		<official-title>To provide the Department of Justice the necessary
		  authority to apprehend, prosecute, and convict individuals committing animal
		  enterprise terror.</official-title>

		<section id="HE39D4B6B642441719E03FE00EA69D93D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Animal Enterprise Terrorism
			 Act</short-title></quote>.</text>
		</section><section id="H0F2A13E2743A4012923C1911DD53A5AC"><enum>2.</enum><header>Inclusion of
			 economic damage to animal enterprises and threats of death and serious bodily
			 injury to associated persons</header>
			<subsection id="HFD77A57965BC400EAE5B486182B9B683"><enum>(a)</enum><header>In
			 general</header><text>Section 43 of title 18, United States Code, is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H71CE4BA8EEC44D94929BB563E9639F35" style="USC">
					<section id="H6A4EECE256CA42B3ACF4E29D00A54140"><enum>43.</enum><header>Force, violence,
				and threats involving animal enterprises</header>
						<subsection id="HF08294B352B7453697C5A4BF6E42E72"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever travels in interstate or foreign
				commerce, or uses or causes to be used the mail or any facility of interstate
				or foreign commerce—</text>
							<paragraph id="H5CD23A35C2B14F0BA059C2875686B200"><enum>(1)</enum><text>for the purpose of
				damaging or interfering with the operations of an animal enterprise; and</text>
							</paragraph><paragraph id="HF7D5AB20FB214ECA96DBEEE9634F4FE4"><enum>(2)</enum><text>in connection with
				such purpose—</text>
								<subparagraph id="HD4DD09374FA3476FA6B114F6DA3ECD5C"><enum>(A)</enum><text display-inline="yes-display-inline">intentionally damages, or causes the loss
				of any property (including animals or records) used by an animal enterprise, or
				any property of a person or entity having a connection to, relationship with,
				or transactions with an animal enterprise;</text>
								</subparagraph><subparagraph id="H356DB7BC712845F29B3FCC0000FECEA2"><enum>(B)</enum><text display-inline="yes-display-inline">intentionally places a person in reasonable
				fear of the death of, or serious bodily injury to that person, a member of the
				immediate family (as defined in section 115) of that person, or a spouse or
				intimate partner of that person by a course of conduct involving threats, acts
				of vandalism, property damage, criminal trespass, harassment, or intimidation;
				or</text>
								</subparagraph><subparagraph id="H5E17FF88479A434B0000728604B7FCF7"><enum>(C)</enum><text display-inline="yes-display-inline">conspires or attempts to do so;</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">shall be
				punished as provided for in subsection (b).</continuation-text></paragraph></subsection><subsection id="H0AF77F4A8E31414D8D502E1F4300F9D0"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">The punishment for a violation of section
				(a) or an attempt or conspiracy to violate subsection (a) shall be—</text>
							<paragraph id="H24F008BCE68D4045B5AC88CD100E972"><enum>(1)</enum><text display-inline="yes-display-inline">for an offense involving exclusively a
				nonviolent physical obstruction of an animal enterprise or a business having a
				connection to, or relationship with, an animal enterprise, that may result in
				loss of profits but does not result in bodily injury or death or property
				damage or loss—</text>
								<subparagraph id="H502CBCC19D6545A1BA2D60D361AAA7FD"><enum>(A)</enum><text display-inline="yes-display-inline">not more than $10,000 and the length of
				imprisonment shall be not more than 6 months, or both, for the first offense;
				and</text>
								</subparagraph><subparagraph id="HBA1DB26B02644EE5A91E4B352EF7EDD4"><enum>(B)</enum><text display-inline="yes-display-inline">not more than $25,000 and the length of
				imprisonment shall be not more than 18 months, or both, for a subsequent
				offense;</text>
								</subparagraph></paragraph><paragraph id="H796D04E78DDF42A4894868D3C38BFFA"><enum>(2)</enum><text display-inline="yes-display-inline">a fine under this title or imprisonment not
