2.Congress finds that—
(1)long before the
arrival of Lewis and Clark, Native Americans in the Oregon country lived amid
the wild splendor of the Cascade Mountains and the Columbia River, where the
waters teemed with fish, game roamed the forests, and fruits and berries were
abundant;
(2)the Native
Americans arrived in this bountiful land from Asia by way of the Bering Sea and
inhabited the land in and around Mount Hood and the Columbia Gorge;
(3)some of the
tribes along the Columbia River were part of the Chinook family;
(4)many of the
people of the tribes—
(A)used canoes made
from cedar logs;
(B)were expert
fisherman;
(C)told fire legends
about the mid-Columbia volcanic peaks that featured warrior heroes, fair
ladies, and numerous gods; and
(D)Mount Hood as
Wy’East, the warrior whose passionate love caused the region to be transformed
as he hurled powerful volcanic fire in his quest for the love of the gentle
maiden Loo-wit, known today as Mount St. Helens;
(5)traveling down
the Columbia River in 1805, the Lewis and Clark Corps of Discovery expedition
was awed by the unspoiled scenic splendors of the Cascade Mountains and the
Columbia River Gorge cutting through the mountain rampart;
(6)on October 18,
1805, Clark recorded in his journal: I ascended a high cliff, about 200
feet above the water, from the top of which is a level plain, extending up the
river and off for a great extent. From this place I discovered a mountain of
immense height, covered with snow.
;
(7)following Lewis
and Clark, settlers came to the Oregon territory by way of the Oregon Trail,
transforming more accessible portions of the wild landscape into farms,
orchards, and small communities using the old growth forests;
(8)in 1845, Oregon Trail pioneers Samuel K.
Barlow and Joel Palmer and their parties opened the Barlow Trail across Barlow
Pass, high on the south slopes of Mount Hood, with Palmer writing on October
11, 1845: I had never seen a sight so nobly grand.
;
(9)even as the
settlers transformed the wilderness, that frontier land helped develop in the
settlers the characteristics of self-reliance, fortitude, hard work,
independence, and love of the land, which the people of Oregon and the entire
United States cherish to this day and wish to inculcate in their
children;
(10)the unprotected
wilderness that remains in the Mount Hood and Columbia River Gorge region
provides easily accessible outdoor recreation for the descendants of the early
settlers and more recent arrivals;
(11)Mount Hood is
home to the historic Timberline Lodge, which—
(A)is a National
Historic Landmark;
(B)was built as a
project by the Federal Works Progress Administration in 1937; and
(C)was restored to
its former grandeur by the dedication and stewardship of Richard L.
Kohnstamm;
(12)preserving
wilderness assures the integrity of the background and scenic views that enrich
more developed forms of recreational use, including downhill skiing and
roadside enjoyment of sweeping wilderness scenery;
(13)designation as
wilderness provides the strongest congressional protection of scientific,
cultural, educational, environmental, scenic, and recreational values that
contribute long-term quality of life and economic benefits to the people of
Oregon, visitors to Oregon, and local communities in and around the Mount Hood
National Forest, including the wilderness-dependent wildlife, high water
quality, and resident and anadromous fish that thrive in undisturbed
ecosystems;
(14)the Mount Hood
National Forest is the seventh most visited National Forest in the United
States;
(15)wilderness
management is interrelated with and will interface with the established
activities and management of adjacent land, particularly when the land is
high-density recreation land;
(16)Mount Hood
National Forest is predominantly used by the public for mechanized and
non-mechanized activities, such as hiking, camping, and fishing, which
according to the Mount Hood National Forest Management Plan, are projected to
increase dramatically over time;
(17)the Land and
Resource Management Plan for Mount Hood National Forest provides that
the present capability to supply recreational opportunities such as
hiking on trails in primitive and semi-primitive non-motorized areas is
predicted to fall short of satisfying demand
;
(18)according to the
plan described in paragraph (17), the Mount Hood National Forest—
(A)provides
resources for nearly 2 times the current demand for developed recreation such
as skiing, power boating, and sightseeing by car; but
(B)meets less than
2/3 of the demand for back country recreation;
(19)the Management
Plan for Mount Hood National Forest projects that by 2040, the Mount Hood
National Forest will only meet 16 percent of the demand for wilderness
recreation, while meeting more than 100 percent of the demand for mechanized
recreation;
(20)because the
Mount Hood National Forest provides drinking water for more than 16 communities
and over 40 percent of Oregon residents, management of the Mount Hood National
Forest needs to take into consideration plans developed by local watershed
councils in managing the forest; and
(21)the management
of the Mount Hood National Forest should address practical, site-specific
situations in a manner that supports wilderness and the general environmental,
economic, and community-related welfare of the mountain.
3.In this Act:
(1)The term Indian tribe
has the meaning given
the term in section 4 of the Indian Self-Determination and Education Assistance
Act (25 U.S.C. 450b).
(2)The term mountain bike does not include a
motorized vehicle.
(3)The term old growth, with respect to a tree
or grove of trees, means a tree or grove that is—
(A)at last 120 years
old; or
(B)previously
unmanaged.
(4)The
term Secretary means—
(A)when used in
reference to Forest Service land, the Secretary of Agriculture; and
(B)when used in
reference to Bureau of Land Management land, the Secretary of the
Interior.
(5)The
term State means the State of Oregon.
<enum>I</enum><header>Designation of
wilderness areas</header>
<section id="id8819881DFAD74C90A682E804F1F1C726"><enum>101.</enum><header>Findings and
purpose</header>
<subsection id="id60C9444E21B941629A597524D35C4E7C"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
<paragraph id="id0F7639B8DB5B4B0AA5AC80B78EEED108"><enum>(1)</enum><text display-inline="yes-display-inline">the most recent designation of wilderness
in the Mount Hood National Forest occurred in 1984; and</text>
</paragraph><paragraph id="id930791880FD5491DB6C026A5E1EB5A54"><enum>(2)</enum><text>the designation
of an additional 128,400 acres as a wilderness area by this title will increase
the amount of wilderness designated as a wilderness area in the Mount Hood
National Forest by 68 percent.</text>
</paragraph></subsection><subsection id="idDA1E5BEE9F364C89AE22E228ED216D89"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to designate
approximately 128,400 acres of National Forest System land in the Mount Hood
National Forest as a wilderness area.</text>
</subsection></section><section id="IDa0f7a91a2c4544b9897d247662e67aab"><enum>102.</enum><header>Lewis and
Clark Mount Hood wilderness areas</header>
<subsection id="id8EF38A31F66E434BA83EB0CD669D9843"><enum>(a)</enum><header>Designations</header><text display-inline="yes-display-inline">In accordance with the Wilderness Act (16
U.S.C. 1131 et seq.), the following areas in the State are designated as
wilderness areas and as components of the National Wilderness Preservation
System:</text>
<paragraph id="IDab88e1af96dc48c2ab596cae42c481fe"><enum>(1)</enum><header>Badger Creek
Wilderness additions</header><text>Certain Federal land managed by the Forest
Service, comprising approximately 3,700 acres, as generally depicted on the
maps entitled <quote>Badger Creek</quote> and <quote>Bonnie Butte</quote>,
dated September 2006, which are incorporated in, and considered to be a part
of, the Badger Creek Wilderness, as designated by section 3(3) of the Oregon
Wilderness Act of 1984 (16 U.S.C. 1132 note; 98 Stat. 273).</text>
</paragraph><paragraph id="IDdfe3eba12bc943a28194eda0d35a9768"><enum>(2)</enum><header>Bull of the
woods wilderness addition</header><text>Certain Federal land managed by the
Forest Service, comprising approximately 6,870 acres, as generally depicted on
the map entitled <quote>Bull of the Woods</quote>, dated June 2006, which is
incorporated in, and considered to be a part of, the Bull of the Woods
Wilderness, as designated by section 3(4) of the Oregon Wilderness Act of 1984
(16 U.S.C. 1132 note; 98 Stat. 273).</text>
</paragraph><paragraph id="ID6a94ca4b7a564839ab673dab52afe4ec"><enum>(3)</enum><header>Clackamas
wilderness</header><text>Certain Federal land managed by the Forest Service and
Bureau of Land Management, comprising approximately 11,900 acres, as generally
depicted on the maps entitled <quote>Clackamas Canyon</quote>, <quote>Big
Bottom</quote>, <quote>Memaloose Lake</quote>, <quote>South Fork
Clackamas</quote>, <quote>Sisi Butte</quote>, and <quote>Upper Big
Bottom</quote>, dated September 2006, which shall be known as the
<quote>Clackamas Wilderness</quote>.</text>
</paragraph><paragraph id="IDbf8efd8a35bd46678f26e1f55b186dd6"><enum>(4)</enum><header>Lower white
river wilderness</header><text>Certain Federal land managed by the Forest
Service and Bureau of Land Management, comprising approximately 2,850 acres, as
generally depicted on the map entitled <quote>Lower White River</quote>, dated
September 2006, which shall be known as the <quote>Lower White River
Wilderness</quote>.</text>
</paragraph><paragraph id="idC0E139F389144C2AA6A9F1E14FB88E14"><enum>(5)</enum><header>Mark O.
Hatfield Wilderness additions</header><text>Certain Federal land managed by the
Forest Service, comprising approximately 26,000 acres, as generally depicted on
the maps entitled <quote>Gorge Ridgeline</quote> and <quote>Larch
Mountain</quote>, dated September 2006, which shall be known as the <quote>Mark
O. Hatfield Wilderness Additions</quote>.</text>
</paragraph><paragraph id="id1CB79396A96947E3A1DEDCE863E72D91"><enum>(6)</enum><header>Mount hood
wilderness additions</header><text>Certain Federal land managed by the Forest
Service, comprising approximately 21,580 acres, as generally depicted on the
maps entitled <quote>Elk Cove/Mazama Addition</quote>, <quote>Sandy
Additions</quote>, <quote>Tilly Jane</quote>, <quote>Sand Canyon</quote>,
<quote>Lost Lake</quote>, <quote>Twin Lakes</quote>, <quote>Barlow
Butte</quote>, <quote>White River</quote>, and <quote>Richard L. Kohnstamm
Memorial Area</quote>, dated September 2006, which are incorporated in, and
considered to be a part of, the Mount Hood Wilderness as designated under
section 3(a) of the Wilderness Act (16 U.S.C. 1132(a)), and enlarged by section
3(d) of the Endangered American Wilderness Act of 1978 (16 U.S.C. 1132 note; 92
Stat. 43).</text>
</paragraph><paragraph id="IDf5f393dab77440ad9cc6f6c1f52cc79b"><enum>(7)</enum><header>Roaring river
wilderness</header><text>Certain Federal land managed by the Forest Service,
comprising approximately 37,750 acres, as generally depicted on the map
entitled <quote>Roaring River Wilderness</quote>, dated September 2006, which
shall be known as the <quote>Roaring River Wilderness</quote>.</text>
</paragraph><paragraph id="ID2f47d56e79054f69b7792bf21da3d69e"><enum>(8)</enum><header>Salmon-huckleberry
wilderness additions</header><text>Certain Federal land managed by the Forest
Service, comprising approximately 17,720 acres, as generally depicted on the
maps entitled <quote>Alder Creek Addition</quote>, <quote>Eagle Creek
Addition</quote>, <quote>Mirror Lake</quote>, <quote>Inch Creek</quote>,
<quote>Salmon River Meadows</quote>, and <quote>Hunchback Mountain</quote>,
dated September 2006, which are incorporated in, and considered to be a part
of, the Salmon-Huckleberry Wilderness, as designated by section 3(2) of the
Oregon Wilderness Act of 1984 (16 U.S.C. 1132 note; 98 Stat. 273).</text>
</paragraph></subsection><subsection id="id8955503C7B234CB9A54B5DD1F3C87594"><enum>(b)</enum><header>Effect of
designations</header>
<paragraph id="id73CDFE396D8E4134B69DEFF26782B543"><enum>(1)</enum><header>Electric
utilities</header><text>The areas in the State that are designated as
wilderness areas and as components of the National Wilderness Preservation
System under subsection (a) shall not—</text>
<subparagraph id="idC7F49EC6752E4B088B1CDE86EE298FCF"><enum>(A)</enum><text>include any land
that on the date of enactment of this Act is—</text>
<clause id="idC84CB3BB63C4452DB21962804E9E9006"><enum>(i)</enum><text>licensed for a
hydroelectric project by the Federal Energy Regulatory Commission; or</text>
</clause><clause id="id6CE5C86C12E84F22B0DBEFA61D631318"><enum>(ii)</enum><text>located within
200 feet of an electric power line in the White River Unit of the Mount Hood
Wilderness Additions under subsection (a)(6); or</text>
</clause></subparagraph><subparagraph id="id575E12719DDC44C69BD01905066CB0E4"><enum>(B)</enum><text>affect any
activity relating to the operation, maintenance, or construction of a project
described in clause (i) or (ii) of subparagraph (A).</text>
</subparagraph></paragraph><paragraph id="id6E05A4FB705141A88CEF4537D7039C44"><enum>(2)</enum><header>Columbia Gorge
airshed</header><text>The area depicted on the maps entitled <quote>Gorge
Ridgeline Wilderness</quote> and <quote>Large Mountain</quote>, dated September
2006, that is designated as a wilderness area and as a component of the
National Wilderness Preservation System under subsection (a) shall not result
in the designation of a Class I airshed in the Columbia Gorge through Federal
regulatory action.</text>
</paragraph></subsection></section><section id="IDbbbd8f3390094836929993ee8b259f7d"><enum>103.</enum><header>Map and legal
descriptions</header>
<subsection id="ID1b78c8817a1f48d89a299c742b4c0aa6"><enum>(a)</enum><header>In
general</header><text>As soon as practicable after the date of enactment of
this Act, the Secretary shall file a map entitled <quote>Lewis and Clark Mount
Hood Wilderness Additions of 2006</quote>, dated September 2006, and a legal
description of each wilderness area designated by this title, with—</text>
<paragraph id="ID3ce67f21160b4a219fd3e627b3462199"><enum>(1)</enum><text>the Committee on
