		<official-title>To provide for the extension of preliminary permit
		  periods by the Federal Energy Regulatory Commission for certain hydroelectric
		  projects in the State of Alaska.</official-title>

		<section id="idE05EC418879D4A4CB402DE3663879E6E" section-type="section-one"><enum>1.</enum><header>Extension of preliminary
			 permit periods</header>
			<subsection id="idFC3742B70FDF45E69E83B2E5A0460E57"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="idED6075A83EF949678CF24EC1757E79BB"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Federal Energy Regulatory
			 Commission.</text>
				</paragraph><paragraph id="idF223825A75234C139314431E89A3B758"><enum>(2)</enum><header>Thomas Bay
			 project</header><text>The term <term>Thomas Bay project</term> means—</text>
					<subparagraph id="id1263094E527147ACB96CF0785D34E400"><enum>(A)</enum><text>the hydroelectric
			 project of the Commission at Cascade Creek, Alaska, preliminary permit number
			 12495, dated October 8, 2004;</text>
					</subparagraph><subparagraph id="id5E2048CD4C4E4555AC9CE9663BB253AD"><enum>(B)</enum><text>the hydroelectric
			 project of the Commission at Ruth Lake, Alaska, preliminary permit number
			 12619, dated February 23, 2006; and</text>
					</subparagraph><subparagraph id="id85D3BEB598E5467C8167BC8DE637524C"><enum>(C)</enum><text>the hydroelectric
			 project of the Commission at Scenery Lake, Alaska, preliminary permit number
			 12621, dated February 23, 2006.</text>
					</subparagraph></paragraph></subsection><subsection id="idC954F0C6E6784811A7BDFBBBAAB2271D"><enum>(b)</enum><header>Extension</header><text display-inline="yes-display-inline">Notwithstanding section 5 of the Federal
			 Power Act (16 U.S.C. 798) or any other provision of law (including
			 regulations), on receipt of a request from the preliminary permit holder of a
			 Thomas Bay project and after providing reasonable notice, the Commission may
			 extend the period of the preliminary permit for the Thomas Bay project for not
			 more than 2 consecutive 3-year periods following the expiration of the initial
			 preliminary permit for the Thomas Bay project, in accordance with applicable
			 procedures of the Commission.</text>
