		<official-title>To amend the Rehabilitation Act of 1973 and the Public
		  Health Service Act to set standards for medical diagnostic equipment and to
		  establish a program for promoting good health, disease prevention, and wellness
		  and for the prevention of secondary conditions for individuals with
		  disabilities, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Promoting Wellness for Individuals
			 with Disabilities Act of 2006</short-title></quote>.</text>
		</section><section id="id24A73E525B77447DB9E6954A2C8AD807"><enum>2.</enum><header>Establishment of
			 standards for accessible medical diagnostic equipment</header><text display-inline="no-display-inline">Title V of the Rehabilitation Act of 1973
			 (29 U.S.C. 791 et seq.) is amended by adding at the end of the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id4274A29CA7744EA1A83878DE902B5E8B" style="OLC">
				<section id="id2A2B94C9537148249383B045DBBE223D"><enum>510.</enum><header>Establishment
				of standards for accessible medical diagnostic equipment</header>
					<subsection id="id888AB6836D6C40B9A4D181331F1FB1CE"><enum>(a)</enum><header>Standards</header><text>Not
				later than 9 months after the date of enactment of the
				<short-title>Promoting Wellness for Individuals with
				Disabilities Act of 2006</short-title>, the Architectural and Transportation
				Barriers Compliance Board shall issue (including publishing) standards setting
				forth the minimum technical criteria for medical diagnostic equipment used in
				(or in conjunction with) physician's offices, clinics, emergency rooms,
				hospitals, and other medical settings. The standards shall ensure that such
				equipment is accessible to, and usable by, individuals with disabilities, and
				shall allow independent entry to, use of, and exit from the equipment by such
				individuals to the maximum extent possible.</text>
					</subsection><subsection id="idB96E6A74ACDE4E4BA7F53361C8FF98AA"><enum>(b)</enum><header>Medical
				diagnostic equipment covered</header><text>The standards issued under
				subsection (a) for medical diagnostic equipment shall apply to equipment that
				includes examination tables, examination chairs (including chairs used for eye
				examinations or procedures, and dental examinations or procedures), weight
				scales, mammography equipment, x-ray machines, and other radiological equipment
				commonly used for diagnostic purposes by health professionals.</text>
					</subsection><subsection id="idA8A8FB15004F49E480DE3878F00E0452"><enum>(c)</enum><header>Review and
				amendment</header><text>The Architectural and Transportation Barriers
				Compliance Board shall periodically review and, as appropriate, amend the
				standards.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id04C2C244BD384E4CAC805CFA39B4AB56"><enum>3.</enum><header>Wellness grant
			 program for individuals with disabilities</header><text display-inline="no-display-inline">Part P of title III of the Public Health
			 Service Act (42 U.S.C. 280g et seq.) is amended by adding at the end the
			 following new section:</text>
			<quoted-block display-inline="no-display-inline" id="idB51FF2D21D3148ADA85419AD7D82790E" style="OLC">
				<section id="ID34e356b3f44e40fb97f6ff4c9a3ebefd"><enum>399P.</enum><header>Establishment
				of wellness grant program for individuals with disabilities</header>
					<subsection id="IDa5e860cef7724f149f3f4af017897292"><enum>(a)</enum><header>In
				general</header>
						<paragraph id="id353B6A90B6A4464AA20489627F4BF876"><enum>(1)</enum><header>Individual with
				a disability defined</header><text>For purposes of this section, the term
				<term>individual with a disability</term> has the meaning given the term in
				section 7(20) of the Rehabilitation Act of 1973 (29 U.S.C. 705(20)), for
				purposes of title V of such Act (29 U.S.C. 791 et seq.).</text>
						</paragraph><paragraph id="id7F19D3AFD101419080EEE7D89F127B50"><enum>(2)</enum><header>Wellness Grant
				Program for Individuals with Disabilities</header><text>The Secretary, in
				collaboration with the National Advisory Committee on Wellness for Individuals
				With Disabilities, may make grants on a competitive basis to public and
				nonprofit private entities for the purpose of carrying out programs for
				promoting good health, disease prevention, and wellness for individuals with
				disabilities, and preventing secondary conditions in such individuals.</text>
						</paragraph></subsection><subsection id="ID332efaa05956459fac964912bdefb77f"><enum>(b)</enum><header>Requirement of
				application</header><text>To be eligible to receive a grant under subsection
				(a), a public or nonprofit private entity shall submit to the Secretary an
				application at such time, in such manner, and containing such agreements,
				assurances, and information as the Secretary determines to be necessary to
				carry out this section.</text>
