		<section id="idD279FE5AC2534B34B7352C84A7B137E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Terrorism Prevention Act of
			 2006</short-title></quote>.</text>
		</section><section id="id8E138D4AEB674772BEF66AAF78D28670"><enum>2.</enum><header>Providing
			 material support to terrorist groups</header>
			<subsection id="ID12f9078cd7d74797a11772923c2137bc"><enum>(a)</enum><header>Offense of
			 rewarding or facilitating international terrorist acts</header>
				<paragraph id="ID53d7837b4b704b99b5a6152968748e57"><enum>(1)</enum><header>In
			 general</header><text>Chapter 113B of title 18, United States Code, is amended
			 by adding at the end the following section:</text>
					<quoted-block display-inline="no-display-inline" id="id7A306E25C81041F491EC8A352889239F" style="USC">
						<section id="ID751d9513ee594c5a92a7e34cd54ee034"><enum>2339E.</enum><header>Providing
				material support to international terrorism</header>
							<subsection id="id546E30AC813E4FC9ABA20F08D3D18489"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="id354092E3640F427EAD594E571CBCE097"><enum>(1)</enum><text>The term
				<term>material support or resources</term> has the same meaning as in section
				2339A(b).</text>
								</paragraph><paragraph id="idC57E5B7D152B4DB4A3E5B3DF18D3B67A"><enum>(2)</enum><text>The term
				<term>the perpetrator of an act</term> includes any person who—</text>
									<subparagraph id="id766E8B2DEA0C4E4A83D61ECFCD959523"><enum>(A)</enum><text>commits the
				act;</text>
									</subparagraph><subparagraph id="id2DFD9DD0DCBB4A5381DD1EA7B6C0CA74"><enum>(B)</enum><text>aids, abets,
				counsels, commands, induces, or procures its commission; or</text>
									</subparagraph><subparagraph id="idE0D8F60BA72D4FC8A5D755D6ABF17E25"><enum>(C)</enum><text>attempts, plots,
				or conspires to commit the act.</text>
									</subparagraph></paragraph><paragraph id="idD08C34721122416CB167798184532093"><enum>(3)</enum><text>The term
				<term>international terrorism</term> has the same meaning as in section
				2331.</text>
								</paragraph><paragraph id="id5E7876D6E73045ABB80D3C69F862C3E8"><enum>(4)</enum><text>The term
				<term>facility of interstate or foreign commerce</term> has the same meaning as
				in section 1958(b)(2).</text>
								</paragraph><paragraph id="idFA3349F5587F423385B559B3D66AEB85"><enum>(5)</enum><text>The term
				<term>serious bodily injury</term> has the same meaning as in section
				1365.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0FBB9CB514D478FBFF1C4E2CFA44533"><enum>(6)</enum><text>The term
				<term>national of the United States</term> has the same meaning as in section
				101(a)(22) of the Immigration and Nationality Act (8 U.S.C.