Energy and Natural Resources of the Senate; and</text>
</paragraph><paragraph id="id6D0081DE6B97400B84E19D35EDDECFD9"><enum>(2)</enum><text>the Committee on
Resources of the House of Representatives.</text>
</paragraph></subsection><subsection id="ID99965d67be9f4411b544878e8cc9433f"><enum>(b)</enum><header>Force of
law</header><text>The map and legal descriptions filed under subsection (a)
shall have the same force and effect as if included in this Act, except that
the Secretary may correct typographical errors in the map and each legal
description.</text>
</subsection><subsection id="IDa1b805c6cbeb4612b5e5c72a52cf8661"><enum>(c)</enum><header>Public
availability</header><text>Each map and legal description filed under
subsection (a) shall be on file and available for public inspection in—</text>
<paragraph id="id6B9A7DD11DE244AFA16C56ADFB63FAD6"><enum>(1)</enum><text>the office of the
Chief of the Forest Service;</text>
</paragraph><paragraph id="id29A53B4570C64FDC8A01BC24D923D3EC"><enum>(2)</enum><text>the office of the
Director of the Bureau of Land Management; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAABDC4DBA5CD49E5879F78EC7B19EDCF"><enum>(3)</enum><text>the applicable
local Forest Service and Bureau of Land Management offices.</text>
</paragraph></subsection></section><section id="ID535b4ef142304f699ee196675488731a"><enum>104.</enum><header>Administration</header>
<subsection id="IDd4dab0a7f55b41448b79c44429175988"><enum>(a)</enum><header>In
general</header><text>Subject to valid rights in existence on the date of
enactment of this Act, each wilderness area designated under this title shall
be administered by the Secretary in accordance with the Wilderness Act (16
U.S.C. 1131 et seq.).</text>
</subsection><subsection id="ID00e3231214f54996a6d6f07c241df41a"><enum>(b)</enum><header>Consistent
interpretation to the public</header><text>Notwithstanding their separate
jurisdictions, the Secretary of Agriculture and the Secretary of the Interior
shall collaborate to ensure that the wilderness areas designated by this title,
if appropriate, are interpreted for the public as an overall complex related
by—</text>
<paragraph id="idCECFCEE62CA740DA8BF51797CB8ECB84"><enum>(1)</enum><text>common location
in the Mount Hood-Columbia River Gorge region;</text>
</paragraph><paragraph id="id408FD09C06A84BAFBE7ADDE15A228DB3"><enum>(2)</enum><text>the abundant
history of Native American use;</text>
</paragraph><paragraph id="id639C4481BD144594B1F7AAD24C2D1E6F"><enum>(3)</enum><text>the epic journey
of Lewis and Clark;</text>
</paragraph><paragraph id="id9C7E7DF3813B431981A35E615BC22A47"><enum>(4)</enum><text>the pioneer
settlement and growth of the State; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id862E5D85C73241E5977F6DFF6BF27CD3"><enum>(5)</enum><text>water sources for
more than 40 percent of the residents of the State.</text>
</paragraph></subsection><subsection id="ID9c8f6224128b459ab4ae21c125d17846"><enum>(c)</enum><header>Incorporation
of acquired land and interests</header><text>Any land or interest in land
located within the boundaries of an area designated as a wilderness area by
this title that is acquired by the United States after the date of enactment of
this Act shall be added to, and administered as part of, the wilderness area
within which the acquired land or interest is located.</text>
</subsection></section><section id="ID0ac093d233734d25be6f2e8ed31dcafb"><enum>105.</enum><header>Buffer
zones</header>
<subsection id="id289F1836ECDA45DA888BBE72C60421E0"><enum>(a)</enum><header>In
general</header><text>As provided in the Oregon Wilderness Act of 1984 (16
U.S.C. 1132 note; Public Law 98–328), Congress does not intend for designation
of wilderness areas in the State under this title to lead to the creation of
protective perimeters or buffer zones around each wilderness area.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id951DF10A3F144D38A6F5F554C65735F3"><enum>(b)</enum><header>Activities or
uses up to boundaries</header><text>The fact that nonwilderness activities or
uses can be seen or heard from within a wilderness area shall not, of itself,
preclude the activities or uses up to the boundary of the wilderness
area.</text>
</subsection></section><section id="IDc4e6887bd84a40a99e46971ba46df82b"><enum>106.</enum><header>Fire safe
community zones</header><text display-inline="no-display-inline">Consistent
with the Mount Hood National Forest Management Plan and the Healthy Forests
Restoration Act of 2003 (16 U.S.C. 6501 et seq.), the Secretary shall construct
a strategic system of defensible fuel profile zones (including shaded
fuelbreaks, thinning, individual tree selection, and other methods of
vegetation management) between the wilderness boundary and the community
boundary around Cascade Locks and Government Camp.</text>
</section><section id="ID7ef9c2ea302b46109aa25521564a7ca7"><enum>107.</enum><header>Gateway
communities</header>
<subsection id="idF354EA20F06C4571BE52C0C08F318344"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary may
provide grants to communities that are gateways to Mount Hood Wilderness areas,
including the Hoodland Fire District, Government Camp, and the villages
surrounding Mount Hood, and the appropriate county governments in the State, to
be administered through the Forest Service State and Private Forestry
program.</text>
</subsection><subsection id="idDE16F141ABBA49389D498081E0F5D552"><enum>(b)</enum><header>Limitation of
funds</header><text>The total amount of funds provided by the Secretary to
gateway communities under subsection (a) shall not exceed $10,000,000.</text>
</subsection></section><section id="ID87fdf403104c4586bb3df531a2a4f577"><enum>108.</enum><header>Fish and
wildlife; hunting and fishing</header>
<subsection id="ID06a439fcef154ee0b671c91b596b63b6"><enum>(a)</enum><header>Fish and
wildlife</header><text>In furtherance of the purposes of the Wilderness Act (16
U.S.C. 1131 et seq.), the Secretary may carry out management activities to
maintain or restore fish and wildlife populations and fish and wildlife
habitats on the National Forest System land designated as wilderness by section
102 if those activities are—</text>
<paragraph id="id0123D33FA89D43D7B951F782E8AF41A1"><enum>(1)</enum><text>consistent with
applicable wilderness management plans; and</text>
</paragraph><paragraph id="id8B018999308A4B439D7F403ABDE90FF3"><enum>(2)</enum><text>carried out in
accordance with applicable guidelines and policies.</text>
</paragraph></subsection><subsection commented="no" id="ID5e7cd7b8c8a34c4592c72f8f6ab5d74e"><enum>(b)</enum><header>Bull trout
restoration project</header>
<paragraph commented="no" id="idF0EF62DA13304866B061B1A42A46653E"><enum>(1)</enum><header>In
general</header><text>Nothing in this Act affects the authority of the
Secretary to carry out the Bull Trout restoration project underway as of the
date of enactment of this Act in Clear Branch Creek.</text>
</paragraph><paragraph commented="no" id="idAAE76B30D05546B5A0ED1643ACFA6F35"><enum>(2)</enum><header>Minimum tool

project under paragraph (1) in accordance with the minimum tools policies of
the Forest Service.</text>
</paragraph></subsection></section><section id="ID06725f9d54f5439a97925037145f3cc2"><enum>109.</enum><header>Trail
restoration and study</header>
<subsection id="idB5BFF2E09F7B42A8854E1CFB85E1FB44"><enum>(a)</enum><header>Palmeteer trail
restoration</header>
<paragraph id="idA2148C46961F498CA000C59BA14556F1"><enum>(1)</enum><header>In
general</header><text>It is the intent of Congress that nothing in this title
shall prevent the Secretary from conducting the planned Palmateer Trail
restoration project underway as of the date of enactment of this Act in the
Twin Lakes area of the Mount Hood National Forest to restore the quality of the
Trail.</text>
</paragraph><paragraph id="idA80B75F93C2A43C7811FCDDE943805FE"><enum>(2)</enum><header>Minimum tools
policies</header><text>The Secretary shall carry out the Palmateer Trail
restoration project described in paragraph (1) in accordance with the minimum
tools policies of the Forest Service.</text>
</paragraph></subsection><subsection id="id15595E107DE54B3CA6AF0BBEB828C95D"><enum>(b)</enum><header>Study of Cool
Creek Trail 794</header><text>The Secretary shall conduct a study of the
appropriate public use of Cool Creek Trail 794.</text>
</subsection></section><section id="id232575F585A54CC896E74BDBCD0DAB6C"><enum>110.</enum><header>Fire, insects,
and diseases</header><text display-inline="no-display-inline">As provided in
section 4(d)(1) of the Wilderness Act (16 U.S.C. 1133(d)(1)), within the
wilderness areas designated by this Act, the Secretary of Agriculture (in
collaboration with the Secretary of the Interior, where appropriate) may take
such measures as are necessary to control fire, insects, and diseases, subject
to such conditions as the Secretary of Agriculture (in collaboration with the
Secretary of the Interior where appropriate) determines to be desirable.</text>
</section><section id="IDbebaec8dc6bc42fc893a4a5392ac2d42"><enum>111.</enum><header>Land
reclassification</header>
<subsection id="IDf2cec9eecae04e63bf1f419c0d435401"><enum>(a)</enum><header>Oregon and
California railroad land</header><text>Not later than 180 days after the date
of enactment of this Act, the Secretary of Agriculture and the Secretary of the
Interior shall identify any Oregon and California Railroad Land that is subject
to section 201 of the Act of August 28, 1937 (43 U.S.C. 1181f), within the
boundary of the Clackamas Wilderness, as generally depicted on the map entitled
<quote>South Fork Clackamas</quote>, dated September 2006.</text>
</subsection><subsection id="IDab2b3e20a15d4ad1b5d4cd123d03b910"><enum>(b)</enum><header>Public domain
land</header>
<paragraph id="idFF449E85E2F04A8881549147C72266C3"><enum>(1)</enum><header>Definition of
public domain land</header><text>In this section, the term <quote>public domain
land</quote>—</text>
<subparagraph id="id922FDE1A24124DE882C80883CCA4BD20"><enum>(A)</enum><text>has the meaning
given the term <quote>public land</quote> in section 103 of the Federal Land
Policy and Management Act of 1976 (43 U.S.C. 1702); and</text>
</subparagraph><subparagraph id="ID92670cba032c437b811503205db77800"><enum>(B)</enum><text>does not include
any land managed under the Act of August 28, 1937 (43 U.S.C. 1181a et
seq.).</text>
</subparagraph></paragraph><paragraph id="IDd08ba1d63f894b90b4a97623e4ed5126"><enum>(2)</enum><header>Identification</header><text>Not
later than 180 days after the date of enactment of this Act, the Secretary of
the Interior shall identify public domain land within the State that is
approximately equal in acreage of land described in subsection (a), but is not
subject to the Act of August 28, 1937 (43 U.S.C. 1181a et seq.).</text>
</paragraph><paragraph id="ID7ddf4241e3724cd5bda15e90586bd7c7"><enum>(3)</enum><header>Maps</header><text>Not
later than 180 days after the date of enactment of this Act, the Secretary of
the Interior shall submit to Congress and publish in the Federal Register, 1 or
more maps depicting the land identified under subsections (a) and this
subsection.</text>
</paragraph><paragraph id="IDaf0aa049124641608aed96566dbdd501"><enum>(4)</enum><header>Reclassification</header><text>After
providing an opportunity for public comment, the Secretary of the Interior
shall administratively reclassify—</text>
<subparagraph id="idC2D06481636848AFB10209D33C507873"><enum>(A)</enum><text>the land
described in subsection (a) as public domain land that is not subject to
section 201 of the Act of August 28, 1937 (43 U.S.C. 1181f); and</text>
</subparagraph><subparagraph id="id32CA5BDF6B8B43D1B65297BD55143B3F"><enum>(B)</enum><text>the land
described in this subsection as Oregon and California Railroad Land that is
subject to the Act of August 28, 1937 (43 U.S.C. 1181a et seq.).</text>
</subparagraph></paragraph></subsection></section><section id="idEDCC002213404D33924EA2DC01557B0D"><enum>112.</enum><header>Valid existing
rights and withdrawal</header>
<subsection id="ID3307f71a5ccf45f1902e1c49f2784ea6"><enum>(a)</enum><header>Valid existing
rights</header><text>Nothing in this Act affects any valid existing
right.</text>
</subsection><subsection id="ID6eb4a2df5cea42e29137cd406f3cb30e"><enum>(b)</enum><header>Withdrawal</header><text>Subject
to valid rights existing on the date of enactment of this Act, the Federal land
referred to in section 102 is withdrawn from all forms of—</text>
<paragraph id="ID97579583be6f4d6c87ae6bc08f55091a"><enum>(1)</enum><text>appropriation;</text>
</paragraph><paragraph id="ID88ed643e4c36473a9a65a7c71b11e938"><enum>(2)</enum><text>disposal under
public law;</text>
</paragraph><paragraph id="ID15a75452690442cfbc64197f8beb882a"><enum>(3)</enum><text>location, entry,
and patent under mining law; and</text>
</paragraph><paragraph id="ID437306c54c7542eda894bba6479c6c73"><enum>(4)</enum><text>disposition under
all laws pertaining to mineral and geothermal leasing or mineral
materials.</text>
</paragraph></subsection></section><section id="ID56e827d3c5f84dceb1243fd07fe5ab8c"><enum>113.</enum><header>Maintenance
and replacement of foot bridges in wilderness areas</header>
<subsection id="id13D241CA9DF743F5AE7807B4C17486B1"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">In the case of each
wilderness area designated or expanded by section 102, it is the intent of
Congress that the Secretary be able to provide for—</text>
<paragraph id="idA8375854BDA54A8F84904614060E1FBE"><enum>(1)</enum><text display-inline="yes-display-inline">the maintenance of any foot bridge crossing
located in a wilderness area; and</text>
</paragraph><paragraph id="id8D9181472D4848D8B781DAC4E6303BC4"><enum>(2)</enum><text display-inline="yes-display-inline">when needed, the replacement of the foot
bridge crossings to ensure public access and safety.</text>
</paragraph></subsection><subsection id="id2163406B503F45F68E8B76A27DAA2CB4"><enum>(b)</enum><header>Minimum tool
policies</header><text display-inline="yes-display-inline">The Secretary shall
carry out foot bridge replacement work under subsection (a) in accordance with
the minimum tools policies of the Forest Service.</text>
</subsection></section><section id="id07C1D0AEB96746F1B7306DDB6E755CF5"><enum>114.</enum><header>Richard L.
