			 title <enum-in-header>35</enum-in-header>, United States Code</header><text display-inline="no-display-inline">Whenever in this Act a section or other
			 provision is amended or repealed, that amendment or repeal shall be considered
			 to be made to that section or other provision of title 35, United States
			 Code.</text>
		</section><section id="ID2260ba1a1e2e44b4b54952a823eaf1c2"><enum>3.</enum><header>Right of the
			 first inventor to file</header>
			<subsection id="ID5ca4c1ca538f4f41b07d7ebb37da6eab"><enum>(a)</enum><header>Definitions</header><text>Section
			 100 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFFC02A4F52CA455C8B2894FD974E82FE" style="OLC">
					<subsection id="IDa2d982c01f0b46aebbbefc542bcf4499"><enum>(f)</enum><text>The term
				<term>inventor</term> means the individual or, if a joint invention, the
				individuals collectively who invented or discovered the subject matter of the
				invention.</text>
					</subsection><subsection id="ID1e8f3ec13d7045d19a1a322570c31ec1"><enum>(g)</enum><text>The terms
				<term>joint inventor</term> and <term>coinventor</term> mean any 1 of the
				individuals who invented or discovered the subject matter of a joint
				invention.</text>
					</subsection><subsection id="ID879a13c4f54c4baca8e5edb7c131b55d"><enum>(h)</enum><text>The
				<term>effective filing date of a claimed invention</term> is—</text>
						<paragraph id="ID386112c97fbe4a6d9f5e8022179332b9"><enum>(1)</enum><text>the filing date
				of the patent or the application for patent containing the claim to the
				invention; or</text>
						</paragraph><paragraph id="ID11bf1a9197674d2fac7262c7ba1e8525"><enum>(2)</enum><text>if the patent or
				application for patent is entitled to a right of priority of any other
				application under section 119, 365(a), or 365(b) or to the benefit of an
				earlier filing date in the United States under section 120, 121, or 365(c), the
				filing date of the earliest such application in which the claimed invention is
				disclosed in the manner provided by the first paragraph of section 112.</text>
						</paragraph></subsection><subsection id="IDfd3d0de72f3148c4ab139c0961d15311"><enum>(i)</enum><text>The term
				<term>claimed invention</term> means the subject matter defined by a claim in a
				patent or an application for a patent.</text>
					</subsection><subsection id="ID83a2a8c6c3154210b269df526cfab85c"><enum>(j)</enum><text>The term
				<term>joint invention</term> means an invention resulting from the
				collaboration of inventive endeavors of 2 or more persons working toward the
				same end and producing an invention by their collective
				efforts.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID671301cd1b794cc4b756f892aa58ac12"><enum>(b)</enum><header>Conditions for
			 patentability</header>
				<paragraph id="ID4d60201b2d854a59aaf5d1b93c4272b2"><enum>(1)</enum><header>In
			 general</header><text>Section 102 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id7D0A255E78614D72A83F745095BFDC34" style="USC">
						<section id="ID64c92b85721c4d24a8927e2cc37c8a30"><enum>102.</enum><header>Conditions for
				patentability; novelty</header>
							<subsection id="IDe187721dff5b44c59062395b394373b2"><enum>(a)</enum><header>Novelty; prior
				art</header><text>A patent for a claimed invention may not be obtained
				if—</text>
								<paragraph id="IDe4eedd2f19614d6b99ab096e1489fd65"><enum>(1)</enum><text>the claimed
				invention was patented, described in a printed publication, or otherwise
				publicly known—</text>
									<subparagraph id="ID43ad4aa9703346d08db961517a7fde5f"><enum>(A)</enum><text>more than 1 year
				before the effective filing date of the claimed invention; or</text>
									</subparagraph><subparagraph id="IDde52e48b5ee6410fa024222904421955"><enum>(B)</enum><text>1 year or less
				before the effective filing date of the claimed invention, if the invention was
				patented or described in a printed publication or otherwise publicly known
				before the invention thereof by the applicant for a patent; or</text>
									</subparagraph></paragraph><paragraph id="ID547d61752f3f4ed6a1286439a1d4fe9c"><enum>(2)</enum><text>the claimed
				invention was described in a patent issued under section 151, or in an
				application for patent published or deemed published under section 122(b), in
				which the patent or application, as the case may be, names another inventor and
				was effectively filed before the effective filing date of the claimed
				invention.</text>
								</paragraph></subsection><subsection id="ID783e51ad68284961aa09a4e3798d1371"><enum>(b)</enum><header>Limitation on
				prior art</header>
								<paragraph id="ID9811d8e0f06c47a2ac1f9dae107e3439"><enum>(1)</enum><header>Derivation and
				common assignment exceptions</header><text>Subject matter that would otherwise
				qualify as prior art only under subsection (a)(2) shall not be prior art to a
				claimed invention if—</text>
									<subparagraph id="IDda698ef067f64d41bea08510a475651a"><enum>(A)</enum><text>the subject
				matter was obtained directly or indirectly from the inventor or a joint
				inventor; or</text>
									</subparagraph><subparagraph id="ID8a2960d3dd024f6f96857f009703bd79"><enum>(B)</enum><text>the subject
				matter and the claimed invention were, not later than the effective filing date
				of the claimed invention, owned by the same person or subject to an obligation
				of assignment to the same person.</text>
									</subparagraph></paragraph><paragraph id="IDf02eefe203624248870ac32497d3de4b"><enum>(2)</enum><header>Grace
				period</header><text>Subject matter disclosed in the prior art less than 1 year
				before the effective filing date of the claimed invention shall not preclude
				the patenting of a claimed invention under subsection (a) or section 103 if the
				claimed invention was made prior to the date the subject matter becomes prior
				art pursuant to section 102(b), if the subject matter disclosed was obtained
				directly or indirectly from an inventor of the claimed subject matter or the
				applicant.</text>
								</paragraph><paragraph id="IDf524d0b35753457db8485b18f8f8756c"><enum>(3)</enum><header>Patents and
				published applications effectively filed</header><text>A patent or application
				for patent is effectively filed under subsection (a)(2) with respect to any
				subject matter described in the patent or application—</text>
									<subparagraph id="ID2edd3ae8a7ca4ef9b668e9c67c1d800a"><enum>(A)</enum><text>as of the filing
				date of the patent or the application for patent; or</text>
									</subparagraph><subparagraph id="ID95d8230aeb6847a58982810da4c6f441"><enum>(B)</enum><text>if the patent or
				application for patent is entitled to claim a right of priority under section
				119, 365(a), or 365(b) or to claim the benefit of an earlier filing date under
				section 120, 121, or 365(c), based upon 1 or more prior filed applications for
				patent, as of the filing date of the earliest such application that describes
				the subject
				matter.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDac55413bedb34187a4e33eb63955ecf8"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The item relating to section 102 in the table of
			 sections for chapter 10 is amended to read as follows:</text>

			 <quote>at the time the invention was made</quote> and inserting <quote>before
			 the effective filing date of the claimed invention</quote>;</text>
					</subparagraph></paragraph><paragraph id="IDce573825cfb141bdafe669e1e28a1598"><enum>(2)</enum><text>by striking
			 subsection (b) and redesignating subsection (c) as subsection (b);</text>
				</paragraph><paragraph id="ID333b488cbd4d44e19cfeda3f54abb559"><enum>(3)</enum><text>by amending
			 subsection (b)(1), as so redesignated, to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idFA888FD83D5C4537AA42D8CE339C9FD5" style="OLC">

				developed by another person, which is disqualified as prior art under section
				102(b), shall not preclude patentability under this section if the subject
				matter and the claimed invention were owned by the same person, or subject to
				an obligation of assignment to the same person, on or before the effective
				filing date of the claimed invention.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID1623514080eb4f89a002df7fc86959bc"><enum>(4)</enum><text>in subsection
