            Damage, and for other purposes.</official-title></form><legis-body style="OLC" id="IDB19EE25F4800429C97DBA45A885936DE"><section section-type="section-one" id="ID3100981FC44646188155E1157D31FCE0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
                        <quote><short-title>Convention on Supplementary Compensation for Nuclear
                        Damage Contingent Cost Allocation Act</short-title></quote>.</text></section><section id="IDD283C927A3C54ED78B60F453E1358C95"><enum>2.</enum><header>Findings and purpose</header><subsection id="ID96DF4A237E6A4435845E6DF50E9817B4"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="IDC829CCC61D5B4BA1866754BF94399220"><enum>(1)</enum><text>section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2210) (commonly known as the
                            <quote>Price-Anderson Act</quote>)—</text><subparagraph id="IDF0AA133B3FA84120AF673536C61CF7E0"><enum>(A)</enum><text>provides a predictable legal framework necessary for nuclear projects;
                            and</text></subparagraph><subparagraph id="ID97C83231BEDC4A01842182DC42812EEF"><enum>(B)</enum><text>ensures prompt and equitable compensation in the event of a nuclear
                            incident in the United States;</text></subparagraph></paragraph><paragraph id="IDF176A5C443D3464E837972441519F83A"><enum>(2)</enum><text>section 170 of that Act, in effect, provides operators of nuclear
                        powerplants with insurance for damage arising out of a nuclear incident and
                        funds the insurance primarily through the assessment of a retrospective
                        premium from each operator after the occurrence of a nuclear
                        incident;</text></paragraph><paragraph id="ID881A5305431347258A2BAF69A5887BE6"><enum>(3)</enum><text>the Convention on Supplementary Compensation for Nuclear Damage, done at
                        Vienna on September 12, 1997, will establish a global system—</text><subparagraph id="IDF99796AEDB204F77BA49C9B9CFECC619"><enum>(A)</enum><text>to provide a predictable legal framework necessary for nuclear energy
                            projects; and</text></subparagraph><subparagraph id="ID19BB77EC97154C37A54A4C17BEBCD1BC"><enum>(B)</enum><text>to ensure prompt and equitable compensation in the event of a nuclear
                            incident;</text></subparagraph></paragraph><paragraph id="ID657670217E614F1A8C6BD95DD3AAD4F8"><enum>(4)</enum><text>the Convention benefits United States nuclear suppliers that face
                        potentially unlimited liability for a nuclear incidents outside the coverage
                        of section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2210) by replacing a potentially open-ended
                        liability with a predictable liability regime that, in effect, provides
                        nuclear suppliers with insurance for damage arising out of such an
                        incident;</text></paragraph><paragraph id="ID046F89BAAC1A408DA11A0A7759334112"><enum>(5)</enum><text>the Convention also benefits United States nuclear facility operators that
                        may be publicly liable for a Price-Anderson incident by providing an
                        additional early source for a Price-Anderson incident by providing an
                        additional early source of funds to compensate damage arising out of the
                        Price-Anderson incident;</text></paragraph><paragraph id="IDD18FE5D205BF4440A26C21B25E895103"><enum>(6)</enum><text>the combined operation of the Convention, section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C.