Kohnstamm Memorial Area</header>
<subsection id="id7756423E0605466E80E5C9A2A30C83BE"><enum>(a)</enum><header>Designation</header><text>Certain
Federal land managed by the Forest Service, comprising approximately 30 acres,
as generally depicted on the map entitled <quote>Richard L. Kohnstamm Memorial
Area</quote>, dated September 2006, and approximately 157 acres of designated
wilderness, as generally depicted on the map entitled <quote>Richard L.
Kohnstamm Memorial Area</quote>, dated September 2006, shall be known and
designated as the <quote>Richard L. Kohnstamm Wilderness</quote>.</text>
</subsection><subsection id="id85D29E64056A4BA0B03D56F5ED80AADA"><enum>(b)</enum><header>References</header><text>Any
reference in a law, map, regulation, document, paper, or other record of the
United States to an area described in subsection (a) shall be deemed to be a
reference to the Richard L. Kohnstamm Wilderness.</text>
</subsection><subsection id="idED397447137C420FB247EA1437848CD3"><enum>(c)</enum><header>Boundary</header>
<paragraph id="idB680EAF441224A72BFF6A9A55800785C"><enum>(1)</enum><header>In
general</header><text>The memorial area shall consist of land located within
the boundary depicted on the map entitled <quote>Richard L. Kohnstamm Memorial
Area</quote>, dated September 2006.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5550841B418945348A30F978CDF92D8A"><enum>(2)</enum><header>Availability of
map</header><text>The map shall be on file and available for public inspection
in the appropriate offices of the Forest Service.</text>
</paragraph></subsection></section><enum>II</enum><header>Designation of
streams for wild and scenic river protection in the mount hood area</header>
<section id="id6C3E460B8E42403CBFDF8A98407B4700"><enum>201.</enum><header>Finding and
purpose</header>
<subsection id="idFB0EC8B397CE4F44BF6EEF3D1B98811F"><enum>(a)</enum><header>Finding</header><text>Congress
finds that the addition of 81 miles of waterways to the National Wild and
Scenic River System in the Mount Hood National Forest would increase the total
length of the portion of the National Wild and Scenic River System that is
located in the Mount Hood National Forest by approximately 47 percent.</text>
</subsection><subsection id="idA200E8B7D71D4A8CBC2F905C0B7D2F24"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to designate
approximately 81 miles of waterways in the Mount Hood National Forest as
additions to the National Wild and Scenic Rivers System.</text>
</subsection></section><section id="IDedc57cdd72814bb3b5b180185c3935a8"><enum>202.</enum><header>Wild and
scenic river designations, Mount Hood National Forest</header><text display-inline="no-display-inline">Section 3(a) of the Wild and Scenic Rivers
Act (16 U.S.C. 1274(a)) is amended—</text>
<paragraph id="idDBE2EB48DE3F4B278225F77109F720FC"><enum>(1)</enum><text>by designating
the undesignated paragraph relating to the White Salmon River as paragraph
(167); and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88C09D6B57F948AD965A4DA6568A47A7"><enum>(2)</enum><text>by adding at the
end the following:</text>

segment of Eagle Creek from its headwaters to the Mount Hood National Forest
boundary, of which—</text>

segment from its headwaters to the west section line of T. 3 S., R. 6 E., sec.
20, as a wild river; and</text>
</clause><clause id="ID6c341f466e214c869bc213d610e1b761"><enum>(ii)</enum><text>the remaining
1.8-mile segment from that section line, as a recreational river.</text>
</clause></subparagraph><subparagraph id="ID0380a37e09cd4a08a2a35aef83cfb9cd"><enum>(C)</enum><text>The 3.7-mile
segment of the Middle Fork of the Hood River from the confluence of Clear and
Coe Branches to the Mount Hood National Forest boundary of sec. 11 and 12 in T.
1 S., R. 9 and 10 E., as a scenic river.</text>
</subparagraph><subparagraph id="ID95f19235ddfd4f02b76f8698386c98d5"><enum>(D)</enum><text>The 4.6-mile
segment of the South Fork Roaring River from its headwaters to its confluence
with Roaring River, as a wild river.</text>
</subparagraph><subparagraph id="IDc1f6718f957149e081312753c73a5e39"><enum>(E)</enum><text>The 4.3-mile
segment of the Zig Zag River from its headwaters to the Mount Hood Wilderness
boundary, as a wild river.</text>

segment of Fifteenmile Creek from its source at Senecal Spring to the Mount

segment from the western edge of section 20, T. 2 S., R. 12 E., WM to the Mount

segment of the East Fork Hood River from Oregon State Highway 35 to the Mount

</subparagraph><subparagraph id="ID027be862a9284ab5b580cfee34f37ab4"><enum>(H)</enum><text>The 17.8-mile
segment of the Collawash River from the headwaters of the East Fork Collawash
to the confluence with the Clackamas River, of which—</text>
<clause id="id2E0922D0A507444E8644AE7E3F7B12BF"><enum>(i)</enum><text>the 11.0-mile
segment from the headwaters of the East Fork Collawash River to Buckeye Creek,
as a scenic river; and</text>

segment from Buckeye Creek to the Clackamas River, as a recreational

water rights and flow requirements</header>

existing requirements</header><text>Congress does not intend for the
designation of any portion of the Hood River under section 3(a) of the Wild and
Scenic Rivers Act (16 U.S.C. 1274(a)), as amended by this Act, to have any
impact on any water right or flow requirement relating to—</text>
<paragraph id="idFCB045070CAF40E6B4E3091C5D786128"><enum>(1)</enum><text>the Middle Fork
Irrigation District;</text>
</paragraph><paragraph id="id38BB13B49E0242F781DA8EC0452EAC86"><enum>(2)</enum><text>the East Fork
Irrigation District; or</text>
</paragraph><paragraph id="id590846A7B7494977A0F6D1ECF522D906"><enum>(3)</enum><text>the Mt. Hood
Meadows Ski Resort.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9B5799550861410882B5BBBB09253BB6"><enum>(b)</enum><header>Exclusion of
operational areas</header><text>Congress does not intend for the designation of
any portion of the Hood River under section 3(a) of the Wild and Scenic Rivers
Act (16 U.S.C. 1274(a)), as amended by this Act, to include any portion of the
operational area of—</text>

</paragraph></subsection></section><enum>III</enum><header>Mount hood
national recreation area</header>
<section id="idCC97823449D743EBB345F1890C805954"><enum>301.</enum><header>Designation</header>
<subsection id="id072D2883B42C402FB8AFA8E110197944"><enum>(a)</enum><header>Designation</header><text>The
Mount Hood National Recreation Area shall be known and designated as the
<quote>Mount Hood National Recreation Area</quote>.</text>
</subsection><subsection id="ID1DEB61C5FAC94A8BBCA4E15DCCF3D722"><enum>(b)</enum><header>References</header><text>Any
reference in a law, map, regulation, document, paper, or other record of the
United States to the Mount Hood National Recreation Area shall be deemed to be
a reference to the Mount Hood National Recreation Area.</text>
</subsection><subsection id="ID2DAE59FF196A41A7AFF9EDFD89D995BD"><enum>(c)</enum><header>Boundary</header>
<paragraph id="ID70EB6A010F6145909297173716EA0C42"><enum>(1)</enum><header>In
general</header><text>The Mount Hood National Recreation Area shall consist of
land located within the boundary depicted on the map entitled <quote>Mount Hood
National Recreation Area</quote>, dated September 2006.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID57261AD5E3D94B119685EFFBE8654895"><enum>(2)</enum><header>Availability of
map</header><text>The map shall be on file and available for public inspection
in the appropriate offices of the Forest Service and Bureau of Land
Management.</text>
</paragraph></subsection><subsection id="IDBD19D0C2EE874FBAA90FE7C2EB0EC486"><enum>(d)</enum><header>Administration</header><text>The
Secretary shall administer the Mount Hood National Recreation Area in
accordance with the laws, rules, and regulations applicable to the national
forests for public outdoor recreation—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID2C84F56795144057AC569AB64A6C9477"><enum>(1)</enum><text>in a manner
that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id85134B1F36844FA7BB4D55EA4ECBFC60"><enum>(A)</enum><text>protects and
maintains—</text>
<clause commented="no" display-inline="no-display-inline" id="idDE2343135DFB4DEC92BB95A36E4CC93D"><enum>(i)</enum><text>the diverse
recreational opportunities of the Mount Hood National Recreation Area for
public use; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idDA134C806D18477AAE08E3B0B4FC6E09"><enum>(ii)</enum><text>fish and
wildlife habitats;</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75659F0890EE4EEFBE012C3F166683DC"><enum>(B)</enum><text>conserves the
scenic, recreational, cultural, scientific, spiritual, and other values of the
Mount Hood National Recreation Area that contribute to the benefit of the
public;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54EA666EF62E4498862B552EED33B361"><enum>(C)</enum><text>preserves each
feature and peculiarity of the Mount Hood National Recreation Area believed to
be biologically significant, including—</text>
<clause commented="no" display-inline="no-display-inline" id="id63657D07C7DB4B37B1ECFD6FC6C61C81"><enum>(i)</enum><text>rare and endemic
plant species;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id188790DEC42D411881FDBD7831FDA28A"><enum>(ii)</enum><text>rare
combinations of aquatic, terrestrial, and atmospheric habitats; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id92F979290C4440099DDD65A7BC9D59EE"><enum>(iii)</enum><text>rare
combinations of outstanding and diverse ecosystems and parts of associated
ecosystems;</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD1DF11065D0E4C4AB0BC93474DB5BC9E"><enum>(D)</enum><text>protects
archeological and paleontological sites and interprets those sites for the
benefit of the public;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE7991E3606DE46F09E46F03BACC8C52F"><enum>(E)</enum><text>maintains and
enhances the desired structural components consistent with Standards and
Guidelines of the Northwest Forest Plan; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7357A75F1CA24929B1806194097B2EAD"><enum>(F)</enum><text>prevents any
cutting, sale, or removal of timber except where the cutting, sale, or removal
of timber—</text>
<clause commented="no" display-inline="no-display-inline" id="idBD277253B9C74087BB04EB635D7B43E5"><enum>(i)</enum><text>improves the
health of the forest and—</text>
<subclause commented="no" display-inline="no-display-inline" id="idF17434EBDFE34C6E99A40A96DB999931"><enum>(I)</enum><text>maximizes the
retention of large trees as appropriate to the forest type, to the extent that
those trees promote stands that are fire-resilient and healthy;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id248660D43857487EA9F1D62531DA96A4"><enum>(II)</enum><text>improves the
habitats of threatened, endangered, proposed, or sensitive species; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="idDE3FDE71F23F451295ABF172045CE782"><enum>(III)</enum><text>maintains or
restores the composition and structure of the ecosystem by reducing the risk of
uncharacteristic wildfire effects;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5FBD586A265F48688762AD78B3C0B9C3"><enum>(ii)</enum><text>is incidental to
the accomplishment of an approved management activity not otherwise prohibited;
or</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id191BE402BD4740DDABBFCA9BA7C4082F"><enum>(iii)</enum><text>is for personal
or administrative use; and</text>
</clause></subparagraph></paragraph><paragraph id="idE728FD70F5F344B8A086A128A8C56534"><enum>(2)</enum><text>to prevent the
new or temporary construction or reconstruction of roads, except when the new
or temporary construction or reconstruction of roads is required—</text>
<subparagraph id="id8E9592F790934738901150243D194899"><enum>(A)</enum><text>to protect the
health and safety of individuals in cases of an imminent threat of flood, fire,
or any other catastrophic event that, without intervention, would cause the
loss of life or property;</text>
</subparagraph><subparagraph id="id5C0714B3EAC44C2EBCEF884362BA0BEE"><enum>(B)</enum><text>to conduct
environmental cleanup required by the Federal Government;</text>
</subparagraph><subparagraph id="idE484941BA16E4A659566376373F9E980"><enum>(C)</enum><text>to allow for
reserved or outstanding rights provided for by a statute or treaty;</text>
</subparagraph><subparagraph id="idB00A7364F770428A946B0556D419C48E"><enum>(D)</enum><text>to prevent
irreparable resource damage by an existing road;</text>
</subparagraph><subparagraph id="idD5BE9DC0236A46F6B2FE20D8A617B0B4"><enum>(E)</enum><text>to rectify a
hazardous road condition;</text>
</subparagraph><subparagraph id="id691F4C6FF1554F6AB40C057D9E33EB57"><enum>(F)</enum><text>as part of a
Federal-aid highway project; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39BA2B55D5BF41FE9167CECE765DDE17"><enum>(G)</enum><text>in conjunction
with—</text>
<clause commented="no" display-inline="no-display-inline" id="id71CBE5AACF944E28A4CB0B84C67464D6"><enum>(i)</enum><text>the continuation,
extension, or renewal of a mineral lease on land that is under lease; or</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id4900D7B892234F8A93FA852255A3AAE2"><enum>(ii)</enum><text>a new mineral
lease that is issued immediately after the expiration of an existing mineral
lease.</text>
</clause></subparagraph></paragraph></subsection><subsection id="id2B600DEBB0D041B285E9A5267E60FC6C"><enum>(e)</enum><header>Chainsaws</header><text>The
Secretary may use chainsaws to maintain existing trails in the Mount Hood
National Recreation Area.</text>
</subsection></section><enum>IV</enum><header>Transportation
and communication systems</header>
<section id="ID6bbc8050a8344999aaa3e4d86da504e5"><enum>401.</enum><header>Definition of
Mount Hood region</header><text display-inline="no-display-inline">In this
title, the term <term>Mount Hood region</term> means—</text>
<paragraph id="id0723AB4FC75146B7A4D65399A12EAD7F"><enum>(1)</enum><text display-inline="yes-display-inline">Mount Hood and the other land located
adjacent to the mountain;</text>
</paragraph><paragraph id="id23351BA6AB0D4024867EFC08C6E808F8"><enum>(2)</enum><text display-inline="yes-display-inline">any segment of the Oregon State Highway 26
corridor that is located in or near Mount Hood National Forest;</text>
</paragraph><paragraph id="idC1F6579345F4478AA4A4630F8346CD04"><enum>(3)</enum><text>any segment of
the Oregon State Highway 35 corridor that is located in or near Mount Hood
National Forest;</text>
</paragraph><paragraph id="id12338E7C30554295BB41014ACEBAB14D"><enum>(4)</enum><text display-inline="yes-display-inline">each other road of the Forest Service,
State, or county that is located in and near Mount Hood National Forest;
and</text>
</paragraph><paragraph id="id081502C062624F9780E45650E4712F03"><enum>(5)</enum><text display-inline="yes-display-inline">any gateway community located adjacent to
any highway or road described in paragraph (2), (3), or (4).</text>
</paragraph></section><section id="ID238cfe80baa04accb8b536835b22a00e"><enum>402.</enum><header>Transportation
plan</header>
<subsection id="ID2fa9c2301d5246e4be7cea19a73097cd"><enum>(a)</enum><header>In
general</header><text>The Secretary shall collaborate with the State to develop
an integrated, multimodal transportation plan for the Mount Hood region to
achieve comprehensive solutions to transportation challenges in the Mount Hood
region—</text>
<paragraph id="id4012732D725D425BBB53BD03569417A2"><enum>(1)</enum><text>to promote
appropriate economic development;</text>
</paragraph><paragraph id="id80D583A6AB864FC88ACA29E0564923B2"><enum>(2)</enum><text>to preserve the
landscape of the Mount Hood region; and</text>
</paragraph><paragraph id="id7FDEF40F63FC4A30A453B40EB92D3E90"><enum>(3)</enum><text>to enhance public
safety.</text>
</paragraph></subsection><subsection id="ID478ef5bd957e483996b30cd4654317c7"><enum>(b)</enum><header>Planning
process</header><text>The transportation plan under subsection (a)
shall—</text>
<paragraph id="id63BA2A66EED247F58C4CEA6F7EF1045B"><enum>(1)</enum><text>conform with
Federal and Oregon transportation planning requirements; and</text>
</paragraph><paragraph id="id5D03BA0BEBE54EB4A616BAA200134C69"><enum>(2)</enum><text>be developed
through a collaborative process, preferably through the use of a commission
composed of interested persons appointed by the State, with representation from
