		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Canyon Ferry National Recreation
			 Area Act</short-title></quote>.</text>
		</section><section id="id96567B62D1E044409528207167A5A38F"><enum>2.</enum><header>Findings;
			 purposes</header>
			<subsection id="id0D107C1545AC4A868AD9DE170748B6E5"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="IDc6fcd0355f5b4ed5b43e8c79c30f385e"><enum>(1)</enum><text>the Canyon Ferry
			 Unit Dam—</text>
					<subparagraph id="idE956A266361346D795659544DD1B67B7"><enum>(A)</enum><text>was authorized by
			 the Flood Control Act of 1944 (58 Stat. 891, chapter 665); and</text>
					</subparagraph><subparagraph id="idDD8FEF897267477B8F1D724CF3FE7B7D"><enum>(B)</enum><text>is operated by
			 the Bureau of Reclamation;</text>
					</subparagraph></paragraph><paragraph id="ID1b67bc5ece1f42efb83961a4a45493e1"><enum>(2)</enum><text>the Canyon Ferry
			 Reservoir—</text>
					<subparagraph id="idFFF08E375F8A4D7FA8DD07D1787923C3"><enum>(A)</enum><text>covers
			 approximately 33,500 acres;</text>
					</subparagraph><subparagraph id="id9EE802E25DD843F6ADA2C8C21062C963"><enum>(B)</enum><text>has 96 miles of
			 shoreline;</text>
					</subparagraph><subparagraph id="id83F6CFB8A6214A49B732BE6095BFC42F"><enum>(C)</enum><text>encompasses 9,360
			 acres of developed and undeveloped recreation land;</text>
					</subparagraph><subparagraph id="id68586C85B96D470CBA5078A3D678A3FC"><enum>(D)</enum><text>is located
			 approximately 17 miles east of Helena, Montana; and</text>
					</subparagraph><subparagraph id="idECD939EA565F45AD981472D3D19C33B2"><enum>(E)</enum><text>has become an
			 important regional recreation destination;</text>
					</subparagraph></paragraph><paragraph id="IDe3ca4bf60726435e86a69f20d4f5b8c3"><enum>(3)</enum><text>the growing
			 recreational use at the Canyon Ferry Reservoir generates revenue that is
			 important to local economies; and</text>
				</paragraph><paragraph id="IDa27fa5972e48455fbcf46ce100596687"><enum>(4)</enum><text>multiple
			 jurisdictions currently manage that important public land.</text>
				</paragraph></subsection><subsection id="IDf4b50b2239a84457a2abe4f012992966"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="ID8c69d221886542f58a54382e905347c6"><enum>(1)</enum><text>to provide high
			 quality recreational facilities and services on the land surrounding the Canyon
			 Ferry Reservoir;</text>
				</paragraph><paragraph id="IDeb86bb9450604dafaef7eaf344be1800"><enum>(2)</enum><text>to conserve the
			 scenic, scientific, historic, and other resource values contributing to the
			 public use and enjoyment of that land and water;</text>
				</paragraph><paragraph id="ID3f9dd77a14b74b63bc4fe1316911066d"><enum>(3)</enum><text>to promote
			 cooperation between the Federal Government and private entities to manage that
			 exceptional resource;</text>
				</paragraph><paragraph id="IDff52aed244a14c049fcc0a176db830b1"><enum>(4)</enum><text>to authorize the
			 Secretary to manage certain resources; and</text>
				</paragraph><paragraph id="IDde92b320749c450dbd0bd25a53284952"><enum>(5)</enum><text>to transfer to
			 the Secretary, without consideration, administrative jurisdiction over certain
			 Federal land for management as a unit of the National Forest System.</text>
				</paragraph></subsection></section><section id="ID3ab749d3eae94c4ba8e5968540e05378"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idFD77074DD9B44596B27D233D96AECDE1"><enum>(1)</enum><header>Cooperator</header><text>The
			 term <term>cooperator</term> means any—</text>