			 (b)(2)(A), as so redesignated, by striking <quote>the date the claimed
			 invention was made</quote> and inserting <quote>the effective filing date of
			 the claimed invention</quote>.</text>
				</paragraph></subsection><subsection id="ID8d90c782d133480b83ef776ce6a23439"><enum>(d)</enum><header>Repeal of
			 requirements for inventions made abroad</header><text>Section 104, and the item
			 relating to that section in the table of sections for chapter 10, are
			 repealed.</text>
			</subsection><subsection id="IDdf2016704a1f416d9e57c70895efdbbb"><enum>(e)</enum><header>Repeal of
			 statutory invention registration</header>
				<paragraph id="IDd9d99874eb1d45cb866b03b55e26b19a"><enum>(1)</enum><header>In
			 general</header><text>Section 157, and the item relating to that section in the
			 table of sections for chapter 14, are repealed.</text>
				</paragraph><paragraph id="ID4a5ed8b7784b4c60aa0162a15f59645c"><enum>(2)</enum><header>Removal of
			 cross references</header><text>Section 111(b)(8) is amended by striking
			 <quote>sections 115, 131, 135, and 157</quote> and inserting <quote>sections
			 131 and 135</quote>.</text>
				</paragraph></subsection><subsection id="ID22ee37ad3f374860aac04773ebf10e93"><enum>(f)</enum><header>Earlier filing
			 date for inventor and joint inventor</header><text>Section 120 is amended by
			 striking <quote>which is filed by an inventor or inventors named</quote> and
			 inserting <quote>which names an inventor or joint inventor</quote>.</text>
			</subsection><subsection id="IDd7363ec8fdf642228545fac6534de7fd"><enum>(g)</enum><header>Conforming
			 amendments</header>
				<paragraph id="ID31cecca30eff4aec9c87a4ad16d48662"><enum>(1)</enum><header>Right of
			 priority</header><text>Section 172 is amended by striking <quote>and the time
			 specified in section 102(d)</quote>.</text>
				</paragraph><paragraph id="ID68dd39c6f1f1448eb89ab3c9f76e9f8b"><enum>(2)</enum><header>Limitation on
			 remedies</header><text>Section 287(c)(4) is amended by striking <quote>the
			 earliest effective filing date of which is prior to</quote> and inserting
			 <quote>which has an effective filing date before</quote>.</text>
				</paragraph><paragraph id="ID07d17171658f44479bac1d2138eea9ac"><enum>(3)</enum><header>International
			 application designating the United States: effect</header><text>Section 363 is
			 amended by striking <quote>except as otherwise provided in section 102(e) of
			 this title</quote>.</text>

			 International application: effect</header><text>Section 374 is amended by

				</paragraph><paragraph id="ID753d5cd6fecf4265b0c19ea2803b9e7c"><enum>(5)</enum><header>Patent issued
			 on international application: effect</header><text>The second sentence of
			 section 375(a) is amended by striking <quote>Subject to section 102(e) of this
			 title, such</quote> and inserting <quote>Such</quote>.</text>
				</paragraph><paragraph id="IDa7f593d5ae7e46bda9df313678f4ef7e"><enum>(6)</enum><header>Limit on right
			 of priority</header><text>Section 119(a) is amended by striking <quote>; but no
			 patent shall be granted</quote> and all that follows through <quote>one year
			 prior to such filing</quote>.</text>
				</paragraph><paragraph id="ID206277d7a2474c07b85271a8a7861f55"><enum>(7)</enum><header>Inventions made
			 with Federal assistance</header><text>Section 202(c) is amended—</text>
					<subparagraph id="ID4e8874fe30214c43b3e26d8dd31a1024"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="ID2ba990f2850d48f8b279a860a73ed384"><enum>(i)</enum><text>by
			 striking <quote>publication, on sale, or public use,</quote> and all that
			 follows through <quote>obtained in the United States</quote> and inserting
			 <quote>the 1-year period referred to in section 102(a) would end before the end
			 of such 2-year period</quote>; and</text>
						</clause><clause id="ID7d6c859bbd0c491fa8a81481ae3e0ed9"><enum>(ii)</enum><text>by
			 striking <quote>the statutory</quote> and inserting <quote>the 1-year</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="id69CA177892AF403F8CFC65B12DFD315F"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>any statutory bar date that may occur under this title due
			 to publication, on sale, or public use</quote> and inserting <quote>the
			 expiration of the 1-year period referred to in section 102(a)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdd0f8fe47be548a88b4c8e71c148e5bd"><enum>(h)</enum><header>Repeal of
			 interfering patent remedies</header><text>Section 291, and the item relating to
			 that section in the table of sections for chapter 29, are repealed.</text>
			</subsection><subsection commented="no" id="ID7ffa5b07f29e4bb28d175bd57f076d15"><enum>(i)</enum><header>Action for
			 claim to patent on derived invention</header><text>Section 135(a) is amended to
			 read as follows:</text>

					<subsection id="ID08648f9fc8fd4e58bd1ccc85b403fdd7"><enum>(a)</enum><header>Dispute over
				right to patent</header>
						<paragraph id="ID9e114f81c49a4edd8de98ffb31d9882f"><enum>(1)</enum><header>Institution of
				inventor’s rights contest</header><text>An applicant may request initiation of
				a derivation proceeding to determine the right of the applicant to a patent by
				filing a request which sets forth with particularity the basis for finding that
				an earlier applicant derived the claimed invention and without authorization
				filed an application claiming such invention. Any such request shall be made
				within 12 months of the date of first publication of an application containing
				a claim that is the same or is substantially the same as the claimed invention,
				under oath and supported by substantial evidence. Whenever patents or
				applications for patent naming different individuals as the inventor are
				determined by the Director to interfere because of a dispute over the right to
				patent under section 101, the Director shall institute an inventor’s rights
				contest for the purpose of determining which applicant is entitled to a
				patent.</text>
						</paragraph><paragraph id="IDd127bb347ea542339bbebbc493327a40"><enum>(2)</enum><header>Requirements</header><text>No
				proceeding shall be commenced under this subsection unless the party requesting
				the proceeding has filed an application that—</text>
							<subparagraph id="IDdb786dccb92649969bb1da1ce7669e8a"><enum>(A)</enum><text>was filed not
				later than 18 months after the effective filing date of the application or
				patent deemed to interfere with the subsequent application or patent;
				and</text>
							</subparagraph><subparagraph id="ID0dfb7a1caeeb4c2b86d7c9cb2b189b8a"><enum>(B)</enum><text>did not, within 1
				year of the earliest effective filing date of the application, contain a claim
				that is the same or substantially the same as the invention claimed in the
				earlier filed application;</text>
							</subparagraph></paragraph><paragraph id="ID32f713d970b3492991a6f37f7c2e1990"><enum>(3)</enum><header>Determination
				by Patent Trial and Appeal Board</header><text>In any proceeding under this
				subsection, the Patent Trial and Appeal Board—</text>
							<subparagraph id="ID20153a1e4bcf41a087e89d0cb9bdf677"><enum>(A)</enum><text>shall determine
				the question of the right to patent;</text>
							</subparagraph><subparagraph id="ID5c71f6f6e6934431a576d782d79ed9e1"><enum>(B)</enum><text>in appropriate
				circumstances, may correct the naming of the inventor in any application or
				patent at issue; and</text>
							</subparagraph><subparagraph id="ID8e7858442c1146b18e6efe2e8349b4be"><enum>(C)</enum><text>shall issue a
				final decision on the right to patent.</text>
							</subparagraph></paragraph><paragraph id="ID04152e5fc6314332899d2144c049bfe0"><enum>(4)</enum><header>Derivative
				proceeding</header><text>The Board may defer action on a request to initiate a
				derivation proceeding until 3 months after the date on which the Director
				issues a patent to the applicant that filed the earlier application.</text>
						</paragraph><paragraph id="ID789db523b09747cdabf61116f1d7d207"><enum>(5)</enum><header>Effect of final
				decision</header><text>The final decision of the Patent Trials and Appeal
				Board, if adverse to the claim of an applicant, shall constitute the final
				refusal by the Patent and Trademark Office on the claims involved. The Director
				may issue a patent to an applicant who is judged to have the right to patent.