					</subsection><subsection id="ID8d700a773e5342898a47e11f6566cdcd"><enum>(c)</enum><header>Authorized
				activities</header><text>With respect to promoting good health and wellness for
				individuals with disabilities described in subsection (a), activities for which
				the Secretary may make a grant under such subsection include—</text>
						<paragraph id="ID5d6b41b214454784be9e5662acb4488f"><enum>(1)</enum><text>programs or
				activities for smoking cessation, weight control, nutrition, or fitness that
				focus on the unique challenges faced by individuals with disabilities regarding
				these issues;</text>
						</paragraph><paragraph id="ID72a2bfa7f91d4b1998740e82823192e9"><enum>(2)</enum><text>preventive health
				screening programs for individuals with disabilities to reduce the incidence of
				secondary conditions; and</text>
						</paragraph><paragraph id="IDaac65fee7116403aa93e2cdf19ecf69d"><enum>(3)</enum><text>athletic,
				exercise, or sports programs that provide individuals with disabilities
				(including children with disabilities) an opportunity to increase their
				physical activity in a dedicated or adaptive recreational environment.</text>
						</paragraph></subsection><subsection id="ID22a708de6296452b8f9f5c4c8f829ebd"><enum>(d)</enum><header>Priorities</header>
						<paragraph id="id5269513464D346829D7367F7A171BDE8"><enum>(1)</enum><header>Advisory
				Committee</header><text>The Secretary shall establish a National Advisory
				Committee on Wellness for Individuals With Disabilities that shall set
				priorities to carry out this section, review grant proposals, and make
				recommendations for funding, and annually evaluate the progress of the program
				under this section in implementing the priorities.</text>
						</paragraph><paragraph id="id57AEF85993C64E11B4CAACD1BA3E00EF"><enum>(2)</enum><header>Representation</header><text>The
				Advisory Committee established under paragraph (1) shall include representation
				by the Department of Health and Human Services Office on Disability, the United
				States Surgeon General or his designee, the Centers for Disease Control and
				Prevention, private nonprofit organizations that represent the civil rights and
				interests of individuals with disabilities, and individuals with disabilities
				or their family members.</text>
						</paragraph></subsection><subsection id="ID1f15a6b6e31f4b49a92934bb7a861c42"><enum>(e)</enum><header>Dissemination
				of information</header><text>The Secretary shall, in addition to the usual
				methods of the Secretary, disseminate information about the availability of
				grants under the Wellness Grant Program for Individuals with Disabilities in a
				manner designed to reach public entities and nonprofit private organizations
				that are dedicated to providing outreach, advocacy, or independent living
				services to individuals with disabilities.</text>
					</subsection><subsection id="ID1fc857b407004c39858651729e2de48d"><enum>(f)</enum><header>Reports to
				Congress</header><text>The Secretary shall, not later than 180 days after the
				date of the enactment of the <short-title>Promoting
				Wellness for Individuals with Disabilities Act of 2006</short-title>, and
				annually thereafter, submit to Congress a report summarizing activities,
				findings, outcomes, and recommendations resulting from the grant projects
				funded under this section during the preceding fiscal year.</text>
					</subsection><subsection id="IDbb3c65d7019645449f5b3bb38c57431c"><enum>(g)</enum><header>Authorization
				of appropriations</header><text>For the purpose of making grants under this
				section, there are authorized to be appropriated such sums as may be
				necessary.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idAFF8377E1AC148C18E7D540F082DFF19"><enum>4.</enum><header>Improving
			 education and training to provide medical services to individuals with
			 disabilities</header>
			<subsection id="id65D269AC4F68461996B8E4E7837B92B9"><enum>(a)</enum><header>Coordinated
			 program To improve pediatric oral health</header><text>Section 320A(b) of the
			 Public Health Service Act (42 U.S.C. 247d–8(b)) is amended by—</text>
				<paragraph id="id2786A8FA43604E24A710C72452F71694"><enum>(1)</enum><text>striking <quote>,
			 or to increase</quote> and inserting <quote>, to increase</quote>; and</text>
				</paragraph><paragraph id="idA709482804FC4BA2BCBD64F5E50D760C"><enum>(2)</enum><text>striking the
			 period and inserting the following <quote>, or to provide training to improve
			 competency and clinical skills in providing oral health services to, and
			 communicating with, patients with disabilities, including those with
			 intellectual disabilities.</quote>.</text>
				</paragraph></subsection><subsection id="idB34A88F1C6CE4ABB9A611DB6D140F6B7"><enum>(b)</enum><header>Children's
			 hospitals that operate graduate medical education
			 programs</header><text>Section 340E of the Public Health Service Act (42 U.S.C.