                        2210), and this Act will augment the quantity of assured funds available for
                        victims in a wider variety of nuclear incidents while reducing the potential
                        liability of United States suppliers without increasing potential costs to
                        United States operators;</text></paragraph><paragraph id="IDA73AD116FF2E4809A0A25F947248A207"><enum>(7)</enum><text>the cost of those benefits is the obligation of the United States to
                        contribute to the supplementary compensation fund established by the
                        Convention;</text></paragraph><paragraph id="IDA79B5E33641548B39D5D06750BA90381"><enum>(8)</enum><text>any such contribution should be funded in a manner that neither upsets
                        settled expectations based on the liability regime established under section
                        170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2210) nor shifts to Federal taxpayers
                        liability risks for nuclear incidents at foreign installations;</text></paragraph><paragraph id="IDD540E1F4EBDB4867A64A379F9B97966C"><enum>(9)</enum><text>with respect to a Price-Anderson incident, funds already available under
                        section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2210) should be used; and</text></paragraph><paragraph id="ID4B262A6F483844CCBB088409AD81E9C2"><enum>(10)</enum><text>with respect to a nuclear incident outside the United States not covered
                        by section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2210), a retrospective premium should be
                        prorated among nuclear suppliers relieved from potential liability for which
                        insurance is not available.</text></paragraph></subsection><subsection id="IDA10AE334D53C46C08A110120DABA1CC3"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to allocate the contingent costs associated with
                    participation by the United States in the international nuclear liability
                    compensation system established by the Convention on Supplementary Compensation
                    for Nuclear Damage, done at Vienna on September 12, 1997—</text><paragraph id="IDCD1390F2FB5245FCABB42EB792A8B602"><enum>(1)</enum><text>with respect to a Price-Anderson incident, by using funds made available
                        under section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act
                            of 1954</act-name> (42 U.S.C. 2210) to cover the contingent costs in a
                        manner that neither increases the burdens nor decreases the benefits under
                        section 170 of that Act; and</text></paragraph><paragraph id="IDAD3CF1949BDE4183A549984299EBBD94"><enum>(2)</enum><text>with respect to a covered incident outside the United States that is not a
                        Price-Anderson incident, by allocating the contingent costs equitably, on
                        the basis of risk, among the class of nuclear suppliers relieved by the
                        Convention from the risk of potential liability resulting from any covered
                        incident outside the United States.</text></paragraph></subsection></section><section id="ID0C3F816617784CB2ACA6BFF36534D779"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ID17596126A818446EA19F762EC19AEC60"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory
                    Commission.</text></paragraph><paragraph id="IDEC3DB44D7E8B4581B5F7AC1085C465B0"><enum>(2)</enum><header>Contingent cost</header><text>The term <term>contingent cost</term> means the cost to the United States in
                    the event of a covered incident the amount of which is equal to the amount of
                    funds the United States is obligated to make available under paragraph 1(b) of
                    Article III of the Convention.</text></paragraph><paragraph id="IDD8FEB4D94B434C6B90C58D331AB9D6D9"><enum>(3)</enum><header>Convention</header><text>The term <term>Convention</term> means the Convention on Supplementary
                    Compensation for Nuclear Damage, done at Vienna on September 12, 1997.</text></paragraph><paragraph id="ID7FE943F92A244E0F83603E46096CC52A"><enum>(4)</enum><header>Covered incident</header><text>The term <term>covered incident</term> means a nuclear incident the occurrence
                    of which results in a request for funds pursuant to Article VII of the
                    Convention.</text></paragraph><paragraph id="ID28C070FB811D4A5F9376245E81D8A9FF"><enum>(5)</enum><header>Covered installation</header><text>The term <term>covered installation</term> means a nuclear installation at
                    which the occurrence of a nuclear incident could result in a request for funds
                    under Article VII of the Convention.</text></paragraph><paragraph id="IDB37200C4C4584E3D9EAB65C7DFD24F85"><enum>(6)</enum><header>Covered person</header><subparagraph id="IDC257FAAF549F43CD8D43EA0AE8431381"><enum>(A)</enum><header>In general</header><text>The term <term>covered person</term> means—</text><clause id="IDFD5D452CD9F946869D15FDABF9659B20"><enum>(i)</enum><text>a United States person; and</text></clause><clause id="ID17D7258D2DF54945B2A4933F37BE0DC3"><enum>(ii)</enum><text>an individual or entity (including an agency or instrumentality of a
                            foreign country) that—</text><subclause id="IDC67012D8FE7F4D3EAA1D70D5CF383CFB"><enum>(I)</enum><text>is located in the United States; or</text></subclause><subclause id="IDD33984AC084C4553AB7341676EDD888A"><enum>(II)</enum><text>carries out an activity in the United States.</text></subclause></clause></subparagraph><subparagraph id="ID8662C7080C794A11B998170F7E27FEBD"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered person</term> does not include—</text><clause id="ID1F2F67A6399E43B9BD6E70633232E5D6"><enum>(i)</enum><text>the United States; or</text></clause><clause id="ID807FD233221342D180E4DB9962F9A7FE"><enum>(ii)</enum><text>any agency or instrumentality of the United States.</text></clause></subparagraph></paragraph><paragraph id="ID2E521918855F4966A53157031BE45718"><enum>(7)</enum><header>Nuclear supplier</header><text>The term <term>nuclear supplier</term> means a covered person (or a successor
                    in interest of a covered person) that—</text><subparagraph id="IDE6F352E571774792A954464FBF82FB52"><enum>(A)</enum><text>supplies facilities, equipment, fuel, services, or technology pertaining
                        to the design, construction, operation, or decommissioning of a covered
                        installation; or</text></subparagraph><subparagraph id="ID1F08ED2EE5E44EA2A6434270110DEC04"><enum>(B)</enum><text>transports nuclear materials that could result in a covered
                        incident.</text></subparagraph></paragraph><paragraph id="ID745475E871D44A2FBF6B3EAA323C8347"><enum>(8)</enum><header>Price-anderson incident</header><text>The term <term>Price-Anderson incident</term> means a covered incident for
                    which section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                        1954</act-name> (42 U.S.C. 2210) would make funds available to compensate
                    for public liability (as defined in section 11 of that Act (42 U.S.C.