				The final decision of the Board, if adverse to a patentee, shall, if no appeal
				or other review of the decision has been or can be taken or had, constitute
				cancellation of the claims involved in the patent, and notice of such
				cancellation shall be endorsed on copies of the patent distributed after such
				cancellation by the Patent and Trademark
				Office.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID0cbe10af82b74d718b5f8cb1a69556df"><enum>(j)</enum><header>Patent Trial
			 and Appeal Board</header>
				<paragraph id="ID7ac0b0b5ff674d00acda11476b7667f3"><enum>(1)</enum><header>Elimination of
			 references to interferences</header>
					<subparagraph id="ID042cf850e68b4047b211a6b4f1ec9611"><enum>(A)</enum><text>Sections 6, 41,
			 134, 141, 145, 146, 154, 305, and 314 are each amended by striking <quote>Board
			 of Patent Appeals</quote> each place it appears and inserting <quote>Patent
			 Trial and Appeal Board</quote>.</text>
					</subparagraph><subparagraph id="ID00f1d8afd1184f758da08bffa4f20b44"><enum>(B)</enum><text>Sections 135,
			 141, 146, and 154 are each amended by striking <quote>interference</quote> each
			 place it appears and inserting <quote>inventor's rights contest</quote>.</text>

			 or declaration</header>
			<subsection id="ID70706383c01f45f7b338f34836e03d7a"><enum>(a)</enum><header>Inventor’s oath
			 or declaration</header>
				<paragraph id="ID6f7b600d4edd4250828a47697b1cddc5"><enum>(1)</enum><header>In
			 general</header><text>Section 115 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idDBA3F4FF8A7F4B058901C34F464F3EA2" style="USC">
						<section id="IDb0c4aadc2803419497112d927366640b"><enum>115.</enum><header>Inventor’s
				oath or declaration</header>
							<subsection id="IDeeaf697be00249379ded4f0b447853c9"><enum>(a)</enum><header>Naming the
				inventor; inventor’s oath or declaration</header><text>An application for
				patent that is filed under section 111(a), that commences the national stage
				under section 363, or that is filed by an inventor for an invention for which
				an application has previously been filed under this title by that inventor
				shall include, or be amended to include, the name of the inventor of any
				claimed invention in the application. Except as otherwise provided in this
				section, an individual who is the inventor or a joint inventor of a claimed
				invention in an application for patent shall execute an oath or declaration in
				connection with the application.</text>
							</subsection><subsection id="IDb8ffa8fc12f3404f825d0507265c3541"><enum>(b)</enum><header>Required
				statements</header><text>An oath or declaration under subsection (a) shall
				contain statements that—</text>
								<paragraph id="IDfd2944b0ea814dcf9ac6a0c288c18888"><enum>(1)</enum><text>the application
				was made or was authorized to be made by the affiant or declarant; and</text>
								</paragraph><paragraph id="ID4d10dd5756ae426495ad47945c906bdc"><enum>(2)</enum><text>such individual
				believes himself or herself to be the original inventor or an original joint
				inventor of a claimed invention in the application.</text>
								</paragraph></subsection><subsection id="ID3cfa6d63952644d3897d907475088450"><enum>(c)</enum><header>Additional
				requirements</header><text>The Director may specify additional information
				relating to the inventor and the invention that is required to be included in
				an oath or declaration under subsection (a).</text>
							</subsection><subsection id="ID4d97b87640ea405a900d67a45d5ea64b"><enum>(d)</enum><header>Substitute
				statement</header>
								<paragraph id="ID407bd61f750845fb86e4fbd148b4f216"><enum>(1)</enum><header>In
				general</header><text>In lieu of executing an oath or declaration under
				subsection (a), the applicant for patent may provide a substitute statement
				under the circumstances described in paragraph (2) and such additional
				circumstances that the Director may specify by regulation.</text>
								</paragraph><paragraph id="ID69f5a03c2f094fbea9cfaf9fb02ff151"><enum>(2)</enum><header>Permitted
				circumstances</header><text>A substitute statement under paragraph (1) shall be
				permitted with respect to any individual who, at the time the substitute
				statement is filed—</text>
									<subparagraph id="ID354e809f299848d7abf5b9d1d233fb84"><enum>(A)</enum><text>is
				deceased;</text>
									</subparagraph><subparagraph id="ID59e790b88dac48a6aced12bd6f89bd0f"><enum>(B)</enum><text>is under legal
				incapacity;</text>
									</subparagraph><subparagraph id="IDda1232cdb82c4f22979755a343c86064"><enum>(C)</enum><text>is under an
				obligation to assign the invention, but has refused to make the oath or
				declaration required under subsection (a); or</text>
									</subparagraph><subparagraph id="ID1c09176f37bb4a0594521dc50ca97f41"><enum>(D)</enum><text>cannot be found
				or reached after diligent effort.</text>
									</subparagraph></paragraph><paragraph id="ID7365ece553b04a80a2e2b4f91c289e5a"><enum>(3)</enum><header>Contents</header><text>A
				substitute statement under this subsection shall—</text>
									<subparagraph id="IDc028289bd41b4d4ea857ba1787b322ec"><enum>(A)</enum><text>identify the
				individual with respect to whom the statement applies;</text>
									</subparagraph><subparagraph id="ID2126d71044464433ba3385a5c7dcfd8d"><enum>(B)</enum><text>set forth the
				circumstances representing the permitted basis for the filing of the substitute
				statement in lieu of the oath or declaration under subsection (a); and</text>
									</subparagraph><subparagraph id="ID560abdcb342c4ccea9ba2c2994804666"><enum>(C)</enum><text>contain any
				additional information, including any showing, required by the Director.</text>
									</subparagraph></paragraph></subsection><subsection id="IDbdf2a52d172a43d0879431562a0131dd"><enum>(e)</enum><header>Making required
				statements in assignment of record</header><text>An individual who is under an
				obligation of assignment of an application for patent may include the required
				statements under subsections (b) and (c) in the assignment executed by the
				individual, in lieu of filing such statements separately.</text>
							</subsection><subsection id="ID6252be9670d241b79d65f3255e3dc7e0"><enum>(f)</enum><header>Time for
				filing</header><text>A notice of allowance under section 151 may be provided to
				an applicant for patent only if the applicant for patent has filed each
				required oath or declaration under subsection (a) or has filed a substitute
				statement under subsection (d) or recorded an assignment meeting the
				requirements of subsection (e).</text>
							</subsection><subsection id="ID2591e6d6ee134e2eab1a5798e703a4d0"><enum>(g)</enum><header>Earlier-filed
				application containing required statements or substitute
				statement</header><text>The requirements under this section shall not apply to
				an individual with respect to an application for patent in which the individual
				is named as the inventor or a joint inventor and that claims the benefit under
				section 120 or 365(c) of the filing of an earlier-filed application, if—</text>
								<paragraph id="IDcc348827aec94bfbb46f30458eb5bee7"><enum>(1)</enum><text>an oath or
				declaration meeting the requirements of subsection (a) was executed by the
				individual and was filed in connection with the earlier-filed
				application;</text>
								</paragraph><paragraph id="ID0ed49787c5ab4ee1bc65d27f4f1d4c80"><enum>(2)</enum><text>a substitute
				statement meeting the requirements of subsection (d) was filed in the earlier
				filed application with respect to the individual; or</text>
								</paragraph><paragraph id="ID81ff3a87c70c4f759dc2ee8cb4815798"><enum>(3)</enum><text>an assignment