				<subparagraph id="idAB6D058927864608AD064FC36DF1B164"><enum>(A)</enum><text>Federal
			 agency;</text>
				</subparagraph><subparagraph id="id96EA2DDE44B24A5E8BC90ACBC204CDF8"><enum>(B)</enum><text>State, local, or
			 tribal government;</text>
				</subparagraph><subparagraph id="id0455E8AE7BEB4562B10A03DE2CF5D0C1"><enum>(C)</enum><text>public or private
			 agency;</text>
				</subparagraph><subparagraph id="idEB80CCA3EE2944DF890BE1471DD815F1"><enum>(D)</enum><text>nonprofit
			 organization;</text>
				</subparagraph><subparagraph id="id9095300BE25D46D88926ED7B8C93E08E"><enum>(E)</enum><text>institution
			 (including any educational institution);</text>
				</subparagraph><subparagraph id="id2264D394E85E49E8BC5D8C97CB21E4E3"><enum>(F)</enum><text>small or local
			 business;</text>
				</subparagraph><subparagraph id="idA547DECBD98D4AAF86D24167CBEEB262"><enum>(G)</enum><text>corporation;</text>
				</subparagraph><subparagraph id="id1F0B9EFC38834868BD70FDCE92F7B636"><enum>(H)</enum><text>individual;
			 and</text>
				</subparagraph><subparagraph id="id284AD4439B104F5FBB8E94843A2DB502"><enum>(I)</enum><text>other legal
			 entity located within the United States.</text>
				</subparagraph></paragraph><paragraph id="id9E649F52EEFF4971B18F2C6796845906"><enum>(2)</enum><header>Dam</header><text>The
			 term <term>Dam</term> means—</text>
				<subparagraph id="id8DA0C7ECDF1546568848F503902059FE"><enum>(A)</enum><text>the Canyon Ferry
			 Unit Dam; and</text>
				</subparagraph><subparagraph id="id084659324B5B46DB983B262A84EA3A77"><enum>(B)</enum><text>any facility
			 relating to the Canyon Ferry Unit Dam.</text>
				</subparagraph></paragraph><paragraph id="IDa98fa11cf7ba435e8f99deb97b070ef1"><enum>(3)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the Canyon Ferry Management Fund established by
			 section 9(a).</text>
			</paragraph><paragraph id="ID4f4d95eb5d5d414db3fabf5be0fdbf04"><enum>(4)</enum><header>National forest
			 system land</header><text>The term <term>National Forest System land</term>
			 means land included in the National Forest System (as defined in section 11(a)
			 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C.
			 1609(a))).</text>
			</paragraph><paragraph id="ID339f4fb1c3104e7b878189f045b03e5b"><enum>(5)</enum><header>Recreation
			 Area</header><text>The term <term>Recreation Area</term> means the Canyon Ferry
			 National Recreational Area designated by section 4(a).</text>
			</paragraph><paragraph id="IDd6a9fc9e8e14481ba65c96d929d67064"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="idA0D2AED79A584FEE9407F8AAE68CEBB2"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Montana.</text>
			</paragraph></section><section id="IDf3f8ea3dce02497198d449a72a7ef545"><enum>4.</enum><header>Establishment</header>
			<subsection id="IDb7481d4b96374b059df9b76b8e0fe0fd"><enum>(a)</enum><header>In
			 general</header><text>Certain Federal land managed by the Forest Service, as
			 generally depicted on the map entitled <quote>Canyon Ferry National Recreation
			 Area</quote>, dated June 2006, is designated as the <quote>Canyon Ferry
			 National Recreation Area</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4415D411FF3547A8B2C55B2CFD48BF27"><enum>(b)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">The map described in subsection (a) shall
			 be filed and made available for public inspection—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4467429BA3A14A0FB65C13B549297A8E"><enum>(1)</enum><text display-inline="yes-display-inline">in the Office of the Forest Supervisor of