				1101(a)(22)).</text>
								</paragraph></subsection><subsection id="ID9db8d5841d04421082778d367b3086b8"><enum>(b)</enum><header>Prohibition</header><text>Whoever,
				in a circumstance provided in subsection (c), provides material support or
				resources to the perpetrator of an act of international terrorism, or to a
				family member or other person associated with such perpetrator, with the intent
				to facilitate, reward, or encourage that act or other acts of international
				terrorism, shall be fined under this title and imprisoned for any term of years
				not less than 10 or for life, and, if death results, shall be imprisoned for
				any term of years not less than 30 or for life.</text>
							</subsection><subsection id="IDb3d88b569ab14d5c82f4d14c691a6922"><enum>(c)</enum><header>Jurisdictional
				bases</header><text>A circumstance referred to in subsection (b) is—</text>
								<paragraph id="ID3d6e101bc19e40a2aed53a8b8b34601d"><enum>(1)</enum><text>the offense
				occurs in or affects interstate or foreign commerce;</text>
								</paragraph><paragraph id="IDc619101c8e714c37a071b44948bc9235"><enum>(2)</enum><text>the offense
				involves the use of the mails or a facility of interstate or foreign
				commerce;</text>
								</paragraph><paragraph id="IDf2e297687f164b53a2e47681a2732ee0"><enum>(3)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that affects interstate or foreign commerce or would have affected interstate
				or foreign commerce had it been consummated;</text>
								</paragraph><paragraph id="ID7091c091ae934ab68c42cc753ad3229e"><enum>(4)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that violates the criminal laws of the United States;</text>
								</paragraph><paragraph id="ID184f180cc65c4a07ad51735516e03cde"><enum>(5)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that is designed to influence the policy or affect the conduct of the United
				States Government;</text>
								</paragraph><paragraph id="IDb67d1104d93645478d8330250fc5e0a0"><enum>(6)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that occurs in part within the United States and is designed to influence the
				policy or affect the conduct of a foreign government;</text>
								</paragraph><paragraph id="ID4df202ad2c2546eca06379d7e21351db"><enum>(7)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that causes or is designed to cause death or serious bodily injury to a
				national of the United States while that national is outside the United States,
				or substantial damage to the property of a legal entity organized under the
				laws of the United States (including any of its States, districts,
				commonwealths, territories, or possessions) while that property is outside of
				the United States;</text>
								</paragraph><paragraph id="ID91d984103192448cae2290842cfe3fa1"><enum>(8)</enum><text>the offense
				occurs in whole or in part within the United States, and an offender intends to
				facilitate, reward or encourage an act of international terrorism that is
				designed to influence the policy or affect the conduct of a foreign government;
				or</text>
								</paragraph><paragraph id="IDee35735ae47a4b5a8dfde320da351a4b"><enum>(9)</enum><text>the offense
				occurs in whole or in part outside of the United States, and an offender is a
				national of the United States, a stateless person whose habitual residence is
				in the United States, or a legal entity organized under the laws of the United
				States (including any of its States, districts, commonwealths, territories, or
				possessions).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDdb3da622165c419dbe296f5f389424d1"><enum>(2)</enum><header>Technical and
			 conforming amendments</header>
					<subparagraph id="id84BB470D823D479D83139C1AE5DC057B"><enum>(A)</enum><header>Table of
			 sections</header><text>The table of sections for chapter 113B of title 18,
			 United States Code, is amended by adding at the end the following:</text>

			 penalties for providing material support to terrorists</header>
				<paragraph id="id4BFEF1E0BB04416B9856FD3E2F7FD834"><enum>(1)</enum><header>Providing
			 material support</header><text>Section 2339A(a) of title 18, United States
			 Code, is amended by striking <quote>, imprisoned not more than 15
			 years,</quote> and all that follows through <quote>life.</quote> and inserting