				meeting the requirements of subsection (e) was executed with respect to the
				earlier-filed application by the individual and was recorded in connection with
				the earlier-filed application.</text>
								</paragraph></subsection><subsection id="ID1268c3b923da44658c82dd4cfefbe77f"><enum>(h)</enum><header>Supplemental
				and corrected statements; filing additional statements</header>
								<paragraph id="ID2a62449858a841bcb0fbb68ec82686fa"><enum>(1)</enum><header>In
				general</header><text>A statement made under this section may be withdrawn,
				replaced, or otherwise corrected at any time. If a change is made in the naming
				of the inventor requiring the filing of 1 or more additional statements under
				this section, the Director shall establish regulations under which such
				additional statements may be filed.</text>
								</paragraph><paragraph id="IDb21c9db2ae7d44f09d0a563b8a146bfd"><enum>(2)</enum><header>Supplemental
				statements not required</header><text>If an individual has executed an oath or
				declaration under subsection (a) or an assignment meeting the requirements of
				subsection (e) with respect to an application for patent, no supplemental oath
				or declaration or further substitute statement shall thereafter be required in
				connection with the application for patent or any patent issuing
				thereon.</text>
								</paragraph><paragraph id="IDd47c0235733d41d0a2fff36f107be8e5"><enum>(3)</enum><header>Savings
				clause</header><text>No patent shall be invalid or unenforceable based upon the
				failure to comply with a requirement under this section if the failure is
				remedied as provided under paragraph
				(1).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDd260dec7489441b8bdc165c7341648c5"><enum>(2)</enum><header>Relationship to
			 divisional applications</header><text>Section 121 is amended by striking

				non-exclusive marketplace licensing of the invention; and</text>
								</subparagraph><subparagraph id="idC7786D4BA89840F49415E8A5FEE4D944"><enum>(C)</enum><text>other relevant
				factors in applicable
				law.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDb0cb92e31cf143cc8b6b67536cdaa3d8"><enum>(2)</enum><text>by amending the
			 second paragraph to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idF49E6B8D3E2D49E9BF23C49801CA1A2B" style="OLC">
						<subsection id="ID476084473f4d4934b34f0c61b300222a"><enum>(b)</enum><header>Willful
				infringement</header>
							<paragraph id="ID7d2b938f7031432f9296194ca57cbdc0"><enum>(1)</enum><header>Increased
				damages</header><text>A court that has determined that the infringer has
				willfully infringed a patent or patents may increase the damages up to 3 times
				the amount of damages found or assessed under subsection (a), except that
				increased damages under this paragraph shall not apply to provisional rights
				under section 154(d).</text>
							</paragraph><paragraph id="ID9214f785997241af82ff225f9950544a"><enum>(2)</enum><header>Permitted
				grounds for willfulness</header><text>A court may find that an infringer has
				willfully infringed a patent only if the patent owner presents clear and
				convincing evidence that—</text>
								<subparagraph id="IDfa4c150e2e3d4a93b3e64f48cfbadf1b"><enum>(A)</enum><text>the infringer,
				having received adequate written notice from the patentee, after a reasonable
				opportunity to investigate, thereafter performed 1 or more of the alleged acts
				of infringement;</text>
								</subparagraph><subparagraph id="ID0c91e91d106f4f28ac783e9fad93dbc3"><enum>(B)</enum><text>the infringer
				intentionally copied the patented invention with knowledge that it was
				patented; or</text>
								</subparagraph><subparagraph id="ID0f8b3e75296e4940baac9a682ed6f2fc"><enum>(C)</enum><text>after having been
				found by a court to have infringed that patent, the infringer engaged in
				conduct that was not colorably different from the conduct previously found to
				have infringed the patent, and which resulted in a separate finding of
				infringement of the same patent.</text>
								</subparagraph></paragraph><paragraph id="IDb09c9a500b2d447980df9380cd04218a"><enum>(3)</enum><header>Written
				notice</header><text>For purposes of paragraph (2), written notice shall be
				adequate only if such notice—</text>
								<subparagraph id="ID6ea9646367694083b93232c02b575f12"><enum>(A)</enum><text>alleges acts of
				infringement in a manner sufficient to give the infringer an objectively
				reasonable apprehension of suit on such patent, and</text>
								</subparagraph><subparagraph id="ID7146f35bcca446ef8acab453fe72c943"><enum>(B)</enum><text>identifies with
				particularity each claim of the patent, each product or process that the patent
				owner alleges infringes the patent, and the relationship of such product or
				process to such claim, the infringer.</text>
								</subparagraph></paragraph><paragraph id="ID88eb240932be46b1b530cef9553908ac"><enum>(4)</enum><header>Limitations on
				willfulness</header>
								<subparagraph id="idEB85D70CDFF94D03B3EDE9C8A0D473B2"><enum>(A)</enum><header>In
				general</header><text>A court shall not find that an infringer has willfully
				infringed a patent under paragraph (2) for any period of time during which the
				infringer had an informed good faith belief that the patent was invalid or
				unenforceable, or would not be infringed by the conduct later shown to
				constitute infringement of the patent.</text>
								</subparagraph><subparagraph id="idC13875B81C40475F9D9E76A1976574AC"><enum>(B)</enum><header>Informed good
				faith belief</header><text>For purposes of this paragraph, an informed good
				faith belief may be established by—</text>
									<clause id="idF8FB611E57244E8B971567562B58451E"><enum>(i)</enum><text>reasonable
				reliance on advice of counsel;</text>
									</clause><clause id="id703DE54673274DFEB5107231C8CDFB96"><enum>(ii)</enum><text>evidence that
				the infringer sought to modify its conduct to avoid infringement once it had
				discovered the patent; or</text>
									</clause><clause id="id46C2C7C0A3054333A2F8329C25160CEF"><enum>(iii)</enum><text>other evidence
				a court may find sufficient to establish such good faith belief.</text>
									</clause></subparagraph><subparagraph id="id5C3B75C8E6774F558F1C96EB32B1EFB2"><enum>(C)</enum><header>Evidence</header><text>The
				decision of the infringer not to present evidence of advice of counsel shall
				have no relevance to a determination of willful infringement under paragraph
				(2).</text>
								</subparagraph></paragraph><paragraph id="ID6a659c9dec4f4ec5ae5c26286d0bc1d4"><enum>(5)</enum><header>Limitation on
				pleading</header><text>Before the date on which a determination has been made
				that the patent in suit is not invalid, is enforceable, and has been infringed
				by the infringer, a patentee may not plead, and a court may not determine, that
				an infringer has willfully infringed the patent. The court’s determination of
				an infringer’s willfulness shall be made without a
				jury.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID60ef01591f904a0c97e308342760982b"><enum>(3)</enum><text>in the third
			 paragraph, by striking <quote>The court</quote> and inserting <quote>(c)
			 <header-in-text level="subsection" style="OLC">Expert
			 testimony.—</header-in-text>The court</quote>.</text>
				</paragraph></subsection><subsection id="ID4bc629869de44d31bed60a717af84338"><enum>(b)</enum><header>Attorney's
			 fees</header><text>Section 285 is amended to read:</text>
				<quoted-block display-inline="no-display-inline" id="id9E5E44C1B32E4540A8E4752C00747DC0" style="OLC">
					<subsection id="ID47a8b0c65b974629a322e2ea81b4bfd4"><enum>(a)</enum><text>The court shall
				award, to a prevailing party, fees and other expenses incurred by that party in