                    2014)).</text></paragraph><paragraph id="IDE7B914263867482BB68DE8B0B765B6AC"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="IDEC99C1689B6448D1A93CB5D7858F1833"><enum>(10)</enum><header>United states</header><subparagraph id="ID2C5318CD5C754CB790EA511FBE88B19D"><enum>(A)</enum><header>In general</header><text>The term <term>United States</term> has the meaning given the term in
                        section 11 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                            1954</act-name> (42 U.S.C. 2014).</text></subparagraph><subparagraph id="ID4A600C9532334132A373C545DEB8D6D4"><enum>(B)</enum><header>Inclusions</header><text>The term <term>United States</term> includes—</text><clause id="IDD567668971C24A22A1F5569AAAC43812"><enum>(i)</enum><text>the Commonwealth of Puerto Rico;</text></clause><clause id="ID22352D61CA0F40A78CC401965B75727C"><enum>(ii)</enum><text>any other territory or possession of the United States;</text></clause><clause id="ID41C7022A41F7409D984C499AE94D24AD"><enum>(iii)</enum><text>the Canal Zone; and</text></clause><clause id="ID143537D68F964907BA8E6C206E46A311"><enum>(iv)</enum><text>the waters of the United States territorial sea under Presidential
                            Proclamation Number 5928, dated December 27, 1988 (43 U.S.C. 1331
                            note).</text></clause></subparagraph></paragraph><paragraph id="ID7D469D7049914C5BAE3AEDFB12D3E455"><enum>(11)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="ID1C4A0ECBFA174CABB974146353AA4E45"><enum>(A)</enum><text>any individual who is a resident, national, or citizen of the United
                        States (other than an individual residing outside of the United States and
                        employed by a person who is not a United States person); and</text></subparagraph><subparagraph id="IDCD2E3EEE3865407D95B58C4AF77CC057"><enum>(B)</enum><text>any corporation, partnership, association, joint stock company, business
                        trust, unincorporated organization, or sole proprietorship that is organized
                        under the laws of the United States.</text></subparagraph></paragraph></section><section id="ID47FB613CC1A94704A40790513011D731"><enum>4.</enum><header>Use of price-anderson funds</header><subsection id="ID025CD4858C4F4A9498F0EDA3A85B6C75"><enum>(a)</enum><header>In general</header><text>Funds made available under section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C. 2210) shall be used to
                    cover the contingent cost resulting from any Price-Anderson incident.</text></subsection><subsection id="IDB66A1A08D10B4B0D93C91757E489930E"><enum>(b)</enum><header>Effect</header><text>The use of funds pursuant to subsection (a) shall not reduce the limitation on
                    public liability established under section 170 e. of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C.