			 <quote>and imprisoned for any term of years not less than 10 or for life, and,
			 if the death of any person results, shall be imprisoned for any term of years
			 not less than 25 or for life.</quote>.</text>
				</paragraph><paragraph id="ID13DC0B380B854B068EF2BF4D9357E6B7"><enum>(2)</enum><header>Providing
			 material support or resources to designated foreign terrorist
			 organizations</header><text>Section 2339B(a) of title 18, United States Code,
			 is amended by striking <quote>or imprisoned not more than 15 years,</quote> and
			 all that follows through <quote>life.</quote> and inserting <quote>and
			 imprisoned for not less than 5 years and not more than 25 years, and, if the
			 death of any person results, shall be imprisoned for any term of years not less
			 than 20 or for life.</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFF02FD328DB142D095276C7F6784408C"><enum>(3)</enum><header>Receiving
			 Military-Type training from a foreign terrorist
			 organization</header><text>Section 2339D of title 18, United States Code, is
			 amended by striking <quote>or imprisoned for ten years, or both.</quote> and
			 inserting <quote>and imprisoned for not less than 3 years and not more than 15
			 years.</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9146F3AAF93E4D8194D902D71F8DE7A9"><enum>(c)</enum><header>Exceptions to
			 prohibition</header><text>Section 2339A(b)(1) of title 18, United States Code,
			 is amended by striking <quote>, except medicine or religious
			 materials</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id37372AB2A3B646B793E65EC150BA9FAE"><enum>(d)</enum><header>Addition of
			 attempts and conspiracies to an offense relating to military
			 training</header><text>Section 2339D of title 18, United States Code, is
			 amended by inserting <quote>, or attempts or conspires to receive,</quote>
			 after <quote>receives</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4F633D8C7FF245A28BF66A357548F384"><enum>(e)</enum><header>Denial of
			 federal benefits to convicted terrorists</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0EC2251ECA8A4F6FA0F93C7888F60306"><enum>(1)</enum><header>In
			 general</header><text>Chapter 113B of title 18, United States Code, as amended
			 by this section, is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF6A1EE6FFBEB484AB06BD7AE4C1449F8" style="USC">
						<section commented="no" display-inline="no-display-inline" id="id2BC3B355F4A34AD68AC49FF1B303F5FE"><enum>2339F.</enum><header>Denial of
				Federal benefits to terrorists</header>
							<subsection commented="no" display-inline="no-display-inline" id="id962D7DA19BE749348A4D1E5BA790936B"><enum>(a)</enum><header>In
				general</header><text>Any individual who is convicted of a Federal crime of
				terrorism (as defined in section 2332b(g)) shall, as provided by the court on
				motion of the Government, be ineligible for any or all Federal benefits for any
				term of years or for life.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idB04FF21899CA451ABD353FFA9F0BD701"><enum>(b)</enum><header>Federal benefit
				defined</header><text>In this section, <quote>Federal benefit</quote> has the
				meaning given that term in section 421(d) of the Controlled Substances Act (21
				U.S.C.
				862(d)).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6DE1E735553348C485D6FC09FA233807"><enum>(2)</enum><header>Technical and

			 Information Procedures Reform Act of 2006</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD8E7C1EBD92042A1A41369A0CB399FF2"><enum>(b)</enum><header>Interlocutory
			 appeals under the classified information procedures act</header><text>Section
			 7(a) of the Classified Information Procedures Act (18 U.S.C. App.) is amended
			 by adding at the end <quote>The Government's right to appeal under this section
			 applies without regard to whether the order appealed from was entered under
			 this Act.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id2EA92CDB54504E4BA5E70D0296E9FFA5"><enum>(c)</enum><header>Ex parte
			 authorizations under the classified information procedures
			 act</header><text>Section 4 of the Classified Information Procedures Act (18
			 U.S.C. App.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7848467F45AE4BFAA408DEEB4FF86C50"><enum>(1)</enum><text>in the second
			 sentence—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE7E2D54DD4604749BC9E1C6DA5FD3E27"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8A4F5FC42284DD88134ED4761F74DF9"><enum>(B)</enum><text>by striking