			 the Helena National Forest; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFED55DCAECF340D0AA8F4F2CA03CF6A4"><enum>(2)</enum><text display-inline="yes-display-inline">on the Internet.</text>
				</paragraph></subsection></section><section id="IDb74f7c4d12ca402889c29a824771abf4"><enum>5.</enum><header>Management</header>
			<subsection id="IDaa3ed30d72334a82b5e0ea7e858b19c5"><enum>(a)</enum><header>In
			 general</header><text>Subject to the authority of the Secretary of the Interior
			 under section 6, the Secretary shall manage the Recreation Area to establish
			 and provide for—</text>
				<paragraph id="ID68c7ab17ccc6448586144a9e751fbcbd"><enum>(1)</enum><text>public
			 recreational opportunities in the Recreation Area (including hunting and
			 fishing);</text>
				</paragraph><paragraph id="ID624f15aa97c7440f97a10c98d7ff5ce5"><enum>(2)</enum><text>scenic,
			 scientific, historic, and other resource values contributing to the public use
			 and enjoyment of the Recreation Area; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90641beebabf484b958c04070c403861"><enum>(3)</enum><text>other uses in the
			 Recreation Area.</text>
				</paragraph></subsection><subsection id="ID559eeb04e0da4cdd85b00b4131ae2b9f"><enum>(b)</enum><header>Applicable
			 law</header><text>Subject to valid existing rights, the Secretary shall
			 administer the Recreation Area in accordance with laws (including regulations)
			 applicable to units of the National Forest System.</text>
			</subsection><subsection id="IDcd44c579aa7d4954a35b0f34c0f9b3b7"><enum>(c)</enum><header>Waters</header>
				<paragraph id="IDe44cdcb03cce4f42b2f33e2cb4b45fbd"><enum>(1)</enum><header>Effect</header><text>Nothing
			 in this Act affects the jurisdiction of the Commissioner of Reclamation to
			 manage and regulate water levels that are—</text>
					<subparagraph id="id8635895381BE4909BD240C1A3B5EF362"><enum>(A)</enum><text>located on the
			 Missouri River; and</text>
					</subparagraph><subparagraph id="id846C36333DB248679300D5C51E2AEC86"><enum>(B)</enum><text>subject to
			 flowage easements.</text>
					</subparagraph></paragraph><paragraph id="id1B140618103345A88C08F5D900E5FA61"><enum>(2)</enum><header>Limitation of
			 management authority</header><text>The Secretary shall manage all Forest System
			 land in the Recreation Area, as depicted on the map described in section
			 4(a).</text>
				</paragraph></subsection><subsection id="IDed7b16c1090f401a99ab60219c16c52d"><enum>(d)</enum><header>Campgrounds and
			 airports</header>
				<paragraph id="IDffb1fdad0c9643ba8aa6ec8cf59009a8"><enum>(1)</enum><header>Authority of
			 Secretary</header><text>In accordance with section 1005 of the Omnibus
			 Consolidated and Emergency Supplemental Appropriations Act, 1999 (Public Law
			 105–277; 112 Stat. 2681–715), the Secretary of the Interior shall
			 manage—</text>
					<subparagraph id="idB3DDB5E317764D5189B65EFADD691182"><enum>(A)</enum><text>Indian Road
			 Campground;</text>
					</subparagraph><subparagraph id="idD919FF31FD46421BBEBAC9B6E8D503D6"><enum>(B)</enum><text>Cottonwood
			 Campground; and</text>
					</subparagraph><subparagraph id="idC7E43447480A46EFB79D1A8411E7F8F3"><enum>(C)</enum><text>the Canyon Ferry
			 Airport.</text>
					</subparagraph></paragraph><paragraph id="IDb2a1568e472d404cad2b84ce44f30e4a"><enum>(2)</enum><header>Existing
			 agreements</header><text>To benefit the interests of the public, the Secretary
			 shall act in accordance with any agreement in existence on the date of
			 enactment of this Act with any organization for the management of—</text>