                    2210(e)).</text></subsection></section><section id="ID0523E0700C81482392B3F60C7842D2DB"><enum>5.</enum><header>Effect on amount of public liability</header><subsection id="IDFFABAEC598234E49A60DF18E132C78AE"><enum>(a)</enum><header>In general</header><text>Funds made available to the United States under Article VII of the Convention
                    with respect to a Price-Anderson incident shall be used to satisfy public
                    liability resulting from the Price-Anderson incident.</text></subsection><subsection id="ID0550C4278D154971B0F663F041374D2C"><enum>(b)</enum><header>Amount</header><text>The amount of public liability allowable under section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C. 2210)
                    relating to a Price-Anderson incident under subsection (a) shall be increased by
                    an amount equal to the difference between—</text><paragraph id="ID9A6708525BBB4E5588E5D26035238E93"><enum>(1)</enum><text>the amount of funds made available for the Price-Anderson incident under
                        Article VII of the Convention; and</text></paragraph><paragraph id="ID48F9B70D1FF346F1AEF05269951C93D3"><enum>(2)</enum><text>the amount of funds used under section 4 to cover the contingent cost
                        resulting from the Price-Anderson incident.</text></paragraph></subsection></section><section id="ID333CDA3BC3C64AD0BB6A03715423A607"><enum>6.</enum><header>Retrospective risk pooling program</header><subsection id="ID47877D78E00E442D8790C4114425D5F1"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), each nuclear supplier shall participate
                    in a retrospective risk pooling program in accordance with this Act to cover the
                    contingent cost resulting from a covered incident outside the United States that
                    is not a Price-Anderson incident.</text></subsection><subsection id="ID9B823A225E884044B0E902DC96DCAB60"><enum>(b)</enum><header>Deferred payment</header><paragraph id="ID4DF5CC6F029349B18C41920A6779FCF5"><enum>(1)</enum><header>In general</header><text>The obligation of a nuclear supplier to participate in the retrospective
                        risk pooling program shall be deferred until the United States is called on
                        to provide funds pursuant to Article VII of the Convention with respect to a
                        covered incident that is not a Price-Anderson incident.</text></paragraph><paragraph id="IDF69C9A07E70144FF850E9C27FCE1E5A4"><enum>(2)</enum><header>Amount of deferred payment</header><text>The amount of a deferred payment of a nuclear supplier under paragraph (1)
                        shall be based on the risk-informed assessment formula determined under
                        paragraph (3).</text></paragraph><paragraph id="IDC50F0BF610FD4BE99E4903BBAB5B8ED6"><enum>(3)</enum><header>Risk-informed assessment formula</header><subparagraph id="IDBF3D29D7D1A044A19E79476655D8B3D3"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, and
                            every 5 years thereafter, the Secretary shall, by regulation, determine
                            the risk-informed assessment formula for the allocation among nuclear
                            suppliers of the contingent cost resulting from a covered incident that
                            is not a Price-Anderson incident, taking into account risk factors such
                            as—</text><clause id="IDA1832373F9D5446ABAFE944183165995"><enum>(i)</enum><text>the nature and intended purpose of the goods and services supplied
                                by each nuclear supplier to each covered installation outside the
                                United States;</text></clause><clause id="ID8FCA98DE8A364CE79A3BC4AC6E15FA05"><enum>(ii)</enum><text>the quantity of the goods and services supplied by each nuclear
                                supplier to each covered installation outside the United
                                States;</text></clause><clause id="IDD811B0DB5C904306BE71D6F8E302E918"><enum>(iii)</enum><text>the hazards associated with the supplied goods and services if the
                                goods and services fail to achieve the intended purposes;</text></clause><clause id="IDFCFF59B150394489A3A9C94F04E2071C"><enum>(iv)</enum><text>the hazards associated with the covered installation outside the
                                United States to which the goods and services are supplied;</text></clause><clause id="IDFA6E1B1F41E34EC08CF1AAE41B32AF5F"><enum>(v)</enum><text>the legal, regulatory, and financial infrastructure associated
                                with the covered installation outside the United States to which the
                                goods and services are supplied; and</text></clause><clause id="ID0F125DE16E8E447FAB25BB25D0C56DCC"><enum>(vi)</enum><text>the hazards associated with particular forms of