			 <quote>written statement to be inspected</quote> and inserting <quote>statement
			 to be made ex parte and to be considered</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id580B5F772FBD40E7AC35781EC7C03325"><enum>(2)</enum><text>in the third
			 sentence—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB0C82E960C654F96904FB5E5183E8BDE"><enum>(A)</enum><text>by striking
			 <quote>If the court enters an order granting relief following such an ex parte

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5E7E1A520E57481BA412C16BD05A52F4"><enum>(d)</enum><header>Application of
			 classified information procedures act to non-documentary
			 information</header><text>Section 4 of the Classified Information Procedures
			 Act (18 U.S.C. App.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC6F758F25D73480692097DFE46AD0629"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="traditional">, and access to,</header-in-text></quote> after
			 <quote><header-in-text level="section" style="traditional">of</header-in-text></quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3BD64FB248D4F558A2CCED14C39EE70"><enum>(2)</enum><text>by inserting
			 <quote>(a)<header-in-text level="subsection" style="USC"> Discovery of
			 classified information from documents.—</header-in-text></quote> before the
			 first sentence; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0324A0C0D6640059431A9DEE98C84A5"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5FC882AC472F4793ABB034479E1AFC62" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="idC41BE910C4F8487C92718047F3D9F141"><enum>(b)</enum><header>Access to other
				classified information</header>
							<paragraph id="ID90775f69d0b94301a100e80f077db34e"><enum>(1)</enum><text>If the defendant
				seeks access through deposition under the Federal Rules of Criminal Procedure
				or otherwise to non-documentary information from a potential witness or other
				person which he knows or reasonably believes is classified, he shall notify the
				attorney for the United States and the district court in writing. Such notice
				shall specify with particularity the classified information sought by the
				defendant and the legal basis for such access. At a time set by the court, the
				United States may oppose access to the classified information.</text>
							</paragraph><paragraph id="IDb2277cc7a2dc48f7936d51b19e54ebb9"><enum>(2)</enum><text>If, after
				consideration of any objection raised by the United States, including any
				objection asserted on the basis of privilege, the court determines that the
				defendant is legally entitled to have access to the information specified in
				the notice required by paragraph (1), the United States may request the
				substitution of a summary of the classified information or the substitution of
				a statement admitting relevant facts that the classified information would tend
				to prove.</text>
							</paragraph><paragraph id="ID52e7c219faed4bf4b56f24dd356ccf71"><enum>(3)</enum><text>The court shall
				permit the United States to make its objection to access or its request for
				such substitution in the form of a statement to be made ex parte and to be
				considered by the court alone. The entire text of the statement of the United
				States, as well as any summary of the classified information the defendant
				seeks to obtain, shall be sealed and preserved in the records of the court and
				made available to the appellate court in the event of an appeal.</text>
							</paragraph><paragraph id="ID6077ba1b8e224987976b76ca039578e4"><enum>(4)</enum><text>The court shall
				grant the request of the United States to substitute a summary of the
				classified information or to substitute a statement admitting relevant facts
				that the classified information would tend to prove if it finds that the
				summary or statement will provide the defendant with substantially the same
				ability to make his defense as would disclosure of the specific classified
				information.</text>
							</paragraph><paragraph id="ID45183470a59a430abe9682ba4d50f7e2"><enum>(5)</enum><text>A defendant may
				not obtain access to classified information subject to this subsection except
				as provided in this subsection. Any proceeding, whether by deposition under the
