		<official-title>To strengthen antitrust enforcement in the insurance
		  industry.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Insurance Industry Antitrust
			 Enforcement Act of 2006</short-title></quote>.</text>
		</section><section id="IDe4e543877547413888cb659852b5ebdb"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 2(b) of the Act of March 9, 1945 (15
			 U.S.C. 1012(b)), commonly known as the McCarran-Ferguson Act, is amended
			 by—</text>
			<paragraph id="ID43fc52378356467cbcee07190b2123a5"><enum>(1)</enum><text>inserting
			 <quote>section 5 of</quote> after <quote>Clayton Act, and</quote>;</text>
			</paragraph><paragraph id="ID8f123a5df6b142149d30b50534e032b4"><enum>(2)</enum><text>inserting
			 <quote>as section 5 relates to unfair methods of competition,</quote> after
			 <quote>Commission Act, as amended,</quote>;</text>
			</paragraph><paragraph id="ID3c6780fccffc430ca2ca91efc9971235"><enum>(3)</enum><text>striking
			 <quote>to the extent that</quote> and all that follows through
			 <quote>law.</quote> and inserting the following: “except to the extent—</text>
				<quoted-block display-inline="no-display-inline" id="id43B2F1828F76446090B335BD10F46CD4" style="OLC">
					<paragraph id="ID47413c23f45a468690a6869cfe58211d"><enum>(1)</enum><text>the conduct of a
				person engaged in the business of insurance is undertaken pursuant to a clearly
				articulated policy of a State that is actively supervised by that State;
				or</text>
					</paragraph><paragraph id="IDa3e6ae530d474804b7326a0a7d8616f3"><enum>(2)</enum><text>the conduct
				involves a third party not engaged in the business of insurance—</text>
						<subparagraph id="ID274444459ea04fd7b9a96b87e145e5c1"><enum>(A)</enum><text>that collects,
				compiles or disseminates aggregated historical loss data;</text>
						</subparagraph><subparagraph id="ID21c8f55c0f95402caafdfa4a5360c0d4"><enum>(B)</enum><text>that develops and
				disseminates standardized insurance policy forms, contracts addendums or
				language; or</text>
						</subparagraph><subparagraph id="ID80c821147d9240028c9457a17ce6ba64"><enum>(C)</enum><text>that—</text>
							<clause id="idF3B7555837484AB098D5FD267B93C765"><enum>(i)</enum><text>facilitates other
				joint conduct pursuant to guidelines issued by the Federal Trade Commission or
				existing law; and</text>
							</clause><clause id="id4CC2081D56C543D8B1638953F4E0FF7B"><enum>(ii)</enum><text>does not
				include—</text>
								<subclause id="ID41c127b8ad28487cb05ef44e6cacf0e7"><enum>(I)</enum><text>exchanging
				information among competitors relating to sales, profitability, prices,
				marketing, or distribution of any product, process, or service that is not
				reasonably required for the purposes enumerated in subparagraph (A) or
				(B);</text>
								</subclause><subclause id="IDf7f6cc58a6ed4b648cae40eb45b543ec"><enum>(II)</enum><text>entering into
				any agreement or engaging in any other conduct that would allocate a market
				with a competitor; or</text>
								</subclause><subclause id="IDa9b676c1f5d54d34a1b1eef43bda7c24"><enum>(III)</enum><text>entering into
				any agreement or conspiracy that would set or restrain prices of any good or
				service.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID92f3d8d93c9d4ea2b54df5cfc3862688"><enum>(4)</enum><text>adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA44A5DE4B5674E68AE7518BD6D72B19B" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">Except as
				it relates to unfair methods of competition, the Federal Trade Commission Act
				shall be applicable to the business of insurance to the extent that such
				business is not regulated by State
				law.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