					<subparagraph id="id928FFAE283F34E75B527B8132BC8072C"><enum>(A)</enum><text>campgrounds
			 located in the Recreation Area; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFE10ECE169341F48D0A844246366D11"><enum>(B)</enum><text>marinas located
			 in the Recreation Area.</text>
					</subparagraph></paragraph></subsection><subsection id="ID3eef3e04c4c541dca346e42cf2836448"><enum>(e)</enum><header>Land
			 acquisition</header><text>The Secretary may acquire land and interests in land
			 by purchase, exchange, donation, or otherwise, with donated or appropriated
			 funds.</text>
			</subsection><subsection commented="no" id="ID9d60816ce5fd451eb8c1bb90a3c1b027"><enum>(f)</enum><header>Boundaries</header><text>For
			 purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (16
			 U.S.C. 460<italic>l</italic>–9), the boundary of the Recreation Area shall be
			 considered to be a National Forest boundary that existed as of January 1,
			 1965.</text>
			</subsection><subsection id="ID5b2617ae9a8f42f392dfc7b0fb52c9ba"><enum>(g)</enum><header>Comprehensive
			 management plan</header>
				<paragraph id="id909C26A8748047A18608E9168773624C"><enum>(1)</enum><header>Applicable
			 law</header><text>The Secretary shall develop a management plan for the
			 Recreation Area under paragraph (1) in accordance with the Forest and Rangeland
			 Renewable Resources Planning Act of 1974 (16 U.S.C. 1600 et seq.).</text>
				</paragraph><paragraph id="id497CAD294D9840FFBE7F5E71E751CD31"><enum>(2)</enum><header>Development of
			 plan</header><text>The Secretary may develop a management plan under paragraph
			 (1)—</text>
					<subparagraph id="id53AE7523306E4DC3A8E21C224014E029"><enum>(A)</enum><text>as a separate
			 document; or</text>
					</subparagraph><subparagraph id="id19B40DE2001B4C3D97D37935C089F0F7"><enum>(B)</enum><text>in conjunction
			 with the next regular update of the management plan for the Helena National
			 Forest.</text>
					</subparagraph></paragraph><paragraph id="idAE10A4F9EE444F2BA00F4FC150399BD0"><enum>(3)</enum><header>Applicability</header><text>Nothing
			 in this Act requires an immediate revision or amendment to any plan for any
			 unit of the National Forest System.</text>
				</paragraph><paragraph id="ID2eeb08576a0e46b59e105d86a1da23b3"><enum>(4)</enum><header>Use of planning
			 documents</header><text>Until the date on which the Secretary develops a
			 management plan under paragraph (1), the Secretary may use planning documents
			 prepared by the Department of the Interior without further administrative
			 action.</text>
				</paragraph></subsection><subsection id="IDca0102cdd12b4d9e883fe1cf5d57d3fd"><enum>(h)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, all Federal land located within the Recreation Area
			 is withdrawn from—</text>
				<paragraph id="id922303EF195E4B79821B2E8E6541EC10"><enum>(1)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="id6BFFC20C586E47DC86D7FF109E10974C"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="ID57185cff03c34bcfaed2467d2ebde56d"><enum>(3)</enum><text>disposition under
			 all laws relating to mineral and geothermal leasing.</text>
				</paragraph></subsection></section><section id="ID017237e6575c446eab3d2541d01c5c2d"><enum>6.</enum><header>Authority of
			 Secretary of the Interior</header>
			<subsection id="ID7409ec56936643cfb621d09a335eb222"><enum>(a)</enum><header>Hydropower
			 facilities</header><text>The Commissioner of Reclamation shall continue to
			 administer and operate—</text>
				<paragraph id="id6EFEC619765C46DCB80D561D9FAA6750"><enum>(1)</enum><text>the Dam;</text>