                                transportation.</text></clause></subparagraph><subparagraph id="ID66EFCBCD3BAE4EC08B8F407A41B45D74"><enum>(B)</enum><header>Factors for consideration</header><text>In determining the formula, the Secretary may—</text><clause id="ID82F98CFB7DC64389BC2F4CE7532F4385"><enum>(i)</enum><text>exclude—</text><subclause id="ID9301203F27AC44A3ACF8E82BD8A52CF9"><enum>(I)</enum><text>goods and services with negligible risk;</text></subclause><subclause id="IDEA2C4E5D88324D2C95AE05D15B6C6D59"><enum>(II)</enum><text>classes of goods and services not intended specifically for
                                    use in a nuclear installation;</text></subclause><subclause id="ID6C5BD1A9059B4A5AABF7D81B7614950E"><enum>(III)</enum><text>a nuclear supplier with a de minimis share of the contingent
                                    cost; and</text></subclause><subclause id="ID1398007DE13549C2868F290C6D6977D1"><enum>(IV)</enum><text>a nuclear supplier no longer in existence for which there is
                                    no identifiable successor; and</text></subclause></clause><clause id="ID36904C86836B4964A764C6CE7FCCD46D"><enum>(ii)</enum><text>establish the period on which the risk assessment is based.</text></clause></subparagraph><subparagraph id="ID665621A544564216B8F0B71CFE8AB05D"><enum>(C)</enum><header>Application</header><text>In applying the formula, the Secretary shall not consider any covered
                            installation or transportation for which funds would be available under
                            section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of
                                1954</act-name> (42 U.S.C. 2210).</text></subparagraph><subparagraph id="IDC27E4473FFC2443EBABC433F65A5E7E1"><enum>(D)</enum><header>Report</header><text>Not later than 5 years after the date of enactment of this Act and every 5 years thereafter, the
                            Secretary shall submit to the Committee on Environment and Public Works
                            of the Senate and the Committee on Energy and Commerce of the House of
                            Representatives a report on whether there is a need for continuation or
                            amendment of this Act, taking into account the effects of the
                            implementation of the Convention on the United States nuclear industry
                            and suppliers.</text></subparagraph></paragraph></subsection></section><section id="ID39A44D264EF146088D151D208AC98C00"><enum>7.</enum><header>Reporting</header><subsection id="ID7A002F8B8C714A0585D767F13E852800"><enum>(a)</enum><header>Collection of information</header><paragraph id="ID966EFAE7010242139DA5BD9B8326A784"><enum>(1)</enum><header>In general</header><text>The Secretary may collect information necessary for developing and
                        implementing the formula for calculating the deferred payment of a nuclear
                        supplier under section 6(b).</text></paragraph><paragraph id="ID4CA50C4A8E06454385875E76BD647963"><enum>(2)</enum><header>Provision of information</header><text>Each nuclear supplier and other appropriate persons shall make available
                        to the Secretary such information, reports, records, documents, and other
                        data as the Secretary determines, by regulation, to be necessary or
                        appropriate to develop and implement the formula under section
                        6(b)(3).</text></paragraph></subsection><subsection id="IDFAE637BD28734E168022FF6E12720B27"><enum>(b)</enum><header>Private insurance</header><text>The Secretary shall make available to nuclear suppliers, and insurers of
                    nuclear suppliers, information to support the voluntary establishment and
                    maintenance of private insurance against any risk for which nuclear suppliers
                    may be required to pay deferred payments under this Act.</text></subsection></section><section id="ID1AB6156E7185467E96511D43BC322357"><enum>8.</enum><header>Effect on liability</header><text display-inline="no-display-inline">Nothing in any other law (including
                regulations) limits liability for a covered incident to an amount equal to less than
                the amount prescribed in paragraph 1(a) of Article IV of the Convention, unless the
                law—</text><paragraph id="IDE39C065939DC4222ABC42A52EFD281CF"><enum>(1)</enum><text>specifically refers to this Act; and</text></paragraph><paragraph id="ID502740091F9A4FDD9D183CA775666C6E"><enum>(2)</enum><text>explicitly repeals, alters, amends, modifies, impairs, displaces, or
                    supersedes the effect of this section.</text></paragraph></section><section id="ID87A5CA66B3AA42F6A1B86358B223C983"><enum>9.</enum><header>Payments to and by the united states</header><subsection id="IDC6CF1B26681844F8A53E112B8254F304"><enum>(a)</enum><header>Action by nuclear suppliers</header><paragraph id="ID0557E9DD1D384AE1B25D12A2BDF8BB6A"><enum>(1)</enum><header>Notification</header><text>In the case of a request for funds under Article VII of the Convention