				connection with that proceeding, unless the court finds that the position of
				the nonprevailing party or parties was substantially justified or that special
				circumstances make an award
				unjust.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2fdb6dff771842a8a09d7c6571323f2f"><enum>(c)</enum><header>Unenforceability</header><text>Section
			 282 of title 35, United States Code, is amended—</text>
				<paragraph id="id3DA71C81638144EB8194B69B1D035A7B"><enum>(1)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general</header-in-text>.—</quote> before <quote>A patent shall be presumed
			 valid.</quote>; and</text>
				</paragraph><paragraph id="id14DB3F8A35A64E4CAA96BEA51F934B6F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id77F83823899143E5A49DE1A99B67B202" style="OLC">
						<subsection id="ID72a0c998701e4f1fb9eb0f779fd09847"><enum>(b)</enum><header>Unenforceability</header>
							<paragraph id="ID2a705f3b223044b89ad63e400649e5f8"><enum>(1)</enum><header>Permitted
				grounds for unenforceability</header><text>A court may find that a patent is
				unenforceable only if the patent owner presents clear and convincing evidence
				that, with respect to the patent at issue the patentee, or a patentee’s agent,
				or privy before issuance of the patent—</text>
								<subparagraph id="ID133f2fe7ccb341969781a908988b65b7"><enum>(A)</enum><text>failed to
				disclose material information, or submitted false material information or
				statements; and</text>
								</subparagraph><subparagraph id="ID3a099c2178ff4de5aab92ae9a21d80b2"><enum>(B)</enum><text>did so with an
				intent to mislead or deceive the United States Patent and Trademark
				Office.</text>
								</subparagraph></paragraph><paragraph id="ID0b100c0c270a4ffd9e742e3ca7e6666a"><enum>(2)</enum><header>Limitations on
				unenforceability</header><text>A court shall not find that a patent in
				unenforceable under paragraph (1) if—</text>
								<subparagraph id="IDafee947bd29842dcabccf46720056710"><enum>(A)</enum><text>the patentee,
				agent, or privy had an informed good faith belief that the specific information
				that was not disclosed was not material;</text>
								</subparagraph><subparagraph id="ID8947ddd45d064e7281d1c7fa8aef7f56"><enum>(B)</enum><text>the patentee had
				no actual or constructive knowledge of the misconduct of an agent or privy,
				exercised due care in selecting and supervising such agent or privy, and
				reasonably relied on counsel in obtaining the patent;</text>
								</subparagraph><subparagraph id="IDa00e973196f64c51a649b51dec033ee9"><enum>(C)</enum><text>establishes good
				faith by other evidence a court may find sufficient; or</text>
								</subparagraph><subparagraph id="IDe8d1ad0cad7549b49d98cb9bf41691f6"><enum>(D)</enum><text>the court has not
				determined 1 or more claims in the patent at issue in the action to be
				invalid.</text>
								</subparagraph></paragraph><paragraph id="ID45be0fd4d5bd48b590c11d95c4ae832f"><enum>(3)</enum><header>Limitation on
				pleading</header><text>Before the date on which a determination has been made
				that the patent in suit is not invalid in whole and has been infringed by the
				infringer, a defendant may not plead, and a court may not determine, that the
				patent in question is
				unenforceable.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID12a285f471e84987b96225cd8730567c"><enum>(d)</enum><header>Defense to
			 infringement based on earlier inventor</header><text>Section 273 of title 35,
			 United States Code, is amended—</text>
				<paragraph id="ID0b1e3cfdfa184d629c7c01250d24730c"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="IDf15cf2c8f7534e6ba0c7c917b1a5e196"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="IDfa24fce25fc04ba5ae1684298ba9e11f"><enum>(i)</enum><text>by
			 striking <quote>of a method</quote>; and</text>
						</clause><clause id="ID0c863e58de8b41c59f7c10ddf51018a4"><enum>(ii)</enum><text>by

				post-grant review</header><text display-inline="no-display-inline">Any person
				who is not the patent owner may file a petition for cancellation seeking to
				institute a post-grant review proceeding before the Patent Trial and Appeal
				Board to cancel as unpatentable any claim of a patent on any ground which might
				be raised under section 282(a) (2) and (3) (relating to invalidity of the
				patent or any claim).</text>
							</section><section id="ID6805a122e2d24c7b9552f094eab23fb7"><enum>312.</enum><header>Timing of
				petition</header><text display-inline="no-display-inline">A post-grant review
				proceeding may be instituted only if the petition for cancellation is filed by
				a cancellation petitioner—</text>
								<paragraph id="ID4647b93a74da4b0b9cc90f5da45c4de5"><enum>(1)</enum><text>not later than 12
				months after the date the patent was issued or reissued; or</text>
								</paragraph><paragraph id="IDe95717be0fb942d690a4a689a5bce41a"><enum>(2)</enum><text>who establishes a
				substantial reason to believe that the continued existence of the challenged
				claim causes or is likely to cause the petitioner significant economic
				harm.</text>
								</paragraph></section><section id="ID2f734b7f9c0740869e22b1335a395284"><enum>313.</enum><header>Submission of
				petition</header><text display-inline="no-display-inline">The petition for
				cancellation shall—</text>
								<paragraph id="ID5053c75fbc634c2583d62bb2cfd07df2"><enum>(1)</enum><text>be accompanied by
				payment of the post-grant review fee set forth in subsection 41(a);</text>

				filings</header><text display-inline="no-display-inline">No post-grant review
				proceeding shall be instituted—</text>

				(a) of section 312 if the petition for cancellation identifies the same

								</paragraph></section><section id="ID8cca0adc6e6f44a099131f60f6aa56d8"><enum>315.</enum><header>Conduct of
				post-grant review proceedings</header>
								<subsection id="idD892D96432FC46A2BB185A08399426D5"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director
				shall—</text>
									<paragraph id="ID5685497098c64691beac4357877d89a5"><enum>(1)</enum><text>establish
				regulations, in accordance with section 2(b)(2), to govern post-grant review
				proceedings and their relationship to other proceedings;</text>
									</paragraph><paragraph id="IDe73ccdcf1c4c451995870776e3a76dcf"><enum>(2)</enum><text>prescribe
				regulations setting forth the standards for showings of substantial reason to
				believe and significant economic harm under section 312(b) and sufficient
				grounds in section 317; and</text>
									</paragraph><paragraph id="id7EA3AA1F261840DDB6FED4AD0B4FEE08"><enum>(3)</enum><text>prescribe
				regulations setting forth procedures for discovery of relevant evidence,
				including that such discovery shall be limited to evidence directly related to
				factual assertions advanced by either party in the proceeding, and the
				procedures for obtaining such evidence shall be consistent with the purpose and
				nature of the proceeding.</text>
									</paragraph></subsection><subsection id="id541BC7E9337340DDAEDD08F6F2AC1D0F"><enum>(b)</enum><header>Post-grant
				regulations</header><text>Regulations under subsection (a)(1)—</text>
									<paragraph id="id1F5A2E1447744C90892362A2C7775B5E"><enum>(1)</enum><text>shall be designed
				to result in a final decision on a petition for cancellation within 12 months
				of the institution of the post-grant review proceeding;</text>
									</paragraph><paragraph id="idFA2C58F6A68D4338AD6048715475B3C6"><enum>(2)</enum><text>shall provide for
				discovery upon order of the Board;</text>
									</paragraph><paragraph id="id3969EBBA98564986A4E5C004FC2AED18"><enum>(3)</enum><text>may prescribe
				sanctions for abuse of discovery or abuse of process to the extent authorized