				</paragraph><paragraph id="idBF874D63ED7841F8B5E2BB170EC8C059"><enum>(2)</enum><text>any power
			 facility relating to the Dam; and</text>
				</paragraph><paragraph id="id8E04B8C274DC40FDA43872798723819E"><enum>(3)</enum><text>any land or
			 facility depicted on the map described in section 4(a).</text>
				</paragraph></subsection><subsection commented="no" id="IDb916e3f04186438ba2d9c25252a22f43"><enum>(b)</enum><header>Residential
			 areas</header><text>Nothing in this Act affects the authority of the Secretary
			 of Interior to carry out title X of the Omnibus Consolidated and Emergency
			 Supplemental Appropriations Act, 1999 (Public Law 105–277; 112 Stat. 2681–710)
			 as depicted on the map described in section 4(a).</text>
			</subsection></section><section id="ID3b5b4e19ea6746d19955ba30e7a382e7"><enum>7.</enum><header>Existing
			 authorizations</header>
			<subsection id="ID425f99062b7640059446290889b36816"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsections (b) and (c), nothing in
			 this Act affects any authorization in effect as of the date of enactment of
			 this Act made by any department or agency of the Federal Government for the use
			 of land or water located within the Recreation Area (referred to in this
			 section as an <quote>existing authorization</quote>).</text>
			</subsection><subsection id="idEFC92662804544799CC1A24410FF49A3"><enum>(b)</enum><header>Assumption of
			 existing authorization</header><text>Not later than 1 year after the date of
			 enactment of this Act, the Secretary shall—</text>
				<paragraph id="idF50F2BA4ACDE450EA4F0277743FA177C"><enum>(1)</enum><text>assume the
			 administration of any existing authorization; and</text>
				</paragraph><paragraph id="idCFE3840015F44BFB865434319B7ED713"><enum>(2)</enum><text>manage the
			 existing authorization in accordance with the terms of that existing
			 authorization.</text>
				</paragraph></subsection><subsection id="IDa6416d631b954d97abeabfe0a317966a"><enum>(c)</enum><header>Renewal of
			 existing authorization</header><text>The renewal of any existing authorization
			 shall be made in accordance with such terms and conditions as the Secretary may
			 prescribe.</text>
			</subsection></section><section id="ID257c61a59d57415d971f1075996b1666"><enum>8.</enum><header>Cooperative
			 agreements</header>
			<subsection id="IDadc34ef723344e33bd5d5a727690c1c2"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding chapter 63 of title 31, United States
			 Code, the Secretary may enter into cooperative agreements (including agreements
			 providing for the sharing of costs of activities or services otherwise
			 authorized by law) with 1 or more cooperators for—</text>
				<paragraph id="IDe74c6ca9a42f476786b30eeb007744fa"><enum>(1)</enum><text>the construction,
			 maintenance, improvement, or operation of any facility not under the
			 jurisdiction of the Administrator of General Services that is located on or in
			 the vicinity of—</text>
					<subparagraph id="id4FA8365FA511434FB30E94931BB41C23"><enum>(A)</enum><text>land managed by
			 the Forest Service;</text>
					</subparagraph><subparagraph id="id49FF97C063D845FEA961E2D1622A5749"><enum>(B)</enum><text>land administered
			 by any other public entity; or</text>
					</subparagraph><subparagraph id="id0D0161D946314222877D77026820A8AB"><enum>(C)</enum><text>private
			 land;</text>
					</subparagraph></paragraph><paragraph id="ID1cdef3215cae4d8d9c989438d8d055f1"><enum>(2)</enum><text>the development,
