		<official-title>To amend the Small Business Investment Act of 1958 to
		  improve surety bond guarantees, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Surety Bond Improvement Act of
			 2006</short-title></quote>.</text>
		</section><section id="id509D87233F57446390681E725ECE830A"><enum>2.</enum><header>Surety
			 Bonds</header>
			<subsection id="id17713E5831FB4CA5BC09F8C433329B47"><enum>(a)</enum><header>Rates</header><text>Section
			 411(a) of the Small Business Investment Act of 1958 (15 U.S.C. 694b(a)) is
			 amended—</text>
				<paragraph id="id092979DD1AD54D2CBD1A1EE8631F22B5"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>$2,000,000</quote> and inserting <quote>$3,000,000</quote>;
			 and</text>
				</paragraph><paragraph id="idABBE491D6DAA44FF88D5A12CA4931087"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id541DE37B55FF4863A2D52C8F55CBA573" style="OLC">
						<paragraph id="id8D7816E85B7B458599A48E4D82F75B4B" indent="up1"><enum>(6)</enum><text>The Administrator may authorize a
				surety that issues, monitors, or services bonds under paragraph (3) to use
				rates approved by the insurance commissioner in the State in which such
				contract will be
				performed.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id011F5DBC8B4342EFB65ACB931C05E25F"><enum>(b)</enum><header>Payment of
			 guarantees</header><text>Section 411(b) of the Small Business Investment Act of
			 1958 (15 U.S.C. 694b(b)) is amended—</text>
				<paragraph id="id46DB0D48FA484CF69129B0AFD9F5FFC3"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and
			 adjusting the margins accordingly;</text>
				</paragraph><paragraph id="id106AD1F33C914DA08B350D3F8BB0C6E6"><enum>(2)</enum><text>by striking
			 <quote>Subject to the provisions</quote> and inserting the following:</text>

				</paragraph><paragraph id="idD119177DF6E244C9B3FA8F1A8549E5AE"><enum>(3)</enum><text>by striking
			 <quote>: <italic>Provided, however</italic></quote> and
			 inserting</text>

						<text>.</text><paragraph id="idCC3ADDBF810C4399B57152C5CC8BBEC5"><enum>(2)</enum><header>Conditions</header><text>For
				a guarantee under this
				subsection—</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id43E68FE86B664315B8475CB5A01B4B88"><enum>(4)</enum><text>by striking
			 <quote>In no event shall</quote> and inserting the following:</text>

						<paragraph id="idB8C2A764E5954164AAED73AF0632F99D"><enum>(3)</enum><header>Maximum
				amount</header><text>In no event shall</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id633D416A02C444388201702AEDAD14D7"><enum>(5)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDA4AB1D375F84487A2D0721FA3E4590E" style="OLC">
						<paragraph id="idF164FCDBDA634ED4B91262AA6BBF949B"><enum>(4)</enum><header>Payment of
				guarantees</header><text>The Administrator may not refuse to make payment on a
				guarantee under this subsection based on facts, circumstances, or defects that
				the Administrator reasonably should have identified during the process of
				making the
				guarantee.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id889F0E1B2BDD484EB52A8C93AAA8E42D"><enum>(c)</enum><header>Reports to
			 Congress</header>
				<paragraph id="id24512E0CDCE94C918D360F05A99B0201"><enum>(1)</enum><header>In
			 general</header><text>On the date on which the Administrator of the Small
			 Business Administration provides notice of a proposed change in fees under
			 section 411(h) of the Small Business Investment Act of 1958 (15 U.S.C.
			 694b(h)), the Administrator shall submit to the Committee on Small Business and
			 Entrepreneurship of the Senate and the Committee on Small Business of the House
			 of Representatives, and make publically available, a report regarding the basis
			 for the change in fees.</text>
				</paragraph><paragraph id="id1225359A7B0542F68487A1DD3AA7CBC6"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall include—</text>
					<subparagraph id="idBA9DA958F6604F35BB37C40B2C7E3637"><enum>(A)</enum><text>the contents of
			 any study used by the Administrator in determining whether to change fees under
			 section 411(h) of the Small Business Investment Act of 1958; and</text>
					</subparagraph><subparagraph id="idC2954EB43E1843D199F67EA773EEC6BF"><enum>(B)</enum><text>the total amount
			 of fees received under such section 411(h) and the total cost of the program
			 under part B of title IV of the Small Business Investment Act of 1958 (15
			 U.S.C. 694a et seq.)—</text>
						<clause id="idB073E7605C184F3DAB80CEBF71A327E6"><enum>(i)</enum><text>for
			 the first report submitted under paragraph (1), during the 3-year period ending
			 on the date of the submission of the report; and</text>
						</clause><clause id="id4396ADAB6CFD45DA9C69F14B34883BA9"><enum>(ii)</enum><text>for each
			 subsequent report, during the period beginning on the date of the submission of
			 the prior report submitted under paragraph (1) and ending on the date of
			 submission of such subsequent report.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id1321B3F491C34AFA87E849B265F76843"><enum>(d)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that the program under part
			 B of title IV of the Small Business Investment Act of 1958 (15 U.S.C. 694a et
			 seq.) is not required to be self-funding and, therefore, the program may at
			 times operate at a loss.</text>