				in United States district courts by rule 11 and rule 37 of the Federal Rules of
				Civil Procedure;</text>
									</paragraph><paragraph id="idBAF51F426971445B86503D044C905784"><enum>(4)</enum><text>may provide for
				protective orders governing the exchange and submission of confidential
				information; and</text>
									</paragraph><paragraph id="idC0A84FA72E634A26B6715E4C7F6EDE09"><enum>(5)</enum><text>shall ensure that
				any information submitted by the patent owner in support of any amendment
				entered under section 318 shall be made available to the public as part of the
				prosecution history of the patent.</text>
									</paragraph></subsection><subsection id="id3ECE521FC5A74459983C0187C801CC8F"><enum>(c)</enum><header>considerations</header><text>In
				prescribing regulations under this section, the Director shall take into
				consideration the effect on the economy, the integrity of the patent system,
				and the efficient administration of the Office.</text>
								</subsection></section><section id="IDb96cbe16dbc2435e875bdd3c29de320d"><enum>316.</enum><header>Proof and
				evidentiary standards</header>
								<subsection id="IDae12cbef38484bb6952307ff21831407"><enum>(a)</enum><header>In
				general</header><text>The presumption of validity set forth in section 282
				shall not apply in a challenge to any patent claim under this chapter.</text>
								</subsection><subsection id="IDcbb5c2787350409496a5a4f93d490b56"><enum>(b)</enum><header>Burden of
				proof</header><text>The party advancing a proposition under this chapter shall
				have the burden of proving that proposition.</text>
								</subsection></section><section id="IDd05604dcc4c749188f2d19b9c52022c5"><enum>317.</enum><header>Showing of
				sufficient grounds; institution of post-grant review proceedings</header><text display-inline="no-display-inline">Within such time as may be prescribed by
				regulation, the cancellation petitioner shall file any information known to it
				that supports its allegation of the unpatentability of any challenged claim.
				The Patent Trial and Appeal Board shall not institute a post-grant review
				proceeding unless it determines that the information presented provides
				sufficient grounds to proceed. If the Patent Trial and Appeal Board does not
				institute a post-grant review proceeding under this section then the
				cancellation petitioner may not assert the same grounds against the same claims
				in any other proceeding within the Office.</text>
							</section><section id="IDc809c6d0e9f7414ebbde1464666ebc72"><enum>318.</enum><header>Amendment of
				the patent</header>
								<subsection id="ID58903c864f1e47aaa0ef22d88bf5997f"><enum>(a)</enum><header>In
				general</header><text>In response to a challenge in a petition for
				cancellation, the patent owner may file 1 motion to amend the patent in 1 or
				more of the following ways:</text>
									<paragraph id="IDc9faee4e29bc441a8a7766b7b976db00"><enum>(1)</enum><text>Cancel any
				challenged patent claim.</text>
									</paragraph><paragraph id="ID91cd3b2bb8f94e4b96d211b5e095a8f9"><enum>(2)</enum><text>For each
				challenged claim, propose a substitute claim that includes all the limitations
				of the challenged claim.</text>
									</paragraph><paragraph id="ID3c4636cbe75549d1956bab3e3f0072cd"><enum>(3)</enum><text>Amend the patent
				drawings or otherwise amend the patent other than the claims.</text>
									</paragraph></subsection><subsection id="ID64f335631685401b9dfc8cb0954015ee"><enum>(b)</enum><header>Additional
				motions</header><text>Additional motions to amend may be permitted only for
				good cause shown.</text>
								</subsection><subsection id="ID92f6602014024b35a510c2edffa1bb3a"><enum>(c)</enum><header>Scope of
				claims</header><text>No amendment shall enlarge the scope of the claims of the
				patent. No amendment shall introduce new matter.</text>
								</subsection></section><section id="ID593c01aa79f14673973c9cafded237a8"><enum>319.</enum><header>Decision of
				the Patent Trial and Appeal Board</header><text display-inline="no-display-inline">If the post-grant review proceeding is
				instituted under section 317 and not dismissed under section 320 or subsection
				(b) of section 323, the Patent Trial and Appeal Board shall issue a final
				decision with respect to patentability of any patent claim challenged and any
				new claim added under this section 318.</text>
							</section><section id="IDbf930746f96540599f2b9c50fc3d4284"><enum>320.</enum><header>Effect of
				decision</header>
								<subsection id="ID465522b223fd4fea941f21a25f25ac0b"><enum>(a)</enum><header>In
				general</header><text>Where a final decision of the Patent Trial and Appeal
				Board is issued under section 319 and the time for appeal has expired or any
				appeal proceeding has terminated, the Director shall issue and publish a
				certificate canceling any claim of the patent finally determined to be
				unpatentable and incorporating in the patent by operation of the certificate
				any new claim determined to be patentable.</text>
								</subsection><subsection id="ID4f39cb10a602493e9ac18dc3920bb1c6"><enum>(b)</enum><header>New
				claims</header><text>Any new claim held to be patentable and incorporated into
				a patent in a post-grant review proceeding shall have the same effect as that
				specified in section 252 for reissued patents on the right of any person who
				made, purchased, offered to sell, or used within the United States, or imported
				into the United States, anything patented by such new claim, or who made
				substantial preparations therefore, prior to issuance of a certificate under
				the provisions of subsection (a) of this section.</text>
								</subsection></section><section id="ID85afccc0606c4799a68d19dd2e84ef54"><enum>321.</enum><header>Relationship
				to other pending proceedings</header><text display-inline="no-display-inline">Notwithstanding subsection 135(a), sections
				251 and 252, and chapter 30, the Director may determine the manner in which any
				reexamination proceeding, reissue proceeding, interference proceeding, or
				post-grant review proceeding that is pending during a post-grant review
				proceeding, may proceed, including providing for stay, transfer, consolidation,
				or termination of such proceedings.</text>
							</section><section id="ID2fb143fbf3284e48a795e0ce54f2a2ce"><enum>322.</enum><header>Effect of
				decisions rendered in civil action on future post-grant review
				proceedings</header><text display-inline="no-display-inline">If a final
				decision has been entered against a party in a civil action arising in whole or
				in part under section 1338 of title 28 establishing that the party has not
				sustained its burden of proving the invalidity of any patent claim—</text>
								<paragraph id="ID03aa1c9be5244a789ba105833f103473"><enum>(1)</enum><text>that party to the
				civil action and the privies of that party may not thereafter request a
				post-grant review proceeding on such patent claim on the basis of any grounds,
				under the provisions of section 311, which that party or the privies of that
				party raised or could have raised in such civil action; and</text>
								</paragraph><paragraph id="ID192834467a6241f9839fbc4f6c29db42"><enum>(2)</enum><text>the Office may
				not thereafter maintain a post-grant review proceeding previously requested by
				that party or the privies of that party on the basis of such grounds.</text>
								</paragraph></section><section id="IDe5a7884fb736482b8238d33d485c083f"><enum>323.</enum><header>Effect of
				final decision on future proceedings</header>
								<subsection id="ID5944ef2932944b1092c9311368189dde"><enum>(a)</enum><header>In