the Forest Service and local governments in the Mount Hood region.</text>
</paragraph></subsection><subsection id="IDdaa186c8119f40bc866e677389be31cf"><enum>(c)</enum><header>Scope of
plan</header><text>The transportation plan under subsection (a) shall address
issues relating to—</text>
<paragraph id="IDb4474a4cde6542b68d525ef3ba61d295"><enum>(1)</enum><text>the
transportation of individuals to and from areas outside the Mount Hood region
on major corridors traversing that region; and</text>
</paragraph><paragraph id="ID740379f6914e4c35958929cedacbf417"><enum>(2)</enum><text>the
transportation of individuals to and from locations that are located within the
Mount Hood region.</text>
</paragraph></subsection><subsection id="ID659a06ed9220493fadd273eea2911635"><enum>(d)</enum><header>Contents of
plan</header><text>At a minimum, the transportation plan under subsection (a)
shall consider—</text>
<paragraph id="ID459bb4e8a12443e5bb794c5f989f42bf"><enum>(1)</enum><text>transportation
alternatives between and among recreation areas and gateway communities that
are located within the Mount Hood region;</text>
</paragraph><paragraph id="ID70b182bbbaad4e1690db65c9ff8670d2"><enum>(2)</enum><text>establishing
park-and-ride facilities that shall be located at gateway communities;</text>
</paragraph><paragraph id="ID6c9ceda636e948729b62cef4cd4909d7"><enum>(3)</enum><text>establishing
intermodal transportation centers to link public transportation, parking, and
recreation destinations;</text>
</paragraph><paragraph id="ID8524c230ba224f4e9cef7afee2ca15f8"><enum>(4)</enum><text>creating a new
interchange on Oregon State Highway 26 that shall be located adjacent to or
within Government Camp;</text>
</paragraph><paragraph id="ID3d2d063df5ea476cb765a617a592f67e"><enum>(5)</enum><text>designating,
maintaining, and improving alternative routes using Forest Service or State
roads for—</text>
<subparagraph id="idFDD67E1BCEE84625A8F0B8E6D4C5900C"><enum>(A)</enum><text>providing
emergency routes; or</text>
</subparagraph><subparagraph id="idDEDCC1DC55E14997BB2F4A28ACD4006C"><enum>(B)</enum><text>improving access
to, and travel within, the Mount Hood region;</text>
</subparagraph></paragraph><paragraph id="IDfd156d2be4004e5791adf2e8cc0070f4"><enum>(6)</enum><text>reconstructing
the segment of Oregon State Highway 35 that is located between Mineral Creek
and Baseline Road to address ongoing debris flow locations; and</text>
</paragraph><paragraph id="IDa835be53c15e44f2b7f7371576f325d8"><enum>(7)</enum><text>creating
mechanisms for funding the implementation of the transportation plan under
subsection (a), including—</text>
<subparagraph id="id9C04DADFE0F34CA48AC8BA3DFB8F8B85"><enum>(A)</enum><text>funds provided by
the Federal Government;</text>
</subparagraph><subparagraph id="id43DB6655615C42178927146207B0BF89"><enum>(B)</enum><text>public-private
partnerships;</text>
</subparagraph><subparagraph id="idA745E333619943A781009F9B4394C052"><enum>(C)</enum><text>incremental tax
financing; and</text>
</subparagraph><subparagraph id="idDA9C945D5700471295243B2CCC04BB5C"><enum>(D)</enum><text>other financing
tools that link transportation infrastructure improvements with
development.</text>
</subparagraph></paragraph></subsection><subsection id="ID3fdbac83135f467582ebef6d15d17bab"><enum>(e)</enum><header>Completion of
plan</header><text>Not later than 2 years after the date on which funds are
first made available to carry out this section, the Secretary shall complete
the transportation plan under subsection (a).</text>
</subsection><subsection id="ID8eb57b0d363e4feab446b17f7a452006"><enum>(f)</enum><header>Authorization
of appropriations</header><text>There is authorized to be appropriated to carry
out this section $2,000,000.</text>
</subsection></section><section id="ID7c495d06706f43019951aec3c8ea92b4"><enum>403.</enum><header>Study relating
to gondola connection and intermodal transportation center</header>
<subsection id="ID34a064ed06034216acb270070d617e5b"><enum>(a)</enum><header>Feasibility
study</header><text>The Secretary shall carry out a study of the feasibility of
establishing—</text>
<paragraph id="ID38cbb5449fda41c092c73661e4ca300a"><enum>(1)</enum><text>a gondola
connection that—</text>
<subparagraph id="id28EBB51BB5604EBD87CEAC1846DE6128"><enum>(A)</enum><text>connects
Timberline Lodge to Government Camp; and</text>
</subparagraph><subparagraph id="id48FA9DA1C6D843C2A77405938305DD5F"><enum>(B)</enum><text>is located in
close proximity to the site of the historic gondola corridor; and</text>
</subparagraph></paragraph><paragraph id="ID8a4059093e374fb38f1125e11125fb6e"><enum>(2)</enum><text>an intermodal
transportation center to be located in close proximity to Government
Camp.</text>
</paragraph></subsection><subsection id="IDfe7448c314d64a7dad5440455a708782"><enum>(b)</enum><header>Consideration
of multiple sites</header><text>In carrying out the feasibility study under
subsection (a), the Secretary may consider 1 or more sites.</text>
</subsection></section><section id="ID83a578a8d7af456e8c0b00a5b033eca3"><enum>404.</enum><header>Burial of
power lines</header><text display-inline="no-display-inline">Because of the
incongruent presence of power lines adjacent to or within wilderness areas, the
Secretary may provide to Cascade Locks and Hood River County $3,200,000 through
the Forest Service State and Private Forestry program to bury ground power
lines adjacent to or within Mount Hood Wilderness areas, including wilderness
areas designated by this Act.</text>
</section><section id="ID2ee5677c506f42daaa2dee79bb2680a2"><enum>405.</enum><header>Culvert
replacement</header>
<subsection id="ID43a540940e9f44ea9f3f7c7fb669e183"><enum>(a)</enum><header>In
general</header><text>The Secretary may provide $1,000,000 to Clackamas County
to replace or remove culverts on the wild and scenic river segments in
Clackamas County, Oregon, designated by title II.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd9b68f129d444bf0a7381ad13e7c319c"><enum>(b)</enum><header>Limitation</header><text>Culvert
replacement carried out by the Forest Service and Clackamas County to improve
fish passage and the ecology of the wilderness designated by this Act shall not
be considered water and resource development.</text>
</subsection></section><section id="ID7a8facfb36ad4d0d826480d8225b8a63"><enum>406.</enum><header>Clarification
of treatment of State highways</header>
<subsection id="ID81c15edae862412e973c88b65d0213d9"><enum>(a)</enum><header>Exclusion</header><text>Any
part of Oregon State Highway 35 or other any other State highway in existence
on the date of enactment of this Act (including all existing rights-of-way and
150 feet on each side of the centerline, whichever is greater, that is adjacent
to or within wilderness areas in the Mount Hood National Forest, including
wilderness areas designated by this Act) shall be excluded from wilderness
under this Act.</text>
</subsection><subsection id="ID57a422796d82444fb725f45e05af2129"><enum>(b)</enum><header>No net
effect</header><text>The designation of wilderness or wild and scenic rivers
under this Act or an amendment made by this Act shall not limit or restrict the
ability of the State—</text>
<paragraph id="id69E97D1E537042A2B68567395C52533C"><enum>(1)</enum><text>to operate,
maintain, repair, reconstruct, protect, or make any other improvement to Oregon
State Highway 35 or any other State highway in existence on the date of
enactment of this Act;</text>
</paragraph><paragraph commented="no" id="id6A4A3EBA9C334803B7BCC3C5D83E7373"><enum>(2)</enum><text>to use any site
that is not within a highway right-of-way to operate, maintain, repair,
reconstruct, protect, or make any other improvement to those highways;
or</text>
</paragraph><paragraph id="idF88FE3A610B7471ABCA4612C38C53872"><enum>(3)</enum><text>to take any
action outside of a highway right-of-way that is necessary to operate,
maintain, repair, reconstruct, protect, or make any other improvement to those
highways.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdde12a03eaff434caac0302eb500672e"><enum>(c)</enum><header>Flood
plain</header><text>Congress encourages the carrying out of projects that will
reduce the impact of Oregon State Highway 35 on the flood plain of the East
Fork Hood River.</text>
</subsection></section><enum>V</enum><header>Land
exchange</header>
<subtitle id="idD3F4CCCF6A614B8DB07F081A9AF5599C"><enum>A</enum><header>Cooper
Spur-Government Camp Land Exchange</header>
<section id="IDf76a5b7d24984292a2a098e908a92d94"><enum>501.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this subtitle is to recognize
the years of work by local residents and political and business leaders from
throughout the States of Oregon and Washington to protect the north side of
Mount Hood and bring to culmination the land exchange authorized by section
502.</text>
</section><section id="IDee63c78b3d9544f682dd2acec5cf5fd3"><enum>502.</enum><header>Cooper
Spur-Government Camp land exchange</header>
<subsection id="ID8bab9f3ef5894510ac7df1482da3e08f"><enum>(a)</enum><header>Conveyance
required</header><text>With the exception if the Retained Conservation and
Trail Easements under subsection (j), the Secretary shall convey to Mt. Hood
Meadows Oreg., Limited Partnership (in this subtitle referred to as “Mt. Hood
Meadows”), all right, title, and interest of the United States in and
to—</text>
<paragraph id="ID2f96cc3380a34949873d2e504a3d2127"><enum>(1)</enum><text>a parcel of
National Forest System land in Mount Hood National Forest consisting of
approximately 80 acres in Government Camp, Clackamas County, Oregon, as
depicted on the map entitled <quote>Cooper Spur-Government Camp Land
Exchange</quote> and dated September 2006 (in this subtitle referred to as the
<quote>official map</quote>); and</text>
</paragraph><paragraph id="ID9bc4249f1c7c437095e3791cf23c5bf7"><enum>(2)</enum><text>a parcel of
National Forest System land in Mount Hood National Forest consisting of
approximately 40 acres in Government Camp, as depicted on the official
map.</text>
</paragraph></subsection><subsection id="ID1d32f2bf47f1494190dcf4716aa3f27c"><enum>(b)</enum><header>Consideration</header><text>As
consideration for the conveyance under subsection (a), Mt. Hood Meadows,
Meadows North, LLC, and North Face Inn, LLC, shall convey to the United States
all right, title, and interest of these entities in and to—</text>
<paragraph id="ID2d65da2404e044bd97cc50aa3af2100e"><enum>(1)</enum><text>a parcel of
private land consisting of approximately 770 acres at Cooper Spur, as depicted
on the official map;</text>
</paragraph><paragraph id="IDe51df931ebb444d1bad7257f522b5e88"><enum>(2)</enum><text>all buildings,
furniture, fixtures, and equipment at the Inn at Cooper Spur covered by the
appraisal described in subsection (c)(1);</text>
</paragraph><paragraph id="ID3fa75f59ddfb47788fe39851f55743b8"><enum>(3)</enum><text>the 1,350 acre
special use permit for the Cooper Spur Ski Area, as depicted on the official
map; and</text>
</paragraph><paragraph id="IDa0bd6aada2a24ec4aafb385d4362a819"><enum>(4)</enum><text>all buildings,
furniture, fixtures, and equipment at the Cooper Spur Ski Area covered by the
appraisal described in subsection (c)(1).</text>
</paragraph></subsection><subsection id="IDbb727020696d4fd58845d13e42932a31"><enum>(c)</enum><header>Appraisals</header>
<paragraph id="id6B19A8DDF9394EC683A7B860E54EDB56"><enum>(1)</enum><header>In
general</header><text>The values of the lands to be exchanged under this Act
shall be determined by appraisals using nationally recognized appraisal
standards, including as appropriate—</text>
<subparagraph id="IDa33f50d5b1eb47fe92848805dd124b9a"><enum>(A)</enum><text>the Uniform
Appraisal Standards for Federal Land Acquisitions (1992); and</text>
</subparagraph><subparagraph id="ID1d4c4c65850e4dbea6d621498552983c"><enum>(B)</enum><text>the Uniform
Standards of Professional Appraisal Practice.</text>
</subparagraph></paragraph><paragraph id="IDd49870bcbff049e18731172814b8d83b"><enum>(2)</enum><header>Existing
appraisals</header><text>The Secretary shall review the appraisals of the land
and other property to be conveyed under subsections (a) and (b) performed in
2005 by Appraiser Steven A. Hall, MAI, CCIM, for accuracy and compliance with
paragraph (1). If the Secretary determines that the appraisals are accurate and
meet the requirements of paragraph (1), then the Secretary may approve the
appraisals.</text>
</paragraph><paragraph id="ID56010ca38e5c46e98cb6bac63890205f"><enum>(3)</enum><header>Treatment of
excess consideration</header><text>Should the appraisal determine a difference
in values between the properties exchanged, in favor of the government, excess
value donated to the United States will not be deemed a donation for tax
purposes. Donation of non-Federal land may exceed 25 percent of the value of
the Federal land.</text>
</paragraph></subsection><subsection id="ID9c3513d4137f40719c54f33b30a5c8c2"><enum>(d)</enum><header>Equal value
exchange</header><text>The values of the land to be exchanged under this
section shall be determined pursuant to an appraisal acceptable to the
Secretary of Agriculture, the County and Mt. Hood Meadows Oreg., Limited
Partnership. If the values are not equal, they shall be equalized in the manner
provided in section 206(b) of the Federal Land Policy and Management Act of
1976 (43 U.S.C. 1716(b)).</text>
</subsection><subsection id="ID48342621b0fe4aaaa05523febfd9ac5c"><enum>(e)</enum><header>Compliance with
existing law</header><text>Except as otherwise provided in this section, the
Secretary shall carry out the land exchange under this section in the manner
provided in section 206 of the Federal Land Policy Management Act of 1976 (43
U.S.C. 1716).</text>
</subsection><subsection id="ID0cc8f38407fc4f12ae2da47314a96dfe"><enum>(f)</enum><header>Conditions on
acceptance</header><text>Title to the non-Federal land to be acquired by the
Secretary of Agriculture under this section must be acceptable to the
Secretary, and the conveyances shall be subject to valid existing rights of
record. The non-Federal land shall conform with the title approval standards
applicable to Federal land acquisitions.</text>
</subsection><subsection id="ID983b6c76ce8b48ae9a350071cd4d3579"><enum>(g)</enum><header>Legal
descriptions</header><text>The exact acreage and legal description of the land
to be exchanged under this section shall be determined by surveys satisfactory
to the Secretary of Agriculture. The costs of any such survey, as well as other
administrative costs incurred to execute the land exchange, shall be negotiated
between the Secretary and the County.</text>
</subsection><subsection id="ID9e3c0e29c94b499e9d6a937a55e5b4df"><enum>(h)</enum><header>Existing
rights</header><text>The conveyance of Federal land under this section shall be
subject to valid existing rights of third parties. In the alternative, the
Secretary of Agriculture may grant substitute permit rights of equivalent
utility to use other Federal land.</text>
</subsection><subsection id="ID0863ffe81d094e048b49037740c6d621"><enum>(i)</enum><header>Completion of
land exchange</header><text>The Secretary of Agriculture shall complete all
legal and regulatory processes required in connection with the land exchange
under this section and complete the closing of the land exchange not later than
16 months after the date of the enactment of this Act.</text>
</subsection><subsection id="IDc6d267fe731243f086a24619b5779c54"><enum>(j)</enum><header>Retained
conservation and trail easements</header><text>In conjunction with the
conveyance of title to Mt. Hood Meadows, the Secretary of Agriculture shall
reserve a Conservation Easement to protect existing wetlands on the conveyed
parcels, as determined by the Oregon Department of State Lands. Alternative
equivalent wetland mitigation measures shall be allowed to compensate for minor
wetland encroachments necessary for the orderly development of the parcels. In
addition, the Secretary of Agriculture shall reserve a Trail Easement which
allows the non-motorized functional use by the public of identified existing
trails located on the conveyed parcels as depicted on the map entitled
<quote>Government Camp Trail Map</quote> and dated September 2006 as such
trails may be improved or relocated to accommodate development of the property.