			 production, publishing, distribution, or sale of educational and interpretive
			 materials and products;</text>
				</paragraph><paragraph id="IDce00ae0cb70446c5b07775d0c9c733d6"><enum>(3)</enum><text>the sale, on or
			 in the vicinity of land managed by the Forest Service, of—</text>
					<subparagraph id="id545511DD09454D8BBC4F3CF537B6F4A8"><enum>(A)</enum><text>health and safety
			 convenience products;</text>
					</subparagraph><subparagraph id="id594483BF9EA644F4B37245D5342ED577"><enum>(B)</enum><text>photography
			 supplies; or</text>
					</subparagraph><subparagraph id="id5F191378CC044D78BE7DC1BD05A55BCD"><enum>(C)</enum><text>other related
			 items (as determined by the Secretary);</text>
					</subparagraph></paragraph><paragraph id="IDa5835ddcb52d4e3aa2049c4abf8fb689"><enum>(4)</enum><text>the collection,
			 on behalf of the cooperators that are parties to the cooperative agreement, of
			 funds from the sale of—</text>
					<subparagraph id="id0F7BCFA5E1AF49D297783556FC6F2DFE"><enum>(A)</enum><text>materials;</text>
					</subparagraph><subparagraph id="idAD584E3811EF43C5A8AEE774CEBAB092"><enum>(B)</enum><text>products;
			 and</text>
					</subparagraph><subparagraph id="id7D8D1C0D621D49DBA809640EF779AF99"><enum>(C)</enum><text>services;</text>
					</subparagraph></paragraph><paragraph id="ID5e0d4ae355b84c5a8c2dc17892cfcbbc"><enum>(5)</enum><text>the restoration
			 and maintenance of the ecological integrity of National Forest System land;
			 and</text>
				</paragraph><paragraph id="id7DE79AD5B92B4E0A84663FB3AE2981F2"><enum>(6)</enum><text>the operation and
			 maintenance of any recreation facility located on National Forest System
			 land.</text>
				</paragraph></subsection><subsection id="ID5c1ae528b08144b3a38032c79207a90b"><enum>(b)</enum><header>Terms and
			 conditions</header>
				<paragraph id="id4A51524D5D6C43B7BF82DB87BF5729B9"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), a cooperative agreement entered
			 into under subsection (a)—</text>
					<subparagraph id="id7F6A8933BD8844E5A9E8872D7A412E2D"><enum>(A)</enum><text>shall, at a
			 minimum, require terms and conditions that protect public investments,
			 including terms and conditions that—</text>
						<clause id="idFF06D0A103864678AFA49BB4B9D0037D"><enum>(i)</enum><text>relate to the
			 ownership and operation of any facility or improvement covered by the
			 cooperative agreement; and</text>
						</clause><clause id="idF2DEA15670144A048DF869A5138329EF"><enum>(ii)</enum><text>are mutually
			 agreed to by the Secretary and the cooperators that are parties to the
			 cooperative agreement; and</text>
						</clause></subparagraph><subparagraph id="idE0D656E759C24973B444E96403A32012"><enum>(B)</enum><text>may provide terms
			 and conditions that describe the manner by which costs shall be shared between
			 the Secretary and the cooperators that are parties to the cooperative
			 agreement, including—</text>
						<clause id="idF0EBD1D4AD444263A69D697FFC377B03"><enum>(i)</enum><text>the
			 acceptance of any in-kind contribution; and</text>
						</clause><clause id="idC98C4C7170B445609423668793F5DE30"><enum>(ii)</enum><text>the contribution
			 of any volunteer service.</text>
						</clause></subparagraph></paragraph><paragraph id="ID2cc551621cf3478382dfb7215d25658c"><enum>(2)</enum><header>Exception</header><text>The
			 Secretary shall not enter into a cooperative agreement under subsection (a) if
			 the purposes described in subsection (a) may be satisfied by—</text>
					<subparagraph id="id5603038A7F424F1CB3CAF25074667DCF"><enum>(A)</enum><text>entering into a