                        resulting from a covered incident that is not a Price-Anderson incident, the
                        Secretary shall notify each nuclear supplier of the amount of the deferred
                        payment required to be made by the nuclear supplier.</text></paragraph><paragraph id="IDE4593443BDD24A728561407997511E4F"><enum>(2)</enum><header>Payments</header><subparagraph id="ID1CC07E7F206E40FE800820F6B0510404"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), not later than 60 days after
                            receipt of a notification under paragraph (1), a nuclear supplier shall
                            pay to the general fund of the Treasury the deferred payment of the
                            nuclear supplier required under paragraph (1).</text></subparagraph><subparagraph id="IDA1605F1C2EE945C9A383A4B5004B0ECB"><enum>(B)</enum><header>Annual payments</header><text>A nuclear supplier may elect to prorate payment of the deferred
                            payment required under paragraph (1) in 5 equal annual payments
                            (including interest on the unpaid balance at the prime rate prevailing
                            at the time the first payment is due).</text></subparagraph></paragraph><paragraph id="ID75DA86C4E2F14823B887B79686499C1F"><enum>(3)</enum><header>Vouchers</header><text>A nuclear supplier shall submit payment certification vouchers to the
                        Secretary of the Treasury in accordance with section 3325 of title 31,
                        United States Code.</text></paragraph></subsection><subsection id="ID59720F84289D47E8AC1B801AF1E7DE9B"><enum>(b)</enum><header>Use of funds</header><paragraph id="IDA0FC6D4F9E0E4A8797EE3CD7D1B0FF75"><enum>(1)</enum><header>In general</header><text>Amounts paid into the Treasury under subsection (a) shall be available to
                        the Secretary of the Treasury, without further appropriation and without
                        fiscal year limitation, for the purpose of making the contributions of
                        public funds required to be made by the United States under the
                        Convention.</text></paragraph><paragraph id="IDE11F12E754074D24AA5DD0010E4FFF8D"><enum>(2)</enum><header>Action by secretary of treasury</header><text>The Secretary of the Treasury shall pay the contribution required under
                        the Convention to the court of competent jurisdiction under Article XIII of
                        the Convention with respect to the applicable covered incident.</text></paragraph></subsection><subsection id="IDEB8EC95E2F7D4A4685280084933A7BAA"><enum>(c)</enum><header>Failure To pay</header><text>If a nuclear supplier fails to make a payment required under this section, the
                    Secretary may take appropriate action to recover from the nuclear
                    supplier—</text><paragraph id="ID34E0CCFAE841455E916306A6F4CE753E"><enum>(1)</enum><text>the amount of the payment due from the nuclear supplier;</text></paragraph><paragraph id="ID2690725DEABC445F8973008521E1FB70"><enum>(2)</enum><text>any applicable interest on the payment; and</text></paragraph><paragraph id="ID3D49BCE4B2A84AE3956866C02B188530"><enum>(3)</enum><text>a penalty of not more than twice the amount of the deferred payment due
                        from the nuclear supplier.</text></paragraph></subsection></section><section id="ID393679AAABFD4C9D8D086F74A86DB1AE"><enum>10.</enum><header>Limitation on judicial review; cause of action</header><subsection id="IDAF67552CE183436B9AFCA4FDBA358ECF"><enum>(a)</enum><header>Limitation on judicial review</header><paragraph id="ID5EC6677B4538474294ACC849E9064807"><enum>(1)</enum><header>In general</header><text>In any civil action arising under the Convention over which Article XIII
                        of the Convention grants jurisdiction to the courts of the United States,
                        any appeal or review by writ of mandamus or otherwise with respect to a
                        nuclear incident that is not a Price-Anderson incident shall be in
                        accordance with chapter 83 of title 28, United States Code, except that the
                        appeal or review shall occur in the United States Court of Appeals for the
                        District of Columbia Circuit.</text></paragraph><paragraph id="ID787E35A62E044536B0CF6FF585EB965A"><enum>(2)</enum><header>Supreme court jurisdiction</header><text>Nothing in this subsection affects the jurisdiction of the Supreme Court
                        of the United States under chapter 81 of title 28, United States