				Federal Rules of Criminal Procedure or otherwise, in which a defendant seeks to
				obtain access to such classified information not previously authorized by a
				court for disclosure under this subsection must be discontinued or may proceed
				only as to lines of inquiry not involving such classified
				information.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id8F89DE04FE2B4722836DBF626DECB216"><enum>4.</enum><header>Improvements to
			 the terrorist hoax statute</header>
			<subsection id="id03F8C8F45E5E457391DE5CCCE09E8914"><enum>(a)</enum><header>Hoax
			 statute</header><text>Section 1038 of title 18, United States Code, is
			 amended—</text>
				<paragraph id="id7782A1F63E7244DF8E29FF522EBF16F7"><enum>(1)</enum><text>in subsections
			 (a)(1) and (b), by striking <quote>a violation</quote> and all that follows
			 through <quote>title 49</quote> and inserting <quote>an offense listed under
			 section 2332b(g)(5)(B) of this title</quote>; and</text>
				</paragraph><paragraph id="idB708E85586D74A45AE7482A5C6CEC519"><enum>(2)</enum><text>in subsection
			 (a)(2)—</text>
					<subparagraph id="id04E45FEF73F24DC1AAD2E9DEDD658650"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>, imprisoned not more than 5 years, or both</quote> and
			 inserting <quote>and imprisoned for not less than 2 years nor more than 10
			 years</quote>;</text>
					</subparagraph><subparagraph id="id7F5E7DAA2C28419381327F9323E8914A"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>, imprisoned not more than 20 years, or both</quote>
			 and inserting <quote>and imprisoned for not less than 5 years nor more than 25
			 years</quote>; and</text>
					</subparagraph><subparagraph id="id7C2E1F4CD24C460F9391BE427ED55C81"><enum>(C)</enum><text>in subparagraph
			 (C), by striking <quote>, imprisoned for any term of years or for life, or
			 both</quote> and inserting <quote>and imprisoned for any term of years not less
			 than 10 or for life</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id4FA74B688AE74A019C6B49D6758AB353"><enum>(b)</enum><header>Threatening
			 communications</header>
				<paragraph id="IDca319258b84148ee93cf0e36adb317a0"><enum>(1)</enum><header>Mailed within
			 the United States</header><text>Section 876 of title 18, United States Code, is
			 amended by adding at the end thereof the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="idE235092105094422BE95D7FF650CCD21" style="OLC">
						<subsection id="ID73a7f18d90134ec6891a781dae1089e3"><enum>(e)</enum><text>For purposes of
				this section, the term <quote>addressed to any other person</quote> includes an
				individual (other than the sender), a corporation or other legal person, and a
				government or agency or component
				thereof.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDce804703286d49e4be8c4e1801137310"><enum>(2)</enum><header>Mailed to a
			 foreign country</header><text>Section 877 of title 18, United States Code, is
			 amended by adding at the end thereof the following new paragraph:</text>

						<subsection id="id12C948D0C4054406805B0DEE7501B054"><enum></enum><text>For purposes
				of this section, the term <quote>addressed to any person</quote> includes an

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idCD33B6B3D6404B1EAF819393EE8A4311"><enum>5.</enum><header>Terrorist
			 murders, kidnappings, and assaults</header>
			<subsection id="idC6C41183DE33498A8F24B02FDC6C13C1"><enum>(a)</enum><header>Homicide</header><text display-inline="yes-display-inline">Section 2332(a) of title 18, United States
			 Code, is amended—</text>
				<paragraph id="id2401FD2BF60A47688E7B39F8A34811E8"><enum>(1)</enum><text>by inserting
			 <quote>, or attempts or conspires to kill,</quote> after <quote>Whoever
			 kills</quote>; and</text>

			 2332(b) of title 18, United States Code, is amended to read as follows:</text>

					<subsection id="id08BA0BB651BB4AB09E1F257AEB30FE26"><enum>(b)</enum><header>Kidnapping</header><text>Whoever
				outside the United States unlawfully seizes, confines, inveigles, decoys,
				kidnaps, abducts, or carries away, or attempts or conspires to seize, confine,
				inveigle, decoy, kidnap, abduct or carry away, a national of the United States,
				shall be fined under this title and punished by imprisonment for any term of
				years not less than 20 or for life; and, if the death of any person results,
				shall be fined under this title and punished by death or imprisonment for
