58DC459B8F13337936ACB782"><enum>(1)</enum><header>Clerical
			 error</header><text>The term <term>clerical error</term> means the bookkeeping
			 errors at the Social Security Administration that resulted in the overpayment
			 of amounts transferred from the Trust Funds to the general fund of the Treasury
			 during the period commencing with 1999 and ending with 2005 as transfers, under
			 the voluntary withholding program authorized by section 3402(p) of the Internal
			 Revenue Code of 1986, of anticipated taxes on benefit payments under title II
			 of the Social Security Act.</text>
			</paragraph><paragraph id="id6C8FECBB49C24D25B32EE4D63365CBE6"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Treasury.</text>
			</paragraph><paragraph id="id6675B12A4C5242E7B6738096B51E55F4"><enum>(3)</enum><header>Trust
			 funds</header><text>The term <term>Trust Funds</term> means the Federal Old-Age
			 and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust
			 Fund.</text>
			</paragraph></section><section id="id865CA3692BCF4F3399DFDF1018CE5C13"><enum>3.</enum><header>Restoration of
			 trust funds</header>
			<subsection id="idB0795B306B6746498487B66AC19BD465"><enum>(a)</enum><header>Appropriation</header><text>There
			 is hereby appropriated to each of the Trust Funds, out of any money in the
			 Treasury not otherwise appropriated, an amount determined by the Secretary, in
			 consultation with the Commissioner of Social Security, to be equal, to the
			 extent practicable in the judgment of the Secretary, to the difference
			 between—</text>
				<paragraph id="id6C79AF1ADDEE4D01B33965B93DA76B17"><enum>(1)</enum><text>the sum
			 of—</text>
					<subparagraph id="idB47B7C4E5A094D309A517E02A5C0EF35"><enum>(A)</enum><text>the amounts that
			 the Secretary determines, in consultation with the Commissioner of Social
			 Security, were overpaid from such Trust Fund to the general fund of the
			 Treasury by reason of the clerical error, and</text>
					</subparagraph><subparagraph id="id91954845701E4E3B8E2302BC53AAC439"><enum>(B)</enum><text>the amount that
			 the Secretary determines, in consultation with the Commissioner of Social
			 Security, to be equal, to the extent practicable in the judgment of the
			 Secretary, to the interest income that would have been payable to such Trust
			 Fund pursuant to section 201(d) of the Social Security Act on obligations
			 issued under chapter 31 of title 31, United States Code, that was not paid by
			 reason of the clerical error, and</text>
					</subparagraph></paragraph><paragraph id="id403CE8542CD84419A842B0FFABB750BE"><enum>(2)</enum><text>the sum
			 of—</text>
					<subparagraph id="id2276C1FC023C432C9B11786B8B4B88E2"><enum>(A)</enum><text>the amounts that
			 are refunded to such Trust Fund as overpayments by reason of the clerical error
			 to the extent not limited by periods of limitation under applicable provisions
			 of the Internal Revenue Code of 1986, and</text>
					</subparagraph><subparagraph id="idC1BBCA9295994F6CB4D9A1B202AFF994"><enum>(B)</enum><text>the interest that
			 is paid to such Trust Fund on the overpayments resulting from the clerical
			 error to the extent allowed under applicable provisions of such Code.</text>
					</subparagraph></paragraph></subsection><subsection id="id36B3221BDF484BCE9A39F4A08E5E2CE9"><enum>(b)</enum><header>Investment</header><text>The
			 Secretary shall invest the amounts appropriated to each of the Trust Funds
			 under subsection (a) in accordance with the currently applicable investment
			 policy for such Trust Fund.</text>
			</subsection></section><section id="id626486B170F9478BAFFA4F727383F769"><enum>4.</enum><header>Timing</header>
			<subsection id="idD784E795698F4939AA5391929B643E13"><enum>(a)</enum><header>Actions by the
			 Secretary</header><text>The Secretary shall take such actions as are necessary
			 to accomplish the restoration described in section 3 not later than 120 days
			 after the date of the enactment of this Act.</text>
			</subsection><subsection id="idB96663574B5447258573951BDF46B06F"><enum>(b)</enum><header>Action by the
			 Commissioner</header><text>The Commissioner of Social Security shall cooperate
			 with the Secretary to the extent necessary to enable the Secretary to meet the
			 requirements of subsection (a).</text>
			</subsection></section><section id="idD58FC98431624642B3D820099CAE0FDD"><enum>5.</enum><header>Congressional
			 notification</header><text display-inline="no-display-inline">Not later than 30
			 days after the Secretary takes the last action necessary to accomplish the
			 restoration described in section 3, the Secretary shall notify each House of
			 the Congress in writing of the actions so taken.</text>