				more than 1 year, or both, if the offense does not instill in another the
				reasonable fear of serious bodily injury or death and—</text>
								<subparagraph id="HE0D2A68AC05B463499F01DC32138BFF"><enum>(A)</enum><text display-inline="yes-display-inline">the offense results in no economic damage
				or bodily injury; or</text>
								</subparagraph><subparagraph id="H68DF30FFCAF34C8CA9BA3FB7E0E578EF"><enum>(B)</enum><text display-inline="yes-display-inline">the offense results in economic damage that
				does not exceed $10,000;</text>
								</subparagraph></paragraph><paragraph id="H7E27FACFC99848F08F00ABDD002B7BE2"><enum>(3)</enum><text display-inline="yes-display-inline">a fine under this title or imprisonment for
				not more than 5 years, or both, if no bodily injury occurs and—</text>
								<subparagraph id="H0E602CB6AC3249F5BE5D785DA2C1F719"><enum>(A)</enum><text display-inline="yes-display-inline">the offense results in economic damage
				exceeding $10,000 but not exceeding $100,000; or</text>
								</subparagraph><subparagraph id="H6B8A3F8F72B0414CAB5FA758974CEC9C"><enum>(B)</enum><text display-inline="yes-display-inline">the offense instills in another the
				reasonable fear of serious bodily injury or death;</text>
								</subparagraph></paragraph><paragraph id="HD515881CD19A4C6AB001094BA2C6D283"><enum>(4)</enum><text display-inline="yes-display-inline">a fine under this title or imprisonment for
				not more than 10 years, or both, if—</text>
								<subparagraph id="HEDD3B0FB4E6E4DD29CE553AC9CFE526"><enum>(A)</enum><text>the offense results
				in economic damage exceeding $100,000; or</text>
								</subparagraph><subparagraph id="H7B1E901DC80F41D3BF651582CFEFF4BF"><enum>(B)</enum><text>the offense causes
				substantial bodily injury to another individual;</text>
								</subparagraph></paragraph><paragraph id="HDAE0CEB181A548B3851C14DD3FF57BCF"><enum>(5)</enum><text display-inline="yes-display-inline">a fine under this title or imprisonment for
				not more than 20 years, or both, if—</text>
								<subparagraph id="H9ACA546AF20843DEB517B57BB8A358CC"><enum>(A)</enum><text>the offense
				results in serious bodily injury to another individual; or</text>
								</subparagraph><subparagraph id="HB448E216A47A49518960EC515BEF29BE"><enum>(B)</enum><text display-inline="yes-display-inline">the offense results in economic damage
				exceeding $1,000,000; and</text>
								</subparagraph></paragraph><paragraph id="H1F07B89202BD46BABF49FE3500AF14D7"><enum>(6)</enum><text display-inline="yes-display-inline">a fine under this title and imprisonment
				for life or for any term of years, or both, if the offense results in death of
				another individual.</text>
							</paragraph></subsection><subsection id="H0EEBE5A09C154800AEF22254815E219E"><enum>(c)</enum><header>Restitution</header><text display-inline="yes-display-inline">An order of restitution under section 3663
				or 3663A of this title with respect to a violation of this section may also
				include restitution—</text>
							<paragraph id="HDE60A5854B654F7F9F33D8545294106D"><enum>(1)</enum><text display-inline="yes-display-inline">for the reasonable cost of repeating any
				experimentation that was interrupted or invalidated as a result of the
				offense;</text>
							</paragraph><paragraph id="H372F2BFE692141FBB674BE6BE93ED477"><enum>(2)</enum><text display-inline="yes-display-inline">for the loss of food production or farm
				income reasonably attributable to the offense; and</text>
							</paragraph><paragraph id="HC02668DC616D462EA8034380519C80FC"><enum>(3)</enum><text display-inline="yes-display-inline">for any other economic damage, including
				any losses or costs caused by economic disruption, resulting from the
				offense.</text>
							</paragraph></subsection><subsection id="H9F9985DB13B5440593155651F2B6F0EF"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph id="H8EBD9E29129546759C0050E35618ED61"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>animal enterprise</quote>
				means—</text>
								<subparagraph id="H0A8CEA9B21814F1DB4DCEA76DC1157DE"><enum>(A)</enum><text display-inline="yes-display-inline">a commercial or academic enterprise that