The Trail Easement shall provide that roads, utilities and infrastructure
facilities may cross such trails.</text>
</subsection></section></subtitle><subtitle id="id92940BFC7FF0452D86F2F43F5F86AA6E"><enum>B</enum><header>Other land
exchanges</header>
<section id="idE7EE3754E3D540C382CF2F1D42A987E0"><enum>511.</enum><header> Land
exchange, Port of Cascade Locks-Pacific Crest National Scenic Trail</header>
<subsection id="ID1cb4735f02134f5aa4484b8e4ff16530"><enum>(a)</enum><header>Conveyance
required</header><text>The Secretary of Agriculture shall convey to the Port of
Cascade Locks, Cascade Locks, Oregon (in this section referred to as the
<quote>Port</quote>), all right, title, and interest of the United States in
and to a parcel of National Forest System land in the Columbia River Gorge
National Scenic Area consisting of approximately 10 acres, as depicted on the
map entitled <quote>Port of Cascade Locks-Pacific Crest National Scenic Trail
Land Exchange</quote> and dated June 2006.</text>
</subsection><subsection id="ID7e14485bc8c34e0cb8685527c7031faf"><enum>(b)</enum><header>Consideration</header><text>As
consideration for the conveyance under subsection (a), the Port shall convey to
the United States all right, title, and interest of the Port in and to a parcel
of land consisting of approximately 40 acres, as depicted on the map referred
to in subsection (a). The acquisition of this land will ensure the continued
integrity of the Pacific Crest National Scenic Trail in the vicinity of Cascade
Locks and the public's ability to access the north Oregon entrance of the
trail.</text>
</subsection><subsection id="ID0b7f2f90a99f4011a9bbb9e7121d3bda"><enum>(c)</enum><header>Equal value
exchange</header><text>The values of the land to be exchanged under this
section shall be determined pursuant to an appraisal acceptable to the
Secretary of Agriculture and the Port. If the values are not equal, they shall
be equalized in the manner provided in section 206(b) of the Federal Land
Policy and Management Act of 1976 (43 U.S.C. 1716(b)).</text>
</subsection><subsection id="IDedf231054a5147a7930745044d3fc820"><enum>(d)</enum><header>Compliance with
existing law</header><text>Except as otherwise provided in this section, the
Secretary shall carry out the land exchange under this section in the manner
provided in section 206 of the Federal Land Policy Management Act of 1976 (43
U.S.C. 1716).</text>
</subsection><subsection id="ID86a93b8a7bbf49859684c8b9e1589248"><enum>(e)</enum><header>Conditions on
acceptance</header><text>Title to the non-Federal land to be acquired by the
Secretary of Agriculture under this section must be acceptable to the
Secretary, and the conveyances shall be subject to valid existing rights of
record. The non-Federal land shall conform with the title approval standards
applicable to Federal land acquisitions.</text>
</subsection><subsection id="ID342156fc696745df87bb5d4b97015154"><enum>(f)</enum><header>Legal

to the Secretary of Agriculture. The costs of such survey, as well as other
administrative costs incurred to execute the land exchange, shall be negotiated
between the Secretary and the Port.</text>
</subsection><subsection id="IDa417b92769684858985e54a63446e77c"><enum>(g)</enum><header>Existing
rights</header><text>The conveyance of Federal land under this section shall be
subject to valid existing rights of third parties. In the alternative, the
Secretary of Agriculture may grant substitute permit rights of equivalent
utility to use other Federal land.</text>
</subsection><subsection id="IDb695592871844c2c9f5cf83ab07d76ba"><enum>(h)</enum><header>Completion of
land exchange</header><text>The Secretary of Agriculture shall complete all
legal and regulatory processes required in connection with the conveyances
under this section and complete the closing of the conveyances within 16 months
after the date of the enactment of this Act.</text>
</subsection></section><section id="ID58da2296a25b45bdb61ae28896b66c7b"><enum>512.</enum><header>Hunchback
Mountain land exchange, Clackamas County</header>
<subsection id="ID81357594e768411fb3029f4543fed39e"><enum>(a)</enum><header>Conveyance
required</header><text>The Secretary of Agriculture shall convey to Clackamas
County, Oregon (in this section referred to as the <quote>County</quote>), all
right, title, and interest of the United States in and to a parcel of National
Forest System land in the Mount Hood National Forest consisting of
approximately 160 acres, as depicted on the map entitled <quote>Hunchback
Mountain Land Exchange-Clackamas County</quote> and dated June 2006.</text>
</subsection><subsection id="IDd84690d11e194f12843ed73e52d75556"><enum>(b)</enum><header>Consideration</header><text>As
consideration for the conveyance under subsection (a), the County shall convey
to the United States all right, title, and interest of the County in and to a
parcel of land consisting of approximately 160 acres, as depicted on the map
referred to in subsection (a). The acquisition of this parcel will ensure the
continued integrity of the forested land, a substantial portion of which
exceeds 120 years in age, and the public's access to the parcel.</text>
</subsection><subsection id="ID336db1dd003a43f39b0f1ef68927d35d"><enum>(c)</enum><header>Equal value
exchange</header><text>The values of the land to be exchanged under this
section shall be determined pursuant to an appraisal acceptable to the
Secretary of Agriculture and the County. If the values are not equal, they
shall be equalized in the manner provided in section 206(b) of the Federal Land
Policy and Management Act of 1976 (43 U.S.C. 1716(b)).</text>
</subsection><subsection id="IDd99bf5c11a66446db8b219e9e6b7a7ed"><enum>(d)</enum><header>Compliance with
existing law</header><text>Except as otherwise provided in this section, the
Secretary shall carry out the land exchange under this section in the manner
provided in section 206 of the Federal Land Policy Management Act of 1976 (43
U.S.C. 1716).</text>
</subsection><subsection id="IDbf502d5103fe42299938c7ff4e005046"><enum>(e)</enum><header>Conditions on
acceptance</header><text>Title to the non-Federal land to be acquired by the
Secretary of Agriculture under this section must be acceptable to the
Secretary, and the conveyances shall be subject to valid existing rights of
record. The non-Federal land shall conform with the title approval standards
applicable to Federal land acquisitions.</text>
</subsection><subsection id="IDd05aca520ebb469fab213363998fdb53"><enum>(f)</enum><header>Legal
descriptions</header><text>The exact acreage and legal description of the land
to be exchanged under this section shall be determined by surveys satisfactory
to the Secretary of Agriculture. The costs of any such survey, as well as other
administrative costs incurred to execute the land exchange, shall be negotiated
between the Secretary and the County.</text>
</subsection><subsection id="ID46804df8e40947c7ab937af12292c120"><enum>(g)</enum><header>Existing
rights</header><text>The conveyance of Federal land under this section shall be
subject to valid existing rights of third parties. In the alternative, the
Secretary of Agriculture may grant substitute permit rights of equivalent
utility to use other Federal land.</text>
</subsection><subsection id="IDf2cf53e3498a4e589f1651cf62f4e641"><enum>(h)</enum><header>Completion of
land exchange</header><text>The Secretary of Agriculture shall complete all
legal and regulatory processes required in connection with the land exchange
under this section and complete the closing of the land exchange not later than
16 months after the date of the enactment of this Act.</text>
</subsection></section></subtitle><enum>VI</enum><header>Mount Hood
National Forest and Watershed Stewardship </header>
<section id="id44239767521741118D84D5B7856A70EC"><enum>601.</enum><header>Findings and
purpose</header><text display-inline="no-display-inline">The purpose of this
title is to direct the Forest Service to prepare an assessment to promote
forested landscapes resilient to catastrophic fire, insects, and disease, to
protect homes and communities from property damage and threats to public
safety, and to protect and enhance existing community or municipal watersheds.