				general</header><text>If a final decision under section 319 is favorable to the
				patentability of any original or new claim of the patent, the cancellation
				petitioner may not thereafter, based on any ground which the cancellation
				petitioner raised during the post-grant review proceeding—</text>
									<paragraph id="ID2ea1518572164f7fbe38738853188a65"><enum>(1)</enum><text>request or pursue
				a reexamination of such claims;</text>
									</paragraph><paragraph id="ID5fea081463ca40adb7af5626dafcc8f9"><enum>(2)</enum><text>request or pursue
				an interference of such claims;</text>
									</paragraph><paragraph id="IDfc7645c4135a494ca1c030e5d0580939"><enum>(3)</enum><text>request or pursue
				a post-grant review proceeding of such claims; or</text>
									</paragraph><paragraph id="ID1a392a75b45f4b89b47a0f849428d4e3"><enum>(4)</enum><text>assert the
				invalidity of any such claims, in any civil action arising in whole or in part
				under section 1338 of title 28.</text>
									</paragraph></subsection><subsection id="ID66e6eeb2f4bb4b7c9ca077c964b5deae"><enum>(b)</enum><header>Extension of
				prohibition</header><text>If the final decision is the result of a petition for
				cancellation under section 312(b), the prohibition under this section shall
				extend to any ground which the cancellation petitioner raised or could have
				raised during the post-grant review
				proceeding.</text>

				requirements</header><text>Any submission under paragraph (1) shall—</text>
							<subparagraph id="IDb181574917d544d08442fc433feb9134"><enum>(A)</enum><text>set forth a
				concise description of the asserted relevance of each submitted
				document;</text>

				such fee as the Director may prescribe; and</text>
							</subparagraph><subparagraph id="IDafd20785a5fa4c309f8e822f1460e05e"><enum>(C)</enum><text>include a
				statement by the submitter affirming that the submission was made in compliance
				with this
				section.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDe6884465a87e4ef8b8eabae20ebc538f"><enum>(d)</enum><header>Effective
			 dates</header><text>Notwithstanding any other provision of law, sections 311
			 through 318 of title 35, United States Code, as amended by this Act, shall
			 apply to any patent that issues from an original application filed on any
			 date.</text>
			</subsection></section><section id="IDcc8eae50584749899a098c4d86fc5bb1"><enum>8.</enum><header>Venue and
			 jurisdiction</header>
			<subsection id="IDf098f31bf7fc433ab7e41793353c6f3e"><enum>(a)</enum><header>Venue for
			 patent cases</header><text>Section 1400 of title 28, United States Code, is
			 amended by striking subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id10724927C1274CA58BE73C8BA05C9103" style="OLC">
					<subsection id="IDc2465bcd0238429398f0e3f4c37ad640"><enum>(b)</enum><text>Any civil action
				arising under any Act of Congress relating to patents, other than an action for
				declaratory judgment or an action seeking review of a decision of the Patent
				Trial and Appeal Board under chapter 13 of title 35, may be brought
				only—</text>
						<paragraph id="ID176074048bad4b14b2a99e121be3dfde"><enum>(1)</enum><text>in the judicial
				district where either party resides; or</text>
						</paragraph><paragraph id="ID80d891314b4b4eadbbd6926b550c11f1"><enum>(2)</enum><text>in the judicial
				district where the defendant has committed acts of infringement and has a
				regular and established place of business.</text>
						</paragraph></subsection><subsection id="ID3957b881d0d747078bd68813ca27dae0"><enum>(c)</enum><text>Notwithstanding
				section 1391(c) of this title, for purposes of venue under subsection (b), a
				corporation shall be deemed to reside in the judicial district in which the
				corporation has its principal place of business or in the State in which the
				corporation is
				incorporated.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8b43a2c8a3d443e08ffaee26955830cb"><enum>(b)</enum><header>Interlocutory
			 appeals</header><text>Subsection (c)(2) of section 1292 of title 28, United
			 States Code, is amended by adding at the end:</text>
				<quoted-block display-inline="no-display-inline" id="id7F06CBAAC9654456A4FAC2175A2BEEAF" style="OLC">
					<paragraph id="ID6f13b28c23f24640bd956ebffb87d7be"><enum>(3)</enum><text>of an appeal from
				an interlocutory order or decree determining construction of claims in a civil
				action for patent infringement under section 271 of title 35.</text>
						<subparagraph id="ID0223d0361917406293b22d74df99d2d6"><enum>(A)</enum><text>Application for
				an appeal hereunder shall be made to the court within 10 days after entry of
				the order or decree.</text>
						</subparagraph><subparagraph id="IDaaa4cc92639d4ebfb31c0e99e66e33b3"><enum>(B)</enum><text>Proceedings in
				the district court shall be stayed during pendency of the
				appeal.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="IDc83ee2b993da45ca89d3de9e5848a26a"><enum>9.</enum><header>Other statutory
			 and conforming amendments</header>
			<subsection id="ID491a9e755efa42c9b2f0e279b039d4ab"><enum>(a)</enum><header>Fees</header><text>Section
			 41(a) of title 35, United States Code is amended—</text>
				<paragraph id="IDb179c59c963b4336a55fa84c3b943b6d"><enum>(1)</enum><text>by redesignating
			 paragraphs (8), (9), (10), (11), (12), (13), (14), and (15) as paragraphs (10),
			 (11), (12), (13), (14), (15), (16), and (17) respectively; and</text>
				</paragraph><paragraph id="ID4ac331438287400d8c9570947f71ba12"><enum>(2)</enum><text>by inserting
			 after paragraph (7) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3B225BCDA4C34495BFB19A5FAD08154A" style="OLC">
						<paragraph id="ID0e43bddab3e047938166f49e566e5f86"><enum>(8)</enum><text>On filing a
				petition for cancellation under subsection (a) of section 312, a fee
				established by the Director to recover ½ the estimated average cost to the
				Office of a post-grant review proceeding.</text>
						</paragraph><paragraph id="ID7e528d7b84a245d9b44c23f9ceaec2dc"><enum>(9)</enum><text>On filing a
				petition for cancellation under subsection (b) of section 312, a fee
				established by the Director to recover the estimated average cost to the Office
				of a post-grant review
				proceeding.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID3c3c57dd3f65477aa357c1f978119b7c"><enum>(b)</enum><header>Definitions</header><text>Section
			 100 (as amended by this Act) is further amended—</text>
				<paragraph id="ID2f3140f525c84fd592618d488123c1d1"><enum>(1)</enum><text>in subsection
			 (e), by striking <quote>or inter partes reexamination under section
			 311</quote>;</text>
				</paragraph><paragraph id="ID18894105327349339b1832c0caa1e13b"><enum>(2)</enum><text>by inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id9DE433E7357A49D38945AA8E26640B53" style="OLC">
						<subsection id="ID692fc82f273d4bc88078ac4f107d81ba"><enum>(k)</enum><text>The term
				<term>cancellation petitioner</term> means the real party in interest
				requesting cancellation of any claim of a patent under chapter 31 of this title
				and the privies of the real party in
				interest.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID066e10064160491394a904047aac90ae"><enum>(c)</enum><header>Patent Trial
			 and Appeal Board</header>
				<paragraph id="ID48ab93bc1bce43bd8895ea7c930ce581"><enum>(1)</enum><text>Section 6 is
			 amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idDEE85B9EF0A9435BB39EC39E25071079" style="USC">
						<section id="IDb3cbe590c173495aad02b01eac6af75d"><enum>6.</enum><header>Patent Trial and
				Appeal Board</header>
							<subsection id="IDaba7a0592d174f99ad9ff73818d1d4b0"><enum>(a)</enum><header>Establishment
				and composition</header><text>There shall be in the Office a Patent Trial and
