			 <quote><short-title>Flu Protection Act of

			 2005</short-title></quote>.</text>

			<enum>I</enum>

			<header>Flu vaccine awareness campaign</header>

				<header>Awareness campaign and education and outreach efforts</header>

				<text display-inline="no-display-inline">Part P of title III of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-1">42 U.S.C.

			 280g</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

				efforts</header>

						<subsection commented="no" display-inline="no-display-inline" id="id318D5363224D42B4ADC9DAA4A9F9039F">

							<enum>(a)</enum>

							<header>Campaign</header>

							<text display-inline="yes-display-inline">The Secretary, acting

				through the Director of the Centers for Disease Control and Prevention (in this

				section referred to as the <quote>Director</quote>), shall conduct a public

				awareness campaign and education and outreach efforts each year during the time

				period preceding the influenza season on each of the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDAE63FAB435524805B003B6C2E0EAE186">

								<enum>(1)</enum>

								<text display-inline="yes-display-inline">The importance of receiving

				the influenza vaccine.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID385CEABD377E454F82D056FA8BA0668A">

								<enum>(2)</enum>

								<text display-inline="yes-display-inline">Which populations the

				Director recommends to receive the influenza vaccine to prevent health

				complications associated with influenza, including health care workers and

				household contacts.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFA710567628E40FA843FC0CA2E658524">

								<enum>(3)</enum>

								<text display-inline="yes-display-inline">Professional medical

				education of physicians, nurses, pharmacists, and other health care providers

				and such providers’ associated organizations.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF6753D03FE2D4536A40B7F1E7A4BE4A5">

								<enum>(4)</enum>

								<text display-inline="yes-display-inline">Information that emphasizes

				the safety and benefit of recommended vaccines for the public good.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6CE219BE91454E4895DBB20BB744B6BC">

							<enum>(b)</enum>

							<header>Outreach to Medicare recipients</header>

							<paragraph commented="no" display-inline="no-display-inline" id="IDDEFB09C230DD4768A5C25501A9CAD1C5">

								<enum>(1)</enum>

								<header>In general</header>

								<text display-inline="yes-display-inline">The Administrator of the

				Centers for Medicare &amp; Medicaid Services shall, at the earliest possible

				time in the influenza vaccine planning and production process, reach out to

				providers of medicare services, including managed care providers, nursing

				homes, hospitals, and physician offices to urge early and full preordering of

				the influenza vaccine so that production levels can accommodate the needs for

				the influenza vaccine.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD43405FB3D0D4A4B9D41617CE830223A">

								<enum>(2)</enum>

								<header>Rates of immunization among Medicare recipients</header>

								<text display-inline="yes-display-inline">The Director shall work

				with the Administrator of the Centers for Medicare &amp; Medicaid Services to

				publish the rates of influenza immunization among individuals receiving

				assistance under the medicare program under title XVIII of the

				<act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et

				seq.).</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2BFBF245FC8F49F29467E20BD541986D">

							<enum>(c)</enum>

							<header>State and public health adult immunization

				activities</header>

							<text display-inline="yes-display-inline">The Director shall support

				the development of State adult immunization programs that place emphasis on

				improving influenza vaccine delivery to high-risk populations and the general

				population, including the exploration of improving access to the influenza

				vaccine.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID19354206AA0B4236B4973393CFA3EE29">

							<enum>(d)</enum>

							<header>Efficacy of vaccine</header>

							<text display-inline="yes-display-inline">The Director shall work

				with appropriate agencies in conducting a study to assess the efficacy of the

				influenza vaccine.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4F8E572F6703488291A64185D68076C6">

							<enum>(e)</enum>

							<header>Existing modes of communication</header>

							<text display-inline="yes-display-inline">In carrying out the public

				awareness campaign and education and outreach efforts under subsections (a) and

				(b), the Director may use existing websites or structures for

				communication.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID42F7D09CCE7944B09D3B7F914E2BCCE7">

							<enum>(f)</enum>

							<header>Authorization of appropriations</header>

							<text display-inline="yes-display-inline">There are authorized to be

				appropriated to carry out this section $10,000,000 for each of fiscal years

				2005 through 2009.</text>

				<header>Incentives for the construction of vaccine manufacturing

			 facilities</header>

					<header>Vaccine manufacturing facilities investment tax credit</header>

						<header>Allowance of credit</header>

						<text display-inline="yes-display-inline">Section 46 of the Internal

			 Revenue Code of 1986 (relating to amount of investment credit) is amended by

			 striking <quote>and</quote> at the end of paragraph (1), by striking the period

			 at the end of paragraph (2) and inserting <quote>, and</quote>, and by adding

			 at the end the following new paragraph:</text>

			 subchapter A of chapter 1 of such Code (relating to rules for computing

			 investment credit) is amended by inserting after section 48 the following new

			 section:</text>

									<text display-inline="yes-display-inline">For purposes of section 46,

				the vaccine manufacturing facilities investment credit for any taxable year is

				an amount equal to 20 percent of the qualified investment for such taxable

				year.</text>

									<enum>(b)</enum>

									<header>Qualified investment</header>

									<paragraph commented="no" display-inline="no-display-inline" id="id6155240C4935415D85602374838EFCD7">