It is the intent of Congress that site-specific forest health projects
undertaken pursuant to this assessment shall be completed in accordance with
existing law.</text>
</section><section id="ID61d2a0f85fb34b559a8912df1498f873"><enum>602.</enum><header>Forest
stewardship assessment</header>
<subsection id="ID13a055d0aab14db496a2ea05eb8e2e48"><enum>(a)</enum><header>Preparation of
assessment</header><text>The Secretary of Agriculture shall prepare an
assessment to identify the forest health needs in those areas of the Mount Hood
National Forest with a high incidence of insect or disease infestation (or
both), heavily overstocked tree stands, or moderate-to-high risk of unnatural
catastrophic wildfire for the purpose of improving condition class, which
significantly improves the forest health and water quality. The Secretary may
utilize existing information to complete the assessment. The assessment shall
also identify specific projects to address these issues.</text>
</subsection><subsection id="IDd5d0ee2a665f425aa2c1760640d62933"><enum>(b)</enum><header>Improved
mapping</header><text>The assessment will include peer reviewed mapping of
condition class 2 and condition class 3 areas and other areas identified in
subsection (a) in Mount Hood National Forest.</text>
</subsection><subsection id="ID1a89c327537e43b1ad2c595ebe0f5180"><enum>(c)</enum><header>Completion</header><text>The
Secretary of Agriculture shall complete the assessment not later than 1 year
after the date of enactment of this Act.</text>
</subsection><subsection id="ID160cf2e8c4fb4e10b4dcd65708871724"><enum>(d)</enum><header>Duration of
study</header><text>The assessment shall cover a 10-year period.</text>
</subsection><subsection id="IDda4903c5883048d7bb970068b0000a5b"><enum>(e)</enum><header>Implementation</header><text>Not
later than 1 year after completion of the assessment, the Secretary shall
commence implementation of projects to address the needs identified in the
assessment. These projects shall be implemented using authorities available to
the Secretary to manage the Mount Hood National Forest to achieve the purpose
specified in subsection (a).</text>
</subsection><subsection id="IDa6ecc91061f54d088540aa4d57174546"><enum>(f)</enum><header>Delay</header><text>During
development of the assessment under this section, a forest management project
that is unaffiliated with the assessment and has completed review as required
under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) in
accordance with existing law, need not be delayed in the event the Secretary
fails to meet the deadline specified in subsection (c).</text>
</subsection><subsection id="ID316937378af74cd5988dac65a55633ae"><enum>(g)</enum><header>Relation to
existing law and plans</header><text>Nothing in this section grants the
Secretary any authority to manage the Mount Hood National Forest contrary to
existing law. The assessment conducted by the Secretary under this section
shall not supersede, be considered a supplement or amendment to, or in any way
affect the legal or regulatory authority of the Mount Hood National Forest Land
and Resource Management Plan or the collection of documents entitled
<quote>Final Supplemental Environmental Impact Statement and Record of Decision
for Amendments to Forest Service and Bureau of Land Management Planning
Documents Within the Range of the Northern Spotted Owl</quote> and
<quote>Standards and Guidelines for Management of Habitat for Late-Successional
and Old-Growth Forest-Related Species Within the Range of the Northern Spotted
Owl</quote>.</text>
</subsection><subsection id="IDcee1e4685a164227990ef4f9db347582"><enum>(h)</enum><header>Public
participation</header><text>The Secretary shall provide an opportunity for
interested persons to be involved in development of the assessment conducted by
the Secretary under this section.</text>
</subsection></section><section id="ID7e1bf910a2284741b054d35b99bf1c71"><enum>603.</enum><header>Sustainable
biomass utilization study</header>
<subsection id="ID0307ad44cbe441769e290e75a486d53b"><enum>(a)</enum><header>Study
required</header><text>The Secretary of Agriculture shall conduct a study to
assess the amount of long-term sustainable biomass available in the Mount Hood
National Forest that, consistent with applicable law, could be made available
as a raw material for—</text>
<paragraph id="IDa7437fa7398f4d69a3d8d419b90a3bc7"><enum>(1)</enum><text>the production of
electric energy, sensible heat, transportation fuel, or substitutes for
petroleum-based products;</text>
</paragraph><paragraph id="ID33badb645c5644a781dd479edba1f25a"><enum>(2)</enum><text>dimensional
lumber, fencing, framing material, poles, firewood, furniture, chips, or pulp
for paper; or</text>
</paragraph><paragraph id="ID5462180dcd1f4ad08ab383c8869c0701"><enum>(3)</enum><text>other commercial
purposes.</text>
</paragraph></subsection><subsection id="ID1565f7ff163d40df8094074e6eb16c67"><enum>(b)</enum><header>Definition</header><text>In
this section, the term <term>biomass</term> means small diameter trees and
understory vegetation that is removed from forested land as a by-product of
forest restoration efforts.</text>
</subsection></section><section id="ID29556660b28f48f7b880cd9b0aacc25d"><enum>604.</enum><header>Watershed
management memoranda of understanding</header>
<subsection id="ID82821929b5534e55ac60ecc6ed91d041"><enum>(a)</enum><header>Completion of
memoranda of understanding</header><text>To the extent that memoranda of
understanding or other legal agreements involving watersheds of Mount Hood
National Forest do not exist between irrigation districts or municipalities and
the Forest Service, the Secretary of Agriculture may complete memoranda of
understanding that outline stewardship goals to manage the watersheds for water
quality and water quantity.</text>
</subsection><subsection id="ID9b34cac5d5034fdcb28209435b4ec789"><enum>(b)</enum><header>Elements of
memorandum</header><text>A memorandum of understanding involving a watershed of
Mount Hood National Forest shall encourage adaptability, establish benchmarks
regarding water quality and water quantity, and require monitoring to determine
progress in meeting such benchmarks. The memorandum of understanding may
restrict public access to areas of the watershed where appropriate.</text>
</subsection><subsection id="ID962c64df709246b7a405f4e5736befd2"><enum>(c)</enum><header>Public process
required</header>
<paragraph id="IDdbada172d7264942a94aee14234a187f"><enum>(1)</enum><header>Collaboration
and consultation</header><text>The Secretary of Agriculture shall ensure that
the process by which the Secretary enters into a memorandum of understanding
with an irrigation district, local government, or other entity involving a
watershed of Mount Hood National Forest is based on collaboration and
cooperation between the Forest Service and local jurisdictions and other
interested persons.</text>
</paragraph><paragraph id="IDdb77f48d2826437e9fa81c94fae531b4"><enum>(2)</enum><header>Public meeting
required</header><text>The Secretary and the other party or parties to the
proposed memorandum of understanding shall hold at least 1 joint public meeting
before completing a final draft of the memorandum of understanding.</text>
</paragraph><paragraph id="IDd49de67d56ec4d43a70cdc4589c7b3cd"><enum>(3)</enum><header>Public
comment</header><text>A draft memorandum of understanding shall also be open to
public comment before being finalized.</text>
</paragraph></subsection></section><section id="ID0d89ffe6cc6c4bab9d720acffe7f3b62"><enum>605.</enum><header>Termination of
authority</header><text display-inline="no-display-inline">The authority
provided by this title shall terminate on the date that is 10 years after the
date of enactment of this Act.</text>
</section><enum>VII</enum><header>Crystal Springs
Watershed Special Resources Management Unit</header>
<section id="IDbf4cc4f8dbb941eba3ba853953ef0d25"><enum>701.</enum><header>Findings and
purpose</header><text display-inline="no-display-inline">The purpose of this
title is to establish a special resources management unit to ensure protection
of the quality and quantity of the Crystal Springs watershed as a clean
drinking water source for the residents of Hood River County, Oregon, while
also allowing visitors to enjoy its special scenic, natural, cultural, and
wildlife values.</text>
</section><section id="IDd13525ebbb00481e8a029f79b90bc648"><enum>702.</enum><header>Establishment
of Crystal Springs Watershed Special Resources Management Unit</header>
<subsection id="ID9ce1d4693bdf45caac627648ba1cfcdc"><enum>(a)</enum><header>Establishment</header><text>Effective
as provided by section 705, the Secretary of Agriculture shall establish a
special resources management unit in the State consisting of all National
Forest System land that is located within 200 yards from any point on the
perimeter of the Crystal Springs Zone of Contribution, as determined by the
Crystal Springs Water District, and other National Forest System land in and
around the Inn at Cooper Spur and the Cooper Spur Ski Area, as depicted on the
map entitled <quote>Crystal Springs Watershed Special Resources Management
Unit</quote> and dated June 2006 (in this subtitle referred to as the
<quote>official map</quote>).</text>
</subsection><subsection id="ID87b4fe330f604ad6b381025bf9895bc8"><enum>(b)</enum><header>Designation</header><text>The
special resources management unit established pursuant to subsection (a) shall
be known as the Crystal Springs Watershed Special Resources Management Unit, in
this title referred to as the <quote>Management Unit</quote>.</text>
</subsection><subsection id="IDc16da968d6d14622a73d03b4a05f7e6f"><enum>(c)</enum><header>Exclusion of
certain land</header><text>The Management Unit does not include any National
Forest System land otherwise covered by subsection (a) that is designated as
wilderness by title I.</text>
</subsection><subsection id="ID1376247b8d794fe6853a60b71313b8fa"><enum>(d)</enum><header>Withdrawal</header><text>Subject
to valid existing rights, National Forest System land included in the
Management Unit are permanently withdrawn from all forms of appropriation under
the public land laws, including the mining laws and mineral and geothermal
leasing laws.</text>
</subsection><subsection id="ID035536775c5440ca977b1aaf71710890"><enum>(e)</enum><header>Maps and legal
description</header>
<paragraph id="IDe110e08cfb504c65a50b722740c4a85e"><enum>(1)</enum><header>Submission of
legal descriptions</header><text>As soon as practicable after the effective
date specified in section 705, the Secretary shall prepare and submit to
Congress a legal description of the Management Unit.</text>
</paragraph><paragraph id="IDc011403c218f463a88f4beb0865ff84e"><enum>(2)</enum><header>Force of
law</header><text>The map referred to in subsection (a) and the legal
descriptions prepared under paragraph (1) shall have the same force and effect
as if included in this Act, except that the Secretary may correct technical
errors in the map and legal descriptions. The map of the Crystal Springs Zone
of Contribution is incorporated in this Act to delineate the boundaries of the
Management Unit, and the delineation of these boundaries is not intended to
affect the specific uses that may occur on private land within the boundaries
of the Management Unit.</text>
</paragraph><paragraph id="IDbe2e09d371494edab27f2ae93e582a7e"><enum>(3)</enum><header>Public
availability</header><text>The map referred to in subsection (a) and the legal
descriptions prepared under paragraph (1) shall be filed and made available for
public inspection in the appropriate offices of the Forest Service.</text>
</paragraph></subsection></section><section id="IDbca92c9234ca42159996855839809ce1"><enum>703.</enum><header>Administration
of Management Unit</header>
<subsection id="IDc4035d0eacff493698fc81238e9a1e70"><enum>(a)</enum><header>General
applicability of existing laws</header><text>Except as provided in this title,
all other laws and regulations affecting National Forest System lands shall
continue to apply to the National Forest System lands included in the
Management Unit.</text>
</subsection><subsection id="IDf51822f8c5f74400987cb420c1c4578d"><enum>(b)</enum><header>Authorized
activities</header>
<paragraph id="ID275bc93aa5304aa382e2c556f894bf05"><enum>(1)</enum><header>Process for
allowing activities</header><text>Only activities described in this subsection
may occur in the Management Unit, and the Secretary of Agriculture may permit
an activity described in this subsection to occur in the Management Unit only
after the Secretary—</text>
<subparagraph id="ID29a30c1b8b8b40a0aad1a19d972f8c80"><enum>(A)</enum><text>obtains the
review and opinions of the Crystal Springs Water District regarding the effect
of the activity on the purposes of the Management Unit;</text>
</subparagraph><subparagraph id="IDaa253b84831c44c39a2fedec037f20ca"><enum>(B)</enum><text>complies with all
applicable Federal law regarding development and implementation of the
activity; and</text>
</subparagraph><subparagraph id="IDd74cf1f55ba04b71a747cd797a2be38e"><enum>(C)</enum><text>when appropriate,
provides to the general public advance notice of the activity, an opportunity
to comment on the activity, and appeal rights regarding the activity.</text>
</subparagraph></paragraph><paragraph id="IDa6223401f5ca4c0e9f388b44cd3d10c6"><enum>(2)</enum><header>Recreation</header><text>The
Secretary may—</text>
<subparagraph id="ID88ca07518dfb4ef5bda565cfae023390"><enum>(A)</enum><text>continue to
maintain recreational opportunities and trails, in existence in the Management
Unit as of the effective date specified in section 705, within their existing
and historic footprints or at an alternative location; and</text>
</subparagraph><subparagraph id="ID7c0a30b996e14007b037e57daf173f17"><enum>(B)</enum><text>develop new
footpaths or cross-county skiing trails in the Management Unit.</text>
</subparagraph></paragraph><paragraph id="IDdfdbd5a531b14c23a589291042f92937"><enum>(3)</enum><header>Lease of
certain improvements</header><text>The Secretary may lease improvements and
facilities, in existence in the Management Unit as of the effective date
specified in section 705, within their existing and designated footprints to 1
or more concessionaires.</text>
</paragraph><paragraph id="IDe12c6af530bd4987b85b87a27940ca9f"><enum>(4)</enum><header>Road
maintenance</header><text>Subject to subsection (d), the Secretary may maintain
National Forest System roads, in existence in the Management Unit as of the
effective date specified in section 705 or as directed by the management plan
required by subsection (d). Maintenance may include the installation of
culverts and drainage improvements and other similar activities.</text>