			 procurement contract or providing a grant under chapter 63 of title 31, United
			 States Code; or</text>
					</subparagraph><subparagraph id="id92BBCAB26AF44A6C8B086E3FDA6FC619"><enum>(B)</enum><text>providing a
			 special use authorization.</text>
					</subparagraph></paragraph></subsection><subsection id="IDc05c9930dd544881b9953096f34b94c9"><enum>(c)</enum><header>Treatment of
			 contribution of volunteers</header><text>The value of services performed by
			 persons who volunteer services to the Forest Service and who are recruited,
			 trained, and supported by a cooperator that is a party to a cooperative
			 agreement under subsection (a) may be considered to be an in-kind contribution
			 of the cooperator for the purposes of cost sharing under subsection (a).</text>
			</subsection><subsection id="ID8eb9af794a2f4b46a6d0dae42f5ee449"><enum>(d)</enum><header>Funds collected
			 by cooperators</header>
				<paragraph id="id5B7E68B55EF94855AAC1DF977BD55E7C"><enum>(1)</enum><header>In
			 general</header><text>Funds collected under an agreement under subsection (a)
			 from the sale of materials, products, or programs on behalf of a cooperator
			 shall not be considered to be the property of the United States.</text>
				</paragraph><paragraph id="idF46CC34C46494DFEAD85540A291012FE"><enum>(2)</enum><header>Forwarding of
			 funds</header><text>The Secretary shall forward to the appropriate cooperator
			 any funds described in paragraph (1).</text>
				</paragraph></subsection><subsection id="ID688bf8fef7c64dc8a6e869eaec3cd07d"><enum>(e)</enum><header>Advancement or
			 reimbursement of funds</header>
				<paragraph id="id4D34054E2FD447C3A5E4ABB364B36A5B"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), and in accordance with a
			 cooperative agreement entered into under subsection (a), the Secretary
			 may—</text>
					<subparagraph id="idFD9034F3076C46559CDA5F96987ED581"><enum>(A)</enum><text>advance or
			 reimburse funds to an appropriate cooperator from any appropriation of the
			 Forest Service that is available for similar work; and</text>
					</subparagraph><subparagraph id="idC8B5EBEAF9AA4500AF7DE23C88999D20"><enum>(B)</enum><text>furnish to the
			 cooperator any supplies, facilities, or equipment.</text>
					</subparagraph></paragraph><paragraph id="id2F7D353AA96945E3A0B6CEE1BCEB1EB2"><enum>(2)</enum><header>Conditions for
			 advancement</header><text>The Secretary may advance funds to a cooperator under
			 paragraph (1)(A) if—</text>
					<subparagraph id="id6B082A4B21124081968864FF3C634AE6"><enum>(A)</enum><text>the advancement
			 represents the share of the Secretary of any costs, activities, or services
			 under a cooperative agreement entered into under subsection (a); and</text>
					</subparagraph><subparagraph id="id4DD388AC90B342A58A8AB59A39FA289A"><enum>(B)</enum><text>the cooperator is
			 not obligated to reimburse the Secretary for those costs, activities, or
			 services.</text>
					</subparagraph></paragraph></subsection></section><section id="ID6c12d1fb873d42458e4ea6d8fc590d25"><enum>9.</enum><header>Miscellaneous
			 provisions</header>
			<subsection id="IDd5d65a21698f49fc95cc73252917b2af"><enum>(a)</enum><header>Donations</header>
				<paragraph id="id6F1A972C7070486E9F0EE9666F271509"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, the Secretary
			 may accept donations of funds, property, or services from any—</text>
					<subparagraph id="id9D63A2E3DC154FE9A8910F99846875D6"><enum>(A)</enum><text>individual;</text>