										<enum>(1)</enum>

										<header>In general</header>

										<text display-inline="yes-display-inline">For purposes of subsection

				(a), the qualified investment for any taxable year is the basis of each vaccine

				manufacturing facilities property placed in service by the taxpayer during such

				taxable year.</text>

									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID81773A73B4694571A7AB373483A28AF1">

										<enum>(2)</enum>

										<header>Vaccine manufacturing facilities property</header>

										<text display-inline="yes-display-inline">For purposes of this

				section, the term <term>vaccine manufacturing facilities property</term> means

				real and tangible personal property—</text>

										<subparagraph commented="no" display-inline="no-display-inline" id="ID40E873CDB65C47F19D95A1D865B33B2A">

											<enum>(A)</enum>

											<clause commented="no" display-inline="yes-display-inline" id="ID6D15FC78D1B84F269570F3E1938BEF30"><enum>(i)</enum>

												<text display-inline="yes-display-inline">the original use of which

				commences with the taxpayer, or</text>

											</clause><clause commented="no" display-inline="no-display-inline" id="IDBD341A6E08E5460B9FE657E1D6BAC367" indent="up1">

												<enum>(ii)</enum>

												<text display-inline="yes-display-inline">which is acquired through

				purchase (as defined by section 179(d)(2)),</text>

											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBF67CABCFB1E4BB0A8DF34F821F9343F">

											<enum>(B)</enum>

											<text display-inline="yes-display-inline">which is depreciable under

				section 167,</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID033DB817BAE64D08A42E7E23909B98D5">

											<enum>(C)</enum>

											<text display-inline="yes-display-inline">which is used for the

				manufacture, distribution, or research and development of vaccines, and</text>

										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDF92B2110F59491E8E370D60B1EB57F3">

											<enum>(D)</enum>

											<text display-inline="yes-display-inline">which is in compliance with

				any standards and regulations which are promulgated by the Food and Drug

				Administration, the Occupational Safety and Health Administration, or the

				Environmental Protection Agency and which are applicable to such

				property.</text>

										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC4CB3070845749A4BD505D14365E74EE">

									<enum>(c)</enum>

									<header>Certain progress expenditure rules made applicable</header>

									<text display-inline="yes-display-inline">Rules similar to rules of

				subsections (c)(4) and (d) of section 46 (as in effect on the day before the

				date of the enactment of the Revenue Reconciliation Act of 1990) shall apply

				for purposes of this subsection.</text>

								</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDC328C3A5D28421C86B045E0CC0C373B">

									<enum>(d)</enum>

									<header>Termination</header>

									<text display-inline="yes-display-inline">This subsection shall not

				apply to any property placed in service after December 31, 2009.</text>

				<text display-inline="no-display-inline">Title XXI of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.

			 300aa–1 et seq.) is amended by adding at the end the following:</text>

								<header>Requests for more doses</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID6EB704A4799C4774B3A886FFB91E5024">

									<enum>(1)</enum>

									<header>In general</header>

									<text display-inline="yes-display-inline">Not later than March 15 of

				each year, the Secretary shall enter into contracts with manufacturers to

				produce such additional doses of the influenza vaccine as determined necessary

				by the Secretary.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91BBC5707C454449A91F62C9C398D73E">

									<enum>(2)</enum>

									<header>Content of contract</header>

									<text display-inline="yes-display-inline">A contract for additional

				doses shall provide that the manufacturer will be compensated by the Secretary

				at an equitable rate negotiated by the Secretary and the manufacturer for any

				doses that—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDCFA11588D8E842199B0EBB2B14FD811C">

										<enum>(A)</enum>

										<text display-inline="yes-display-inline">were not sold by the

				manufacturer through routine market mechanisms at the end of the influenza

				season for that year; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7253051FE774462E94ED04003A619D23">

										<enum>(B)</enum>

										<text display-inline="yes-display-inline">were requested by the

				Secretary to be produced by such manufacturer.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8B3B5395D2124130B6EE0C9B744EA184">

									<enum>(3)</enum>

									<header>When such vaccine purchases should take place</header>

									<text display-inline="yes-display-inline">The Secretary may purchase

				from the manufacturer the doses for which it has contracted at any time after

				which it is determined by the Secretary, in consultation with the manufacturer,

				that the doses will likely not be absorbed by the private market.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBBA7807C69254B44BAF84A90CFB8540E">

								<enum>(b)</enum>

								<header>Contingency plan</header>

								<text display-inline="yes-display-inline">The Secretary shall

				encourage States to develop a contingency plan, in coordination with the

				Department of Health and Human Services, for maximizing influenza immunization

				for high-risk populations in the event of a delay or shortage of the influenza

				vaccine.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC2D9278C84844873AF24458186642B77">