				uses or sells animals or animal products for profit, food or fiber production,
				agriculture, education, research, or testing;</text>
								</subparagraph><subparagraph id="H3741CECA0C2B432780B567E50312AF5D"><enum>(B)</enum><text display-inline="yes-display-inline">a zoo, aquarium, animal shelter, pet store,
				breeder, furrier, circus, or rodeo, or other lawful competitive animal event;
				or</text>
								</subparagraph><subparagraph id="H5480E2C73F72482A8CDEFB55A8F016F"><enum>(C)</enum><text display-inline="yes-display-inline">any fair or similar event intended to
				advance agricultural arts and sciences;</text>
								</subparagraph></paragraph><paragraph id="HAB563C784E7D48BB891594DA7342A4C"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>course of conduct</quote>
				means a pattern of conduct composed of 2 or more acts, evidencing a continuity
				of purpose;</text>
							</paragraph><paragraph id="HF8FA32ED2DF84C8CABD61E316723B613"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>economic
				damage</quote>—</text>
								<subparagraph id="H70ACCC40087E439C80E4C8AA11180062"><enum>(A)</enum><text display-inline="yes-display-inline">means the replacement costs of lost or
				damaged property or records, the costs of repeating an interrupted or
				invalidated experiment, the loss of profits, or increased costs, including
				losses and increased costs resulting from threats, acts or vandalism, property
				damage, trespass, harassment, or intimidation taken against a person or entity
				on account of that person’s or entity’s connection to, relationship with, or
				transactions with the animal enterprise; but</text>
								</subparagraph><subparagraph id="H895C142B8C674E3684CD00DD431277E0"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any lawful economic
				disruption (including a lawful boycott) that results from lawful public,
				governmental, or business reaction to the disclosure of information about an
				animal enterprise;</text>
								</subparagraph></paragraph><paragraph id="H26175B371D4B4E19B92C1E01BB8C5780"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>physical
				obstruction</quote> means rendering impassable ingress to or egress from an
				animal enterprise facility, or rendering passage to or from such a facility
				unreasonably difficult;</text>
							</paragraph><paragraph id="H36CA807F609847FF87D21C77682F78AF"><enum>(5)</enum><text display-inline="yes-display-inline">the term <quote>serious bodily
				injury</quote> means—</text>
								<subparagraph id="HFD95A7A599CB43C3A7A48800E4A9CE1"><enum>(A)</enum><text display-inline="yes-display-inline">injury posing a substantial risk of
				death;</text>
								</subparagraph><subparagraph id="H112DBE90215E4507BB80394C7410AAF"><enum>(B)</enum><text display-inline="yes-display-inline">extreme physical pain;</text>
								</subparagraph><subparagraph id="HEDA07D619B134208A8D1854F0404CDD1"><enum>(C)</enum><text display-inline="yes-display-inline">protracted and obvious disfigurement;
				or</text>
								</subparagraph><subparagraph id="HEB060B3149A148318626519B2DE302AD"><enum>(D)</enum><text display-inline="yes-display-inline">protracted loss or impairment of the
				function of a bodily member, organ, or mental faculty; and</text>
								</subparagraph></paragraph><paragraph id="H79AC28D0408C4F368DB222A0B3DB38B"><enum>(6)</enum><text display-inline="yes-display-inline">the term <quote>substantial bodily
				injury</quote> means—</text>
								<subparagraph id="H7BBDFC08AD484860877EBCC0F57C9198"><enum>(A)</enum><text>deep cuts and
				serious burns or abrasions;</text>
								</subparagraph><subparagraph id="HA8DD6897DA8C4E42942F107083D2CC7E"><enum>(B)</enum><text>short-term or
				nonobvious disfigurement;</text>
								</subparagraph><subparagraph id="HA3506E349534493685E722D0763F8099"><enum>(C)</enum><text>fractured or
				dislocated bones, or torn members of the body;</text>
								</subparagraph><subparagraph id="HF4155FB449504AC3ABC541F43B0337B2"><enum>(D)</enum><text>significant
				physical pain;</text>