			 256e) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id643FD43B33D5498C9BE59127BB3C486D" style="OLC">
					<subsection id="idB8CE9A05F38E4BB2B2E1DD677C4F9967"><enum>(h)</enum><header>Requirement To
				provide training</header><text>To be eligible to receive a payment under this
				section, a children's hospital shall provide training to improve competency and
				clinical skills in providing health care to, and communicating with, patients
				with disabilities, including those with intellectual disabilities, as part of
				any approved graduate medical residency training program provided by the
				hospital.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id9B117C0EBB9140BE88C60C779BFAF9F1"><enum>(c)</enum><header>Centers of
			 excellence</header><text>Section 736(b) of the Public Health Service Act (42
			 U.S.C. 293(b)) is amended—</text>
				<paragraph id="idE7FF888686D742B6A9E6501DE392F6D2"><enum>(1)</enum><text>in paragraph
			 (6)(B), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="idC51D9CFB94E84F0293ACAB944A21EAEC"><enum>(2)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
				</paragraph><paragraph id="id5556E73BD1604A599CC258F172E78A0A"><enum>(3)</enum><text>by inserting
			 after paragraph (6) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD9C82417B153431985F8130F05FE2175" style="OLC">
						<paragraph id="idBED5D1509FB84890B23AA616B78C3DE8"><enum>(7)</enum><text>to carry out a
				program to improve competency and clinical skills of students in providing
				health services to, and communicating with, patients with disabilities,
				including those with intellectual disabilities;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idC415E16991B842A48571D680C8414B65"><enum>(d)</enum><header>Family
			 medicine, general internal medicine, general pediatrics, general dentistry,
			 pediatric dentistry, and physician assistants</header><text>Section 747(a)(6)
			 of the Public Health Service Act (42 U.S.C. 293k(a)(6)) is amended by striking
			 <quote>pediatric dentistry.</quote> and inserting the following: “pediatric
			 dentistry; and</text>
				<quoted-block display-inline="no-display-inline" id="idA24697F9FE6240B0BD95B75D702DF828" style="OLC">
					<paragraph id="idBD6D0DEB6DEF43138AA4CA7AFA1A19FA"><enum>(7)</enum><text>to plan, develop,
				and operate a program for the training of physicians or dentists, or medical or
				dental residents, to improve competency and clinical skills of physicians and
				dentists in providing services to, and communicating with, patients with
				disabilities, including those with intellectual
				disabilities.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idBA5C2862E390450FADB203CD1D3DE511"><enum>(e)</enum><header>Advisory
			 council on graduate medical education</header><text>Section 762(a)(1) of the
			 Public Health Service Act (42 U.S.C. 294o(a)(1)) is amended—</text>
				<paragraph id="idDE09087646D34EF788FE5761E6472BAD"><enum>(1)</enum><text>in subparagraph
			 (E), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="id8B260C5B1BE947B5B9A090F34408BDDF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id35CAA1DA1F07462AB5D1B155F6737087" style="OLC">
						<subparagraph id="id88C1374FA18D4303872321B2F962C107"><enum>(G)</enum><text>appropriate
				efforts to be carried out by hospitals, schools of medicine, schools of
				osteopathic medicine, schools of dentistry, and accrediting bodies with respect
				to changes in undergraduate and graduate medical training to improve competency
				and clinical skills of physicians in providing health care services to, and
				communicating with, patients with disabilities, including those with
				intellectual disabilities;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id37D4FEBDB3A5482688A92471069EFFB6"><enum>(f)</enum><header>Medicare
			 graduate medical education programs</header><text>Section 1886(h) of the Social
			 Security Act (42 U.S.C. 1395ww(h)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idD8D467E143B24BDD8988C31A809B67C2" style="OLC">
					<paragraph id="idE30FCFF4A81C4D8D8FA74752C95410DB"><enum>(8)</enum><header>Requirement to
				provide training</header><text>To be eligible to receive a payment under this
				subsection, a hospital shall provide training to improve competency and
				clinical skills in providing health care to, and communicating with, patients
				with disabilities, including those with intellectual disabilities, as part of
				any approved medical residency training program provided by the
				hospital.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id69943F4BF6654C26A5B7006F4E296B58"><enum>(g)</enum><header>Effective
			 date</header><text>The amendments made by subsections (b), (c), and (f) shall
			 take effect 180 days after the date of enactment of this Act.</text>