                        Code.</text></paragraph></subsection><subsection id="ID176D5FADCB5D45AEAB23D9FFFEA306B4"><enum>(b)</enum><header>Cause of action</header><paragraph id="ID05FEC6EF2D14459789CFB099C70E99CD"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), in any civil action arising under the Convention
                        over which Article XIII of the Convention grants jurisdiction to the courts
                        of the United States, in addition to any other cause of action that may
                        exist, an individual or entity shall have a cause of action against the
                        operator to recover for nuclear damage suffered by the individual or
                        entity.</text></paragraph><paragraph id="ID789F28264E7348E7AC1AC981958A0907"><enum>(2)</enum><header>Requirement</header><text>Paragraph (1) shall apply only if the individual or entity seeks a remedy
                        for nuclear damage (as defined in Article I of the Convention) that was
                        caused by a nuclear incident (as defined in Article I of the Convention)
                        that is not a Price-Anderson incident.</text></paragraph><paragraph id="ID7BFBEBADADB54AE3B2F91A2C576E7362"><enum>(3)</enum><header>Effect of subsection</header><text>Nothing in this subsection limits, modifies, extinguishes, or otherwise
                        affects any cause of action that would have existed in the absence of
                        enactment of this subsection.</text></paragraph></subsection></section><section id="ID523DA87D96A64F85BF3107B535ED675B"><enum>11.</enum><header>Right of recourse</header><text display-inline="no-display-inline">This Act does not provide to an operator of a
                covered installation any right of recourse under the Convention.</text></section><section id="ID92B7C616BBCA4D919808C46952144ED6"><enum>12.</enum><header>Protection of sensitive united states information</header><text display-inline="no-display-inline">Nothing in the Convention or this Act requires
                the disclosure of—</text><paragraph id="IDFBD4E787A9394F1D891B898CDA61B857"><enum>(1)</enum><text>any data that, at any time, was Restricted Data (as defined in section 11 of
                    the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42
                    U.S.C. 2014));</text></paragraph><paragraph id="IDE90E7EEF47714C97AA8BE8A7C94A9F37"><enum>(2)</enum><text>information relating to intelligence sources or methods protected by section
                    102A(i) of the National Security Act of 1947 (50 U.S.C. 403–1(i)); or</text></paragraph><paragraph id="ID257BA41A439A45A1B6E2798B2FA347A6"><enum>(3)</enum><text>national security information classified under Executive Order 12958 (50
                    U.S.C. 435 note; relating to classified national security information) (or a
                    successor regulation).</text></paragraph></section><section id="ID1628CA0BE75E4CA0BBF222825332BA1B"><enum>13.</enum><header>Regulations</header><subsection id="IDC32CCF14B2D2473D88BB7CDAA9C209AF"><enum>(a)</enum><header>In general</header><text>The Secretary or the Commission, as appropriate, may prescribe regulations to
                    carry out section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act
                        of 1954</act-name> (42 U.S.C. 2210) and this Act.</text></subsection><subsection id="IDA7375ECDA3BB4116BDF48CE4B3CBD4AA"><enum>(b)</enum><header>Requirement</header><text>Rules prescribed under this section shall ensure, to the maximum extent
                    practicable, that—</text><paragraph id="ID0DCB4A8FA7EE458BB9711353033C167C"><enum>(1)</enum><text>the implementation of section 170 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C. 2210) and this Act is
                        consistent and equitable; and</text></paragraph><paragraph id="ID39670930FA894A85982E002F1EA2FA84"><enum>(2)</enum><text>the financial and operational burden on a Commission licensee in complying
                        with section 170 of that Act is not greater as a result of the enactment of
                        this Act.</text></paragraph></subsection><subsection id="ID253B3F9C895F440CB353DE7588EEEEB1"><enum>(c)</enum><header>Applicability of provision</header><text>Section 553 of title 5, United States Code, shall apply with respect to the
                    promulgation of regulations under this section.</text></subsection><subsection id="ID5D867644EC2641B09EA8C6A92C311ED7"><enum>(d)</enum><header>Effect of section</header><text>The authority provided under this section is in addition to, and does not
                    impair or otherwise affect, any other authority of the Secretary or the
                    Commission to prescribe regulations.</text></subsection></section><section id="ID177D2C95207842F58AC2E956DAB474B9"><enum>14.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act takes effect on the date on which the
                Convention enters into force for the United States under Article XX of the