</paragraph><paragraph id="ID1880bf38a5814f8193c67d81876a1a66"><enum>(5)</enum><header>Fuel reduction
in proximity to improvements and primary public roads</header><text>To protect
the water quality, water quantity, scenic, cultural, historic, natural, and
wildlife values of the Management Unit, the Secretary may permit fuel reduction
on National Forest System land in the Management Unit—</text>
<subparagraph id="IDad57754239524cae954056929feb8ceb"><enum>(A)</enum><text>extending up to
400 feet from structures on National Forest System land or structures on
adjacent private land; and</text>
</subparagraph><subparagraph id="IDda5a03a6118f41d6bf0cc075f6230e48"><enum>(B)</enum><text>extending up to
400 feet from the Cooper Spur Road, the Cloud Cap Road, and the Cooper Spur ski
area loop road.</text>
</subparagraph></paragraph><paragraph id="ID7f9853ca4af94fa2a879bca6e9486953"><enum>(6)</enum><header>Other fuel
reduction and forest health activities</header><text>The Secretary may conduct
fuel reduction and forest health management activities in the Management Unit,
with priority given to activities that restore previously harvested stands,
including the removal of logging slash, smaller diameter material, and ladder
fuels. The purpose of any fire risk reduction or forest health management
activity conducted in the Management Unit shall be the maintenance and
restoration of fire-resilient forest structures containing late successional
forest structure characterized by large trees and multi-storied canopies (where
ecologically appropriate) and the protection of the water quality, water
quantity, scenic, cultural, historic, natural, and wildlife values of the
Management Unit.</text>
</paragraph></subsection><subsection id="IDd5654e44c8e7415e8bcd5269a8260bde"><enum>(c)</enum><header>Specifically
prohibited activities</header><text>The following activities may not occur on
National Forest System land in the Management Unit, whether separately or,
except as provided in paragraph (2), as part of an activity authorized by
subsection (b):</text>
<paragraph id="ID8f5796610af540cfa58a1e53d93ba565"><enum>(1)</enum><text>New road
construction or renovation of existing non-System roads.</text>
</paragraph><paragraph id="ID3f02bd94c030453daf2ff43718cd42ee"><enum>(2)</enum><text>Projects
undertaken for the purpose of harvesting commercial timber. The harvest of
merchantable products that are by-products of activities conducted pursuant to
subsection (b)(6) and carried out pursuant to a stewardship contract are not
prohibited by this subsection.</text>
</paragraph><paragraph id="ID30256e35ca97445a80a610ed7c8aaed2"><enum>(3)</enum><text>Commercial
livestock grazing.</text>
</paragraph><paragraph id="IDc88aa84405a343f9a92a957aaa732f49"><enum>(4)</enum><text>The placement or
maintenance of fuel storage tanks.</text>
</paragraph><paragraph id="IDdf7af6f68a254c25b7e710980d47e250"><enum>(5)</enum><text>The application
of any toxic chemicals, including pesticides, rodenticides, herbicides, or
retardants, for any purpose, except with the consent of the Crystal Springs
Water District.</text>
</paragraph></subsection><subsection id="ID17560c0090bc44ad8dd1b849a254bfe7"><enum>(d)</enum><header>Management
plan</header>
<paragraph id="ID52446990cad5416981754b9874c98b00"><enum>(1)</enum><header>Plan
required</header><text>Within 9 months after the effective date specified in
section 605, the Secretary of Agriculture shall adopt a management plan for the
Management Unit that, while providing for the limited activities specifically
authorized by subsection (b), protects the watershed from illegal dumping,
human waste, fires, vandalism, and other risks to water quality.</text>
</paragraph><paragraph id="ID704a3cabcb1c412b889ed44ab6ba2c08"><enum>(2)</enum><header>Consultation
and public participation</header><text>The Secretary shall prepare the
management plan in consultation with the Crystal Springs Water District, the
Cooper Spur Wild and Free Coalition, and Hood River County and provide for
public participation as described in subsection (b)(1)(C).</text>
</paragraph></subsection><subsection id="ID4a49407cb51f440ab92f055ca4fe6d3d"><enum>(e)</enum><header>Forest road
closures</header><text>As part of the management plan required by subsection
(d), the Secretary of Agriculture may provide for the closure or gating to the
general public of any Forest Service road within the Management Unit, except
for the road commonly known as Cloud Cap Road.</text>
</subsection><subsection id="IDe22eb2347b4642fa842ac2c9a2865a95"><enum>(f)</enum><header>Private
land</header><text>Nothing in this section affects the use of, or access to,
any private property within the Crystal Springs Zone of Contribution by the
owners of the private property and their guests. The Secretary is encouraged to
work with interested private landowners who have voluntarily agreed to
cooperate with the Secretary to further the purposes of this title.</text>
</subsection><subsection id="ID82786e1a55914336b0b19771af82011c"><enum>(g)</enum><header>Relationship
with Water District</header><text>Except as provided in this section, the
Crystal Springs Water District has no authorities over management or use of
National Forest System land included in the Management Unit.</text>
</subsection></section><section id="ID9ee6f6bc94c54cc385dd8676ce2e4fc9"><enum>704.</enum><header>Acquisition of
lands</header>
<subsection id="ID12b137d0d7a54f0d9c302984b3fbff06"><enum>(a)</enum><header>Acquisition
authority</header><text>The Secretary of Agriculture may acquire from willing
landowners any lands located in the Crystal Springs Zone of Contribution within
the boundaries of Mount Hood National Forest. Lands so acquired shall
automatically be added to the Management Unit.</text>
</subsection><subsection id="IDa79409661db1480e80072ac28bd2c16c"><enum>(b)</enum><header>Prohibition on
subsequent conveyance</header><text>The Secretary may not sell, trade, or
otherwise transfer ownership of any land within the Management Unit, including
any of the land acquired under subsection (a) or received by the Secretary as
part of the Cooper Spur-Government Camp land exchange authorized by subtitle A
of title VIII and included within the Management Unit, to any person.</text>
</subsection></section><section id="IDae0973b312ce40e38a98d32fd4bc8ee4"><enum>705.</enum><header>Effective
date</header><text display-inline="no-display-inline">The Secretary of
Agriculture shall establish the Management Unit as soon as practicable after
the final closing of the Cooper Spur-Government Camp land exchange authorized
by subtitle A of title VIII, but in no case later than 30 days after the date
of the final closing of such land exchange. The Management Unit may not be
established before final closing of the land exchange.</text>
</section><enum>VIII</enum><header>Local and
tribal relationships</header>
<section id="idDC4D507DB0E74A679BB02B57D0ADED7B"><enum>801.</enum><header>Findings and
purpose</header><text display-inline="no-display-inline">The purpose of this
title is to recognize and support the ability of Native Americans to continue
to gather first foods in the Mount Hood National Forest using traditional
methods and the central role of the State and local governments in management
of issues dealing with natural and developed environments in the vicinity of
the national forest.</text>
</section><section id="IDf9701987e8ee429d95322f01de5688b9"><enum>802.</enum><header>First foods
gathering areas</header>
<subsection id="IDed635741367849b185323d9b9b3aa94b"><enum>(a)</enum><header>Priority use
areas</header><text>The Secretary of Agriculture shall identify, establish,
develop, and manage priority-use areas in Mount Hood National Forest for the
gathering of first foods by members of Indian tribes with treaty-reserved
gathering rights on lands encompassed by the national forest. The priority-use
areas shall be identified, established, developed, and managed in a manner
consistent with the memorandum of understanding entered into between the
Department of Agriculture, the Bureau of Land Management, the Bureau of Indian
Affairs, and the Confederated Tribes of the Warm Springs Reservation of Oregon
(in this section referred to as the <quote>Warm Springs Tribe</quote>) and
dated April 23, 2003, and such further agreements as are necessary between the
Secretary of Agriculture and the Warm Springs Tribe to carry out the purposes
of this section.</text>
</subsection><subsection id="ID7c9e0093c27f4cf3b2f5399c9feb3c0c"><enum>(b)</enum><header>Priority
use</header><text>Members of Indian tribes with treaty-reserved gathering
rights on lands encompassed by Mount Hood National Forest shall have exclusive
rights to gather first foods in the priority-use areas established pursuant to
subsection (a).</text>
</subsection><subsection id="ID53c3a78cd41446488b5b6b4344253363"><enum>(c)</enum><header>Applicable
law</header><text>In considering and selecting National Forest System land for
inclusion in a priority-use area under subsection (a), the Secretary of
Agriculture shall comply with the land and resource management plan for Mount
Hood National Forest and applicable laws.</text>
</subsection><subsection id="IDa635bb0242a44cc2b72feb8e3dab3abc"><enum>(d)</enum><header>Definition</header><text>In
this section, the term <term>first foods</term> means roots, berries, and
plants on National Forest System land in Mount Hood National Forest that have
been gathered for traditional and cultural purposes by members of Indian tribes
with treaty-reserved gathering rights on lands encompassed by Mount Hood
National Forest.</text>
</subsection></section><section id="IDaaa39d8dd988453eb416497bdd131cc7"><enum>803.</enum><header>Forest Service
coordination with State and local governments</header><text display-inline="no-display-inline">Congress encourages the Secretary of
Agriculture to cooperate with the State, local communities, counties, and
Indian tribes in the vicinity of Mount Hood National Forest, and the heads of
other Federal agencies to identify common ground, coordinate planning efforts
around the national forest, and make the Federal Government a better partner in
building cooperative and lasting solutions for management of Mount Hood
National Forest and non-Federal land in the vicinity of the national
forest.</text>
</section><section id="ID558ffe49732943b69671b6c8cb94e851"><enum>804.</enum><header>Savings
provisions regarding relations with Indian tribes</header>
<subsection id="ID668a2372d65f4750b43cb65ab5c23af0"><enum>(a)</enum><header>Treaty
rights</header><text>Nothing in this Act is intended to alter, modify, enlarge,
diminish, or extinguish the treaty rights of any Indian tribe, including the
off-reservation reserved rights established by the Treaty of June 25, 1855,
with the Tribes and Bands of Middle Oregon (12 Stat. 963). Section 702 is
consistent with and intended to implement the gathering rights reserved by such
treaty.</text>
</subsection><subsection id="ID52baeea15240485198279f17d644691b"><enum>(b)</enum><header>Tribal
lands</header><text>Nothing in this Act is intended to affect lands held in
trust by the Secretary of the Interior for Indian tribes or individual members
of Indian tribes or other lands acquired by the Army Corps of Engineers and
administered by the Secretary of the Interior for the benefit of Indian tribes
and individual members of Indian tribes.</text>
</subsection><subsection id="ID6f81cde0edb243bda13ff1533d369a93"><enum>(c)</enum><header>Hunting and
fishing</header><text>Nothing in this Act is intended to affect the laws,
rules, and regulations pertaining to hunting and fishing under existing State
and Federal laws and Indian treaties.</text>
</subsection></section><section id="ID2c01ea0f5cd749998450cc2a36b1eb5f"><enum>805.</enum><header>Improved
natural disaster preparedness</header>
<subsection id="ID2eb78d5c0a5b4eb4a57e6f7d67f1ad7f"><enum>(a)</enum><header>Imposition of
standards</header><text>New development occurring on land conveyed by the
Secretary of Agriculture under title V or undertaken or otherwise permitted by
the Secretary of Agriculture on National Forest System land in Mount Hood
National Forest after the date of the enactment of this Act shall be
constructed or altered in compliance with 1 of the nationally recognized model
building codes or wildland-urban interface codes and with other applicable
nationally recognized codes.</text>
</subsection><subsection id="ID226a5ade231147ecb2d57e8533dfe130"><enum>(b)</enum><header>Inclusion of
standards in land conveyances</header><text>In the case of each of the land
conveyances described in title V, the Secretary shall impose the requirements
of subsection (a) as a condition on the conveyance of the Federal land under
the conveyance.</text>
</subsection><subsection id="IDcc58f577d9c3451d86554d72fb02be8c"><enum>(c)</enum><header>Effect on State
and local law</header><text>To the maximum extent feasible, the codes imposed
pursuant to subsection (a) shall be consistent with the nationally recognized
codes adopted by the State or political subdivisions of the State. This section
shall not be construed to limit the power of the State or a political
subdivision of the State to implement or enforce any law, rule, regulation, or
standard concerning fire prevention and control.</text>
</subsection><subsection id="ID06c7034cf1ac4e9dbcb3a3c88b2fb5fa"><enum>(d)</enum><header>Enforcement</header><text>The
codes imposed pursuant to subsection (a) may be enforced by the same entities
otherwise enforcing building codes regarding new development occurring on land
conveyed by the Secretary of Agriculture under title V.</text>
</subsection></section><enum>IX</enum><header>Recreation</header>
<section id="idD2A16FC5B96A4980A474F7D21BCC6902"><enum>901.</enum><header>Findings and
purpose</header><text display-inline="no-display-inline">The purpose of this
title is to recognize and support recreation as a dynamic social and economic
component of the legacy and future of the Mount Hood National Forest.</text>
</section><section id="ID02decd4c3fc74774a6d76ce3d296239b"><enum>902.</enum><header>Retention of
Mount Hood National Forest land use fees from special use
authorizations</header>
<subsection id="ID1709abadff82434498cf9639fa2b1e8a"><enum>(a)</enum><header>Special
account</header><text>The Secretary of the Treasury shall establish a special
account in the Treasury for Mount Hood National Forest.</text>
</subsection><subsection id="IDc6ac262e3f644d6fa65c15ebc30e2cca"><enum>(b)</enum><header>Deposits</header><text>Except
as provided in section 7 of the Act of April 24, 1950 (commonly known as the
Granger-Thye Act; 16 U.S.C. 580d), the National Forest Organizational Camp Fee
Improvement Act of 2003 (title V of division F of Public Law 108–107; 16 U.S.C.
