		<official-title>To protect children and their parents from being coerced
		  into administering a controlled substance in order to attend school, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="HE41C91469412499788627B81428BF809" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child Medication Safety Act of
			 2006</short-title></quote>.</text>
		</section><section id="H1BBD637DCD134EE49298126F2397C94E"><enum>2.</enum><header>Required policies
			 and procedures</header>
			<subsection id="HE376F6F891784326A89D748BDFDE4D87"><enum>(a)</enum><header>In
			 general</header><text>As a condition of receiving funds under any program or
			 activity administered by the Secretary of Education, not later than 1 year
			 after the date of the enactment of this Act, each State shall develop and
			 implement policies and procedures prohibiting school personnel from requiring a
			 child to obtain a prescription for substances covered by section 202(c) of the
			 Controlled Substances Act (21 U.S.C. 812(c)) as a condition of attending school
			 or receiving services.</text>
			</subsection><subsection id="HB9A01C9B3C9041ABAE2BE042C6D3D1D7"><enum>(b)</enum><header>Rule of
			 construction</header><text>Nothing in subsection (a) shall be construed to
			 create a Federal prohibition against teachers and other school personnel
			 consulting or sharing classroom-based observations with parents or guardians
			 regarding a student’s academic performance or behavior in the classroom or
			 school, or regarding the need for evaluation for special education or related
			 services under section 612(a)(3) of the Individuals with Disabilities Education
			 Act (20 U.S.C. 1412(a)(3)).</text>
			</subsection></section><section id="HF2155898B1074F4EB1C0DA23D162A2B8"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H78CED9053E584DECB02C7DC8486914C6"><enum>(1)</enum><header>Child</header><text>The
			 term <term>child</term> means any person within the age limits for which the
			 State provides free public education.</text>
			</paragraph><paragraph id="HEA3A7DC4760B4951AA004400EA84A4E6"><enum>(2)</enum><header>State</header><text>The
			 term <term>State</term> means each of the 50 States, the District of Columbia,
			 and the Commonwealth of Puerto Rico.</text>
			</paragraph></section><section id="H907D5C0F696843CCAE3C1949DCB93400"><enum>4.</enum><header>GAO study and
			 review</header>
			<subsection id="HA82B55377470496EBE73AEFC77AEA6E6"><enum>(a)</enum><header>Review</header><text>The
			 Comptroller General of the United States shall conduct a review of—</text>
				<paragraph id="H242A9E27A8324984B7620055461EECD7"><enum>(1)</enum><text>the variation
			 among States in definitions of psychotropic medication as used in regard to
			 State jurisdiction over public education;</text>
				</paragraph><paragraph id="H1D366A9E8D9D4CFCAE71A28C587BC12D"><enum>(2)</enum><text>the prescription
			 rates of medications used in public schools to treat children diagnosed with
			 attention deficit disorder, attention deficit hyperactivity disorder, and other
			 disorders or illnesses;</text>
				</paragraph><paragraph id="H8F99160E6F7F4734ABE7718267025165"><enum>(3)</enum><text>which medications
			 used to treat such children in public schools are listed under the Controlled
			 Substances Act; and</text>
				</paragraph><paragraph id="H6DF744D65CC94A8CAFED8196FB4D571B"><enum>(4)</enum><text>which medications
			 used to treat such children in public schools are not listed under the
			 Controlled Substances Act, including the properties and effects of any such
			 medications and whether such medications have been considered for listing under
			 the Controlled Substances Act.</text>
				</paragraph></subsection><subsection id="H821175BB97874DDA969D1736FE871DBC"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General of the United States shall prepare and submit a report that contains
			 the results of the review under subsection (a).</text>
