		<official-title>To amend the Animal Health Protection Act to prohibit the
		  Secretary of Agriculture from implementing or carrying out a National Animal
		  Identification System or similar requirement, to prohibit the use of Federal
		  funds to carry out such a requirement, and to require the Secretary to protect
		  information obtained as part of any voluntary animal identification
		  system.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Prohibition on mandatory
			 animal identification program</header><text display-inline="no-display-inline">Section 10409 of the Animal Health
			 Protection Act (7 U.S.C. 8308) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idB382686CE82448BEB5C266CA7C5F4219" style="OLC">
				<subsection id="id927A3A41CF134EF8BDCDE9C878A51E05"><enum>(c)</enum><header>Prohibition on
				mandatory animal identification program</header><text>Notwithstanding any other
				provision of law, the Secretary shall not implement or carry out, and no
				Federal funds shall be used to implement or carry out, a National Animal
				Identification System, or similar requirement, that mandates the participation
				of livestock
				owners.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id5BA6C79D030E4385B5516A9BBF4D2CE1"><enum>2.</enum><header>Protection of
			 information in a voluntary animal identification system</header><text display-inline="no-display-inline">Section 10409 of the Animal Health
			 Protection Act (7 U.S.C. 8308) (as amended by section 1) is amended by adding
			 at the end the following:</text>

				<subsection id="id05AF7E2E09724E1EB61E662EF8FEEB42"><enum>(d)</enum><header>Protection of
				information in a voluntary animal identification system</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idFCD2D0FEAA404963A393C3EE3DDB05DB"><enum>(1)</enum><header>Definition of
				animal identification system</header><text>In this subsection, the term
				<term>animal identification system</term> means a voluntary system for
				identifying or tracing animals that is established by the Secretary.</text>
					</paragraph><paragraph id="id9789FDE1400F4572B8333093717609F7"><enum>(2)</enum><header>Protection from
				disclosure</header>
						<subparagraph id="id0B096EE0A9FC4D3DA54280381D5221AA"><enum>(A)</enum><header>In
				general</header><text>Information obtained through the animal identification
				system shall not be disclosed except as provided in this subsection.</text>
						</subparagraph><subparagraph id="id3D9E86A18646442F8EDD22322D331B4E"><enum>(B)</enum><header>Waiver of
				privilege or protection</header><text>The provision of information to the
				animal identification system and the disclosure of information in accordance
				with this subsection shall not constitute a waiver of any applicable privilege
				or protection under Federal law, including trade secret protection.</text>
						</subparagraph></paragraph><paragraph id="idB05EF79DB8A84BBD909AAF88455C25D6"><enum>(3)</enum><header>Limited release
				of information</header><text>The Secretary may disclose information obtained
				through the animal identification system if—</text>
						<subparagraph id="id7DCE99D39E4C4D20A1B3CACB01AAA01E"><enum>(A)</enum><text>the Secretary
				determines that livestock may be threatened by a disease or pest;</text>
						</subparagraph><subparagraph id="id0BDE789C65F745FBB77BF5AB327A0760"><enum>(B)</enum><text>the release of
				the information is related to actions the Secretary is authorized to take under
				this subtitle; and</text>
						</subparagraph><subparagraph id="idDCAEEAC0EC3A4D788195E5333D0C1BF7"><enum>(C)</enum><text>the Secretary
				determines that the disclosure of the information to a government entity or
				person is necessary to assist the Secretary in carrying out the purposes
				of—</text>
							<clause id="id7C8A0F76BB184F6F8036554500A91DE0"><enum>(i)</enum><text>this subtitle;
				and</text>
							</clause><clause id="id9B8BC691765648A592FDFB7BD871487A"><enum>(ii)</enum><text>the animal
				identification system.</text>
							</clause></subparagraph></paragraph><paragraph id="id67B8CADE826C48279A623CB935140298"><enum>(4)</enum><header>Mandatory
				disclosure of information</header><text>The Secretary shall disclose
				information obtained through the animal identification system regarding
				particular animals to—</text>
						<subparagraph id="id4E4109C8D9724DDEB7310844E3F9F2B3"><enum>(A)</enum><text>the person who
				owns or controls the animals, if the person requests the information in
				writing;</text>
						</subparagraph><subparagraph id="id14F44B2AB613474796722AF0F66C6DCE"><enum>(B)</enum><text>the Attorney
				General for the purpose of law enforcement;</text>
						</subparagraph><subparagraph id="idE5B0E7DC83AE4FDE95907F991B1A8AEC"><enum>(C)</enum><text>the Secretary of
				Homeland Security for the purpose of homeland security;</text>
						</subparagraph><subparagraph id="id1B371CF30BD8405EAC5A76680F75C2BD"><enum>(D)</enum><text>the Secretary of
				Health and Human Services for the purpose of protecting the public
				health;</text>
						</subparagraph><subparagraph id="idDE1A53A95D87407BB4D710805E7B7B09"><enum>(E)</enum><text>an entity
				pursuant to an order of a court of competent jurisdiction; and</text>
						</subparagraph><subparagraph id="id89308F73804F41D0A030D46B3EBABAF6"><enum>(F)</enum><text>the government of
				a foreign country if disclosure of the information is necessary to trace
				animals that pose a disease or pest threat to livestock or a danger to human
				health, as determined by the Secretary.</text>
						</subparagraph></paragraph><paragraph id="idE9E1B78E3E7E46EF82107E4451CC5E21"><enum>(5)</enum><header>Prohibition on
				disclosure under State or local law</header><text>Any information relating to
				animal identification that a State or local government obtains from the
				Secretary shall not be made available by the State or local government pursuant
				to State or local law requiring disclosure of information or records to the
				public.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