					</subparagraph><subparagraph id="idBDE1A9094CF24028BF5E11863993D34E"><enum>(B)</enum><text>foundation;</text>
					</subparagraph><subparagraph id="id57C367AD8B3B4B65A0E309FB07A2EE43"><enum>(C)</enum><text>corporation;
			 or</text>
					</subparagraph><subparagraph id="idC4FAF3A68FE3455F83D8BED3B2FBB12F"><enum>(D)</enum><text>public
			 entity.</text>
					</subparagraph></paragraph><paragraph id="idB6FDBFDD00EF45AE8055C755CC620451"><enum>(2)</enum><header>Authorized
			 uses</header><text>The Secretary shall use donations of funds, property, or
			 services accepted under paragraph (1) for—</text>
					<subparagraph id="id63145100E1D74853A2C90933E3775F82"><enum>(A)</enum><text>capital
			 improvements in the Recreation Area;</text>
					</subparagraph><subparagraph id="id308FEF2320B84151B851AA230632DA81"><enum>(B)</enum><text>facility
			 enhancements and repair of the Recreation Area;</text>
					</subparagraph><subparagraph id="id91C8531FBE984C549C9244945F15D7A0"><enum>(C)</enum><text>operation and
			 maintenance of the Recreation Area;</text>
					</subparagraph><subparagraph id="id66489E1F769C429BAAD1985B843BACD0"><enum>(D)</enum><text>the provision
			 of—</text>
						<clause id="id10317AA462F244379C987E8A4C88A102"><enum>(i)</enum><text>visitor access to
			 the Recreation Area;</text>
						</clause><clause id="id9896C6CF0BB84EA98F1A1E1B59C46B55"><enum>(ii)</enum><text>visitor services
			 and information relating to the Recreation Area; and</text>
						</clause><clause id="id30A565D55418423F942354007D26E4D6"><enum>(iii)</enum><text>interpretation
			 of and education relating to the Recreation Area;</text>
						</clause></subparagraph><subparagraph id="id2D6795CAC1AF41C7A8A660B71892AC67"><enum>(E)</enum><text>maintenance of
			 trails in proximity to the Recreation Area;</text>
					</subparagraph><subparagraph id="id5F60C793B9A44BEDA61D7C7411736A1A"><enum>(F)</enum><text>ensuring the
			 health and safety needs of visitors of the Recreation Area;</text>
					</subparagraph><subparagraph id="idD17DD7F79705437C8B75A23ECF7AB451"><enum>(G)</enum><text>habitat
			 restoration relating to wildlife-dependent recreation, including—</text>
						<clause id="id933511B113FC4272A0C3A499F67ECA64"><enum>(i)</enum><text>hunting;</text>
						</clause><clause id="id1E0637345DA04FA59F10689D8B114DC8"><enum>(ii)</enum><text>fishing;</text>
						</clause><clause id="id95835A74E06F4993BC1BB0466AFE3711"><enum>(iii)</enum><text>wildlife
			 observation; and</text>
						</clause><clause id="id364425EA99154A90A98EE4A72825FA34"><enum>(iv)</enum><text>photography;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7B71A8FBFBB470B9D9F838C1657BF0A"><enum>(H)</enum><text>law enforcement
			 relating to public use of the Recreation Area.</text>
					</subparagraph></paragraph></subsection><subsection id="ID3799482174464481b6966c33c03a2247"><enum>(b)</enum><header>Cooperating
			 associations</header><text>To provide services and facilities consistent with
			 this Act, the Secretary may enter into grants, contracts, and cooperative
			 agreements with—</text>
				<paragraph id="idE8A51F4C122D441D95AEB68BA124BB84"><enum>(1)</enum><text>the Canyon Ferry
			 Foundation;</text>
				</paragraph><paragraph id="id2F03C4D541C34B198E39078A10C6F205"><enum>(2)</enum><text>the Helena Forest
			 Foundation; and</text>
				</paragraph><paragraph id="idF394C1BFE9C34148816DAEAE3D2BD621"><enum>(3)</enum><text>any other
			 organization.</text>
				</paragraph></subsection></section><section id="IDc2583b424aaa4f5b966497456f2f3a85"><enum>10.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