6231 et seq.), Public Law 106–206 (commonly known as the Commercial Filming
Act; 16 U.S.C. 460l–d), and the Federal Lands Recreation Enhancement Act (title
VIII of division J of Public Law 108–477; 16 U.S.C. 6801 et seq.), all land use
fees received after the date which is 6 months after the date of enactment of
this Act from special use authorizations, such as recreation residences,
resorts, winter recreation resorts, communication uses, and linear
rights-of-way, and all other special use types issued with regard to Mount Hood
National Forest shall be deposited in the special account established under
subsection (a).</text>
</subsection><subsection id="ID697d5fcb9af14eb2a33f15bb9bf5aae7"><enum>(c)</enum><header>Availability</header><text>Subject
to subsection (d), amounts in the special account established under subsection
(a) shall remain available, without further appropriation and until expended,
for expenditure as provided in section 903. Upon request of the Secretary of
Agriculture, the Secretary of the Treasury shall transfer to the Secretary of
Agriculture from the special account such funds as the Secretary of Agriculture
may request. The Secretary shall accept and use the funds in accordance with
section 903.</text>
</subsection><subsection id="IDece08ba9696247c7a841e633e6fb6000"><enum>(d)</enum><header>Termination of
special account</header><text>The special account required by subsection (a)
shall terminate at the end of the 10-year period beginning on the date of
enactment of this Act. Any amounts remaining in the special account at the end
of such period shall be transferred to the general fund of the Treasury.</text>
</subsection></section><section id="ID29d191ed9b644e1aaecf68d5b09eb03e"><enum>903.</enum><header>Use of funds
in special account to support recreation</header>
<subsection id="ID63a598985bc04f438606d27c76434eb5"><enum>(a)</enum><header>Authorized
uses</header><text>The Secretary of Agriculture shall use funds received from
the special account under section 902(c) for the following purposes related to
Mount Hood National Forest:</text>
<paragraph id="ID28c17bdbdb73491193f7215bfbc31569"><enum>(1)</enum><text>Installation,
repair, maintenance, and facility enhancement related directly to visitor
enjoyment, visitor access, and health and safety, such as—</text>
<subparagraph id="IDd6a178eabf6e4b73a0c7d751e798c19a"><enum>(A)</enum><text>the improvement
and maintenance of trails, including trails used for hiking, biking,
snowmobiling, horseback riding, cross-country skiing, and off-highway
vehicles;</text>
</subparagraph><subparagraph id="ID0ca8fb40937e4d89901f7f5779b6ef85"><enum>(B)</enum><text>water system
improvements; and</text>
</subparagraph><subparagraph id="IDfa9673382f3a45ec9849b3f43fc10616"><enum>(C)</enum><text>personal
sanitation facilities improvements.</text>
</subparagraph></paragraph><paragraph id="ID606c44dd93c249acb390858d4f46420c"><enum>(2)</enum><text>Interpretive
programs, visitor information, visitor services, visitor needs assessments,
mapping, signage, Leave-No-Trace materials, and wilderness rangers.</text>
</paragraph><paragraph id="ID14319b890e904e07a768c49741fb2e7d"><enum>(3)</enum><text>Habitat
restoration directly related to recreation.</text>
</paragraph><paragraph id="ID24d58bb0e916411cb422c0a77ba31978"><enum>(4)</enum><text>Cooperative
environmental restoration projects with non-Federal partnership groups and
associations, including groups and associations that work with youth.</text>
</paragraph><paragraph id="IDc7f58835a2cd4f31985aea191e742f1b"><enum>(5)</enum><text>Law enforcement
and rescue and recovery efforts related to public use and recreation, such as
law enforcement at recreation events, search and rescue operations, illegal
recreation activities investigations, and enforcement.</text>
</paragraph><paragraph id="IDc5fe14c1f41746328a66a269e09cabf6"><enum>(6)</enum><text>Improving
administration of special use authorizations.</text>
</paragraph><paragraph id="ID98046a056f2642de9ca19a90948a0395"><enum>(7)</enum><text>Preparation of
documents required under the National Environmental Policy Act of 1969 (42
U.S.C. 4321 et seq.) in connection with the improvement or development of
recreational opportunities.</text>
</paragraph><paragraph id="ID632c931f1cc545e0a802a0839979b34b"><enum>(8)</enum><text>Other projects or
partnerships recommended by the Mount Hood National Forest Recreation Working
Group established by section 905.</text>
</paragraph></subsection><subsection id="ID91eedb0c8acf446ca56e378f1bc5fb1f"><enum>(b)</enum><header>Allocation
requirements</header><text>Of the total funds received by the Secretary of
Agriculture from the special account under section 902(c) for a fiscal year,
the Secretary shall allocate the funds as follows:</text>
<paragraph id="IDf0378db1877342fc8fed75c678137f75"><enum>(1)</enum><text>95 percent of the
funds to Mount Hood National Forest.</text>
</paragraph><paragraph id="ID57c9bf82d23d488aaca47d90c68fc1b8"><enum>(2)</enum><text>5 percent of the
funds to the Regional Office for the Pacific Northwest Region of the Forest
Service to develop needed policy and training to support programs in wilderness
areas, special uses, trails, developed and dispersed recreation, and
interpretation related to Mount Hood National Forest.</text>
</paragraph></subsection></section><section id="IDe7beca18f61c4537b1dcbf997444e57d"><enum>904.</enum><header>Annual
reporting requirement</header><text display-inline="no-display-inline">The
Secretary of Agriculture shall submit to Congress an annual report
specifying—</text>
<paragraph id="IDaf848f0b11f14fa79220e10bf4596d5c"><enum>(1)</enum><text>the total funds
received by the Secretary from the special account under section 902(c) for the
preceding fiscal year;</text>
</paragraph><paragraph id="ID163d1084764949128d41424a9d3f2ed5"><enum>(2)</enum><text>how the funds
were allocated and expended; and</text>
</paragraph><paragraph id="ID5267b5535391475096aa2d8862958cab"><enum>(3)</enum><text>the results from
such expenditures.</text>
</paragraph></section><section id="IDb03ab23655e042de8fe19daaf3fb77b0"><enum>905.</enum><header>Mount hood
national forest recreational working group</header>
<subsection id="IDfe6950cbabd14427b46a8f1d8de54130"><enum>(a)</enum><header>Establishment
and purpose</header><text>The Secretary of Agriculture shall establish the
Mount Hood National Forest Recreational Working Group for the purpose of
providing advice and recommendations to the Forest Service on planning and
implementing recreation enhancements in Mount Hood National Forest, including
advice and recommendations regarding how the funds in the special account
established under section 902 should be requested and expended.</text>
</subsection><subsection id="ID76747f9126d648fea0dd0c33dc266ad5"><enum>(b)</enum><header>Duties</header><text>The
Working Group shall—</text>
<paragraph id="ID23f3626719bd458d9af481f42f82929c"><enum>(1)</enum><text>review projects
proposed by the Secretary for Mount Hood National Forest under section
903(a);</text>
</paragraph><paragraph id="ID160c02bdcc154ef9be0262750526dfaa"><enum>(2)</enum><text>propose projects
under section 903(a) to the Secretary;</text>
</paragraph><paragraph id="IDa6274f98cc34432c821e9a3052fbe608"><enum>(3)</enum><text>recommend the
amount of funds from the special account established under section 902 to be
used to fund projects under section 903; and</text>
</paragraph><paragraph id="ID39f3db1663d34063859c911f5ce712f5"><enum>(4)</enum><text>provide
opportunities for citizens, organizations, Indian tribes, the Forest Service,
and other interested parties to participate openly and meaningfully, beginning
at the early stages of the development of projects under section 903(a).</text>
</paragraph></subsection><subsection id="IDa21294a36d204e2697392f8740b13386"><enum>(c)</enum><header>Appointment</header>
<paragraph id="IDb5c9c78ef43442a2b585bad7d19dc628"><enum>(1)</enum><header>Appointment and
term</header><text>The Regional Forester, acting on behalf of the Secretary of
Agriculture, shall appoint the members of the Working Group for a term of 3
years beginning on the date of appointment. A member may be reappointed to
subsequent 3-year terms.</text>
</paragraph><paragraph id="ID1085d750eafa49b89841e20728e1d454"><enum>(2)</enum><header>Initial
appointment</header><text>The Regional Forester shall make initial appointments
to the Working Group not later than 180 days after the date of enactment of
this Act.</text>
</paragraph><paragraph id="ID99b562be550f44d8a71dc2b07fed48ae"><enum>(3)</enum><header>Vacancies</header><text>The
Regional Forester shall make appointments to fill vacancies on the Working
Group as soon as practicable after the vacancy has occurred.</text>
</paragraph><paragraph id="ID8ef2e0dd081143e7b87b48e1160cd373"><enum>(4)</enum><header>Compensation</header><text>Members
of the Working Group shall not receive any compensation for their service on
the Working Group.</text>
</paragraph><paragraph id="ID4303e5ea0f034937bea82ad818f68743"><enum>(5)</enum><header>Nominations</header><text>The
State and county governments for each county directly adjacent to or containing
any portion of Mount Hood National Forest may submit a nomination to the
Regional Forester for each activity or interest group category described in
subsection (d).</text>
</paragraph><paragraph id="IDf79f57b26caf404ab371058565c69b87"><enum>(6)</enum><header>Broad and
balanced representation</header><text>In appointing the members of the Working
Group, the Regional Forester shall provide for a balanced and broad
representation from the recreation community.</text>
</paragraph></subsection><subsection id="ID8830386255124b9499c3f5b671d21275"><enum>(d)</enum><header>Composition of
Working Group</header><text>The Working Group shall be composed of 15 members,
selected so that the following activities and interest groups are
represented:</text>
<paragraph id="ID6b3c22473e804af9a511e2764cfc1f2e"><enum>(1)</enum><text>Summer
non-mechanized recreation, such as hiking.</text>
</paragraph><paragraph id="ID0c8b344b95c44bcd8e33c47a8400566c"><enum>(2)</enum><text>Winter
non-motorized recreation, such as snowshoeing and backcountry skiing.</text>
</paragraph><paragraph id="ID43cbd2d7d07946d6a3ddb878e4239ac8"><enum>(3)</enum><text>Mountain
biking.</text>
</paragraph><paragraph id="IDe1b71f18f787478ebb92c4700701ca6e"><enum>(4)</enum><text>Hunting and
fishing.</text>
</paragraph><paragraph id="IDbe1b1c03920449508f4afba2a61f2013"><enum>(5)</enum><text>Summer motorized
recreation, such as off-highway vehicle use.</text>
</paragraph><paragraph id="ID7a228e28982144aeb624542a63ac0dd0"><enum>(6)</enum><text>Local
environmental groups.</text>
</paragraph><paragraph id="ID9f5ff9f547964c11ab55b9560ec94c95"><enum>(7)</enum><text>Winter motorized
recreation, such as snowmobiling.</text>
</paragraph><paragraph id="IDdee9322bdce3420e9c0a4f21e4ecb32b"><enum>(8)</enum><text>Permitted ski
areas.</text>
</paragraph><paragraph id="ID491235f066c747d9a50e19149abcc048"><enum>(9)</enum><text>Forest products
industry.</text>
</paragraph><paragraph id="ID2e82db51ee344c11a7debbfe65de5815"><enum>(10)</enum><text>Affected Indian
tribes.</text>
</paragraph><paragraph id="IDb77d0113b1e2429684d3263abe41a7d4"><enum>(11)</enum><text>Local holder of
a recreation residence permit.</text>
</paragraph><paragraph id="IDfaa38e8657b744cfa104a2c283a9ec19"><enum>(12)</enum><text>Local government
interests, such as a county commissioner or city mayor in an elected position
representing a county or city directly adjacent or containing any portion of
Mount Hood National Forest.</text>
</paragraph><paragraph id="ID112b3ff152854766a634145f64b00399"><enum>(13)</enum><text>A resident of
Government Camp.</text>
</paragraph><paragraph id="IDf628b8f6df4346b2857c998418129d70"><enum>(14)</enum><text>The
State.</text>
</paragraph><paragraph id="IDc0457fd716cc4c4b9c231a2e1a0402ce"><enum>(15)</enum><text>Operators of
campground facilities open to the general public.</text>
</paragraph></subsection><subsection id="ID7c560c71ff6e463d972a6cf9ff28e3b5"><enum>(e)</enum><header>Chairperson</header><text>The
chairperson of the Working Group shall be selected by a majority of the Working
Group.</text>
</subsection><subsection id="IDf0355b9d8ca344689591c93dc9300096"><enum>(f)</enum><header>Other Working
Group authorities and requirements</header>
<paragraph id="ID38bc86dc10ea457a8af55fcd0d54a558"><enum>(1)</enum><header>Staff
assistance</header><text>The Secretary of Agriculture shall provide staff
assistance to the Working Group from Federal employees under the jurisdiction
of the Secretary.</text>
</paragraph><paragraph id="IDd50475d0fe2a486a834c80555a712647"><enum>(2)</enum><header>Meetings</header><text>All
meetings of the Working Group shall be announced at least 1 week in advance in
a local newspaper of record and shall be open to the public.</text>
</paragraph><paragraph id="IDf1d3142d2f7b41f09a8594e62e2b1b08"><enum>(3)</enum><header>Records</header><text>The
Working Group shall maintain records of the meetings of the Working Group and
make the records available for public inspection.</text>
</paragraph></subsection><subsection id="ID5410474fb9bd4e72a6508ac3bb8216be"><enum>(g)</enum><header>Limitation on
administrative assistance</header><text>Not more than 5 percent of the funds
allocated under section 903(b) to Mount Hood National Forest for a fiscal year
may be used to provide administrative assistance to the Working Group during
that fiscal year.</text>
</subsection><subsection id="ID3415986bc76f4f1186ccfa299d3b7efb"><enum>(h)</enum><header>Federal
Advisory Committee Act</header><text>The Federal Advisory Committee Act (5
U.S.C. App.) shall not apply to the Working Group.</text>
</subsection><subsection id="IDd91e2a54a4f84f2ca676d9ea57200b80"><enum>(i)</enum><header>Termination of
Working Group</header><text>The Working Group shall terminate at the end of the
10-year period beginning on the date of enactment of this Act.</text>
</subsection></section><section id="ID7f91f14accab48dd89a6a23600ceead8"><enum>906.</enum><header>Consideration
of conversion of forest roads to recreational uses</header>
<subsection id="IDc004e3a79ae64f3bb8ff20e5d33d702b"><enum>(a)</enum><header>Evaluation of
currently closed roads</header>
<paragraph id="ID8ad89db295ba474ba09e0967830b1428"><enum>(1)</enum><header>Consideration
for recreational use</header><text>The Secretary of Agriculture may make a
determination regarding whether the Forest Service roads in Mount Hood National
Forest that were selected before the date of enactment of this Act for closure
and decommissioning, but have not yet been decommissioned, should be converted
to recreational uses to enhance recreational opportunities in the national
forest, such as conversion to single-track trails for mountain bikes and trails
for snowmobiling, off-road vehicle use, horseback riding, hiking, cross-country
skiing, and other recreational uses.</text>
</paragraph><paragraph id="IDa4f5db7d58374d1bbb9acf665f6d5646"><enum>(2)</enum><header>Consideration
of environmental and economic impacts</header><text>In evaluating the
feasibility and suitability of converting Forest Service roads under this
subsection to recreational uses, and the types of recreational uses to be
authorized, the Secretary shall take into account the environmental and
economic impacts of implementing the conversion and of the resulting
recreational uses.</text>
</paragraph><paragraph id="IDa336ff91c4d24600a0a47e9871deecb1"><enum>(3)</enum><header>Public
process</header><text>The consideration and selection of Forest Service roads
under this subsection for conversion to recreational uses, and the types of
recreational uses to be authorized, shall be a public process, including
consultation by the Secretary of Agriculture with the Mount Hood National
Forest Recreational Working Group.</text>
</paragraph></subsection><subsection id="ID161e9633a6fd48b4adca6c864acd8a63"><enum>(b)</enum><header>Future closure
considerations</header><text>Whenever the Secretary of Agriculture considers a
Forest Service road in Mount Hood National Forest for possible closure and
decommissioning after the date of enactment of this Act, the Secretary shall
include, as an alternative to decommissioning the road, consideration of
converting the road to recreational uses to enhance recreational opportunities
in the Mount Hood National Forest.</text>
</subsection></section><section id="IDb4e50950879747c09ce3e51fc7677aba"><enum>907.</enum><header>Improved trail
access for persons with disabilities</header>
<subsection id="ID7bfa5138f2844934803c2a571e42741c"><enum>(a)</enum><header>Construction of
trail</header><text>The Secretary of Agriculture may enter into a contract with
a partner organization or other person to design and construct a trail at a
location selected by the Secretary in Mount Hood National Forest suitable for
use by persons with disabilities.</text>
</subsection><subsection id="ID89b937e97fb640e2925b0d22fa58508a"><enum>(b)</enum><header>Public
process</header><text>The selection of the trail location under subsection (a)
and the preparation of the design of the trail shall be a public process,
including consultation by the Secretary of Agriculture with the Mount Hood
National Forest Recreational Working Group.</text>
</subsection><subsection id="ID6bd4037b96db49b2a3035aafb85f7035"><enum>(c)</enum><header>Funding</header><text>The
Secretary of Agriculture may use funds in the special account established under
section 902 to carry out this section.</text>
</subsection></section><enum>X</enum><header>Authorization of
appropriations</header>
<section id="id605414110EAA4E0FB9660A5DA943DA95"><enum>1001.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated such sums as are necessary to carry out this
Act.</text>
</section>