				Appeal Board. The Director, the Deputy Director, the Commissioner for Patents,
				the Commissioner for Trademarks, and the administrative patent judges shall
				constitute the Patent Trial and Appeal Board. The administrative patent judges
				shall be persons of competent legal knowledge and scientific ability who are
				appointed by the Director. Any reference in any Federal law, Executive order,
				rule, regulation, or delegation of authority, or any document of or pertaining
				to the Board of Patent Appeals and Interferences is deemed to refer to the
				Patent Trial and Appeal Board.</text>
							</subsection><subsection id="ID73804b62659a49729e9b2eab1e729bcf"><enum>(b)</enum><header>Duties</header><text>The
				Patent Trial and Appeal Board shall, on written appeal of an applicant, review
				adverse decisions of examiners upon application for patents; shall, on written
				appeal of a patent owner, review adverse decisions of examiners upon patents in
				reexamination proceedings under chapter 30; shall determine priority and
				patentability of invention in inventor’s rights contests declared under
				subsection 135(a); and shall preside over post-grant review proceedings under
				chapter 31. Each appeal, inventor’s rights contest, and post-grant review
				proceeding shall be heard by at least 3 members of the Patent Trial and Appeal
				Board, who shall be designated by the Director. Only the Patent Trial and
				Appeal Board may grant
				rehearings.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID708083a26ba04acd953a36a9cc0e9bb4"><enum>(2)</enum><text>Title 35, United
			 States Code, is amended by striking <quote>Board of Patent Appeals</quote> each
			 place it appears and inserting in its place <quote>Patent Trial and Appeal
			 Board</quote>.</text>
				</paragraph></subsection><subsection id="ID79cc62e02fc64d8591294319ab837d75"><enum>(d)</enum><header>Authority of
			 panels of administrative patent judges</header><text>Section 6 (as amended by
			 this section) is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD8AD3C1148C14EC1855AB8B3EAF33341" style="OLC">
					<subsection id="ID9c8ec7b28a5248b8a533fab2c79c3ba1"><enum>(c)</enum><header>Additional
				responsibilities of administrative patent judges</header><text>Panels of
				administrative patent judges, once assigned by the Director, shall have the
				responsibilities under chapter 32 in connection with post-grant opposition
				proceedings.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDb707f39ea70046858adfe99c011cca87"><enum>(e)</enum><header>Rulemaking
			 authority</header><text>Section 3(a) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id008D4EA10F6D44B1A2D2E43381FCE91B" style="OLC">
					<paragraph id="idD7617DF56AD1436D82DA65E4D20A325B"><enum>(5)</enum><header>Rulemaking
				authority</header><text>In addition to the authority conferred by other
				provisions of this title, the Director may promulgate such rules, regulations,
				and orders as the Director determines appropriate to carry out the provisions
				of this title or any other law applicable to the United States Patent and
				Trademark Office or that the Director determines necessary to govern the
				operation and organization of the
				Office.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID5c46583a2eba47059f06dedceba8f8a2"><enum>(f)</enum><header>Reexamination</header>
				<paragraph id="ID418a9d5cb52545b780915268a6d1d26d"><enum>(1)</enum><text>Section 304 is
			 amended by striking the final 3 sentences.</text>
				</paragraph><paragraph id="ID100272637801434c9a376114b5567900"><enum>(2)</enum><text>Section 305 is
			 amended by striking, in the first sentence, “and reply” and also striking
			 <quote>have</quote> and inserting <quote>has</quote> in its place.</text>
				</paragraph><paragraph id="IDd237c937bbc54a31be753737bc16f5cb"><enum>(3)</enum><text>Section 315(c) is
			 amended by striking <quote>or could have raised</quote>.</text>
				</paragraph><paragraph id="ID4d8fbfc449fb40ccbaee6c0594f8374f"><enum>(4)</enum><text>Section 4607 of
			 the Intellectual Property and Communications Omnibus Reform Act of 1999, as
			 enacted by section 1000(a)(9) of Public Law 106–113, is repealed.</text>
				</paragraph></subsection><subsection id="IDc64a0ff2d33342cc8311a08b19bf6255"><enum>(g)</enum><header>Appeal to the
			 court of appeals for the Federal circuit</header>
				<paragraph id="ID2a4c28b69bd9438ab9d0afb29934dccd"><enum>(1)</enum><header>In
			 general</header><text>Section 141 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id1D741C9B08E0425DB010370BC3A2D85D" style="USC">
						<section id="ID60f125bcf754458694c755f282c8b466"><enum>141.</enum><header>Appeal to the
				Court of Appeals for the Federal Circuit</header>
							<subsection id="ID937cdd580b3242db92f499c3ed874df3"><enum>(a)</enum><header>Examinations</header><text>An
				applicant dissatisfied with the final decision in an appeal to the Patent Trial
				and Appeal Board under section 134 may appeal the decision to the United States
				Court of Appeals for the Federal Circuit. By filing such an appeal, the
				applicant waives his right to proceed under section 145.</text>
							</subsection><subsection id="ID6d57d9a807604d1f89ecc07cecbb5b52"><enum>(b)</enum><header>Reexaminations</header><text>A
				patent owner in any reexamination proceeding who is dissatisfied with the final
				decision in an appeal to the Patent Trial and Appeal Board under section 134
				may appeal the decision to the United States Court of Appeals for the Federal
				Circuit.</text>
							</subsection><subsection id="ID0ab929e31acd4839b7747154c28705ff"><enum>(c)</enum><header>Inventor’s
				rights contest</header><text>A party to an inventor’s rights contest
				dissatisfied with the final decision of the Patent Trial and Appeal Board on
				the interference may appeal the decision to the United States Court of Appeals
				for the Federal Circuit.</text>
							</subsection><subsection id="ID1d7eacf00d0a443199aabc79da3a70fa"><enum>(d)</enum><header>Post-grant
				review</header><text>A party to a post-grant review proceeding dissatisfied
				with the final decision of the Patent Trial and Appeal Board under section 319
				may appeal the decision only to the United States Court of Appeals for the
				Federal Circuit. Any decision of the Patent Trial and Appeal Board under
				subsection 312(b) or section 317 shall be final and nonappealable. A decision
				by the Board under section 320 not to issue a final decision under subsection
				319 as a result of settlement shall also be final and
				nonappealable.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID3312838d7f8b41e4abc86a84a8f0a6c4"><enum>(2)</enum><header>Certain
			 appeals</header><text>Subsection 1295(a)(4)(A) of title 28, United States Code,
			 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id175FA88DDB3049E58482DE70E7BB3615" style="OLC">
						<subparagraph id="IDad22e5ef6bb84e68ba7158975e5424b5"><enum>(A)</enum><text>the Patent Trial
				and Appeal Board of the United States Patent and Trademark Office with respect
				to patent applications, reexaminations, and inventor’s rights contests, at the
				instance of an applicant for a patent or any party to a patent interference,
				reexamination, or post-grant review proceeding, and any such appeal shall waive
				any right of such applicant or party to proceed under section 145 or 146 of
				title
				35;</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID4953d3d23ac24324b57f2ed5bb664927"><enum>10.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as otherwise
			 provided in this Act, the provisions of this Act shall take effect 12 months
			 after the date of enactment of this Act and shall apply to any patent issued on
			 or after that effective date.</text>