				life.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id64B1C749A4BF493A9743A46C613F56C5"><enum>(c)</enum><header>Other
			 conduct</header><text>Section 2332(c) of title 18, United States Code, is
			 amended—</text>
				<paragraph id="IDdabcd67a73214924a8853303ead2038b"><enum>(1)</enum><text>by inserting
			 <quote>(as defined in section 1365, including any conduct that, if the conduct
			 occurred in the special maritime and territorial jurisdiction of the United
			 States, would violate section 2241 or 2242)</quote> after <quote>injury</quote>
			 in paragraphs (1) and (2); and</text>
				</paragraph><paragraph id="IDffd79c5882674e7593f4b5c410efdbd4"><enum>(2)</enum><text>in the matter
			 following paragraph (2), by striking <quote>or imprisoned</quote> and all that
			 follows and inserting <quote>and imprisoned for any term of years not less than
			 10 or for life.</quote>.</text>
				</paragraph></subsection><subsection id="id4D3AEA4EF8F34122BF59FC1A760EAB6C"><enum>(d)</enum><header>Terrorist
			 offenses resulting in death</header>
				<paragraph id="id69E1011A439F430EB2FD082C4B961463"><enum>(1)</enum><header>In
			 general</header><text>Chapter 113B of title 18, United States Code, as amended
			 by this Act, is further amended by adding at the end the following:</text>

						<section id="id79DA54CCA19848CB9A92DB177496FF6C"><enum>2339G.</enum><header>Terrorist
				offenses resulting in death</header>
							<subsection id="ID730e5bb5980742abadc3fce5d3104ac0"><enum>(a)</enum><text>Whoever, in the
				course of committing a terrorist offense, engages in conduct that results in
				the death of a person, shall be punished by death or imprisoned for any term of
				years not less than 20 or for life.</text>
							</subsection><subsection id="ID0177f8407e9e4c5ea98dfa8747836d36"><enum>(b)</enum><text>In this section,
				the term <term>terrorist offense</term> means—</text>
								<paragraph id="IDed841dc8b40042b782129916f551946b"><enum>(1)</enum><text>a felony offense
				that is—</text>
									<subparagraph id="IDc41703c28b7340168cf161ef167f9c62"><enum>(A)</enum><text>a Federal crime
				of terrorism as defined in section 2332b(g), other than an offense under
				section 1363; or</text>
									</subparagraph><subparagraph id="IDa02336c8b597418cbcf102ec3e33eb86"><enum>(B)</enum><text>an offense under
				this chapter, section 175, 175b, 229, or 831, or section 236 of the Atomic
				Energy Act of 1954; or</text>
									</subparagraph></paragraph><paragraph id="IDa41a302f4e354ff387b0d6afbc5300d4"><enum>(2)</enum><text>a Federal offense
				that is an attempt or conspiracy to commit an offense described in paragraph
				(1).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 designed to destroy aircraft</header><text>Section 2332g(c)(3) of title 18,
			 United States Code, is amended by inserting <quote>death or</quote> before
			 <quote>imprisonment for life</quote>.</text>
				</paragraph><paragraph id="idFBC25CC9AD7E42AC90AC920EC36A7177"><enum>(3)</enum><header>Nuclear
			 material</header><text>Section 222b. of the Atomic Energy Act of 1954 (42
			 U.S.C. 2272) is amended by inserting <quote>death or</quote> before
			 <quote>imprisonment for life</quote> the last place it appears.</text>
				</paragraph><paragraph id="id3F1FC07ACA8D4DA5908BABDE125510B9"><enum>(4)</enum><header>Radiological
			 dispersal devices</header><text>Section 2332h(c)(3) of title 18, United States
			 Code, is amended by inserting <quote>death or</quote> before
			 <quote>imprisonment for life</quote>.</text>
				</paragraph><paragraph id="idAEBF9DBF5E114AE9B77687455A5C2920"><enum>(5)</enum><header>Variola
			 viruses</header><text>Section 175c(c)(3) of title 18, United States Code, is

			 terrorist crimes</header>
			<subsection id="id1F94944BF7654FBA995C435389A71F75"><enum>(a)</enum><header>Nondisclosure
			 of FISA investigations</header><text display-inline="yes-display-inline">The
			 following provisions of the Foreign Intelligence Surveillance Act of 1978 are
			 each amended by inserting <quote>(other than in proceedings or other civil
			 matters under the immigration laws, as that term is defined in section
			 101(a)(17) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(17)))</quote> after <quote>authority of the United
			 States</quote>:</text>

			 penalties for obstruction of justice in terrorism cases</header><text>Sections