								<enum>(c)</enum>

								<header>Authorization of appropriations</header>

								<text display-inline="yes-display-inline">There are authorized to be

				appropriated to carry out this section such sums as may be necessary.</text>

			<enum>IV</enum>

			<header>Preparing for a pandemic or epidemic</header>

				<header>Preparation for influenza pandemic or epidemic</header>

				<text display-inline="no-display-inline">Subtitle 3 of title XXI of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, as added

			 by section 301, is amended by adding at the end the following:</text>

		  epidemic</header><subsection commented="no" display-inline="yes-display-inline" id="ID784B63639CA64B0BAFE6A5D35FD31DCF"><enum>(a)</enum>

							<header>Establishment of a protocol</header>

							<text display-inline="yes-display-inline">The Secretary, acting

				through the Director of the National Vaccine Program (referred to in this

				section as the <quote>Director of the Program</quote>), shall continue progress

				on the pandemic preparedness plan and, in consultation with the Director of the

				Centers for Disease Control and Prevention, establish a protocol to attempt to

				prevent, prepare for, and respond to an influenza pandemic or epidemic. Such

				protocol shall be updated as determined appropriate by the Director of the

				Program.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE1A8B09CD5BD48C9B606BED4E69B749A">

							<enum>(b)</enum>

							<header>Contents of protocol</header>

							<text display-inline="yes-display-inline">The protocol established

				under subsection (a) shall—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID2FAFB20E3404462E885BB6308F671D2D">

								<enum>(1)</enum>

								<text display-inline="yes-display-inline">improve upon the current

				influenza vaccines and production and dissemination methods; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0D577DFACD544854BD6BF36D94C75594">

								<enum>(2)</enum>

								<text display-inline="yes-display-inline">address—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="idC701D5683BAA41808F7A12741A18FFEE">

									<enum>(A)</enum>

									<text display-inline="yes-display-inline">methods to coordinate

				dissemination of the influenza vaccine to key populations in the event of an

				influenza pandemic or epidemic;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E47F5EC124E4BC591C3528040A279F6">

									<enum>(B)</enum>

									<text display-inline="yes-display-inline">expansion of influenza

				vaccine manufacturing capacity (including making advance arrangements for

				ensuring the availability of raw materials) to respond to the needs of the

				United States during an influenza pandemic or epidemic;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1BB89ADDF75A468E9C5C59785A8724C4">

									<enum>(C)</enum>

									<text display-inline="yes-display-inline">alternative ways to

				manufacture or produce the influenza vaccine;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID328E7D2CC1A246EF8410E47462B5BFCE">

									<enum>(D)</enum>

									<text display-inline="yes-display-inline">alternative methods to

				prevent the spread of, and complications associated with, influenza, including

				antiviral medications;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2027739055E44D3FA2E996CB60FA8AB5">

									<enum>(E)</enum>

									<text display-inline="yes-display-inline">vaccine manufacturing

				capacity, production, and dissemination to improve preparedness for immediate

				pandemic threats, which may include avian influenza;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD814952307E0484AB07F8C0E41E4F50E">

				publicly and privately sold doses of the influenza vaccine to enable the

				Director of the Program to determine, after consultation with manufacturers of

				the influenza vaccine, how much supply is in circulation in the case of an

				influenza pandemic or epidemic; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID54F276521F1542E9BA890C7C5C84CE1F">

									<enum>(G)</enum>

									<text display-inline="yes-display-inline">other issues determined by

				the Director of the Program to be appropriate.</text>

							<enum>(c)</enum>

							<header>Coordination; preparation; prevention</header>

							<text display-inline="yes-display-inline">In establishing the

				protocol under subsection (a), the Director of the Program shall—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID838288E5D1C14852855CF07B0DBF2A88">

								<enum>(1)</enum>

								<text display-inline="yes-display-inline">coordinate with health care

				providers, manufacturers, research institutions, health care organizations, and

				other expert stakeholders;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8D0C82517A784EAAB9788730F6F85E6D">

								<enum>(2)</enum>

								<text display-inline="yes-display-inline">continue building

				international and national surveillance capacity;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04C2C9A360D24BCB9F7DCFD7FD10557E">

								<enum>(3)</enum>

								<text display-inline="yes-display-inline">continue to engage in

				epidemiological studies and research on novel influenza viruses; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCF57EB1E896647AFAA0BDCFD3819AB4C">

								<enum>(4)</enum>

								<text display-inline="yes-display-inline">assist States with

				preparedness activities for a rapid State and local response to an influenza

				pandemic, including exploring methods of making the influenza vaccine more

				accessible to the general population.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEFB84DE4F5B4468F846E362697AAC535">

							<enum>(d)</enum>

							<header>Authorization of appropriations</header>

							<text display-inline="yes-display-inline">There are authorized to be

				appropriated to carry out this section $150,000,000 for each of fiscal years

				2005 through 2009.</text>