								</subparagraph><subparagraph id="HEA820253DED84D0BA989DD945086EA09"><enum>(E)</enum><text>illness;</text>
								</subparagraph><subparagraph id="H866B49CEE62645E18E896C4734474B51"><enum>(F)</enum><text>short-term loss or
				impairment of the function of a bodily member, organ, or mental faculty;
				or</text>
								</subparagraph><subparagraph id="H902BEFCBE49442DDABB53E640889DF8F"><enum>(G)</enum><text>any other
				significant injury to the body.</text>
								</subparagraph></paragraph></subsection><subsection id="HD51550A5E62B4A1699B13B00A00400A3"><enum>(e)</enum><header>Rules of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed—</text>
							<paragraph id="H8CA698FC98F14EDA95FE453299001FAF"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit any expressive conduct
				(including peaceful picketing or other peaceful demonstration) protected from
				legal prohibition by the First Amendment to the Constitution;</text>
							</paragraph><paragraph id="HA365E9175435422C8DECAAEDAEB7817"><enum>(2)</enum><text display-inline="yes-display-inline">to create new remedies for interference
				with activities protected by the free speech or free exercise clauses of the
				First Amendment to the Constitution, regardless of the point of view expressed,
				or to limit any existing legal remedies for such interference; or</text>
							</paragraph><paragraph id="HB4C2C92EA04A4FC3B880E54B8F40C163"><enum>(3)</enum><text display-inline="yes-display-inline">to provide exclusive criminal penalties or
				civil remedies with respect to the conduct prohibited by this action, or to
				preempt State or local laws that may provide such penalties or
				remedies.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7186F3CE49BB4AA592D6ACC2BF7292F5"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The item relating to section 43 in the table of
			 sections at the beginning of chapter 3 of title 18, United States Code, is
			 amended to read as follows:</text>

			</subsection><subsection id="H451EEE8022DE4BFE90EF35027804CFB9"><enum>(c)</enum><header>Amendments
			 relating to substantial bodily injury</header>
				<paragraph id="HD5BBB41D4DD545719F75EF63A9D117C6"><enum>(1)</enum><text>Section 2118 of
			 title 18, United States Code, is amended by striking <quote>significant</quote>
			 each place it appears other than in subsection (e) and inserting
			 <quote>serious</quote>.</text>
				</paragraph><paragraph id="HD67BFC1827584FC6B553199FC0A92139"><enum>(2)</enum><text>Section 2118(e) of
			 title 18, United States Code, is amended—</text>
					<subparagraph id="H819049731AE14EB6BBE6398900879E75"><enum>(A)</enum><text>by striking
			 <quote>significant</quote> the first place it appears and inserting
			 <quote>serious</quote>;</text>
					</subparagraph><subparagraph id="H6C930A421AB74273A7C3D36500EFEBE3"><enum>(B)</enum><text>by inserting
			 <quote>substantial</quote> before <quote>risk of death</quote>; and</text>
					</subparagraph><subparagraph id="H92F5CB7776684FA39F2EBAAA3E45CA9D"><enum>(C)</enum><text>by striking
			 <quote>significant physical pain</quote> and inserting <quote>extreme physical
			 pain</quote>.</text>
					</subparagraph></paragraph><paragraph id="HBD43A63631624969AB65CBD8BA96F83"><enum>(3)</enum><text>Section 113(b)(1)
			 of title 18, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H1C8B3845B12E47A4A887CE284048E88" style="USC">
						<paragraph id="HB97304DD7A2E4C0A8D118D000264B7F1"><enum>(1)</enum><text>the term
				<quote>substantial bodily injury</quote> means—</text>

				serious burns or abrasions;</text>
							</subparagraph><subparagraph id="H76B865290E274232B5FCE7EDE912AB40"><enum>(B)</enum><text>short-term or
				nonobvious disfigurement;</text>
							</subparagraph><subparagraph id="HCDB205B010B141DF8E3CF75F5D854E5"><enum>(C)</enum><text>fractured or
				dislocated bones, or torn members of the body;</text>

				physical pain;</text>

				impairment of the function of a bodily member, organ, or mental faculty;

							</subparagraph><subparagraph id="H1DE7FDC367554EFC9BE809AB4697BA9D"><enum>(G)</enum><text>any other
				significant injury to the body;
				and</text>
