		<official-title>To discourage international assistance to the nuclear
		  program of Iran and transfers to Iran of advanced conventional weapons and
		  missiles. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Iran Nuclear Nonproliferation Act
			 of 2006</short-title></quote>.</text>
		</section><section id="idA6AB20DDACC243228639A7EDECB0896C"><enum>2.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It should be the policy
			 of the United States to neither negotiate nor seek to bring into force an
			 agreement for cooperation with the government of any country that is assisting
			 the nuclear program of Iran or transferring advanced conventional weapons or
			 missiles to Iran unless the President has made—</text>
			<paragraph id="idFF8649B1914B4BF986C872BE658868B8"><enum>(1)</enum><text display-inline="yes-display-inline">the determination set forth in section
			 3(a)(1) with respect to Iran; or</text>
			</paragraph><paragraph id="id1FEBB81C3DFC4B4987E79F3A1BD4D328"><enum>(2)</enum><text display-inline="yes-display-inline">the determination set forth in section
			 3(a)(2) with respect to the government of that country.</text>
			</paragraph></section><section id="id58D4A5E6C5C74D52924C9DF68FB9F9EB"><enum>3.</enum><header>Restrictions on
			 nuclear cooperation with countries assisting the nuclear program of
			 iran</header>
			<subsection id="id7EBBCCD1662242CF8B017E48106C6272"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law or any
			 international agreement, no agreement for cooperation between the United States
			 and the government of any country that is assisting the nuclear program of Iran
			 or transferring advanced conventional weapons or missiles to Iran may be
			 submitted to the President or to Congress pursuant to section 123 of the Atomic
			 Energy Act of 1954 (42 U.S.C. 2153), no such agreement may enter into force
			 with such country, no license may be issued for export directly or indirectly
			 to such country of any nuclear material, facilities, components, or other
			 goods, services, or technology that would be subject to such agreement, and no
			 approval may be given for the transfer or retransfer directly or indirectly to
			 such country of any nuclear material, facilities, components, or other goods,
			 services, or technology that would be subject to such agreement, until the
			 President determines and reports to the Committee on Foreign Relations of the
			 Senate and the Committee on International Relations of the House of
			 Representatives that—</text>
				<paragraph id="id05C7CAD9F68447358EDC4E3400801BC9"><enum>(1)</enum><text>Iran has
			 suspended all enrichment-related and reprocessing-related activity (including
			 uranium conversion, and research and development, manufacturing, testing, and
			 assembly relating to enrichment and reprocessing), has committed to verifiably
			 refrain permanently from such activity in the future (except potentially the
			 conversion of uranium exclusively for export to foreign nuclear fuel production
			 facilities pursuant to internationally agreed arrangements and subject to
			 strict international safeguards), and is abiding by that commitment; or</text>
				</paragraph><paragraph id="idFAF6F94D73B94DF99E2F0A1DD2DB13DB"><enum>(2)</enum><text>the government of
			 the country that is assisting the nuclear program of Iran or transferring
			 advanced conventional weapons or missiles to Iran—</text>
					<subparagraph id="id5D79DF7C688D4AFD9CC3E310173A3EDA"><enum>(A)</enum><text>has, either on
			 its own initiative or pursuant to a binding decision of the United Nations
			 Security Council, suspended all nuclear assistance to Iran and all transfers of
			 advanced conventional weapons and missiles to Iran pending a decision by Iran
			 to implement measures that would permit the President to make the determination
			 described in paragraph (1); and</text>
					</subparagraph><subparagraph id="id5948E3E70D2D4A659B49EA6CDA2A48B9"><enum>(B)</enum><text>is committed to
			 maintaining that suspension until Iran has implemented measures that would
			 permit the President to make such determination.</text>
					</subparagraph></paragraph></subsection><subsection id="id514BBAA56AD340939EDB5F0A0205E044"><enum>(b)</enum><header>Construction</header><text>The
			 restrictions in subsection (a)—</text>
				<paragraph id="idDB00FE2A9CFD4F7088FB0FC0213A97F7"><enum>(1)</enum><text>shall apply in
			 addition to all other applicable procedures, requirements, and restrictions
			 contained in the Atomic Energy Act of 1954 and other laws; and</text>
				</paragraph><paragraph id="idCD24A24A3A774221A0BE13F68C3D456D"><enum>(2)</enum><text>shall not be
			 construed as affecting the validity of agreements for cooperation that are in
			 effect on the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="idD804B84510464A1C97D8EEB3B4A24F0D"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idF91694FB5E234DC79B492C0EDD504918"><enum>(1)</enum><header>Agreement for
			 cooperation</header><text>The term <term>agreement for cooperation</term> has
			 the meaning given that term in section 11 b. of the Atomic Energy Act of 1954
			 (42 U.S.C. 2014(b)).</text>
			</paragraph><paragraph id="idBABE804C6BFA46BEBA0FD96E55004820"><enum>(2)</enum><header>Assisting the
			 nuclear program of Iran</header><text>The term <term>assisting the nuclear
			 program of Iran</term> means the intentional transfer to Iran by a government,
			 or by a person subject to the jurisdiction of a government with the knowledge
			 and acquiescence of that government, of goods, services, or technology listed
			 on the Nuclear Suppliers Group Guidelines for the Export of Nuclear Material,
			 Equipment and Technology (published by the International Atomic Energy Agency
			 as Information Circular INFCIRC/254/Rev. 3/Part 1, and subsequent revisions) or
			 Guidelines for Transfers of Nuclear-Related Dual-Use Equipment, Material, and
			 Related Technology (published by the International Atomic Energy Agency as
			 Information Circular INFCIR/254/Rev. 3/Part 2, and subsequent
			 revisions).</text>
			</paragraph><paragraph id="idB3CD7E559D034C6FB8CAAFD39A15CEDC"><enum>(3)</enum><header>Country that is
			 assisting the nuclear program of Iran or transferring advanced conventional
			 weapons or missiles to Iran</header><text>The term <term>country that is
			 assisting the nuclear program of Iran or transferring advanced conventional
			 weapons or missiles to Iran</term> means—</text>
				<subparagraph id="idD26867577DEB40DCA1C7724C1CBBB064"><enum>(A)</enum><text>Russia;
			 and</text>
				</subparagraph><subparagraph id="id27ED10ABEE164FA8A5F7B9CEFE47576B"><enum>(B)</enum><text>any other country
			 determined by the President to be assisting the nuclear program of Iran or
			 transferring advanced conventional weapons or missiles to Iran.</text>
				</subparagraph></paragraph><paragraph id="idC01BC1C7CB9A44C5B291EEAC6BFD48AD"><enum>(4)</enum><header>Transferring
			 advanced conventional weapons or missiles to Iran</header><text>The term
			 <term>transferring advanced conventional weapons or missiles to Iran</term>
			 means the intentional transfer to Iran by a government, or by a person subject
			 to the jurisdiction of a government with the knowledge and acquiescence of that
			 government, of goods, services, or technology listed on—</text>
				<subparagraph id="id0D1A4488A01A47279E618D1BFAC8D2AE"><enum>(A)</enum><text>the Wassenaar
			 Arrangement list of Dual Use Goods and Technologies and Munitions list of July
			 12, 1996, and subsequent revisions; or</text>
				</subparagraph><subparagraph id="idC59D6DBBDCF049B2AD8874C551944F91"><enum>(B)</enum><text>the Missile
			 Technology Control Regime Equipment and Technology Annex of June 11, 1996, and
			 subsequent revisions.</text>
				</subparagraph></paragraph></section></legis-body>
